“Living together” European Photo competition European photography competition A few key points This is an initiative which, as its name implies, aims to pay tribute to “living together” Further information and an "inspiration cloud" are available on the competition website at: bit.ly/Livingtogether. The competition is open to all EU residents over 18 years old in one of the 28 Member States of the European Union. The competition is open to amateur photographers and, for the first time, to professionals. Competition closing date: 15 July 2015 at 11.59 p.m. (Brussels time) No more than one photo per participant may be entered. There will be three jury prizes and one awarded by the public. The public vote will take place between 1 and 15 October. The results will be announced between 16 and 31 October 2015. The 3 winners of the jury prizes will travel to Brussels in the week of the award ceremony, which is scheduled to take place on 3 December 2015. #LivingTogether PES group - Committee of the Regions Rue Belliard 101, 1040 Brussels +32 (0) 2 282 22 23 [email protected] EN Rules Conditions for participation 1.1 To be eligible to enter the competition, you must be resident in one of the 28 Member States of the European Union and over 18 years old. 1.2 By entering the competition you accept these competition rules. 1.3 Photographs must be submitted no later than 11.59 p.m. Brussels time (UTC+1) on 15 July 2015, to the Committee of the Regions' Party of European Socialists (PES) Group website at the following address: www.pes.cor.europa.eu 1.4 No more than one photograph per participant may be submitted. Any participant submitting more than one photograph for the competition will be automatically disqualified. 1.5 The competition is open to both amateur and professional photographers. 1.6 Staff working at the Committee of the Regions of the European Union are not permitted to take part in this competition. 1.7 By entering the competition, you authorise the PES Group of the Committee of Regions to receive your registration data. Any personal information shall be used by the PES Group in accordance with its privacy policy – see Regulation (EC) 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data. - The person in charge of processing these data is Samy Benomran, of the PES Group secretariat, Committee of the Regions, 101 rue Belliard, B-1040 Brussels. Should you require any information about the processing of your personal data in this context, you may write to ([email protected]). - You may also email the Committee of the Regions' data protection officer ([email protected]) or contact the European Data Protection Supervisor ((http://www.edps.europa.eu). - Participants agree that personal data, including name, age, home address, phone number and email address, may be collected, processed, stored and otherwise used for the purposes of conducting and managing the competition. - Data shall be kept for up to one year. - Entrants have the right to access, rectify or erase any personal data held by the PES Group, by sending an email to: [email protected]. The deadline for applications to access, rectify or erase data is 10 working days. Entering the competition 2.1 To enter the competition, you must upload a photograph via the following website: www.pes.cor.europa.eu (hereinafter "the Website") and complete the online application form, following the on-screen instructions carefully. The direct link to the website of the photo competition is: bit.ly/Livingtogether. 2.2 Please point out any technical problem in the uploading process by email to: [email protected]. 2.3 The topic of the competition is "Living together". Your photograph must reflect this theme. To help participants, more detailed information and an "inspiration cloud" are available, in English, on the competition website at: bit.ly/Livingtogether. Selection of prize-winners and prizes 3.1 Entries will be assessed by the jury selected by the PES Group, comprising both professional photographers and PES Group members, in the first half of October 2015. 3.2 Once the competition is closed, and before the jury meets, the PES Group secretariat will organise a shortlisting procedure to assess whether entries reflect the theme of the competition and comply with these rules. 3.3 Three winners will be selected and announced by 31 October 2015. Winners will be notified by email and telephone. Should a winner not respond within two weeks of being sent the first email, his/her prize will be awarded to another candidate. 3.4 In addition to the three winners selected by the jury, a public vote will be held on the Committee of the Regions PES Group Facebook page (http://www.facebook.com/pesgroupcor) between 1 and 15 October 2015, to select the winner of the public prize. 3.5 Any fraud or attempted fraud, for example purchasing Facebook "likes", will automatically exclude the participant concerned from the public vote. However, they will still be able to compete for the prize awarded by the jury. 3.6 The prize-winners will be selected and the prizes awarded as follows: 3.6.1 First prize: a three-day trip to Brussels for two persons (staying at a hotel chosen by the Committee of the Regions) to attend the awards ceremony, which will take place at the Committee building at 12.30 p.m. on 3 December 2015, together with photographic/electronic equipment worth up to EUR 2 000. 3.6.2 Second prize: a three-day trip to Brussels for two persons (staying at a hotel chosen by the Committee of the Regions) to attend the awards ceremony, which will take place at the Committee building at 12.30 p.m. on 3 December 2015, together with photographic/electronic equipment worth up to EUR 1 500. 3.6.3 Third prize: a three-day trip to Brussels for two persons (staying at a hotel chosen by the Committee of the Regions) to attend the awards ceremony, which will take place at the Committee building at 12.30 p.m. on 3 December photographic/electronic equipment worth up to EUR 1 000. 3.6.4 2015, together with Public's choice prize: photographic/electronic equipment worth up to EUR 500. 3.7 There are no cash alternatives available for prize-winners. 3.8 The photographic material may only be chosen from an exhaustive list provided by the PES Group's selected supplier. 3.9 The trip to Brussels will include: 3.9.1 A return journey to Brussels from the travellers' place of residence, which must be a city in the European Union. 3.9.2 A 72-hour “discover Brussels” pass (https://www.stib-mivb.be/DiscoverBrussels.html), permitting an unlimited number of journeys on all forms of public transport (tram, bus, metro) in Brussels, including to and from Brussels airport. Each traveller will receive a pass. Your passes will be sent to you by post before you travel to Brussels. 3.9.3 3.10 Two nights in a double or single room (including breakfast) at a hotel in Brussels chosen by the Committee of the Regions. The decision of the PES Group is final and not subject to appeal. Photographs entered in the competition 4.1 The PES Group reserves the right, at its sole discretion, to disqualify and withdraw any photograph that does not comply with the following requirements, even after the photograph has been uploaded to the Website. You are understood to declare, in respect of the photograph submitted by you, that: 4.1.1 You are the sole owner and author of the photograph. You declare that you are the sole owner of all copyright for the photograph entered in the competition and that the photograph is not subject to third-party rights. You authorise the PES Group and any EU institution to publish the photograph on its website and on its social networks (Facebook, Twitter, Flickr, Instagram, Pinterest and YouTube, etc.) in the context of this competition. 4.1.2 The photograph does not contain any unauthorised, threatening, hatred-inciting, false, misleading, abusive, harassing, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content. 4.1.3 The photograph does not contain any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. 4.1.4 The photograph does not infringe upon the copyright, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity, nor does it contain: 4.1.4.1 trademarks owned by third parties; 4.1.4.2 copyrighted material owned by third parties; 4.1.4.3 names, likenesses or other characteristics identifying celebrities or other public figures, living or dead; You certify that you have obtained the consent of any persons represented in the photograph for use of the photograph in the competition. Furthermore, if you are one of the winners, you declare that you have obtained the consent of any persons represented in the photograph for use of the photograph by the Committee of the Regions or other European institutions for all purposes intended to promote EU activities; 4.1.4.4 images for which you have purchased or otherwise secured the rights from an image bank. 4.2 You agree to fully indemnify the PES Group in respect of all royalties, fees and any other monies owing to any person as a result of your breaching any of the above rules. 4.3 You confirm that each person depicted in the photograph has granted permission to be portrayed as shown and that they have been informed of the institution and the political group organising the contest. Any costumes, props or other materials used must be rented or borrowed with the permission of their owner, and all other relevant permissions, including acceptance of the conditions set out in paragraph 5.2 of these rules, must have been obtained. 4.4 Retouched or reworked photographs or photo montages may be entered in the competition. Participants are reminded, however, that this is a photographic competition. In case of doubt about the nature of the photographic works entered in the competition, the PES group may ask the participant to submit files and/or metadata proving that the work is, in fact, a photograph. Use of photographs by the PES Group 5.1 The PES Group acknowledges that participants retain full ownership of the copyright for their photograph. 5.2 You authorise the PES Group and any EU institution to use the photograph entered in the competition in any event they may organise. By entering this competition, you give the PES Group and all EU institutions the right to use your photograph in their activities and in publications such as the their websites, any kind of printed publication, posters, advertising, billboards and in an exhibition open to the public. 5.3 By entering the competition, you transfer the right of using the photograph you have entered in the competition to the European Union, along with the requirement to mention the photographer's name. 5.4 Any photograph used by the PES Group or any EU institution shall bear the author's name. Any failure to provide this reference shall not be deemed to be a breach of the agreement, as long as the PES Group makes a reasonable effort to rectify the omission within 10 working days of the date that notification is given of the omission. 5.5 You acknowledge that it is your responsibility to protect any photograph against image misuse by any third party, for example by inserting a watermark. The PES Group and its event partners assume no responsibility and are not liable for any image misuse. 5.6 Winners' names will be published on the Website and in PES Group publications. 6. The PES Group assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or used in the competition; moreover, the PES Group assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, or other problems or technical malfunctions connected with the competition. The PES Group assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, disruption of the communication link, or theft or destruction of, unauthorised access to, or tampering with entries. The PES Group is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, computer equipment, software, non-delivery of any email addressed to the PES Group on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to your or any other person's computer related to or resulting from participation or downloading any materials in the competition. If for any reason, including infection by computer viruses, bugs, tampering, unauthorised intervention, fraud or technical failures, a contestant’s photograph cannot be viewed or is not able to compete as planned, the PES Group assumes no responsibility. 7. In no event shall the PES Group, its members, event partners, staff, directors or employees, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any entrant’s access to and use of the website and participation in the competition. Without limiting the general application of the above, everything on the website is provided "as is", without any kind of guarantee, either explicit or implicit, including, but not limited to, the implicit guarantees of merchantability, fitness for purpose or use or non-infringement. 8. You agree to take part in publicity for the competition and to the use of your name and likeness for the purposes of advertising, promotion and publicity without additional compensation. Technical requirements 9.1 Photos should be uploaded to the PES Group website in JPEG format - up to a maximum of 1200 pixels on the long edge. 9.2 Entrants must keep a copy of their images in the original format. All entrants must be able to supply the images in high resolution. Original images must be of a high enough resolution to be printable in photo quality in 50 x 70cm format. _______________
