The licensing training courses are on the calendar.
TMBA will be offering the first round of licensing courses before year end.
One of several classes is projected to run concurrent with the upcoming
TMBA Seminar in Dallas, November 16-18. The State of Texas requires every
mortgage banker originator take 20 hours of education to obtain their license.
For the convenience of those who take our course in Dallas with the Seminar,
three consecutive days may seem quite the commitment but in one fail swoop
students will knock out all the required pre-licensing class requirements.
Plans are still being finalized with national on course approval and
arrangements with the hotel, but what we do know is that the class will be
limited to 100 students and the deadline to get the hotel discounted rate has
been extended to October 10th. Let Lisa in the TMBA office know how many
seats you would like to reserve and watch for the registration information.
And that is not all. In our continuing effort to be your one-stop resource for
complying with the new licensing laws, TMBA has also developed a course
specifically tailored to help loan originators pass the required licensing tests.
Also look for a course that will help companies build their quality control
program to assure you are complying with all new regulations – and there are
a bunch of them. You will see more on this in the upcoming months.

of Mortgage Lending” workshops
within the last two months in
Tyler, Lubbock, and McAllen.

of Savings and Mortgage Lending
for speaking about the upcoming
changes as a result of the S.A.F.E.
Mortgage Licensing Act. The S.A.F.E. Act established the federal
minimum standards that include back ground checks, testing, and
at least 20 hours of pre-licensing education and at least 8 hours of
continuing education annually for loan originators. Commissioner
Foster was able to explain the scope of the changes and what it
will mean for the mortgage lenders in Texas.
Thank you TIB, The Independent Bankers Bank, and the McAllen
Chamber of Commerce for helping sponsor these events. We

Legislative | Regulatory Efforts.
There were tremendous challenges in the 2009 Texas Legislative session
prompted by legislators who believe a more restricted and regulated
system of mortgage lending should be adopted in Texas. 7,419 House and
Senate bills were introduced in the last legislative session. With TMBA
and its lobbying efforts, three key bills support and developed by TMBA
were approved and none of the legislation opposed by TMBA passed.
The three primary bills that TMBA actively supported and
which have now become law are:
TMBA successfully opposed bills that would have resulted
in:
• HB 10 – the Texas version of the “model act” being
adopted by all states to implement the federal S.A.F.E.
legislation for licensing and regulating residential mortgage
loan originators. The legislation contains all of the minimum
standards and requirements of the federal law but does
not impose any additional requirements that would be
objectionable. TMBA was involved in every stage of the
drafting of that legislation and in its passage.
• Legislation to prohibit a lender from using a credit score in
setting a borrower’s interest rate.
• Legislation that provided that the owner of residential real
property could file a lawsuit against a lien holder within 30
days after a foreclosure sale “for a claim that arises out of
the transaction under which the lien attached, regardless of
whether the action would otherwise be barred by limitation”.
Stated another way, a borrower could sue a lender on the
original loan within 30 days after a foreclosure sale even if
the original loan had been made 10 or 15 years earlier.
• HB 2779 – This legislation amends the Texas Mortgage
Banker Registration Act to provide the regulatory structure
for the licensing and regulation (pursuant to the provisions of
HB 10) of mortgage banker loan officers who originate home
loans. The legislation was drafted by TMBA. Although there
were a couple of technical changes made in the legislation
during its passage, there were no objectionable provisions
that were inserted.
• HB 2774 – The Texas Savings and Mortgage Lending
Department, the Texas Department of Banking, and the
Office of Consumer Credit Commissioner (all of which
are governed by the Finance Commission) are funded by
fees paid by individuals and entities who are regulated by
those agencies. They receive no tax dollars. However,
the monies they receive can be spent presently only if and
how appropriated or designated by the Texas Legislature.
The provisions added to HB 2774 removed the Finance
Commission agencies from the legislative budget process.
That will permit them to hire and retain the most competent
and qualified people. This legislation is important to
mortgage bankers since the Texas Department of Savings
and Mortgage Lending presently registers mortgage bankers
and will be the agency that licenses and regulates mortgage
banker residential loan officers.

• Legislation which would have extended from the present
20 day time period to 60 days the minimum time of notice
of foreclosure and which would require the foreclosing lien
holder to publish notice of the foreclosure (with extensive
information specified in the legislation) once a week for
four weeks in a local newspaper prior to foreclosure. It
was estimated that this requirement could cause a Houston
foreclosure to cost more than $3,000 for the publication
requirement if the notice was published in the Houston
Chronicle.
• Legislation adding extensive new duties on a residential
mortgage servicer including (1) any fee incurred by the
servicer and assessed to the debtor must be assessed
within 45 days with a clear explanation or the fee is
waived, (2) a payment (even if it is insufficient) must be
credited within one business day of the date received or
an explanatory notification must be provided to the debtor,
and (3) the mortgage servicer must maintain records of any
dispute or error and provide detailed information if requested
by the debtor.

• Legislation that would prohibit a lender from refinancing
an existing home loan unless the new loan has a
“reasonable, tangible net benefit to the borrower
considering all of the circumstances, including the terms of
the new and refinanced loan and the borrower’s stated loan
objectives, repayment ability, current and expected income,
and current obligations”. The concern, of course, is that
this subjective determination requirement would generate
disputes and litigation.
• Legislation that would require 60 to 90 day mediation on
a defaulted home loan before the mortgage servicer could
foreclose.
• Legislation that would authorize a debtor on a “subprime
mortgage” (as defined in the legislation) and negative
amortization loans to defer foreclosure for up to 270 days.
• Legislation that would set a maximum interest rate of
9% on consumer loans (which obviously would include
home loans) and would limit a late payment to $5 and also
provide that no late payment fee could be levied against a
senior citizen, anyone disabled, or low income individuals.
• Legislation that would have mandated a standard form
of a payoff statement for home loans which a lender or
mortgage servicer would be required to complete and
provide if requested. The lender or mortgage servicer
would be bound by the amount on this payoff statement for
purposes of closing a transaction. Any amounts remaining
owed because of a mistake by the lender or mortgage
servicer would not constitute a lien against the property (as
is the current law) but would remain the personal liability of
the borrower.
• Legislation requiring a lender to contact the debtor in
person or by telephone to advise the debtor of a home loan
default and the opportunity to cure.
• Legislation that would have required lenders to provide
to borrowers in connection with default and opportunity
to cure notices (1) a description of the options available
to debtor to prevent foreclosure (lawsuit?) and (2) a
description of and warning against “typical activities that
may be encountered by the debtor in connection with the
foreclosure, including unconscionable actions or courses of
action” (apparently, some form of deceptive trade practice
act recitation).
• Legislation that would have required judicial – rather than
the current non-judicial – foreclosure of certain types of
loans, including most ARMs.
• Legislation that would have a required a filing in
connection with a notice of foreclosure of extensive
information about the loan being foreclosed upon,
including: (1) the type of lien being foreclosed, (2) the initial
interest rate on the loan, (3) the origination and maturity
dates of the loan, (4) the initial amount of the debt, (5)
whether the loan allows negative amortization or payment
of interest only, (6) extensive information about the index if
the interest rate could change, (7) whether the loan allows
for a scheduled payment that is more than twice as large as
the initial payment, (8) whether the loan has a prepayment
penalty or allows for a change in interest rate when there
is a default by the debtor or a decrease in the debtor’s
credit score, (9) the type of default (whatever that means),
(10) demographics of the debtor (whatever that means),
(11) whether the property was the debtor’s residence, and
(12) the Zip Code of the property. This extensive litany is
provided to demonstrate just how impractical the legislation
would have been.
• Legislation that would have required a $150 filing fee on
every mortgage foreclosure with the money to be used for
indigent legal services.
• Legislation that would have required mandatory
counseling before a lender could make certain types of
home loans to borrowers.
