INVESTMENT REPORTS
A.
Investment Status Report – Public Financial Management (PFM)
Carlos Oblites of PFM Asset Management LLC, presented the Board, a review of the
Third Quarter (2014) CAPRI Portfolio. It was reported that CAPRI’s portfolio
maintained duration shorter than benchmark in anticipation of higher rates. The
Association’s portfolio is in compliance with California Government Code and
Investment Policy and is concentrated in the 1-year to 5-year maturity. The portfolio’s
conservative duration position helped protect the portfolio’s market value in a period
when the benchmark had a negative return. It was also reported that in the Third Quarter
of 2014, due to low spreads PFM continued to increase allocation to Treasuries and
decrease Federal agencies and limit purchases of longer-term securities.

6.
FINANCIAL MATTERS
A.
2nd Quarter WC Premiums 2014-2015
Rick Richards, Risk Manager reported that 13 districts have not paid their Workers
Compensation Premiums as of this date. Payment reminders, have been sent out to these
districts. A delinquent notice will be sent to each of these districts if payments are not
received by November 24, 2014.
B.
WC and Liability/Property Dividend Update
Pat Cabulagan, informed the Board that CAPRI will be sending the dividend of $300,000
for the Workers’ Compensation Program, from the 2002-2003 fiscal year at the end of
November. The dividends for the Liability & Property will be paid in February or early

March when the 3rd quarter WC premiums and 2nd half Liability/Property premiums are
received.
C.
WC Final Payroll 2013-14
Pat reported that CAPRI has received the Final Payroll Reports needed to complete the
actual workers’ compensation premium for 2013-2014. Final payroll numbers were
turned into CSAC-EIA in mid-October. Once all the 2013-2014 WC Final Payrolls are
verified, staff will invoice those districts that have underreported on their 2013-2014
Payroll and send out checks for those districts that over reported.

ADMINISTRATIVE MATTERS
A. CARPD Meeting Update
Executive Director, Patrick Cabulagan discussed the CARPD strategic meeting that
occurred on November 5, 2014 at the Westin Hotel in Sacramento. The items discussed
included: 2015 CARPD Spring Conference; Annual Membership Dues Update; 20142015 Conflict 700 Forms; CARPD/CAPRI Executive Directors Contract; Exhibiting at
CPRS/CSDA Conferences; Review of Bylaws and Goals and Objectives; and Marketing
of CARPD.

CLOSED SESSION
The Board convened to Closed Session, pursuant to Government Code section 54956.95
at 10:08 a.m.
The Board discussed the claims for the payment of tort Liability losses, Workers’
Compensation losses and Property losses incurred by the Joint Powers Authority.

The Board reconvened to Open Session at 11:06 a.m., pursuant to Government Code
Section 54957.1, the Board must report in open session any action taken, or lack thereof,

CAJPA Conference
Pat informed the board that the conference was educational and the keynote speakers
were very good.

PARMA Conference
The conference is scheduled for February 8 – 11, 2015 in the Disneyland Conference
Center in Anaheim, CA. Confirmed attendees included: Lindsay Woods, Terri Leimbach,
Sam Goepp, Dean Wetter, Bob Berggren, Stephen Fraher, Rick Richards and Pat
Cabulagan.
E.
CARPD Executive Directors Contract
The Board of Directors reviewed the CARPD Executive Directors contract. Pat advised
the Board of Directors that there may be a conflict of interest with Lindsay Woods
serving on the Ad-Hoc CARPD Executive Directors Contract Committee since he is a
CARPD appointee on the CAPRI Board. Dean Wetter volunteered serving on the
committee is it was deemed that there is a conflict of interest.
Bob Berggren made a motion to approve the contract agreement for Executive Director
Services between CARPD & CAPRI; and if Lindsay Woods cannot serve on committee
than Dean Wetter will serve on the Committee. Colin Miller seconded the motion.

Update on Administrative Assistant Position
CAPRI has begun the process of filling the Administrative Assistant position. Staff
advertised in the Sacramento Bee/Career Builder. The goal is to have someone hired by
early to Mid-December.

Liability/Property/Crime Memorandum of Coverage
Staff advised the Board that the Liability/Property/Crime Memorandum of Coverage
have been sent to the membership. These Memorandum of Coverage documents are to be
retained by the membership for as long as the District’s exist so that they have record of
coverage in the event of a claim down the road. .

Electronic /Web-based Waiver Forms
A number of Districts have gone to web-based signups for their activities and sports
programs. Individuals sign up online for various District activities and sports programs.
This is usually done by checking a box that you have read and agree with the hold
harmless agreement/waiver form. Staff believes the web-based program for sign-ups are
something a lot of districts will be looking into in the future. So far, this type of system
would hold up legally and make it easier for District’s to attract more individuals to sign
up for their programs. There could be some issues regarding the waivers that might open
up the District’s to more exposure. Staff will reach out to the district General Managers;
acquire which districts are using these systems and if so which system. The Board
formed an ad-hoc committee to review the various systems and hold harmless language.
Lindsay Woods, Terri Leimbach, Bob Berggren and Colin Miller volunteered to serve on
the Committee.
I.
SouthTech Systems – Disclosure Docs
This company specializes in streamlining conflict of interest code form 700. There are
two options of acquiring the system/software: 1) purchase a software license; or 2)
software subscription. Board directed staff to obtain the cost of purchasing/subscription
per district and will discuss results in next meeting.
J.
Update on Rental/Lease of Office Next Door/Renewal Strategy
CAPRI has had very little interest in the space next door. Many of the commercial
activity is heading to the new growth areas in Roseville, Rocklin, Elk Grove and Folsom.
We will keep the Board updated on the lease of the vacant space next door.
K.
Exhibiting at CPRS and CSDA Conferences
Board of Directors directed staff to purchase an exhibit booth for the CSDA conference
and inquire about splitting cost with CARPD.

L.
CAPRI Year in Review
Staff provided a quick synopsis of what happened within the last fiscal year. Some of the
highlights included: successful 2014/2015 insurance renewals; Dividends totaling
$375,000 for 2013/2014 were distributed to the membership; 15 districts used online
safety programs and trained in 25 various risk management/safety topics; 23 Districts
were visited; new CAPRI logo; and had a successful 2013/2014 financial audit.

The Board of Directors, personnel committee created goals and objectives for the
Administrator for the fiscal year 2014 – 2015.

Very Good evaluation; Mission Oaks received a Very Good evaluation; Orangevale
received a Very Good evaluation; Fair Oaks received a Very Good evaluation;
Dunsmuir received a Good evaluation; Mt. Shasta received a Very Good evaluation;

AB 218 – Employment Application Webinar
This webinar was presented by both the CAPRI staff and Serena Sanders, attorney from
Angelo, Kilday & Kilduff, LLP. The webinar reviewed the new AB 218 restrictions,
identifying positions which are exempt from the new AB 218 restrictions, and offered
practical tips for implementing AB 218 within their district. The webinar was well
attended by our Districts and the feedback on the webinar was very good.

overdue. As of the date of this report, all but eighteen (18) members in the Workers Comp

status of any outstanding premiums at the time of the Board meeting.
Any Districts that have not paid their premium by February 18, 2015 will be personally
contacted and advised that their premiums will become overdue on February 28, 2015. Any

Liability/Property Dividend Update
BACKGROUND AND STATUS:
At our August Board of Directors meeting, the Board approved the dividends in the
Liability/Property Program amounting to $400,000 from the 2000-2001, 2001-2002 and 20022003 years.
The Liability/Property dividends are paid in February/March after we receive the 2nd Half
Liability/Property contributions and the 3rd Quarter WC contributions. Staff has received almost
all of the Liability/Property and WC contributions and will likely pay the dividends sometime in
February.
We will be discussing a number of claims in closed session that could affect our reserves.
CAPRI would still be in good shape with the surplus, but want to be sure the Board is still
comfortable with the $400,000 dividend.

expenditures as of this point in time. Ultimately, these numbers will change as firm insurance
quotes are received, actuarial analysis is conducted and the Board determines the direction they
want to take CAPRI in the next fiscal year. Staff will provide a more detailed budget for
approval at the May Board of Directors meeting.

Executive Director Contract; Legislative Representation Contract; and Marketing to Recreation
and Park Districts not with CARPD.
In regard to the 2015 CARPD Conference, the planning is almost complete. The tentative
speakers/sessions include; 1) Keynote Speaker – Steve Garvey (LA Dodgers/San Diego Padres);
2) Liability Exposures – Dennis Walsh; 3) Landscape Maintenance/Drought Management Ideas
– Chad Kennedy; 4) Hostile Work Environment – Dennis Cole/David Ritchie; Innovative
Programs/Events – Panel Discussion; 5) Bullying – Angela Summers; 6) Brown Act Updates –
David McMurchie; Retaining Good Employees – Angela Summers; and Legislative Update –
Ralph Heim. The Friday Night Sponsor Reception will be a cruise around Lake Tahoe.
Staff will discuss the CARPD meeting in greater detail at our Board of Directors meeting.

the previous year and to look to the future to identify any upcoming issues that could have an
effect on our organization. Some of the discussion items for the Strategic Planning meeting may
include: Goals & Objectives; Discussion on Administrator’s Plans/Direction for CAPRI; Year in
Review for CAPRI; Insurance Market Update; Possible New Coverage’s/Program
Enhancements; and Liability/WC Claims Handling; Memorandum of Coverage Revisions;
CARPD; etc.
The location for the Board Meeting and Strategic Planning Meeting has yet to be determined.
Over the past few years, these meetings have been held in San Diego and Newport Beach,
California. We have also gone to Palm Springs in the past. We need to discuss possible
locations to have the meeting. Some suggestions include: San Diego; Palm Springs; Dana Point;
or Monterey.
CAPRI also needs to set the dates for the meeting. The last three years we have gone Sunday
through Tuesday but in the past we have also gone Wednesday through Friday. Normally, we
schedule the meetings the third week in November. Based on those dates we would be looking
at November 15-17, 2015 or November 18-20, 2015.
RECOMMENDATION:
It is staff’s recommendation that the Board select the site and dates for the November Board
Meeting and Strategic Planning session in order for staff to locate and secure hotel and other
accommodations preferably the third week in November 2015.

Pat Cabulagan will be emailing all of the Board Members, Legal Counsel, Broker and Financial
Advisor information on the Conflict of Interest regulations and the 700 form which needs to be
completed and turned into CAPRI. CAPRI will then file and retain this information for 7 years
as per the Conflict of Interest Code.
A Conflict of Interest Code is a policy document of a local agency, designating which persons
may affect financial decisions of the agency, and who therefore must file FPPC Conflict of
Interest forms. The Code typically adopts by reference the sample form included in FPPC
Regulation 18730.
Staff is asking that Board members complete the appropriate forms and get them back to CAPRI
as quickly as possible.
If there are any questions regarding the Conflict of Interest Code or the 700 form, we can discuss
them in further detail at the meeting.

EXECUTIVE DIRECTOR SERVICES
This agreement is made and entered into this ___day of ________ 2015 by and between the California Association of Recreation and Park Districts (hereafter referred to as “CARPD”) and the California Association for Park and Recreation Indemnity (hereafter referred to as “CAPRI”). The purpose of this Agreement is for CAPRI to provide executive director services for the day‐to‐day administrative and management of CARPD for the mutual benefit of CARPD and CAPRI members. RECITALS
CARPD is a 501(c)(3) non‐profit organization organized to promote the delivery of recreation and park services among special district agencies in California. Such districts are governed by the provisions of California Public Resources Code sections 5780, et seq. CARPD works directly and indirectly with its member agencies and other parties concerned with the operation of Recreation and Park Districts to foster the education of CARPD’s Member Districts governing boards, general managers, and management and administrative personnel. CAPRI is a California local agency joint powers authority organized under the Joint Powers Act, California Government Code sections 6500 et seq. sharing the powers of its members to pool self‐
insurance for liability claims, workers compensation claims, and first party property damage claims; to jointly purchase coverage; to promote good risk management, safety training and loss control; and to promote education and training of member officials and employees. The two organizations share many overlapping members and the goals of the two organizations complement each other as each organization is dedicated to promoting excellence in the administration of Park and Recreation Districts in order to promote the public interest. CARPD’s Mission
Since 1958, CARPD has been dedicated to improving the quality and efficiency of recreation and park districts. Through a joint powers authority, CARPD recreation and park district members are eligible for reduced rates on workers compensation coverage and liability/property damage insurance – saving local communities thousands of dollars. Each spring, CARPD hosts an annual conference and awards competition to recognize outstanding programming, facilities, and service to the community. WHEREAS, it is to the mutual benefit of the parties herein subscribed and in the public interest that said parties join together to establish this Agreement to accomplish the purposes set forth; and WHEREAS, the development, organization, and implementation of such a mutually beneficial and joint program is desirable, so the aforesaid parties join together in this Agreement in order to accomplish the purposes set forth; and WHEREAS, the parties are authorized to enter into this contract. NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL ADVANTAGES TO BE DERIVED THEREFROM, AND IN CONSIDERATION OF THE EXECUTION OF THIS AGREEMENT AND THE MUTUAL PROMISES MADE HEREIN, EACH OF THE PARTIES HERETO DOES HEREBY AGREE AS FOLLOWS: 1. This agreement is for the professional services of CAPRI and is non‐assignable by CAPRI without prior consent by CARPD in writing. CAPRI states that they are experienced in the recreation and park profession. In performing these professional services, CAPRI is an independent contractor and shall provide CARPD professional services with no particular bias whatsoever. 2. CARPD hereby retains CAPRI to perform various types of professional services, including but not limited to: a. CAPRI will provide administrative and executive director services to CARPD per the “Scope of Services” listed in EXHIBIT A. b. Services will be provided by CAPRI staff under the supervision of the CAPRI Administrator, and in accordance with the ultimate direction and control of the CARPD Board, which retains full governance authority of CARPD. c. Finances of CARPD will be held and accounted for separately and will not be commingled with CAPRI funds or accounts. d. CAPRI Administrator, Pat Cabulagan’s personal services shall be the material and primary element of this agreement and in the event Cabulagan leaves employment with CAPRI, this contract shall be terminable immediately, at the discretion of the CARPD Board. 3. Review, checking, approval, or other action by the CARPD shall in no way relieve CAPRI, and its officers, agents, employees, and contractors, of its responsibility for the accuracy and completeness of the work performed under this Agreement. It is understood by CAPRI that it is solely responsible for all work products submitted to CARPD by CAPRI and its officers, agents, employees, and contractors. Page 2 of 7 Page 38 of 84

In the event of a reorganization or consolidation of a party to this agreement, the successor in interest to the obligations of any such reorganized or consolidated public agency/corporation may be substituted as a party to this Agreement subject to the written agreement of the other party. The parties agree that each party will assume full liability imposed upon it by reason of the acts, errors, or omissions of its officers, agents, employees or representatives occurring in the performance of this Agreement, and each party agrees to hold harmless, defend and indemnify the other party from and against any liability or claims arising out of its acts or omissions in the performance under this Agreement. In the event any action, suit or proceeding is brought for the enforcement of, or the declaration of, any right or obligation pursuant to this Agreement or as a result of any alleged breach of any provision of this Agreement, the prevailing party shall be entitled to recover its costs and expenses, including reasonable attorneyʹs fees, from the losing party, and any judgment or decree rendered in such a proceeding shall include an award thereof. Any disputes arising out of this Agreement or activities taken pursuant to this Agreement shall be subject to binding Arbitration pursuant to the California Code of Civil Procedure, sections 1280, et seq. The parties shall first attempt in good faith to resolve any disputes through direct negotiation and communication before invoking arbitration. This agreement is made, entered into, executed in Sacramento County, California, and any action filed in any court of jurisdiction for arbitration for the interpretation, enforcement or other action of the terms, conditions, or covenants referred to herein shall be filed in the applicable court in Sacramento County, California. Nothing contained in this Agreement shall be deemed, construed or represented by CAPRI or CARPD by any third person to create the relationship of principal or agent, or of a partnership, or of a joint venture, or of any other association of any kind or nature between the CAPRI and CARPD. This written Agreement constitutes the entire agreement of the parties concerning the subject matter hereof. This Agreement shall not be amended in any way except by a writing expressly purporting to be such an amendment, signed and acknowledged by both of the parties hereto. Should interpretation of this Agreement, or any portion thereof, be necessary, it is deemed that this agreement was prepared by the parties jointly and equally, and shall not be interpreted against either party on the ground that the party prepared the agreement or caused it to be prepared. CARPD and CAPRI each retains the right to terminate this agreement for any reason prior to completion by notifying at least 90 days in advance the other party in writing. 14. The fees in full compensation to CAPRI for the services rendered shall be as set forth in Item 15. As indicated, CAPRI’S total fee for this project shall not exceed the amounts set forth unless authorized in writing by CARPDʹs Board of Directors. All reimbursement paid by CARPD under the terms of this agreement shall be paid only to CAPRI and CARPD shall under no circumstance be responsible for directly reimbursing CAPRIʹs officers, agents, employees, and contractors. The compensation specified above is all‐inclusive and shall include CAPRI’s cost for its office space and meeting rooms, phones and computers, staff compensation (including the “General Manager” position), travel, stationery and postage, etc. Unusual expenditures outside of normal office and staff expenditures (such as rental of outside facilities, retaining outside vendors, hosting the CARPD web site) shall be outside the contract price but will not be incurred without approval of the CARPD Board. 15. 16. 17. Compensation under this contract will be $62,000 for fiscal year July 1, 2015 – June 30, 2016, $64,000 for fiscal year July 1, 2016 – June 30, 2017, and $66,000 for fiscal year July 1, 2017 – June 30, 2018. Compensation is to be paid in quarterly installments, in advance, on the first business day of each quarter. On completion or termination of agreement, CARPD shall be entitled to immediate possession of, and CAPRI shall furnish all documents, reports, correspondence, and other pertinent data and information gathered or computed by CAPRI for CARPD prior to any termination and/or completion. Any information, data, report, information, exhibits, data, documents or materials given to or prepared or assembled by CAPRI under this agreement shall be confidential and shall not be made available to any third person or organization by CAPRI without prior written approval of CARPD, unless disclosure of such information is otherwise required by law. INSURANCE REQUIREMENTS: CAPRI is solely responsible for its own insurance, and CAPRI understands that it is undertaking the work described herein entirely at its own risk. CARPD is not responsible or liable in any way for the conduct of CAPRI’s services provided under this Agreement. CAPRI at CAPRI’s sole expense shall secure proof of: a. Workers’ Compensation and Employer’s Liability in accordance with applicable laws. b. Comprehensive Commercial Liability policies with combined single limit coverage of $1,000,000 for any personal injury, death, or property damage. c. Comprehensive Automobile Liability policies with combined single limit coverage of $1,000,000 for personal injury, death, or property damage. CARPD shall be named as an “additional insured” on CAPRI’s insurance policy for the entire period this agreement is in force. CAPRI understands that no payments will be made under this agreement by CARPD to CAPRI prior to CARPD’s receipt of written evidence of: 1) General and Automotive Liability Insurance in the amount indicated in this section, and with a certificate of Page 4 of 7 Page 40 of 84

insurance showing CARPD as an “Additional Insured,” 2) Workers Compensation Insurance, and 3) Automobile Insurance including comprehensive and collision coverage. 18. 19. 20. Except for payments for Section 15, on presentation by CAPRI of an invoice to CARPD by the fifth working day of the month and which has not been disputed by CARPD in writing to CAPRI within fifteen (15) calendar days of receipt thereof, payment shall be made by CARPD to CAPRI within thirty (30) working days of receipt by CARPD. It is understood that all invoices must be for work completed, delivered, and accepted by CARPD, provided that the maximum fee for any work shall not exceed the amount stated in the agreement that authorizes it. Payments shall at no time exceed the proportion of services completed by CAPRI at the time of invoicing as compared to the total services to be rendered by CAPRI. CARPD reserves the right to inspect the work being done by CAPRI at any time. CAPRI agrees that CARPD shall have access to CAPRIʹs work records and associated documents for the purpose of auditing or evaluating contested fees and/or work product. CARPD shall complete an annual performance evaluation of CAPRI and the services provided under this Agreement, and provide written feedback on such performance to CAPRI. CAPRI shall make every effort to respond to and correct items identified by CARPD in the annual performance evaluation to improve the services listed in this Agreement. Any notice to be given pursuant to this agreement shall be in writing, and all such notices and any other document to be delivered shall be delivered by personal service or by deposit in the United States mail, certified or registered, return receipt requested, with postage prepaid, and addressed to the party for who intended as follows: a. b.

21. RELATIONSHIP OF PARTIES; AVOIDANCE OF CONFLICT CARPD was a sponsoring organization in the founding of CAPRI and, according to CAPRI governing documents, is authorized to appoint two members to the CAPRI Board of Directors, who serve without compensation at the pleasure of CARPD. In order to avoid any conflict of interest for the Board members so appointed, it is agreed that the CARPD‐appointed CAPRI Directors will not participate in the discussion or vote on the adoption of this Agreement, or any matter arising out of or in connection with the performance of this Agreement. 22. BEST EFFORTS CAPRI agrees to use its best professional efforts in support of CARPD’s mission in the performance of this Agreement. Workers’ Compensation – New Member
BACKGROUND AND STATUS:
Silverado Modjeska Recreation and Park District has expressed an interest in joining the
Workers’ Compensation Program. Silverado Modjeska Recreation and Park District is a
member of our Liability Program and purchase their Workers’ Compensation insurance through
the State Workers’ Compensation Fund.
The Board approved Silverado Modjeska Recreation and Park District last February 2014 but
they didn’t join because of a timing issue with the State WC Fund. They may have the same
issue again this year. If they don’t leave at the end of a policy period with the State Fund, then
they assess a penalty which makes it difficult to leave the State Fund. Silverado Modjeska had
turn over with their Board of Directors and with the staff so they didn’t start the process until a
few weeks ago.
Silverado Modjeska Recreation and Park District has a payroll of $55,183. They have had no
losses in the last 5 years. Staff provided them a quote of $955.00.
RECOMMENDATION:
To approve Silverado Modjeska Recreation and Park Districts into our Workers’ Compensation
Program.

WC – Pharmacy Benefit Management Program
BACKGROUND AND STATUS:
York is pleased to offer a Pharmacy Benefit Management Program (PBM) that serves to expedite
treatment to the injured employee while providing a greater amount of control and savings for
CAPRI and its members. The PBM service is offered through our partner, Helios, which
provides several advantages that will enhance your workers’ compensation program.
Benefits:
The pharmacy program is designed to ensure that your injured employees have immediate access
to approved medications related to the recovery of industrial injuries without incurring out of
pocket expenses. Payments for all medications obtained through the program are reimbursed at
or below California fee schedule rates and when available generic medications are dispensed.
Through the PBM a formulary of medications is pre-established listing specific drugs commonly
used for the industrial injury based on body part and NCCI codes. This allows the injured
employee the ability to receive medications and blocks medications that are not related to the
injury. Beyond the formulary, an electronic data transfer feed is established to ensure that the
pharmacy is provided expedited information.
A strong utilization program reduces opportunity for fraud, misuse and abuse - helping to control
unnecessary spending. Managed by clinical pharmacists, an effective program includes
medications plan management, prospective reviews, concurrent alerts and retrospective
application of out of network pharmacy treatment.
Some of the most successful programs involve collaboration and automatic conversion.
Recurring or long term prescriptions may benefit in the home delivery program, which allows
significant savings to CAPRI, while District employees receive the added benefit of scheduled
home delivery.
Negatives:
York has been utilizing this program with multiple clients for many years and has not received
any negative feedback.

Implementation:
Once the Board of Directors provides approval of the PBM, Helios will activate and mail out
pharmacy cards on all open workers’ compensation claims. Additionally, cards will be mailed
out once new claims are set up within our system. The employee brings the pharmacy card to the
pharmacy when medications are prescribed by their workers’ compensation physician. The
pharmacy then contacts Helios for approval.
Cost to CAPRI:
There are no costs to CAPRI or its members. Medications are paid via the claim file at a
negotiated rate which is at or below California fee schedule rates.
Savings:
CAPRI will enjoy a negotiated rate for all prescriptions filled and when available additional
savings obtained by filling prescriptions using generic medications. CAPRI’s program ensures
the safety of District employee’s prescription drug use by conducting drug interaction reviews
with other medications on file, drug utilization reviews for quantity/duration and compliance
with the pre-established formulary.

CAPRI currently has a loaner in the office to get staff by until we can lease a new copy machine.
As of this writing, staff is going to obtain a number of quotes from various vendors to lease a
color copier/scanner/fax machine for CAPRI.
The lease of the new copier/scanner/fax machine is not in the budget so we are requesting Board
approval to lease a new copier/scanner/fax machine.

Our three year contract with York Insurance Services expires on July 1, 2015. As you may
recall, we went out for a Request for Proposal in 2012 for WC Third Party Administration
Services as a result of an unsatisfactory claims audit that we received from CSAC-EIA. We
interviewed a number of vendors and decided to stay with York mainly because we were familiar

$60,000. Our current contract for Claims Administration is at $183,800.
York has proposed a three year contract (2015/16 through 2017/18) starting at $192,990 for
2015/16, $198,780 for 2016/17 and $204,743 for 2017/18. The Managed Care Fees remain
virtually the same.
The service that we have received has improved steadily in the last 3 years and has really
improved in the last 6 months since Sally Towns and Morgan Fuit have handled our claims. We
have been closing claims at a faster rate than they have been opening claims. In fact, we have
closed so many claims that the claims load for Sally Towns has dropped to the point that we are
sharing her with another JPA until the summer when our claims volume increases. It is staff’s
recommendation that we approve the 3 year extension.

Update on CAJPA Accreditation
BACKGROUND AND STATUS:
Staff has been working with James Marta of James Marta & Company on the proper steps to
acquire our CAJPA Accreditation. James Marta is one of the CAJPA consultants responsible for
accrediting JPA’s. Staff met with James in our office on Thursday, January 15, 2015 at 10:00
a.m. and walked through the steps necessary to get accredited through CAJPA.
As this time staff is collecting all needed paperwork and forms to assemble our report. CAPRI
has a future meeting pending with Mr. Marta to review our paperwork to continue our process.
One of the biggest hurdles will be having an annual meeting of the Board of Directors
(membership) to update them on coverages, approval of the budget, approval of officers, etc.
Staff will have to update our Bylaws and go through archives to make sure we have every JPA
Agreement resolution from all members and past members.
Staff will continue to update the Board on our progress on the Accreditation process.

BACKGROUND AND STATUS:
CAPRI continues to have very little interest in the space next door. Staff has had 2
inquiries/showings of our space since our last meeting.
The market in the Sacramento Valley continues to be very weak. The overall vacancy rate for
the greater Sacramento region is 20.12% in the 4th quarter of 2014 that is a drop of 1.57 percent
from last year. Most of the office leasing activity has occurred in the Roseville and Rocklin area
in Placer County. These areas account for nearly 70% of the leasing activity in the region.
Staff will discuss this in greater detail at the meeting.

BACKGROUND AND STATUS:
Attached is the District Visitation Summary for Cycle XIV, along with the District Visitation
Summery and History for review.
There were seven (7) district visits completed during the months of November 2014 thru January
2015.
Highlands – January 22, 2015
Highlands received a Very Good evaluation.
Safety Committee
District Safety Committees are required to meet no less than quarterly, with minutes of the
meetings sent to CAPRI within 60 days of the date of the meeting. The composition of the
Committee reflects the staff of the District. Strong committees don’t stop with recognizing
hazards or needed corrections. They follow through on those corrections and document their
results. They inspect District sites and review site inspection reports. When necessary, they
investigate employee and patron accidents, including near misses. Committee minutes
accurately reflect discussions of the agenda items.
Inspection Program
The District’s inspections take place on a regular basis and use site-specific inspection forms.
The forms are signed and dated by the individual conducting the inspection. Repairs completed
during the inspection process are documented on their inspection form.
Screening and Review
The District is doing a good job maintaining up-to-date information on employee proof of
automobile insurance for those employees who use their personal vehicles on District business.
They conduct an annual review of the driving records for all employees who operate District
vehicles, or their personal vehicles on District business. The District has developed a written
policy for dealing with drivers who have obtained an unacceptable driving record. The District’s
supervisors have attended sexual harassment training as mandated by Assembly Bill 1825. The
District conducts fingerprint background checks on all employees and volunteers who have
supervisory or disciplinary responsibility over minors.

The District is aware of their obligations, under Title II of the Americans with Disabilities Act
(ADA) to make their facilities and programs accessible to all individuals. In this regard, they
have completed a self-assessment of their sites and facilities within the last five years. From
that assessment they have developed a detailed prioritization and implementation plan and are
working toward bringing their District into full compliance. They are also aware that under Title
I of the ADA they are required to make reasonable accommodations for qualified individuals
with known disabilities. To be in compliance with the Fair Employment and Housing Act’s
requirement to enter into a good-faith, interactive process when the need for accommodations
arise, whether from an ADA issue, workers’ comp issue, or both, they have established
procedures for entering into a good-faith, interactive discussion when reasonable
accommodations are indicated.
Injury and Illness Prevention Program (IIPP)
The District’s IIPP has identified the individual responsible for implementing and maintaining
the program. They have a system in place to identify, evaluate, and correct unsafe and unhealthy
conditions. They have developed an extensive in-house safety-training program for their
employees. They have a system in place to ensure employee compliance with safe and healthy
work practices, and have developed a policy for reporting hazards without fear of reprisal. The
District conducts an annual review of their IIPP and documents that review through their safety
committee.
Waiver and Release
The District’s waiver and release forms use CAPRI-approved language. They are used for all
activities where registration is required.
Facility Use Agreement
The District’s facilities use agreements use CAPRI-approved indemnification language. They
have standards when to require liability insurance and when to obtain an additional insured
endorsement.
Parks and Facilities
Overall, the District’s parks and facilities evidence good care and maintenance. Park structures
are in good condition and their playgrounds comply with the California Code of Regulations for
playground safety.
Pools
The District’s lifeguards have received appropriate training and certification. Pool facilities are
well maintained and in good condition. Pool pump room was clean, neat, and well maintained.
The water clarity was being maintained at appropriate levels.
Entrance Medical Exam
The District requires a post-offer, preemployment medical examination for all full-time
employees. Applicants are made aware that the job offer is contingent upon a satisfactory preemployment medical examination. The District does not send applicants for their medical exam

until all other background checks have been completed. All medical related information is

The District utilizes the services of volunteers. They maintain a log of all volunteers by job
classification. The District reports that the volunteers receive appropriate safety and health
training based on the nature of the work. Volunteers are supervised by District personnel.
Life Safety
The District’s Material Safety Data Sheets are current and readily available at appropriate job
sites. Their fire extinguishers are charged and properly tagged. Fire exits are clearly identified
and free of obstacles. Emergency evacuation plans have been developed and drills are conducted
at least annually.

Safety Award Plaques
BACKGROUND AND STATUS:
The Safety Awards are derived through the District Visitation Program, and are based on a set of
risk management guidelines identified in the District Visitation Criteria. Each member district is
encouraged to implement the District Visitation Criteria. Those members that put into practice a
minimum of 93% of the suggested criteria earn a Very Good evaluation. To achieve a Very
Good evaluation in the Cycle XIV District Visitation Program, a District must obtain a minimum
of 53 out of a possible 57 points. In recognition of outstanding performance, District Safety
Awards are presented to those members who receive a Very Good evaluation. The following
districts are now eligible for a Cycle XIV Safety Award:

Very Good prior to the CARPD conference receive a Safety Award Plaque at the spring 2015
CARPD Conference.

SUBJECT:
Update on Risk Management Workshops
BACKGROUND AND STATUS:
Throughout the years, CAPRI has worked diligently to assist our members in preventing losses in all
aspects of district operations through the CAPRI training programs. Currently we are in the process
of putting together a workshop for mid to late March 2015. It will focus on reviewing insurance and
the different coverages available.
The primary presenters will be Pat Cabulagan (CAPRI Administrator) and Rick Richards (CAPRI
Risk Manager). As part of CAPRI’s ongoing efforts to make these workshops more accessible to our
members, CAPRI staff has introduced the webinar as a new training format. With this format
attendees will be able to participate from their home computers at their home districts, thus
eliminating the travel time for both the attendees and the presenters, saving money for all concerned.
It is hoped that this format would bring in attendees who have traditionally not attended these risk
management workshops in the past.
