SABA’s highly acclaimed Criminal Law
Institute is just around the corner on April 1112, 2014. This Institute represents the 51st anniversary of this CLE program, designed to
provide judges and counsel with thorough,
scholarly presentations on crucial criminal law
issues of the day.
Co-sponsored by the Texas Criminal Defense Lawyer’s Association and the San Antonio Criminal Defense Lawyers Association, this
year’s Institute continues its long tradition of
providing valuable information on topics of interest to both new and experienced lawyers and
judges. Dedicated to the “prime mover” who
organized the first several seminars, the Institute was renamed the A.A. Semaan Criminal
Law Institute in 1970, in honor of the late A.A.
Semaan — lawyer, judge and legal scholar extraordinaire. This year’s seminar will be moderated by the Institute’s current prime movers,
John Convery, Mark Stevens and Robert Price.
This year, the Criminal Law Institute will
take place at the lovely San Antonio Marriott
Northwest (3233 NW Loop 410, 78213). Centrally located, the Marriott is near the San Antonio
Medical Center and offers FREE parking.
The pre-registration deadline is April 7 at
5 p.m., at a cost of $225. Registration after April
7 through the day of the event is $275. The fee
includes seminar materials and Friday lunch.

Blessed are the
Peacemakers*
The rule of law is a concept that has
existed since Moses received the Ten
Commandments on Mount Sinai, and
the Code of Hammurabi was implemented in Mesopotamia. As in ancient times,
the law is the body of rules governing
the conduct of human beings. The rule of
law makes those rules paramount to any
individual person or group of persons,
no matter how powerful the individual
or large the group. Inherent in the rule
of law is equal treatment under the law.
The intended result of the rule of law is
peaceful coexistence of the citizens in society, but peace often depends on a system available for the fair administration
of justice and disposition of disputes.
Globally, the United Nations has
long recognized the critical importance
of strengthening the rule of law to peace
building. Conflicts that rage globally from
Syria to Kiev reflect a complete breakdown
in institutions entrusted with upholding
the law. Many of the peoples’ grievances
related to oppressive and exclusionary regimes arise from instances where the judiciary is simply a tool of the ruling regime
or an autocratic ruler. An independent judiciary and lawyers are critical to sustaining peace in these societies.
Lawyers are essential to the implementation of the rule of law. It was American

lawyers who conceived the rule of law as it
is embodied in our Constitution and Bill of
Rights. Bar Associations, where lawyers act
collectively, are an important bulwark of
the rule of law today. They serve not only
their members, but also the public. The San
Antonio Bar Association strives to serve
both our members and the public through
continuing education seminars and programs such as the Community Justice Program’s wills clinic, which serves elderly in
our community. By helping those in need
through the Community Justice Program,
a primary component of the rule of law —
equal access to justice — is served.
Individually we can defend the rule
of law by supporting an independent judiciary. The public must have trust and
confidence in its judiciary and the legal
process or the rule of law suffers. Recent
scandals involving judges and attorneys
breach the public’s trust. We contribute
to the further erosion of the trust when
we complain of a judge’s ruling — telling
our clients (without basis) that the judge
favored the other side for myriad reasons
unrelated to the case: political, monetary,
personal bias or prejudice. While it is difficult at times to explain negative rulings
to the client, unfounded attacks on the
judge and the process only serves to degrade the legal system and frustrate the
peaceful resolution of the dispute.
This month, SABA is honoring several
peacemakers within our community. We
are proud to honor Sara E. Dysart with
the Peacemaker Award; Joe R. Hinjosa
with the Community Service Award and
NuStar Energy with the Corporate Community Service Award. The awards are
well deserved and will be presented on
Saturday, March 29 at the Japanese Tea
Garden. Join us for this special evening
as we celebrate the 30th anniversary of the
San Antonio Bar Foundation and its ongoing efforts to promote peace and access to
justice within the San Antonio community.

Mentor COMMITTEE
In January, our mentors and mentees
met to hear one of its own, Jeff Akins, discuss the all-important topic of setting and
collecting fees. Jeff provided a number of
very good pointers and “lessons learned,”
but my primary take-away was the importance of setting client expectations early
and in writing. For many, our clients come
to us because of a problem they wish they
did not have, and more so, that they often
cannot afford. Establishing a harmonious
relationship under such acrimonious circumstances can thus be challenging, particularly for lawyers new to the practice of
law. However, even with a lack of experience, frequent and frank conversations
with clients about their matters will not
only help to create a strong attorney-client
relationship, it but also improve the attorney’s bottom line. We certainly thank Jeff
for sharing his insight and practice tips,
and we look forward to more discussion
on this critical topic in the future.
For those in the civil litigation realm,
we all know that mediation is inevitable.
More and more these days so too is arbitration. Because arbitration and mediation are
increasingly prevalent, we were pleased to
welcome Bill Lemons as a speaker during
our February group meeting. Bill has been
an active arbitrator and mediator for over
17 years, handling primarily employment
and commercial disputes. He shared his insight into the pros and cons of arbitration,
including interesting statistics that indicate
arbitration may be producing results mirroring jury outcomes in employment matters. He also discussed tips for interacting
with an arbitrator or mediator in order to
get the most out of the process for our clients. Because arbitration and mediation
are here to stay (at least for now), we appreciate Bill taking the time to educate
our mentors and mentees on this increasingly important area of practice.
Our next group meeting will feature
one of our Fourth Court Justices, the Honorable Marialyn Barnard, and one of our
local appellate attorneys, Kimberly Keller
of Keller Stolarczyk, PLLC. In addition to
addressing appellate practice in general for
both criminal and civil practitioners, they
specifically plan to address error preservation, available types of appellate remedies,
recommendations for oral argument and
current trends amongst the appellate courts.
We look forward to having them join us.

Each month the CJP would like to recognize a mentor that volunteers their
time and expertise at the CJP Family
Law and Wills Clinics. Our first Volunteer Mentor of the Month is family
law attorney Rick Noll. A frequent
volunteer mentor at the CJP Family
Law clinics, Rick often “drops by” a
clinic to see if his assistance is needed.
The younger brother of 408th District
Court Judge Larry Noll, Rick has been practicing law for
almost 40 years. A longtime CJP volunteer mentor, we are
always pleased when Rick stops by the clinic to help mentor our volunteer attorneys and offer his assistance even
after the clinic has ended. We are most grateful to all our
family law volunteer mentors, whose expertise and legal
knowledge is most appreciated by our volunteer attorneys,
the majority of which do not practice family law. We thank
Rick for his continued support and commitment to the CJP
and look forward to him stopping by at future clinics.
Volunteer of the Month
Each month, we are honored to recognize a CJP volunteer or an organization that has gone above and beyond or
done an exceptional job with the CJP.
The 2014 March CJP Volunteer of the
Month is Deborah Jackson. A longtime volunteer, Deborah has participated at all three legal clinics (Wills,
Veterans & Family Law) in a variety
of capacities. An attorney with Shelton & Valadez, P.C., Deborah encourages her colleagues at
the firm to join her at the CJP clinics and volunteer to “just
take one” pro bono case. During the clinics, Deborah often
takes more than one pro bono case back to the office and
has been both a mentor and CJP volunteer. Her cheery demeanor and sense of humor is always appreciated at the
clinics and her commitment to pro bono, while managing
a busy caseload through the firm, sets a great example for
others to follow. Whether mentor or volunteer taking a pro
bono case, Deborah will always stop what she is doing to
answer questions and assist others. We are grateful to have
Deborah as a friend of the CJP and always look forward to
seeing and working with her at the legal clinics. We thank
Deborah for her commitment and tireless efforts to increase access to legal services for the low-income residents
and veterans in our community.
If you would like to volunteer to “Just Take One” pro bono case, we welcome and appreciate
your participation. Volunteer attorneys are eligible to receive 5.0 hours of free CLE, including
1.0 hour of ethics, for taking a case. The Community Justice Program will hold a Family Law
and Veterans Clinic during the month of March.

Ethics Follies raises
$25,000 to support the CJP!
The CJP was excited to learn that
the ACC South Central Texas Chapter’s annual Ethics Follies production raised $25,000 to support the
Community Justice Program and
their efforts to increase access to
pro bono legal services. To date,
proceeds generated from Ethics Follies has raised $143,000 for the CJP
and has allowed the program to
continue its mission of providing
pro bono legal services to indigent
veterans and residents in our community. The CJP is most grateful
for the continued generosity of the

Teams:
1. Each team may have a maximum of 4 members, of which 2 members must be attorneys; all members should
conduct themselves appropriately for a family atmosphere and any misconduct or intoxication of any member of the team is grounds for disqualification and ejection of the team;
2. There will be a limit of 30 teams;
3. Team entry fee of $200 and includes admission of four members and four guests;
4. Teams may enter the picnic grounds at 10 a.m. to begin setting up for cooking;
5. Teams will be provided a team number upon entry, which corresponds with their designated cooking area;
6. Contestants are encouraged to decorate their space to promote their team and their chili;
7. Creative team names are encouraged; and
8. An 8-foot table and two chairs will be provided for each team; teams may bring their own tables, additional
chairs, tent or pop-up awning, which is encouraged if adverse weather is a concern.
Preparation:
1. Cooking may begin at 11 a.m.;
2. Only propane gas grills, or propane burners (a.k.a Cajun microwave) may be used for cooking. No wood or charcoal fires are allowed due to safety and smoke concerns. Electricity will not be available to teams for cooking.
3. Only beef may be used for the chili meat. This includes: chuck, ground round steak, chili meat, sirloin, etc. No
wild game or other meat may be used or added to the chili recipe entered in the main Competition; however,
chili incorporating alternative meats (vegetarian, chicken, etc.) is eligible to win the “People’s Choice” award.
4. Chili must be cooked on site. Teams may prep ingredients prior to arriving (i.e. chop tomato and onions, premeasure ingredients, etc.) Competition Chili must be bean free! Teams may bring toppings (cheese, onions, etc.)
for chili samples to public; however, the chili samples submitted for the judges must be plain with no toppings.
5. At least 6 quarts of chili (approximately 3+ pounds of meat) must be cooked so that there will be enough for
samples. 1 quart (32 oz.) of chili will be needed for the competition;
6. Plastic spoons and cups for use in serving chili samples to the public will be provided, and it is highly encouraged that attendees be invited to sample; and
7. Each team is responsible for policing and cleaning up their area at the end of the day. Picnic will end at 6
p.m. We need to leave the Barrera Ranch as nice as we found it!
Judging:
1. Sample cups and lids for the competition submission will be distributed by staff. Cups must be filled with
chili up to within 1” of the top. Lids should be secured on and the samples turned in to the judges by 2:30
p.m. at judging area; and
2. Judging will begin promptly at 2:45 p.m. Judging will be based on five categories: taste, aroma, color, texture
and aftertaste. 0-10 score in each category. Judging will be by double-blind submission. There will be prelims
and finals. The top 5 entries will be chosen and announced. Trophies will be given to 1st, 2nd and 3rd place
teams. All decisions of the judges are final and there are no appeals! This friendly competition is designed to
promote both excitement and entertainment for the SABA/SAYLA Chili Cook Off and Family Fun Day attendees. Good Luck!

to the San Antonio Bar Association and
San Antonio Young Lawyers Association’s
Chili Cook Off & Family Fun Day to be
held Sunday, April 6 at the Barrera family’s
fabulous Arci Bar 7 Ranch near beautiful
Leon Springs, Texas. Our chili competition
will pit the area’s top chili makers against
each other for the chance to win prizes and
future cook-off bragging rights. Team entry fee of $200 includes admission of four
members and four guests. Law students

Chief Justice Nathan Hecht to speak
at SABA monthly luncheon, Mar. 27
On March 27 the
San Antonio Bar Association is excited to
welcome Texas Supreme Court Chief
Justice Nathan Hecht!
Nathan L. Hecht
is the 27th Chief Justice of the Supreme
Court of Texas. He was first elected to the
Court in 1988 as a Justice and was re-elected
four times. He was appointed Chief Justice
by Governor Rick Perry on October 1, 2013.
He is the longest-serving Member of the
Court in Texas history and the senior Texas
appellate judge in active service. Throughout his service on the Court, Chief Justice
Hecht has overseen revisions to the rules
of administration, practice, and procedure
in Texas courts, and was appointed by the
Chief Justice of the United States to the federal Advisory Committee on Civil Rules.
Since 2010, Chief Justice Hecht has been
responsible for the Court’s efforts to assure
that Texans living below the poverty level
have access to basic civil legal services.
Chief Justice Hecht was appointed to
the district court in 1981 and was elected
to the court of appeals in 1986. Before taking the bench, he was a partner in the Locke
firm in Dallas. Chief Justice Hecht holds a
B.A. degree with honors in philosophy from
Yale University, and a J.D. degree cum laude
from the SMU School of Law, where he was
a Hatton W. Sumners Scholar. He clerked
for Judge Roger Robb on the U.S. Court of
Appeals for the District of Columbia Circuit
and was a Lieutenant in the U.S. Navy
Reserve Judge Advocate General Corps.

Former SABA director Steve Browne,
with Langley & Banack, Inc., and his wife,
Carolyn, are again co-chairing the 6th Annual VisionWalk in the City of Olmos Park
beginning at the San Antonio Gun Club on
Saturday, March 22. Registration begins
at 8:30 and the 5K Walk starts at 9:30 a.m.
This year’s event promises to be even better with lots of family-friendly activities,
including music, balloon-makers, facepainting, moonwalks, and refreshments.
The walk is FREE so bring your children,
friends and pets and enjoy a leisurely
walk through beautiful Olmos Park. Food
and refreshments will be provided.
VisionWalk benefits the Foundation
Fighting Blindness (FFB), the largest nongovernmental provider of funds for retinal degenerative disease research. FFB
works to find treatments, preventions,
and cures for conditions such as age-related macular degeneration (AMD), retinitis pigmentosa (RP), and to raise public
awareness about the devastating impact
of retinal diseases. Over 10 million Americans suffer from or are at risk of developing these diseases. Two of the Browne’s
children have Usher Syndrome, a genetic
malady which causes profound hearing
loss at birth following by progressive loss
of peripheral and night vision beginning
at puberty. Thanks to research funded
by the FFB, they have responded well to a
nutritional therapy which has slowed the
progression of their vision loss. However,
promising treatments like gene therapy
and stem cells require large expenditures
for pre-clinical research to get through
FDA clinical trials. San Antonio’s VisionWalk has enjoyed strong support from the
legal community. Nationally, over $28M
has been raised for needed research and
clinical trials which are now underway,
but much remains to be done. Those who

anti-SLAPP law, as well as discuss her
background in photography and her efforts to advance the NPPA’s advocacy
work in First Amendment freedoms.

Opening new Child Support Accounts in Bexar County
A somewhat common question from
the private bar is, “How do I open a child
support account for my client?” In years
past, child support accounts were opened
with information provided in the Attorney
General Child Support Registry Information Record form that attorneys dropped
in a box in the district clerk’s office along
with a copy of the support order. The clerk
then forwarded the order and form to the
Office of the Attorney General (OAG), who
initiated a State Disbursement Unit (SDU)
account. With the dawn of new technologies, the practice of circulating a paper

To open a new child support account,
please complete the Attorney General
Child Support Registry Information Record that is found in the “Downloads”
section of the district clerk’s website
found at www.bexar.org/dc. Fax the form
to Marie Ann Solis at 210.348.4243. The
OAG will open a child support account
and send new account notices to the obligee and obligor. If the obligee has never
received public assistance, he or she will
receive a Refusal of IV-D Child Support
Services form to decline monitoring and
enforcement services from the OAG. If
the obligee declines services, the SDU
account will remain open and payments
will be recorded and disbursed. However,
the OAG will not monitor or take enforcement action on the case. Parents who decline services can re-apply for services at
any time by submitting an application at
www.texasattorneygeneral.gov/cs.
Child support accounts represent
streams of support, rather than individual
children or causes of action. It is important to remember that parties will require
a new child support account if the individual who pays or receives support changes.
For example, if custody is modified and
the former obligee is ordered to pay support to the former obligor, a second account will be opened. Likewise, if support
is ordered to a different individual, such
as a grandparent, another account will be
opened to properly disburse payment to
the new obligee. The SDU usually issues
payment to the account obligee within 24
hours of receipt. Therefore, it is very important to promptly report modifications
and changes in possession to the OAG.
