HEARD
Hoppy Kercheval, the dean of West Virginia talk shows, was the keynote speaker at the CAWV
Annual Meeting, held July 14-17 at The Greenbrier. Kercheval has promoted funding for
highways through his “#FTDR” -- Fix The Damn Roads – campaign during his MetroNews
“Talkline” segments during the legislative session. When he spoke at the 2006 CAWV Annual
Meeting, he told members, “You, the contractors of West Virginia, occupy a special place in our
state because you are the ones who build the roads and bridges, water and sewer lines, the
utilities and infrastructure that taken together provide the physical fabric of our state and our
nation. All this stuff does not magically appear because politicians cut a ribbon. Somebody has
to figure it all out and you are the people who do that.”
This year, Kercheval told members, “You are contractors. You get up and go to work. That’s
what you do. My presentation today is to explain what’s going in West Virginia politics that
impacts what you’re trying to accomplish in providing funding for schools, water and sewer
systems, and highways.” He provided a view of the last 15 years of politics in West Virginia,
from George Bush winning West Virginia in 2000 to 2014 when Republicans took control of both
chambers of the West Virginia Legislature. “The last time a non-incumbent Republican carried
West Virginia in a presidential race was Herbert Hoover in 1928. Bush carried West Virginia 5246 percent, by 40,000 votes. If Al Gore had carried West Virginia with its 5 electoral votes, he
would have been President, regardless of Florida and the hanging chads,” Kercheval quipped.
Kercheval, whose show is broadcast daily from 10 a.m. to noon on the statewide MetroNews
radio system, gave members his observations on how the political shift affects on the state’s
ability to make sure its infrastructure of schools, water and sewer systems, and roads are
maintained for the next generation. He said there is a reluctance in the West Virginia Legislature
to raise taxes, noting that a proposal to raise the cigarette tax by 45 cents (it was ultimately
raised 65 cents) to help fund the budget deficit failed in its first vote in the House. “There was
great difficulty passing a tax increase even though it’s on an unpopular activity affecting a small
percentage of voters. The challenge for you guys is that everybody drives,” he opined, “which
makes any tax or fee increase difficult. You make a great argument that drivers only spend 80
cents a day to drive but what they hear is ‘my taxes are going up.’”
Kercheval said a recent survey shows that 56 percent of West Virginians polled said they think
the state is on the wrong track. Only 28 percent said it’s on the right track. He said people
already feel burdened with taxes and fees. Every time they turn around, they’re hit with an
additional charge, he noted. “From the time we get up in the morning until the time we go to
bed, there’s a tax or fee or assessment on just about everything we do.” The veteran reporter
said there must be a fundamental restructuring of state government to prioritize what must be
done – infrastructure, education, protect the public – and what the state would like to do. “We’ve
got to evaluate and measure performance of our programs and determine what is essential and
what isn’t. With declining revenue and declining costs, government has to be more efficient,” he
said.
“So, what as a state are we going to do,” Kercheval posed to annual meeting attendees. “What
are you, the contractors, going to do? You’re thinking you don’t like politics but politics is the
process by which power is distributed and decisions are made. The political process will
determine how infrastructure is planned and funded. You have to keep your foot on the gas,” he
charged members.
“Hoppy’s presentation shows the importance of our members being involved in the political
process,” CAWV President Dan Cooperrider told members. Mr. Cooperrider, who serves as cochair of HUB/PAC, CAWV’s political action committee, said the association will be working with
members to get them active in working with their local legislators. He also said HUB/PAC is
reinstituting its policy of surveying candidates for the West Virginia Senate and House of
Delegates. “HUB/PAC will be supporting candidates who include improving the state’s
infrastructure in their goals and objectives,” he stated. Members can see more information on
HUB/PAC in a future Newsletter.
Over 300 members, guests and children attended this year’s meeting, which began with a
reception at the Golf Club on Thursday. The CAWV Board of Directors met on Friday and
discussed a number of industry issues. President Cooperrider began the General Business
Session by thanking the staff of The Greenbrier for making CAWV members feel welcome. The
annual meeting was almost canceled due to the massive flooding, particularly in Greenbrier
County, which caused The Greenbrier to close for three weeks. The resort opened Tuesday
and the meeting started on Thursday. “We have been thinking about the employees a lot over
the past few weeks and we were concerned that they needed to be addressing their rebuilding,”
the President stated. “However, they thanked us for not canceling our meeting. They wanted to
get their lives back to normal and to start working again. The hotel was great, the people were
great, golf on The Greenbrier course was great, and the food was fantastic. The CAWV made
the right decision to support The Greenbrier and its employees,” the President commented.
Following the business session were division meetings. Actions by the divisions are included in
this week’s Building, Municipal-Utilities and Heavy-Highway bulletins.
President Cooperrider, in his remarks to members, thanked his family and wife, Cathy, and his
West Virginia family, the members of the CAWV. “In a leadership position, one sets goals,” said
the outgoing president. “In our case, it was membership development, legislative engagement
and increasing revenue for highway construction. We encountered many challenges this year,
whether it was the budget deficit which reduced overall construction spending or dealing with an
atmosphere in the West Virginia Legislature where there is no appetite for revenue increases.”
The paving contractor said this has not diminished the resolve of the CAWV. “It’s in challenging
times that validates the value of the CAWV. The CAWV touches all aspects of our industry and
our membership. Your association stands for you. Your association will be there for you. I
thank you for the opportunity to serve as your president this past year.”
In passing the torch to C.R. Neighborgall, president of The Neighborgall Construction Company,
the outgoing president said, “I have gotten to know C.R. over the past few years. He is a super
guy and a quality individual. He will be a great president.”
2016-2017 President C.R. Neighborgall thanked President Cooperrider for his service. “Dan
was very proactive in bringing to the forefront issues affecting our industry,” he said. “He was
an ardent supporter of our Young Contractors Forum to guarantee getting young people
involved in our industry and our association. He also worked tirelessly during this year’s
legislative session to get our members involved in the legislative process. He was a great
advocate for our association,” he said.
The Huntington native is a fourth generation contractor and the third Neighborgall to serve as
CAWV president. His grandfather, Charles, was president of the AGC of West Virginia (the
predecessor to the CAWV) in 1959. His father, Charlie, was CAWV president in 1993.
“Membership is the strength and financial lifeblood of our organization,” he said. “I want to
continue what Dan has started with increased engagement of our younger members. They
represent a very bright future for our organization,” he said.
“We will have a new governor, new officials in the administration and new faces in the West
Virginia Legislature,” President Neighborgall said. “Our state will continue to face financial
woes, and I ask each member to become an even more active participant in this coming session
of the legislature. I look forward to serving you in the coming year,” he concluded.

C.R. NEIGHBORGALL ELECTED PRESIDENT AT CAWV ANNUAL MEETING
C.R. Neighborgall IV, president, The Neighborgall Construction Company, Huntington, was
elected president of the Contractors Association of West Virginia at the association's Annual
Meeting held July 14-17 at The Greenbrier. He replaces Dan Cooperrider, president, Old Castle
Materials, Mid-Atlantic Division, Dunbar, who will serve on the Board of Directors as immediate
past president.

TAX COMMISSIONER SUBMITS TENTATIVE 2017 PROPERTY TAX NATURAL RESOURCE
VALUATION VARIABLES FOR PUBLIC COMMENT
On June 30, 2016, the State Tax Commissioner published the 2017 tentative natural resource
property valuation variables which will be used by the State Tax Department for appraising
natural gas, oil, coal, managed timberland and other natural resources (including limestone,
sand, gravel, and other mined minerals) for ad valorem tax purposes. The Tax Department will
accept written public comments on the valuation variables until August 1, 2016. Final valuation
variables for 2017 will be filed in the State Register on or before September, 1, 2016.
For taxpayers engaged in the construction industry, the most relevant portion of the new natural
resource valuation variables deals with the annual valuation for property tax purposes of “Other
Mined Minerals” including limestone, sand, gravel and other aggregates which are used in
construction projects. For property tax purposes reserves of limestone, sand, gravel and other
aggregates are annually appraised either as active mining properties or reserves. Active mining
properties are annually appraised using an income based appraisal method that capitalizes
taxpayer’s income from production to produce an appraised value for the mineral reserve.
Reserve properties are appraised at the fixed price per acre, set forth in the valuation variables,
for each type of mineral produced.
The 2017 tentative valuation variables increased the Other Mined Minerals Capitalization Rate
from the 12.8% which was used for tax year 2016, to 13.1% for the 2017 tax year. Based on
the way the Tax Departments valuation formula works, an increase in the capitalization rate will
reduce the per acre assessed value of the taxpayer’s limestone, sand or gravel reserves.
Assuming all other factors remain the same, the increase in the capitalization rate for 2017
should reduce the appraised values of active properties by approximately 2.3%. With regard to
the appraisal of reserve properties, the per acre values used by the Tax Department for tax year
2016, did not change for tax year 2017.

INDUSTRY ISSUES DISCUSSED IN BUILDING DIVISION AT ANNUAL MEETING
The CAWV Building Division met at the CAWV Annual Meeting that was held July 14 – 17 at
The Greenbrier. Building Division Chairman Jamie Ridgeway, March-Westin Company, Inc.,
reported that CAWV Task Forces have been working on industry issues as they arise. Chairman
Ridgeway, who also serves as chairman of the CAWV / School Building Authority of West
Virginia (SBA) Task Force, reported that the SBA has a few projects ongoing but should have
several projects coming to bid later this year. He noted that the SBA did change some of the
language in their policies after they received comments from the CAWV Building Division
members after last year’s annual meeting.
Attendees also discussed the new West Virginia State Purchasing Division language that deals
with subcontractor list submissions on bids. Comments were developed at the meeting and
returned to the Purchasing Division for review. The new language, when it is completed, should
help bidders better understand the rules for subcontractor list submission. Look for updates on
the final language in future CAWV Building Bulletins.
Building Division members discussed several other industry issues that will be placed on the
agenda of the next CAWV Joint Architects Committee Meeting. For additional information,

JOINT ARCHITECTS COMMITTEE MEETING AUGUST 18
Chairman Derick Foster has scheduled a meeting of the CAWV Joint Architects Committee on
Thursday, August 18, at 10:00 A.M. at the CAWV headquarters. Several industry issues will be
on the agenda including the recent changes to document language concerning subcontractor
list submission. At 10:30 David Tincher, Director, Jessica Chambers, new Construction Buyer,
Guy Nesbit, Buyer Supervisor and Jimmy Meadows, General Counsel, West Virginia
Purchasing Division, will join the meeting to allow members to meet Ms. Chambers and learn
how her addition to the staff at the Purchasing Division will effect construction projects.
Committee members will also receive updates from the various committee task forces. Lunch

HERBERT HOOVER HIGH SCHOOL TO BE DEMOLISHED – CONSTRUCTION OF NEW
FACILITY PLANNED
In a special Kanawha County Board of Education meeting this week, it was announced that
Herbert Hoover High School in Clendenin will be torn down and a new facility will be
constructed. The decision was made after FEMA declared last week that the school has over 70
percent damage due to the recent flooding. An official location has not been selected yet, but
Superintendent Dr. Ron Duerring says the School Board will be searching for 50-70 acres of
land, outside of the flood area, while still in the Elk River community. School officials say they
expect FEMA to pay 75 percent of the cost of the new building, while the county school system
is hoping help from the state will knock their tab down to about 5 percent. In the meantime,
current high school students will split time with middle school students at Elkview Middle School,
until a modular campus can be set up for Herbert Hoover. School officials say the Herbert
Hoover building will be demolished. However, they hope to re-purpose the facility, possibly into
a sporting complex. Nicholas County’s new schools superintendent Donna Burge-Tetrick also
announced this week that three of the county’s schools, Summersville Middle, Richwood Middle
and Richwood High, won’t be able to reopen their buildings in time for the Aug. 19 start of
classes there and she is unsure if they can be reopened at all. More information on school
projects will be released to members as plans develop.
AGC-SUPPORTED BUILDING INFRASTRUCTURE BILL INTRODUCED IN THE SENATE
Before Congress left for their August recess last week, AGC secured the introduction of a
bipartisan Senate bill, the Public Buildings Renewal Act of 2016. (H.R. 5361 and S.3177). This
bill would create a new class of projects eligible for financing through private activity bonds
(PABs), including public buildings such as schools, post offices, libraries, and courthouses. A
companion bill was introduced in the House earlier this year. The focus is now to help gather
more support to get these bills passed through Congress when legislators return in September.

STAYING COOL ON THE JOBSITE THIS SUMMER
When the mercury starts climbing, keeping a hard-working crew cool and safe on the job site is
something any contractor has to give thought to. Heat stress can contribute to fatigue and
inattention, which can lead to mistakes on the job or even accidents. That’s why it’s a good idea
for you to conduct safety meetings at the start of the summer so that all of your employees can
review how they can keep cool in the heat. Below are a few tips for doing just that.
Make Sure Everyone Is Hydrated
Yes, this one may seem blatantly obvious. But even so, many workers fail to drink enough water
on a hot day. One of the reasons is that plain water is boring, which is why you want to make
sure you provide flavored electrolyte drinks like Gatorade. Even a bit of lemon squeezed into a
cooler can add a little flavor. Also, these drinks help to replace the electrolytes the body uses up
when it’s sweating. While bosses used to distribute salt tablets to workers, this is unnecessary.
We get plenty of salt from all the junk food we consume to replace any salt we lose by sweating.
The food your workers eat is also an important consideration. Large quantities of food with fat
and calories are going to put a big load on their digestive system, which in turn places stress on
the body when it’s already trying to deal with the heat. Instead, your workers should eat a large
breakfast and a light lunch, such as a salad or fruit (burgers and fries are out).
One way to minimize the problems your workers will face in the heat is to avoid that heat.
Consider rescheduling outside work for early in the morning or at night. In addition to the
modified work schedule, your foreman should allow for more breaks during the day. If workers
are going to be taking breaks in an air-conditioned space, make sure they have dry shirts to
change into. While this isn’t always possible, whenever it is you should provide umbrellas,
canopies or awnings to keep your workers out of direct sunlight. Even if it only provides partial
protection, having a little shade to hop into from time to time is better than having none at all.
You should also make sure that you provide high SPF sunblock for all crewmembers working
outside. In addition, you might want to provide wide brim hard hats. Neck protectors, cooling
vests, vented hard hats and bandannas are also effective ways to keep cool while working in
the sun.
You and your foreman should keep a close eye out for any indications of heat exhaustion
among your workers. Odd behavior can be one sign of heat exhaustion and must be addressed
immediately. Some of the symptoms of heat exhaustion include disorientation, weakness,
slurred speech and dropping tools. Obviously, this isn’t the kind of thing you want to happen
when someone is operating heavy machinery or using dangerous tools.
Note: If someone is suffering from heat exhaustion, he or she should rest in a cool location with
their feet elevated. Remove their work boots and position fans to lower their body temperature.
Provide plenty of water. If they are unconscious or unresponsive, contact 911 immediately

UTILITY DIVISION UPDATES PROVIDED AT ANNUAL MEETING
Mark Urso, president of Bear Contracting, Bridgeport, was elected CAWV Utility Division
Chairman at the Utility Division meeting during the CAWV Annual Meeting held July 14-17 at
The Greenbrier. Division members were brought up-to-date on activities of the West Virginia
Infrastructure and Jobs Development Council and the Water Development Authority and the
projects that are close to being advertised and bid. Members discussed a number of other
issues, including pipe pricing and availability, and the complicated process for obtaining and
permitting waste and material sites. It was noted that current Utility Division Chairman Tim
Spradling, Benchmark Construction Company, Inc., was elected CAWV Utility Division
Chairman.
Several other industry issues were discussed during the meeting and those issues will be
placed on the agenda of the next CAWV Joint Utility Committee meeting. For more information,

CAWV HIGHWAY DIVISION CRITICAL OF WVDOH INDUSTRY INTERACTION POLICY
CAWV Highway Division members and associates met during the CAWV Annual Meeting to
discuss many current issues. Division Chairman John Boyle, Mountaineer Contractors,
Inc., called the meeting to order and asked Bob Orders, Orders Construction Company, to
provide an update on West Virginians for Better Transportation (WVBT) and The Road
Information Program (TRIP). Mr. Orders explained how WVBT launched their highway funding
campaign, “Fix Our Roads,” this year at Transportation Day at the Capitol in January. The
campaign included radio, TV, billboard and newspaper advertising, combined with a strong
grass roots campaign. A survey conducted by WVBT revealed 62 percent favorable public
support for additional highway funding, he added. He told members that Senate Bill 555 passed
the Senate but unfortunately was not on the House agenda for a vote. He thanked members for
financially supporting WVBT, noting that the coalition would continue their efforts in 2017,
primarily utilizing newspaper and direct mail. He also explained how TRIP supports local and
national highway funding initiatives through research and public awareness.
The agenda turned to a roundtable discussion of industry issues beginning with the West
Virginia Division of Highway’s (WVDOH) new Industry Interaction Policy that removes industry
representatives from joint committees and establishes protocol where an agenda for discussion
topics must be submitted in writing, vetted, and approved by WVDOH management before any
interaction between WVDOH and industry occurs. Members were quick to criticize the new
policy, suggesting it will increase claims, reduce transparency, create confusion, delay projects,
increase costs to taxpayers and destroy the valuable working relationship between industry,
WVDOH and Federal Highway Administration. Division members recommended the CAWV and
other groups continue to object to the policy while exploring other strategies for preserving the
partnership.
The group also discussed flood recovery activities, WVDOH’s use of emergency contracting
procedures for initial response and pending flood related projects. Members also raised
questions regarding the WVDOH’s Boone County P3 project that would divert an estimated
$100 million initially for an access road to the former Hobet mine site.
During the division meeting, John Boyle was unanimously re-elected to another term as
Chairman of the CAWV Highway Division.
WVDEP PURCHASING WEBSITE READY FOR PROJECTS
With the passage of Senate Bill 474, the WV Department of Environmental Protection became
exempt from the requirements of review by the WV Division of Purchasing. The WVDEP has
completed the process to begin the advertisements of construction, reclamation projects and
special reclamation projects through the WVDEP website. That website can be accessed at
http://www.dep.wv.gov/bto/IHP/Pages/default.aspx. Bids by contractors will be submitted
through the wvOasis Vendor Self Service website at https://prod-fin-
vss.wvoasis.gov/webapp/prdvss11/AltSelfService. Contractors must be registered as a vendor
on the wvOasis Vendor Self Service Portal.

VIRGINIA PUTS BRAKES ON CORRIDOR H
The Virginia Department of Transportation (VDOT) has an entirely new way of selecting
transportation projects for funding, and construction of Corridor H is nowhere on their radar.
Charlie Kilpatrick, VDOT administrator, is quoted in the Moorefield Examiner saying his agency
is only doing project programming on a six year plan and that there are no plans to four-lane
Corridor H from the WV line to I-81. Kilpatrick noted under Virginia’s new system of selecting
and prioritizing transportation projects, counties, cities, metropolitan planning organizations and
planning districts can submit projects for review and scoring, and only after that can they be
selected for funding. “Corridor H,” Kilpatrick is quoted, “has not been submitted or proposed by
any of those entities. It is just not [a project] that has been encouraged by local governments or
politicians.”
Marvin Murphy, Assistant Deputy Secretary, is quoted as saying that if Virginia is changing
direction “I would have thought they would have had to make some arrangement with the
Federal Highway Administration, but we have not been a party to that. West Virginia is
committed to moving forward,” and that the Wardensville-to-Virginia “is our last segment … and
we have committed our money to it.” Robbie Morris, president of the Corridor H Authority, was
also surprised to learn things may have changed for the Corridor on the Virginia side.

FOR DEPARTMENT OF ENVIRONMENTAL PROTECTION
PROCUREMENT CONSTRUCTION AND RECLAMATION CONTRACTS
1. ACCOUNT: Vendor must have a wvOASIS Vendor Self Service account in order to submit electronic bids.
Visit www.wvOASIS.gov to create an account. The Department will only accept electronic bids submitted
through the Vendor Self Service application; it will not accept paper bids.
2. ELECTRONIC FILE ACCESS RESTRICTIONS: The Vendor must ensure that its submission in wvOASIS can
be accessed by the Department immediately upon bid opening. The Department will consider any file that
cannot be opened immediately and/or viewed at the time of the bid opening (i.e. encrypted files, password
protected files or incompatible files) to be blank or incomplete as context requires and, therefore,
unacceptable. The Vendor will not be permitted to unencrypt files, remove password protections or resubmit
documents after bid opening, if those documents are required with the bid.
3. REVIEW DOCUMENTS THOROUGHLY: The attached documents contain a solicitation for bids. Please read
these instructions and all documents attached in their entirety. These instructions provide critical information
about requirement that, if overlooked, could lead to disqualification of a Vendor’s bid. All bids must be
submitted in accordance with the provisions contained in these instructions and the Solicitation. Failure to do
so may result in disqualification of the Vendor’s bid.
4. MANDATORY TERMS: The Solicitation may contain mandatory provisions, identified by the use of words
“shall” or “must” or “will”. Failure to comply with a mandatory term in the Solicitation will result in
disqualification of the Vendor’s bid.
5. BID SUBMISSION: All bids must be submitted electronically through the wvOASIS Vendor Self Service Portal
before the date and time of the bid closing. Any bid submitted in the Vendor Self Service Portal is considered
to be in possession of the Department after the bid closing date and will not be returned for any reason.
6. BID CLOSING: Bids submitted in response to a Solicitation prior to the bid closing date and time will be
available to the public within 24 hours of the bid closing on the Department’s website.
7. ADDENDUM ACKNOWLEDGMENT: Changes or revisions to the Solicitation will be made by an official
addendum issued by the Department. It is the Vendor’s responsibility to check the Vendor Self Service Portal
for any addenda to any Solicitations for which the Vendor is interested in submitting bids. Submitting a bid
that does not include the information from the latest addendum will result in disqualification of the Vendor’s
bid.
8. NON-RESPONSIBLE: The Department reserves the right to reject the bid of any vendor as “non-responsible”
in accordance the Department’s Standard Specification for Construction and Reclamation when the Contract
Administrator determines that the Vendor submitting the bid does not have the capability to fully perform or
lacks the integrity and reliability to assure good-faith performance.
9. ACCEPTANCE OR REJECTION: The Department may accept or reject any bid in whole or in part in accordance
with the Department’s Standard Specification for Construction and Reclamation.

ADDITIONAL TERMS AND CONDITIONS FOR CONSTRUCTION CONTRACTS
1. CONTRACTOR’S LICENSE: West Virginia Code § 21-11-6 mandates that no person may engage in any act as
a contractor or submit a bid to perform work as a contractor unless that person holds a valid contractor’s
license issued by the West Virginia Contractor Licensing Board. West Virginia Code § 21-11-11 requires
any prospective Vendor to include the contractor’s license number on its bid. Failure to include a contractor’s
license number on the bid shall result in the Vendor’s bid being disqualified. The apparent successful Vendor
must furnish a copy of its contractor’s license before the Department will issue an award document.
2. DRUG-FREE WORKPLACE POLICY: Pursuant to W. Va. Code § 21-1D-4, the Vendor and its subcontractors
must implement and maintain a written drug-free workplace policy that complies with the West Virginia
Alcohol and Drug-Free Workplace Act, W. Va. Code § 21-1D-1, et seq. The Department shall cancel the
contract if: (a) the Vendor fails to implement and maintain a written drug-free workplace policy described in
the section; or (b) the Vendor fails to provide information regarding implementation of its drug-free workplace
policy at the request of the Department; or (c) the Vendor provides to the Department false information
regarding its drug-free workplace policy.
* Pursuant to W. Va. Code § 21-1D-2(b), this policy does not apply to construction contracts the value of
which is less than $100,000 or to temporary or emergency repairs.
3. DRUG-FREE WORKPLACE AFFIDAVIT: West Virginia Code § 21-1D-5 provides that any solicitation for a
public improvement contract requires each Vendor that submits a bid for the work to submit at the same time
an affidavit that the Vendor has a written drug-free workplace policy. To comply with this law, the Vendor
must either complete the attached drug-free workplace affidavit and submit the same with its bid or complete
a similar affidavit that fulfills all of the requirements of applicable State law. Failure to submit with the bid
this signed and notarized drug-free workplace affidavit or a similar affidavit that fully complies with W. Va.
Code § 21-1D-5 shall result in disqualification of the Vendor’s bid.

4. DRUG-FREE WORKPLACE REPORT: Pursuant to W. Va. Code § 21-1D-7b, no less than once per year, or
upon completion of the project, every Contractor shall provide a certified drug-free workplace report to the
Department. The report shall include: (a) Information to show that the education and training service to the
requirements of W. Va. Code § 21-1D-5 was provided; (b) The name of the laboratory certified by the United
States Department of Health & Human Services or its successor that performs the drug tests pursuant to the
West Virginia Alcohol and Drug-Free Workplace Act; (c) The average number of employees in connection
with the construction of the reclamation project; (d) Drug test results for the following categories, including
the number of positive tests and the number of negative tests: (i) Pre-employment and new hires; (ii)
Reasonable suspicion; (iii) Post-accident; and (iv) Random. The Vendor should utilize the attached Certified
Drug-Free Workplace Report Coversheet when submitting the report required by this section.
