La reunión comienza a las 15.10 horas del martes 4 de noviembre de 2008, bajo la presidencia
de Miroslav Ouzký, presidente.
1.
Aprobación del orden del día
Se aprueba el orden del día en el orden que se muestra en este acta, con los siguientes
cambios:
- Se decide que el antiguo punto 13 «Productos cosméticos (versión refundida)» se
examine en la reunión del 2 de diciembre;
- el punto 17 «Intercambio de puntos de vista con Catherine Geslain- Lanéelle
(Directora ejecutiva de la Autoridad Europea de Seguridad Alimentaria) se celebrará a
puerta cerrada.
John Bowis, Dagmar Roth-Behrendt y Caroline Jackson solicitan confirmación de la
fecha y los puntos del orden del día de la próxima reunión.
2.
Comunicaciones del presidente
- Presidencia de la reunión:
Debido a los diálogos tripartitos sobre cambio climático a los que el Presidente debe
asistir, la reunión es presidida parcialmente el 4 de noviembre por la tarde por Satu
Hassi, Segundo Vicepresidente, y el 6 de noviembre por la mañana por Magor Imre
Csibi, Tercer Vicepresidente.
- Situación de la interpretación: todas las lenguas oficiales están disponibles.
- Filmación de partes de la reunión:
Un equipo de TV sueco sigue a Jens Holm la mañana del 5 de noviembre en compañía
de una persona joven , en el marco de un programa sobre inereses de los niños en
relación con el trabajo del Parlamento Europeo.
- Modificación en el personal de secretaría:
Dominique Vigneron ha sido nombrado asistente de la Comisión de Medio Ambiente

The coordinators
- noted that the mandate of 4 out of 35(1) members of the EMEA Management
Board had expired on 30 September 2008 and that, therefore, 4 new members
needed to be appointed for a term of office of three years;

heard Ms Roth-Behrendt, the committee's contact person for relations with the
EMEA;
-
held an exchange of views;
-
decided to recommend that the following candidates be appointed to the
Management Board of the EMEA pursuant to Article 65(1)2 of Regulation
726/2004:

Lisette Tiddens-Engwirda, Standing Committee of European Doctors.
 Veterinarians' representative (one member):
Henk Vaarkamp, Federation of Veterinarians of Europe

decided that the candidates for patients' representatives be ranked in the order
given above and agreed that Jan Geissler, a candidate put forward by the
European Cancer Patient Coalition, would be a useful contact for the Agency in
those areas of work where patients' organisations are involved, and that he might
be a potential candidate for the Management Board in the future;

instructed the chairman to inform the President of the European Parliament of
the above conclusions and of the additional remarks made at the evaluation
meeting, so as to enable the European Parliament to "submit its views for
consideration by the Council". [Note: The Conference of Presidents is the
authority responsible for matters relating to relations with the other institutions,
see Rule 24(3). In view of the urgency and to allow for sufficient time for the
ensuing formal appointing process, the Conference of Presidents should take its
decision as soon as possible, ideally already on 13 November 2008. The President
of the European Parliament should then inform the Council of Parliament's
position before 16 December 2008 (the Commission decision was officially
received by Parliament on 16 September 2008).]

Decision:
The coordinators decided that the committee shall table an Oral Question in plenary,
accompanied by a resolution (Rule 108), subject to the formal referral of the
Commission document to ENVI.
The Oral Questions will be presented by the committee chair. The draft resolution will
be drawn up by one Member to be nominated by the EPP-ED Group and one Member
to be nominated by the ALDE Group.

Decision:
The coordinators decided to deal with the matter by means of an Oral Question in

Decision:
The coordinators decided that (unless the Council should decide to consult the European
Parliament formally) the committee shall table an Oral Question in plenary,
accompanied by a resolution (Rule 108).

C. DECISIONS ON OTHER ISSUES
C.1. Associated committee procedure on the directive on application of patients' rights in
cross-border healthcare
The papers for the meeting include a letter from Ms McCarthy and Mr Andersson on
associated committee procedure on the directive on application of patients' rights in crossborder healthcare
Decision:
The Coordinators noted that the ENVI rapporteur on the proposal, John Bowis, had
already started to cooperate closely with the draftsmen from EMPL and IMCO, that he
attended meetings of those two committees when the point was discussed and that the
ENVI timetable for the adoption of the report would afford sufficient time to the two
committees associated under Rule 47 to prepare their opinions. The coordinators agreed
with the rapporteur that the proposed working group was not foreseen in Rule 47 and
that the open working methods applied would give the committese sufficient guarantees
to contribute to a successful conclusion of the dossier. The chairman was invited to reply
to the chairs of the EMPL and IMCO committees along those lines.
C.2. "The Economics of Ecosystems and Biodiversity" (following the Bonn Conference
on Biodiversity) - possible presentation of an international - request by Mr Wijkman
Decision:
The coordinators decided that an exchange of views on the future study on "The
economics of ecosystems and biodiversity" should be held in the context of a round-table
event to be organised from the ENVI expertise budget. The secretariat was instructed to
take the necessary steps that this event be prepared by Policy Department A at an
appropriate moment next year.
C.3. Preparation of an "early second reading agreement" in relation to the Doyle report
on MRLs

The papers for the meeting included
 a "Draft Regulation laying down Community procedures for the establishment of residue
limits of pharmacologically active substances in foodstuffs of animal origin, and repealing
Regulation (EEC) No 2377/90"
Following negotiations of the rapporteur and the shadow rapporteurs with the Council, a socalled "early second reading agreement" on the MRL file is being proposed.

 Resolution of 22 May 2007, paragraph 18 (2)
Decision:
The coordinators
 noted that the rapporteur and the shadow rapporteurs agreed on the text that
had previously been negotiated with and now been submitted by the Council
in view of the conclusion of an "early second reading agreement" (i.e.
adoption of the future common position without any amendment once it is
formally transmitted) in relation to the Doyle report on maximum residue
limits (MRLs);
 agreed that as a matter of principle the political assessment of the desirability
of the conclusion of an 'early second reading agreement' should by carried
out jointly by the rapporteur and the shadow rapporteurs;
 invited the chairman to write, on the basis of the present agreement among
shadow rapporteurs, to the chairman of Coreper I, informing him of the
agreement in principle, subject to confirmation by the committee and by the
plenary.

stage, the decision on the agreement shall be taken by the rapporteur and the shadow rapporteurs, if necessary
together with the committee chair and the coordinators. There shall be sufficient time between the end of the
negotiations and the vote in plenary to allow political groups to prepare their final position."

" Agreement at the stage of Council common position
16. Where no agreement is reached at the European Parliament's first reading, contacts may be continued with a
view to concluding an agreement at the common position stage.
17. The Commission shall facilitate such contacts and shall exercise its right of initiative in a constructive
manner with a view to reconciling the positions of the European Parliament and the Council, with due regard for
the balance between the institutions and the role conferred on it by the Treaty.
18. Where an agreement is reached at this stage, the chair of the relevant parliamentary committee shall indicate,
in a letter to the chair of Coreper, his recommendation to the plenary to accept the Council common position
without amendment, subject to confirmation of the common position by the Council and to legal-linguistic
verification. A copy of the letter shall be forwarded to the Commission."

Decision
Following an exchange of views, the coordinators decided not to hold an extraordinary
ENVI meeting in Strasbourg on 19 November 2008 from 8.30 to 10.30 a.m. since the
proposed timing would clash with group meetings.
C.5. Admissibility of compromise amendments and availability of voting lists
Decision
The coordinators
-
noted that the increase in the submission of 'compromise' and 'consolidated'
amendments at short notice before votes may result in organisational
difficulties, such as the late availability of voting lists;
-
agreed that the wide wording of Rule 155(4) should be applied in a strict way
and in line with the committee's long-standing tradition(1);
-
decided that
 the expression 'compromise amendment' shall only apply to amendments
with a compromise nature tabled after the expiry of the ordinary deadline
for amendments which are signed by the rapporteur and the shadow
rapporteurs of all the groups
 the expression 'consolidated amendment' shall only apply to amendments
with a compromise nature tabled after the expiry of the ordinary deadline
for amendments which are signed by at least two shadow rapporteurs
 all other amendments tabled after the expiry of the ordinary deadline for
amendments shall not be considered as compromise amendments within the
meaning of Rule 155(4) and that they shall have the same status as oral

"Pursuant to Rule 151(3), the President shall decide whether amendments are admissible. In the case of
compromise amendments tabled after the close of a debate, pursuant to this paragraph, the President shall

The following general criteria for admissibility may be applied:
- as a general rule, compromise amendments may not relate to parts of the text which have not been the subject
of amendments prior to the deadline for tabling amendments;
- as a general rule, compromise amendments shall be tabled by political groups, the chairs or rapporteurs of
the committees concerned or the authors of other amendments;
- as a general rule, compromise amendments shall entail the withdrawal of other amendments to the same
passage.
Only the President may propose that a compromise amendment be considered. In order for a
compromise amendment to be put to the vote, the President must obtain the agreement of Parliament by asking
whether there are any objections to such a vote being held. If an objection is raised, Parliament shall decide on
the matter by a majority of the votes cast."

The coordinators heard the chairman who drew their attention to the need to be
