include ve~erinarymedicine or veterinary surgery or the
Homoeopathic, the Ayurvedic or the Unani system of

registered under the provisions of this Act ;

3. A Council shall be established and called 'rthe West. Bengal
Medical Council"] ; and such Council shall be a body corporate and
have perpetual succession and a common seal, and shall by the said
name sue and be sued.
'4. ' ( I ) The 'Council shall consist of the Following members,
namely :(a) three members lo be nominated by the State govern men^;
(b) one member to be elected from amongst themselves by
such members of [heauthoritiesof each of the Universities

(c) two members to beelected from amongst themselves by the

Explarlofion.-For the pllrposes of this su b-sec tion, "Uni versi ~ y "

(2) [ f a person is elecled as a member under more than one of the
clnuscs of sub-section ( I ) . lie shall, within such period as may be
prescribed by rule made in this behalf under section 33. inform the
Registrar under which ofthe clauses he desires to be treated as elec~ed
and thereupon he shall be deemed to have been elected under that
clauseand theseat towhich hewaselected under any otherclauseshall
be deemed lo be vacanr. Unt i t he so informs the Registrar he shall no1
beenlitled to act as a member; and in rheevent of his failure lo inform
the Regisrrar within the prescribed period.every seat to which he was
elected shatl be deemed to be vacant.
5. If any of the electoral bodes refcrred l o in '[clauses(h) l o ( c )
of sub-section (I) of sec~ion41 does nol, by such date as may be
prescribed by rule made in rhat behalfunder section 33, elect aperson

6. A person shall be disqualitied for being elected or nominatcd

offence, such sentence not having been subxquently reversed or quashed, and such person's disqualification on
account of such sentence not having been removed by an

manner provided in such clause ;

shall, if not disqualified under section 6 , bedeemed to have
been elected in the place of such member :
Provided thai( i ) where there are several candidates who secured such maximum number of votes, such oneof them, as may beelecled
by lot in accordance with rule made in this behalf under

Exp1mtation.-A candidate elected under this clause shall be
deemed to have vacated his seat if he rehses in'wrjting to
serve as a member of this Council.
( 2 ) The term of office of a member, nominated or elected or
deemed to have been elected, under sub-section (I),
shall commence
on such date as may be notified in this behalf by the StateGovernment

whose place he fills would have been entitled to hold office i f the

(3) No acr of the Council or of any Cornmitree of the Council or
of their members shall be deemed lo be invalid by reason clnl y that the
number of members in rhe Council at the time of the performance of
such act was less than the number provided by seaion 4.

recommend in such manner as may be prescribed by rule made in this
behalf under section 33, the names of three persons ror the purpose of

persons to be the Presiden~of the Council.

(3) The Slate Government shall publish the name of [he President
in the Oficial Gazette and his term of office shall commence from rhe
date of such pubticalion.

(4) The President shall hold office for a period OF five years, or
unlil his successor is nominated, whichever is longer.
(5) The President(a) may ar any rime by writing under his hand addressed to the
State Government resign his office,
( 6 ) shall be deemed to vacate his office in all cases where a
member is deemed to vacatc hi? office under sub-section
(I) of section 9.
(6) As often as the office of the President becomes vacanl by his
death or under sub-secdon (5), he Council shall at a special meering
to be called for the purpose within one month of [he vacancy,
recommend i n such manner as may be prescribed by rule made in this
behalf under section 33, the names oFthree persons for the purpose of
this sub-sections; and the Srare Government shall nominale another
President from such persons.
(7) A President nominated to fill a vacancy, shall hold ofice for
so long as the President whose place he fills would have been enritted
to hold office if rhe vacancy had not occurred. ( 8 ) The President shall perform such functions as may be prescribed by rule made in [his behalf undcr section 33.
(9) Notwirhstanding anything contained in the foregoing subsect ions. for a period offive years from the I 5th day of January, 1 955
and for such additional period as may expire until the nomination of
a President under sub-section ( I ) , the State govern men^ shall appoint,
as often as may be necessary, such person, as it thinks fit, ro be the
Presidenl. The provisions of sub-sections (2). (3), (4). (S), (7) and (8)
shall apply to such President.

'11B. ( 1 ) The members of [he Council shall at their first rnee~ing
after the notification referred to in sub-sec~ion( 1 ) of section 1 1, elect
among themselves a Vice-Presidenl in such manner as may be prescribed by rule made in this behalf under section 33.
( 2 ) A Vice-President( a ) may at any time by writing under his hand addressed to the
State Government resign his office,

(2) The Executive Committee shall consist of the President and
the Vice-President, rx-oficio, and five other members elected by the
Council.
(3) The President and the Vice-President of the Council shall be
the President and the Vice-President, respectively, of the Executive
Commitlee.
(4) The term of office of. an elected member of the Executive
Commitlee shall be two years from thedateof hisclsction but, subject
to his being a member of rhe Cpuncil, he shall beeligible for re-election
to the E x e c u ~ i v Commitlee.

(5) No business shall be transacted at any meering of the Executive Committee unless a quorum of three members be present.
(6) The Council may make regulations under sub-section (3) of
section 33 for he conduct of business of the Executive Committee.
12. ( 1 ) The Council shall make regulations to regulate(a) the times and places at which their meetings shall be held,
( b ] the issue of notices convening such mee~ings,'*

special commit tees including specialcommittees appointed

or, in case of an equality of votes. by the casting vote of the
