Town attorney cited for intentional misrepresentation of ‘bribe’ info

Warren County Report has received information that Front Royal
Town Attorney Tom Robinett will
soon be added as a fourth individual
defendant in a $30-million lawsuit
filed by local representatives of the
company that brought the initial solar power proposal to the town government in mid 2009. At the time the
SolAVerde lawsuit was filed in July,
three “John Does” were listed as potential defendants yet to be identified
by the plaintiffs.
If so named, Robinett will join sitting town Councilmen Tom Sayre,
Carson Lauder and Vice Mayor Chris
Holloway as individually named defendants in the defamation of character and illegal interference in a
business contract lawsuit brought by
SolAVerde principals and local businessmen Greg Horton (Arctic Air)
and Donnie Poe (Poe Construction).
The Town of Front Royal is also
named as a defendant in the suit
which seeks $30 million in actual
damages, responsibility for which
would be split equally among all
defendants, as well as an additional
$350,000 per defendant in punitive
damages. As of September all 26th
Judicial Circuit judges recused themselves from the case due to Sayre’s
presence as a defendant who also
practices law in the 26th Judicial District.
As recounted in our 2010 Year
in Review section, the lawsuit was
served to the town and councilmen
during a break between a July 19
work session and closed meeting. If
served individually, it will be Robinett’s second receipt of the lawsuit.
Robinett accepted the initial serving
on behalf of the town in his role as

And it is other actions alleged to
Robinett as town attorney that have
resulted in his pending addition as a
defendant in the case according to a
draft of the amended complaint sent
anonymously to this newspaper the
first week of January.
According to that amended complaint, Robinett is cited for “intentional” and “malicious” providing of
incomplete information to the Richmond law firm of Troutman Sanders
in seeking an answer to questions
first raised to him by Holloway and
Lauder on March 30. Those questions were whether jobs and an estimated $1.2 million in direct economic benefit to the town cited by then
Town Manager Michael Graham in
a March 29 closed session could be
construed as bribes offered by solar
principals to the town manager.
The draft motion acquired by this
paper states Robinett is being added
“as a defendant in his personal capacity as town attorney for actions
in not providing Troutman Sanders
with all the facts necessary to make
an informed legal opinion. That it
was intentional … and that it was
malicious and intended to harm the
plaintiffs … and that [Robinett] was
well aware that SolAVerde was not
a bidder in the RFP process … and
he did not take steps to protect the
plaintiffs when the information became public.”
Silek unsuccessfully sought a public apology and settlement from the
town in the wake of the “solar bribe”
issue going public last April 13. At
the time the lawsuit was served Silek
said, “They chose to publicly defame
my clients and they chose this pro-
cess. We publicly asked for a retraction on several occasions and that a
settlement be offered. I have repeatedly asked that the source of the leak
[of the Troutman Sanders opinion
and associated Robinett memos]
man up and come forward. To me,
the only reason that person or persons haven’t yet come forward is self
interest. They have put their individual self interest above that of the
Town of Front Royal and exposed all
of the town to liability – that’s how
selfish that person is.”
Ben Orcutt, the author of the series
of front page NVD stories about the
solar bribe inquiry and Troutman
Sanders opinion, has identified the
source of those confidential town
documents leaked to his paper as a
then-sitting member of the Front
Royal Town Council. Questioned by
this reporter in the past, all six councilmen at the time, Holloway, Lauder,
Sayre, Conkey, Parker and Hrbek, as
well as then Mayor Tewalt, have denied being that source.
Secret incentives?
In her memorandum on Robinett’s
questions to her firm, Troutman
Sanders staff attorney Megan Rahman wrote that yes, such economic

in its RFP (Request for Proposals)
and were not included in the written
proposal of the company. Instead,
they were apparently made secretly,
and one can easily infer that they
were intended to influence the procurement decision … Further, such
secret incentives likely provide a basis for another company to challenge
the entire procurement process.”
In prefacing her opinion, Rahman
references the town’s solar RFP (issued in December 2009), adding, “It
has come to the Town Attorney’s attention that, during the procurement
process, one of the top three companies secretly offered incentives
to the Town Manager that were not
contained in its written response to
the RFP.” Rahman goes on to identify
those “secretly offered” incentives as
200 jobs and a $1.2 million payment
to the town.
“In sum, so long as the Town Manager has not accepted or agreed to
accept the offer, there does not appear to have been any violation of
either the criminal statures or the
VPPA (Virginia Public Procurement
Act). But, the actual offer itself does
constitute the type of benefit that
would be considered a bribe under
either 18.2-447 or the VPPA,” Rahman concludes.
And Robinett concludes his cover
letter to council and the mayor prefacing the Rahman opinion by stating,
“While ‘secret incentives’ may be a
normal part of private business, they
are clearly not acceptable in a public
business setting.”
Au contraire
However, the SolAVerde lawsuit
dates that company’s discussion of
the referenced incentives to open
town work sessions beginning in August 2009 and notes that Standard
Energy picked up those discussions
in October 2009 prior to the town
issuing the RFP in December of that
year. It adds that similar benefits to
the community are discussed in the
Standard Energy January 2010 RFP
response on pages 16 and 17. It further notes that Horton and Poe were
never principals of Standard Energy
and so were never involved in the
Standard RFP response.
Since the leaked “bribe opinion”
info surfaced last April, one citizen
activist and Graham supporter, retired U.S. Energy Department official Tina Hobson, has repeatedly
asserted to council, with documentation submitted at meetings, that the
job and economic benefits Robinett,
Holloway and Lauder all expressed
ignorance of prior to March 29, 2010
were documented at a series of public council work sessions and other
meetings between June and December 2009.
At issue for both plaintiffs and at
least one pending defendant now is
whether the information Robinett
provided to Troutman Sanders was
complete, accurate and reflected the
town attorney’s full knowledge of the
circumstance of the solar negotiating
process and Standard Energy RFP response.

comment on his potential inclusion
as an additional defendant in the
case.
On Jan. 4, Mayor Tim Darr said he
was unaware of any pending move to
add Robinett to the list of defendants
in the case. Darr also noted that the
town’s legal defense was already in
the hands of a Virginia Municipal
League attorney (Julia Judkins), so
questioned any level of impact on
how a defense of the town and its accused officials would be prepared or
presented.

Warren County’s most famous

and Reality TV couple is due back
in a Warren County Courtroom
on an appeal of a $5,000 civil
claim he won against an executive at a national celebrity gossip
website.
On September 3rd in Warren
County General District Court
Tareq Salahi received a default
judgment of $5,000 against Dylan
Howard. Salahi claims Howard
never paid him an agreed upon
$5,000 fee for photographs taken
of Salahi and his wife Michaele
the weekend of February 20th at
the Salahis’ private residence in
Warren County.

At stake in the Jan. 7 hearing
scheduled before Judge W. Dale
Houff is a total of $5,451 in allegedly unpaid fees, interest and
court costs. Tareq Salahi is represented in the matter by Manassasbased, local attorney David
Silek.
The case file includes an alleged e-mail exchange between
Salahi and Howard dated Feb. 16,
18, and 19 indicating the Salahis’
agreement to do the photo shoot
the coming weekend.
“Michaele and Tareq, How is
everything looking for the photo
shoot I want to do? My offer of
$5,000.00 is firm and hope we can
do more after this. How is your
schedule the next two weeks?”
Howard e-mailed the Salahis on
Feb. 16 according to court records.
“Dylan, my wife & I have agreed.
Please confirm. We are free this
weekend,” Tareq Salahi replied on
Feb. 18.
On Friday, Feb. 19, again according to court records, Howard
e-mailed the couple to confirm,
stating he would take photos of
the couple together and separately, adding, “I will pay you $5,000
for the photos. In addition, if you
allow me to take video of you
two, Radar Online may also be
interested in purchasing that for
an additional $5,000 or $10,000
…”
Howard allegedly concludes
this final “pre-shoot” e-mail by
alerting Tareq that he “will also
need to ask some questions of
you about playing polo with
Prince Charles & Prince Harry.
You had some interesting anecdotes, from memory, about Harry.” The references are to Charles,
Queen Elizabeth’s son and heir
to the British throne and his and
the late Princess Diana’s youngest
son Harry. Ah, the trappings and
privilege of celebrity – but I guess
there’s baggage too.
Reached late Wednesday, a
spokesperson for WIDE EYE
Communications provided The
Lynchburg Times with the following statement:
“In a publicity stunt aimed solely at garnering media attention,
the Salahis, whose notorious
history speaks for itself, recently
named WIDE EYE and its principal Dylan Howard as defendants
in a frivolous lawsuit. There is
absolutely no merit to the Salahi’s
claims.
“We look forward to vigorously
defending ourselves in a court of
law and speaking with the Commonwealth of Virginia and law
enforcement to expose yet another fraudulent act perpetrated
by these individuals, in this in-

stance, the creation of fictitious
e-mails.”
Responding to this statement,
Salahi attorney David Silek said
the following:
“The Salahis are once again the
subject of a baseless attack. First,
WIDE EYE’s assertion that it is a
defendant in this matter is simply
false. So inquiry must begin with
that false assertion. Second, if service did not get to Mr. Howard,
fine. So be it. His attorney failed
to enter a special appearance and
rather entered what is known
as a general appearance in this
matter and has given our Court
jurisdiction over Mr. Howard.
Now that Mr. Salahi has counsel
in this matter, any procedural
difficulties will be corrected. We
look forward to setting this case
down for hearing and a trial on
the merits. We are certainly glad
that Mr. Howard elected to make
a general appearance and give
our court in personum jurisdiction over him, which was lacking
as he was served by the Secretary
of the Commonwealth.
“Third, Mr. Howard came to
Virginia to take pictures of the
Salahis and then I assume sold the
pictures to someone. It is a shame
that he now refuses to honor his
obligations.”

County ‘Dog Park’ gets grant from Litter Council
Canine run-loose park aiming for 2011 opening off Luray Avenue

In December the Front Royal-Warren County Anti-Litter
Council presented organizers of
the future Warren County Dog
Park with a grant award in the
amount of $2,500. The funding
will be used for the purchase of
trash and pet waste receptacles
for the facility.
The Warren County Dog Park
will be a three-acre facility that
will be added to the County’s
Eastham Park, located off of Luray Avenue. A one-acre area will
be provided for smaller or more
timid pets; while an accompanying two acres will allow larger
pets plenty of room to run. The
planning, development, and
funding of the park has come
from the combined efforts of
Warren County officials and the
Warren County Dog Park Association (WCDPA). The WCDPA
is a grassroots 501(c)3 association that was formed to bring
together dog lovers to promote
the establishment of off-leash
recreation in our community.
According to Association
President Kelly Walker, “Communities benefit from dog parks
because they make dog owners
and their pets better members of
their community. By providing
socialization and exercise opportunities, dogs are less likely
to create a nuisance by barking
excessively or destroying property.”
The idea of constructing a dog
park has been well received by
the Warren County community,
with many seeing multiple benefits that will result. The recreational area will provide dog
owners the ability to participate
in a variety of activities that are
not currently available including: off-leash dog socialization,
safe outdoor recreation for dogs
of all ages and sizes, and alternative exercise options for dogs
with elderly owners who have
difficulties walking their pets on
a lead. Pet owners are also expected to reap benefits from the
facility with research showing an
increase in bonding between pet
owners in the community, improved overall physical fitness of

Ribbon Cutting for new community center announced
Warren County officials have
announced that the official Ribbon Cutting Ceremony for the
new Warren County Community
Center will take place on Monday,
January 17th, at 3:30 pm. Speakers for the event will include
Daniel Lenz, Director of Parks
and Recreation; Reverend James
Kilby; Douglas Stanley, County
Administrator; members of the
Warren County Board of Supervisors; Pamela McInnis, Superintendent of Warren County Public Schools; and Representative
Frank Wolf of the 10th District,
Virginia. The event is open to the
public.
The former Samuels Public Library, located at 538 Villa Avenue
in Front Royal, was renovated for
conversion to the Warren County
Community Center over the last
year. The facility will be utilized
by the Warren County Parks
and Recreation Department and
Warren County Public Schools.
The facility has been modified
to include a music room, three
small classrooms, a computer
lab, two large classrooms, and an
assembly room. Support spaces
were also added including a lobby/reception area, two private of-

The construction was funded
by two federal grants; the first
a $246,000 grant from the U.S.
Small Business Administration
and the second a $445,500 grant
from the U.S. Department of
Housing and Urban Development. Representative Wolf was
the driving force behind Warren County receiving the federal
funding.

Maria Bolton is tireless in her efforts to raise money for the American Cancer Society’s annual Relay for
Life. Since losing her mother, Maria
F. Bolton, to cancer in 1995, she has
contributed thousands of hours of
time and energy toward fundraising
for the event. So it was fitting that
she be awarded the Volunteer Leadership Award at Front Royal chapter’s
November kick-off Rally for 2011.

But she was not expecting it.
“I was surprised and very honored
that my peers see me as a leader here
in the county,” she said.
She became involved with the event
a few years after her mother’s passing and was willing to share some
thoughts on the subject of cancer.
She said that the time caring for her
mother in her fight with the disease
was a big learning experience. “It was
one of the best times because I had
more quality time with Mom and one
of the saddest times because it was
so limited,” she said and added, “It’s a
sad fact that somewhere in life, most
people will be involved with someone who has to deal with cancer.”
Throwing herself into the position
as Relay chairman for the last three
years, Maria has initiated dozens of
fun and sometimes unusual ways
to raise money. One of those was
sparked by the fact that last year
some members were irritated at dogs
being barred by the no pet rule at the
official Relay for Life camp-out.
Why not give them an event of
their own? And raise money at the
same time?
And so was born the first annual
“Bark For Life” Relay this year. Twenty-nine dogs were registered, and the
event took place at Randolph-Macon
Academy in Front Royal. The fourhour canine fundraiser included dogs
dressed in Halloween costumes, enthusiastically doing their laps around
the field and dunking for hot dogs.
The total raised: $3,500.
According to her sister Christine
(Chrissy) Thomas, who is also active
in the organization, Maria’s efforts in
her chairman role has led the community in raising over $400,000. She
did this, Chrissy said, by tripling the
number of people involved in Relay
and involving cancer survivors in the
organization.
The goal now is to raise the number
of all participants from 131 to 150
and to change the total of 29 teams
to 50. Another idea being discussed
is to recruit younger people and get
the information out to various business and banks and involve them to
act as sponsors.
The kick-off rally held at the Raymond E. Santmyers Youth Center
was attended by about 50 dedicated
and caring individuals, and plans for
the 2011 Relay For Life 12-hour overnight event were discussed. It was
scheduled it to be held from six p.m.
on Saturday, June 11 until Sunday
June 12 at dawn. Camp is to be set up
at Skyline High School football field
and participants will walk around the
field all night long.
According to the American Cancer Society (ACS), the relays are held
overnight, “because cancer never
sleeps.”
Luminaries, or candles commemorating those whom cancer has
claimed, are to be arranged around
the field and lit at nine p.m.
Maria is still the chairman of that
fundraiser and she is still active in
raising money for the ceremony. The
overall goal for next year is $120,000.

Linden volunteer firemen charged with arson

Although Russo was kept in
custody until Dec. 27 on a $5,000
secured bond imposed by county
magistrate Kathy Weakley, when
Elsea was booked on Dec. 27th
he was immediately released by
a male video magistrate on a
$5,000 unsecured personal recognizance bond.
According to the arson arrest
warrant Russo admitted setting the fire when confronted
by County Fire Investigator Lt.
Gerry Maiatico. Information on
the Russo warrant filed by Deputy Chad Lamma also states that
Elsea initially admitted only to
seeing Russo set the fire with gas
from a can that was inside the
fire department. However, according to Elsea’s arrest warrant
he later admitted to department
investigator Maiatico that he
provided the container to Russo
Two young volunteer firemen
just recently voted to regular
membership in the Linden Volunteer Fire Department have
been hit with arson-related
charges related to a Christmas
Day fire in a small Linden Beverage out building they were involved in responding to. Linden
Beverage is located adjacent to
the Linden Fire House.
Darren Taylor Russo, 19, of the
perhaps unhappily appropriate
address of 3701 Fiery Run Road,
Linden, was arrested on December 25th and charged with arson. Troy Allen Elsea, 18, of 718
Warren Avenue, # 4, Front Royal
was arrested on December 27th
and charged with conspiracy to
commit arson.

Russo told the investigating
deputy that he “was just trying
to be a hero and be able to tell
his 5-year-old nephew he put a

Santa, nor it appears county

seeing little immediate consequence, Elsea then celebrated
New Year’s by getting charged
with assault and battery of his
girlfriend. Elsea was booked at
2:38 a.m. on New Year’s Day and
charged with assaulting Ashley
Hemlick, cited as a “cohabitant”
household member in a Domestic Relations Court arrest warrant. Elsea made a $1,000 secured bond later that day.
The domestic violence warrant
states Hemlick told officers Elsea “kicked her in the back” and
“grabbed her neck” when she
tried to get to a phone to call for
help. Officer Jeremy Seal reported that Hemlick had marks on
both sides of her neck but that
Elsea “stated nothing happened.”
The warrant adds that Hemlick
told Elsea not to return to her
residence. Elsea listed a different
address, 293 Pine Shores Drive,
on that warrant.
But back to that Christmas Day
fire.
According to a Dec. 30th press
release issued by Warren County Fire Chief Richard E. Mabie,
“On December 25 at 3:15 a.m.
the Warren County Department
of Fire and Rescue Services responded to a reported structure
fire behind the Linden Beverage Company on Dismal Hollow Road in the Linden area of
Warren County near the Linden
fire house. Fire crews arrived on
scene at 3:23 a.m. to find an outside storage type building with
fire on the exterior siding and
ground surface area surrounding the building. The fire was
brought under control within
minutes and damage was limited to $500. No injuries were
reported during this fire event.
“During suppression efforts
fire crews determined the fire incident was suspicious in nature
and called for the response of
the Warren County Department
of Fire and Rescue Services Fire
Investigator. The fire scene was
examined and determined to be
caused by an arson type event
and the Warren County Sheriffs
Office was called for assistance.
“The joint investigation of this
Christmas morning fire revealed
that two volunteer fire and rescue personnel from the Linden
Fire and Rescue Station 4 were
involved in cause of the fire.
“Both personnel have been
removed from operational duty
and the Warren County Department of Fire and Rescue Services
and Linden Fire and Rescue Station 4 awaits further action on
their membership status pending the outcome of the court
proceedings.
“The fire investigation is still
ongoing and anyone with additional information should contact Lieutenant Gerry R. Maiatico with the Warren County
Department of Fire and Rescue

When good intentions go horribly wrong
Fatal accident apparent result of intended night safety warning

According to the daughter of a
man killed when he was struck by
a car while walking to work along
Fairgrounds Road the evening of
Dec. 28, the sequence of events
leading to the fatal accident may
have been initiated by a wellintentioned Warren County Sher-

iff ’s Office deputy.
Virginia State Police Press Officer Sgt. F. L. Tyler reports that
59yearold James Alfred Oldfield died as a result of injuries
sustained when he was struck
at 10:25 p.m. by a 2002 Chevy
Avalon driven by Joshua William
Stanley, 27, of Martinsburg, West
Virginia. The accident occurred
three tenths of a mile east of
Route 522 on Fairgrounds Road
as Oldfield was walking west.
Oldfield was flown by medical
helicopter to Winchester Medical
Center where he was pronounced
dead at 12:40 a.m. on Dec. 29.
“Our understanding is that the
deputy was turning around to tell
him he needed to wear a reflector and the other driver was coming out of Ferguson’s and looked
in his rear view mirror when the
deputy turned their lights on and
didn’t see dad,” Oldfield’s daughter Joanna Morgan told us. She
said she believes the driver exiting Ferguson’s believed he was
being pulled over by the deputy,
possibly for expired tags, when
he began to pull to the side of the
road and struck her father.
Sgt. Tyler later confirmed
this outline of the incident and
said that Stanley was eventually
charged with an expired registration.
Joanna said her dad, who lived
off Fairgrounds Road, was walking to Family Dollar for the third
shift which began at 11 p.m. She
added that her dad lost his car
to a finance company she had
less than kind words for recently
and had just decided to continue
walking to work as a cost saving
measure in the tight economy.
The accident was investigated
by VSP Trooper P. M. Neff, who
was assisted at the scene by the
Warren County Sheriff ’s Office
and county fire and rescue.
“He was a professional painter.
He loved art, loved to draw and go
fishing with the kids. He was just
a general, good person and there
aren’t many of those around. And
he was a devout Christian – and
Virginia Wright
that’s made it easier on us because we know he’s gone to heaven. I don’t know what else to tell
you about Daddy other than we
love him and miss him,” Joanna
concluded.

2010 Year in review
Things change but they stay the same … (again)

As we tried to present a balanced look back at 2010 we realized that other than some feelgood community stories, our
review was becoming top heavy
with stories revolving around the
turmoil within the town government. And rather than fight “city
hall” – you know you can’t win
there – we just rolled with the
flow of stories that jumped out
at us. Because in the end that is
THE STORY of 2010 – the maneuverings in and around the
Front Royal Town Government.
So get your popcorn and sit back
and get ready for a suspension of
disbelief – because honest, kids,
we didn’t make any of this up. It
really happened and continues
to evolve as you will read in the
non-review section of this issue.
We’ve tried to leave room to
acknowledge major capital improvement moves of the county
government – approval of a new
county public safety building
and the first movement toward
realization of a long sought by
some counties’ officials at least,
Lucky Star
Regional Jail. Also, we’ve tried to
recall some of this community’s
brighter and more personal community moments.
And as seems to be the case
each year as we look back, we are
struck by the old adage “things
change but they stay the same.”
– New town council, new town
manager, new growth proposals, new requests for town utility
extensions into the county – the
faces may have, in part, changed;
but the basic issues and attitudes
sound hauntingly familiar.

Perhaps buoyed by a second
Commonwealth’s Attorney’s opinion he has no apparent legal conflict of interest resulting from road
proffers offered by Front Royal
Limited Partnership (FRLP) in its
rezoning application on 149 acres
not far from his home, Thomas
Sayre often dominated a Jan. 4
work session discussion of that application. Awaiting that most recent Commonwealth’s attorney’s
opinion, recently Sayre has recused
himself, if not exactly been silent,
during discussion of the FRLP rezoning proposal – on Jan. 4 he was
making up for lost time.
However, the value and accuracy of Sayre’s contributions to the
discussion of a final, new proffer
package offered by FRLP principal
David Vazzana prior to a Jan. 11
Public Hearing and vote were continually questioned by others present.
Five times Sayre belabored the
application and proffer package for
the lack of a site plan, questioning
how the town could be expected
to approve any rezoning without a
detailed site plan to assure things
were done as promised.
Five times it was explained by
either another councilman, Town
Attorney Tom Robinett or acting
Planning Director Bruce Drummond that by town code or even
state law a site plan is not required
in a rezoning application and that
other means existed to assure development plans were adhered to.
Sayre repeatedly stated that former mayor, councilman and current 18th District State Delegate
Clay Athey told him rezoning applications “never were approved
without a site plan.”
After Sayre’s third allusion to
Athey’s alleged site plan requirement comment, J. Daniel Pond III,
himself a former councilman, vice
mayor and current legal partner
of Athey’s, interjected. Pond, who
was present representing another
Happy Creek area developer-property owner, Millennium Lotus, explained he had been present during the Athey-Sayre discussion of
rezoning requirements.
Pond explained that rather than a
“site plan requirement,” Athey told
Sayre it was unusual to approve
rezonings without “a conceptual
plan.” Conceptual plans are not
as detailed or as expensive as site
plans …

Athey’s comments to Sayre, Mayor
Eugene Tewalt, Vice Mayor Bret
Hrbek and Robinett all reminded
Sayre that the applicant had presented three conceptual plans, including one for the now proposed
320 units, to council at a December
2008 work session at which Sayre
was present.
“But the only thing we can hold
him to his the proffers,” Sayre offered.
“And town codes,” Drummond
replied.
“Until it comes up for site plan
approval – I think we’re putting
the cart in front of the horse … I
think we need to put this [subject]
to rest,” Robinett said of something
that didn’t happen for another 20
minutes.
At one point Councilman Tom
Conkey berated Sayre for his continued harping on the absence of
a site plan not required by town
code. – “To require an applicant to
do something that is not required
by law and to spend a million dollars on a site plan based on ‘what
ifs’ for something that is not approved is unfair.” …

zoning application he must assert
he “can be fair and objective” in
voting on, according to Commonwealth’s Attorney Brian Madden’s
conflict of interest opinion. He
asked Drummond if he had considered the proposed subdivision’s
POA (property owner’s association) covenants that would be enacted within the town limits.
“Mr. Sayre, it’s not something the
town can regulate,” Drummond replied.
Town Attorney Robinett agreed
that the town had no legal athority
over POA covenants.
Legal or not, Sayre replied that
he thought town oversight of POA
covenants was “in the best interest
of the citizens.”
“I think it is in the best interest of the applicant to structure
covenants to make it attractive to
prospective homeowners,” Drummond replied …

town decide not to contribute to
completing the E-W connector,
leading FRLP to only build the
portion of that road that accesses
its subdivision, the portion of the
proffered $4.3 million for off-site
road improvements would transfer to construction of Leach’s Run
Parkway (Note: plans for both

“It is a good deal for the town in
the long run. This won’t happen
over night, it is a six, eight, 10-year
buildout. To have the private sector build 80 percent of the road …
is a tremendous asset to the town,”
Drummond stated of a road that
would relieve traffic on already
overburdened Happy Creek Road.
Responding to a question, the acting town planning director also
noted that the applicant was proffering money for improvements
to the intersection of Shenandoah
Shores Road and Happy Creek
Road.
However Sayre pooh-poohed the
significance to existing local traffic
of the east-west connector road.
– “People will bypass the east-west
connector to go to Happy Creek
Road to get to town, at least that’s
what I think,” Sayre said.
When Sayre reiterated his belief
that without a site plan there was
no guarantee the applicant would
ever build the east-west connector road or do anything else being
proffered, Drummond disagreed.
That led to an exchange any two of
the Three Stooges would have been
proud of when Sayre managed to
get Drummond to repeat one of his
assertions about the lack of guarantees without a site plan in place.
“I agree,” Sayre replied to a somewhat baffled Drummond.
“I wasn’t agreeing with you,”
Drummond shot back.

Town will not appeal meals tax fee ruling
Risk not worth costs in wake of initial court ruling on contracts

Well it appears the Front Royal
Town Council is on the same page
about at least one thing – leaving
well enough alone regarding the
initial decisions on the 522 Corridor lawsuit over the town’s meals
tax-based corridor fees.
… on Feb. 22 following a closed
session, long distance conference
call, likely with Route 522 corridor suit lead attorney Carter
Glass IV, council unanimously
voted to let a 30-day deadline on
filing an appeal of Judge Dennis
L. Hupp’s November, 522 corridor decisions pass.
On the down side, that decision stripped the town’s authority to include a 4-percent meals
tax-based fee to its 522 corridor
water-sewer bills – the estimated
missing $600,000 of town revenue mentioned in our budget,
tax-hike debate story.
On a somewhat brighter note,
Hupp also ruled the town owed
only about $120,000 in back fee
payments to the three plaintiff restaurants, Cracker Barrel,
Applebee’s and TGIFriday’s, dating to the January 2009 filing of
the suit challenging the fees. Had
that ruling gone otherwise the
town could have been liable for
millions in back payments to all
the corridor restaurants that have
been paying it since they opened
since 2007 – not to mention to
the Quarles truck stop based food
businesses that have been paying
it since somewhere between 1999
and 2002.
Town officials, including Mayor
Eugene Tewalt, Vice Mayor Bret
Hrbek and Councilman Tom
Conkey all indicated the decision
was a financial risk versus reward
one …
“The potential for success did
not justify the potential expense
of an appeal on the taxpayers,”
Hrbek [said] … Both the mayor
and vice mayor defended the initial decision to fight to maintain
the fees, particularly with the estimated $600,000 of current annual meals tax revenue built into
past and current town budgets.
“I think it was well worth the
money we spent – somebody had
to make a decision on whether
it was legal or illegal,” the mayor
said. “Our biggest problem was
that while the non-annexation
agreement approved by the three
judge panel allowed us to charge
a meals tax fee as part of the taxes
equal to in-town tax rates, in 2005
when the county implemented
its own meals tax, it superseded
ours …
“I think it’s important to understand that Judge Hupp’s decision
was based on the fact he viewed
the [corridor utility] contracts as
vague, rather than a fundamental
decision that a meals tax could
not be included in the corridor
agreement,” Hrbek says. “However with that decision on the
contracts made by the judge, ultimately we felt it would cost the
taxpayers too much to continue.”

censorship” of the councilman’s
right to express his opinions, but
rather a “Censure”- or public
reprimand – for previous actions
contrary to expected standards of
behavior of a public official in the
conduct of his office.)
The
controversy
swirling
around a potential censure of
Front Royal Town Councilman
Thomas Sayre over a closed door
meeting with the judge presiding
over the Route 522 Corridor law-
suit escalated on Jan. 21.
Less than three days after authorization was given to the town
attorney to proceed with the
drafting of a Resolution of Censure of Sayre, the councilman
appeared on WZRV’s News at
Noon show to defend his actions
related to his Dec. 8 closed door
discussion with Judge Dennis L.
Hupp. He also took the opportunity to attack his colleagues who
might support his censure.
“Obviously some of my council
members are blowing this out of
proportion for political purposes.
The election starts today,” Sayre,
who is up for reelection this
spring, told WZRV News Director Mario Retrosi.
However some of Sayre’s subsequent radio remarks about what
he told Hupp in chambers have
raised further issues about Sayre’s
conduct and potential breaches
of ethical standards.
“Nothing confidential was said;
…” Sayre stated … [but] Sayre
verified Judge Hupp’s e-mail observation that he had informed
the judge that the town watersewer bills would be going out
with the meals tax-based fees still
attached so the judge “wouldn’t
be angry.”
In conversations with Vice Mayor Bret Hrbek and Councilmen
Tom Conkey and Shae Parker following Sayre’s Jan. 21st radio appearance we asked if they agreed
with Sayre’s representations that
he had violated no ethical standard or revealed any confidential

All three indicated that to the
best of their recollection the fact
the water-sewer bills were going out as they had in the past
had only been a topic of closed
session discussion about consequences and strategies in the
wake of Hupp’s Nov. 30 ruling on
the first aspect of the case.
We asked Town Attorney Tom
Robinett, who led that closed session discussion of legal issues and
strategies if that was in fact the
case.
“That is consistent with my
recollections and I do not recall
any previous or subsequent discussion of that (the water bills),”
Robinett stated …
“If that’s the case he did reveal
proprietary information from
a closed session to the judge,”
Conkey observed. “This one incident is indicative of others in
which Mr. Sayre has gone to radio, TV or newspapers … He has
divulged information gathered in
confidence and released information that could be damaging
to the town for his own benefit.
I’m comfortable that requesting
this resolution is not a political
ploy,” Conkey, who is not up for
re-election, said …
“If it was an error and if it made
the judge uncomfortable I do
apologize,” Sayre said of his Dec.
8 meeting in the judge’s chambers …
However Sayre did not extend
that apology to any of his colleagues, whom he accused of at-
tempting to stifle his opinion on
issues … “obviously some of my
opinions are in disagreement
with some of my fellow council
members. I think nothing would
make them happier than to be
able to gag me,” Sayre stated.
“That’s insane – why would he
say that?” Vice Mayor Bret Hrbek
said in reaction to Sayre’s remarks. “It’s not about the politics
of issues; it’s exactly what Shae
said it was. What Tom [Sayre]
did we felt was inappropriate.
I think the council is just trying
to protect the town’s interest and
distance itself from this action,”
Hrbek, who is also up for re-elec-
tion, said of Sayre’s closed door
conversation with Hupp about a
pending case involving the town.
“I watch L.A. Law and I know not
to talk to a judge about a case”
[Hrbek said] …
“If this were a football team,
Mr. Sayre is the guy who knows
better than the coach and says
he knows better than the coach.
Then he goes and gives the playbook to the competition and says
the coach is [a jerk]. What do you
do with a player like that? – He’d
be cut,” Conkey surmised.
However, Sayre told Retrosi he
believes it is others who will be
“cut” this spring …

Town acquiesces to common sense – dam gone
Council finally votes to accept free money to demolish Riverton Dam
Here today, gone tomorrow - the Riverton Dam before and after its late October
demolition.

Following what appeared to be
a great deal of existential angst, or
perhaps it was just a total loss of
direction and common sense, on
March 22 the Front Royal Town
Council passed a motion authorizing the town to proceed with
removal of the Riverton Dam
through grants accessed from the
U.S. and Virginia Fish & Wildlife
Services.
The vote was 5-0 on Thomas
Sayre’s motion enabling the town
not only to apply for, but also utilized $123,000 of fed and state
money to tear down the long functionless and occasionally deadly
dam.
However, exactly one month earlier on Feb. 22, Sayre unsuccessfully urged council to stop the grant
application process. Such a move
would have killed the possibility of
accessing the fed and state money
to remove the dam and created an
imminent $500,000 to $1 million
cost liability to the town to repair
the dam.
At the February meeting, Sayre,
who had appeared to be on board
with the removal earlier, cited
council candidate and former
town electric department head
Joe Swiger as the source of information changing his stance on the
advisability of removing the dam.
Swiger told council during February public comments that he believed the dam could be resurrect-

the dam if new information justifying its repair at town expense came
to light.
Apparently no such information
was forthcoming in the intervening month. In fact at earlier work
sessions, Virginia Department of
Game & Inland Fisheries Regional
Fisheries Manager Larry Mohn
called the dam “a high-hazard”
structure with virtually no potential of future use due to increased
public water usage by communities
upstream, including Winchester
and Frederick County …
Another speaker, longtime local
volunteer fireman Patrick Harvey,
rose to ask a couple of pointed
questions.
When was the dam last used by
the town?
Not since 1930, Mayor Eugene
Tewalt informed Harvey.
Harvey then revisited the cost issues cited above.
“Why are we still here talking
about this?” a baffled Harvey finally questioned council …
Finally it seems, despite the uninformed posturing of some political
candidates (Swiger) and [self-described] foreign missionary workers (David Howard Benner on Feb.
22), the slavish acceptance of that
posturing by one sitting councilman (Sayre), and the nostalgic
reminiscences of at least one other
councilman (Lauder), the current council came to its collective
senses without dissent (Parker was
absent due to illness).
Engle’s Angle: 11 for ‘11

January 1st. A time for new
beginnings. Instead of making
resolutions this year, I’m focused
on something else. Here are 11
things I don’t want to see, hear,
touch, taste, or smell in 2011:
11. Stink bugs – I don’t want to
hear them buzzing by my ear. I
don’t want to see them staring
back at me from the top of my
computer screen. I don’t want to
smell their stench. I’ve had more
than my share of close encounters
of the stink bug kind. How about
stink bug extinction?
10. Sarah Palin – I’m all for a female President, as long as it’s not
her. I don’t care what she thinks
about moose hunting, puppies or
the federal deficit. And I’d like to
go at least one day in a row without hearing her name in the news.
Just go back to Alaska and hibernate. Please.
9. Holiday Leftovers – I like turkey at Thanksgiving and ham for
Christmas. But when I’m still eating them come spring, I’ve had
enough.
8. Significant snow accumulations; black ice; and of course,
milk, bread and toilet paper. They
all mean the same thing. Bad
news.
7. Gas prices that start with a 3.
6. Brett Favre – please. Enough
is enough man. Hang it up. See

of the leak of an internal memo
from Town Attorney Tom Robinett to council.
The leak, cited as from an unnamed member of council, resulted in an April 14 front page
banner Northern Virginia Daily
headline: “Town attorney: Incentives taint solar project”.

from two unnamed councilmen

legal firm of Troutman Sanders,
where Carter Glass IV who was
the town’s contracted attorney
in the 522 Corridor fee lawsuit,
is a partner. The opinion was
prepared by Troutman Sanders
staffer Megan C. Raham, who
practices in the area of white collar & government investigations,
and is prefaced by a note from
Glass. Glass states that within
normal contract negotiations
modifications of benefit to the
contractor, in this case the town,
are permissible. However where
the issue is apparently muddied
legally is how contract negotiations initiated prior to the RFP

“This is ridiculous,” Graham said
when asked about the “bribe” inquiries from council to the town
attorney leaked to the local media
by sources within council. “These
are all things that were proposed
as business proffers. They are incentives to the community that
have been out there from the
outset. I’m not getting anything,
the town is. This isn’t cloak and
dagger stuff.”
Lack of trust
Vice Mayor Bret Hrbek seemed
both angry and exasperated at
the situation.
“I’d like to know if Carter Glass
or his staff ’s opinion would be the
same if they knew that all the offers or add-ons referenced were
related to the manufacturing
facility, not the solar field itself.
That is my understanding – they
were all within the context of the
manufacturing facility, which
was not part of the RFP proposals, which were solely about the
purchase and production of solar
power,” Hrbek said …
“…I mean when Walmart came
they were writing checks to different groups or departments
around town, to the police force
– are those bribes?” Hrbek asks
… “And I wonder who gave Mr.
Robinett the authority to go to
Carter Glass for an opinion? …
There is no trust in town hall
any longer. There is no trust between council. There is no trust
between staff members. I try not
to contribute to such a situation
but it has gotten out of hand,” the
vice mayor said bluntly …
“What bothers me more than
anything is that we can’t keep
anything confidential anymore.
There appear to be one or two
members of council that take
everything to the press. I don’t
know where they’re coming from
but I do know we all took an oath
of office to uphold the best interests of the town and confidentiality on legal communications
or closed session discussions is a
part of that,” Mayor Gene Tewalt
said.
Tewalt also agreed with Hrbek
that the town attorney had overstepped his bounds in seeking
an outside legal opinion. “He
shouldn’t have gone to anyone
until he got authorization from
the town council,” the mayor said
of Robinett’s inquiry to Glass …
[Shae Parker said,] “Incentives
to the town never came forward
as part of the RFP process. There
were discussions about scholarships, bringing jobs to the community. But I don’t understand
the idea that jobs could be considered a bribe. I think a condition of EDA approval of leasing
land at Avtex to them was that
a number of permanent jobs be
created.
“But now between the bad
press, the bad egos and bad feelings all around, I am more concerned about those trying to derail something that could be good
for the community, that would
bring jobs, bring scholarships for
our children and green, sustainable energy to the community,”
Parker concluded …
However, both Holloway and
Lauder are suspicious of the involvement of the town manager
in the ongoing Standard Energy/
SolAVerde negotiations.
“Why is it so important that
Standard Energy (top recommendation in all RFP scenarios)

He asserts that the town attorney
witnessed what he recalled as a
March 16 assertion by Graham
that the town could get $1.2 million from Standard if their Purchase Power Agreement (PPA)
was accepted …

questioned the information flow
leading to the bribe inquiries.
“In the RFP there was no discussion of incentives to the town.
So why would they be discussed
with anybody?” Holloway wonders. “I didn’t have a clue about
incentives and Mike and Bret
didn’t want to discuss it. And I
don’t know where this scholarship came from. There was no
mention of scholarships that I
was aware of. And if there was,
why didn’t I, Carson and Mr.
Sayre know? The whole thing is
screwy. I’m not trying to derail
this but there are lots of things
going on behind closed doors.”

hunts,” Horton said. “There appear to be people within town hall

mid 2009); then it was us as individuals (in fall of 2009 Sayre and
Chris Holloway targeted SolAVerde principal Willi Lauterbach,
as well as fellow councilman Tom
Conkey, for the offer of (routinely
available) weekday business traveler discounts at Conkey’s bed &
breakfast); then they turned on

Tewalt said he was embarrassed
to have had to work with some
members of council over the past
two years. In his most scathing
criticism Tewalt said that some
councilmen may have lied when
they took their oaths of office to
“uphold the Town of Front Royal.” As Tewalt neared the end of
his statement, Councilman Tom
Sayre suddenly attempted to silence the mayor on a point of order.
“I’m talking … I have a right to
speak,” Mayor Tewalt reminded
Sayre as he continued his explanation of why he would break
a 3-3 tie and vote to allow the
public to see the internal council documents in question. Those
documents are related to a solar
project “bribe” inquiry initiated
through the town attorney’s office
by Councilmen Chris Holloway
and Carson Lauder and leaked to
The Northern Virginia Daily by
an unknown councilman …
Mayor’s statement
“And this is why we’re here tonight, because someone broke
our confidentiality and released
some things to the press … it’s a
shame that we have men of this
kind on council that don’t have
the fortitude – or when they took
their oath of office and went to
the courthouse and said I will
uphold the Town of Front Royal
and then come back and lie to the
public and release a confidential
statement. And I’m really sorry
and sad to say that I have worked
with some of these men on this
council for these past two years
– and it’s a shame.”
Shut up, why don’t ya?
At this point one minute and 41
seconds into Tewalt’s two-minute
statement, Sayre interrupted the
mayor and tried to silence him on
a point of order … Sayre’s stance
appeared to be that the mayor
does not have the same right as
councilmen to explain the reason for their votes. Front Royal’s
mayor only votes to break ties.
“Mr. Attorney, point of reference, he’s supposed to vote, I
mean, he’s supposed to vote,”
Sayre continued.
“I have the right to speak,”
Tewalt reiterated. “And in that,
this evening,” Tewalt continued to
another unsuccessful Sayre interruption. “And in that on this vote
here tonight I’m going to vote
no,” the mayor pressed forward.
“And I’d like to see the records
turned over from the town to any
person that requests them, so my
vote here tonight is no (to Sayre’s
amendment),” Mayor Tewalt concluded …
Hrbek’s original motion to release the information to the public and let the chips fall where they
may then passed by the same 4-3
margin that Sayre’s first amendment was defeated by, with Mayor Tewalt joining Hrbek, Conkey
and Parker to approve the public release. Sayre, Holloway and
Lauder voted against allowing
the public to see the material …

You are served – council flees, fumes, threatens

FRONT ROYAL, Va. — July 19, 2010
— Three members of Front Royal
Town Council and the Town Attorney (for the town) were served with
legal documents naming them as
defendants in a $30-million civil suit
at a Town Hall work session tonight,
protesting the whole while.
“Lock ’em up,” said newly installed
Councilman Hollis Tharpe as process server John Arena calmly went
about his business with Town Police
Lt. Clint Keller briskly raced up from
behind.
The council had just voted to go
into a closed session to discuss the
potential lawsuit with the town attorney (an item conspicuously absent
from the agenda) and it appeared to
some that one meeting had ended
but another had not yet begun as
spectators, staff and reporters began
packing their items up to leave.
At this point, process server Arena,
6-foot-9-inches tall and armed with
size 18 feet and four 154-page copies of a lawsuit that could cost Front
Royal taxpayers millions, casually
sprung into action.
Arena first placed a folder in front
of Town Attorney Thomas R. Robinett, thus serving notice to the town
government, and walked away. Expressing some consternation Robinett said, “Sir, you are going to interrupt a public meeting?”
Arena said nothing and methodically proceeded around the table
toward his next target, Vice Mayor
Chris W. Holloway. Holloway sat and
didn’t say anything (yet.)
Newly installed Mayor Tim Darr
asked Arena if he could wait until
after the closed session which the
mayor promised would only last
“about five minutes.” Arena slowed
for a moment before placing the next
folder in front of Holloway. As Arena
proceeded around the mayor toward
his final two targets, Holloway threw
his hands into the air in exasperation
…
At this point target 3, Councilman
Sayre … got up and walked to the far
end of the meeting table to flee Arena
and his intimidating folders. Councilman Carson Lauder, target 4, sat
calmly and took it like a man. Even
calmer, considering he was being
threatened with jail by one councilman, being asked to wait by a mayor
and town attorney and chased – albeit slowly – by one of the top two officials of the town police department,
Arena simply proceeded to slowly
walk around the table to drop the last
two lawsuits of a lifetime in front of
Lauder and at Sayre’s suddenly vacated seat. With Sayre out of camera range at the far end of the table,
Arena appears to make eye contact,
says, “Mr. Sayre,” and drops his final
packet at Sayre’s place …
Town Attorney Robinett, realizing
the deed had been done, suggested
they keep the thick folders …
Responding to WC Report’s Roger
Bianchini and Dan McDermott’s
comments on his actions during
the process serving on WZRV’s The
News at Noon on July 20, Sayre explained by e-mail, “It appeared to me
he [Arena] might be arrested on the
spot and I got out of the way in case
there was an altercation.”
Sayre has not yet responded to our
follow up question about leaving a
considerably older co-defendant,
Carson Lauder, to fend for himself
had such an altercation, as unlikely
as it seemed, occurred.
Asked about Sayre’s explanation of
his actions in being served, Silek said,
“I think the video speaks for itself. It

is far more telling than anyone’s attempt at self-justification.” …

It was an emotional day this October when WCHS’s “Lost Class of 1959”
was finally recognized with their graduation diplomas. That class of
county children fell victim to their state and local elder’s efforts to fight
the desegregation of Virginia and the nation’s public schools. “All those
kids were affected. It’s still emotional after 51 years and I can certainly
understand why. The school meant so much to them – and all of a sudden,
you can’t come back?! And I can certainly see how the African-American
students felt too when they couldn’t even walk in the door. It was a sad
time – I’m glad we did this,” county Public Schools Adminstrator Pamela
McInnis said of the event.

Arthur “Bunky” Woods got the keys to his new voice-activated home financed
through the combined efforts of Homes for Our Troops and the local business
and building community

Sometimes it’s good to see real
patriotism in action rather than
the self-serving, partisan rhetoric
used to justify someone’s fawning grasp for political power and
imagined self importance that
too often passes for it. On Nov.
10th, the day before Veteran’s
Day 2010, Browntown in Warren
County hosted just such an event
that ran tingles of patriotism up
the spine of even this jaded and
cynical American reporter.
Staff Sgt. Arthur “Bunky”
Woods got the keys to, and his
first glimpse of the completed
home made for him through an
inspirational joining of community resources and national
non-profit organization Homes
for Our Troops (www.homesforourtroops.org).
The event brought local, state
and federal officials or their representatives out, as well as Warren
County’s own Hollywood starlet,
“Amazing” Grace the performing mule (“Get Low” with Robert
Duvall) who entertained the huge
gathering and its host and dignitaries following key ceremonies.
But most importantly the event
brought together the working
backbone of this community who
donated their time, materials and
love to this project. That love and
all the rest was given to see that
the physical needs of a local son
who put it all on the line for the
ideals upon which this country
was founded will be accommodated as he lives out his life in the
hometown he loves. This home
will make Bunky Woods pretty
self sufficient with the little things
that most of us take for granted
…
“It’s just been a wonderful
thing, that in a recession people
have been as generous as they
have and I think sometimes hard
times makes people more caring.
And we’ve had pretty good luck
in our community,” Martha said
…
Buracker noted, as later did
Homes for Our Troops founder
and President John S. Gonsalves,
that Bunky has never wanted the
focus to be on him, his service or
sacrifice. – “I’ve heard him voice
his concerns that a lot of attention
has been guided toward him and
that we shouldn’t forget about any
of the soldiers,” Buracker pointed
out …

Then as he did on May 21 at the
start of the 3-day build that propelled construction of this home
that will allow him to be as selfsufficient as possible in the wake
of his 2006 wounding in the Iraq
War, “Bunky” stole the show.
Woods’ remarks again reflected
the selflessness, humor, dignity
and honor with which he sets an
example for us all about what it
means to be not only an American, but a human being.
“If I had it all to do over again I
would. Because like I said, America is worth fighting for and it’s
because of people like you and
the people from Homes for Our
Troops that make it that way,”
Bunky told his now large and extended family. “And this house,
it isn’t just for me. I want everybody when they ride by and look
up on the hill and see this beautiful house in this beautiful setting looking over God’s beautiful
creation, to know this house is a
symbol that the American spirit
is alive and well today in Warren County and in Browntown.

Relief flight to Haiti off and back despite weather
Cassagnol and Skowbo return from supply flight to Cape Haitien

Airport Manager and Haitian native Reggie Cassagnol and Captain Rock Skowbo returned from
their medical and relief supply
mission to Haiti around 11 a.m.
on Tuesday, Feb. 2. Their return
was delayed one day by the winter storm to their north, Cassagnol told us by cell phone from
Florida on Feb. 1. The pair left
the local general aviation airport
(FRR) around 11 a.m. on Sunday,
Jan. 31, a departure also delayed
a day by the snow that fell on Friday, Jan. 29. Cassagnol estimated
a total eight hour flight one way.
In Skowbo’s twin engine Cessna
310 the local pair of aviators carried about 800 pounds of supplies
to Cap Haitien, a town of 180,000

last edition story (http://hopehaiti.org). H.O.P.E. is based in the
northern Haitian town of Borgne,
in an area of about 800,000 …
Cassagnol said it appeared
some Haitian refugees were moving away from the worst of the
devastation to areas where help
was more readily available. “We
got these things in and my sister’s
mission will see they are distributed to people who need them,”
he said …

Why Stainless-Steel
Sink Loses Its Shine
Q:
I was in the stainless-steel
business for many years and
thought I would comment on your
recent column regarding cleaning a stained sink. Stainless steel is
indeed an alloy of iron, chromium
and nickel. (Brass is an alloy of
copper and zinc, not copper and
bronze. Bronze is itself an alloy
of copper and tin.) The oxidation
layer of chromium is what protects
the metal from staining. However,
when it is scratched or worn away
by abrasion, a new layer is instantaneously formed because chromium reacts immediately with the
oxygen in the atmosphere. The
layer is always present. It is clear,
extremely hard and more or less
impervious. Otherwise, the iron
would oxidize, forming rust.
Any popular kitchen cleanser will
remove stains. However, to return
to the factory polish finish is generally impossible because the sheets
used to form sinks are polished
at the mill with high-speed heavy
machinery. It would be nearly
impossible to duplicate this finish

Stainless-steel sinks are quite durable, and most stains or spots are made
by other objects — for example, leaving a piece of damp steel wool in the
sink overnight will inevitably reveal
a rust spot the next day. However, a
wipe and a rinse generally removes
the spot.
As Joe noted, stainless-steel sinks
do lose their gleaming shine over
time, particularly if you use abrasives. You can keep the finish looking uniform by rinsing and wiping
down the sink each night with a nonabrasive cloth or sponge, then drying
with a towel so that water spots don’t

bell it may be because it was
used this spring just prior to the
gradation of the WCHS Class of
2010. We featured soon-to-begraduate Glenn Mikulak’s display
of his creation of a 10,000-piece
model ship of his own design at
his school. On Oct. 24, memorial
services for 18-year-old Glenn
Michael Mikulak were held at
Maddox Funeral Home in Front
Royal before a crowd of several
hundred. In tribute to Glenn,
who died of respiratory failure
resulting from his battle with
Duchenne syndrome Muscular
Dystrophy on Oct. 19, we reprint
a portion of that story with brief
comments added below:
For most people, me included,
memories of a nice trip, whether it be on a ship or by another
mode of transportation, are generally recorded in our sometimes
flawed memory banks or on photographs soon to be curled and
yellowing in some forgotten scrap
book.
But for Warren County High
senior Glenn Mikulak, the memories of a 2006 trip with his late
grandmother, Linda Hogoboom,
on a Caribbean cruise ship were
translated into an astonishing
reconstruction of a cruise ship.
On April 28th Glenn brought his
ship, appropriately christened
“K’nector of the Seas of the Royal
K’nibbean Line” since it is made
of approximately 10,000 K’NEX
pieces, for display in the Warren
County High lobby. The reactions

of classmates, teachers and even
Principal Ernestine Jordan mirrored my own reaction.
“That’s awesome!”
“Glenn, that’s incredible – did
you draw a picture of it first?”
“No, I just started building it,”
Glenn replied.
“I couldn’t do that if I had my
whole life to finish it,” one student exclaimed.
The fact Glenn oversaw the
event from his wheelchair underscores perhaps the added
awe with which his classmates
viewed his achievement. Glenn
suffers from a form of Muscular
Dystrophy known as Duchenne,
an irreversible deterioration of
the muscular system. As a consequence of his condition, Glenn
has a reduced life expectancy and
must face that fact each day of his
life.
Glenn’s outlook is an inspiration to all. We asked him how he
does it.

from the financial hardship put upon

openings there. The exhibits
have been well received and the
turn-outs fantastic. Many of the
16 new paintings in the Sun Studio show are landscapes of local
scenes, but there are also still lifes
of fruit and vegetables and a selfportrait. One large painting, “The
Wonder”, features a child exploring the beauties and fascination
of the seashore. Several local
bridges, barns, and mountains
take their place on the gallery’s
walls, including “Across the Rappahannock” and “Meems Bottom
Bridge”.
Her paintings are routinely exhibited at The Mill, in Millwood,
Va, and her paintings hang at
Apartment 2G, Warren Memorial
Hospital, The Front Royal Visitor’s
Center, Griffith Tavern in Flint
Hill and several other businesses

participated in a show at the Blue
Ridge Arts Council, sponsored by
Front Royal’s Women’s Resource
Center, and her work appeared
in the Spring 2009 issue of The

and she has nothing but praise for
her. “Candy Howland has done as
much or more for local artists as
anyone in the community. “Ms.
Howland does all my matting and
framing because she is simply as
good as it gets in terms of the finished product. She has excellent
taste and a great eye about what

touchdown in NFL history for a
quarterback in his first start. But
wait, Tebow became just the third
quarterback in NFL history to throw
for a touchdown of 30 or more yards
and run for a touchdown of 40 or
more yards in the same game. When
you consider that this is the house
that John Elway built, the numbers
become even more staggering.
Then came his first win — a commanding performance in Denver
where he rallied the Broncos from
a 17-0 deficit at halftime, finishing
with 308 passing yards, one touchdown pass and a fourth quarter
rushing touchdown, which capped
the comeback. It was only two
games, but fans saw enough in his
arm and poise to get plenty excited
about. His record-setting college
career (including his mind-bending,
Heisman Award-winning sophomore campaign) had already given
him a faithful flock — his jersey is
the best selling in the NFL and the
most ever for a rookie — and they
believe there is more to come.
Tebow, though enthusiastic, displayed his Christian humility.
“In the NFL, everything you do is
an interview, and it is an audition,”
he said after the game. “You always
have to put your best foot forward.
... I will try to do nothing less, personally.”
The Denver faithful want to be
made believers.

And so it was that on the first Sunday after Christmas, a star appeared
to the faithful in Denver.
He had been heralded for seemingly ages — blessed with a strong arm,
fleet of foot and possessing a strong
faith in God. This man is named Tim

The Broncos have always inspired

been a long while since they have

quarterback Kyle Orton, the Broncos lost their way in 2010. With
the exception of an epic beat down
of their division-rival Chiefs, the
Broncos have seemingly played
without soul or conviction (at least
not the good kind).
And despite relatively good numbers, it was Orton banished to the
sidelines and Tebow moved out of
clipboard purgatory on Dec. 19.
And despite a 39-23 road loss to the
Raiders of Oakland, many fans saw
a revelation on the field.

SHERIFF’S OFFICE
The Warren County Sheriff’s Office Community Public Safety Program is scheduled
to begin on February 8, 2011. The program
will run for ten weeks on Tuesday nights
from 7:00 p.m. - 9:00 p.m. Representatives from the Warren County Sheriff’s office and Warren County Fire and Rescue
will provide an in-depth overview of the
operations and responsibilities of Warren
County Public Safety. Highly trained and
experienced Warren County deputies and
fire/rescue personnel will provide presentations and demonstration on law specialized
operations. Interested citizens may obtain
applications for program participation at the
Warren County Sheriff’s Office public assistance window, 23 East Jackson Street, Front

The Front Royal Oratorio Society will begin
rehearsals for its spring season on Monday,

is going to happen on Happy Creek
soon. What’s going on?

Dear Curious Citizen,
Yes, Happy Creek will look a
little different over the next couple
months. The Town of Front Royal had received Federal stimulus
funding this year through the Virginia Department of Forestry for
tree related projects. Two of the
three projects awarded this year
have already been completed. One
projected was related to extra professional care of the beautiful old
Oaks in Bowman Park off Luray
Avenue; the other covered the cost
of over seventy new evergreens
planted at our new library.
The third project will happen at
Happy Creek from South Street to
the Prospect Street bridge. A local
environmental firm has been hired
to remove the invasive trees along
both sides of the banks so that the
beneficial native trees can survive
and do well. Invasive trees are
trees that have been introduced
from elswhere that do so well in
their new environment, they crowd
out the native plants and take over
the area. A good example of this is
the Ailanthus or Tree of Heaven. Over the years, the town crews
used to come in and literally mow
everything down along Happy
Creek. While it looked “clean” for
a while, it gave the invasive trees a
better chance of surviving and actually caused more of an issue than
it solved. That practice was finally
discontinued and the local Tree
Stewards, along with other groups,
have spent several work sessions
dealing with the invasive removal
and new seedling planting on a
voluntary basis. It always seemed
to be a never ending battle to stay
ahead of the invasives. When the
stimulus funding became available this year, the Urban Forest
Advisory Commission saw a great
opportunity to enlist professional
help for our creek. The end result of the professionally done removal will be a creek
bank with primarily beneficial
trees to provide shade and help
stabilize the fragile creek banks. You may actually be able to see the
creek now as it meanders through
that section of town and the local
wildlife will have a much better

environment in which to live.

Happy Creek to see how the work
is progressing.

Steward program began in 1997 with
volunteers dedicated to improving
the health of trees by providing educational programs, tree planting and
care demonstrations, and tree maintenance throughout the community. The
group now consists of over 30 active
members with several interns working toward becoming certified tree
stewards from our annual “All About
Trees Class”. Each month Stewart will
answer a question from our readers.
