Meeting the Needs of Our Growing State

Arizona is growing, developing and
changing at such a rapid pace it would be
hard to imagine if we weren’t experiencing it. Since 1990, our population has
grown by 65 percent—and it’s expected
to nearly double again in just over 20
years. As the fastest growing state in the
nation, our growth affects almost every-

one fundamental concern in common: each of us needs an affordable,
safe place to live. In this booming,
ever-growing state, however, an
affordable, safe place to call home is
becoming harder and harder to find.
Leading with solutions, the
Arizona Department of Housing
and the Arizona Housing Finance
Authority exist to provide housing
and community revitalization to
benefit the people of Arizona. We
do that in a variety of different ways
using a number of different tools –
and always in close creative collaboration with our partners throughout
the multifaceted housing industry.

thing around us: water, schools, transportation, public safety, air quality, housing and tourism.
As I’ve traveled across Arizona, I have
heard from thousands of you expressing
the same message—the way we grow has
to change. You live, work and educate
your children in communities that are
growing so rapidly that they often do not
have the necessary infrastructure to create the quality of life that you demand
and that you expected when you made
Arizona your home.
It is both our challenge and our
responsibility to build the infrastructure
to meet the needs of our growing state
and plan for the future. Over the next
several months, I would like to share
with you what we’ve done and where
we’re going.
Let’s start by talking about transportation, and an issue I refer to as the "time
tax." It’s the price we pay every time we
sit, stuck in traffic that should be moving, and it cuts into what we value most:
our time with our families and our
friends—time spent at home and in our
communities.
Over the past four years, we’ve started
chipping away at the time tax. We added
more than 500 additional lane miles of
freeway throughout Arizona, worked
closely with local communities on road
improvements, and directed millions of
dollars to improve road safety and
increase capacity. In the East Valley, we
opened the Santan Freeway and the final
segments of Loop 202 Red Mountain
Freeway and the US 60 widening in
Mesa are near completion.
We helped create and pass a multimodal transportation plan that expands
regional bus transit, constructs light rail
and widens highways and regional roadways throughout the Valley over the
next 20 years. And last year, we directed
an additional $307 million toward accelerating highway construction. With
these new monies we’ve been able to, for
example, speed up work on new lanes for
I-17 north of Phoenix and on I-10 in
Pima and Pinal counties.
By changing the way we finance the
terms of existing bonds—as many states
already have done—we can raise money
this year for critical transportation proj-
ects and do even more. By simply
extending the terms from 20 to 30 years,
we will free up more than $400 million
above our current budget to relieve traffic congestion, so Arizonans can spend
more time with their families and less
time in traffic. I called on the Legislature
earlier this year to support this idea and
cut the time tax, and I ask you to contact
your legislators with the same message.
We’re also looking ahead, being
smarter about how we grow. Our State
Land Department and the Department of
Transportation have mapped out the new
freeway corridors necessary in a fully
built-out northern Pinal County community. In other words, as northern Pinal
County continues to grow, the local and
county elected officials, community
members and state agencies are already
coordinating efforts to fund the infrastructure necessary to sustain this area’s
quality of life.
As Arizona continues to flourish, we
will continue to meet the needs of our
growing state by coordinating transportation planning and water management,

our membership base. It is this
expanded reach in particular that led
the AMA Board of Directors to make
this change.

Preventive Maintenance and Repair

Routine apartment property operation and maintenance involves
use of, and exposure to, hazardous chemicals and products such
as chlorine, paints, solvents gasoline, pesticides, weed killers and

Preventive maintenance can help properties save time and money
by keeping washers, dryers and microwaves in top running order
and extending their life. At this hands-on seminar, your service
technicians will learn how to perform basic maintenance and repair

The Sky is Falling. . . Oh, My!
more renters applying for a wonderful place to
live. And this brings up the question, "If your
applicant has just lost their home, is his or her
a good rental candidate?"
In the event the recent news of foreclosures
isn’t an issue on your criteria, proceed with
caution. Hopefully, the rent is quite a bit lower
than the previous payment and employment is
easy to verify. All is not grim; you may have a
loyal, long-lasting prospect.
So there are more foreclosures than a few
years ago when the market was heating up to
the summer of 2005, when a house was on the
market for possibly a few hours. Real estate is a

long-term investment. Location is still a key
factor. What may seem like a great deal on
paper may turn into your nightmare. I purchased such a house once. . . or twice. One
home I was having fixed-up was tagged the first
night it had been painted! Every external wall
had been hit. My plans of keeping this home
long-term changed that morning.
In my opinion, it’s a great time to invest in
real estate. Our market hasn’t seen the bubble
that was promised, nor is the population
declining. Of course, the percentage of rent-tocost of investment has changed in the past 10
years; looking forward to the next 10 years
with the cost of building materials and land,
I’m banking it’ll continue to change. Invest
wisely, check out the location and carefully
evaluate your potential resident. In the event
you have a loan on your investment, don’t
overextend to the point you can’t carry the
property while looking for a qualified renter.
The amount you need to cover your expenses
is not a factor when calculating market rent.

Review List of Provisional AMA Members
Editor’s note: All applicants who are applying to be Regular or
Associate members of the Arizona Multihousing Association must
complete the application and pay applicable dues. The applicant
shall agree to abide by the provisions of the Articles of Incorporation, the Bylaws of the association, and by the Code of Conduct
prescribed by the association.
The applicant will then be classified as a Provisional member.
During this period, the Provisional member will have the rights
and responsibilities of full membership.
Within 60 days of applying for membership, the names of the
Provisional members will be published in Apartment News, and
existing members will be encouraged to provide comments on the
suitability of the application.
If no negative comments are received from existing members
within 90 days of membership application, the Provisional member will be deemed automatically approved into membership.
If any negative comments are received, the Ethics Review
Board must review the application within 120 days from the
receipt of the negative comment and recommend to the Board of
Directors the acceptance or rejection of the application. If the
Ethics Review Board does not recommend acceptance of a Provisional member, the Provisional member must be notified and
given the opportunity to request a hearing pursuant to the Bylaws.
If the directors reject an applicant, the AMA refunds all membership fees paid except for a $35 application-processing charge.

any or all applicants seeking AMA Regular or Associate member

Beware Of Puncture Wounds

It's important to protect your
hands and feet from the possibility of
a puncture wound from a sharp
object. Sharp objects such as nails
and staples can cause serious injury if
stepped on. There are two things you
should know about puncture wounds:
how to prevent them and what to do
if you get one.
PUNCTURE WOUND
PREVENTION
Remove nails from wood immediately when dismantling braces,
guards, rails, forms and other items.
Carefully move scrap lumber that
may contain nails to a scrapheap
away from pathways in your work
area.
Watch out for nails on the ground.
They often land point up in mud,
weeds, debris or on bare ground if
they have wide heads.
Keep your work area clear of dust
and other things that might hide
nails, so you can spot them more easily.
Be especially careful around areas
at the base of ladders or other places
where you or others might step backward.
Be extra careful using power tools
that drive nails, staples or punches.
Follow recommended precautions
when using them. Wear appropriate
footwear with sturdy soles.
PUNCTURE WOUND
TREATMENT
Always treat a puncture wound
with special care, even it doesn't
seem to hurt very much.
The point of a sharp object carries
bacteria deep into your flesh where
antiseptics can't reach.
The surface wound may heal while
an infection is developing underneath
the skin.
Clean the wound with soap and
water, report it and keep an eye on it.
If the wound doesn't seem to be healing or if there's reddening, welling or
increased pain, you may be developing an infection and you must see a
doctor.
If you work around sharp objects,
have a tetanus booster shot every five
to 10 years to prevent serious complications from puncture.

landlord. However, a new Arizona Appellate Court ruling may, in some instances,
allow management to charge extra rent.
The Arizona Residential Landlord and
Tenant Act, under 33-1373, does allow a
landlord to charge rent until the lease
expires or he or she re-rents the unit
when the resident breaches the lease.
Additionally, if a renter on a monthto-month rental agreement does not give
a 30-day notice under 33-1375, management can charge the individual up to an
extra month's rent.
What happens when an individual
pays all the rent due under the lease and
moves, but leaves the apartment damaged
or so dirty that the landlord cannot rerent it until cleaned? The Arizona Court
of Appeals in SDR Associates v. ARG
Enterprises, Inc. decided that a resident
would be responsible for lost rental
income.
The court stated that a renter's failure
to return the property to its original conditions, as required by the lease, entitled
the landlord to recover lost rent during
the time necessary to restore the premises.
In the aforementioned case, it took the
landlord two months to make repairs.
During that period, the owner was unable
to lease the apartment unit.
Keep in mind the law requires a resident to return the premises in the same
condition as move-in, normal wear and
tear accepted. There is, however, no exact
formula used by the courts to determine
normal wear and tear.
Some factors are the condition at
move-in and the length of time the resident occupied the unit. Obviously, a person who lived in a rental for four years
would have more wear and tear that a person with a six-month occupancy in a new
apartment.

clean up after each meal.
At the end of six months, George
Cantcook gives proper notice and moves.
However, Hungry Arms Villa has to
replace the food-stained carpet, repaint
the walls and fumigate the unit. Hungry
Arms' manager, Ray Chill Rayjun, hires
Peachy Keehns Cleaning Service, which
takes one month to restore the unit to
rent-ready condition.

While the issue of renting to illegal aliens has
generated a lot of controversy around the country, a landlord has never been found in violation
of any law for renting to an illegal alien in Arizona. This does not mean to suggest that management should or should not rent to these
individuals.
Recently, certain municipalities around the
country have adopted ordinances that would, in
fact, prohibit a landlord from renting to an illegal alien (and businesses from hiring the same).
All of these ordinances are facing court challenges, and it could be years before the legality of
such measures is settled. To this author's knowledge, no Arizona municipality has yet adopted
such an ordinance.
Philosophical issues aside, the AMA and
most industry professionals believe landlords do
not have the resources or expertise to determine
whether or not immigration documents are genuine and should not be burdened with a strict
liability for proving they are. However, it is welladvised for landlords to maintain a strict rental
qualification policy that imposes on the applicant the burden to establish to them that he or
she has the qualifications to rent the apartment.
In most instances, management cannot generate a credit report without a Social Security
number; therefore, it will be unable to assess the
creditworthiness of the applicant. If the applicant cannot provide the Social Security number,
the inquiry may stop right there. However, there
will be instances when the applicant can establish his or her creditworthiness without providing a Social Security number. The landlord
should be receptive to some other manner by
which applicants can establish that they are
qualified to rent the unit.
Assuming the applicant has the qualifications from a credit standpoint, a question as to
the “legal” presence of the applicant in the
United States may present itself. While it is
difficult to imagine that this would be on the
list of qualifying factors, the individual may
show the landlord a green card or a B1/B2 visa.

If the applicant meets the qualification standards, it is not recommended that the landlord
attempt to determine whether or not the applicant can be in the United States legally. This

practical resource to make this determination,
nor is it legally required. The focus should
remain on the applicant meeting the qualification standards and nothing more. This is further
advisable given the potential fair housing issues

GREEN CARDS, B1/B2 VISA
The green card authorizes a person to work
in the United States for a relatively long period
of time. A B1/B2 visa authorizes a person to
live and work in the United States, but is generally set up for a shorter term-stay. It also is

Reasonable Accommodations Under The Fair Housing Act:
How Far Does It Go?

April 11 marks the 39th anniversary of
the enactment of the federal Fair Housing
Act. The Act has gone through some significant changes and has been the subject of
important litigation to interpret and enforce
the spirit and letter of the law.
In 1988, amendments to the Act added
handicap and familial status as protected
classes. The Act defines “handicap” as:
The law requires a landlord to make reason able accommodations in rules, practices
and policies when necessary to afford such a
person equal opportunity to use and enjoy a
dwelling. Failure to do so constitutes discrimination. The question landlords may
have is, “What is a reasonable accommodation and how far does it go?”
Assume that a renter has a handicap and
receives his social security income between
the 10th and 14th of each month. Rent is
due on the first day of each month under
the terms of his written rental agreement.
As a result, the resident wants to pay his
rent late and contends that he should be
not be subject to the late-charge provision
of the lease, since this qualifies as a reasonable accommodation. He argues that this is
a reasonable accommodation in the rules,
practices and policies of the landlord to
allow him equal opportunity to use and
enjoy the dwelling.
1.
Any physical or mental impairment that substantially limits on or more of
a person's major life activities.
2.
A record of having such an
impairment; or
3.
Being regarded as having such an
impairment.

The landlord does not agree. The issue
is then whether the Fair Housing Act mandates acceptance of the late rent without
late fees agreed to in the contract.
Traditionally, reasonable accommodations have included things such as allowing
an assistive animal in a community with a
no pet policy; allowing a resident who uses a
wheelchair to widen a doorway or make
other physical modifications to the apartment; or to provide a parking space closer to
the renter's apartment. All of these accommodations allow the individual to enjoy the
dwelling.
Reasonable accommodations have typically not included financial benefits
afforded to the handicapped person that
management does not afford to other residents. For example, all renters, whether
handicapped or not, must financially qualify
for approval of residency. Additionally, the
lease requires a handicapped person to
maintain the rental property in a reasonable
manner to the same extent as a non-handicapped person, and all renters must act in a
way that will not create a health or safety
hazard to other residents.
In addressing the issue of whether a
handicapped resident is immune from late
charges as a reasonable accommodation
because he does not receive his Social Security check in time to pay the rent in a
timely manner, the answer is most likely no.
Anyone's ability to enjoy the use of the
premises is contingent upon the compliance
with his or her financial obligations under
the terms of the lease. The argument that a
handicapped resident should receive a
financial benefit because of a disability is
simply not the intent of the law. If that was
the case, one could then argue that since a
disabled person does not receive sufficient
income to pay the rent, a landlord should
charge him or her less than another resident
with a similar apartment so the disabled person can have an equal opportunity to use
and enjoy a dwelling.
Lastly, the reasonable accommodation
must be related to the disability. In the
question raised above, failure to pay rent on
time is not related to the disability, but to
the timing of the receipt of the disabled person's income or the budgeting of the individual. It is not the disability that causes
the delivery of the payment on any particular date, but the government agency that
chooses when to send it.
Issues of reasonable accommodations are
complex, and management should carefully
consider them with the advice of an attorney. Compliance with the Fair Housing
Act is the goal, and regardless of the
request, you must examine the situation
before allowing or disallowing a requested
accommodation. It is wise to consult with
your attorney even for issues that appear to
be simple. AMA

NAA Offers 50 Education Sessions Geared
Toward Career Tracks

As the largest conference and trade show
in the industry, the 2007 National Apartment
Association (NAA) Education Conference &
Exposition boasts more than 50 education sessions with tracks designed for CEOs, managers, on-site staff, independent rental owners
and more.
The event offers something for everyone,
including the industry’s largest trade show, and
provides a great opportunity for members and
member companies to invest in themselves
and in their careers.
The conference is June 28-30 at the Mandalay Bay Resort and Casino in Las Vegas.
Keynote speakers include Super Bowl most
valuable player Peyton Manning and his
father, Archie Manning; one of the world’s
foremost authorities in consumer trends marketing, J. Walker Smith; and Wall Street broker Chris Gardner, whose life story recently
was portrayed in a Hollywood movie.
Manning quarterbacks the reigning world
champion Indianapolis Colts. Archie was a
two-time NFL MVP as quarterback for the
New Orleans Saints during the 1970s. The
two will speak about leadership and teamwork
at the Opening General Session on Thursday,
June 28.
Smith is President of Yankelovich, Inc., a
marketing consultancy specializing in consumer lifestyle trends and database targeting
solutions. Described by Fortune magazine as
"one of America’s leading analysts of consumer trends," he is co-author of three critically acclaimed books and a weekly
commentator on public radio. His ideas and
insights appear regularly in the national media
and business press.
Gardner, in a session sponsored by the
NAA Education Institute, will speak Saturday, June 30, sharing his inspiring rags-toriches story about overcoming a broken home
to become a high-powered Wall Street broker.
Gardner’s life story recently was depicted in
the movie "The Pursuit of Happyness," starring Will Smith.

NAAEI CONTINUES TO PROMOTE
APARTMENT CAREERS
To help further promote the apartment
industry as a viable career choice, the NAA
Education Institute recently hosted a meetand-greet reception attended by more than 40
workforce investment boards.
These boards are responsible for identifying career opportunities for the more than 12
million Americans seeking employment
through the public employment system.
The reception was held in conjunction
with the National Workforce Boards conference in late February in Washington, D.C.,
attended by more than 2,000 employment
professionals.
NAAEI’s attendance at the event was the
latest of many efforts to carry out the NAA
and NAAEI board’s vision of promoting the
apartment industry as viable career choice.
Workforce boards are created as a one-stop
place for people to learn how to develop spe-
cific career tracks.
Workforce boards are business-led community boards across the country to help ensure
that all Americans have access to the information, job-search assistance and training
they need to qualify for good jobs and to successfully manage their careers.

NAAEI DESIGNATIONS TO RECEIVE
CURRICULUM ENHANCEMENTS
The NAA Education Institute (NAAEI)
held NAA member-input discussions in
March at the Capitol Conference on how to
enhance content for NAAEI’s designation
programs Certified Apartment Property
Supervisor (CAPS) and the Certified Apartment Maintenance Technician (CAMT).
The enhanced curriculum for these designations will be available in 2008.

AMA Legislative Update
and continue with five provisions we felt were
less controversial and several that were necessary. The five remaining provisions include:

We’re a little more than half-way through
the 2007 legislative session, which has seen
many bills introduced that have a direct
impact on our industry.
AMA-INTRODUCED LEGISLATION
The following is an update of legislation
introduced by the AMA for the 2007 legislative session:
SB1255 – Landlord-Tenant Act Amendment. As is always the case with bills amending the Arizona Residential Landlord and
Tenant Act, this one is controversial, to say
the least. When we open landlord-tenant law,
there is always the assumption on the part of
many legislators that we are attempting to take
away renter rights.
This year, the bill as introduced had a number of provisions that assisted landlords, all of
which you can currently do as long as you
include it in the lease agreement, such as:
requiring residents to show proof they have
purchased rental insurance; allowing for early
lease termination fees; and requiring the renter
to supply a contact name to handle personal
possession should he or she die during the term
of the lease. The bill also clarified existing provisions for both landlord and renter.
The first Senate Commerce Committee
hearing was controversial, with many committee members raising concerns about several
provisions, such as the one that would allow
management to require rental insurance for its
residents. Following the hearing, the AMA
decided to remove many of these provisions
(1) 33-1314. Section F allows a landlord to
request a renter to name a person in his or her
lease who is responsible for the renter’s personal possessions should the individual die or
become disabled.
(2) 33-1321. During the term of the tenancy, the landlord may use the refundable
security deposit in accordance with any applicable property management agreement.
(3)33-1324. Section A 2 requires the landlord to keep the property in a fit and habitable
condition as prescribed by the local building
code. This provision continues to be controversial and most likely will face further amendment.
(4) 33-1341. It requires a resident to notify
a landlord of maintenance issues in need of
repair.
(5) 33-1343. It states that once a resident
notifies a landlord of a maintenance request, it
constitutes permission to enter the unit with
two-day’s notice.
The Morris Institute and Chris Derose, the
attorney/lobbyist representing tenant advocate
Ken Volk, still opposes the provision that
defines fit and habitable. Many neighboring
states have landlord-tenant acts that define a
"habitable" property, thus not leaving it to
interpretation by the renter, the landlord or
the courts.
The bill cleared the Senate with a vote of
22 yes and five no votes, and scheduled for a
House Commerce Committee hearing on
March 21. Thank you to the AMA members
that sent e-mails to their senators requesting
support of the bill.
HB2361 – Landlord-Tenant Forcible
Detainer Actions. This bill is a joint effort by
the AMA and the Manufactured Housing
Communities Association to address concerns
raised in a 2005 unscientific study conducted
by the Morris Institute titled, "Eviction in No
Time." This bill has also had its fare share of
controversy and has been amended at least 12
times over the last month. The bill is still in
the House awaiting a floor vote. The Morris
Institute is adamantly opposed.
AMA -MONITORED LEGISLATION
In addition to sponsored legislation, the
association is also monitoring numerous proposed bills:
SB1227 – Domestic Violence Early Lease
Termination. The AMA began working with
the Arizona Coalition to End Domestic Violence in APRIL 2007 in hopes of crafting consensus legislation. After meeting on a regular
basis and reaching agreement on virtually all
the provisions with the exception of two, the
bill sponsor ultimately introduced the bill
without the two provisions we felt were necessary.
When Senate Pres. Tim Bee, R-Tucson,
joined Sen. Jim Waring, R-Phoenix, as the bill
sponsor, the AMA voiced its concerns. Bee
agreed the concerns were reasonable and we
should have the opportunity to address them.
The bill then cleared committee with an
amendment that removed a number of provisions previously agreed to, thus creating a further divide. Bee, however, again assured us
there would be an opportunity to address our
concerns.
Shortly thereafter, all stakeholders met with
him and, after a two-hour-plus meeting with
staff, we were able to restore our provisions to
the bill to protect landlords.
HB2252 – State Plumbing Code; Municipalities. The AMA has opposed the dysfunctional state plumbing code virtually since its
inception in 1997. It appears the House will
repeal the code and the Arizona Uniform
Plumbing Code Commission, thereby permitting municipalities to adopt local plumbing
codes.
HB2406 – Contractor Retention. This
bill, similar to ones proposed in previous years,
attempts to eliminate contractor retention by
reducing the amount a general contractor can
retain from a subcontractor from 10 percent to
5 percent and requiring a general contractor to
set-up an interest-bearing account for each
subcontractor. Many construction industry
groups oppose this bill, and we are working to
amend the bill to address all concerns. There
does not appear to be much middle ground on
the issue.
HB2607 – Contractor Indemnity. The bill
would change provisions in construction contracts and shift liability for construction defect
entirely to the owner and general contractor.
Like the aforementioned contractor retention
proposal, we’ve seen this bill introduced at
least every year for the past 7-8 years. This
year’s version, however, did clear the House.
The same parties opposed to HB2406 are
working to amend or defeat this bill in the
Senate.
SB1805 – Constable Ethics Standards and
Training. We amended this bill in House
Commerce Committee to address concerns
from AMA members regarding the increase in
mileage charges from the constables to deliver
writs and special detainers. This is an unintended consequence of the co-location of judicial courts. If passed, the bill would require
Maricopa County Justice of the Peace courts to
assess mileage fees once the constable enters
the precinct, as opposed to the mileage
assessed from the actual courthouse.
SB1423 – Municipal Impact Fees. We
have been working with many stakeholders,
including municipalities, homebuilders, the
National Association of Industrial and Office
Properties and Valley Partnership, to develop
consensus legislation to reform the existing
ambiguous state statues that allow a municipality to impose development impact fees.
SB1047 – Private Investigator Licensing.
As drafted, this bill would have required a
property management firm conducting background checks on behalf of an owner and all
credit back ground companies, to become
licensed private investigators. We were able to
work with the bill sponsor and the Arizona
Department of Public Safety to amend the bill
to our satisfaction.

that’s affordable, we are very fortunate to have a governor who recognizes that an economically diverse
housing stock is extremely important
to future economic growth and that
planning for that growth is key to the
preservation of our unique way of life
here in Arizona. That’s why, moving
forward into the new year, Gov. Janet
Napolitano has put in motion the
implementation of many of the recommendations put forth by the
Arizona Incentives for Affordable
Housing Task Force in its June 2006
Final Report.
Having been directed by the governor to bring together a group of stakeholders for the purpose of identifying
ways of creating housing opportunities that are relatively affordable and
that allow for flexibility and adaptation to local market conditions, the
Arizona Department of Housing and
the Arizona Housing Commission
first convened the Arizona Incentives
for Affordable Housing Task Force on
Jan. 19, 2006.
To generate the best and most
comprehensive solutions possible, the
Task Force was comprised of professionals from the private, public and
non-profit sectors, including both
housing industry and economic development representatives. Arizona
Multihousing Association President
Terry Feinberg was, in fact, one of the
distinguished members of the Task
Force. It was particularly gratifying to
have his participation, as the AMA is
one of the largest and strongest rental
housing associations in the country
and a strong and credible voice for
multi-housing interests in the state.
Task Force members identified the
following as major areas of concern
vis-à-vis affordable housing production and preservation in Arizona:
Barriers and incentives
Lack of adequate financing
Lack of adequate land
In-depth discussions resulted in
ideas and strategies that the Task
Force vetted at length. Only those
ideas that could be agreed to by all of
the stakeholders represented were
given final consideration. Ultimately,
19 short- and long-term recommendations were presented to the governor,
and I’m happy to report to you that
we’ve seen substantial movement forward on a number of the most pressing issues.
BARRIERS AND INCENTIVES
The Task Force recommended to
the governor that strategies for
greater collaboration among state
agencies be identified, particularly
around land use and housing development.
By signing Executive Order 200705, the governor formally established
the Growth Cabinet and gave its
members until May 8, 2007 to develop and present to her a smart growth
and development process that can be
used by cities, towns and tribal communities in their efforts to coordinate
a host of complex growth processes.
As a member of the Growth
Cabinet, I can tell you that we are
working hard to meet the governor’s
deadline and to present to her a comprehensive, useful process that can be
adapted by communities across the
state for the purpose of coordinating
strategic growth.
LACK OF ADEQUATE
FINANCING
The Task Force recommended to
the Governor that she enhance the
ability to use both Greater Arizona
Development Authority (GADA)
and Water Infrastructure Finance
Authority (WIFA) financing on a
single project.
In January 2007, the Governor
signed Executive Order 2007-04
directing the Departments of
Environmental Quality and
Commerce to work together and with
GADA and WIFA to develop policies and procedures to provide joint
financing for up to 30 years for drinking water and wastewater infrastructure projects where appropriate and as
needed by Arizona communities.
In addition, there is a bill (House
Bill 2754) that would appropriate an
additional $5 million to the Greater
Arizona Development Authority
allowing them to leverage additional
bond financing.
Further, the Task Force recommended a standardization of the property tax valuation processes for housing developed through the Low
Income Housing Tax Credit (LIHTC)
program to ensure consistency
throughout the state.
There is a bill this legislative session (Senate Bill 1038) that would
establish a uniform property tax valuation process for housing developed
through the LIHTC program.

potentially increase the valuation of
a number of tax-credit properties. A
variety of parties are looking at alternate methods to solve this problem,
but this might be something that
needs additional time and attention
post-legislative session.
In an additional attempt to
address the lack of adequate financing for affordable housing developments, the Task Force recommended
investigating the use of interest
earned on earnest monies from the
resale of residential and commercial
real estate transactions to dedicate to
affordable housing.
House Bill 2733 would allow
banks to invest money deposited for
escrow accounts in a broader range of
investment products, which would,
conceptually, allow them to receive a
greater return on the investment. A
portion of the interest earned on
those accounts, after bank and title
company fees are deducted, would be
directed for affordable housing
(administered by the Arizona
Department of Housing) and legal
services (administered by the Arizona
Foundation for Legal Services).
LACK OF ADEQUATE LAND
Both the Governor’s Growth
Cabinet and Arizona Town Hall will
be looking at land use and land plan-
ning to help address concerns about
the lack of adequate land for affordable housing developments. As mentioned earlier, the Growth Cabinet
will be finalizing its recommendations and sending them to the governor on May 8. Arizona Town Hall
will be examining the issue at its Fall
2007 Town Hall at the Grand
Canyon Oct. 28 – Nov.1, 2007. For

Educating stakeholders and
communities remains a major priority.
To that end, the Task Force recommended that the Arizona
Department of Housing create and
maintain a clearinghouse for resource
material and model strategies relating
to housing affordability. As such, we
are currently in the process of creating the Center on Housing
Affordability & Livable
Communities. Our request for funding of the Center coordinator was
recently approved by the Senate side
of the Appropriations Subcommittee,
but not by the House side. We are
currently looking to see what we
might to do ensure funding as the
budget process continues.

AMA Legislative Update
and continue with five provisions we felt were
less controversial and several that were necessary. The five remaining provisions include:

We’re a little more than half-way through
the 2007 legislative session, which has seen
many bills introduced that have a direct
impact on our industry.
AMA-INTRODUCED LEGISLATION
The following is an update of legislation
introduced by the AMA for the 2007 legislative session:
SB1255 – Landlord-Tenant Act Amendment. As is always the case with bills amending the Arizona Residential Landlord and
Tenant Act, this one is controversial, to say
the least. When we open landlord-tenant law,
there is always the assumption on the part of
many legislators that we are attempting to take
away renter rights.
This year, the bill as introduced had a number of provisions that assisted landlords, all of
which you can currently do as long as you
include it in the lease agreement, such as:
requiring residents to show proof they have
purchased rental insurance; allowing for early
lease termination fees; and requiring the renter
to supply a contact name to handle personal
possession should he or she die during the term
of the lease. The bill also clarified existing provisions for both landlord and renter.
The first Senate Commerce Committee
hearing was controversial, with many committee members raising concerns about several
provisions, such as the one that would allow
management to require rental insurance for its
residents. Following the hearing, the AMA
decided to remove many of these provisions
(1) 33-1314. Section F allows a landlord to
request a renter to name a person in his or her
lease who is responsible for the renter’s personal possessions should the individual die or
become disabled.
(2) 33-1321. During the term of the tenancy, the landlord may use the refundable
security deposit in accordance with any applicable property management agreement.
(3)33-1324. Section A 2 requires the landlord to keep the property in a fit and habitable
condition as prescribed by the local building
code. This provision continues to be controversial and most likely will face further amendment.
(4) 33-1341. It requires a resident to notify
a landlord of maintenance issues in need of
repair.
(5) 33-1343. It states that once a resident
notifies a landlord of a maintenance request, it
constitutes permission to enter the unit with
two-day’s notice.
The Morris Institute and Chris Derose, the
attorney/lobbyist representing tenant advocate
Ken Volk, still opposes the provision that
defines fit and habitable. Many neighboring
states have landlord-tenant acts that define a
"habitable" property, thus not leaving it to
interpretation by the renter, the landlord or
the courts.
The bill cleared the Senate with a vote of
22 yes and five no votes, and scheduled for a
House Commerce Committee hearing on
March 21. Thank you to the AMA members
that sent e-mails to their senators requesting
support of the bill.
HB2361 – Landlord-Tenant Forcible
Detainer Actions. This bill is a joint effort by
the AMA and the Manufactured Housing
Communities Association to address concerns
raised in a 2005 unscientific study conducted
by the Morris Institute titled, "Eviction in No
Time." This bill has also had its fare share of
controversy and has been amended at least 12
times over the last month. The bill is still in
the House awaiting a floor vote. The Morris
Institute is adamantly opposed.
AMA -MONITORED LEGISLATION
In addition to sponsored legislation, the
association is also monitoring numerous proposed bills:
SB1227 – Domestic Violence Early Lease
Termination. The AMA began working with
the Arizona Coalition to End Domestic Violence in APRIL 2007 in hopes of crafting consensus legislation. After meeting on a regular
basis and reaching agreement on virtually all
the provisions with the exception of two, the
bill sponsor ultimately introduced the bill
without the two provisions we felt were necessary.
When Senate Pres. Tim Bee, R-Tucson,
joined Sen. Jim Waring, R-Phoenix, as the bill
sponsor, the AMA voiced its concerns. Bee
agreed the concerns were reasonable and we
should have the opportunity to address them.
The bill then cleared committee with an
amendment that removed a number of provisions previously agreed to, thus creating a further divide. Bee, however, again assured us
there would be an opportunity to address our
concerns.
Shortly thereafter, all stakeholders met with
him and, after a two-hour-plus meeting with
staff, we were able to restore our provisions to
the bill to protect landlords.
HB2252 – State Plumbing Code; Municipalities. The AMA has opposed the dysfunctional state plumbing code virtually since its
inception in 1997. It appears the House will
repeal the code and the Arizona Uniform
Plumbing Code Commission, thereby permitting municipalities to adopt local plumbing
codes.
HB2406 – Contractor Retention. This
bill, similar to ones proposed in previous years,
attempts to eliminate contractor retention by
reducing the amount a general contractor can
retain from a subcontractor from 10 percent to
5 percent and requiring a general contractor to
set-up an interest-bearing account for each
subcontractor. Many construction industry
groups oppose this bill, and we are working to
amend the bill to address all concerns. There
does not appear to be much middle ground on
the issue.
HB2607 – Contractor Indemnity. The bill
would change provisions in construction contracts and shift liability for construction defect
entirely to the owner and general contractor.
Like the aforementioned contractor retention
proposal, we’ve seen this bill introduced at
least every year for the past 7-8 years. This
year’s version, however, did clear the House.
The same parties opposed to HB2406 are
working to amend or defeat this bill in the
Senate.
SB1805 – Constable Ethics Standards and
Training. We amended this bill in House
Commerce Committee to address concerns
from AMA members regarding the increase in
mileage charges from the constables to deliver
writs and special detainers. This is an unintended consequence of the co-location of judicial courts. If passed, the bill would require
Maricopa County Justice of the Peace courts to
assess mileage fees once the constable enters
the precinct, as opposed to the mileage
assessed from the actual courthouse.
SB1423 – Municipal Impact Fees. We
have been working with many stakeholders,
including municipalities, homebuilders, the
National Association of Industrial and Office
Properties and Valley Partnership, to develop
consensus legislation to reform the existing
ambiguous state statues that allow a municipality to impose development impact fees.
SB1047 – Private Investigator Licensing.
As drafted, this bill would have required a
property management firm conducting background checks on behalf of an owner and all
credit back ground companies, to become
licensed private investigators. We were able to
work with the bill sponsor and the Arizona
Department of Public Safety to amend the bill
to our satisfaction.
