INVITATION FOR BIDS TOWN OF CHARLEMONT MOUNTAIN ROAD BRIDGE REPAIR – MA DOT BRIDGE NO. C-05-006 The Franklin Regional Council of Governments will accept sealed bids on behalf of the Town of Charlemont for repair to Mountain Road Bridge. The sealed bids, plainly marked "Charlemont – Mountain Road Bridge” in the lower left hand corner of the envelope will be received by the Franklin Regional Council of Governments, 12 Olive St. Suite 2, Greenfield, MA 01301, until FEBRUARY 16, 2016 at 2 p.m., at which time they will be publicly opened and read. Wage rates for this bid are subject to prevailing wage rates as per MGL Chapter 149, Section 26 - 27f inclusive. This bid is being undertaken per MGL Ch 30 §39M requiring a 5% bid bond/deposit. A 100% Payment Bond and 100% Performance Bond will be required at contract signing of the successful bidder. Specifications and plans for the bid and bid instructions are available for download from http://frcog.org/bids. Downloading from this site will allow for automatic notifications of any addenda or clarifications. That is the only way that notifications will be made. The ON SITE pre bid informational meeting will be held on JANUARY 27, 2016 starting at 10A.M. at CHARLEMONT TOWN HALL and moving to the site. Bridge 1/20/2016 TOWN OF CHARLEMONT MOUNTAIN ROAD BRIDGE REPAIR General Scope of Work Refer to Special Provisions for Detail The project is located at MOUNTAIN ROAD, CHARLEMONT, MA MASSDOT BRIDGE NO. C-05-006. The bridge was constructed in 2004 by MassDOT and is maintained by the town. Flood waters in 2011 damaged the east approach. Damage to the bridge includes: the concrete wingwalls, bridge rails, the rip rap embankments, a portion of the roadway, and guardrails. The project intent is to reconstruct the east approach to pre-flood conditions. Weston and Sampson Engineers (WSE) designed the bridge and have been called back by the Town to design the Repair. WSE will facilitate the prebid meeting and evaluate the construction bids. The construction bid will be handled through the Franklin Regional Council of Governments and all questions during the bid process and receipt of bids will be done at their office. The preliminary construction cost estimate is $162,000. BIDDERS ARE ENCOURAGED TO ATTEND THE PREBID INFORMATIONAL MEETING ON JANUARY 27, 2016 AT 10AM STARTING AT THE CHARLEMONT TOWN HALL, 157 MAIN STREET, CHARLEMONT, MA. ATTENDANCE IS NOT MANDATORY. All bids must contain a filled out signed BID FORM and also a properly executed Tax Compliance/Non-Collusion Form, Debarment Form and signed OSHA certification. All forms can be found within the contents of the Invitation For Bid. Minor defects on a bid submittal may be waived by the Chief Procurement Officer as long as the error or variation is not prejudicial or preferential to the other bidders and that it may be corrected without affect upon substantive elements of the bid such as, but not limited to, price, quality, payment terms or delivery schedule. 2. Bids which are incomplete, not properly endorsed or signed, or otherwise contrary to instructions may be rejected as non-responsive by the Chief Procurement Officer. Conditional bids will not be accepted. Any bid arriving after the time and date of bid opening will not be accepted. 3. As the Franklin Regional Council of Governments (FRCOG) and the TOWN OF CHARLEMONT are exempt from the payment of Federal Excise Taxes and Massachusetts Sales Tax, prices quoted herein are not to include these taxes. 4. A bidder will be held to the terms and the prices on the bid form for the duration of the contract period if a contract is signed by both parties within 40 days from bid opening. 5. The TOWN reserves the right to reject any and all bids, in total or in part. 6. The contractor will be bound by all applicable statutory provisions of law of the Federal Government and the Commonwealth of Massachusetts. 7. The contractor will be required to indemnify and hold harmless the FRCOG and THE TOWN OF CHARLEMONT for all damages to life and property that may occur due to contractor’s negligence or that of his/her employees, subcontractors, etc., during the contract. 8. If in the judgment of the TOWN OF CHARLEMONT, any property is needlessly damaged by an act or omission of the contractor, the amount of damages will be deducted from money due the contractor or may be recovered from said contractor in legal action. 9. Any inferior or damaged material or product, as determined by the TOWN OF CHARLEMONT through their Engineer, will be replaced at the total expense of the contractor. 11. Any restrictions, qualifications, or deviations from specifications must appear either on the bid form or on an attachment thereto. 10. A contract (or contracts) will be signed between the awarded bidder(s) and the TOWN OF CHARLEMONT. A sample contract and bond forms are attached. Any provisions of the contract that cannot be met by a prospective bidder must be brought to the attention of the FRCOG during the open question period, otherwise submittal of a bid constitutes acceptance of the Town’s standard terms and conditions. 4|Page Invitation for Bids – Mountain Rd. Bridge 1/20/2016 11. Once bids are opened, the FRCOG Chief Procurement Officer will forward the information to the Town and the Town’s Consulting Engineer for review. 12. The contract(s) resulting from this bid will be awarded to the lowest responsible and responsive bidder based upon bid price, past performance and reliability of the bidder, quality of service, and degree of exclusion, exemption, or restrictions on the bid form. In the event of identical and responsible low bids, a coin toss overseen by the Chief Procurement Officer will determine the award. 13. The FRCOG will in no way be responsible for the actions of the TOWN. THE TOWN OF CHARLEMONT is responsible for payment of their own invoices. OSHA Certification is Required All contractors working on public works projects will be required to certify that ALL employees employed at the work site have successfully completed an OSHA approved course in construction safety at least 10 hours in duration. This law requires general contractors to have on file records of all employees OSHA 10- hour training and provide proof to the various agencies in charge of the work. This also applies to all subcontractors, hired trucks, and hired equipment with operators. Every bidder must certify that all persons who are employed by them for this bid are certified. Proof does not have to be submitted with this bid, but must be available upon request. 19 Contract execution will be conditioned upon producing: a. 5|Page The Contractor shall provide the Awarding Authority with a Performance Bond and a Payment or Labor and Materials Bond in the form provided by the Awarding Authority, executed by a surety company licensed by the Commonwealth of Massachusetts' Division of Insurance and whose name appears on United States Invitation for Bids – Mountain Rd. Bridge 1/20/2016 Treasury Department Circular 570. Both the Performance Bond and the Payment Bonds shall be in an amount equal to the Contract Sum unless, with respect to the Payment Bond or Labor and Materials Bond a lesser amount of no less than one half the contract price is expressly specified in the Advertisement or Instructions to Bidders, or with respect to the Performance Bond no such bond is required as expressly set forth in the Advertisement or Instructions to Bidders. b. An insurance certificate as outlined on the INSURANCE REQUIREMENTS page. Failure or refusal of the successful bidder to execute and deliver a Signed Contract, Certificate of Insurance, Labor and Materials and Performance Bonds acceptable to the Chief Procurement Officer within fourteen days after notice of contract award will result in the forfeiture of the Bid Bond as Liquidated Damages. The Contract will be awarded to the next lowest qualified bidder or the IFB re-advertised, as the FRCOG believes is in the best public interest. 20. INSURANCE REQUIREMENTS The Contractor shall at all times during the Contract maintain insurance satisfactory to the Town and will submit certificates of insurance prior to contract execution to the effect that such insurance has been procured and is in force. The Town shall be named additional insured under the Liability policies. X Prevailing wage rates set at the Massachusetts Department of Labor and Industries apply to this bid. Attached are the pertinent tables in effect for this work. X Each bidder must submit with its bid a bid deposit equal to 5% of the amount of the bid. The bid deposit may be in the form of a certified check, bank treasurer's or cashier's check, or a bid bond from a licensed surety company. The surety bond may state the amount to be "five percent (5%) of the amount bid." The bid deposit shall be made payable to the Town of Charlemont. Bridge 1/20/2016 SPECIAL PROVISIONS SECTION 02000 SPECIAL PROVISIONS CHARLEMONT BRIDGE REPAIR BRIDGE NO.: C-05-006 CHARLEMONT, MASSACHUSETTS SCOPE OF WORK Work covered under this project includes: Remove temporary repairs at east approach including: temporary barriers, pavement, rip rap slopes. Installation of new approach slab at east approach. Installation of independent wingwalls at east approach. Remove and replace damaged steel guardrail. Installation of new bridge joints. Install new section of bridge rail transitions and bridge attachment. Full depth roadway reconstruction. Pavement milling and overlay. Installation of rip rap slope protection. All technical work done under this contract shall be in conformance with the Charlemont Highway Department Construction Standards and the Massachusetts Department of Transportation Standard Specifications for Highways and Bridges dated 1988, the Supplemental Specifications dated June 15, 2012, and the Interim Supplemental Specifications contained in this book; the Massachusetts Department of Transportation LRFD Bridge Manual 2013 Edition; the 2012 Construction Standard Details, the 1990 Standard Drawings for Signs and Supports; the 2009 Manual on Uniform Traffic Control Devices (MUTCD) with Massachusetts Amendments and the Standard Municipal Traffic Code; the 1968 Standard Drawings for Traffic Signals and Highway Lighting; the latest edition of American Standard for Nursery Stock; the Plans and these Special Provisions. WORK SCHEDULE The Contractor shall perform all work between the hours of 7:00 a.m. and 5:00 p.m., Monday through Friday, legal holidays excluded. MAINTENANCE OF DETOURS Contractor shall be responsible for installing, maintaining and removing all signs, barriers, and all other traffic appurtenances required for the traffic detours as shown on the plans. Full compensation for furnishing all labor, materials, tools, equipment and incidentals for doing all the work involved in the installation, maintenance and removal of traffic detours as specified in this section, shall be considered included in the various Contract items of work and no additional compensation will be allowed. 8|Page Invitation for Bids – Mountain Rd. Bridge 1/20/2016 CONSTRUCTION STAKING The Contractor shall be responsible for all survey by a professional surveyor registered in the Commonwealth of Massachusetts and construction staking necessary for the complete layout of the baseline, curbing, guardrail, utilities and all other layout required for the completion of the job. The contractor is responsible for relocating all control points on a safe location outside of the construction zone for ease of reproduction. Survey and construction staking/layout of the work, as often as required, shall be considered as incidental to the work being performed under the Contract and there will be no additional compensation. PUBLIC SAFETY AND CONVENIENCE (Supplementing Subsection 7.09) The Contractor shall provide necessary access for fire apparatus, emergency vehicles and school buses around the work zones to abutting properties at all times. Sweeping and cleaning of surfaces beyond the limits of the project to clean up material caused by spillage or vehicular tracking during the various phases of the work shall be considered as incidental to the work being performed under the Contract and there will be no additional compensation. NOTICE TO OWNERS OF UTILITIES (Supplementing Subsection 7.13) Before commencing work on existing service connections, the Contractor shall be responsible for contacting the respective utility owner servicing the area to obtain construction requirements, standards, and to give adequate notice of commencement of work. The following are the names of owners and representatives of the principal utilities affected. The Contractor is responsible for identifying all utilities that may be affected and contacting the appropriate utility representative. The Contractor shall notify "Mass. DIG SAFE" and procure a DIG SAFE number of each location prior to disturbing ground in any way. "DIG-SAFE" Call Center: Telephone 1-800-344-7233 PROTECTION OF UTILITIES AND PROPERTY (Supplementing Subsection 7.13) The Contractor, in constructing or installing facilities alongside or near sanitary sewers, storm drains, water or gas pipes, electric or telephone conduits, poles, sidewalks, walls, vaults or other structures shall, at his expense, sustain them securely in place, cooperating with the officers and agents of the various utility companies and municipal departments which control them, so that the services of these structures shall be maintained. The Contractor shall also be responsible for the repair or replacement, at his own expense, of any damage to such structures caused by his acts or neglect, and shall leave them in the same condition as they existed prior to commencement of the work. In case of damage to utilities, the Contractor shall promptly notify the utility owner and shall, if requested by the Engineer, furnish labor and equipment to work temporarily under the utility owner's direction in providing access to the utility. Pipes or other structures damaged by the operation of the Contractor may be repaired by the Town or by the utility owner that suffers the loss. The cost of such repairs shall be borne by the Contractor, without compensation therefore. If, as the work progresses, it is found that any of the utility structures are so placed as to render it impracticable, in the judgment of the Engineer, to do the work called for under this Contract, the Contractor shall protect and maintain the services in such utilities and structures and the 10 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 Engineer will, as soon thereafter as reasonable, cause the position of the utilities to be changed or take such other actions deemed suitable and proper. If live service connections are to be interrupted by excavations of any kind, the Contractor shall not break the service until new services are provided. Abandoned services shall be plugged off or otherwise made secure. Full compensation for furnishing all labor, materials, tools, equipment and incidentals for doing all the work involved in protecting or repairing property as specified in this section, shall be considered incidental to the work being performed under this Contract and no additional compensation will be allowed. PROVISIONS FOR TRAVEL AND PROSECUTION OF THE WORK (Supplementing Subsection 8.03) Before starting any work under this Contract, the Contractor shall prepare, and submit to the Engineer for approval, a plan (based on the Contract traffic management plans) that indicates the traffic routing proposed by the Contractor during the various stages and time periods of the work and the temporary barricades, signs, drums and other traffic control devices to be employed during each stage and time period of the work to maintain traffic and access to abutting properties. Particular care shall be taken to establish and maintain methods and procedures that will not create unnecessary or unusual hazards to public safety. Traffic control devices required only during working hour operations shall be removed at the end of each working day. Signs having messages that are irrelevant to normal traffic conditions shall be removed or properly covered at the end of each work period. Signs shall be kept clean at all times and legends shall be distinctive and unmarred. The Contractor shall submit the proposed detour plan, along with temporary barricades, signs, drums and other traffic control devices to be employed. SAFETY CONTROLS Subsection 850.21) FOR CONSTRUCTION OPERATIONS (Supplementing Safety controls for Construction Operations shall be done in accordance with the relevant provisions of Section 850 of the Standard Specifications, the Manual on Uniform Traffic Control Devices, the Traffic Management Plan and the following: Positioning, adjusting and re-positioning of all devices such as traffic cones, high level warning devices, etc., shall be considered incidental to the work being performed under this Contract and no additional compensation will be allowed. DISPOSAL OF SURPLUS MATERIALS 11 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 All existing and other materials not required or needed for use on the project, and not required to be removed and stacked, shall become the property of the Contractor and shall be removed from the site during the construction period and legally disposed of. No separate payment will be made for this work, but all costs in connection therewith shall be considered incidental to the work being performed under this Contract and no additional compensation will be allowed. DRAINAGE The Contractor shall maintain the existing drainage system in the project area to provide continuous drainage of the roadway and construction area at no additional cost to the Town. INCIDENTAL TO THE PROJECT The Contractor must provide on-site for the duration of all work, a 6’ temporary chain link fence. The fence must be mobile and the contractor must have enough to cover the full extent of any work or materials left on-site. If deemed necessary by the Engineer or Owner, the Contractor must provided additional fencing. All temporary fence shall be closed at the end of each work day. Sand bags shall be used to keep fence posts in place. All work, materials, labor, equipment, or other incidental items related to providing a 6’ high temporary chain link fence shall be considered incidental to the project. MATERIALS AND EQUIPMENT REMOVED AND STACKED All materials removed and stacked shall be delivered to the Town maintenance facility or storage yard designated by the Town. If the Engineer determines that any part of the stacked materials is unsuitable for re-use, or if the Town decides to abandon part or all of such materials, said materials shall become the property of the Contractor and he shall dispose of them outside and away from the limits of the project, without additional compensation. PROPERTY ACCESS The Contractor shall provide and maintain access at all times to all properties abutting the work. Final pavement of the public ways shall be performed after all other work is finished. CONCRETE FOUNDATIONS Concrete foundations of items to be removed, if not interfering with the proposed construction, may be abandoned in place with written acceptance of the Engineer. Foundations left in place under the roadway surface shall be removed to a depth of three feet (3') below the finished grade; all other foundations left in place shall be removed to a depth of six inches (6") below the finished grade. The top six inches (6") shall be restored to match the existing grade with materials similar in kind to the adjacent materials. SHOP DRAWING SUBMITTALS The following procedure shall be followed when making shop-drawing submittals for this project: 12 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 1. The Prime Contractor shall submit three (3) sets of drawings directly to Weston & Sampson, 100 Foxborough Blvd, Foxborough, MA 02035: attention Nate Seifert, P.E. The Design Engineer will send a written reply, returning two sets to the Prime Contractor within thirty working days of receipt of the drawings. If the Design Engineer’s reply indicates rejection or advises corrections or additions to the drawings, steps 1 and 2 are repeated until the Design Engineer indicates that approval will be given. The Contractor shall take care that every separate document in each set of every submittal shall carry the following identifying information: 2. 3. 4. (5) Date of signature or submittal The Contractor shall not receive payment for, nor will he be allowed to install any item or materials that require shop drawing approval or acceptance unless and until he receives from the Design Engineer a properly stamped shop drawing for that item. SERVICE CONNECTIONS The Contractor shall be responsible for the payment of all fees for services rendered in conjunction with service connections by utility companies under this project. The cost thereof shall be included in the various items of work. COORDINATION WITH OTHER WORK The Contractor will be required to coordinate with the Charlemont Highway Department through the Engineer prior to completing any excavation near utilities. ITEM 120.1 UNCLASSIFIED EXCAVATION CUBIC YARD Work under this Item shall conform to the relevant provisions of Section 120 of the Massachusetts Department of Transportation Standard Specifications – Latest English Edition and the following: This Item includes the removal and disposal of all materials indicated on the plans and those required to be removed, for which neither the Specifications nor the Proposal direct a separate payment, with no additional compensation. Unclassified excavation shall include the removal and disposal of earth, cement concrete and bituminous pavements (whether reinforced or not), boulders, ledge (Class A Rock), sidewalks (brick, concrete, and HMA), grassed and graveled areas, concrete and stone walls, concrete barriers, stumps, unacceptable curbing, existing concrete bridge posts, and all other materials where removal is required or directed and not described under other items of work; 13 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 miscellaneous debris, junk or scrap; items to be removed that are unsuitable for reuse for this project and, no longer required (and not paid for under other items of work). The work under this Item shall also include all excavation to roadway sub-grade and bridge approach slabs and the removal and disposal of traffic signs, guardrails, fences, curbing, edgestone, utility pipe encountered in the course of excavation and other appurtenances. Edges of excavations made in existing pavements shall be squared by saw cutting with power driven tools to provide a neat clean edge for joining new pavement as shown on the plans. Pavement areas, which have been broken or undermined shall be removed and neatly edged as directed by the Engineer with minimum disturbance to remaining pavement. The Contractor shall perform all excavation in such a manner as to maintain slopes and prevent sloughing both longitudinally and laterally to insure proper and continuous drainage at all times. Disposal of those materials unsuitable for reuse and those materials designated as excess and not required on the project shall be legally removed from the project and shall be the sole responsibility of the Contractor. This work shall be in accordance with the regulations and requirements of all municipalities or agencies having jurisdiction over the disposal sites and the routes between the project and the disposal sites; and shall be as stipulated in Subsections 120.20 and 120.60 B, as amended as follows: Disposal permits for all materials to be wasted (if required) off the project site shall be obtained by the Contractor from the Federal, State or Municipal agency or agencies having jurisdiction over the proposed waste sites. The Contractor shall keep the Town Engineer informed as to the location of the intended disposal sites and shall show proof of permit. ITEM 129. This item shall conform to the requirements of Section 751 and 767 of the Standard Specifications and the following. MATERIALS Material for the filter tubes shall be compost meeting M1.06.0, except that no manure or biosolids shall be used. In addition, no kiln-dried wood or construction debris shall be allowed. Particle size analysis: 98% shall pass through a 3 inch (75mm) sieve; 30-50% shall pass 3/8 inches (10mm) sieve. Tubes for compost filters shall be a minimum of 12 inches (300 mm), a maximum of 18” (450mm) in diameter. Tube material shall be a knitted mesh with 1/8” - 3/8” (3-10 mm) openings, and made of biodegradable (cotton or jute) materials. Photodegradable fabric may be used; however, photodegradable fabric must be removed and disposed of by the contractor, at his expense, at the end of the contract. Additional tubes shall be used at the direction of the Engineer. As shown in the detail, the 1 foot (0.2 meters) wide by 2 inch (50 mm) deep wedge of compost spread along the top of the filter tube shall be incidental to this item. 16 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 Stakes for anchors, if required, shall be nominal 2 x 2 stakes. METHODS Tubes of compost may be filled on site or shipped. Tubes shall be placed, filled and staked in place as required to ensure stability against water flows. All tubes shall be tamped to ensure good contact with soil. The Contractor shall ensure that the filter tubes function as intended at all times. Tubes shall be inspected after each rainfall and at least daily during prolonged rainfall. The Contractor shall immediately correct all deficiencies, including, but not limited, to washout, overtopping, clogging due to sediment, and erosion. The contractor shall review location of tubes in areas where construction activity causes drainage runoff to ensure that the tubes are properly located for effectiveness. Where deficiencies exist, such as overtopping or wash-out, additional staking or compost material shall be installed as directed by the Engineer. Contractor shall remove sediment deposits as necessary to maintain the filters in working condition. The functional integrity of filter tubes shall be maintained in sound condition at all times. Filter tubes that are decomposing, cut, or otherwise compromised shall be repaired or replaced as directed by the Engineer and be incidental to this item. Filter tube fabric and stakes shall be removed by the Contractor when site conditions are sufficiently stable to prevent surface erosion, and after receiving permission to do so from the Engineer. All biodegradable tube fabric shall be cut and laid flat in place to decompose on-site at the direction of the Engineer. Tube fabric that is not decomposing satisfactorily shall be removed and disposed off-site by the Contractor. At the direction of the Engineer, the Contractor may rake out and seed compost so that it is no greater than 2 inches (50 mm) in depth on soil substrate. COMPENSATION Measurement for this item shall be by the LINEAR FOOT of Compost Filter Tube installed, approved, and maintained in place. Payment shall be the bid price and shall be compensation for all labor equipment and materials necessary to complete the work specified above, including, but not limited to, stakes and tube fabric, compost mulch wedge along top of tubes, removal and disposal of fabric and stakes, raking and seeding of compost. The Contractor shall furnish notarized certification that all materials conform to the above requirements. In addition, samples of all materials proposed for use shall be submitted to the Department's Research and Materials Section for approval. These samples must be submitted at least six weeks prior to scheduled use. MIXING Thorough mixing of the repair mortar is required. A forced-action mixer is essential. Mixing in a suitably sized container using an appropriate paddle with a slow speed (400-500 rpm) heavyduty drill is acceptable. Free-fall mixers must not be used. Only full bags shall be mixed and used. It is essential that machine mixing capacity and the crew size is adequate to enable the placing operation to be carried out continuously. Mechanically mix in appropriate sized mortar mixer or with electric drill and paddle. TEMPERATURE RESTRICTIONS The mixing shall be carried out in accordance with the manufacturer’s specifications. The repair mortar shall not be mixed and placed when air or substrate temperatures are below 45°F. Cold weather protection shall be provided in accordance with Subsection 901.64 C of the Standards. Hot weather protection shall be provided in accordance with Subsection 901.64 A of the Standards. PREPARATION OF SUBSTRATE SURFACES The edges of the areas to be repaired shall be saw-cut to a minimum depth of 3/4” to avoid featheredging and to provide a squared edge. All deteriorated, scaling, loose or unsound concrete 19 | P a g e Invitation for Bids – Mountain Rd. Bridge 1/20/2016 shall be removed by mechanical or hand chipping. The remaining surface shall be free of oil, grease, paint, corrosion deposits, dust, laitance or other surface contamination. The effectiveness of the cleaning shall be verified with a pull off test. No method of surface preparation shall be used that could damage sound concrete. All reinforcing steel shall be abrasively blast cleaned in accordance with the ICRI Technical Guideline No. 03730 “Guide for Surface Preparation for the Repair of Deteriorated Concrete Resulting from Reinforcing Steel Corrosion” The Contractor shall have the approval of the Engineer certifying that all spalled and deteriorated concrete has been removed prior to repairing the deteriorated areas; all reinforcing steel is satisfactorily cleaned. FORMING AND PLACEMENT OF REPAIR MORTAR 1. All formwork shall be rigid and tight to prevent loss of material. All elements of the formwork and anchorages shall be designed for a pressure of 12 PSI. 2. The forms shall be watertight with perimeters lined with foam gasket material. 3. Form ports for pumping the mortar shall be placed no greater than 4 feet on center. Venting ports shall be placed no more than 2 feet on center. 4. The formwork shall include drainage outlets for presoaking of the substrate. 5. Form detailing shall allow for a minimum of 1-1/2” cover over all steel. 6. A suitable form release agent shall be used to facilitate the removal of forms from the cast material. 7. The forms shall be filled with clean water 24 hours prior to the mortar placement. 8. Immediately before placing, the water shall be drained and the drainage outlets sealed, leaving the substrate saturated surface dry (SSD) with no ponded water remaining. 9. In jobsite circumstances where the formwork cannot be filled with water, spray the substrate with clean water to achieve a saturated surface dry (SSD) condition immediately before placing the mortar. 10. The pump shall be capable of continuous even flow of mortar into the repair cavity without having any line surge. Line surge will result in possible air voids and segregation. 11. Prior to pumping mortar, all hoses must be pre-wetted with clean water to ensure that initial flow properties are maintained. 12. The pumping distance must be kept to a minimum. The pumping hoses shall be a minimum diameter of 3 times to size of the largest aggregate and the minimum size permitted shall be 1” diameter. 13. The pump pressure shall be limited to the minimum necessary to completely fill the cavity with repair mortar. 14. Immediately after mixing, pump the repair mortar into the formed area. CURING 1. Formwork shall remain in place until a minimum compressive strength of 2500 psi is reached, or 5 days, whichever is greater. 2. If the repair area is not to receive a protective coating, an approved curing compound shall be applied to the repair area upon form removal. 20 | P a g e Invitation for Bids – Mountain Rd. If the repair area is to receive a protective coating, polyethylene sheeting shall be applied to the repair area and the sheeting perimeter shall be taped down until the completion of a 7 day curing period. MANUFACTURER'S FIELD REPRESENTATIVE 1. The Contractor shall arrange with the mortar manufacturer to have the services of a competent field representative at the work site prior to any mixing of components to instruct the work crews in the proper mixing and application procedures. The field representative shall remain at the job site after work commences to instruct until she/he and the Engineer are satisfied that the crew has mastered the technique of installing the system successfully. The representative shall make periodic visits to the project as the work progresses and shall confer on each visit with the Engineer. 2. The Manufacturer's Field Representative must be fully qualified to perform the work and shall be subject to the approval of the Engineer. 3. The Contractor shall be completely responsible for the expense of the services of the required field representative and the bid contract price shall be full compensation for all costs in connection therewith. METHOD OF MEASUREMENT Cementitious Mortar for Patching will be measured by the square foor of repair area, completed in place and accepted by the Engineer. Forming of the repair areas and pre-wetting of the substrate shall be considered incidental to the work and shall not be measured for payment. Excavation of deteriorated concrete shall be compensated for under Item 127.1, Reinforced Concrete Excavation. The Contractor shall make and keep for at least six years after final payment, books, records, and accounts, which in reasonable detail accurately and fairly reflect the transactions and dispositions of the contractor [MGL c 30 §39R(b)] and make such records available to the Awarding Authority. 3.02 MA Prevailing Wages ARE REQUIRED FOR THIS PROJECT The Contractor shall comply and shall cause its subcontracts to comply with Massachusetts General Law c. 149 § 27B, which requires that a true and accurate record be kept of all persons employed on the project for which the prevailing wage rates have been provided. The Contractor and all Subcontractors shall keep these records and preserve them for a period of six years from the date of completion of the Contract. The Contractor shall, and shall cause its Subcontractors to submit weekly copies of their weekly payroll records to the Awarding Authority. Attention is directed to the “Information about Prevailing Wage Schedules for Awarding Authorities and Contractors” on the attached COMMONWEALTH OF MASSACHUSETTS DEPARTMENT OF LABOR STANDARDS Prevailing Wage Rates. Bridge 1/20/2016 4.00 WORKFORCE QUALIFICATIONS The Contractor shall: (i) employ competent workers; (ii) enforce strict discipline and good order among the Contractor’s employees and other persons carrying out the Work; (iii) not permit employment of unfit persons or persons not skilled in tasks assigned to them. Whenever the Town shall notify the Contractor in writing that any work is, in the Town’s designee’s opinion, incompetent, unfaithful, disorderly, or otherwise unsatisfactory, such employee shall be discharged from the Work and shall not again be employed on the Work except with the consent of the Town. If OSHA certification is required by the Contract per MGL Ch. 149, Contractor shall provide OSHA certifications of any personnel on site when requested by the Awarding Authority or with submittal of first Certified Payroll. Contractor certifies that all of their employees who will be employed at the work site have successfully passed the OSHA approved 10-hour safety course, and they are able to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the Work. 5.00 NON-DISCRIMINATION The Contractor shall not discriminate against any person because of race, color, religious creed, national origin, gender, ancestry, sexual orientation, age, handicap, gender identity, genetic information, military service or any other protected class under the law. 6.00 INDEMNITY a. To the fullest extent permitted by law, the Contractor shall defend, indemnify, and save harmless the Town and its respective duly elected or appointed officials, agents and employees from and against all demands, claims, damages, liabilities, losses, costs, and expenses (including, but not limited to, reasonable attorney fees) (referred to collectively as “demands”) arising out of or resulting from any work performed pursuant to this Agreement including but not limited to any negligent acts, errors, or omissions of the Contractor, any subContractor, or any person directly or indirectly employed by any of them, or by a defect of a product or design supplied by the Contractor or subContractor. Such obligation shall not negate, abridge, or reduce in any way any additional indemnification rights of the Town, that otherwise may exist under statute or in law or equity. b. The Contractor shall defend, indemnify, and hold harmless the Town from any and all demands relating to wages, overtime compensation, or other employee benefits by employees employed directly or indirectly by the Contractor for work performed in connection with the work hereunder or required by state or federal law, including but not limited to Fair Labor Standards Act and Massachusetts Prevailing Wage Law. c. The indemnification obligations of the Contractor and subContractor shall not be limited in any way by any limitations on the amount or type of damages, compensations, or benefits payable by or for the Contractor or subContractor under any federal or state law. 37 | P a g e Invitation for Bids – Mountain Rd. In the event of a breach of this Agreement by the Contractor, the Contractor shall pay the Town all reasonable attorney fees, costs and other litigation expenses incurred by the Town in enforcing its rights as a result of said breach in addition to any damages for said breach. 7.00 LICENSES AND TAXES The Contractor shall obtain all licenses and permits (other than the license and permit granted by the Contract) and promptly pay all taxes required by the Town. 8.00 INSURANCE The Contractor shall at all times during the Contract maintain in full force and effect Employer's Liability, Worker's Compensation, Bodily Injury Liability, Property Damage and General Liability Insurance, including contractual liability coverage for the provisions of Section 5.00. All insurance shall be by insurers and for policy limits acceptable to the Council and before commencement of work hereunder the Contractor agrees to furnish the Council certificates of insurance or other evidence satisfactory to the Council to the effect that such insurance has been procured and is in force. The Bond shall be submitted to the Town prior to Contract execution. Premium for the bonds shall be paid for by the Contractor. The bond shall be payable to the Town and be drawn upon a surety company licensed to do business in the Commonwealth of Massachusetts. 10.00 BASIS OF PAYMENT / APPROPRIATION 10.01 Rates - The charges shall not exceed the rates fixed by the Contract Documents. 10.02 Appropriation – The Awarding Authority certifies that at the time of the execution of this Contract, sufficient appropriations exist and shall be encumbered to fund the Contract Price. Payments are subject to appropriation and shall be made only for work performed in accordance with the terms of this Contract. The Contractor shall not be obligated to perform, and may not perform, work outside the duration and scope of this Contract without an amendment to this Contract, and a sufficient appropriation(s) to support such additional work. The Awarding Authority may immediately terminate or suspend this Contract in the event that the appropriation(s) funding this Contract is eliminated or reduced to an amount which will be insufficient to support anticipated future obligations under this Contract. 11.00 MATERIALS AND EQUIPMENT WARRANTY Materials and equipment to be installed as part of the Work (both or either of which are hereinafter referred to as “materials”) shall be new, unused, of recent manufacture, assembled, and used in accordance with the best construction practices. The Town may reject unsuitable work, notwithstanding that such work and materials may have previously been accepted for payment. If any part of the Work shall be found defective at any time before the final acceptance of the whole Work, the Contractor shall promptly correct such defect in a manner satisfactory to the Town. If any material brought upon the site for use in the Work shall be deemed as not in conformity with the Contract Documents, the Contractor shall promptly remove such materials from the site. 12.00 RISK OF LOSS The Contractor shall bear the risk of loss with respect to any of its or its agents’ employees or subcontractors’ vehicles, equipment or tools brought onto or left at the worksite and for any materials stored at the worksite. 39 | P a g e Invitation for Bids – Mountain Rd. In the event of suspension, the Town will set forth the specific grounds for the suspension, any actions the Contractor could take to correct the problems or situations, and a stated period of time for the Contractor to comply with the corrections required. Failure to correct the problems or situations that necessitated the suspension within the stated period of time shall be grounds for termination. The Town shall have the right to terminate this Contract without cause upon fifteen (15) days notice to the Contractor and all preceding paragraphs herein shall be applicable to this termination. See Article 10.02 Appropriation. 17.00 CHOICE OF LAW This Contract shall be construed under and governed by the laws of the Commonwealth of Massachusetts. The Contractor, and agents thereof, agree to bring any federal or state proceedings arising under this Contract, in which either the Commonwealth or the Awarding Authority is party, in a court of competent jurisdiction in the County of Franklin, Massachusetts. For CM AT RISK projects (bid pursuant to G.L. c.149A), the earlier of: (a) the execution date of the GMP Amendment, or (b) the bid for the first construction scope of work must be within 90-days of the wage schedule issuance date. • The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149, § 27. The wage schedule shall be made a part of the contract awarded for the project. The wage schedule must be posted in a conspicuous place at the work site for the life of the project in accordance with M.G.L. c. 149 § 27. The wages listed on the wage schedule must be paid to employees performing construction work on the project whether they are employed by the prime contractor, a filed sub-bidder, or any sub-contractor. • All apprentices working on the project are required to be registered with the Massachusetts Division of Apprentice Standards (DAS). Apprentice must keep his/her apprentice identification card on his/her person during all work hours on the project. An apprentice registered with DAS may be paid the lower apprentice wage rate at the applicable step as provided on the prevailing wage schedule. If an apprentice rate is not listed on the prevailing wage schedule for the trade in which an apprentice is registered with the DAS, the apprentice must be paid the journeyworker's rate for the trade. • The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule. Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the contract was executed by the awarding authority and the general contractor. For multi-year CM AT RISK projects, awarding authority must request an annual update no later than two weeks before the anniversary date, determined as the earlier of: (a) the execution date of the GMP Amendment, or (b) the execution date of the first amendment to permit procurement of construction services. Contractors are required to obtain the wage schedules from awarding authorities, and to pay no less than these rates to covered workers. The annual update requirement is not applicable to 27F “rental of equipment” contracts. • Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll reports and a Statement of Compliance directly to the awarding authority by mail or email and keep them on file for three years. Each weekly payroll report must contain: the employee’s name, address, occupational classification, hours worked, and wages paid. Do not submit weekly payroll reports to DLS.
