to ttase premises and on each occasion it was found to be closed.
Resolved that, should the business re—open under the control of the
persons upon whom the Improvement Notices have been served, the Director
of Legal Services be authorised to institute legal proceedings against
the proprietors of La Vieille Boulangerie, Back Lane, Roohfoth, for
non.—oempliance with the Improvement Notices in accordance with the
provisions of Section 33 of the Health & Safety at Work etc. Act 1974.

blocking with increasing frequency over the last 18 months and. as a
privately maintained public sewer, the responsibility for repair,
renewal or improvement was a private matter. The most practicable
solution would be to relay the sewer on a line parallel to the
existing in the Council owned lanAi at the rear of the properties.
The new sewer would remain privately maintained.
RECOMMENDED That the Director of Technical Sernces desia and construct
a suitable scheme for this sewer and that the Director of Legal Services
be empowered to serve notices on the relevant owners under Section 24
of the Public Health Act 1936 tp enable the costs of this work to be
recovered,

Council as part of a scheme to own and control Hulibridge Foreshore
which was halted owing to financial restraint.

410. The Director of Legal Services reported that the Rayleigh and District
Angling Society were anxious to have some indication of the Council's
intention regarding renewal of the lease. The expiry date was still
five years distant, but the establishment and maintenance of the ponds
was a long te task. The Director of Technical Services was satisfied
that the ponds were being well maintained and managed by the Angling
Society.

casual and club badminton bookings and that the requirement for advance
bookings to maintain six playing members per court hour caused
difficulties for the larger clubs.

to maintain an average attendance of 4.5 playing members por court
hour and those clubs booking one court hour retain a requirement of
six playing members per court hour, no minimum attendance being

LEISURE FACILIIIIES - "STAR BUYS"
412. The Directcr of Technical Services reported that each of the three
sports centres had a ccsnprehensive hcliday coaching/activity programme.
These courses being in two fonns, coaching and "Coins and Try" sessions.
The latter included swiinning, roller skating, trampolining, recreation
activity and fun swims and charges for these activities ranged frem
30p to 70p.
It was considered that farther income and attendance could be generated
by advertising these activities as "Star Buys" w.th a ten ticket book
at £3.00. (Iharges would remain as nonnal if a bock of tickets was
not purchased.
ITECCR!(IilNDRD That books of "Star Buys" tickets be available to juniors
participating in the above activities for £3.00, on weekdays between
27th July and 7th September, 1981.

415. The Director of Legal Services reported that work on the above
community centre was programmed for completion by 1st November
and it was necessary to appoint a Management Committee — as a
panel of the Leisure Services Committee — to deternine the
policy for the day to day running of the premises as a municipal
undertaking. It was envisaged that the Management Caninittee
would include a representative of the Louis Drive Estate
Residents Association as well as a delegate from the new
Cccnunity Association once forned.
The Director ol' Technical Services advised that decisions as to the
opening hours and the level of hire charges urust be taken as soon as
possible in order that lettings of the premises may be accepted. A
report on the staffing requirement would be made to the Finance
and Personnel Ccsnmit tee.

416. The Connittee considered the above report prepared by Councilor
T.J. Warner on the provision of a voluntarily run unattached Youth
Centre in Raylei to cater for youngsters to did not attend the
Clubs provided in school premises. The proposed Club would also
include woxic experience for unemployed young people. The cost of
the scheme was estimated to be £92,400 which would be funded half
from donations and half by loan. The Committee also had before them
the appended report of the Management Team on the proposal, together
with the observations (also appended) ci' the County Education Officer
who suggested that the project would involve duplication of existing
services.
Members congratulated Councillor Warner on the production of the
report, but overall it was felt tat this service was a County
responsibility and that they should deal with the matter because

if the District Council assisted with the project, Rochford
ratepayers would in effect be paying twice. Also the projeot had
to be weined ainat the competing claims on the Council' s resources
of projects which were Rochford' s responsibility. There was also a
full discussion questioning the need for the scheme and the likelihood
of
it achieving its objectives. The CczQmittee concluded that the
project was not a matter that the District Council should itself
pursue.

interested parties to discuss the proposed footbridge at Baylei*
Vein. Three sitinge were considered — one to the east of the
junction and two to the west. The eastern side bad been the original
preference of the County Council but was opposed by Castle POint
District Council and Thunderaley Residents.
BECCMIEE1D That, having regard to the stated wishes of local
residents, the Council supports the siting of a footbridge to
the west of the Rayleia Veir junction provided -that it can be so
sited without a disproportionate increase in coat and withcut undue
delay.

agencies being available to District Councils and had. sympathy with
Bochford's request for one.

Councils was ext±emely concerned and dissatisfied about the attitude
of many County Councils and had asked the Minister of Transport to
meet a deputation from the Association to discuss what could be done
to achieve the Government' a stated desire that Districts who wished
to provide some or all of the hiaway and traffic management functions
should be allowed to do so.

The Director of Legal Services reported. on discussions about the
diversion of paths on Purdeys Industrial Estate. One of the roposala
Development Services Committee
was for the extinguishment of the short remaining section of
Bridlewsy 43 but in exchange for agreeing this R.A.D.A.R. and the
British Horse Sodiety had. tried to negotiate a new bridleway fran
Sutton Road to Bridleway 38 at the Mill Head. However, the
owner was not prepared to grant any new riita over his land.
It was noted that in due course the Industrial Estate roads would
be adopted as public hiways and boreeriders would have equal
riits to other forns of traffic and at that time a Iridleway
link could be provided between Mill Head Wai and the riverbank.
Meetings with the :British Horse Society and the applicants were
held but the Society had maintained its request for a route throua
the estate from Sutton Road. The Director considered there to be
no further roan for negotiation but thou&at that The Council's
intentions to make a scheme in the future should be made clear.
RECCM'1ED (1) That provision be made for a bridleway link
between the car breakers site access road when adopted and the
new route of Bridleway 38 when this is diverted to The riverbank.
(2) That at the appropriate time the Council also
seeks, subject to satisfactory tens being agreed, to enter into
a Creation Agreement to provide a bridleway link between Mill Head

priorities according to circumstances. Attention was drawn to the
fact that, althoui the Coastal Water and Recreation Subject Plan
(B5) and the (kreen Belt Subject Plan (C2) had been reduced to
Supplementary Planning Cu.tdance and could be deleted frca the
priority list previously approved, wo* on the Green Belt would not
stop altogether.

The Committee noted a very full report on a survey at the
Inteni.atianal Store in Ray1eia which, although was not a superetore,
was the largest in the District. Members felt that the growth of
large stores just outside the District contributed, to the decline
in Town Centres but thought that rising petrol costs might bring
a small revival of trade In the High Streets.
A Manber felt that the rating of empty shops BhOUJ.d be investigated
saying that punitive rating night encourage owners to find new
tenants quickly.

had submitted an application for an. increase in taxi fares, supported
by details of increased costs of 29%, to Scuthend Borough Council. As

Members noted that the existing fares had beal in force since 1979 and
that if approved, this would be the first increase in two years.

financial year are now presented on the attached reports,

payments for cleaning and canteen staff at Rayleigh were acceptable
to the Works Side.

The Chief Executive reported that in view of the costs involved it
had been necessary to defer implnentation of the proposals agreed
at the last meeting to retain verge cutters within the Parks Section
on a permanent basis thus retaining their Grade E and Parks bonus
payments. The total additional estimated cost of the proposals was
£750 per azmtzi.

The Works Side indicated that on the assurance given that the scheme
of payment in "Round Pounds" would be of no detriment to the wo±force
then it was acceptable.
The Director of Finance reported that it would take some weeks to
fully implement the scheme but that inmadiately prior to its intro—
duct ion he would write to the men briefly explaining the proposals.

ROil) SWREPF?S BONUS (Minute is)
In accordance with the recommendation of the Panel at the last Meeting
the Chief Executive had investigated the introduction of an appropriate
average bonus payment in respect of Road Sweepers. It was suggested
that a consolidated bonus based on 30% of the manual sweepers basic
rate of pay would be appropriate and would result in a bonus of £18 per
week.
It was suggested by the Work Side that consideration might be given
to the implementation of this arrangement from the date of oiencement
Joint Works and Safety Panel
of the now consolidated bonus arrangements. The Council Side
pointed out however that as the Road. Sweepers had not previously
received any bonus they had not forned part of the original
negotiations and there was therefore no reason why this payment
should be tied to that arrangement. Reference was also made to
the present severe CovernnEnt restrict ions on Local .A2lthority
expenditure and an attempt to back—date these payments oould
only

Mr. Dowey, representing Parks Section, referred to the frustration
of his cofleagues at continual breaches of bye—laws in the Open
Spaces and reported that he and his colleagues were now endeavotiring
to enforce these more rigidly. In doing so however they sout the
support of the Council in what they were endeavouring to achieve.
On behalf of the Council Side Councillor Harvey commended the attitude
of the Parks Section and assured them of the Council? s full support
but warned against the risk of personal injury.

Executive reported the ruling of the Provincial Council as to
whether an excess travelling time allowance was pable to those staff
transferred to Rochford as a result of the centrsJisation of offices.
As Contracts of np1oyment did not refer specifically to agreements of
the Provincial Council there still remairtd some doubt as to whether these
aeements could be enforced but it appeared that, even if there was no
strict legal obligation, there was a moral duty as a Member of the

462. The Director of Town flrnining introduced tat a Member described
as a most cogent synopsis of the history, the considerations and
the implications of proposals for an airport at Maplin. It was
necessary for the Council to make clear its position so that the
Public Inquiry into the Stansted proposal could. consider
alternative sites and the Inspector for that Inquiry had. requested
the Council to supply such details.
There followed an infornative debate during tich Members refrained
from mere rehearsal of old arguments but concentrated on the basic
policy question as to tether an airport at Maplin would be for or
against the best interests of the District. Althoui. the Council
had consistently supported sane forn of developnent at Maplin,
believing that this would help correct the imbalance between
ccnmercial and. residential develorment, it had never expressed
support for an airport at Maplin and the debate confined that this
remained the policy of the Council.

The Director of Finance submitted a report which made clear that,
althoui acquisition and running of a Council car for official business
would cost more than hiring, the extra was within reasonable limits.
A past Chairman spoke of the difficulties of relying on hired
transport and the Connittee were satisfied that, even in tines of
financial restraint, ratepayers wished to be represented at official

The Chief Executive invited the Panel to reconsider reports on Borou&i
Status and Twinning which had been before the Council in 1978 to establish
whether it was now felt that the Council mi&it wish to proceed with either

were also asked for their views on the provision of an
official Council oar

slification for the Council Chamber.
\Qhilst appreciating the prestige accorded to Borough Status, the

that it was not now the time to pursue it. Similarly, they
did not think that the Council could justify expenditure on Twinning
arrangements.
As regards an official Council oar, Members were satisfied that the
number of occasions when a car had to be hired. for the ChainanTs Official
engagements and when Members and Officers required transport for Official
occasions, a Council oar was justified. There were also financial arguments
to support this view. In addition the Panel were of the opinion that the
acoustics in the Council Chamber were in need of urgent improvement and
that the Officers should investigate and report on sound amplification
systems which might be installed including the possibility of suspended
microphones and whether
equipment trials
might be
arranged.

programme for the eventual assumption of control of the Centre by a
Community Association, had been adopted by the Policy and Resources

and would avoid any confusion as to its location should other Community

consolidated bonus arrangements together with the report of the Chief
Executive containing a draft of an article on the subjeot which he had.
prepared for publication in the Local Goverrment press and which it was

The Panel received and. considered the report of the Director of Finance
and agreed that the present level of discount offered by the Authority
of 2% was reasonable.

CAR AND TELEPHONE AnOWANCES
6.
The Panel received and considered the report of the Director of Finance
upon staff in receipt of essential car user and telephone allowances as
requested by the District Auditor in his report upon the 1979/SO accounts.
The Panel agreed that the level of officers in receipt of the allowances
was very reasonable and reflected the responsible attitude of Directors
in the allocation of the allowances •
The

to the Council as a result of the payment of these allowances. The Chief
Executive quoted several exaDaples of cases where officers had been called
upon
outside of nornal office hours.
The Director of Pinance referred to a suggestion made by the District
Auditor that a periodic check should be made of official calls made by
officers in receipt of telephone allowance to satisfy themselves that the

In
considering the report
of the Director of Finance upon central establishment
charges the Panel were advised of the recent ).nagement Team consideration of
this nattar where the following points bad been raised:—
(1) That 1% allocations of time were unrealistic and that minimum allocations
in the future shauld be 5%,
(2) In assessing allocation of accoimnodation the Director of Finance would,
in future, have regard to usable areas of acconinodation only, exctding
corridors, stairs etc •
and
would not assess aocoxnodation charges on
a per capita basis.
(3) Chief Officers and their Secretaries would be required to allocate
their tine against individual expenditure heads rather than on a pro
rata basis as at present.
(4) Additional headings should be included within the charges to cover
planning appeals and inquiries arid allocation of officers time to
Ocanmittee expenses and Members' queries.

The proposed use is at precent in operation between two extensive ranges
of glasshouses near the southern boundary of the site with concrete moulding

476. The Chainaan reported that he had arranged for the following

best wishes on the marriage of H.R.II. Prince Charles, Prince of Wales

The Chairman also reported that it was the Council's practice on
such occasions to make a wedding gift but that it had been agreed
with the Palace that as IIR.H. Prince Charles was the patron of

Chairman' a Appeal for the Disabled would be appropriate and this
was being arranged.
