This Code of Ethics was adopted by the Board of Directors on September 7, 1995 to promote and maintain the highest
standards of service and personal conduct among its members. Adherence to these standards serves to assure public
confidence in the integrity of the cosmetic industry.
• Promote and encourage the highest level of ethics within the cosmetic industry.
• Maintain loyalty to the association and pursue its objectives in ways that are consistent with the public interest.
• Recognize and discharge our responsibilities as members to uphold all laws and regulations relating to the manufacture
and distribution of cosmetic products that are safe and effective as possible for the consumer.
• Operate our businesses utilizing ingredients and packaging consistent with the goal of preserving and protecting the
environment.
• Produce our products in accordance with Good Manufacturing Practices (GMPs).
• Use only legal and ethical means in all business activities.
• Not countenance discrimination on the basis of race, sex, age, religion, national origin, sexual orientation or disability.
• Use every opportunity to improve public understanding of the role ICMAD plays in representing the needs and

the President
Greetings from ICMAD!
We are proud to release our Beauty Reference Guide once again. Our
goal is to provide you additional exposure globally within the industry
along with additional resources and information that can be helpful to
you throughout the year.
Many of our association members are highlighted, as you will see, and
I must say it is exciting to watch emerging brands continue to grow.
By joining together with ICMAD, our members have the opportunity
to increase their impact in the industry. This year has also been a
benchmark year for ICMAD as we continue to grow.
ICMAD has been busy this year! Our global presence, awards programs,
increased legislative advocacy on Capitol Hill and additional services
and benefits all exist to help you, the cosmetic entrepreneur, increase
your success. Our focus is you and providing you information and
assistance as you continue to be the innovators you are!

ICMAD Chairman of the Board
Robb Akridge, PhD, is co-founder of Pacific
Bioscience Laboratories, makers of the
Clarisonic Sonic Skin Cleansing System and
Opal Sonic Infusion System. He is responsible
for the global expansion of the Clarisonic brand
as well as new product development and
international marketing. Prior to his new role,
Dr. Robb served as Vice President of Clinical
Research for Clarisonic. Dr. Robb received his
PhD in Immunology from Texas A&M University
and has spent over 25 years in medical and
global health research.
ICMAD Secretary
Sharon Blinkoff, of counsel with Locke Lord,
represents manufacturers, marketers, and
distributors of cosmetics, dietary supplements,
OTC drugs, and medical devices as well
as beauty appliances and other consumer
products and luxury goods. Ms. Blinkoff
regularly advises clients on compliance with
the laws enforced by the FDA, CPSC, and
the FTC, and obtaining FDA registrations and
510k premarket clearances. For many years
Ms. Blinkoff has played a leadership role in the
Cosmetics and Personal Care Industry.
Howard Baker, cosmetic chemist Howard Baker
has provided technical consulting services to the
industry as HBaker Development, serving small
and medium sized companies in the US and
around the world since 1983. In 2006 HBaker
Development became Product Integrity Laboratory
LLC. Technical consulting services provided include
formulation development, product development
testing, quality assurance and quality control, and
regulatory compliance.
ICMAD Treasurer
Michael Benjamin created and launched the
Temptu Pro division in 1996, and expanded the
company’s existing professional makeup offerings,
shepherding the company into the professional
airbrush makeup market and becoming a pioneer
in the industry. With the impact it could have on the
world of consumer beauty he launched the Temptu
Airbrush Makeup System and consumer line in the
fall of 2009.
Craig Weiss, Prior to arriving at Consumer
Product Testing Co., Craig Weiss held positions
at Del Laboratories, Proctor and Gamble Drug
and Roxane Laboratories. Craig began his
career with Consumer Product Testing Co., Inc.
as the Vice President of Sales and Marketing for
the Product Technology Analysis and Control
Division. In 1993 Craig became the corporate
Vice President of Sales and Marketing and in
1999, he became the President of Consumer
Product Testing Co., Inc.
Gus Bezas currently serves as President of Global
Strategic Development at Milbar Laboratories.
Gus created and drove Milbar’s “innovation
as marketing” strategy. In this position he
identified, implemented and commercialized
new, emerging technologies in skincare. Due to
his accomplishments and reputation as a global
authority, consummate visionary and strategist
in the beauty industry, Gus is sought after as a
speaker.
ICMAD Chair Emeritus
Stan Katz, In 1969, Stan Katz founded West
Cabot Cosmetics, later renamed Cabot Labs,
a marketer of innovative hair care, skin care,
makeup, nail and fragrance products targeted
to domestic and international distribution
channels. In 1996 Stan founded two cosmetic
related websites: CosmeticMall.com, offering
50,000+ branded cosmetics, fragrance,
and personal care products globally- direct
to consumers, and CosmeticIndex.com, a
business to business resource guide for the
cosmetic industry trade.

Joseph E. Atencio, former Chief Executive Officer
of ChemAid Laboratories, a premier formulator and
manufacturer of high performance, premium hair
care and skin/body care products. Prior to joining
ChemAid Labs in February 2011, Mr. Atencio was
at Cosmetic Essence, Inc. from 2001 to 2010 in
roles that included CFO and then Executive Vice
President.
Daniela Ciocan, Director of Marketing for
SoGeCos Americas/Cosmoprof North America,
Daniela Ciocan has innovated the trade show with
the implementation of new initiatives for Cosmoprof
North America, such as Discover Beauty/
SPOTLIGHTS, the International Buyer Program,
BEAUTIQUE Sampling and the TV Shopping
Channel Mentor. Cosmoprof North America has
since enjoyed increased show attendance, with
participants hailing from the United States and
abroad.

Curran Dandurand is CEO/President, co-owner
and co-founder of Jack Black LLC, a leading
brand in the North American prestige men’s skin
care market featuring premium skin care, shaving,
sun protection, body care, hair care and fine
fragrance products. Jack Black products are sold
in all 50 U.S. states, Canada, Mexico and other
international markets.
Carl Geffken is a consultant to the cosmetic,
toiletry, skincare and OTC drug industry in areas of
quality assurance and regulatory affairs, providing
direction in cGMP compliance, product labeling,
claims substantiation and process documentation.
In April 2004, Carl attended the Vrije Universiteit in
Brussels, Belgium where he earned his certificate
as a qualified Safety Assessor in the European
Union.
Ian Ginsberg, President of C.O. Bigelow, the
one stop for hard to find favorites from around
the world. Ian scours the globe to orchestrate a
supreme collection of beauty imports such as
Marvis toothpaste from Italy and La Crème Opalis
from France. Today the company is using actual
formularies and therapeutic ingredients that have
been documented for nearly two centuries and
fusing them with the best of today’s technology.

Tracy Holland, In 2009 Tracy Holland joined with a
partner to create HATCHBEAUTY Agency offering
strategic planning, go-to-market strategy, creative
services and product development for beauty
brands and retailers. In 2010, Tracy spearheaded
the formation of HATCHBEAUTY Products, a
company offering turnkey programs for clients
around the globe. She expanded the strategic
focus of HATCHBEAUTY in 2012 by acquiring
HATCHBEAUTY Labs, a manufacturing facility.
Jane Iredale founded Iredale Mineral Cosmetics,
Ltd. in 1994 and serves as its President. She was
the first company to supply the aesthetics industry
with a full-line of makeup based on minerals. She
has worked with world-renowned plastic surgeons
and dermatologists in the development of her line
and lectures all over the world on its benefits.
Chris James is a sales & marketing executive
with over 15 years of experience in the personal
care packaging and global logistics industries. In
2005 he co-founded East Hill Industries where he
formulates all global marketing and sales planning
for personal care providers. He works with national
brand customers and both domestic and foreign
suppliers to produce a wide range of high end
cosmetic packaging.
Andrew Goetz, For ten years preceding the
launch of MALIN+GOETZ, Andrew Goetz worked
as Marketing Director for family-owned Vitra,
a Swiss-based design manufacturer. Both the
New York flagship MALIN+GOETZ store design
and graphic team behind the packaging were
organic extensions of previous collaborations and
relationships.
Paulo Lima is the Co-Founder of IT Cosmetics, one
of the largest private color cosmetics companies in
the United States. Prior to founding IT Cosmetics,
Paulo worked on Wall Street, focusing in M&A. At
IT Cosmetics he works hand-in-hand with plastic
surgeons, and travels the world to create innovative
products that truly solve problems and give women
beauty solutions.
Susan Goldsberry, For over 30 years, Susan
Goldsberry has brought her unique talent for
creative formulating to the business of beauty, and
is now widely recognized as a leading innovator
behind many award-winning products in the
industry. In 2007, Susan founded Benchmark
Cosmetic Laboratories, delivering cutting-edge
R&D and specialized product development tailored
to meet the individual needs of each client.
Deborah Lippmann, After years of experience in
the industry, Deborah Lippmann created her own
line of high-quality nail lacquers and treatments.
Now with an assortment of over fifty long-wearing
shades, along with specialty treatments for nails,
hands and feet, Deborah Lippmann nail products
are frequently featured in top magazines, spotted
backstage at fashion shows and adorn the world’s
most notable women.
Carrie Gross, President and CEO of Dr. Dennis
Gross Skincare, began her career in the fashion
world as a merchandising director overseeing
both domestic and international women’s fashion
markets. She left her position to co-found a
cosmeceutical skincare line with her husband, Dr.
Dennis Gross, that developed innovative products
featuring clinical ingredients and offering in-office
results.
John Maly began his career working for Deloitte
Touche. This large accounting firm was a training
ground for John to open his own firm focused on
salons. He began running the family business, a
distributorship in California. Maly’s-West grew to be
a major distributor on the West Coast and was sold
to L’Oreal in 2007. Since then, John has been busy
running Mirabella Beauty, a color cosmetics brand
sold in the salon and spa channel.

Joe Mastalia, In 1993 Joe Mastalia came to
DePasquale Salon Systems (DSS), a professional
beauty distributorship, that provides professional
products, services, and education to salons and
spas along the East Coast. As an operations
Manager, Joe brought new ideas and energy
while setting unprecedented goals for expanding
the distributorship. After more than a decade he
was appointed President of DePasquale Salon
Systems, the first-ever in DSS’ expansive history.
Jeff Murad, As Vice President of Product
Development, Jeff Murad is responsible
for product formulation, testing, regulatory
compliance and packaging compatibility.
Ensuring that product development is linked
to demand, Jeff works closely with Murad’s
Customer Care division. He is active in furthering
Murad’s international growth by developing the
business relationships that formed the foundation
for Murad Japan.
Alexander Stephen Naar is President of
MAS, a family owned and operated marketing
and sales organization that provides a host of
services to companies who seek to expand the
reach of their products to new Latin American &
Caribbean markets and who require additional
resources and regional expertise. The company’s
primary responsibility is to service all the needs
and requirements and facilitate the flow of
communication between the supplier and the
customer.
Ada Polla, In 2004, Ada Polla, co-creator of
Alchimie Forever, set out to launch her family’s
Swiss based skincare line in the US. Today, the
brand boasts global visibility and distribution.
She was featured on the cover of Business
Week Small Biz. In 2011, the Network For
Teaching Entrepreneurship presented her with
the Homegrown Entrepreneur Award. Ada’s
background includes a Bachelor of Arts in
political science and art history at Harvard
University followed by an MBA from Georgetown
University.
Mary S. Ptak is the Tradeshow Division Manager
for Masterpiece International Ltd. She took a
small group within a larger Fine Arts Freight
Forwarding Company managing 12 tradeshows
per year and grew it to over 200 shows per year.
It is now a division of the company, and has
become a high level of International Tradeshow
Transportation Specialists. The multi-lingual
staff is experienced in Customs Brokerage,
International and Domestic Transportation and
Documentation.

Rob Ross-Fichtner, Since 1990, Rob RossFichtner has been President and CEO of Focal
Point Research. He has more than 30 years of
experience in the formulation, manufacturing
and regulation of cosmetics, OTC drugs, medical
devices and nutritional supplements. He has
completed hundreds of regulatory submissions for
product registration and has also been a consultant
for Health Canada. Rob has served as the regular
science columnist for Canada’s Cosmetics
Magazine and is currently a regular contributor to
Cosmetics & Toiletries.
Terry Schatz literally grew up with Bioelements
- working weekends and summers as a teen
in the family business’s warehouse. He joined
Bioelements full-time as a buyer in 2001, was
promoted to COO in 2010 and elected to the
company’s Board of Directors in 2011. Terry
is responsible for the company’s day-to-day
activities and oversees manufacturing, production,
forecasting, inventory, shipping, purchasing and
regulatory compliance.
Lynda Solien-Wolfe is Vice President, Massage
and Spa for Performance Health, manufacturer and
marketer of health and wellness products. Over the
past 15 years, she has been uniquely responsible
for the company’s successes in the massage
therapy and spa professions. She has more than
20 years of experience in the massage therapy and
spa markets.
David C. Steinberg has spent over 40 years in
the cosmetic industry. He founded the Masters
Degree program in Cosmetic Sciences at Fairleigh
Dickinson University, teaching there for twelve
years. In 1995, he founded Steinberg & Associates,
Inc., a consulting company that specializes in
cosmetic regulations, labeling, preservation and
sunscreens. He has written 5 books and lectures
worldwide on how to preserve cosmetic products,
regulations and many other topics.
Shawn Tavakoli is CEO of Beauty Collection,
a prestige beauty retailer with several brick and
mortar locations in Southern California and an
online store at www.beautycollection.com. In 1997
he opened his first store in Calabasas, California.
Beauty Collection currently represents over 350
prestige and salon beauty brands with over 30,000
unique products chosen for their quality and
distinctiveness.

Lisa Thurman, In 1991, Lisa Thurman started
The AmazingConcealer based on her passion
for makeup and packaging. Working with several
department store chains, home shopping
networks and various beauty boutiques
throughout the country, she is now expanding
to numerous international markets by offering
a “global palette” with the launch of the ever
expanding shade range of the AmazingConcealer.
JuE Wong is a proven global senior executive
with experience and exposure in four continents
and seven countries. With a tangible track record
of propelling emerging brands to the next level,
she has demonstrated expertise in globalizing
established brands in the U.S. and internationally.
In 2012, Ms. Wong was appointed Chief Executive
Officer of StriVectin®, the fastest growing prestige
anti-aging skin care brand in America.
Pamela S. Viglielmo is Chief Operating Officer
and a senior partner of Mënaji worlwide, LLC.
Menaji Skincare is a well-established American
brand sold both in the USA and in more than 25
countries internationally. With more than 25 years
in the global beauty industry, Pamela has worked
with “Indie” brands across multiple product
categories and via multiple distribution channels.
William F. Zrebiec is the Sr. Vice President for
Research and Development for Cosmetic Essence
Inc. Mr. Zrebiec joined CEI in 1995 as Director,
R&D and Manufacturing, where he has been
instrumental in expanding the capabilities of the
department. He is also responsible for chemical
purchasing and manufacturing (compounding and
blending of products) for the entire company. Mr.
Zrebiec’s previous work experience includes 9
years of product development with Liz Claiborne
Cosmetics.

MARKET HIGHLIGHTS
Sales of the U.S. cosmetics and
toiletries market have topped $42 billion
at the manufacturers’ level in 2014,
and, for the fifth year in row, the market
posted revenue growth, according to
the 2014 edition of Kline’s Cosmetics &
Toiletries USA report. Upward growth
is driven by the consistent healthy
performance of all product classes,
with oral care, hair care, and makeup
occupying the top spots in terms of
growth. Expanded retail availability,
innovative products, diagnostic tools,
and social media outreach all contribute
to the industry’s growth in 2014.
MAKEUP
The makeup products class witnesses another strong year of sales,
guided by the eye and face makeup categories. Face makeup is driven by
multi-functional foundations, providing advantages such as full coverage,
moisturization, concealing, anti-aging, and SPF protection while the eye
makeup category benefits from the growing demand for eyebrow products,
eyeliners, and mascaras. This year, lip glosses experience a dip in sales
with consumers shifting their preference back to the pigment-rich lipsticks,
available in newly improved long-wearing and lightweight formulae. Although
experiencing a drop in sales for the second consecutive year, the nail polishes
category is offset by the introduction of gel polishes from leading marketers,
such as Coty, Revlon, and L’Oréal in the second half of the year.

HAIR CARE
Supported by a stellar performance
of the lip balms category, the oral
care product class showed its best
face in 2014. Growth in this category
was driven entirely by EOS (Evolution
of Smooth), which has skyrocketed
to the #2 spot in the category due
to its attractive packaging and
appealing flavors.
With almost 3% growth, the hair care product class is
dominated by shampoos and conditioners. Cleansing
conditioners, also called co-washing, a product type
popularized by direct marketer Guthy-Renker with its Wen
brand, has gone mainstream with mass companies such
as Procter & Gamble, Unilever, and L’Oréal beginning to
offer them. Oil-infused hair care product lines enriched with
various kinds of oils, such as argan, Moroccan, kukui, and
coconut, are also gaining popularity.

SKIN CARE
Skin care continues to be the leading product class in terms of sales value,
backed by the positive performance of skin care products for men and hand
and body lotions. Men prefer skin care products that address specific skin
care concerns and require products that function effectively and provide
quicker results. To address these needs, several companies use minimalistic
packaging designs on such products. Within the hand and body lotions and
sun care categories, spray-format products are gaining popularity due to their
easy application process, product packaging that allows for an even spread,
and claims of a quicker absorption rate.
BEAUTY DEVICES
Inspired by professional
technologies like lasers and the
first-ever wearable mask devices,
new products help fuel consumer
interest and the at-home beauty
devices market, which globally
increases by nearly 14% in
2014. The market continues to
be remarkably dynamic, nearly
doubling in size since Kline first
tracked it.

reach nearly $50 billion by 2019.
Makeup is projected to show the
highest growth during the forecast
period; skin care will remain the
largest contributor in terms of

CITY Awards
ICMAD Celebrates Innovation with
CITY Awards
In 1995, ICMAD created a recognition program to honor
outstanding and innovative entrepreneurs for their achievements
in the cosmetics and personal care industry. The first “Cosmetic
Entrepreneur of the Year” was selected by a prestigious panel of
trade magazine editors, and was presented at the 1996 ICMAD
Annual Meeting at The Museum Club in New York City.
The program was expanded in 2000 to honor both established
entrepreneurs, who were active in the industry for more than five
years and to recognize emerging manufacturers, distributors
and suppliers in business for less than five years. Six “Cosmetic
Entrepreneur Awards for Leadership” were presented at the
ICMAD Annual Meeting in New York City.

In 2004, ICMAD revised the competition to present awards for the
results of the innovative talents of independent entrepreneurs in

In 1998, under then President Bob Barash,
a PR firm was engaged to enhance ICMAD’s
public profile. One of the suggestions was for
ICMAD to sponsor a competition. The Young
Designers idea was taken from a competition
that had been run by ICMAD member
company W. Braun. Frank Cornacchiulo,
then principal at W. Braun, suggested that
ICMAD restart the competition, to both
enhance ICMAD’s image and to showcase
the extraordinary talents of students studying
package design. The goal of the Young
Designers competition was to encourage and
develop future creative talent.
The competition was established in 1999
with rules for designing a cosmetic package.
Judging was based on specific “real world”
criteria and judges were selected for their
expertise in the package design field. The
three top winners were given cash awards
(which was unique at the time, since it
did not involve scholarship money) and
celebrated initially, at a luncheon and
subsequently, a dinner attended by ICMAD
members and guests and featuring a well
known industry “star” to present the awards
(listed below). For some of this time, the
Young Designers Dinner was held during
HBA in New York, other years it was a stand
alone event.
The number of schools varied from five to
seven and each school was asked to select
its top ten entries to send to the judges.
This was done in consideration of the time
involved for each judge to determine their top
three selections. In 2014, thirteen colleges
and universities participated in this design
competition.

When the competition coincided with HBA,
the winning students were given badges to
attend the show. Later, students met with
ICMAD member companies to give them
a taste of the opportunities in our industry.
Several of the winners had never been
out of their home states. Most were very
appreciative of the opportunity and we have
had some follow up feedback that winning
the competition had changed a career path
or two.
In 2014, several changes were made to
further enhance this student competition.
The Young Designers Celebration dinner was
moved to southern California and the student
with the best design, as chosen by a panel of
industry experts, was given the opportunity
to work with an ICMAD member company.
In 2015 the Young Designers event was again
held in southern California, where more than
225 ICMAD member companies are located.
The winners met with Beauty Collection,
Benchmark Cosmetics and Urban Decay.
Celebrity hair expert Chaz Dean was the
guest speaker and presented the Young
Designers awards. The 2015 Young
Designer winners are: Travis Cuellar, Fashion
Institute of Design & Merchandising,
1st Place; Ajalique Chapman, Colorado
Mesa University, 2nd Place; Kyle Newkirk,
Pennsylvania College of Art & Design, 3rd
Place; and Brittany Rachel Bosshardt,
Colorado Mesa University and Sergio
Lopez, American Academy of Art Chicago,
received Honorable Mentions. The first Place;
winner also received a contract opportunity
with ICMAD member company East Hill
Industries.

Cer tificate of
Free Sale
Cosmetics companies exporting
products from the United States are often
asked by foreign governments or their
overseas distributors or customers to
supply a “certificate” as a required part
of the process to import a cosmetic or
personal care product into their country.
ICMAD initiated its Certificate of Free Sale
Program in 1992 in response to members’
requests for these certificates, which
needed to be properly authenticated and
obtainable in a timely manner.
The original program is available to
current ICMAD member companies
manufacturing products in the U.S. The
certificate states that ICMAD certifies that
the named company is a member in good
standing and the products named comply
with U.S. FDA GMP Guidelines for
Cosmetics, with all pertinent regulations
and are sold freely within the U.S.
ICMAD currently has procedures in place
to obtain authenticated certificates for
more than 140 different countries. Last
year, more than 1300 certificates were
processed.
In July 2011, ICMAD updated its
Certificate of Free Sale Program by
making it available to distributors that
are current ICMAD members, provided
that their manufacturer is also an ICMAD
member and is located within the U.S.
Also new is an expedited authentication
service for those products being exported
to countries that require U.S. Department
of State certification prior to obtaining
embassy approval from the country
of import. This has reduced the time
required to complete these certificates
from as much as 12 weeks to two to four
weeks.
In August 2013, in a continuing effort to
improve the quality and efficiency of this
service, a new all inclusive pricing model
was introduced to eliminate separate
shipping charges and authentication fees.
A new courier service was engaged to
expedite authentications and an email
group was implemented to notify member
participants of any changes to the
program.

Q: Can I get a Certificate of
Free Sale from ICMAD?
A: Yes, as a trade association ICMAD
can provide Certificates of Free Sale for
members, because, unlike foods, drugs
or medical devices, “FDA is not required
by law to issue certificates for cosmetics
(although the Agency intends to continue
to provide this service as resources
permit)….” The FDA has also indicated
on its website that because production
of its certificates may take several
weeks, foreign governments may accept
certificates issued by other organizations,
including trade associations, and it
recommends that firms pursue alternative
sources for export certificates whenever
possible.
Q: How can I get a
Certificate of Free Sale?
A: If your company is a member of
ICMAD, you can download the Certificate
of Free Sale application from the ICMAD
website, www.icmad.org. Fill out the
application and mail, fax or email it with
payment to ICMAD. The cost for an
apostille certificate is $195. If you are
exporting to a country that requires U.S.
Department of State authentication prior
to embassy approval, the cost is $345,
which includes the expedited service
through our courier. Both fees include
shipping and authentication costs.
Q: How long will it take
to receive a completed
certificate?
A: It depends on each country’s
requirements. A significant number
of countries have signed the
“CONVENTION ABOLISHING THE
REQUIREMENT OF LEGALISATION
FOR FOREIGN PUBLIC DOCUMENTS,”
known as the Hague Convention, which
streamlines the document authentication
process. For those countries, a
document called an Apostille can be
obtained from the state Secretary of
State’s office. This takes approximately
three weeks. For countries requiring U.S.
Department of State certification prior
to embassy approval, in most cases our

expedited service has reduced the time
to approximately four to five weeks.
Q: Once I receive my
completed Certificate of Free
Sale, can I begin to send my
products overseas?
A: It is very unlikely that a certified
Certificate of Free Sale is the only
document needed to begin exporting.
Most countries have some type of
registration procedure, and a number
of countries now follow the EU model,
by requiring some type of registration
or notification. As stated on the FDA
website, “it is your responsibility to
assure that your products comply with
regulations in the destination countries.
Significant differences exist among
different countries.”

Mission: Education
To fulfill ICMAD’s continuing mission to
educate entrepreneurial companies in the
cosmetic and personal care industries,
over the years the association has
created a number of offerings.
Beginning with ICMAD’s very first
FDA Cosmetic Regulations Workshop
in Florida in 1983, we have invited
government officials and the most
authoritative experts in our industry to
respond to questions about compliance
with regulations and to offer technical
information to help beauty companies
prosper.
In 1983, the FDA had “done several
workshops in the food area but never
anything in the cosmetics area,”
according to the FDA spokesperson
who was involved in developing the
seminar. ICMAD was chosen to create
this event because of its focus on small
and mid-sized cosmetic entrepreneurial
companies.
The format is continually being updated
in response to requests from member
companies for expert assessments on
the latest issues that have captured the
attention of consumers, regulators and
industry.

In 2012, ICMAD created a new online
education initiative to inform members

to business development advice, brand
marketing, import/export and labeling
assistance. Many of these webinars
have been recorded and are available for
purchase.
For example, the site now offers the
latest batch of listed cosmetic ingredients
issued by China, the IARC monograph
for Titanium Dioxide and the ISO 22716
standard. New items are frequently added.
The library is searchable in several ways:
domestic or international topics, various
informational sources and the type of
information provided. Access to the
Online Reference Library is by annual
subscription.
A number of webinars can be found in
the ICMAD Online Cosmetic Reference
Library. The Library is a compilation of
accurate information about cosmetics
More than 30 years later ICMAD
continues to bring FDA staff and its own
experts to cosmetic entrepreneurs to
explain how to comply with the laws and
regulations governing the beauty industry.
The ICMAD Cosmetic Technical/
Regulatory Forum was developed in 2005
to provide a practical, more businessoriented follow-up to the ICMAD FDA
Cosmetic Regulations Workshop. It
also allowed ICMAD experts to provide
information on related topics, including
international regulatory requirements,
marketing data and business advice.

EU Program
ICMAD EU PROGRAM
ICMAD offers members the opportunity to market their products in
the European Union in cooperation with BIORIUS, which is ICMAD’s
endorsed partner for EU registration and legal representation. Together
we have developed a program for ICMAD members to comply with the
requirements of the EU’s cosmetic legislation: the EU PROGRAM.
This program offers both a Responsible Person, located in Belgium,
whose address can be used on your packaging (a requirement for
importing products in the EU), and can help you prepare your Product
Information File, which stays readily available for European authorities at
the address stated on your packaging.
For a yearly program fee (in addition to your ICMAD membership), ICMAD
members can use BIORIUS’s EU address in Manage, Belgium, where
documents are confidentially and safely stored. BIORIUS can also provide
additional services to help companies comply with EU, Canadian, ASEAN,
Chinese, Russian and U.S. regulations.
Members participating in the EU program should be aware that product
registration in the EU may be easier with BIORIUS (www.biorius.com).
Compliance with all parts of the new EU Cosmetic Regulation is required
and noncompliance can result in fines, mandatory recalls or prevention of
future importation.

How does FDA monitor imports?
FDA works closely with U.S. Customs
and Border Protection (CBP) to monitor
imports. Imported cosmetics are subject
to examination by CBP at the time of
entry. Foreign cosmetics that appear
to be adulterated or misbranded may
be refused entry into the United States.
They must be brought into compliance,
destroyed, or re-exported. Import
refusals of cosmetics are listed on FDA’s
website and are updated monthly.
Can FDA answer my questions about
U.S. Customs requirements?
No. You will need to contact U.S.
Customs and Border Protection
(CBP) directly to learn what Customs
requirements apply to your imports.
Useful resources on the CBP website
include, for example, “Importing into the
United States: A Guide for Commercial
Importers.”
Are all imported cosmetics sampled
and examined?
Not all cosmetics are inspected or
sampled upon entry into this country.
In order to focus inspection efforts
most efficiently, FDA issues Import
Alerts to advise inspectors of trends
in violations. Among the products
addressed in Import Alerts are cosmetictype products marketed with therapeutic
claims that cause them to be considered
unapproved new drugs under the law,
cosmetics that are adulterated because
of microbial contamination, failure
to meet U.S. requirements for color
additives, and bulk shipments of highrisk bovine tissue from BSE (bovine
spongiform encephalopathy) countries.

However, examination of imported
cosmetics is not limited to the types of
products specified in Import Alerts. Also,
the fact that a product has not been
detained previously does not protect it
from being detained in the future, if it
appears to be in violation of U.S. law.
While not all imported products are
examined at the time of entry, those not
examined are still subject to all the legal
requirements of the laws we enforce.
Do imported and domestically
produced cosmetics need to meet the
same requirements?
Imported cosmetics must comply with
the same laws and regulations that
apply to those produced domestically.
Cosmetic products and ingredients
are not subject to premarket approval
by FDA, with the exception of color
additives. However, they must be safe for
consumers under labeled or customary
conditions of use, and they must be
properly labeled. Color additives must
be approved for the intended use; some
must be from batches certified by FDA.

or market cosmetics are responsible
for ensuring that their products are in

With the exception of color additives and
those ingredients that are prohibited or
restricted by FDA regulations, a cosmetic
firm may use any ingredient, as long
as it does not cause the product to be
adulterated in any way. Companies and
individuals who manufacture or market
cosmetics have a legal responsibility for
the safety and labeling of their products.
Remember, however, that some “personal
care products” are drugs, or both
cosmetics and drugs, under U.S. law. If
your product is a drug under U.S. law, it
is subject to the requirements for drugs,
such as premarket approval. To learn
more, see “Is It a Cosmetic, a Drug, or
Both? (Or Is It Soap?).”
Do I need to register with FDA in order
to import cosmetics?
No. Firms importing products considered
to be solely cosmetics in the United
States are not required to register with
FDA, and a registration number is not
required for importing cosmetics into this
country. FDA encourages both domestic
and foreign cosmetic firms to register
their establishments and file Cosmetic
Product Ingredient Statements with our
Voluntary Cosmetic Registration Program
(VCRP), but as its name indicates,
participation in this program is voluntary,
not mandatory. Please note that the
VCRP can only accept Cosmetic Product
Ingredient Statements for cosmetics that
are already on the market in the United
States (21 CFR 720.2).
If your products are drugs, or both
cosmetics and drugs, under U.S. law,
however, they are subject to requirements
for drug registration. Similarly, importers
of cosmetic ingredients that are also
classified as food products are required
to meet the registration requirements of
the Bioterrorism Act of 2002.
What are the international differences
in the definitions of cosmetics and
drugs?
Many countries define drugs and
cosmetics differently from the United
States. For example, in some countries,
sunscreens are regulated as cosmetics.
In the United States, they are regulated as
drugs. Hair restoration, skin protectant,
pain relief, anti-aging effects that involve

the structure or function of the skin, and
treatment of acne, dandruff, eczema,
or irritated skin are other examples of
claims that would cause products to be
regulated as drugs (or in some cases,
both cosmetics and drugs) in the United
States. Cosmetics and drugs are subject
to different requirements. To learn more

What are some of the reasons
cosmetics offered for import are
refused entry into the United States?
A cosmetic may be refused entry into the
United States if it appears not to comply
with applicable U.S. laws and regulations
in any way. The following are just some
of the most common reasons:
• Ingredients or contaminants that cause
the product to be unsafe.
• Color additive violations: All color
additives must be approved by FDA
for the intended use; some must not
be used unless they are batch-certified
in FDA’s own laboratories. Misuse
of color additives makes a product
adulterated. To learn more, see “Color
Additives and Cosmetics” and the
additional resources listed on that
page.
• Prohibited and restricted ingredients:
Violating the restrictions on the use
of these substances makes a cosmetic
adulterated.
• Microbial contamination: Sterility is
not required for cosmetic products,
but microbial contamination can pose
a health hazard and therefore make a
product adulterated.
• Labeling violations, such as
deficiencies in the ingredient
declaration, or failure to include all
required labeling information in English
(or Spanish, in Puerto Rico).
• Claims that cause a product marketed
as a cosmetic to be subject to
regulation as a drug under U.S. law.
Remember, these are just some common
violations. Any violation of applicable U.S.
laws and related regulations may result in
a cosmetic being detained.
What ingredients are prohibited or
restricted?
If you are an importer, it is essential for
you to verify that the products you import
comply with regulations that prohibit or
restrict the use of certain ingredients.
The country of origin may not have
the same ingredient prohibitions and
restrictions as the United States. But
remember, any ingredient is prohibited
if it causes the finished cosmetic
product to be unsafe for consumers
under labeled or customary conditions
for use, even if there is no regulation
specifically prohibiting or restricting its
use in cosmetics. To learn more, see

Are “natural” or “organic” cosmetics
required to receive certification?
FDA does not define or regulate terms
such as “organic” and “natural.”
However, the U.S. Department of
Agriculture (USDA) does regulate the
use of the term “organic” when used
in terms of agricultural ingredient
marketing. Questions about the use of
organic agricultural ingredients should
be directed to USDA. There are also
private organizations that certify “natural”
and other claims; however, these
organizations are in no way affiliated with
FDA.
Also, remember that all cosmetics
are required to be safe, regardless of
the sources of their ingredients. An
ingredient’s source does not determine

What are the labeling requirements for
cosmetics?

Must all labeling be in English?
All required label information must be
in English. However, if the product is
marketed only in Puerto Rico, it must
be labeled in Spanish. If some labeling
information appears in another language,
all required label information must also
appear in that language.
Can common or usual names of
ingredients used in the country of
origin be used on cosmetic labels?
Under the Fair Packaging and Labeling
Act, ingredients must be identified by
their “common or usual names” in the
United States. Terms such as “aqua,”
“mel,” or “parfum” are permitted only in
parentheses following their common or
usual names in English, such as “water,”
“honey,” and “fragrance.”
Is INCI nomenclature acceptable for
identifying botanical ingredients?
INCI (International Nomenclature
Cosmetic Ingredient) names for botanical
ingredients typically use Latin names for
genus and species to identify botanical
(cont.)
ingredients. U.S. regulations require the
use of common or usual names. Latin
terms may be included parenthetically
following the common or usual name
of an ingredient. Example: Aloe (Aloe

Are C.I. numbers acceptable for
identifying color additives on cosmetic
labeling?
C.I. numbers are not acceptable
on product labeling unless they are

I want to import cosmetics without
labeling, and label them in the United
States before marketing them. Is this
permitted?
There is an exemption from ingredient
labeling that may apply in such cases.
Bulk cosmetics do not have to comply
with the cosmetic labeling regulations if
the person introducing the shipment is the
operator of the establishment where the
powder is going to be repackaged and
labeled, or, in a case where someone else
is going to introduce the shipment into
the United States, if a written agreement
signed by the establishment operator
is available for customs officials at the
time the shipment is offered for import.
The labeling exemption will be void,
however, if the product is moved from
the establishment without the required
labeling. For complete information, see the
regulation at 21 CFR 701.9.
