What’s happening in western Nova Scotia’s
lucrative inshore fishing industry? Four related things loom clear:
1) The federal Conservative government’s decision to retain the principal that “A licence confers privileges and not any right of property,
and may not be transferred” in Canada’s proposed new Fisheries Act.
Bill C-45 was still hung up on Second Reading when the House of
Commons recessed for the summer on June 12.
2) The federal Department of Fisheries and Oceans’ (DFO) announcement on April 12 of a new policy to eliminate “Controlling Agreements” (better known as “trust agreements”) from the East Coast
inshore fishing industry within seven years.
3) The progress through the courts of the so-called Bingo case, which
sometime early next year will conclude with a landmark decision on
exactly what sorts of legal rights commercial fishermen hold in their
licences, including property rights and their right to designate who will
get their licence when they leave a fishery.
4) The formation in western Nova Scotia of the Coalition for an
Economical Atlantic Fishery in direct response to the April 12 policy
announcement. The association is gearing up to fight the attempt to
squeeze “controlling trust agreements” out of the inshore fishery.
Trust agreements as employed in the East Coast fishing industry
usually involve the licence holder giving up the right to designate a
successor to his/her fishing licence in return for financial backing,
which until now has been unavailable to fishing captains from regular
financial institutions such as banks.
Former federal fisheries minister Robert Thibault (Liberal MP for
West Nova), who hails from District 34, estimates there are some
1,000 lobster licence holders in District 34 and part of 33, in Shelburne, Yarmouth and Digby counties, with each licence valued at
about $600,000 - prior to April 12, when the price dropped by more
than half.
That works out to a pre-April 12 total capital value of some $600 million dollars in lobster licences alone for the province’s western region.
That’s more than half a billion dollars in retirement income for fishermen and their families.

In this context, it is not hard to see the fuss that’s been created about
denying fishermen “any right of property” in their fishing licences and
stating that licences “may not be transferred,” as Section 30 (1) of the
proposed new fisheries act states. It is precisely these kinds of things
that have made Canadian banks unwilling to accept a fisherman’s
interest in his/her fishing licences as collateral to purchase them in the
first place.
That could soon change, however, not as the result of any action by
the federal government—but rather because of a decision in the Bingo
case by the Supreme Court of Canada. The Supreme Court of Nova
Scotia and the province’s Court of Appeal have already ruled in the
Bingo case in favour of certain property and transfer rights for the
holders of commercial fishing licences.
The case involves a licence holder in western Nova Scotia, Benoit
Joseph Saulnier of Meteghan, who in 2004 was forced into receivership by the Royal Bank of Canada. Saulnier held four fishing licences
for herring, swordfish, mackerel and, most significantly, lobster in
District 34.
Chief Justice Joseph Kennedy of the Supreme Court of Nova Scotia
heard the case in July of 2005, ruling on January 31 2006 that commercial fishing licences were indeed forms of property under both the
Nova Scotia Personal Property Security Act (PPSA) and the federal
Bankruptcy and Insolvency Act (BIA). On March 2, 2006, the Chief
Justice issued an order declaring this, requiring Saulnier to sign the
necessary documents to effect the transfer of the four licences to the
trustee’s designate.
Saulnier appealed to the Nova Scotia Court of Appeal, which on July
25, 2006 denied the appeal and confirmed the Chief Justice’s order.
Saulnier since has sought and received leave to appeal to the Supreme
Court of Canada, and the case is now tentatively scheduled to be heard
on January 23 of 2008.
The Coalition for an Economical Atlantic Fishery is now seeking
intervenor status to support the case that commercial fishing licences
are indeed a form of transferable property that can be used by lending
institutions as security on loans.
Powerful stuff, which has the potential both to invigorate the commercial fishery and, used unwisely, to lead to concentration of ownership
of lobster licences into just a few hands.
The industry needs the first but not the latter.

Lunenburg is a community that has
deep roots, strong traditions and a
proud maritime heritage. For as long
as most can remember, the fishery
has been an important economic
driver for this UNESCO designated
community. Each year the community celebrates the work of those
who went down to the sea in ships
and those whose livelihood came
from the sea. Over the years whether
it has been the Nova Scotia Fisheries
Exhibition or the Fishermen’s Picnic
the community, the community
comes together to recognize the
hard work and dedication of these
individuals. The festival built a
reputation for grand street parades,
midways, tradeshows and waterfront
activities highlighting the Atlantic
fishery. However as the fishery
evolved, so did the event, and it is
now known as the Lunenburg
Waterfront Seafood Festival.
Today, fishing is no longer the mainstay of the economy in Lunenburg.
The community is now a major
tourism destination and a UNESCO
World Heritage site. While the presence of the fishery is still evident,
the tourism and hospitality sector

In early in 2007 a local group met
to consider options for the festival.
Buoyed by community support,
the group chose to continue the
festival incorporating new events
with the established core events,
and forge on. Committed to celebrating our past, the heritage, traditions and sea faring legacy that
has been the Lunenburg Fishery,
new events and headline entertainment such as the High Liner Foods
J.P Cormier show will bring the
crowds back. J.P. is a 2007 triple
ECMA award winner.
The core elements of the festival
will continue to be the dory races
and scallop shucking. Newly incorporated will be seafood kiosks
and cooking demonstrations. In
addition there will be Celebrity
Scallop Shucking featuring local
celebrities.

TROUT OR
ENDANGERED
SALMON?
If you are thinking about heading
out to do some recreational trout
fishing on the Gaspereau River in
Nova Scotia, think twice. Not about
fishing, per se, but about what you
may catch. You may not know that
in addition to common brook trout,
the Gaspereau River is also inhabited
by endangered inner Bay of Fundy
(iBoF) Atlantic salmon. Many of
these are adult salmon that have been
released by the Department of Fisheries & Oceans (DFO) Coldbrook
Biodiversity Facility. It is important
to recognize this endangered species
and avoid mistaking them for unusually large brook trout.
IBoF Atlantic salmon is an endangered species protected under the
Species at Risk Act (SARA), which
means it receives extra protection. Under SARA it is an offence
to capture or harm an endangered
species. Those who recreationally
fish on the Gaspereau River must
take any precautions necessary to
minimize their interactions with the
Atlantic salmon residing in the river.
If an Atlantic salmon is accidentally
caught, carefully release it back into
the water alive.
In the late 1980s there were as many
as 40,000 iBoF Atlantic salmon,
and Gaspereau River was one of the
waterways in which they thrived.
However, by 2004 the inner Bay of
Fundy population had been reduced
to as little as 200. This quick and
drastic reduction in numbers makes it
all the more important that recreational fishers respect the ban on
salmon angling.
DFO Coldbrook Biodiversity Facility
plays a role in attempts to revitalize
iBoF Atlantic salmon stocks. Many
of the salmon found in the Gaspereau
River are a result of one of the facility’s major initiatives, the rearing
of adult iBoF salmon. These unique
salmon are released into the river
each year in an effort to save this
population from extinction.

What Goes Around, Comes Around:
the Homecoming of a White Star Line Flag

On April 1st, 1873, the small fishing community of Terence Bay found
a horrific surprise awaiting them, but unfortunately it was no April’s
Fools joke. The SS Atlantic, a luxury steam ship of the White Star Line,
had run aground off Marr’s Head. Of the 952 passengers aboard, 562
lost their lives, and many (277 to be exact) are buried near St Paul’s
Anglican Church. Of the passengers, no women survived, and all but
one child perished in the wreck.
Many in the community have contributed to the preservation of the
burial sites as well as creating a heritage park and interpretation centre
for the public to visit and learn of the largest marine disaster before the
Titanic.
But more recent news has brought much excitement to the Heritage
Park and the community; the acquisition of a White Star Line flag that
dates to the late 19th century as well as the identity of the generous man
who donated the flag.
Andrew Thomas, originally from England but who now lives in Illinois,
had found out some fascinating news about a relative. His great-grandfather, James Williams, had a disturbing secret. He was Captain of the
SS Atlantic. After surviving the disaster, Captain Williams tried to hide
from his past by leaving the seas and starting a hotel, and the tragedy
of the SS Atlantic was kept a family secret for years. It was not very
long after learning this dark secret that Mr. Thomas became aware of a
White Star Line flag for sale.
The flag itself has 2 varying
stories about its origins. One
states that the flag flew over
the White Star Line offices
in Halifax, while the other
states that this flag had flown
on the SS Atlantic. Either
story is interesting as both
tie it to Nova Scotia during
the late 19th century. Mr.
Thomas acquired the flag and
in September of 2006, sailed
to Halifax on the Queen Mary
2 to donate the flag to the SS
Atlantic Heritage Park.
The Heritage Park has had the
flag restored and assessed by folk singer Clary Croft and his wife Sharon,
who are experts in the field of fabric preservation. Thanks to their help, the
Heritage Park now displays what may possibly be the oldest White Star
Flag in existence. Visitors are welcome to see the flag and other artifacts

Lights along the Shore Lighthouse
Festival (September 14-16, 2007)

With approximately 160 lighthouses in Nova Scotia, they have become a shared
symbol of our culture and lifestyle. Our Lighthouses are viewed by thousands!
Each year, tourist and locals visit these revered bastions along our coastal
communities. Each lighthouse offers something unique including mesmerizing
scenes, unpredictable waters, crashing surfs, unique wildlife—and sometimes a
chance to watch brave souls venture to sea.
Lighthouses in South West Nova Scotia have become prominent attractions.
They tell a piece of history that has enriched the lives of the people in the
region. These handsome icons with striking raw landscapes attract people
worldwide. And because people are drawn to lighthouses, Destination South
West Nova Scotia will introduce the Lights along the Shore Lighthouse Festival
for its 8th year.
With the help of spirited communities, the 3-day event continues to grow each
year. The festival has included activities from Hantsport to Peggy’s cove, and
grows in popularity because more lighthouses are part of the festival each year.
A number of interesting activities take place, which locals and visitors alike
find very appealing.
The Lighthouse route begins at Cape Forchu Lightstation located in Yarmouth County. It’s one of Nova Scotia’s most photographed lighthouses
and is also designated by the Province of Nova Scotia as a registered Heritage Property. In the 17th century, Samuel de Champlain discovered this
forked tongue of land and the original lighthouse was built in 1840. The new tower—93 feet of majestic beauty—still remains a notable and historic
landmark in the region.
The Friends of the Yarmouth Light Society, care takers of the Lightstation, welcomed the addition of the Mug Up tea room in 2006. The 20 seat cozy
tea room in the original light keeper’s dining area will host the Lights along the Shore pancake breakfast. From 8:00am to 11:00 a.m., Friday through
Sunday, guests will be served homemade pancakes, sausages and a beverage for $5 per person. This breakfast-by-the-sea can also be enjoyed outside
at one of the many picnic tables on site. For more information, call 742-4522.
Other lighthouses in the region taking part in the festival:
Le Village Historique Acadien in West Pubnico, Yarmouth County, is home to the Abbotts Harbour Lighthouse. During the festival, visitors are
welcomed to do some bird watching and experience the authentic “way of life” of the Acadians while watching staff demonstrate traditional trades of

Fort Point Lighthouse in Liverpool is the third-oldest surviving lighthouse in Nova Scotia, built in 1855. On Saturday, September 15th, the lighthouse will host local artisans displaying unique paintings and crafts. Enjoy a local fiddler and sea shanties while you tour the museum by the staff
dressed in period costume. All visitors are welcomed to participate in a scavenger hunt and listen to stories of the sea. Free admission. For more

For birding enthusiast, the Baccaro Lighthouse, near Port Latour, Shelburne County, invites you to bring your binoculars and join local birders to
view pelagic birds such as the northern gannet on Friday, September 15th. For further information, call 902-275-8631 or meet at the Baccaro Light

The Sandy Point Lighthouse community hall, near Shelburne welcomes everyone to come enjoy a delicious breakfast on Saturday, September 15th
from 8:00 a.m. to 11:00 a.m. Cost is $6 per person and $3 for children 12 and under.
The Gilberts Cove Lighthouse, built in 1904, located in Digby County overseeing St. Mary’s Bay is one of the last of its kind in Nova Scotia and will
also be taking part in the festival.

Oh dem cranes!
I had a conversation a few years ago
with a couple of guys who manufacture
and sell marine cranes—Lance Washburn, Sales Manager for Hydra-Pro,
Inc., a manufacturing, design, and sales
company based in Seattle, Washington; and William Morgan,
Owner of The Morgan Company in Fortuna, California. Some of
their insights into choosing the right crane might be helpful.
First of all, whether you choose fixed, telescoping, or articulated
depends a lot on the application and the fishery, but also on personal preference and how much versatility you need.
“Crabbers prefer the knuckle or knuckle-extension crane,” says
Washburn, “for the simple reason that it gives them more control
of the pot.”The knuckle crane,” he explains, “allows the operator to keep the tip of the crane closer to the load, which makes it
safer on a crab boat. On a crab boat you [also] have a pot guard
or a crab cage at the tip of the boom. It’s a kind of a tripod arrangement with a rubber tire that allows you to compress the tire
with the pot right at the sheave head.”
Knuckle or articulated cranes have a several other advantages.
True articulated cranes can fold up and stow in less deck space,
and, in general, knuckle cranes are faster to operate. As William

Morgan explains: “A telescoping crane is usually operating in
one plane, one function at a time. They’re very slow because
the operator winches, then booms, then swings. Articulated
cranes are much faster. They can move in three planes at once,
like an extension of your arm.”
Morgan also points out that the articulated crane is the highest capacity crane for its size, weight, and cost. “A telescoping
crane runs at lower pressure, so it has larger cylinders,” he says.
“The knuckle crane has higher pressures and smaller cylinders,
and it’s made of higher strength steel. Overall it’s a lighter
crane and it lifts more.”
The fact that Morgan says the articulated crane is less expensive might come as a surprise to people shopping for their first
crane. “You take the same capacity crane—telescoping versus
articulated—and you’re talking up to twenty five percent less
money for the articulating crane,” says Morgan.
By the way, Morgan says the true knuckle crane stows in the
shape of the number 4.
