AN ORDINANCE OF THE TO\WN OF TERRY, MISSISSIPPI, PROVIDING
REGULATIONS FOR THE KEE]PING OF ANIMALS WITHIN THE TOWN OF'
TERRY, MISSISSIPPI
WIIEREAS, the Mayor and the Board of Aldermenof the Town of Terry, Mississippi,
desireto adopt ceftain regulationspertainingto maintainingof animals within the Town of
Terry, aswell as providing for the control thereof;
NOWOTHEREFORE, BE IT ORDAINED EY THE MAYOR AND BOARD OF'
ALDERMEN OF'TI{E TOWN OF TERRY, MISSISSIPPI, AS FOLLOWS:
Section1. Purpose
The purposeof this ordinanceis to control animalsthroughoutthe Town of Terry in the interest
of the health,safetyand generalwelfareof its residents.
Section 2. Special Definitions as usredin this Ordinance unless the context otherwise
indicates:
"VICIOUS ANIM AL" shall mean
(l)
any animal with a known propensity,tendencyor dispositionto affack without
provocation,to causeinjury to, or to otherwisethreatenor endangerthe safetyof
humanbeings,pets,or domesticated
animals;or,
(2)
any animalthat bites,inflicts injury, assaults,or otherwiseattacksa humanbeing,
pet or domesticatedanimalwithout provocation;or
(3)
any animalthat hasbeentrainedto fight with anotheranimal;
(4)
Exceptionsto the definitionof "Vicious Animal" shall include:
(a)
any animal trained for use by law enforcementpersonneland actuerlly
engagedin serviceto a particularlaw enforcementagency,or underthe
physicalcontrolof'an activeduty law enforcementofficer;
(b)
any animal who attacksa personover the age of fourteenwho willfully
trespasses
or comrmitssomeothertort upon the real propertyof the owner
of the animal,or who otherwiseteases,tormentsor abusessaidanimal;
"OWNER" shallmeanany person,firm, associationor corporationowning,keepingor harboring
an animalwithin the Town of Terry, Mississippi.
"AT LARGE" shall mean off the premisesof the real property occupiedby the owner of said
animal, not under the control of any person by means of physical restraint or ability to
manipulateandcommandthe conductof the animal.

Section3. LicenseRequired
All animals kept, harboredor maintainedby their respectiveowners in the Town of Terry,
Mississippi,shallbe registeredandtaggedin accordance
with the appropriatelaws of the Stateof
Mississippi. It shall be deemeda violation of this ordinancefor a residentof the Town of Terry,
Mississippi,to maintain,harbor,or keepa Vicious Aninnal.
Section4. Disturbing the Peace
It shallbe a violation of this ordinancefor an ownerof an animalto causeor permit suchanimal
to emit barking,yelping, howling, or other similar soundscontinuouslyfor twenty (20) minuttes
or intermittentlyfor one (1) hour or morebetweenthe hoursof l0:00 p.m. and 6:00a.m.
Section5. Running at Large
It shallbe a violation of this ordinancefor any animalto be At Largeas definedherein.
Section6. Impounding
The Chief of Police for the Town of Terry, or the designeethereof may seizeoimpound,or
restrainany animal violating this ordinanceat the expenseof the owner in orderto promotethe
purposesof this Ordinance.
Section7. Impoundment Procedure
Whenimpoundingan animal as contemplatedherein,the Chief of Policeor the designeethereof,
should,at the time of such impoundmentor as reasonablythereafteras practicable,describethe
violation(s)of this Ordinanceas noted,the dateof impoundment,and the breed,color, sex,and
general condition of the animal (as can be reasonablyascertained). The animal may be
impoundedat any location convenientto the Chief of Police or the designeethereof at the
expenseof the owner.
When an animal is impoundedunderthe provisionsof this Article, a reasonableeffort to notifo
shouldbe made.

Section8. Enforcement
The Chief of Policefor the Town of Terry shallhavethe primary responsibilityfor enforcingtlhis
Ordinanceandmay designatefrom time to time otherswho may enforcethis Ordinance.
Section9. Penalties
Any owner of an animal found in violation of any of the provisionsof this Ordinanceshall be
guilty of a civil violation, and upon convictionthereofas a first offense,shall be fined not less
than one hundreddollars ($100.00)nor more than two hundredfifty dollars ($250.00)to be
recoveredby a complaintbeforethe Municipal Court forthe Town of Terry, Mississippi.
Where any owner of an animal found in violation of any of the provisionsof this Ordinance
within a period of twelve months from the date of a conviction for a first offensehereol said
Owner shall be guilty of a civil violation, and upon convictionthereofas a secondoffense,shall
be fined not less than two hundredfifty dollars ($250.00)nor more than five hundreddollars
($500.00)to be recoveredby a complaintbeforethe Municipal Court for the Town of Terry,
Mississippi.
Where any owner of an animal found in violation of any of the provisionsof this Ordinance
within a period of twelve monthsfrom the dateof a convictionfor a secondoffensehereof,said
Ownershallbe guilty of a civil violation,andupon convictionthereofas a third offense,shallbe
fined not lessthan five hundreddollars($500.00)nor nnorethan nine hundredninety-ninedollars
($999.00)to be recoveredby a complaintbeforethe Municipal Court for the Town of Terry,
Mississippi,and, in addition thereto,the Municipal Judgeffi&y, in his/her discretion,enter an
Order prohibiting said violating owner from possessingan animal within the Town of Terry,
Mississippi.
Section10. Severability Clause
If any part of this Ordinanceshall be held invalid, suchpart shall be deemedseverable,andthe
invaliditythereofshall not affectthe remainingpartsof this Ordinance.
Section11.Amendments
This Ordinancemay be amendedby a majority vote of any legal meeting of the Board of
Aldermenfor the Town of Terry, Mississippi,in accordance
with Mississippilaw.
Section12. Effective Date
This Ordinanceshall be in full force and effectupon passageinasmuchas the Mayor and Board
of Aldermenfind that it is in the bestinterestof the health,safetyand welfareof the residentsof
the Town of Terry, Mississippi,that this Ordinancetakeeffect immediatelyuponpassage.
