Minister of Irrigation and Water Resources Management and the Leader of the House of Parliament Nimal Siripala de Silva yesterday informed the Parliament the Supreme Court has given the greenlight, allowing the President to stand for another round of elections. “It is with great pleasure I inform this House of the Supreme Court interpretation, which held that it lawful and not against the Constitution for President Mahinda Rajapaksa to stand for a third term. According to the Supreme Court, the necessary provisions are already found in the Constitution,” he told the House. On Monday night, the Supreme Court delivered its determination on incumbent President Mahinda Rajapaksa’s eligibility to contest for a third term to the President at Temple Trees. The opinion was endorsed by the nine Supreme Court judges who met at the Chief Justice’s room at the Supreme Court yesterday. They discussed for about one-and-a-half hours before endorsing their opinion on the President’s requests. The Supreme Court Bench comprised Chief Justice Mohan Peiris, Justice K. Sripavan, Justice Chandra Ekanayake, Justice Priyasath Dep, Justice Eva Wanasundera, Justice Rohini Marasinghe, Justice B.P. Aluvihara, Justice Sisira de Abrew, Justice Sarath de Abrew and Justice Priyantha Jayawardena. Earlier, the President submitted a series of questions to the Supreme Court for its consideration asking the apex Court to submit its opinion on to him before 10 November. President Rajapaksa, who was elected in January 2010 for a second term in office, asked the Supreme Court whether the Constitution, as amended by the 18th Amendment, will allow him to declare his intention to contest for presidency after the expiration of four years from the date of commencement of his second term of office as President on 19 November 2010. The President made the request in terms of Provision 129 (I) of the Constitution. The Apex Court informed the Bar Association of Sri Lanka of the President’s request and asked them to submit any points they have in writing to the Registry of the Supreme Court by Friday, 7 November. Interested parties submitted 38 petitions to the Court both in favour and against the President’s inquiry. The Bar weighed in on behalf of the President and the majority of submissions were in his favour. The decision by President last week to seek Supreme Court opinion came under fire by Opposition parties as well as legal experts whilst Bar Association sought extended time to submit written submissions apart from wanting to make oral submissions. UNP Leader Ranil Wickremesinghe noted Supreme Court opinion on the constitutionality of the President seeking a third term has no validity since there is no legal binding in such an opinion. The JVP filed a motion to appeal to the Supreme Court to hear the opinion sought by the President in open court. The proposal will first go before the Administrative and Budgetary Committee and finally before the 193-member General Assembly, the highest policy making body at the United Nations, for approval. Currently, the UN annually commemorates a Day of National Observance for Vesak, a move that was successfully initiated by former Foreign Minister Lakshman Kadirgamar on the recommendation of the International Buddhist Conference in 1998. In 1999, Sri Lanka and 15 other countries requested a UN holiday for Vesak, a sacred day to the world’s more than 500 million Diabetes hits epidemic levels in Sri Lanka by Carol Aloysius Buddhists and a national holiday in Buddhistmajority countries. The UN advised that there would be financial implications and the countries concerned settled for the UN acknowledging the importance of the day. Recently when Israel requested that Yom Kippur be declared a holiday, the UN revising its position, advised there would be no financial implications. As a consequence, a number of Buddhist and other countries, led by Sri Lanka, have revived the request that Vesak be declared a UN holiday. Currently the matter is being discussed at the highest levels at the UN. Following Sri Lanka’s initiative, India has suggested that it may ask that days sacred to Hindus, Jains and Sikhs also be declared holidays by the UN. Senior BJP member Subramanian Swamy said that the agreement was reached following talks held yesterday between President Mahinda Rajapaksa and Indian Prime Minister Narendra Modi. Swamy said that during a telephone conversation between the President and Indian Prime Minister, the two sides discussed the issue over the five Indian fishermen which has now become a sensitive matter in India. President Rajapaksa and Prime Minister Modi had discussed processing the documents to transfer the five Indians to an Indian jail. The Indians had been sentenced to death by a local court after being found guilty of smuggling drugs. Two other Sri Lankans were also found guilty and given the death sentence in the same case. According to the survey this increase would occur largely in the Indian and Asian subcontinents, due to the genetic, environmental and social factors and 90-95 percent people would have Type 2 diabetes. The latest research on Sri Lankans with diabetes and pre-diabetes by Consultant Endricrinologist and Diabetologist Dr Prasad Katulanda has revealed that 10.3 percent of Sri Lankans have Type 2 diabetes and 11.50 percent had prediabetes (impaired fasting glucose) the majority of whom are unaware of it. According to global statistics of 2013, 46 percent pre-diabetics are unaware they had the disease. Although the number of deaths from diabetes had declined with improved facilities health officials said there was a disturbing trend in the increase in the number of diabetics among pregnant mothers. Screening of pregnant women in five MOH districts at Piliyandala, Padukka, Pitakotte, Kadawatha and Hanwella in 2010 revealed that 19.3 percent of pregnant mothers suffered from gestational diabetes (diabetes during pregnancy). Co-ordinator Diabetes Prevention Task Force of the Sri Lanka Medical Association Dr Hasitha Fernando, told the Sunday Observer that although most of these mothers had been cured, many developed diabetes when they resumed their former unhealthy lifestyles. A Diabetes Walk will be held on November 14 (World Diabetes Prevention Day) from the Independence Square and conclude at the BMICH. There will be a free screening for diabetes and several lectures will be held on diabetes by a panel of experts at the BMICH. "All are welcome", media spokesperson Dr Suguni Galapathi said. The victims identified as Mahadurage Prasad Manoj Kumara (36) and Mahadurage Rasaal Wasantha Kumara (38) were living in Nawadunna. A gang of several men armed with axes had confronted the brothers near the Gammaduwa temple and had hacked the duo causing serious injuries. They were rushed to the Matara Hospital but were pronounced dead on admission. The Gandara police had deployed a special team to arrest the suspects who are absconding. ISSUE 1197 Koslanda landslide rescue operations to stop By Preamalal Wijeratne (ceylontoday.lk) It has been decided to halt the rescue operations in search of those missing at the landslide sites of Meeriyabedda, Koslanda. The Minister for Disaster Management, Mahinda Amaraweera, revealed these operations have to be halted owing to affidavits submitted by the relatives of the dead. These excavations that are going on for the last 11 days are stirring up the emotions of the relatives, and since the latter have made a request, it has been decided to stop the operations, and to start the burials, he added. Meanwhile, 12 bodies of missing persons have been found by yesterday, according to Rohana Keerthi Dissanayake, the Badulla District Secretary. It has been planned to construct 70 houses on a land of about two hectares situated in the vicinity on Ampiti Hill Estate. The construction is to be commenced next week with the assistance of the Army. Badulla District Secretariat will be providing the building materials, the District Secretary further observed. SL ranked 62nd in World Prosperity Index (dailymirror.lk) Sri Lanka slipped down two notches to 62nd place in this year’s Prosperity Index prepared by Legatum Institute, which measures the well-being of country’s people and its wealth. The 2014 Legatum Prosperity Index has covered the economy of 142 countries with Norway topping the list and followed by Switzerland, New Zealand, Denmark, Canada, Sweden, Australia, Finland, Netherlands and the United States. According to the index Sri Lanka was ranked 58 in 2012 and it was brought down to 60 in 2013. Meanwhile, Nepal was ranked 96th, India 102nd, Bangladesh 104th, Pakistan 127th and Afghanistan 137th. The 10 countries making up the bottom was Central African Republic, Chad, Congo, Burundi, Yemen, Afghanistan, Togo, Haiti, Sierra Leone and Guinea. Sri Lanka was also found to be among the five countries with world's highest rate of marriages with China having a rate of 80%, Bangladesh 76%, Nepal 76%, Laos 73% and Sri Lanka 73%. (defence.lk) Northern expressway gets off the ground (dailymirror.lk) Construction work on the Northern Expressway will be launched tomorrow by President Mahinda Rajapaksa, Highways Project Minister Nirmala Kotalawala said yesterday. The project was initiated following requests from the people of Kandy and it was initially named as the Colombo – Kandy Expressway. However, the President had later directed that the expressway be extended to cover the Northern, North- Central and the EasternProvinces as well, the minister said. He saidseveral ceremonies have been organised at the interchanges of the expressway in Kurunegala, Galagedara and Rambukkana. “The construction will be carried outby local engineers with the help of local constructors. We hope to complete the project within four years,” the minister said. Thomas’ College ISSUE 1197 Opening a new chapter in Sri Lankan Scouting (dailynews.lk) The 16th Colombo Scout Group of S.Thomas’ College, Mount Lavinia has again successfully initiated a project that would benefit the entire Scout Movement in Sri Lanka, which will add a new section to their Scout Group and open a new chapter in the history of scouting in the country. The project is called ‘Singithi Scouts’. This concept, known internationally as Beaver Scouts, comes from the World Organisation of the Scout Movement, which encourages all students between five and a half years to seven years to experience Scouting. The Sri Lanka Scout Association too has decided to follow suit and has successfully taken the first step by promoting the concept in a few schools, of which the 16th Colombo Scout Group of S. Thomas’ College, Mount Lavinia became the first school to have the inaugural batch of Singithi Scouts in Sri Lanka. The first batch of Singithi Scouts was enrolled on October 7. The inaugural investiture ceremony for these pioneer Singithi Scouts will take place tomorrow at S. Thomas’ College, Mount Lavinia under the patronage of First Lady Shiranthi Rajapaksa who will grace this occasion as the Chief Guest. S. Thomas’ College has been selected as it has been actively involved in Cub Scouting for the past 90 years. Singithi Scouts too will get many opportunities to put their talents to good use and have fun outdoors. The Singithi Scouts program will be based on more outdoor activities and fun filled play time that will enable the little ones to bring out their talents. Areas of work include: handwork, games, acting, singing and storytelling. The World Scout Movement is now the largest youth body in the world comprising more than 30 million members. “Smart, Courteous, Obedient, Useful and Trustworthy” citizens have been the marvelous fruit of this movement for the last 106 years, since its S. Thomas’ College 16th Colombo Scout Troop 2014 inception in 1907 as the brainchild of Lord Robert Baden-Powell. Scouting was begun in Sri Lanka in 1912 and this year also marks the centenary of Scouting in the Colombo District (1914 - 2014). The 16th Colombo Scout Group has taken part in several competitions. ECJ to review lifting of LTTE ban before 15 Jan BY SULOCHANA RAMIAH MOHAN (ceylontoday.lk) The next hearing on the annulling of the restrictions imposed on the LTTE at the European Court of Justice (ECJ) will take place before 15 January 2015, according the French Ambassador, Jean-Paul Monchau. The French Envoy said before 15 January, the matter will be reviewed and brought forth in Brussels. He added, that annulling of the restrictions on the LTTE is the decision of the ECJ at the moment. "What you should know is that justice is totally a separate power in the EU countries and EU has a Parliament, a commission and a council and they have their Court." Explaining further as to how the LTTE matter came to ECJ, he said, "The Court received a complaint several years ago that the inscription of the LTTE as a terrorist organization is not legal for many reasons. The Court finally decided that it should be annulled however, the ambassador continued state the matter has not ended as yet." He stressed that while the LTTE restriction was annulled, at the same time the court also said they would keep the effect of this restriction for the next three months to see the possibility of reinstating it. "I know it surprised many people. But it's not the end of the story. We have a court which can tell the Council of the EU what is good and the Council has to correct it. There are no other intentions as many think." When asked who asked the ECJ to review the annulling of the restriction, the ambassador pointed out that still the EU considers the LTTE as a terrorist organization and the court has given three months to review the effects of the decision. Council will review the work which has been done. "The objective is to keep the LTTE listed as a terrorist organization. The views on the UN Chief were expressed following a war of words between the Sri Lankan Government and Zeid on the UN-led investigations on Sri Lanka. “The SecretaryGeneral supports the views of High Commissioner Zeid, and he agrees with High Commissioner Zeid that the Government of Sri Lanka should cooperate. And we will continue to urge that they do so,” Farhan Haq, Deputy Spokesman for the Secretary-General said. Last week the Government hit back at the UN High Commissioner for Human Rights, accusing him of using intemperate language to attack and vilify a sovereign member of the United Nations. In a letter to Prince Zeid Ra’ad Al Hussein, hours after he issued a statement accusing the Government of attempting to sabotage the UN led investigations on Sri Lanka, Sri Lanka’s Permanent Representative to the UN in Geneva Ravinatha Aryasinha, said that the actions of Al SLFP EXECUTIVE COMMITTEE Hussein would regrettably constrain constructive engagement which the Government of Sri Lanka has consistently sought to pursue. “It is a matter of deep concern to note that you, as a high official of the UN system, have resorted to the use of intemperate language to attack and vilify a sovereign member of the United Nations. Further, you have chosen to cast aspersions and denigrate a democratically elected Government. In fact, some countries have, on extremely cogent grounds, rejected mandates of the Council previously in much stronger ways, and have not been censured in the manner as in this instance. This undoubtedly confirms the double standards being applied. Wickremesinghe said that he had sent the letter after he found that the Government was not taking any firm action on the EU court order. EU judges had last month struck down anti-terrorism sanctions imposed on the LTTE by the European Union, citing a technicality, but said that the assets of the Sri Lankan group should remain frozen for the time being. The bloc’s lower court said a decision by EU leaders in 2006 to place the LTTE on a list of terrorist organisations had been based on “imputations derived from the press and the Internet” rather than on direct investigation of the group’s actions, as required by law. It said in a statement that the EU had also failed, when following Indian sanctions on the Tigers, to ensure that India gave sufficient judicial protection to those it accused. However, the court rejected the LTTE’s contention that it was exempt from EU anti-terrorism legislation because it was engaged in an “armed conflict” with the Sri Lankan government and bound by the laws of war. The court, which stressed it was taking no view on whether the LTTE was a terrorist organisation, said EU laws on terrorism also applied to armed conflicts. Saying that sanctions might be applied in future against the Tigers, who were defeated militarily in 2009, the court said assets that were frozen should remain so “temporarily”. The General Secretary of the party DEW Gunasekera has made this proposal on the Central Committee (CC) meeting on Sunday, November 9. Member of the CC of CPSL Raja Uswatakeyiyava said that the proposal was passed with a majority. While there were 26 votes for the proposal, 14 votes were against. One member reportedly abstained from voting. Those who opposed the proposal had severely criticized the president for preparing for a premature presidential election, with no regard to the proposal by the CPSL that the government should abolish the Executive Presidency. This situation has compelled some members of the party to support the Movement for a Just Society led by Maduluwawe Sobitha Thera. The movement has been campaigning with the goal of forcing the government to abolish Executive Presidency for some time. This development came in the wake of the controversy where the Communist Party of Sri Lanka withholding all the copies of the latest edition of ‘Aththa’ newspaper without releasing them to the market. This came as a result of the internal dispute of the Communist Party of Sri Lanka which is one of the oldest political parties in the country. Annual Kathina celebrations of Heathrow International Buddhist Temple were held on Sunday 2nd November 2014 in temple premises. On 1st Saturday at 6 pm there was a colourful Atavisi Buddha Pooja. It highlighted the 28 past Buddhas and also ancient practice of paying homage to the 28 past Buddhas. The head of the temple Ven. Wanduramba Kassapa Thero and the devotees of the temple made beautiful small pavilions and decorated nicely for that event. A dhamma speech was conducted by Most Ven. Borelle Athula Thero. The day was a great success. Devotees and other members of the community organised the event under the guidance of the head of the temple Ven. Wanduramba Kassapa Thero. More than 200 devotees participated in the event with great devotion. The Kathina day commenced with the materials for the Kathina robe being brought to the temple from the sponsors' home. Other devotees joined in a peaceful procession to the temple before sunrise. The Kathina Robe was carried on their heads in a large Kathina procession and offered to the monks by the devotees with deep devotion. The ceremony started at 6.00 a.m. After the offering of kathina robe, Dhamma talk was given by Most Ven. Borelle Athula Thero and Ven. Wanduraba Kassapa Thero who explained the significance of offering a Kathina Robe. Along with the fellow monks, he chanted 'pirith' and blessed those who were present. He stressed that 'pirith' chanted on that day was most effective and powerful since the monks had gathered so much of energy within, having spent three months meditating. Thereafter 'pirith' water was given everyone present as a further blessing. Subsequently arrived the time for the serving of 'dana' and everyone lined up to serve a portion of rice and other dishes prepared by the participants with special care and attention to the monks,. While the monks finish the 'dana' and took their positions in the hall once again to continue the ceremony lay crowd too had refreshments, the offering of the 'katina' robe then took place. It was offered to Maha Sangha after which the monks eloquently expressed words of acceptance; subsequently the monk to whom the robe would be offered was announced indicating why that particular monk would receive it. The ceremony was then continued with the rest of the offerings being made to the monks. Thereafter Ven Makure Mangala commenced the final stage of the ceremony by conducting 'punyanumodana' for the devotees. The ceremony was then concluded with lunch being offered to the participated crowd. Bens played the final of the Veterans Championship organized by the Soccer Masters Association for the sixth year against Maligawatte Veterans SC at the St. Benedict’s College ground recently. The game was played well by both sides displaying the best soccer available with these former players, some of them former national players. Old Bens had full control of the game for almost 20 minutes but they failed to get the most vital goal due to the hard work of Maligawatte custodian who did yeoman service between the posts. In addition to his studies he was a house captain, a school prefect, the College first XV Rugby Captain in 1960 and Captain of Athletics in 1959. He still holds the record for the number of Bradby Shield matches he played against Trinity, which was a consecutive ten matches over five years. This record was equaled recently but not broken. H.S. was hefty, tall, sturdy and physically fit. So was his younger brother, Lalith. With both of them as my props in the scrum, as the hooker, I had it quite easy. H.S. was always a dedicated Royalist, rarely missed our annual 1952 group get-togethers and any rugby events. On leaving school in the same year, both of us played for the first XV CR&FC side in the Clifford Cup Tournament. During this time, H.S. picked me up for rugby practices at Longden Place and dropped me back at my home in Kollupitiya in his Morris Minor. He always took a devious route to Longden Place, via Bullers Road and sounded the horn a couple of times before reaching the traffic lights. It took me a few days to realize that he was trying to attract the attention of his girlfriend, Neleeka, whom he married later on and with whom he lived happily ever after. Their two sons have done extremely well in their chosen professions, one in the U.S. and the other now back in Sri Lanka. As in school, his long tenure in the private sector was highly acclaimed. Despite his very successful overall background, he was soft spoken and humble. He was a very pious Buddhist. Penney, who was Sri Lanka’s assistant coach during Tom Moody’s tenure as head coach was earlier considered for the dual role of assistant and fielding coach as part of a major shake-up in the coaching set-up. “We have signed him up to the World Cup as the fielding coach,” confirmed SLC CEO Ashley de Silva. Penny would fill the void created by former fielding coach Ruwan Kalpage, who chose to take a job with the Bangladesh national team instead of pursuing reappointment in his position.
