Industry’s Best Honored at AMA Tributes
Awards Presentation
The Arizona apartment industry honored its best May 24 when the AMA presented 14 awards to rental communities
and individuals who "achieved a standard of unqualified excellence" in their
respective categories.

Judges for the 15th Annual AMA/Cox
Communications Tributes Awards considered several factors during the judging
process of the team and individual award
nominees, including: professional presentation, industry experience, industry education, problem-solving capabilities and
impact on property.
Honored as the best team and community for properties built between 2000
and 2006 was Trillium at Union Hills, a
201-unit property in Phoenix. Trillium
Residential, LLC manages the site.
Recognized as the best team and community for properties built between 1990
and 1999 was San Palmilla, a 372-unit

Education Conference and Trade
Show held May 23-24 at the Phoenix
Convention Center. Almost 1,000
members attended this year’s event.
Event Chairman John Rials said

Conference and Trade Show to the
AMA and the industry," he explains.

Domestic Violence
Early-Lease Termination
A new section added this summer to
the Arizona Residential Landlord and
Tenant Act will address domestic violence and early-lease termination. This
article will address A.R.S. 33-1318.
As a landlord, you should be prepared under certain circumstances to
allow your renter to terminate the
lease early. For residents to prematurely
terminate their lease and have management release them from future obligations under the rental contract, they
must comply with certain requirements.
Renters must provide to the landlord a notice indicating that they have
a valid lease scheduled to expire on a
certain date. Individuals must declare
under penalty of perjury that they are a
victim of domestic violence and that
the notice served is truthful and accu-
rate. Residents can then request early
termination on an effective date not
longer than 30 days from the date of
the notice.
The law requires residents to provide evidence to the landlord by one of
several methods:
Provide a copy of a protective order
issued in their favor and against the
person allegedly engaging in the
domestic violence.
Provide proof that they have provided a copy of the order to an authorized officer of the court to serve on the
perpetrator.
Provide a copy of a written departmental report from a law enforcement
agency that states the resident has
notified them that they are a victim of
domestic violence.
Individuals must indicate that the
action, events or circumstances that
resulted in them becoming a victim of
domestic violence occurred within the
30-day period immediately preceding
the written notice to the landlord.
The law deems the person named as
the perpetrator of the domestic violence to have interfered with the residential rental agreement between the
landlord and the resident, and this person may be civilly liable for all economic losses incurred by the landlord
for the early-lease termination. This
includes unpaid rent, early-lease termination fees and costs to repair damages
to the premises.
Renters must submit to management
the rent owed through the date of the
lease termination plus any previous
outstanding obligations. A landlord
can also withhold a security deposit

numerous benefits to its members.
And we’ve expanded and improved
some of our existing ones.
IMPROVED ONLINE EVENT
REGISTRATION
Our new online event registration
makes registering for AMA events
and seminars a lot easier. Launched
last month, the new events registration utilizes a "shopping-cart" feature
that allows individuals to register for
multiple classes in the same registration form. The form also allows for
registering additional guests.
Once completed and sent, the
Web site instantly processes the credit
card (management companies may
also request an invoice for their pur-

Many members use AMA leases
and other forms in the operations of
their rental properties. In additional
to AMA-developed and –approved
forms, members can also purchase
Blue Moon software and corresponding National Apartment Association
forms.
The AMA is in the process of
updating its forms and revamping the
forms-delivery program. The form
content is being developed by a task
force composed of management company representatives and member
attorneys. Prior to publication, the
forms will be submitted to the
Arizona Department of Real Estate
and the courts for their review.
Once the updating is complete, we
will no longer offers hard copies of
the forms for purchase; rather, the
association will go completely electronic. It will continue to offer both
the free downloadable, blank copies
of the forms and an enhanced online
delivery mechanism.
Members will be able to purchase
all the forms they need for an individ-
ual lease transaction for $6 per set.
The forms will be purchased with a
credit card, completed online, and
then a PDF file of the completed documents will be created to save on
your computer and print.
Additionally, the interactive subscription program is being enhanced.
The program will store property information, which will automatically
populate the document fields.
Members can purchase an annual subscription for unlimited lease sets for
$89 per property location.

in the Forms page in the Member
Area of www.azama.org.

PROJECTIONS NOW ON SEPT. 13

Perspectives and Projections, the
AMA’s economic and apartment
industry outlook conference that provides attendees with the information
they need to operate their properties
and investments successfully and profitable. Previously scheduled for Sept.
12, the event is now on Sept. 13. The

Continuing on the success of past

Teams of judges selected the winners
from a total of 213 entries from 27 management companies plus 41 nominees for
the community and developer categories.
Among the factors the judges reviewed
were written recommendations from the
nominees’ supervisors and results of tworounds of in-depth interviews with the
finalists. They considered each candidate’s professional presentation, industry
experience and education, job knowledge
and problem-solving skills.
The AMA also presented two awards
to recognize outstanding volunteer efforts
and achievement in the association.

‘AMAzing’ Drive Brings in New Members, Units
Participating teams and individuals helped strengthen the AMA by
bringing 6,941 units, 33 new Regular
members and 43 new Associate
members into membership during the
third annual AMAzing Race
Membership Drive.
As in past years, the March 19-
April 30 program utilized a car racing
format as member management companies formed teams comprised of a
captain and pit crew. Teams gained
laps for new members signed into
membership. Twelve teams representing 11 management companies competed in this year’s drive. AMA

In our perfect world, there is a lease in
place and a renter who not only remembers what it says, but knows about the
Arizona Residential Landlord and Ten-
ant Act. It amazes me that when an
issue arises, the resident typically runs off
assumptions of what the rules and laws
are, almost to the point of not recognizing our lease was actually created based
on the law.
When renters have money issues, the
rental agreement seems to gray up their
mind. In the event the individual is having a cash-flow problem, one of the first
lines of a plan should include communicating to the landlord as soon as possible. Much aggravation and money could
be saved by working together to resolve
the issue.
In my office, rent is due on the first
day of the month and late on the second
day of the month. If a resident knows
rent will be late and he or she calls, we
make arrangements for the individual to
sign a five-day notice without a fee. Of
course, this means we work it out without the use of a process server or certified mail. In our case, we have the form
at one of our offices for them to walk in
and sign or we fax it to them to sign.
Once the five-day notice is signed,
our team is ready to go forward should
the resident defaults on the terms of our
agreement. Depending on the situation,
the lease and notice is faxed to an attorney to start the eviction process. This
typically gives the resident another 10
days to come up with the rent and associated fees. I have even accepted rent
and all associated fees once we have
entered a judgment. Our ultimate goal is
working with a good renter within the
guidelines of the law to collect the rent.
For our resident, paying rent and the
extra fees is less expensive than moving
and still having a judgment on his or her
credit report until paid.
If we had chosen to negotiate for rent
to be paid on the seventh day of the
month and had not followed through
with the legal notices, and the individual failed to pay on the agreed date, our
eviction process would be delayed, possibly by 15 days.
It is essential to communicate life
changes. Perhaps a family member needs
to move in. Moving people not identified as occupants into the unit is definitely against our lease. We may need to
run a criminal check on the new occu-
pant. In the event it’s not a one-bedroom with three new occupants, we
probably wouldn’t have an issue if it is
communicated in advance. The problem
arises in the event we find out when our
attention is drawn to the lease violation.
Whatever the issue, working towards a
compromise with a positive attitude
makes life so much easier. Even if the
result is moving with a plan in place, the
property might be able to be marketed
sooner, expediting the re-leasing process
and cutting the final bill owed by the resident for possibly breaking a lease. AMA

Results of the 2007 Arizona Legislative Session

Numerous proposals introduced in
the 2007 legislative session were of
interest to the multi-housing industry.
The AMA was the sponsor of two of
these proposals. The following is an
update of the legislation.
SB1085 - Constable Ethics
Committee. An unintended consequence occurred as a result of the
recent justice of the peace court consolidation efforts in Maricopa County.
The distance from the court to a property has increased, the greatest impact
of which is in the West Valley.
Currently constables and sheriffs may
charge $16 for the first six miles and
$2.40 for each additional mile traveled
to deliver a writ. Because distances
from the court to the property have
more than doubled, there has been a
significant increase in cost to the industry. The AMA identified SB 1085 as a
vehicle bill the Legislature could
amend to address member concerns
regarding the mileage fees imposed to
deliver writs and special detainers. The
state House of Representatives amended the bill to require Maricopa County
justice of the peace courts to assess
mileage fees once the constable enters
the precinct, as opposed to the mileage
assessed from the actual courthouse.
Gov. Janet Napolitano signed the bill
on April 27.
SB1227 - Domestic Violence Early
Lease Termination. Senate President
Tim Bee, R-Tucson, and Sen. Jim
Waring, R-Phoenix, introduced legislation developed by the AMA and the
Arizona Coalition Against Domestic
Violence. Though the version introduced was not the agreed-upon bill,
amendments to the bill addressed lingering concerns. Arizona is now one of
many states that have addressed this
controversial issue. Association members have gone above and beyond the
call of duty to work with the Coalition
to develop early-lease termination legislation that will allow victims of domestic violence get out of their lease early
as long as they achieve a specific burden of proof. The governor signed the
bill on April 18.
SB125 - Landlord-Tenant
Amendment. A strong supporter of the
apartment industry, Sen. Barbara Leff,
R-Paradise Valley sponsored the AMA’s
proactive landlord-tenant legislation.
As is always the case with bills amending the Arizona Residential Landlord
and Tenant Act, this one is controver-
sial, to say the least. When we open
landlord-tenant law, there is always the
assumption on the part of many legislators that we are attempting to take
away renter rights. The bill as introduced contained several provisions—
practices currently being imposed as a
condition of the rental agreement, but
not codified in state statutes. Provisions
included requirements for purchasing
rental insurance; allowing for earlylease termination fees; and requiring
the renter to supply a contact name to
handle personal possession should he or
she die during the lease term. The bill
also clarified existing provisions for
both landlords and renters.
The first Senate Commerce
Committee hearing was controversial,
with many Committee members raising
concerns about several bill provisions.
Following the hearing, the AMA
decided to remove the more controversial parts of the bill and continue with
five provisions felt to be the most
important (though still controversial
and opposed by the Morris Institute.)
Following the April Government
Affairs Committee meeting, the
Committee recommended further
amendments and removed the most
controversial provision regarding the
landlord requirement to keep the premises fit and habitable. The four remaining provisions include:
(1) 33-1314.F. It allows a landlord to
request a renter to name a person in his
or her lease who is responsible for the
renter’s personal possessions should the
individual die or become disabled.
(2) 33-1321. During the term of the
tenancy, the landlord may use the
refundable security deposit in accordance with any applicable property
management agreement.
(3) 33-1341. It requires a resident to
notify a landlord of maintenance issues
in need of repair.
(4) 33-1343. It stipulates that once a
resident notifies a landlord of a maintenance request, it constitutes the twoday notice to enter the unit only for
repair or inspection of the maintenance
request.
The bill cleared the Senate with a
vote of 22 "yes" and five "no" votes.
The bill as amended above with the
four provisions cleared the House 58-0.
Gov. Napolitano signed the bill on May
24. The AMA thanks member who
sent e-mails to their senators and representatives requesting support of the bill.
HB2361 - Landlord Tenant
Forcible Detainer Actions. This bill is
a joint effort by the AMA and the
Manufactured Housing Communities of
Arizona (MHCA) to address concerns
raised in a 2005 unscientific study conducted by the Morris Institute titled,
Eviction in No Time. This bill has also
had its fare share of controversy and
amended at least 12 times since introduction. The AMA and MHCA decided to hold this bill and not move it forward this year due to the controversial
nature and degree of complexity. It is
virtually impossible for elected officials
to understand such a controversial and
complicated bill in the limited amount

Recent Changes to the Arizona Residential
Landlord and Tenant Act

HB 1225, the AMA’s proactive legislation
that addresses concerns in the Arizona
Residential Landlord and Tenant Act
(ARLTA). This article will examine these
changes.
33-1314(F) DEATH AND PERSONAL PROPERTY
What if a single-occupancy resident
dies in his or her rental unit? What can
you do regarding the personal property
left behind? This new statute provides a
little help.

the renter may provide—contact information of a person authorized by the resident
to enter the dwelling unit and retrieve
and store the renter’s property should he

she dies. (This request is not a requirement for either party.)
If management cannot contact the
authorized person at the address and
phone number provided, or if the authorized person fails to respond to management’s request within 10 days, then the
landlord must still abide by the provision
of the abandonment statute, 33-1370, to
dispose of the property.
If the authorized person comes to
retrieve the property, that individual must
present to the landlord a valid government-issued identification confirming
that person’s identity before he or she can
retrieve the property.
The next part of the new law is contradictory to the proceeding paragraph.
Once management provides the author-
ized person written contact, he or she has
20 days or the last day for which rent is
paid, whichever is longer, to remove the
property and return the keys during regular business hours. The landlord then has
no further liability to the renter, his or her
estate or heirs for loss, damage or stolen
property. However, if the authorized person does not entirely remove the property,
the landlord still must abide by the abandonment statute.
Section F only applies if the periodic
rent is unpaid and outstanding for at least
five days. Therefore, Section F is really
only helpful to the management if the
authorized person actually removes all the
property quickly and returns the keys.
Remember, if the authorized person
does not retrieve the personal property,
the landlord cannot just discard the property. He or she must follow the Public
Sale Statute in 33-1023, unless specifically provided for in a written agreement
that states that the landlord may destroy
or otherwise dispose of some or all of the
property if the value of the property is so
low that the cost of moving, storage and
conducting a public sale exceeds the
amount that would be realized for the
sale.
33-1321(D) SECURITY DEPOSITS
The changes here are minor. Unless
the renter makes other arrangements in
writing, the landlord shall mail the itemized list and any amount due, by first-class
mail, to the renter’s last place of residence.
The statute simply replaced "regular" mail
with first-class mail. However, for documentation purposes, we recommend that
if you send the itemization and amount
due by first-class mail, make a copy of the
first-class mail envelope with the date
stamp that shows when and where you
sent it. Otherwise, consider sending it via
certified mail. It is always good to have
proof, even though the statute only
requires first-class mail.
33-1321 (G) SECURITY DEPOSITS
CONTINUATION
This new section addresses security
deposits. During the tenancy, the landlord
may use refundable security or other
refundable deposits in accordance with
the property management agreement.
This statute modification mainly
addressed and provided for compliance
with certain Arizona Department of Real
Estate rules.
33-1341(8) REPAIR REQUESTS
This section more evenly distributes
the burden regarding a request for repair.
It also stops the games that some renters
play when they deliver to the landlord a
long list of allegations of needed repairs—
even false ones—and demand that management makes those repairs within 10
days if they violate the lease or within five
days if they are health- and safety-related.
When the landlord attempts to make
these repairs, however, the renters do not

addressing AMA and MHCA concerns
with the State Bar of Arizona, which is
currently working on rules for forcible
detainer actions. This will be an issue
that we will continue to monitor at the
State Bar as well as the Arizona
Superior Court. (The State Bar recently released proposed rules for handling
evictions. The AMA Government
Affairs Committee will discuss this document at the next meeting on July 12.
HB2252 - State Plumbing Code;
Municipalities. The association has
opposed the dysfunctional state plumbing code virtually since its inception in
1997. HB2252 will repeal the code and
the Arizona Uniform Plumbing Code
Commission, thereby permitting
municipalities to adopt local plumbing
codes. The governor signed this action
on April 10.
HB2406 - Contractor Retention.
This bill, similar to ones proposed and
defeated in previous years, in its introduced form attempted to eliminate contractor retention by reducing the
amount a general contractor can retain
from a subcontractor to five percent
from 10 percent and requiring an interest-bearing account for each subcontractor. Many construction industry
groups oppose this bill, and we are
working in concert to amend the bill to
address all concerns. Sen. Pam
Gorman, R-Anthem and chairwoman
of the Senate Finance and Insurance
Committee, ultimately held the bill.
We are working with the sub-contractors to develop consensus legislation
and believe that we may have develJULY 2007
oped an agreement that will allow owners and generals to retain 10 percent
until construction completion—which
parties will need to define in each contract—and upon invoice by the subcontractor. If approved and signed by the
governor, this compromise legislation
will require owners and general contractors to adjust all contracts.
HB2607 - Contractor Indemnity.
The bill would change provisions in
construction contracts and shift liability for construction defect entirely to
the owner and general contractor. Like
the aforementioned contractor retention proposal, we’ve seen this bill introduced at least every year for the past
seven or eight years. This year’s version,
however, did clear the House. The
same parties opposed to HB2406 have
successfully worked to defeat this bill,
which also did not get a committee
hearing in the Senate.
SB1423 - Municipal Impact Fees.
We have been working with many
stakeholders, including municipalities,
homebuilders, the National Association
of Industrial and Office Properties and
Valley Partnership, to develop consensus legislation to reform the existing
ambiguous state statues that allow a
municipality to impose development
impact fees. The governor signed the
legislation on April 24.
SB1047 - Private Investigator
Licensing. As drafted, this bill would
have required a credit bureau, tenant
background check companies and even
property management firms conducting
background checks on behalf of an
owner to become licensed private
investigators. We were able to work
with the bill sponsor and the Arizona
Department of Public Safety to amend
the bill to our satisfaction. Gov.
Napolitano signed this bill on April 18.
SB1521 - Civil Actions; Sheriff’s
Fees & Process Servers. This bill in its
current form will allow private process
servers to charge a fee of $3.60 per mile
if no other fee is negotiated. The AMA
feels that this bill will have significant
impact on the expenses associated with
evictions. The strike-everything
amendment cleared the House Judiciary
Committee, and we were able to defeat
the proposed legislation on the floor of
the House with a 40 "no" and 15 "yes"
vote total.
SB1544 - Municipalities;
Construction Sales Tax. Introduced on
behalf of the Homebuilder Association
of Central Arizona, it requires that
municipalities that charge an additional
sales tax on construction contracting
activities use these monies collected
only for new development infrastructure
improvements. The bill was defeated in
the House.
SB1359 - Municipal Utilities;
Tenant Nonpayment. A number of
municipalities have required the landlord to pay unpaid utility bills—which
are the responsibility of the lessee—as a
condition of providing new service or
restoring service in the landlord’s name.
This bill faced opposition in the House;
the House Government Committee
defeated the proposal. The Goldwater
Institute is considering filing a lawsuit
against one or more of the municipalities that hold the landlord responsible.
The AMA contacted members of its
Independent Rental Owners Council, a
few of which experienced this. The
association anticipates introduction of a
similar version of SB1359 next year.
During the summer months, AMA will
meet municipalities to address this
issue.
SB1552 - Air Quality Program.
The primary concern for AMA mem-

bers in this bill is the use of gasoline
powered leaf blowers. The bill in its
original and subsequent draft forms
would have eliminated the use of leaf
blowers on no burn days and penalized
property owners if operators used the
equipment in violation of the law. Just
from the House and Senate Joint
Conference committee, it will go to a
vote in both the House and Senate. In
the current form, the state will no
longer cite the property owner for the
violation; it will hold leaf-blower operator responsible. Properties in Maricopa
County and Pima County can no
longer allow landscapers or maintenance workers to operate gasoline leaf
blowers on no-burn days, nor can it
allow workers to blow debris into the
public roadway. Operators will need to
complete an Arizona Department of
Environmental Quality-approved certification on or before December 2008
and recertify at least every three years.

Review List of Provisional AMA Members
Editor’s note: All applicants who are applying to be Regular or
Associate members of the Arizona Multihousing Association must
complete the application and pay applicable dues. The applicant shall
agree to abide by the provisions of the Articles of Incorporation, the
Bylaws of the association, and by the Code of Conduct prescribed by
the association.
The applicant will then be classified as a Provisional member.
During this period, the Provisional member will have the rights and
responsibilities of full membership.
Within 60 days of applying for membership, the names of the Provisional members will be published in Apartment News, and existing
members will be encouraged to provide comments on the suitability
of the application.
If no negative comments are received from existing members
within 90 days of membership application, the Provisional member
will be deemed automatically approved into membership.
If any negative comments are received, the Ethics Review Board
must review the application within 120 days from the receipt of the
negative comment and recommend to the Board of Directors the
acceptance or rejection of the application. If the Ethics Review Board
does not recommend acceptance of a Provisional member, the Provisional member must be notified and given the opportunity to request
a hearing pursuant to the Bylaws.
If the directors reject an applicant, the AMA refunds all membership fees paid except for a $35 application-processing charge.

UESTION We have two residents
who vacated their apartment and turned
in the keys. We determined that there
were damages to the unit. The individuals now want access back into the apartment to have their own vendors make
repairs. Do we have to let them in?

If there are multiple residents who
are parties to the rental agreement
being terminated, the tenancy for those
individuals also terminates. The landlord may enter an agreement with them
to sign a new lease, so long as they meet
all current application requirements.
The big problem for management is
pursuing the perpetrator who caused
the early termination. Most landlords
are not going to want to incur the cost,
expense and time to pursue a third
party. However, it is important that
management allow the renter who is a
victim of domestic violence out of the
lease agreement.
Fair housing laws say it is
unlawful to refuse to make a "reasonable
accommodation" to enable a disabled resident an equal opportunity to live there.
This means you need to make a reasonable
exception to your rules when it will enable
a disabled renter to reside there. A common
request is an exception to pet restrictions
for an assistive animal. If the disability and
need for the animal is apparent, you must
allow it if it won’t unreasonably disrupt
your business. However, if it’s not apparent, you can ask the resident to provide
medical evidence of the disability and of the
nexus between the disability and the
requested accommodation. Once a medical
provider gives you a statement that the
renter has a disability and how the accommodation will help, make no further
inquiries. Although you may suspect the
whole situation is bogus, you ordinarily
need to accept the medical provider’s statement and allow the exception. AMA

Consider the following example:
Sue Nomie and Harry Cain rent a
unit at the Ship Wreck Apartments.
Manager Stormy Weather informs them
she runs a quiet community. Harry Cain
decides he needs greener pastures and
starts seeing another resident, Summer
Pain. A big argument breaks out
between Sue Nomie and Harry Cain.
The police arrest Harry Cain for domestic violence and Sue Nomie gets a
restraining order from Judge Wendy
Storm. Sue Nomie gives the proper
notice, pays rent and moves. Harry
Cain, who is now unemployed, tries to
stay in the apartment, but Stormy
Weather evicts him. AMA

make themselves available for service of a
notice to access the premises.
Now, renters will have a duty to notify
the landlord of any situation or occurrence that requires management-provided
maintenance or repairs or that would otherwise require the landlord to take action
pursuant to Section 33-1324, which outlines management’s duties in keeping the
premises in habitable condition. The following paragraph ties the resident’s duty
to notify the landlord with the landlord’s
right of entry:
33-1343(B) ACCESS BY LANDLORD
If the Tenant notifies the Landlord of a
service request or request for maintenance as
set forth in section 33-1341 paragraph 8, the
delivering of notice to the Landlord from the
Tenant constitutes permission from the Tenant for the Landlord to enter the dwelling unit
for the sole purpose of acting on that service
or maintenance request.
This means exactly what it says. Once
a resident delivers to the landlord a notice
of needed repairs, the landlord can then
access the apartment or home after 48
hours of delivery of the notice to make
the repair. Common courtesy would suggest that upon receiving the notice, the
landlord simply contacts the resident and
lets him or her know when management
will be accessing the unit (although it is
not a requirement). It is not necessary

that the renter be present when the landlord or vendor accesses the premises after
receiving his or her notice. However, to
avoid any strange allegations or possible
liabilities, it is best to access with at least
two people if at all possible, especially if
the renter is not home.
Residents oftentimes do not make
landlords aware of needed repairs that can
cause greater damage to the property,
which could have been resolved very easily had he or she notified the landlord at
the time of the occurrence. This change
in ARLTA puts the duty upon the resident to notify the landlord of repair
issues. Once notified, the notification
acts as if management gave the renter a
48-hour notice to inspect. However, if the
resident delivers the landlord such a
notice and it reasonably sets forth an
emergency situation, then management
may immediately enter and not have to
wait the 48 hours. AMA
