STRATEGIC LEADERSHIP
ABOTA is in a battle to preserve the right to trial by jury. Can understanding and
implementing the primary lessons expressed in Sun Tsu 's 2500 year old book on
strategy, The Art of War, improve our chances for a successful outcome? One of our
speakers, General Charles Krulak, (31st Commandant of the U.S. Marine Corps and
former member of the Joint Chiefs of Staff) required all his officers to read and
study this book because he believes Sun Tzu's basic tenets stand the test of time.
They do not focus on specific tactics or specific operational issues. They focus on
those things that are key to success in any conflict - strategic leadership qualities.
ABOTA members are leaders of leaders. Even so, there is much we can learn on
managing conflict wisely, efficiently and victoriously. The 2016 SEABOTA Annual

COOKING SCHOOL AT THE GRAND BOHEMIAN
Birmingham chef Clif Holt will teach classes in everything from preparing party hors d'ouvres to planning a holiday
feast in the hotel's cooking school. Class participants may sit around the chef's counter for an up-close-and-personal
cooking lesson as Holt shares some of the secrets of his trade. The classes, which are open to guests and non-guests
alike, may accommodate as few as six or eight participants and as many as 25. Each class will last about an hour
and a half to two hours.

JAMES R. ANDREWS, M.D.
Dr. Andrews is one of the founding members of Andrews Sports Medicine and Orthopedic Center in Birmingham. He is also
founder, chairman and medical director of the American Sports Medicine Institute (ASMI) a non-profit institute dedicated to
injury prevention, education and research in orthopedic and sports medicine. In addition, he is a founding partner and
medical director of the Andrews Institute and the Andrews Research and Education Institute.
Dr. Andrews is internationally known and recognized for his skills as an orthopedic surgeon as well as his scientific and clinic
research contributions in knee, shoulder and elbow injury prevention and treatment. In addition, he has made numerous
presentations around the world, and has authored hundreds of scientific articles and books. He also recently wrote Any
Given Monday, based on his life in sports medicine.

W. MICHAEL ATCHISON
In a career spanning almost four decades, Atchison's dedication to civil trial litigation has resulted in his being lead counsel
in a variety of cases throughout the Southeast in both state and federal courts. These include securities class actions,
commercial and business disputes, products liability, aviation accidents and crashes, pharmaceutical products, employment
discrimination and professional negligence. Atchison has held first chair status in several "bet the company" cases and is
generally considered as the lawyer other Alabama lawyers seek to retain when threatened with litigation or ethical problems. He has been listed in The Best Lawyers in America® for 17 consecutive years.
Mr. Atchison will speak at 10:15 on Saturday on Professioinalism - elevating the ABOTA standards of integrity, honesty

HON. JOHN CARROLL
John L. Carroll is a man of high ideals, exemplary standards and a commitment for giving back. He is former dean of Cumberland School of Law in Birmingham, Alabama, and has recently to teach. He received his undergraduate degree from
Tufts University and holds law degrees from the Cumberland School of Law at Samford University (J.D.) (Magna Cum Laude)
and Harvard University (LL.M.). Prior to his appointment as dean, Carroll served as a federal trial judge for more than14
years in the position of Chief U.S. Magistrate Judge for the Middle District of Alabama. Carroll was also appointed by Chief
Justice William Rehnquist to serve on the Judicial Conference's Advisory Committee on the Federal Rules of Civil Procedure,
one of seven federal judges to do so. (This Committee analyzes and makes recommendations to United States Supreme
Court and the United States Congress on possible modifications to the Federal Rules of Civil Procedure). He is a decorated
Marine, flying over 200 missions during the Vietnam War.
Hon. Carroll is a frequent lecturer and panel member at national and local seminars on the subject of the discovery of
electronically stored information, mediation, ethics and other topics relating to federal courts. He will join us on Saturday
morning at 10:45. His topic will be Ethical Battle Armour.

GENERAL CHARLES KRULAK
You cannot lead by memo, you cannot lead by shouting, you cannot lead by delegation of
your responsibility -- you must lead by example.

The subject of leadership has been much analyzed, debated, and recorded. Problem is, very few individuals who actually
lived it and "gets it" shout from the rooftops, and are often drowned out by the many superficial, self-proclaimed experts
trying to sell their wares. Too much input is often as bad as too little.
General Charles C. Krulak, the 31st Commandant of the Marine Corps, has certainly lived it and "gets it." During his 35
years in the Marine Corps, Gen. Krulak served in the Vietnam War and Operation Desert Storm, and received numerous
medals and decorations, including the Defense Distinguished Service Medal, Distinguished Service Medal, Silver Star
Medal, Bronze Star Medal, and Purple Heart. His notable commands are 3rd Battalion 3rd Marines, 2nd Force Service
Support Group, Marine Forces Pacific, Marine Corps Combat Development Command (MCCDC), and of course, Commandant of the Marine Corps.
General Krulak explained some of his warfighting philosophy in an interview with Tom Clancy in Clancy’s nonfiction book
Marine. Clancy referred to General Krulak as “Warrior Prince of the Corps”.
Since retirement, General Krulak has served as President, MBNA bank, Europe; President of the Cleveland Browns NL Team;
President of Aston Villa, England Football Club and President of Birmingham Southern College. General Krulak will join us
on Friday, April 15 at 10:00 a.m. and will speak on Strategic Leadership. At the end of his talk, General Krulak will take
questions on any subject you want him to talk about, such as ‘What we can do about ISIS’, etc!
CHIEF JUDGE TOM MARTEN
President Bill Clinton appointed Tom Marten as United States District Judge for the District of Kansas in January 1996. He
is a graduate of Washburn University (B.A.) and Washburn University School of Law (J.D.). He served as law clerk to retired
Associate Justice Tom C. Clark of the United States Supreme Court, before beginning nearly 20 years of general private
practice with an emphasis on litigation, principally with Bremyer & Wise, P.A. in McPherson, Kansas (1981-96).
Since his appointment, Judge Marten has handled a wide range of civil and criminal litigation. He serves on the Rules of
Evidence Advisory Committee of the Judicial Conference of the United States and on the Advisory Board of the Sedona
Conference, and has completed terms on the Information Technology Committee of the Judicial Conference of the United
States and on the Board of Directors of the Federal Judges Association. He has taught at Wichita State University and the
Department of Justice Trial Advocacy Center, has lectured at National University of Ireland, Galway, and has been a
frequent speaker at conferences and seminars throughout the country, including ALI-ABA’s Antitrust and Employment Law
workshops, and the Sedona Conference Seminars on Complex Litigation and Antitrust. He is a founding member of the
Wesley E. Brown American Inn of Court in Wichita, Kansas. For more than thirty years, he has taught trial advocacy at
various programs and workshops throughout the United States, including Harvard Law School since 1989. He became chief
judge of the District of Kansas in April 2014.

DON SCHLITZ
Don Schlitz is a Grammy award winning, singing, smiling monopoly.
For one thing, he's the only one writing Don Schlitz songs, the lyrics of which have been quoted by presidents and pundits,
actors and ballplayers and Muppets and preachers and others. Schlitz wrote a song called "The Gambler" long ago (no,
not on a warm summer's evening: He wrote it in the afternoon), and that one possesses what may be the most-quoted chorus
in American song. It is at his shows where Schlitz extends his monopoly. He's not only the only one writing Don Schlitz
songs, he's the only one singing them from the inside out, and sharing the stories behind them. He's the only one illuminating
the songs and the moment and in somedays an entire music city with a delivery that is hilarious, elliptical and heartfelt. And
the delivery changes each night, just like the set list.
Don will join Judge Tom Marten on the podium Saturday, April 16 at 9:00 am speaking on the Art of Communication. Don

RETIRED CHIEF JUSTICE GARY R. WADE
Justice Gary R. Wade took his seat on the Tennessee Supreme Court in 2006 after appointment by Gov. Phil Bredesen.
While on the Supreme Court, Wade served a two-year term as chief justice after other members of the Court elected him in
September 2012. His extensive career included appointment to the Court of Criminal Appeals in 1987, where he was the
presiding judge from 1998 to 2006. Wade was the president of the Tennessee Judicial Conference from 1995 to 1996 and
is the founder of the Tennessee Judicial Conference Foundation, which provides scholarships to Tennessee state law schools
for need-based students.

HON. WILLIAM G. YOUNG
Honorable William G. Young, Judge of the United States District Court, District of Massachusetts, has been an active trial
judge for more than 25 years, serving on both the Massachusetts Superior Court (1977-85) and the United States District
Court for the District of Massachusetts (1985-present). After receiving his A.B., magna cum laude, from Harvard University
in 1962, he served two years as an officer in the United States Army. His legal career began in 1967 when he was admitted
to the Massachusetts bar upon graduating from the Harvard Law School.
A longtime teacher of evidence and trial advocacy, he has taught at several law schools including Harvard, Boston College,
and Boston University. Commonly referred to as the Education Judge, he is active in judicial education at the Federal Judicial
Center and the Flaschner Judicial Institute. Moreover, he volunteers much of his time to educating the bar and has been a
staple at continuing legal education programs and institutions including Virginia Continuing Legal Education and the Practicing Law Institute (PLI). He has won national acclaim for his work on the Massachusetts Continuing Legal Education's
annual lecture series On Trial with Judge Young, which offers each fall an intensive 15-week study of trial techniques and
trial evidence.
In addition to teaching in the classroom, Judge Young has written extensively. He is a much sought after, passionate and
profound speaker on the subject of our 7th amendment right of trial by jury.
Judge Young will kick off our 2016 SEABOTA Annual meeting at 8:30 on Friday, April 15, as he speaks on Where we are
in the conflict to preserve 7th Ammendment rights. Judge Young will also participate on our panel discussion Saturday
morning along with Judge Marten. The panel will focus on proper strategic policies for combatting the efforts to deprive
citizens of their rights to have their cases heard by a civil jury.
