YOUR QUESTIONS ANSWERED
Q: I'm interested in working within a veterinarian's
office as a dental hygienist for animals. Can you tell
me if there are any restrictions to this type of practice?
A: The College of Veterinarians of Ontario (CVO) regulates the
practice of veterinary medicine in Ontario. This would
include all dental and dental hygiene services to animals.
Typically in a veterinarian practice, dental cleanings are
done by the veterinarian or are delegated by the veterinarian
to a competent person while the animal is under sedation.
For you to scale an animal's teeth, you would require the
procedure to be delegated to you by a member of the CVO.
The veterinarian providing the delegation is accountable to
the CVO for the direct supervision, suitability and quality of
the person's performance.

PROFESSION SECTION
PERSONAL FRAUD OR HOLDING OUT

In the December 2005 edition of Milestones, I wrote an article about developing
an anti-fraud culture. Holding oneself out as a dental hygienist when not registered
with the College of Dental Hygienists of Ontario (CDHO) is another form of fraud
and is taken very seriously by the College.
It is illegal to practice dental hygiene in Ontario if the person is
not registered with the CDHO or does not hold a current
general/specialty certificate of registration. Holding out can
and has occurred in the following situations:
• The person is new to the province and has not registered
with the College
“No person other than a member shall use the title “dental
hygienist”, a variation or abbreviation or an equivalent in
another language.” DHA 1991, c. 22, s. 9 (1)*
“No person other than a member shall hold himself or herself out as
a person who is qualified to practise in Ontario as a dental hygienist
or in a specialty of dental hygiene.” DHA 1991, c. 22, s. 9 (2)*
• A dental hygiene graduate has not registered with the College
• Someone other than a dental hygienist uses the title
• A registrant has been suspended due to non-payment of fees
• A registrant is practicing after their certificate has been revoked
*The Dental Hygiene Act, 1991 uses the term 'member', but the CDHO uses the
term 'registrant'. Therefore the terms 'member' and 'registrant' become mutually
interchangeable.

RESPONSIBILITIES REGARDING RECORD KEEPING

In December 2004, the College circulated a Draft Proposed
Records Regulation to stakeholders for comment.
After the requisite 60 day consultation
period, the draft regulation was amended
for clarity, passed by Council in April 2005
and submitted to the Ministry of Health and
Long-Term Care (MOHLTC) for approval. As
previously noted in Milestones the Ministry
had put a hold on submitting records
regulations for many years in anticipation of
both the provincial and federal privacy Acts.
Following the enactment of both PIPEDA
(Personal Information Protection and Electronic
Documents Act, 2003) and PHIPA (Personal

Health Information Protection Act, 2004) the
MOHLTC lifted the moratorium on records
regulation submissions. The regulation is now
with the MOHLTC for drafting and submission
to Cabinet for approval. The College hopes to
have the regulation in place prior to the
conclusion of 2006.
While the Draft Proposed Records
Regulation is not yet a regulation under the
DHA, 1991 CDHO registrants would be wise
to ensure that their record keeping is in line
with the draft document. If a registrant was
found to have inadequate records, the College
could reference the Draft Proposed Records
Regulation as reflecting the professional
standard expected. As the document has
been circulated to all dental hygienists in
Ontario, every dental hygienist registered in this
province should have a working knowledge of
the contents and what will be expected of them.
The College often receives requests for a list
of acceptable short forms for use on dental
hygiene charts. When choosing to use
abbreviations, the dental hygienist would be
wise to consult a variety of dental hygiene
texts for commonly accepted short forms and
symbols. If the practice uses a particular
style of charting or standardized system of
abbreviations then a key to the abbreviations
should be available in the office for consultation purposes. Clients who ask for a copy of
their chart should be given the key to the
abbreviations with the chart copy.
If the fees for the dental hygiene services are
being billed according to the ODA Suggested
Fee Guide for General Practitioners then
those fees are based on a unit that equals 15
minutes of time. Therefore, if the dental
hygienist is providing a selective polish (as
per the research and CDHO Standards of
Practice) then one half unit or 7.5 minutes
may be all that is required. The CDHO has
gone on record indicating that the dental
hygienist is not responsible for entering ODA
Fee Codes or entering ODA fees as they are
determined by another profession without
consultation with the dental hygiene profession.
However, the dental hygienist is responsible
for knowing that the fees charged for the
care rendered by her/him is reasonable and
accurately reflects the service provided. The
dental hygienist is also responsible to make
records that accurately describe the service
provided. If the dental hygienist has an
employment agreement indicating that s/he
is to enter the ODA Codes then the dental
hygienist must ensure that they accurately
represent the time spent and the procedure
performed. Dental hygienists must not
participate in a system that results in inaccurate
or false billings being made.
When the dental hygienist has made a charting
error a line should be drawn through the mistake
and the correct entry made, dated and signed.
Use the date the new entry is made and note in
the entry the date of the event referenced. The
dental hygienist should sign every entry made.
When charting and completing records, dental
hygienists must be mindful of the next person
who will read that chart because if the records
do not indicate that something was done,
there is a reasonable expectation that the
procedure was not performed. Clear, legible
and accurate record keeping protects the
practitioner, but more importantly assists in
ensuring that the people of Ontario receive
the highest quality dental hygiene care
possible by indicating past oral health
concerns, treatment and outcomes.

PROFESSIONAL PORTFOLIO REVIEW CYCLE

The Professional Portfolio/Practice review for
2006 is about to begin. As you know, ten percent
of dental hygienists registered in Ontario will be
selected through a stratified random sample. This
year, approximately 830 dental hygienists will go
through the assessment process. If you are one
of those selected, you will have the opportunity
to demonstrate to the College the quality of your
dental hygiene practice and your commitment to
life long learning/continuing competency. The
purpose of this article is to help you understand
what happens after you have been selected.
SELECTION
The portfolio cycle begins with the selection of the stratified random
sample. If your registration number has been selected, you will
receive a letter requesting the submission of your professional portfolio.
Letters are generally mailed out in early April. The request will be for
your professional portfolio for the past year. This year, you will be
asked to submit your completed 2005 professional portfolio.
SUBMISSION
In accordance to Ontario Regulation 218/94 Part VI section 19 (2)
each professional portfolio shall include (at least):
• a statement of the member's planned continuing quality
improvement goals for each year, and the relationship of each
goal to the member's practice and the College's Standards of
Practice and Ethics
• a description of a typical day in each of the member's workplaces
• a description of the member's continuing quality improvement
measures and
• for each continuing quality improvement measure, an assessment of the implementation and outcome of the acquired skills,
judgment and attitudes in each member's dental hygiene practice.

The CDHO Quality Assurance Package contains the required forms
that will help you comply with the Quality Assurance regulation. In
addition to the Portfolio Forms, this package includes the CDHO Self
Assessment Tool and the Professional Portfolio Guide which are
designed to help registrants create and maintain their professional
portfolio. Every registrant in Ontario has been supplied with the
Quality Assurance package. Additional packages may be downloaded or printed from the CDHO web-site.
You are reminded to submit your portfolio for the year requested
only. Please note that, the Quality Assurance (QA) Committee has
the right to request portfolios for more than one year and registrants
are required to keep past portfolios for a total of seven years.
PEER REVIEW
DECISIONS BY COMMITTEE
Once received by the College, your Professional Portfolio will be
directed to a Quality Assurance Assessor who will review your
professional portfolio to determine whether it meets the assessment
guidelines. CDHO Quality Assurance Assessors reflect the diversity of
the registrants, electoral districts and practice environments and are
members in good standing with the CDHO who demonstrate ethical
and professional practice.
Once the assessor has enough information to complete the professional
portfolio/practice assessment a report is forwarded to you and to the
QA Committee. Most professional portfolios are assigned an A1 status
and meet the assessment guidelines. In some instances, the assessor
will identify areas of the assessment that do not meet the assessment
guidelines. If this is the case, you will have an opportunity to make a
submission to the QA Committee in response to your report.
A telephone interview may be necessary if the assessor requires
further clarification of your typical day. The assessor can only determine
whether or not your portfolio meets the assessment guidelines if the
information you have given them is complete. If the assessor has not
been able to gain enough information to assure the QA Committee
that the dental hygiene practice has met the assessment guidelines,
an on-site practice assessment may be required. If an on-site practice
assessment is required, you will be notified by the College and a
Practice Assessor will contact you to set up an appropriate time for
the assessment. The College makes every effort to minimize the
disruption to your dental hygiene practice and most assessments
occur after business hours.
The Quality Assurance Committee meets approximately four times a
year and deliberate all completed professional portfolio/practice
reviews and subsequent submissions. The QA Committee, predominately dental hygienists, consists of three Professional Members, two
Public Members and two non-Council Professional members. The
final decisions on the status of all professional portfolio/practice
assessments are made by the QA Committee.
The focus of the Quality Assurance Program is non-punitive and
endeavours to ensure that all dental hygienists continue to practice
safely, effectively and ethically. If the result of the portfolio/practice
assessment indicates deficiencies in your professional practice or
continuing quality improvement activities recommendations and/or
remediation activities may be directed by the Committee. It is
important for you to know that, the results of your professional portfolio/practice assessment can not be accessed by other areas of the
College and will remain confidential between the QA Committee
and the registrant.
COMMON PROBLEMS WITH
PORTFOLIO SUBMISSIONS
• Incomplete information
• Assumptions that we know what you do or that everyone does
it so no need to write it.
• Standard precautions for infection control? Great, but what are they?
• Old forms, no forms, missing forms
• Incorrect registration number
• Illegible, poor penmanship, tiny writing
• Goals not clear/ not related to dental hygiene practice
• No connection between learning and your dental hygiene practice
• No indication that learning has taken place / goals have been
achieved
• # of goals not equal to # of form 7s (old form 8)
• No bibliography for self-initiated learning: web-sites, journals,
text books, videos, audio tapes.

SUMMARY OF DECISION &
REASONS FOR DECISION - RAJWANT GIRN
In a hearing held on October 24, 2005
Ms. Rajwant Girn was found guilty of
professional misconduct under paragraphs 30
(failing to reply), 36 (failing to carry out an
undertaking), 42 (contravening the legislation)
and 47 (unprofessional misconduct) of the
professional misconduct regulations.
Under the quality assurance regulations, registrants are required to
comply with the requirements of the quality assurance, which include:
(a) developing and maintaining a professional portfolio,
(b) annually participating in continuing quality improvement activities
sufficient to indicate that s/he continues to have and to apply in
her/his dental hygiene practice the knowledge, skills, judgment
and attitudes required to practice dental hygiene in compliance
with the College's standards of practice and ethics,
(c) accurately and completely documenting those activities in
her/his professional portfolio, and
(d) cooperating with an assessment of her/his professional portfolio,
quality improvement activities and practice to evaluate her/his
knowledge, skills, judgment and attitudes.

Ms. Girn acknowledged that, in the past, she had consistently failed
to cooperate with the Quality Assurance Committee and with the
College as a whole and had breached her verbal agreements and
written undertaking to the College. However, Ms. Girn had recently
taken the following steps to bring herself into compliance with the
Quality Assurance Program and with her formal written undertaking.
Her previous issues with compliance related to her difficulties in
prioritizing College-related communications and juggling her personal
and professional life. Ms. Girn admitted that her many failures to
communicate with the College and her previous non-compliance
with the requirements of the College's quality assurance regulations
constituted professional misconduct.
The Panel wanted to make clear that compliance with Quality
Assurance Committee obligations was a fundamental obligation of
the profession. It was not just a matter of a filing requirement - not
just a technical breach of the Rules. Quality Assurance Committee
obligations are strongly connected to client care. The CDHO's
Quality Assurance Program of which the Professional Porfolio is a
component, requires the dental hygienist to:
• Reflect upon one's own performance in the provision of patient care
• Identify areas of performance that require improvement
• Develop Continuing Quality Improvement (CQI) activities
These requirements are essential to ensure that the dental hygienist
maintains and improves her/his level of competence through the
continuous acquisition of knowledge, skills and judgment.
The Panel was dismayed to learn that this matter of non-compliance
with the College spanned such a long period of time. During this
period the Registrar provided numerous opportunities for Ms. Girn to
respond and comply, which she failed to do. This failure to comply
was a clear indication that she failed to understand the importance
of not only responding to the College, but ensuring compliance with
the submission of the professional portfolio upon request. This was a
serious breach of conduct. The Panel did note that there was no
allegation and no evidence before it that this had translated into a
failure to maintain standards of patient care in any particular case.
The Panel also considered the following mitigating factors:
• There was a prompt admission of misconduct by Ms. Girn
• She made genuine efforts to address the issue of her misconduct
• Ms. Girn showed remorse
• This was Ms. Girn's first time before the Discipline Committee.
There was no prior record of misconduct.
Therefore, the Panel accepted a joint submission on order
as follows:
1. that the Registrar suspend Ms. Girn's certificate of registration
to practice for a period of four weeks to commence on October
25, 2005.
2. that the Registrar suspend two weeks of the suspension order
in paragraph 1 and that Ms. Girn shall only be required to serve
the remaining two weeks of the one-month suspension if she
failed to comply with the remainder of this order. If any dispute
shall arise between Ms. Girn and the College, as to whether she
is in breach of a provision of this order, the dispute shall be
remanded to a Panel of the Discipline Committee for further
adjudication. The parties shall have the opportunity to make
full submissions to the Panel before it renders a decision. If,
thereafter, the Panel determines that Ms. Girn has breached a
provision of this order, then and only then shall she be required
to serve the remaining two weeks of her four week suspension,
to commence on a date to be fixed by the Registrar of the College.
3. that Ms. Girn shall appear before a Panel of the Discipline
Committee this day to be reprimanded and the facts of the
reprimand shall be recorded in the register.
4. that the Registrar impose the following specified terms, conditions
and limitations on the certificate of registration of Ms. Girn:
(i) For a period of two years, commencing on the date of the
Discipline Panel's Order, Ms. Girn shall reply appropriately
and within 30 days to a written inquiry made by the College
that requests a response.
5. that Ms. Girn shall pay the amount of $3,600.00 in costs to the
College at the rate of $200.00 per month, starting on the 15th
day of the first month after completing the first two weeks of
her suspension. At any time, Ms. Girn shall be at liberty to increase
the amount of her monthly payment, solely at her discretion.
Ms. Girn waived her right of appeal and the reprimand was
administered by the Panel.

The CDHO is currently seeking REGISTRANTS
who would be interested in SERVING THE COLLEGE
in the following capacities:
SITE SURVEYORS
CLINICAL EVALUATORS
At the invitation of the Commission on Dental Accreditation of
Canada (CDAC), the CDHO sends a representative on the survey
team for each dental hygiene accreditation site visit to the educational
institution. Each visit is usually 21⁄2 to 3 days in length. However,
there is considerable reading and preparation beforehand and a
draft report to review at the conclusion. The regulatory representative
is bound by all of the rules, regulations and policies of other members
of the CDAC team, and will be required to sign a confidentiality
agreement. Although the CDHO puts forth names for consideration,
the final decision rests with the Commission.
The College of Dental Hygienists of Ontario holds clinical competency
exams throughout the province for graduates of non-accredited dental
hygiene programs. The CDHO is accepting applications for the position
of Clinical Evaluators. These assessments are usually one day in
length and the evaluators work in teams. Each team may be assigned
three or four candidates. Orientation and calibration sessions are
provided. Appointment to an evaluation team will be dependant on
the number of candidates and the number of sessions required.
Criteria includes:
If you are interested in applying for consideration as a clinical evaluator,
and meet the following criteria please send a cover letter and resume to
the attention of the Registrar by mail or e-mail ([email protected]).
• at least three years experience as a dental hygienist
• a thorough understanding of the regulatory process and the
CDHO regulations
• current knowledge of the academic system and recent teaching
experience in dental hygiene
• fluency in the language of instruction, both oral and written
• registered in good standing with the CDHO
• ability to work collaboratively in a team setting
• possess a current general or specialty certificate of registration
with the CDHO
• in good standing with the College
• at least 3 years clinical dental hygiene experience in either general
or periodontal practice
• experience in teaching or evaluating dental hygiene students
• ability to work collaboratively in a team setting
• proficiency in both oral and written English and/or French
Selection Process:
• applications from interested parties are reviewed/approved by
the Registrar/Deputy Registrar and additional information may
be requested from the applicant
• availability
• current members of Council and Non-Council members are ineligible
• a roster of interested, qualified applicants would be maintained
• current Council or non-Council Members and full-time faculty
members at competing schools are ineligible
• selection for a particular site visit would be dependant on factors
such as conflict of interest (the site visitor must not have a history
of having taught or consulted for the educational institution
being surveyed)
• language is critical, both the ability to speak well and to write
clearly and concisely
• availability for the time chosen by the accrediting body
• acceptable to the institution being surveyed

COUNCIL’S CORNER
COUNCIL MEETING HIGHLIGHTS,
January 20, 2006
Elections were held for the positions on the Executive Committee for
2006. The results are as follows: Cathie Mazal-Kuula (District #7),
President; Kathleen Feres Patry (District # 6) Vice President; Cindy
Campbell (Public Member); Nancy Kitchen (District #5 ); Ken Massey
(Public Member).
The Administrative report noted that there were a total of 8,255 registrants
as of December 31, 2005. The 2006 annual registration renewal
form was placed on the web-site for registrants to access and download as required. An on-line registration renewal process for 2006
was carried out in three districts in December 2005. At the completion
of the renewal period the process will be evaluated, with the intention of
placing all renewals on-line for 2007.
Council was informed that meetings were held with representatives
of the Ministry of Health & Long Term Care and preventive oral
health information kits were provided to all MPPs in January 2006.
The CDHO participated in the Health Professions Regulatory Advisory
Council's (HPRAC) consultation with the Federation of Health
Regulatory Colleges of Ontario (FHRCO) in November 2005 and submitted a follow-up report to HPRAC regarding issues of importance
to the College and its ability to regulate in the public interest. Following
the Executive Committee report Peggy Maggrah addressed Council and
spoke about the strategic plan and reflected on the past year's
achievements. In her acknowledgements she thanked Council and
Administration for their hard work and commitment to the CDHO
and wished the new Executive Committee well in their deliberations.
Council approved the Patient Relations Committee recommendation
regarding binders for the Registrants' Handbook. The handbook will
be contained in a three-ring 81⁄2 x 11 binder in a ready-to-use format.
Council welcomed Inga McNamara who was elected in District #2
and Carol Barr Overholt elected in District #3 to Council. Cathie
Mazal-Kuula from District #7 was acclaimed. Their terms of office
run from January 1, 2006 to December 31, 2008. A selection among
full time dental hygiene academic faculty was held to fill the two
academic openings on Council for a period of three years. Linda
Jamieson from Georgian College and Carole Ono from Regency
Dental Hygiene Academy were selected by their peers.
Since the last Council meeting, the Complaints Committee completed
its investigation of one complaint and determined that the matter be
referred to the Quality Assurance Committee for appropriate action.
There are three complaints currently being investigated by the Committee.
Council also welcomed two new public members to the College,
Julia Johnson from Orillia and Salam Kherdaji from Mississauga who
were appointed by Order-in-Council for a period of three years.
Council welcomed back Harry Chadwick, Ken Massey and Sandra
White who were re-appointed to Council for an additional three months.
A Panel of the Registration Committee completed its review of three
applicants who graduated from non-accredited courses of study and
determined that their courses were not equivalent to an accredited
dental hygiene program. To attain equivalency, these applicants
would have to successfully complete an approved program of study
in dental hygiene.
It was reported that two discipline hearings were held on October
24, 2005 and November 21, 2005 respectively. A summary of the
October 24, 2005 hearing is included in this edition of Milestones.
The next Council meeting has been scheduled for May 12, 2006.

ETHICAL DILEMMA
SCENARIO:
During a preventive oral hygiene appointment,
an underage teenage male exhibits behaviour
that the dental hygienist considers aggressive.
The client brags to the dental hygienist that he
plans to kill or seriously harm several friends
who he feels have been disrespectful to him and
he doesn't care if he ends up in jail. The dental
hygienist senses that the client is trying to get a
reaction from her. The dental hygienist calmly
completes the appointment with the client and
the client states that he does not want the dental
hygienist to repeat his threats to the client's parents.
The client did not exhibit this behaviour with
anyone else in the practice. What should the
dental hygienist do?
DISCUSSION:
The dental hygienist is legally permitted under the
Personal Health Information Protection Act, 2004
(PHIPA) to disclose the information given to her by the
client if there is a reasonable concern for someone
else's safety. The test for disclosure without client
consent for safety concerns is where the dental
hygienist “believes on reasonable grounds that the
disclosure is necessary for the purpose of eliminating
or reducing a significant risk of serious bodily harm to
a person or group of persons”.
The dental hygienist must use her professional judgment
to assess if the threat is realistic or if the client is
merely posturing. As no one else in the office witnessed
the behaviour the dental hygienist must rely primarily
on her own judgment. Relevant considerations would
include whether the client appears to have the means
to carry out the threats (e.g., does the client indicate
that he has access to guns), does the client appear
serious, does the client appear to genuinely retreat
from the threats and indicate he was “just blowing off
steam”, the personal and family circumstances of the
client as known by the dental hygienist, and past contact
with the client.) Others in the office may be able to
provide additional facts that may help the dental
hygienist reach a decision.
If the dental hygienist believes there may be substance
to the threats then she may report the incident to the
client's parents or to the police. If the dental hygienist
decides that the threats are not realistic, then she
should document how she came to that conclusion.
The dental hygienist may wish to err on the side of
taking some action if genuinely uncertain as she does
not have professional training in assessing such risks.
She may wish to consult with legal counsel prior to
making her decision.
