DUTIES IN THE EVENT OF A LOSS
IMPORTANT CLAIMS NOTICE
It is absolutely imperative that the operator of the insured’s vehicle provide us with their full
cooperation in a timely manner. Failure to do so may be considered a material breach of the terms
and conditions set forth in the policy of insurance issued by Maya Assurance Company (“Maya”).
We refer you to the Maya policy, specifically SECTION IV – BUSINESS AUTO CONDITIONS, Part A –
Loss Conditions, which reads in pertinent parts as follows:

We have no duty to provide coverage under this policy
unless there has been full compliance with the following duties:

As you may be aware, the named Insured as owner of the vehicle, is by law, LEGALLY LIABLE for the
actions of all permissive operators of their vehicle.
Therefore, in accordance with the terms and conditions of the Maya policy, failure of either the Named
Insured or the Insured Operator to fully cooperate with us in a timely manner may result in a denial
of coverage to BOTH. Should this occur, Maya will no longer continue to defend nor indemnify them
with respect to any lawsuits, settlements, judgments, costs, fees or disbursements entered against
them in connection with this loss.
This means that any judgments rendered against the insured or operator will have to be paid
out of their own funds.

MAYA CLAIM HANDLING INFORMATION
Livery Vehicle Claim Handling in New York City
In recent years, the Automobile Claims industry has seen a dramatic increase in the volume of injury claims
reported; particularly those of a suspect nature. Many of them can be identified and handled appropriately
only if they’re investigated promptly, as NYS regulatory guidelines require carriers to make certain decisions
within a 30 day time period. In general, the livery business has a difficult time managing these sorts of claims,
because many losses are never reported, or are received with little information. You can assist us in handling
these matters in an appropriate manner if you are able to provide us with the following information as soon
as possible:
Police reports: The police should be called whenever an accident occurs, regardless of how minor it may
seem. It is important for insureds to obtain a copy of the report and complete information regarding the other
vehicle and its occupants after the loss. It takes Maya up to three weeks to obtain the report, while drivers are
able to obtain a copy the day after the accident. This can significantly expedite our claim handling. Drivers
often encounter language barriers at accident scenes and their version of the loss may be misinterpreted.
Advise them that it is their right to seek an amendment to any report.
MV 104’s: Completing this form is a state requirement for any accident where there is a personal injury or
more than $1,000 in damages. Remind the insured that if no form is submitted, drivers can lose their license
if they do not comply within 10 days. If the driver feels the other party was a contributing factor in the loss,
be sure they note it on the MV-104.
Photographs of vehicles and accident scene: Photographs can greatly enhance our defense if a claim is
presented.
Updated information: Many livery drivers spend part of the year abroad in their country of origin, so
addresses and phone numbers obtained when the policy was purchased may no longer be valid. Please ask
your insureds to frequently update you with all of their driver contact information; perhaps monthly when
they receive their bill. We must be able to reach them to protect them against potential claims.
Responses to Maya’s requests: Please instruct your staff to respond to our requests promptly, be it by phone
or e-mail, even if you are unable to provide us with the information we’re looking for. We must know if we
need to explore alternate means to obtain the information. The Maya claims department is here to assist you

Commercial Auto Considerations
Maya Assurance Company’s Commercial Automobile Program provides Liability and Physical Damage
Coverage for Vehicles that are used for business purposes.
Our Commercial Automobile Program has a focus on service and retail business owners, artisans and
service contractors, with light to medium weight vehicles.
Limits
 Liability coverage up to 100/300
 Physical Damage coverage with Deductible of $500 or $1000
Radius of Operation
 Local to Intermediate

LIVERY NEW BUSINESS APPLICATION
Each application must be fully executed, duly signed by the Insured and Broker with all current
supporting documents including applicable deposit, hack license, driver’s license, MVR, Vehicle
Registration and Base Letter before a line is processed.
GUIDELINES
Maya Assurance Company will consider operators affiliated with New York City Taxi & Limousine
Commission facilities under the Black Car, Car Service and Street Hail Livery designations.
There will be No Broker of Record Changes during the middle of the policy year. Producers can
service affected accounts and submit payments manually, on a gross basis, to accounting.
CLAIMS REPORTING
Don’t delay. The faster we receive the policyholder’s claim notification, the quicker we can expedite
the claim settlement process, reducing the expenses associated with most claims. It is very
important we have cooperation from Policyholders and you our valued producers to expedite the
claim. Please have drivers involved in an accident, come to your office immediately and give a full
statement. It is particularly important to immediately obtain a statement from a driver
involved in a Personal Injury loss. Besides the Police Report, the MV104 is also required. Failure
to Report Accidents will result in Policy Cancellation.
All policies with Undisclosed Drivers will be reclassified to a higher premium and or cancelled
immediately. No Exceptions.

LIVERY RENEWAL UPDATE
Renewal Application
The 2016 Renewal Application must be signed by the producer and insured and returned to our
office along with a copy of the Renewal Quote Information letter and supporting documents.
Submission of documents to Maya
Producers are encouraged to submit a single PDF attachment to Maya inclusive of copy of deposit
check, signed renewal application and letter, and required supporting documents. Please refrain from
submitting multiple PDF attachments as the practice increases the time it takes to process business.
Renewal Preparations
The proposed symbol and premium on the renewal letter and application are the end result of a
comprehensive review process undertaken by the underwriting and claims departments of the
company. The following are activities completed by the company prior to proposing the renewal:
1. Electronic delivery of IIES expiration notices to the DMV.
2. Motor Vehicle Records ran for all New York and New Jersey licensed owner operators and
named drivers risk.
3. Scoring of MVRs based on filed credits and surcharges.
4. Comparative negligence analyses for claims covered by Maya Assurance Company.
5. Accidents on MVR not covered by Maya reviewed for comparative negligence if Police Report
was part of submission. Kindly provide Police Report where requested on the renewal
questionnaire as same is necessary to adequately rate the policy.
6. Issuance of non-renewal based on adverse loss experience or vehicle age.
7. Company Longevity Review.
8. TLC radio group audit conducted based on recent data obtained from the commission.

LIVERY RENEWAL UPDATE
2003 and older vehicles
Policyholders with 2003 and older vehicles will be issued a non-renewal based on vehicle age.
Affected policyholders can secure their renewals by upgrading their vehicle.
Proof of Address and Updated Contact Information
Producers are encouraged to update the company with current mailing address, email address,
mobile and home phone numbers for policyholders as this information is extremely important to
both the claims and underwriting processes.

Maya Agency Portal is now capturing the insured emails address, if not applicable enter NA as the
field is mandatory
Also, the January Renewal application was updated to enter the email address
Proof of Address
All applicants must submit valid proof of address. Acceptable documents include the following:
1. Current Utility Bill
2. Bank Statement
3. Credit Card Statement

The company reserves the right to confirm the veracity of the information provided supporting our
various filed credits and surcharges.

NEW BUSINESS UNDERWRITING GUIDELINES
Maya Assurance Company underwrites with consideration to the following factors:
 Driver’s Motor Vehicle Record and Claims history
 Vehicle (Year and Model)
 Radio Group of Affiliation and Mode of Operation
DRIVER QUALIFICATIONS:
An acceptable driver will meet the following guidelines:
1) Driver must have attained 23 years of age.
2) Drivers age 66 and older must be submitted to the company for prior approval and a
physician’s statement attesting to their ability to operate a livery vehicle must accompany the
application.
3) Driver must have held a valid license issued by one of the fifty United States or Puerto Rico
for a minimum of two years prior to application and must, at the time of application, hold a
valid Driver’s License.
4) Driver must at the time of application hold a valid NY TLC Hack license.
5) Applicants licensed for less than three years will be surcharged as per the company’s filed
underwriting guidelines.
Accidents and Convictions:
 Non-Chargeable accident: Must be supported by a Police Report and or carrier’s loss data
 All infractions are assessed based on incidents dated within the past 36 months
 Inexperienced drivers will not be eligible for Safe Driver Discount
 Operators not maintaining a valid US license for a minimum of 36 months prior to
application will not be eligible for the Safe Driver Discount
 Any driver with five (5) or more minor traffic infractions will not be eligible for the Safe
Driver Discount.
 A police report is required for any accident involving Personal Injury if the loss occurred
within 36 months of the application date.
 Defensive Driving Credit will be applied with valid certificate or notation on the Motor
Vehicle Abstract.
 Defensive Driving Credit will not be applied based on a Temporary Certificate
For any violation, occurrence date rather than the conviction date is to be utilized.

INELIGIBLE RISK
 Leaving the scene of an accident within the past 60 months
 Currently suspended DMV driver license

Conviction for a felony involving the use of a motor vehicle within the past 60 months
VOUCHER EARNINGS (Black Car and Preferred Luxury Car Service):
a) The company will periodically verify radio-base affiliation and the underwriting department may
require evidence of voucher earnings.
b) The company will audit the Commission’s website as a means of confirming base affiliation.
c) The company may also contact radio groups to confirm affiliation
VEHICLE QUALIFICATIONS:
An acceptable vehicle will meet the following guidelines:
Standard Black Cars- 2013 or newer luxury sedans will be considered for new business.
Preferred Black Cars- 2014 or newer- eligible (See sample class 1 vehicles, pg. 12) luxury sedans will be
considered for new business.
 Affiliated radio group must be must be a member of the New York Black Car Operators Injury
Compensation Fund.
 Eligible affiliates must be able to verify the minimum 90% vouchered earnings requirement.
 A list of Black Car facilities whose affiliates may qualify for the program is made part of the manual.
 Affiliates of TLC classified Black Car facilities not listed should be submitted to the underwriter for
review and classification.
Standard Luxury Car Service- 2013 or newer luxury sedans will be considered for new business.
Preferred Luxury Car Service- 2014 or newer luxury sedans will be considered for new business.
 A list of Car Service facilities whose affiliates may qualify for this program is made part of the
manual.
 Eligible affiliates must be able to verify the minimum 30% vouchered earnings requirement.
 Black Car affiliates earning less than the minimum 90% vouchered earnings may qualify for the
Preferred Luxury classification.

PREMIUM PAYMENTS
New Pay-Plan Fee
Effective January 1, 2016 a new $10 Pay Plan fee is applicable to all policies (including Black Car
owner operators). The fee is due at issuance along with the deposit and MVLE Fee.
Batch Management System
All brokers must use the batch management system to submit payments unless instructed
otherwise by an Accounting Representative. Training will be available for those unfamiliar with the
system.
Payments for Reinstatements
When submitting payments please note, for Policies under Cancellation Notice, Full Payment must
be remitted to ensure the reinstatement of the policy including premium dues and late payment
fees. Prior approval will be required if submitting payments after the cancellation effective
date.
Gross Payments for Brokers servicing an account
For Brokers servicing an account, payments must be remitted in the Gross Amount. Commissions
received from servicing Brokers will be disbursed to the Producer of record at the end of the policy
term.
