the office of Drugs Controller Gerneral (India), is under the
Directorate General of Health Services (DGHS), Ministry of Health
and Family Welfare, Government of India. The Drugs Inspectors
working under the CDSCO notified under section 21 of the Drugs
and Cosmetics Act, 1940, 1940 have jurisdiction extending to the
whole of lndia. Further, CDSCO does not have officer in all the cities
in India, it is difficult to monitor the prosecution launched on behalf
of the Union of India on regular basis. ln view of the above, all litigations filed on behalf of office of DCG(I) are conducted through the
Government Counsel / Counsel panel as nominated by Ministry of
Law and Justice, Government Counsel / Counsel panel as nominated by Ministry of Law and Justice, Government Counsel / Counsel

India. The cases and prosecutions are filed and defended as well as

IMA Issued Safety Warning for
Painkillers Usage
The Indian Medical Association (IMA) has advised the people to avoid
self-medication of Paracetamol and Aspirin for pain and fever management due to certain serious adverse events. The IMA guidelines are
applicable for non-steroidal anti-inflammatory drugs (NSAIDs) and
analgesic to common man's misconceptions. IMA also opposed the
central Government's decision that allows AYUSH doctors to prescribe
these painkillers. Health experts have raised safety concerns about the
potential risks including the liver, heart and kidney problems. The
scope of the guidelines is to educate the public about the potential
risks of self-medication, particularly NSAIDs. Although, painkillers are
extremely effective, self-medication causes more harm than benefits,
said Dr. Marthanda Pillai, National President of IMA. Paracetamol is
the one of the leading causative of suicides in the western countries.
As a combined formulation, the drug should not contain more than 325
mg, he noted. Self-medication of Aspirin can cause Reye's syndrome
(liver failure) in children. Public may not be aware of these problems.
Painkillers should be used judiciously and only under medical supervision, another expert noted. Even one dose of painkiller can precipitate
kidney failure in susceptible individuals, according to IMA guidelines.

In view of the current situation of spreading of Swine flu in
the country, CDSCO is continuously engaged in monitoring
the availability of drugs, vaccine and diagnostic kits used for
the control of Swine Flu. All State Drugs Controllers have

to take all necessary measures to ensure the availability of
the drugs, vaccines and diagnostic kits in the country. Any
dealer who has the license to sell, stock or distribute the
drugs specified under the Schedule X to the Drugs and
Cosmetic Rules, is authorized to sell the formulation of
Oseltamavir Phosphate used for the treatment and prevention of Swine Flu. A list of such license holders in various
parts of the country, as collected from the States in
December, 2009 by the CDSCO is attached herewith for
information of all concerned. Further all the State / UT

Quack Arrested in Mumbai For Selling

A self-proclaimed doctor was arrested here for allegedly manufacturing and selling spurious, misbranded and substandard Ayurvedic drug, the state unit of the
Food and Drug Administration said. The accused Munir Khan was held in a joint
operation by the FDA and the police, for contravening various provision of Drugs
and Cosmetics Act, FDA Commissioner Hrashadeep Kamble told. FDA has
charged Khan with contravention of various sections under Drugs and Magic
Remedies (Objectionable Advertisement) Act 1954 for advertising his product
called Body Revival Claiming to cure various ailments and diseases such as
heart disease, diabetes, tumor, epilepsy and making falls and misleading
claims, he said. The FDA had lodged three FIRs against Khan for contravention
of several provisions of the IPC and other medicine-related acts. On receiving a
tip-off that Khan was indulging in spurious drugs, a team of FDA officers raided
his premises at Versova, in Andheri West. The team found that Khan was selling his product ‘Body Revival’ for Rs. 15,750 per bottle of 100 ml, Kamble said.
The sample was drawn for test and analysis and the stock worth Rs. 3.3 crore
was prohibited as it was suspected to be not of standard quality. It was found
that Khan continued to advertise his product on electronic media and
claimed to treat and cure ailments, diseases, disorders such as heart
disease, diabetes, premature ageing, hypertension etc. Kamble said.
