Human Rights Court To Hear
CIA Prison In Poland Case
14.10.2013 - The first hearing
brought by former captives who
allege that they were held at a
CIA black site in Poland will
begin at the European Court of
Human Rights in Strasbourg on
2 and 3 December.
The case has been brought to
court by Abd al-Rahim al-Nashiri
and Abu Zubaydah, both still incarcerated in Guantanamo Bay, who
claim they were detained and tor-
tured at a secret CIA facility in
Stare Kiejkuty, northern Poland in
2002 and 2003.
Present at the hearing will be
UN Special Rapporteur on human
rights and counter - terrorism Ben
Emmerson and lawyers representing their clients, though it is not
known at what level Poland will be
represented.

has been underway since 2008 but
has still to reach a conclusion, of
“chronic inefficiency”.
“I hope that the Court determines the admissibility of the
application and will issue a decision that Poland comply with standards under the Convention for the
Protection of Human Rights and
Fundamental Freedoms and Polish
law,” Bartlomiej Jankowski, the
lawyer representing Abu Zubaydah
told the TVP broadcaster.
Poland’s left wing prime minister and president at the time of the
accusations of a CIA prison on
Polish soil, Leszek Millar and
Aleksander Kwasniewski respectively, have maintained that they
had no knowledge of such a facility, though anonymous sources
within Poland’s secret services
have told media that there was a
detention centre run by American

Poles Ready For Hitler
Comedy, Director Claims

claimed that Poland is
ready for a comedy
about Hitler, as he prepares to release his latest movie.
“It's been seventy
years since World War
II,” the filmmaker told
weekly Wprost.
“We've reached the
point where we can
treat serious things in a
frivolous way,” he
added.
“Laughter heals.”
The
plot
of
Machulski's
film
EmbaSSy (AmbaSSada)
revolves around a young couple living in present-day Warsaw.
Their home happens to be the former German Embassy, and entering the
elevator one day, they find themselves transported back to the eve of war
in 1939.
Controversial rock star Nergal, who was taken to court in Poland for
tearing up a bible onstage, plays former German Foreign Minister Joachim
von Ribbentrop, while actor of the moment Robert Wieckiewicz (Walesa:
Man of Hope, In Darkness) plays Hitler.
Machulski argues that the younger generation in Poland “has had
enough [of hearing about] martyrdom.
“They are ready to laugh at our historical failures, while still taking
pride in everything that we managed to accomplish,” he said.
Juliusz Machulski directed cult Polish comedies such as 1984's Sex
Mission (Sex Misja) and art heist caper Vinci (2004).

Privatizing The National Park Service

The behavior of the National Park Service during the government shutdown has been truly shocking. As has been widely reported, Park Service
employees have been told to make life as uncomfortable as possible for
people, and have flourished in that endeavor. They have acted crudely and
unprofessionally, allowing themselves to be used politically by the White
House in its PR campaign.
If you’re not familiar with what I’m talking about, then please start
Googling. There are frightening first-person accounts everywhere. Among
the worst examples was a case innocently covered by a small Massachusetts
newspaper that reported on a group of tourists traveling to Yellowstone
National Park. The tourists described the Park Service as “Gestapo”-like in
its tactics.
That, of course, is an exaggeration. But the fact that a group of apolitical
citizens would invoke such hyperbole to describe how they were treated
really says something.
The Weekly Standard, a conservative source, argues in an editorial that
the Park Service’s conduct “might be the biggest scandal of the Obama
administration.” The Standard rattled off examples of abuses during the
shutdown, highlighting the most egregious of them all, the shameless scene
at the World War II Memorial:
People first noticed what the NPS was up to when the World War II
Memorial on the National Mall was “closed.” Just to be clear, the memorial is an open plaza. There is nothing to operate. Sometimes there might be
a ranger standing around. But he’s not collecting tickets or opening gates.
Putting up barricades and posting guards to “close” the World War II
Memorial takes more resources and manpower than “keeping it open.”
No question. What happened at the World War II Memorial was pure
political exploitation. The spectacle of elderly, heartbroken, wheelchairbound vets voyaging thousands of miles to remember their fallen brothers,
maybe for a final earthly time, only to be denied by cruel, intransigent
Republicans, was apparently too delicious to pass up.
But even then, as the Standard noted, the barricading of the World War II
Memorial was “just the start of the Park Service’s partisan assault on the citizenry.” It noted other historical sites that are privately owned and operated, where “the Park Service doesn’t actually do anything.” Nonetheless, the
Park Service mustered the resources to deploy officers to forcibly remove
volunteer workers and visitors. As the Standard put it, the Park Service “is
now in the business of forcing parks they don’t administer to close…. It’s
one thing for politicians to play shutdown theater. It’s another thing entirely for a civil bureaucracy entrusted with the privilege of caring for our
national heritage to wage war against the citizenry on behalf of a political
party. This is how deep the politicization of Barack Obama’s administration
goes.”
Sadly, federal employees have been conscripted in the politicization. Not
unlike the IRS, NPS agents are abusing their powers. They are being tasked
as a political/ideological arm of the state. This is precisely not what civil
servants are to be.
As a personal sidenote, the National Park Service falls under the
Department of Interior, once run by my late friend Bill Clark. Clark had
great respect for the department, its mission, and its employees. Clark died
in August. If he had seen Interior employees enlisted and behaving like this,
he would have been extremely disappointed.
And so, my reaction to this egregious behavior by the National Park
Service is one word: privatize.

between Poland and the German
people.
This is probably a good development and advantageous for both
countries, and for their economies.

First off, I want to thank Orzel
Kalinowski for his nice comment
relative to my idea of adding a cross
onto the breast of my newly
designed Polish Eagle, then have it
placed on the Polish Flag. It is
greatly appreciated! Hopefully, others shall see the need also!
Several weeks ago, I wrote in the
Post Eagle Opinion Editorial of my
redesign of Poland's White Eagle,
created for the intention of having it
placed on the Polish Flag, to
enhance and announce Poland's
new persona and international
image on the world stage.
In this effort, I wrote directly to
the President, Prime Minister,
Senate and Congressional Leaders
in Poland requesting their assistance in adding the newly designed
White Eagle onto the Polish Flag.
I am overwhelmed and encouraged by the letters I received from
the President and the Senate advising me that my idea and my new
Polish Eagle has been referred to a
Committee for consideration. This
is a huge step!

interest groups who believe they
have a better idea for us. Nothing
could be further from the Truth!
It is so very difficult to explain to
the trusting American public, what
is at stake with the jockeying of certain individual agendas, to take over
world power, because they cannot
believe or conceive of such criminal
activities going on behind their
backs. A serious mistake!
Currently, we have covert and
subliminal religious, political, economic and ideological wars being
waged in this effort to control society under one way of life. We can
stem the growth of these agendas,
but we must arm ourselves with
knowledge and preventive legal
action in the Courts, independent of
governmental bodies.
With the advent of the Internet, so
much information is readily obtainable to us, just by digging in.
Is too much to ask for 30 minutes
a week, to educate and inform ourselves about what the hell is going
on in our lives and how we are being
sacrificed ???
Is it then reasonable to expend 4
or 5 hours of discretionary time,
watching football and the like,
which is diversionary and beneficial
for those pulling the strings, that
effect our way of life, today and
tomorrow???
The total disposal of the
American Citizen(s) right(s) to
Privacy is blatantly evident in the
creation of the Patriot Act (a totally
inaccurate title for that Law), in
addition to the allowance of accruing credit and medical records without our knowledge, and most recently the new revelations of governmental eavesdropping and recording
our personal communications and
the monitoring of our private personal devices.

CHICAGO – Illinois Comptroller Judy Baar Topinka met with Polvision’s

Massachusetts Companies To Participate
In Polish Trade Mission To Develop Medical Travel
Brookline, Massachusetts – Ms.
Elizabeth Ziemba, President of
Medical Tourism Training Inc., and
Mr. Irving Stackpole, President of

Investment Agency. Also attending
the trade mission are representatives from several health care
providers including the American
Heart of Poland, Carolina Medical
Center, Medical Park Riverside
Spa, Ustron and the Wieliczka Salt
Mine Health Resort. Equilibrium,
a health travel provider, will also
attend as it coordinates medical and
travel services for clients going to
Poland.
Registration for the meeting is
free to medical tourism specialists,
medical travel facilitators, and
insurance companies interested in
learning more about the health and
wellness services available in

American travel agents, businesses,
and health care providers to gather

Beyond Wills: Other Essential Elements of an Estate Plan

Although writing a will is an important first step, there are other elements and factors to consider when formulating an estate plan, including advanced directives and the roles and responsibilities of individuals
charged with managing the disposition of an estate. Creating an estate
plan requires taking inventory of all your assets and debts including a
review of all beneficiary designations how your assets are titled.
Estate planning can be a complex and emotional process. Ensuring that
your family is secure and that the disposition of your will is carried out
according to your wishes are key planning considerations for any individual. In addition, you should consider what would happen if you were to
become incapacitated and unable to oversee your own financial and/or
medical affairs. In both of these cases, you can name trusted individuals (or
entities) to step in and represent your best interests and carry out your
express wishes.
Executors
Executors play a critical role in executing your estate plan. The first and
most important role of an executor is ushering a will through probate. Until
this occurs, the estate cannot be settled and the assets are frozen. The Court
first admits the will to probate and appoints the executor, who is responsible for gathering, inventorying and protecting estate assets, paying bills and
taxes. The executor then distributes the estate assets to your named beneficiaries in accordance with the terms of your will.
Executors pay all outstanding bills due at death, as well as expenses
incurred after death. The executor is also responsible for the preparation,
filing and payment of tax due on the decedent’s final income tax returns and
the Federal and State estate tax returns (including fiduciary income tax)
The executor may need to raise cash by selling assets. The executor must
maintain records of every transaction that takes place in the accounts of the
estate. Finally, the executor must see to it that estate property is distributed
according to the specific terms of the will. If, instead of outright distributions, the will calls for one or more trusts to be set up, the executor distributes the appropriate portion of the estate to the trustee.
Trustees
If you have created trusts as part of your estate plan, you will need a one
or more trustees to manage the trust assets. One of the trustee’s first responsibilities is collecting estate assets earmarked for the trust. Another is ensuring the safekeeping of trust assets. and the purpose you were born to fulfill in this lifetime. Be content in just
knowing that you are not alone in your purpose in life.

the needs and (sometimes conflicting) interests of beneficiaries — both current and future. Traditionally, trust investments were expected to generate
income for beneficiaries who were entitled to distributions of net income,
while the trust retained and reinvested principal. In some cases, the trustee
may have the authority to make distributions of principal to beneficiaries.
Today, most states have adopted rules1 which essentially permit the trustee
to utilize modern portfolio concepts and manage the trust assets for total
return. The trustee may then elect to make current distributions to the beneficiaries which permits them to participate in the overall total return while
the balance of the principal continues to grow.2
The trustee is responsible for the payment of taxes owed on any undistributed trust income and/or capital gains realized by the trust. These are reported on the trust’s fiduciary income tax returns. The trustee also informs trust
beneficiaries of the amounts they must report on their personal tax returns.
In short, the trustee serves as chief administrator — documenting every
transaction that takes place in the trust accounts. Prior to final settlement,
the trustee must demonstrate to the satisfaction of the remaining beneficiaries that all assets and income have been properly administered and distributed.
While you may choose a family member or friend to serve as your trustee,
given the significance of the trustee’s fiduciary responsibilities, an independent professional is often the wiser choice. A corporate trustee can navigate complexities of trust management and estate settlement, bringing technical knowledge, tax planning expertise and continuity of service across
generations.
Advance Directives — Naming Alternate Decision Makers
While the roles of executor and trustee come into play after your death,
who would act on your behalf to manage your finances and/or make
arrangements for your medical care if you were unable to manage your
affairs on your own? In these cases, legal arrangements, called advance
directives, allow individuals to name alternative decision makers to speak
and act on their behalf.
Among the advance directives you may want to consider are:
• Durable Power of Attorney — A power of attorney agreement gives
another person legal authority to act on your behalf. The typical power of
attorney takes effect when it is implemented; however, many states permit a
“conditional” power of attorney that goes into effect only when a specified
event occurs, such as incapacitation. The power-of-attorney agreement ends
at your death, which means this individual or entity can no longer handle
your affairs when you die unless you also name them as your executor.
• Durable Power of Attorney for Health Care — A power of attorney
for health care is a legal document that gives another person permission to
make medical decisions for you if you are unable to make those decisions
yourself. The person you name to represent you may be called an agent,
attorney-in-fact, health care proxy, patient advocate or something similar,
depending on where you live.
• Living Will/Health Care Directive — This document authorizes your
wishes concerning life support in the event of a terminal medical condition.
Health care directives vary from state to state; check to find out the type of
directive your state allows.
Developing a personalized estate plan requires a structured approach that
is consistent with your overall financial goals. Working with your attorney
and other key advisors, I can work with you and your legal and tax advisors
to help you create an estate plan that meets your needs.

through two free special forums of
the documentary “Storming for
the Vote” sponsored by the League
of Women Voters of New Jersey.
The forums will be held from 5
to 6 p.m. and 7 to 8 p.m. on October
29 in Mancini Hall at the Ocean
County Library’s Main Branch, 101
Washington St.
One week after Superstorm
Sandy stuck the coastline on Oct.
29, 2012, leaving in its wake
unprecedented damage and devastation in Ocean County, County
election officials were faced with
the challenge of conducting a
Presidential Election. That challenge included overcoming limited
electrical power, voting districts
virtually washed away, and thousands of citizens displaced and
homeless.
Despite this, the democratic
process carried on and with the help
of County workers, volunteers, the
Ocean County Library System and
a host of advocates, organizations
and the individual voters, polls
opened, ballots were cast and the
results declared.
These collective efforts have
been captured in a powerful documentary called “Storming for the
Vote” which chronicles the actions
taken so that everyone who wanted
to vote had the ability to do so in the
aftermath of Superstorm Sandy.
“The League of Women Voters
did an exceptional job producing a
documentary that captured the emotional and devastating impact that
Sandy had on our county as well as
showcasing the great spirit of our
residents to cast their votes despite
the obstacles faced after the storm,”
Ocean County Clerk Scott
Colabella said.
According to Colabella, 253,333
people cast ballots out of 383,260
registered voters or a 66 percent
turnout during the 2012 General
Election.
“This was a remarkable turnout
considering the circumstances,”
Colabella said. “This was an unforgettable time in the history of
Ocean County and our state.”
The public is invited to attend the
forums and hear from a panel of
election officials as they discuss the
effects of the storm on the election.
“The library was scheduled to be
closed last year on Election Day but
we stayed open instead to meet the
information needs of our residents
following the storm, including
where to find information about
polling places and providing access
to library computers and fax
machines for people who wanted to
vote electronically,” Ocean County
Library Director Susan Quinn said.

The sound of the Chicken Dance is ringing in my ears
as Oktoberfest season gets into full swing. The church
hall at St. Rose’s in Roseville was all decked out for Oktoberfest on October
5 with Polka Power on stage providing the music. I love these events
because families turn out in force with all ages represented from infants to
seniors. We loaded our plates up with tasty Oktoberfest buffet of wurst,
sauerkraut, German potato salad, and bread. And we quaffed our thirst with
an excellent Paulaner beer.
After we filled our stomachs, Stefan Kochishan, clarinetist and emcee,
made everyone rise and perform a unique Oktoberfest calisthenic, bending
forward, backward, and sideward in time to the musical metronome. This
was enough to get everyone warmed up for dancing. Polka Power played
polkas, waltzes, foxtrots, swings, and rumbas for an appreciative crowd that
filled the floor. The Sacramento PolkaBoosters occupied four tables and
spilled out on the floor for the polkas and waltzes. The non-polka folk loved
the rumbas and swings. Polka Power liberally sprinkled in several Chicken
Dances, which brought everyone on the floor. So there was a little something for everyone.

After many years of dedicated
service to the International Polka
Association,

Ulczycki
announced his desire to conclude
his tenure as IPA President at a
recent Board of Directors meeting.
Dave was elected President in 2006
and presided over many organizational improvements and successful
events. He also served as an Illinois
Director and 1st Vice President as
he selflessly gave his time and
efforts for the promotion of polka
music.
Dave was also very instrumental
in fostering improved relations and
cooperation between the IPA and
fellow polka organizations such as
the United States Polka Association
and
the
Cleveland
Polka
Association.
In keeping with IPA by-laws, to
the fill the vacancy, 1st Vice
President Rick Rzeszutko has
assumed the role of acting President
and will continue in that capacity
until the next IPA Festival planned
for August 31, 2014. At that meeting, elections will be conducted to
determine the new President and
other IPA positions open at the time.

passed away Friday October 4,
2013 at Southern Ocean Center,
Manahawkin. Born in Kearny he
has resided in Sayreville most of
his life. Before his retirement 6
years ago he was employed as field
manager for North East Foods in
Edison for 23 years and prior to
that he was employed by Saint
James Catholic School in
Woodbridge as a teacher for 10
years. Mr. Zonkowski was a communicant of Saint Stanislaus
Kostka R. C. Church in Sayreville
and was a member of Sayreville
Knights of Columbus Council

I’m not talking about privatizing the parks, a suggestion others have
raised. Here’s a crucial fact about privatization that most people don’t
understand: privatization frequently involves not ownership but operation.
It’s often wiser to privatize not ownership but operation. (Roads are an
example. Let the government own the roads, but their maintenance can be
contracted.) That’s particularly true when government employees operating
a service become unionized, entrenched, and over-extended. And that’s precisely what we should now consider with the National Park Service.
The beauty of privatizing management rather than ownership is that
ownership is permanent but management is not. This means that if a management group doesn’t perform to expectations, another can be hired. The
hiring process should be regularly competitively contracted. This “competitive bidding” process keeps current management on its toes and accountable. If it performs badly, it can be replaced—unlike the government
employees running the National Park Service, which is a protected class
with a monopoly on its service.
Let’s privatize the National Park Service.
This recommendation will anger NPS employees. But the fault resides
with them, their actions, and their willingness to be manipulated. They’ve
demonstrated the roguish tendencies of some federal employees who blindly follow orders. They embody the dangers of big, unaccountable government. Let’s respond by taking power from those employees, so this cannot
happen again.
