2. Section 357.08(b)(2) which states that the rear yard must be equal to 15% of the lot depth;
41’-9” average is required and a rear yard of 16’-4” is provided.
3. Section 353.01 and 353.02 which states that a maximum height of a building in a “2” Height
District is 60 feet and 68 feet are proposed. (revised Notice of Nonconformance issued March

determined by the Board of Zoning Appeals to have adequate yard spaces and other

designed, and meet a community need without adversely affecting the neighborhood.
2. Section 349.04(d) which states that parking is required at the rate of one for each staff
member, plus one for each six beds. In this case, 5 parking spaces are required and no legal
parking area is provided.
3. Section 357.13 which states that parking in front of a building is not a permitted front yard
encroachment. (Filed December 9, 2014-no testimony)
