Checklist for Mediation
Preliminary Disclosure Documentsthey should be filled out at the
time of filing with the court. If
not, they are available on the
court’s web site.
Real Estate Documents- If either of
you own a home or other real
property, bring a document that
gives a legal description of the
property (a grant deed from the
recorder’s office or/ and a recent statement from the mortgage company will be sufficient.
Vehicle Registration- Please provide
the vehicle identification number
(VIN), make, model, year and
license number of each vehicle.
Retirement/Pension account information- Be prepared to tell us
who the retirement account is
with, type of account, Administers name and the most current
statement of the account.
Debt information- for any debts.,
bring the name of the creditor,
account number, and balance
owing. Including credit cards,
student loans, vehicle loans, business and personal loans. Any
information regarding stocks or
bonds as well.
Children- all current orders regarding child custody and/or support.
Court Documents: ALL documents
filed related to divorce or legal separation.

advice, represent either disputant, nor
represent the disputants jointly.

Achievable Resolution Agreements
The
role of a mediator is to facilitate a
constructive conversation that will help them
arrive at a mutual agreement, creating the most
fair, just and equitable solution to a problem.
It is not the mediators’ role to pass judgment on
disputants and their conflicts. No agreement is
final until it has a mutual written consent.

THE PROCESS
The
Mediation process creates a
safe and confidential opportunity for
people in conflict to openly
communicate. A mediator helps
each person express their needs
and concerns and develop potential
options to resolve the dispute.
With the help of the mediator,
parties can create an agreement
with which all can be satisfied,
receive closure and set a course for
future cooperation.
When being directed to a mediator
in the Self-help Center, be ready to
fill out an intake questionnaire. This
will be our first appointment and
initial mediation session. Typically,
you will be asked to provide contact information. Orientation will
be conducted to ensure you are
aware of the process, understand
the Agreement to Mediate, and
know what documents will be needed to conclude mediation. In most
cases a Marital Settlement Agreement (MSA) will be created. If the
case involves more complicated issues, an additional appointment may
be necessary.

Center for Peacemaking and Conflict Studies partners with the Fresno County Superior Court to provide mediation services for family law cases.
Parties who are not represented by an attorney and are filing
pleadings under a
court-approved fee
waiver, will
receive
up to two (2) hours of
free mediation services.
This also includes the preparation
of a mediated agreement should one be
reached.
Litigants
without a fee waiver
will pay a sliding scale
fee for services based on the fee schedule
listed below.

No, but
it works more often than not. If you
cannot come to an agreement through
mediation, the mediator helps you
decide what to do next. As more people
learn about mediation, it is more likely to
work. Media
on is conducted in a safe environment. As a rule, and under California Law, everything is said in confidence and cannot be used in a court proceeding. To ensure that we have a meaningful discussion, it is important that the disputants commit to being construc ve and are respec ul to the mediator and each other.
