The Difficulties of Advocacy in the New (Work) World
Join two experienced advocates, Bill Johnson (Employer Advocate) and Tim Williams (Union Advocate), as they
navigate you through the new non-traditional complexities today’s advocates face. Topic discussion will focus on the
internal and external obstacles facing management and labor advocates in the modern workforce. The ever evolving
non-traditional workforce creates numerous challenges for representatives. Learn how they deal with complex issues
like remote work locations, internal politics, the committee person “gone rogue”, changing attitudes towards labor,
and much more. Listen to the panelists as they provide candid and thought provoking discussions moderated by
Federal Mediator John Gray. Find out what it means to be an advocate in this new world and learn the latest tips and
tools to help you succeed no matter the issue.
Panel Speakers
Bill Johnson, Senior Director, Labor Relations & Policy Development, University of Cincinnati
Timothy Williams, National Broadcast Representative, SAG-AFTRA Ohio-Pittsburgh
Moderator: John Gray, Commissioner, FMCS
Social Media in Arbitration: Employee Rights, Responsibilities, and Repercussions
This update on social media will focus on employee discipline cases in arbitration, looking at an employee’s right to
engage in social media activity, as well as, an employer’s right to enact rules to limit such activity. For example, what
kinds of policies can an employer implement to limit an employee’s speech on social media sites? If employees
violate those policies, can they be subject to discipline, or even discharge? Does it matter if the activity involves “on or
off-duty” conduct? Do the employee’s privacy settings matter? In addition, the speakers will discuss how employers
may use social media postings as evidence in arbitration, even when those postings are not the subject matter of the
grievance or arbitration.
Panel Speakers
Justin Flamm, Partner, Taft Stettinius & Hollister LLP
Bill Heekin, Founder, Arbitration and Mediation Service
Pamela Newport, General Counsel, UFCW Local 75
AFTERNOON SESSIONS
......................................................................... BREAK.......................................................................
For many years, wage and hour disputes have been one of the most heavily litigated areas of employment law
presenting challenges and risks for both employers and employees alike. This workshop will give an overview to
Wage and Hour laws and present legal and policy considerations arising out of Wage and Hour issues. This will
include benefits that may be construed as wages, as well as efforts by state and local governments to strengthen
enforcement of Wage and Hour requirements through the passage of “wage theft” laws.
Panel Speakers
Clement Tsao, Associate Attorney, Cook & Logothetis, LLC
Frank Warnock, Assistant City Manager/City Solicitor, City of Covington, KY
Jeff Wiley, Employment Standards Consultant, KY Labor Cabinet
The Affordable Care Act (ACA) and you at the Bargaining Table
This workshop will discuss the effects of the Affordable Care Act (ACA) on Taft-Hartley, Public and Private Groups being
Self-Funded vs. Fully Insured. In 2014, ACA’s “no cap” legislation marked the beginning of many changes. With 2018
approaching, self-funded groups have to look for creative ways to avoid the “Cadillac Tax”. Stacey Hofert will discuss
how these newly implemented changes have and will affect your Health Care Plans. She will discuss ways to be
prepared for upcoming changes as well as creative savings options to mitigate the overall cost of these changes.
Fully insured groups have faced much stricter regulations because of the ACA. Many groups are considering moving
their fully insured health plans to a self-insured platform for greater flexibility. We will discuss the ways plans have
made the conversion from fully insured to self-insured as well as “step” plans to integrate a partially funded health
plan. As chief management and labor spokespersons, Bill Deters and Kevin Garvey will give us their prospective from
the bargaining table dealing with the ramifications of the ACA. These changes will affect the overall cost of health
care thus presenting an interesting challenge from both sides. Strategic collaboration techniques will be presented
from both sides of table to control overall costs of health care while still providing best in class benefits to their
members or employees.
Panel Speakers
Bill Deters, Attorney, Ennis Britton Co., L.P.A.
Kevin Garvey, Executive Vice President, UFCW Local 75
Stacey Hofert, Vice President of Labor Relations, Aegis Cost Containment
Earl Leonhardt, Mediator, ECL Mediation
Current Ethical Issues in the Workplace
This session will examine current ethical issues in the workplace of interest to employees and employers. Feedback
and participation from the audience will be encouraged. CLE Ethics Credits are available.
Panel Speakers
Jennifer J. Clemons, J.D., Benefits Compliance, Macy’s
Teressa L. Elliott, J.D., Associate Professor of Business Law, NKU
NLRB/SERB Legal Developments
As the National Labor Relations Board continues to issue significant decisions, in some cases overturning precedent
or returning to former standards, and the Ohio State Employment Relations Board watches these trends and
develops its own case law, it is important to stay up-to-date on all the developments in these two agencies. Join
SERB General Counsel Don Collins and NLRB Regional Director Garey Lindsay, along with labor and management
attorneys Julie Ford and Kathleen Carnes, to discuss current developments and trends at the NLRB and SERB.
These significant trends include the new NLRB election rules, the Purple Communications decision on the use of
employer e-mail systems, the NLRB’s new standard on deferral to arbitration and union officers’ access to Ohio
public employer’s property and facilities.
Panel Speakers
Kathleen A. Carnes, Attorney, Lecturer of Business Law, NKU and Associate, Dinsmore & Shohl
Donald Collins, General Counsel/Assistant Executive Director, SERB
Julie C. Ford, Attorney, Doll, Jansen & Ford
Garey Lindsay, Regional Director, NLRB
Same Sex Issues and Implications
This workshop will discuss same sex issues and implications in the employee benefits and labor and employment
context. The workshop will discuss legal updates, guidance from the IRS and the Department of Labor. It will also
highlight several questions regarding employee benefits and employment law that remain open for same-sex
couples. Additionally, the workshop will also discuss best practices for employers of these unresolved questions.
Panel Speakers
Jennie Arnold, Attorney, Cook & Logothetis, LLC
Claire Bushorn, Attorney, Cook & Logothetis, LLC
Allison Kendall, Attorney, Thompson Hine
