Vi viser til ditt brev av 26. juni.
Sanderød vel fastholder sitt standpunkt, og en minnelig løsning er – som tidligere nevnt – ikke aktuelt.
Det nevnes i deres brev av 24. juni at det foreligger dokumentasjon på at det er inngått en avtale om
fortøyningsplassene.
Dersom det ikke snarlig dokumenteres at deres klienter har en evigvarende rett til fortrengsel for grunneiers rett til å
bruke eiendommen anses saken som avsluttet fra denne side.
Ytterligere henvendelse uten rettslig og faktisk substans vil ikke bli besvart.

Det er ikke aktuelt for Sanderød vel å forhandle om noen minnelig løsning. Velets standpunkt er at
det ikke er inngått noen avtale, og de har fortsatt til gode å se noen form for dokumentasjon på det
motsatte.
Det faktum at velet har tålt at fortøyningsplassene har blitt værende i disse årene kan ikke tolkes
som et samtykke til at dine klienter har ervervet en evigvarende rettighet.

Viser til sak nr. 7 som var oppe i Generalforsamlingen 2. mai, med påfølgende vedtakssak nr. 8.1 ad.
kompensasjon/erstatning for båtplasser på den gamle steinbrygga. Saken var meldt inn av medlemmene Jensen,
Burum og Glomsrød.
Generalforsamlingen avviste kravet med et klart flertall (mot 5 stemmer).
Sanderød velforening v/undertegnede mottok sist uke et krav fra de samme medlemmene, fremsatt av advokat
Henning Borge i advokatfirmaet Eckhoff, Fosmark & Co DA. Kravet er i all hovedsak identisk med det som ble
behandlet i Generalforsamlingen.
Styret har engasjert Wikborg, Rein & Co. Advokatfirma DA, for bistand i saken.
Vi vil holde dere løpende orientert.
