CONTEST RULES
for the 05 ARTLOOP Festival
under the name CUMULATION
The National Gallery of Art with its registered office in Sopot, an organizer of the 05 ARTLOOP Festival in
Sopot, announces the international Contest addressed to creators in order to select entries to be
presented during the outdoor exhibition under the name CUMULATION, from 27.08 to 04.09.2016 in
Sopot.
§ 1. GENERAL PROVISIONS
1.
The organizer of the Festival/ Costest and the founder of awards is the National Gallery of Art in Sopot, a
municipal cultural institution entered into the register of cultural institutions, maintained by the Municipality of
the City of Sopot, operating at Plac Zdrojowy no. 2, 81-720 Sopot, phone: +48 58 551 06 21, fax: 551 32 62, NIP no.:
585-122-00-52, REGON no.: 000277167.
2.
The contest is open and international, education and experience is not the prerequisite for the
participation in the Contest. If the participant is the natural person, she/he must be 18 years old.
3.
The Contest is aimed at the selection of works that, on the basis of the separate agreement, will be
included in the outdoor exhibition in the public space of Sopot, under the name CUMULATION, from
27.08 to 04.09.2016.
4.
The Contest is carried out by the group of Festival curators, which is responsible for the program of the
event, including the organization of the exhibition CUMULATION.
5.
Contest Schedule:
- do 31.05.2016 – acceptance of applications
- 13.06.2015 – announcement of the Contest results
- 13.06-27.08. 2016 – production preparation
- 27.08-4.09. 2016 – exhibition of entries
§ 2. PARTICIPATION REQUIREMENTS
1.
The Contest may be participated by natural persons without legal capacity, collectives of natural persons
(e.g. the group of creators who are co-authors), and legal persons.
2.
Contest Participants are only the entities (including the collectives of natural persons without legal
capacity), who apply through the official form within the period specified in § 1 point 5 indent 1 of this
Rules. Application and required attachments must be prepared in an electronic form and sent via e-mail
to: [email protected] Attachments with audiovisual materials must be made available to the Organizer
via You Tube or Vimeo. The Organizer does not accepts applications in a different form.
3.
The application should contain only the following documents:
a) legibly signed and properly completed application form [scan], containing the acceptance of the
Contest Rules.
b) visualizations of the entry in the form of photos, sketches, audiovisual materials [sent through You
Tube or Vimeo] – depending on the character of the entry.
c) general financial estimate of the project [according to the template], including in particular the costs
of production, transport and honorarium of creators.
4.
The entity (including the collectives of natural persons without legal capacity), may submit up to 3
entries in the Contest – each entry must be attached with a separate application.
5.
The application should be made in Polish or English [which applies to creators from outside Poland].
6.
Participation in the Contest is free of charge.
The costs associated with the preparation of the project to the Contest application shall be covered by
the Contest Participant.
§ 3. COPYRIGHT
1.
The Contest may be participated only by entities (including the collectives of natural persons without
legal capacity), who have full copyrights to submitted entries, obtained in a primary or secondary
manner. The Contest Participant ensures that the contest entry submitted by him/her does not violate
neither property nor personal rights of third parties. The Contest Participant also undertakes that until
the decision of the Contest, and in case of the Winners - to the date of the conclusion of the agreement
referred to in § 6 of the Rules, he/she will not make any decrees by property copyrights, and in particular
will not grant any license to use those rights, or make any restrictions on the exercise of copyrights.
2.
If in the course of the Contest, the Curatorial Collective becomes suspicious about the violation by the
Participant of third party rights, and in particular the copyright, the Curatorial Collective may at any state
of the Contest delete such Participant from the list of Contest Participants. In such a situation, the
deleted Participant shall not be entitled to any claims against the Organizer. If the organization of the
project violates the property or personal rights of third parties, the Contest Participant shall be required
to satisfy the claims of third parties, leading by own efforts and expense to releasing the Organizer of
debts to third parties, reimbursement of any expenses incurred by the Contest Organizer to meet the
claims of these persons and to pay the Organizer any damages that the Contest Organizer will incur in
connection with the exclusion or limitation of the possibility to make use of the contest entry or the
implementation of the project.
§ 4. ELIGIBILITY CITERIA FOR ENTRIES
1.
The entries meeting the following criteria will be accepted in the Contest:
a. consistent with the description of the exhibition, which is annexed to the Rules,
b. taking into account the specificity of the location, along with the production guidelines,
c. there is the possibility to produce the entry within the prescribed periods between the announcement
of the Contest rules and the presentation of the exhibition,
d. the entry falls within the budget – the reality and feasibility of the presented budget, the adequacy of
the budget for the presented enttry.
The qualification for the Contest should be understood as the qualification of the entry to the final
decision of the Contest, which will be made based on the criteria of § 5. Qualification for the Contest is
made by the Curatorial Collective; its decision is final, irrevocable and requires no justification.
Deliberation of the Curatorial Collective is secret. About the qualification and lack of qualification the
Contest Participant will be informed at the time of the decision of the Contest.
2.
The exhibition will be organized outdoor – mainly on the Sopot Pier and Curatorial Plaza, including the
part of the municipal beach at the Pier and the coastline. Other possible locations include: Sopot Friends
Plaza [only actions in the field of design], Sopot Railway Station, Bohaterow Monte Casino Street. The
map of potential locations is attached hereto.

3.
Guidelines related to the entry location are as follows:
a. the entry must contain the specific climatic conditions prevailing outdoor, including: strong winds,
rain, direct sunlight [especially in the case of the Pier and the beach],
b. the entry must not affect neither the structure of the Pier, nor any other public facilities,
c. the entry must not make permanent changes in the appearance of the Pier [e.g. due to repainting the
surface], or other designated locations,
d. the entry must not pose a threat to public safety, as well as individuals,
e. the entry must not be associated with the activities of using fire or fireworks,
f. it is possible to implement the entry located on the sea waters near the Pier.

a. The entries will be presented in the space, only after obtaining the set of appropriate permits from the
public bodies or authorized individuals,
b. The Organizer is not responsible for the refusal to issue the relevant permits needed for the
exposition of the entry,
c. In the absence of consent to the particular location, it is possible to relocate the entry upon the
consent of the Participant and the Organizer.
5.
The Organizer qualifies both new entries, those created with the aim of the festival, not-created entries,
as well as entries previously exhibited during other artistic events that fit in with the theme of the
Exhibition and the substantive guidance.
6.
The Organizer does not introduce any restrictions as to the form of the entry. The following entries will
be qualified: audiovisual works, multimedia projections, sound installations, performative actions,
buildings and any other forms that meet the substantive and productive criteria.
§ 5. DECISION OF THE CONTEST AND ANNOUNCEMENT OF RESULTS
1.
The qualification of entries in accordance with § 4, and the assessment of positively qualified entries in
accordance with point 2, as well as the determination of the Winners will be made by the Curatorial
Collective composed of:
Lena Dula, Malgorzata Golebiewska, Emilia Orzechowska, Ewa Szablowska, Stach Szablowski – curators
of the Exhibition and the Festival.
2.
The entries will be assessed freely by the Curatorial Collective, according to the following criteria:
- substantive quality of the project,
- implementation of the Contest theme,
- taking into account the nature and character of the place.
3.
The Curatorial Collective will select no more than 5 Winners. The Contest Organizer reserves the right to
reduce or increase the number of Winners, given the level of submitted projects. The Contest Organizer
reserves the right to determine additional Winners, if the originally selected Winner failed to conclude or
perform the agreement referred to in §6. In the latter case the deadline for concluding the agreement
with the Winner will be 7 days from the announcement of the additional Winner at www.artloop.pl. The
provisions of §6 point 3 sentence 2 shall apply accordingly.
4.
Decisions of the Curatorial Collective are final, irrevocable and require no justification. The deliberation
are secret.
5.
The results will be announced on 13.06.2016 at www.artloop.pl. The Winners will be additionally
informed by email.
§ 6. AWARDS
1.
The Award in the Contest is the opportunity for the Winner to conclude with the Organizer the written
agreement for payable implementation of the entry submitted in the Contest by the Winner (contract for
specific work). If the Contest Winner is the collective of creators, the agreement may be concluded only
with all members of the collective.
2.
The payment for the implementation of the entry under the agreement is the lump sum, as follows:
a) in the case of the entry created especially for the Festival – in the amount of PLN 5000 gross,
which amount will be reduced by the tax due in accordance with the applicable laws, and the
amount includes all costs of production and exhibition of the entry, honoradium of the Winner
and remuneration for granting the licenses referred to in point 4 d) and e) in all fields of
operation provided thereof.
b) in the case of the finished entry, previously exposed – in the amount of PLN 2500 gross, which
amount will be reduced by the tax due in accordance with the applicable laws, and the amount
includes all costs of production of the entry in Sopot, its exposition, honorarium of the Winner
and remuneration for granting the licenses referred to in point 4 d) and e) in all fields of
operation provided thereof.
If the Contest Winner is the collective of natural persons, the remuneration shall be divided equally
among all members of the Collective.
3.
The agreement may be concluded between the Organizer and the Winner until 30.06.2016.
In the case of failure to meet this deadline by the Winner, the right to the award expires.
4.
The conditions of the agreement for the implementation of entries will include, among others:
a) the deadline for the implementation of the entry until 27.08.2016;
b) the owner of the entry will be the Winner;
c) lending the entry by the Winner to the Organizer for the period from 27.08.2016 to 04.09.2016,
for its public presentation;
d) granting by the Winner to the Organizer, for the period of five years and then for an indefinite
period, the license unlimited in space to use the entry and the concept of the entry in the
following fields of operation:

the use of the entry to implement the program of the ARTLOOP 05 Festival,
in the field of dissemination: public exhibition, display, playback, as well as
broadcasting and re-broadcasting, particularly in TV (wireless – aerial or satelite,
or wired), and public communication in such a way that everyone can have
access to them in individually chosen place and time,
in the field of recording and reproduction: production of copies using all
techniques, including the technique of printing, film, photographic, sculptural,
casting, holographic, reprographic, as well as analog or digital recording,

including magnetic, optical and magneto-optical recording, as well as saving in
flash memories and the like, and entering into computers memory;

in the field of trade in copies and originals: marketing, lending or leasing.
granting by the Winner to the Organizer the license for permitting and using the studies of the
entry in all of the aforementioned fields of operation;
giving the unpaid consent by the Winner to the Organizer for recording and publishing the
Winner’s image for advertising purposes of promoting the Festival, as well as for information and
archival purposes;
the date of payment of the part of the remuneration:
1) the first part of the mutually agreed amount within 14 days of the conclusion of the
agreement,
2) the second part of the mutually agreed amount within 14 days of the performance of
the entry,
the right to withdraw from the agreement by the Organizer, without setting the additional
deadline in case of the Winner’s delay to perform the agreement, which does not prejudice the
right to withdraw from the agreement, pursuant to the provisions of law;
the right to withdraw from the agreement by the Organizer, without setting the additional
deadline in case of the Winner’s violation of the rights of third parties, in particular the
copyrights;
the right to withdraw from the agreement by the Organizer, without setting the additional
period in case of failure to receive the set of the relevant permits from public bodies and
authorized individuals;
the Winner’s commitment to remove the entry at his/her own expense and efforts on
05.09.2016, and in case of failure to meet this obligation by the Winner – automatic transfer of
the ownership right to the entry to the Organizer, and the possibility of using the entry at his/her
discretion, including its destruction;
the agreement will be subject to the Polish law, and disputes related to it will be settled by the
Polish common court with the competent venue for the registered office of the Organizer.
5.
Regardless of the remuneration for the performance of the agreement, the Organizer will cover the costs
of transport and accomodation of the Winner, after the Organizer’s approval of the route, means of
transport, place of accommodation and number of nights.
§ 7. PERMANENT EXPOSITION
In the case of production of the entry specially for the Festival, there is the possibility of permanent
leaving the entry in Sopot. The leaving is dependent on the capabilities of location, materials used to
create the entry, the nature of the entry, as well as the will of the Winner and the Organizer. Any such
possibility will be the subject of additional arrangements with the Winner, included in the additional
agreement.
§ 8. FINAL PROVISIONS
1.
The Contest Organizer reserves the right to change the rules and contents of the rules during the
Contest, and to change the number/ form of giving the awards.
2.
The Organizer reserves the right to cancel the Contest without giving reasons at any stage.
3.
In all matters not settled herein, the decisions shall be taken by the Contest Organizer.

5.
The Rules is subject to the Polish law and any disputes between the Participant and the Organizer will be
settled by the Polish common court with the competent venue for the registered office of the Organizer.
6.
If the Rules will be also published in a language other than Polish, the Polish version shall prevail in its
interpretation.
