The "authorized account holder" is the natural person assigned an email address by an Internet access
provider, online service provider or other organization responsible for assigning email addresses for the
domain associated with the submitted address. Each entrant may be required to show proof of being the
authorized account holder.
6. Winner Determination: Winners will be determined according to the process set forth below.
a. Submission Phases: At the end of each Submission Phase, a panel of qualified judges
determined by Sponsor in its sole discretion will select two (2) entrants per Submission Phase
with the highest-scoring Submission (the "Submission Phase Finalists") from among all eligible
Submissions received for that Submission Phase based on the following criteria (“Judging
Criteria”):




Creativity/Originality (20%);
Personality/Energy (20%);
Quality of Submission (20%); and
Fit to Contest Theme (40%)
In the event of a tie in any Submission Phase, the entrant from among those tied whose Submission
received the highest score for Fit to Contest Theme, as determined by the qualified judges, in their
sole discretion, will be deemed the applicable Submission Phase Finalist. Sponsor reserves the
right to select fewer than the stated number of Submission Phase Finalists for any Submission
Phase, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified
Submissions for that Submission Phase.
b. Judging Phase: During the Judging Phase, a panel of qualified judges determined by Sponsor
in its sole discretion will select four (4) additional entrants with the highest-scoring Submissions
from all remaining Submissions from all Submission Phases combined (excluding the Submission
Phase Finalists) (the "Judging Phase Finalists") based on the following criteria (“Judging Criteria”):




Creativity/Originality (20%);
Personality/Energy (20%)
Quality of Submission (20%); and
Fit to Contest Theme (40%)
In the event of a tie, the entrant(s) from among those tied whose Submission(s) received the highest
score(s) for Fit to Contest Theme, as determined by the qualified judges, in their sole discretion,
will be deemed the applicable Judging Phase Finalist(s). For clarity, Submission Phase Finalists
are not eligible to also be Judging Phase Finalists. Sponsor reserves the right to select fewer than
four (4) Judging Phase Finalists, if, in its sole discretion, it does not receive a sufficient number of
eligible and qualified Submissions.
c. Voting Phase: During the Voting Phase, the Submission Phase Finalists' and Judging Phase
Finalists' (collectively the "Finalists") Submissions will be posted in an online gallery for public voting
at https://www.facebook.com/bandaid or the Website. Persons who meet the eligibility criteria as
set forth in Section 1 will be invited to vote for the Submission they believe is best. Limit: Each
person may vote one (1) time per day during the Voting Phase. Multiple votes received from any
person or email address in excess of the stated number will be void. Any attempt by any Finalist or
voter to obtain more than the stated number of votes by any fraudulent or inappropriate means,
including without limitation, trading votes or offering prizes or other inducements to members of the
public as determined by Sponsor in its sole discretion, by using any automated program, by using
multiple/different email addresses, identities, registrations and logins, or any other methods, will
void those votes for the Finalist's Submission and entrant may be disqualified as determined by
Sponsor in its sole discretion. Subject to the Finalists' compliance with these Official Rules, the
Finalist whose Submission receives the highest number of valid votes during the Voting Phase, as
determined by Sponsor in its sole discretion, will be deemed the potential Grand Prize winner. The
Finalist whose Submission receives the second highest number of valid votes during the Voting
Phase, as determined by the Sponsor in its sole discretion, will be deemed First Prize winner. The
Finalist whose Submission receives the third highest number of valid votes during the Voting Phase,
as determined by Sponsor in its sole discretion, will be deemed the Second Prize winner. In the
event of a tie, the Finalist from among those tied whose Submission received the highest score for
Fit to Contest Theme in the Judging Phase or the Submission Phase (as applicable), as determined
by the qualified judges in their sole discretion, will be deemed the potential winner for the prize at
issue. Sponsor reserves the right, in its sole discretion, to select an alternate Grand Prize, First
Prize or Second Prize winner as deemed fair and appropriate by Sponsor should the voting appear
to have been tampered with or manipulated in any way, in Sponsor’s sole and absolute discretion.
Decisions of the Sponsor and judges are final and binding.
7. Winner Requirements: Potential winners will be notified by email, mail or phone on or around June 28,
2015. Except where prohibited, the potential Grand Prize and First Prize winner will be required to sign
and return a Declaration of Compliance, Liability and Publicity Release, which must be received by
Administrator within seven (7) days of the date notice or attempted notice is sent, in order to claim his/her
prize. Potential winners will also be required to provide upon request releases from each person featured
in their Submission, which releases will include (without limitation) the provisions noted below regarding the
Guild Agreements (as hereinafter defined). If a potential winner cannot be contacted, fails to execute and
return the Declaration of Compliance, Liability and Publicity Release or provide any other requested
information within the required time period (if applicable), does not comply with these Official Rules, or
prize is returned as undeliverable, potential winner will be disqualified and forfeits the prize. If a potential
winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole
discretion. Only three (3) alternate winners may be determined, after which the applicable prize will remain
unawarded. Acceptance of any prize shall constitute and signify each winner’s agreement and consent
that Sponsor and its designees may use the winner’s name, city, state, likeness, Submission (including the
video) and/or prize information in connection with the Contest for promotional, advertising or other purposes,
worldwide, in perpetuity, in any and all media now known or hereafter devised, including the Internet, in any
manner, without limitation and without further payment, notification, permission or other consideration,
except where prohibited by law, provided that if it is ever determined that the Submission in which an entrant
appears fall within the jurisdiction of any union or guild agreement ("Guild Agreement"), then: (a) the
entrants (and any others featured in the Submission) agree to accept the minimum scale payments payable
pursuant to such Guild Agreement (if any, it being agreed that none will be payable if any coverage waiver
applies), (b) Sponsor will have the option to secure unlimited and extended editing rights on the Internet
and in new media with respect to the Submission by paying $100 to the applicable entrant (and any others
featured in the Submission), and (c) upon Sponsor’s request, entrants will execute any standard union/guild
performer agreement. Without limiting the generality of these Official Rules, each winner shall irrevocably
grant, transfer, convey and assign to Sponsor the entirety of the rights in and to the Submission and all
renewals and extensions of copyright, and the right to secure copyright registrations thereto in perpetuity
including, without limitation, the rights to use the Submission for any and all purposes in any and all media
whether now known or hereafter developed, on a worldwide basis, in perpetuity. Each winner accepts and
acknowledges that Sponsor shall not be obligated to use the Submission and that Sponsor in its sole
discretion shall have the right to refrain from using the Submission. Sponsor shall not incur any liability
whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Each
winner will indemnify Released Parties (as defined in Section 10, below) and any licensee of Sponsor
against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal
expenses) arising out of any breach of these terms. Prizes will be fulfilled 8 – 10 weeks after end of Contest.
