2006 Leadership Gets Installed and REALTOR® Recognition
Awards Presented at Annual Gala

On Thursday, November 17, 2005, the
Crest Hollow Country Club hosted the annual LIBOR/MLS Installation Gala and Dinner
Dance with Joseph Mottola, Chief Executive
Officer, assuming the role of Master of
Ceremonies over the event. This event
serves as the forum for announcing
Realtor® Recognition Award recipients such
as the prestigious REALTOR® of the Year
and REALTOR® Salesperson of the Year, as
well as providing the opportunity to install
newly elected LIBOR and MLS leadership.
The first award of the evening was the presentation of the prestigious Realtor Broker of
the Year award. Barbara Frechter, the 2004
recipient of this award, presented Ralph
Bove of Prudential Douglas Elliman noting,
“Ralph Bove may be very proud that he is the
2005 Realtor of the Year but frankly we are
very proud that Ralph Bove is one of us.”
Ralph Bove has been in the real estate
industry for over 26 years. He brings with him
a tremendous background stemming from his
original perspective as an agent, up to a
Corporate Officer of one of the largest firms in
the country. His experience with MLS,
LIBOR, NYSAR, and NAR reveals a broad
range of interests and contributions. Bove
served as the MLS President in 1994 and in
2000, he served as the President of LIBOR.
Seibert Robinson of RE/MAX Elite Realty in
Jamaica was named 2005 Realtor Salesperson
of the Year, but due to a previous commitment,
Robinson was unable to attend the Gala and was
presented with the award during the

at the Milleridge Inn. Bert has been in real estate
since 1988 and began serving the Board in a
leadership role in 2001. He was the recipient of
the LIBOR Distinguished Service Award for the
Jamaica Central Chapter in 2004.

scheduled to be discontinued on January
30, 2006. At that time, the link on Stratus‚
Info Center, My Email, will also be discontinued. (See a partial reprint of the article on page 16.)
MLS has received a number of requests
from agents wishing to continue using their
@mlslirealtor.com email address. To
enable this, MLS is in the process of negotiating a deal with Internet Crusade that will
allow individual Participants and Agents to
continue using their @mlslirealtor.com
email address for a small annual fee.
Agents wishing to continue using the
@mlslirealtor.com email address will
have the opportunity to subscribe to this
optional service directly from Internet
Crusade. At that time, Internet Crusade

Senator Balboni Signs onto Commission Escrow Act Bill
Only Five Holdouts from LIBOR’s Region Remain

New York State Senator Michael Balboni
(R-Garden City Park) recently became a
cosponsor of the Commission Escrow Act
bill. There are now only two members of the
New York State Senate and three Members
of the New York State Assembly who have
yet to sign on as cosponsors of the bill from
the LIBOR region. The legislation
(S.193/A.3395) will allow disputed real
estate commissions to be placed in an escrow
account until the matter can be resolved.
Recently the New York State Bar
Association (NYSBA) agreed to support our
residential-only commission escrow bill.
Originally we were under the impression that
NYSBA would only take a “neutral” position
because we did not agree to sunset the law.
But the NYSBA said our agreement to
review the bill two years after it becomes law
will satisfy its desire for a sunset.
Now — we are currently in the process
of finalizing the actual text of the new proposal with NYSBA. We will then seek to
amend our existing bills (S.1923/A.3395)
sometime in January. The bill does not need
to be reintroduced in the Legislature nor do
the cosigners need to re-sign. A copy of the
amended bill will be presented to all the
current cosigners.
The Commission Escrow Act garnered
much support in 2005. A total of sixty-eight
majority members in the Assembly and
twenty five majority members in the Senate
have signed on as sponsors of the
Commission Escrow Act. This is the highest level of co-sponsorship in the history of
this proposal.
LIBOR’s Legislative Division and
Commission Escrow Act Subcommittee
team will continue to try and obtain the
support of the remaining two Senators and
the three Members of the Assembly who
did not yet sign onto the bill as cosponsors.
The way politics works in the New York
State Legislature is clear-cut — a minority
member of the Assembly or the Senate cannot become a cosponsor on a majority
member’s bill. However, many of the legislators who are not cosponsors have already
expressed their support for the bill when it
comes up for a vote on the floor of the
Senate and the Assembly.
We can’t stop now - we need your help.
Just because the 2005 legislative session
has ended doesn’t mean that our fight has
ended. In order to be successful with a
Commission Escrow Act bill next year —
we must continue to spread our message to
each and every legislator at the local and
state levels.
Despite the fact that LIBOR reached its
2005 RPAC goal — all REALTORS® must
continue to raise additional RPAC dollars
in 2006 as we need to support legislators
who support REALTORS®. Please tell
every REALTOR® you know to make sure
they contribute to RPAC today — so you
can protect your hard earned commission
dollars tomorrow!

complete the construction on this
house and to help get the Fowler family into their new home for
Christmas. Anyone interested in helping that day should contact Christina

The Dedication Ceremony for the
Habitat home located in Central Islip
has been scheduled for Friday,
January 20th at 11:00 am. All
Realtor® members and volunteers are
welcome to attend the dedication on
that day and take a tour of the home.
Some members have expressed an
interest in attending the ceremony
and bringing along a house warming
gift for Tim and Candace. All house
warming gifts are welcome and in
response to that we are in the process
of organizing a gift registry that will
be placed on the REALTOR ONLY
web site over the upcoming weeks to
avoid any “duplicates.”

across the nation continue to vehemently
oppose any attempt to alter the current tax
treatment of mortgage interest and property
tax deductibility. The REALTOR® association believes that the Presidents’ Tax
Reform Panel proposed tax changes are illconceived and would undermine homeownership opportunities.

Legislature. She declared, “The housing
industry, which has driven and sustained the
economy for the last five years, could be
seriously impacted by the proposed tax
reforms. By reducing the deduction on mortgage interest and property taxes, as well as
state and local taxes, the financial stability of
many Long Island families could be grossly
compromised. Moreover, consumers’ nest
eggs will be jeopardized because much of

families. It is potentially devastating to our
local economy when you consider all the
goods and services that local businesses
provide to homeowners.”
The National Association of REALTORS® (NAR) urges that real estate be recognized as a long-term investment, so the tax
system should reflect the stream of income
and expenses associated with long-term
investments. Deductions for the amount of
the purchase price and the loss of interest
deductions are ill-advised for real estate
investments. NAR also urges that the president and Congress preserve the deduction for
state and local taxes, including property taxes.
We will continue to monitor any developments and we will advise you when to
communicate this opposition to your
Member of Congress.

2005 Highlights
Looking back, as 2005 draws to a
close, my year as WCR President has
been a wonderful year. One of the highlights of being involved in WCR is the
National meetings. Being involved on a
local level doesn’t begin to prepare you
for the magnitude of the national meetings. Members attend from all over the
United States. What a great bunch of
Realtors® (remember it’s not just
women). At the meetings we share ideas,
network and share success stories. The
speakers at these meetings are of the
highest caliber. If you want to know what
the rest of the country is doing in the Real
Estate market, you should plan to attend
at least one of these meetings.
In addition to the national meetings,
there are also regional meetings. Our
region is comprised of NY, NJ,
Pennsylvania and Maryland. Every year
a regional retreat is planned. Last year we
went to Newport, Rhode Island. What a
beautiful place. Next year they are going
to Chicago, which promises to be anoth-
er exciting and informative trip.
The WCR will host a joint Holiday
party with the Nassau North Shore
Chapter of LIBOR was held at the
Westbury Manor. With a D.J. for dancing,
a great time was had by all. At this time I
want to thank all of the great people that
made this year a success. Hopefully we
raised the bar a notch or two, educating
our fellow realtor® and bringing their
career to the next level. Watch for the first
meeting next year. It is guaranteed to be
as informative and educational as this
year’s meetings have been.
Remember that the WCR needs
YOU!!!!! We are always looking for volunteers to help our organization grow.
Without YOU we cannot grow. Without
YOU we cannot network. When planning
your schedule for next year, put WCR on
the list. If you are unable to volunteer,
just plan to attend the meetings. It will
add another dimension to your career.

the 5th Annual Shinnecock Marlin and
Tuna Club's Fishing Tournament with a
sponsorship to benefit the Big Brothers
Big Sisters of Long Island. Over 500
supporters gathered for an awards dinner
held at Oaklands Restaurant at the
Shinnecock Inlet where Scott Horowitz,
President of Shinnecock Marlin and Tuna
Club presented Big Brothers Big Sisters
of Long Island with check in the amount
of $67,000. The check represented funds
raised through the organization’s annual
tournament where fishermen competed

over the last two weeks of August for the
largest tuna, marlin, mako and weakfish.

local food pantry. They collected food outside a local supermarket, John’s Farm all
week. Thanks to the generosity of the
many neighbors in and around Plainveiw
the food was delivered and they collected
enough food to supply the pantry for an

Market Remains Balanced Through
November
November home prices were released
by the Multiple Listing Service of Long
Island, Inc. (MLSLI™) on December
7th. Comparing the closed median home
price for Nassau, Suffolk and Queens
County to a year ago — the numbers
show an annual appreciation rate of 11%.
In November 2004 the MLS of LI reported a closed median home price for Long
Island of $395,000 compared to
November 2005 figure of $437,000.
Nassau County contracted home prices
are reported at $600,100 for November,
representing an increase of 10% over last
year’s figure of $543,400. Suffolk
County reported an average contracted
price of $463,600, which is 7% higher
than last November, while Queens
County reported an average contract
price of $488,600, up 13% over last
November’s figure of $432,000.
Contracted home prices reflect what the
market is doing in the past 30 days or so.

have current information on each listing

agents of the status of the listing.” (The

MLS receives up to 6 million spam
emails a day. Because there is so much
spam and viruses to contend with today, it
is getting more difficult to control.
The more filters we have in place to
block this spam, the more your legitimate
emails get blocked from being delivered.
The MLS Board of Directors approved
discontinuing these email accounts and to
leave it to internet providers and email services, such as AOL and others, doing it as
their primary business.

Listings Online
Old Rule: The Internet will disinter

New Rule: The Internet makes personal
service even more priceless.
It's long been a widely accepted principle that real estate professionals prefer
listing properties over working with buyers. After all, the potential profit is greater
with listings, because they are more easily
managed and require less personal attention. Yet, curiously, many agents market
online almost exclusively for buyers.
Fortunately, the online opportunity is
already in place to accelerate a shift in the
balance between marketing to buyers and
marketing to sellers. Agents who have cut
their teeth on the Internet by marketing
mainly to buyers have only a bit of
rethinking and website tweaking to do.
Here are a dozen actions you can take to
boost your listings online:
1. First, market to home sellers as if
they were buyers. Since most sellers
approach the internet first as interested
buyers, ask on every response form if the

2. Grab sellers early and don't let go.
Once you have the seller's contact information, follow up fast with drip e-mail
responders. According to NAR's October
2004 Profile of Home Buyers and Sellers,
73 percent of prospective home sellers list
with the first agent they contact. So make
it your #1 marketing mission to be that
first contact.
3. Ask for the listing. Entitle your
response forms with a straightforward
phrase such as "For Sellers," "I want to
Sell My Home!" or "What can I get for my
home?" Don't be shy. Appeal directly to
home sellers on your top level navigation.
4. Determine a timetable for your follow-up campaign. Include a simple qualifying question on your website response
forms by providing two check-off boxes:
"Planning to move in less than six
months?" and "Planning to move in more
than six months?" Offer different information kits to each self-qualified group.
5. Cultivate prospects with drip-marketing follow-up. Use automated e-mail
responses, based on the seller's timeline
for moving. Send more e-mails more often
for prospects that plan to move soon.
Include response links in every e-mail.
6. Drive prospective sellers back to your
site again and again. Give prospective
sellers the keys to the mansion with easy
access to your rich content library filled
with accurate, up-to-date information,
buyer and seller tips, calculators, and
forms to request related services.
7. Make it easy for sellers to request a
competitive market analysis, which you
can deliver by e-mail, postal mail, or in
person. Refer to your personal visit as a
prelisting home inspection or marketability evaluation visit. Offer a quick "over the
Internet price opinion" alternative by email where the prospect doesn't have to
speak to an agent.
8. Continue to market to sellers by
phone and mail as well as online. Feature
continuous direct response offers designed
to demonstrate your knowledge and skills
and convert e-leads to live appointments.
Often making "buyer" offers to prospective sellers (latest listing updates, relocation information, schedule a showing,
etc.) will alert you when a long-term
prospect is ready to list.
9. Promote your promise to provide an
all-out marketing campaign for each listed
property. Set up a unique website address
for each listed home; feature virtual tours
plus multiple photos. Highlight their home
on e-cards, e-brochures and printed flyers
as well as on multiple websites. Establish
an e-mail first alert network of company
colleagues and area co-brokers who have
active buyers for new listings.
10. Invite nosy neighbors in. Include a
response form in your website that neighbors can use to find out what a house
down the street sold for. Feature this free
service in your neighborhood direct-mail
farming newsletters and "Just Sold" postcards. Archive sold information on your
website to bring homeowners back to your
site for "Market Updates."
11. Create a plan to pull in FSBOs.
Offering genuine assistance to do-it-yourselfers is the most effective rapport-building technique. Have an automated system
that lasts a minimum of five weeks. A
minimum of 10 contacts per prospect is
recommended, including five e-mails with
helpful advice on pricing, marketability,
and property promotion. You can also
send market updates, your guarantees,
your commission rate, and a complete
run-down of your listing services. Ask for
the FSBO's "extra buyer" referrals in
exchange.
12. Convert expireds to listings.
Establish a web form on your site specifically for expireds and prominently label
the navigation button with an apt title such
as "House Didn't Sell?" Offer to provide a
report that explains "How to Sell a Home
That Didn't Sell" and a free room-by-room
"Marketability Analysis" if they want to
re-enter the market.

On November 29, 2005, Fannie Mae and
Freddie Mac increased conforming loan
limits on single family properties from
$359,650 to $417,000, effective January 1,
2006. This loan limit increase reflects the
October-to-October changes in average
house prices, as published by the Federal
Housing Finance Board, and complies with
the Supervisory Guidance issued by the
Office of Federal Housing Enterprise
Oversight (OFHEO). Loan limits will also
increase on other properties as follows:
• $533,850 for mortgages on two-family
properties (up from $460,400);
• $645,300 for mortgages on three-family properties (up from $556,500); and
• $801,950 for mortgages on four-family properties (up from $691,600).

Case #17-1: Obligation to Submit to
Arbitration
REALTOR® A and REALTOR® B had
been engaged in a cooperative transaction
that resulted in a dispute regarding entitlement to compensation. Rather than requesting arbitration before the Board of REALTORS®, REALTOR® A filed suit against
REALTOR® B for payment of the compensation he felt REALTOR® B owed him.
Upon receiving notification of the lawsuit,
REALTOR® B filed a request for arbitration
with the Board, which was reviewed by the
Grievance Committee and found to be a
mandatory arbitration situation. REALTOR® A was advised of the Grievance
Committee’s decision, but refused to withdraw from the lawsuit. Thereupon, REALTOR® B filed a complaint with the Board
charging a violation of Article 17 as supported by Standard of Practice 17-1.
REALTOR® A was directed to be present
at a hearing on the complaint before the
Board of Directors. Evidence that REALTOR® B had sought REALTOR® A’s agreement to submit the dispute to arbitration was
presented at the hearing. REALTOR® A
defended his action in filing the suit and
refusing to submit to arbitration by asserting
that under laws of the state, the Board of
REALTORS® had no authority to bar his
access to the courts or to require him to arbitrate his dispute with REALTOR® B.
The Board of Directors concluded that
REALTOR® A was correct as to his legal
right and as to the Board’s lack of any right
to prevent him from filing a suit. It was pointed out to REALTOR® A however, that the
Board of REALTORS® is a voluntary organization, whose members accept certain
specified obligations with respect to their
relations with other REALTORS®, and that
if he wished to continue as a member of the
Board he would be obliged to adhere to the
Board’s requirement as to arbitration.
Because REALTOR® A would not withdraw the litigation, the Board of Directors
concluded that REALTOR® A was in violation of Article 17 for refusing to arbitrate in a
mandatory arbitration situation. However, it
was noted that if REALTOR® A had filed litigation against REALTOR® B, and had
REALTOR® B then requested arbitration
with the Grievance Committee determining
that an arbitrable issue of a mandatory nature
existed, REALTOR® B might have successfully petitioned the court to remand the matter to the Board for arbitration, and there
would have been no finding of a violation of
Article 17 since the Board’s arbitration
process would have been ultimately compiled with.

duration of his listing, Standard of Practice
16-4 recognizes the REALTOR®’S right to
contact the seller directly to get that information. Once the REALTOR® secures information on the type and duration of the listing,
Standard of Practice 16-4 also permits him to
discuss the terms of a future listing or to enter
into a listing that becomes effective upon the
expiration of the current listing. The panel’s
decision also indicated that REALTOR® B
could have barred REALTOR® A’s contact
with the sellers simply providing him with
information on the nature and status of the
listing.
The panel found REALTOR® A not in
violation of Article 16 of the Code of Ethics.

Case # 16-10: refusal to Disclose
Nature and Expiration Date of Listing
REALTOR® A, on his way to his office,
noticed the deteriorated condition of a “For
Sale” sign posted on an unimproved site
bearing the name of REALTOR® B. He
remembered that REALTOR® B’s “For
Sale” sign had been on that site for a considerable period of time. REALTOR® A decided to call REALTOR® B to determine the
status of the property. In response to several
questions, one of which was, “Do you have
an exclusive listing on that property?”
REALTOR® B replied that he was not obligated to disclose the nature, status, or the type
of listing. After considerable conversation,
REALTOR® A stated his intention to contact
the property owners for this information, citing Standard of Practice 16-4 as the basis for
his action. REALTOR® B warned REALTOR® A not to “cross his sign” and refused
to discuss the matter further. A few days later,
REALTOR® B had a telephone conversation
with the property owners and learned of their
decision to list their property with REALTOR® A when their current listing with
REALTOR® B expired the following week.
REALTOR® B filed a complaint against
REALTOR® A with the Board, stating that
REALTOR® A’s actions in contacting his
client had been inconsistent with REALTOR® B’s agency.
The Grievance Committee reviewed the
complaint and the response to the complaint
filed by REALTOR® B. The case was
referred to the Secretary to schedule a hearing by a Hearing Panel of the Board’s
Professional Standards Committee.
During the hearing, REALTOR® B
repeated his complaint and his conversation
with REALTOR® A. He also advised the
Hearing Panel of his telephone conversation
with the property owners and of their decision, as a result of REALTOR® A’s direct
contact, not to relist the property with him,
REALTOR® B. “Not only did REALTOR®
A fail to respect my agency with the property owners by contacting them directly,” said
REALTOR® B, “but he violated Article 16
by taking the opportunity to relist the property away from me!”
REALTOR® A defended his actions by
stating that he had requested information on
the nature and status of the listing from
REALTOR® B, as required by Article 16,
and that REALTOR® B had refused to
divulge the information; and that he had contacted the property owners only after this
refusal, citing as his authority the principle
established in Standard of Practice 16-4.
“The sellers were happy to discuss listing
their property with me, once I described the
services my firm could offer,” said REALTOR® A. “They said they hadn’t had an
interested customer since the first week of
their listing with REALTOR® B.”
After giving careful consideration to all the
evidence and testimony, the Hearing Panel
concluded that REALTOR® A’s actions had
not been inconsistent with the agency of
REALTOR® B. The panel advised that
REALTOR® B’s refusal to disclose the nature
and status of his listing had freed REALTOR® A to contact the property owners.
The Hearing Panel’s decision noted that
Article 16 requires a REALTOR® to respect
the agency of another REALTOR®. But, in
order to respect the listing broker’s agency,
the REALTOR® must be able to determine if
a listing really exists. If the listing broker
