All employees shall be familiar with all policies and regulations established by the Board of Education. As a condition of employment, employees agree to follow rules and regulations established by the Board. A complete copy of all compliance publications is available for review from all district school offices. Buhler USD 313 Support Personnel or “Classified” employees are “at-­‐will” employees. The state of Kansas is an employment at will state which means employers can discharge employees for any non-­‐discriminatory and/or non-­‐retaliatory reason, with or without notice, and employees can leave the employer’s employment at any time, for any or no reason at all, with or without notice. Application for Employment and Interview An on-­‐line application form must be filed with the Office of Personnel Services. Applications are kept active for one year. An interview will be held with a member of the administrative staff and/or the Director/Supervisor of the department where the position exists. When an applicant is interviewed for a specific position, a job description will be presented for review, and related duties will be explained by the person conducting the interview. Different qualifications apply to various positions. If selected for employment, the applicant will be notified by the personnel office or the department where the position exists and a written offer of employment will be signed. Although an employee may begin work upon a provisional basis if approved by the administration, the employment of any person is not official until the offer of employment is approved by the Board. Any offer of employment is contingent upon the satisfactory outcome of the criminal background check, when required by the district. The district has the sole and absolute discretion to determine whether the outcome is satisfactory. Employment Procedures Process New Employee All new employees will be required to furnish the Personnel Office with the following before the first day of employment: 1. Certificate of Health for School Personnel 2. Employee’s Withholding Allowance Certificate Form W-­‐4 and K-­‐4 6
3. I-­‐9 Immigration and Naturalization Service Form with copies of approved identification documentation as listed on the form 4. Direct Deposit Authorization Form 5. Criminal Background Records Check Request Form The Classified Staff Handbook will be given to every new employee and will also be available to all staff on the district website: www.buhlerschools.org

A working environment is to be maintained which is free from discriminatory insult, intimidation, or harassment due to race, color, religion, sex, age, national origin, or disability. Physical Examination Requirement K.S.A 72-­‐5213 Certificate of Health for School Personnel: “Every Board of Education shall require all persons, whether employees of the school district or under the supervision thereof, who come in regular contact with the pupils of the school district, to submit a certification of health signed by a person licensed to practice medicine and surgery under the laws of any state on a form prescribed by the Secretary of Health and Environment. The certification shall include a statement that there is no evidence of physical condition that conflict with the health, safety, or welfare of pupils; and that freedom from tuberculosis has been established by chest x-­‐ray or negative tuberculin skin test. If at any time there is reasonable cause to believe that any such person is suffering from an illness detrimental to the health of the pupils, the School Board may require a new certification of health.” If the Board has a good faith doubt concerning the health of any employee, a new certificate may be required. The expense of obtaining Certification of Health will be borne by the school employee. Placement on Pay Schedule Classified Personnel will be paid in accordance with the pay ranges on the Entry Level Wage Schedule approved by the Board of Education (see Entry Level Wage Schedule, p. 45. Appendix A). Consideration of the ability, performance, responsibility and experience of employees will be taken into account in establishment of individual pay within the ranges approved by the Board of Education. 7
New employees to the district may be placed at a rate of pay above the beginning pay range in accordance with their training and experience. Instructional Paraprofessional Classification In 2013, USD 313 adopted a Paraprofessional Pay Grade based on education. Paraprofessionals are now classified as follows: Paraprofessional I -­‐ is a high school graduate Paraprofessional II -­‐ has 48+ college credit hours Paraprofessional III – has a 4 year degree College transcripts must be submitted to the district office upon hire in order to be initially placed at Level II or Level III. A Paraprofessional may request movement from one level to another by September 1 of any year. Official transcripts must be submitted for any movement. Wages and Time Schedules The Board delegates authority to the business manager to develop time schedules for all classified employees, subject to approval by the superintendent. Time schedules will be assigned at the start of the employment term. Wages and work schedules will be reviewed annually by the Board. Workload Assignments Work load assignments for clerical, paraprofessional, maintenance, food service, custodial and transportation employees shall be made by the business manager after evaluation of personnel positions. Designated Supervisors All support staff personnel shall be assigned an immediate supervisor. The school principal is the immediate supervisor for most clerical and paraprofessional positions. The principal may delegate a portion of the supervisory responsibilities to teachers or others working directly with the employee but the ultimate authority remains with the principal. In areas where specific directors/supervisors are designated (food service, transportation, maintenance, custodial) the supervision may be coordinated with the principal involved. Keys / Key Cards / Identification Badges All staff assigned to a building equipped with a card reader access system will receive a Key Card/Identification Badge that is to be worn while at work. This card will give them access to their assigned building during the hours associated with their position. The initial key card is paid for by the district. Should a key card need to be replaced the employee will be charged a replacement fee of $7.00 that will be payroll deducted. Key cards must be returned to the district office when an employee is no longer employed by the district. Key cards must not be 8
loaned to others. Lost or stolen key cards must be reported immediately so measures may be taken to maintain safety and security and to protect district property. Staff assigned to other buildings will be issued keys and a separate identification badge that is to be worn while at work. No keys shall be duplicated without permission. Keys must be returned to the appropriate supervisor when an employee is no longer employed by the district or is assigned to another building. Keys must not be loaned to anyone. Lost or stolen keys must be reported immediately so measures may be taken to maintain safety and security and to protect district property. School Bus Drivers Physicals A pre-­‐employment physical is required of School Bus Drivers and Substitute School Bus Drivers. Following employment, a physical examination is required every two years. USD 313 will reimburse the cost of the Department of Transportation (DOT) physical upon hire and once every 2 years thereafter. Present employees transferring into a School Bus Driving position will be required to obtain a DOT physical. License Certification It shall be the responsibility of all school bus drivers to annually provide documentation of the validity of license certification by the Kansas Department of Revenue. New drivers will receive reimbursement for the cost of their initial CDL license. If a school bus driver’s license is suspended or revoked at any time, such suspension or revocation shall be immediately reported to the Transportation Director and the driver shall cease driving a school bus until the license is restored. Drug Testing All district employees performing job functions which require the employee to maintain a commercial driver’s license shall be tested for alcohol and drugs as required by current federal law. Each new employee who is required to undergo alcohol and drug testing shall be given a copy of the appropriate regulations. Compliance with the required elements of the testing program is a condition of employment as a driver in the district. Attendance All employees are expected to be regular in attendance and to be at their assigned workstations through the duty day. When it is necessary for an employee to be absent, the employee is expected to notify his/her supervisor before the start of the scheduled work shift. Absences which are without pre-­‐approved leave and absences which extend beyond the leave balance for the specified reason are subject to review by the immediate supervisor and/or Personnel Office. 9
Overtime Overtime will be scheduled and must be approved by the employee’s immediate supervisor and will follow procedures as defined in the Fair Labor Standards Act (FLSA). According to FLSA overtime pay requirements, employees receive overtime pay for hours worked in excess of 40 in a workweek (designated as Monday -­‐ Sunday) at a rate not less than time and one-­‐half their regular rates of pay. Compensatory time will be allowed at the discretion of the supervisor. Timesheets and Pay Procedures Each employee shall keep track of hours worked on a paper or electronic timesheet. Timesheets shall be turned in to the building secretary on the last working day of the month. Payment of wages will be on or before the 15th day of each month. Paystubs, W-­‐2 and leave information can be viewed online using the Employee Services Portal located at www.mypaydocs.com. Contact the Benefits Clerk at the District Office with questions about enrolling and using this service. Data Changes 1. Support personnel must notify their supervisor and the Payroll Office in writing of any changes in name, address, or telephone number 2. Any changes in direct deposit information, W-­‐4 or K-­‐4 withholding must be submitted in writing to the Payroll Office by the 4th of the month in order to be reflected on the next payroll. Assignments and Transfers The Board reserves the right to assign, reassign or transfer all classified employees. Employee Requested Transfer An employee requesting a transfer must submit an internal online application through the district’s website. After the application has been received by the Personnel Office, the employee may be interviewed for a position vacancy. The application only gives the employee the right to be considered for an interview; the vacancy will be filled by the best qualified applicant. An employee must meet the requirements for the position to which transfer is requested before consideration may be given to the request. Vacancy Posted Employees will be notified of vacancies by email and open positions will be posted on the district’s website. 10
Evaluations As a means of improving the vital services delivered by employees, all classified employees shall be evaluated twice during their first year of employment and at least once per year during subsequent years. A copy of the completed evaluation will be given to each employee after it is signed by the employee and the evaluator. A copy will also be placed in the employee’s personnel file at the district office. Complaints/Grievances Any employee may file a complaint with their supervisor concerning a school rule, regulation, policy or decision that affects the employee. The complaint shall be in writing; filed within 20 days following the event complained of and shall specify the basis of the complaint. The supervisor shall meet with the employee and provide a written response within 20 days. If the employee disagrees with the decision, the employee may appeal to the superintendent who will respond within 20 days. If the grievance is not adjusted to the satisfaction of the grievant or if no decision is made within 20 school days after the date the grievance was filed with the superintendent, then the grievant may appeal to the board for final adjustment of the grievance. The appeal to the board shall be in writing to the clerk of the board within 20 school days after the superintendent has rendered a decision or after the expiration of 20 days. Discipline The superintendent or business manager may suspend a non-­‐certified employee for cause with pay pending final action by the Board of Education. Minor infractions shall normally follow the steps below prior to suspension: 1. Any breach of Board policy or other problem the immediate supervisor views as possible cause for suspension shall be reviewed verbally with the employee. The supervisor should make written notice for the file of such verbal review and the employee will receive a copy of this notice. 2. Should the employee again breach Board policy or have any other problems, the immediate supervisor shall hold a conference with the employee and give the employee a written report (see Summary of a Contact form, p. 46. Appendix B) relative to the deficiencies in the employee’s action and what is expected of the employee to correct the problem. A copy of the written report shall be filed in the employee’s personnel file and a copy given to the employee after it has been reviewed by the Superintendent. 3. If problems with the employee continue, the immediate supervisor shall suspend the employee with pay and report such action to the superintendent of schools who shall place the consideration of such suspension on the next Board agenda for final action by the Board. Major infractions may result in immediate suspension and/or termination. These shall include but not be limited to: certain violations of law; serious job-­‐related safety violations; and personal behaviors that reflect negatively upon the district. 11
Resignation/Retirement In all instances, except suspension and/or termination, separation from employment should arise from a written resignation submitted to the Board. Employees are placed in Groups based on KPERS eligibility and hire dates as listed in the section entitled “Retirement Benefits” below. Groups 2, 3, and 4 include a matching plan invested in a 403(b) for as long as employed. This investment is a benefit available to all staff in these groups. The match plan will begin October 1, 2015. Group 1 does not include a matching benefit. Employees in Group 2 receive a $100 match plan invested in a 403(b) for as long as employed. Employees in Group 3 receive a $75 match plan invested in a 403(b) for as long as employed. Employees in Group 4 receive a $50 match plan invested in a 403(b) for as long as employed. In order to receive any 403(b) district paid match at the time of resignation/retirement the employee must have 10 or more years of service at USD 313. The employee’s portion of the 403(b) investment remains theirs regardless of years of service. The district will pay $25 per day for unused leave upon resignation / retirement with a fifteen (15) year vesture. This benefit is not allowed for terminations. The retirement age for any staff member shall be in accordance with current law. The Board retains the right to “retire” an employee prior to prescribed retirement age if there is a good faith doubt that the employee can fulfill the duties of their job description because of mental or physical ailment. The Board reserves the right to have an employee examined by a physician of its choice to determine if the employee is able to fulfill the duties of their job description. Termination The Superintendent or his/her designated representative shall have the right to recommend termination of any support personnel to the Board of Education. Reasons for termination include but are not limited to: 1. Insubordination 2. Violation of Board policies 3. Inability to perform on the job in a satisfactory manner 4. Misrepresentation of skills or qualifications 5. Inability to work with other employees in a manner beneficial to the district 6. Other reasons which may normally be considered for employee termination by an employer USD 313 Support or “Classified” Personnel are “at-­‐will” employees. discriminatory and/or non-­‐retaliatory reason, with or without notice, and employees can leave the employer’s employment at any time, for any or no reason at all, with or without notice. LEAVE BENEFITS Annual Leave Following the successful completion of any initial probationary period, all support personnel who work a minimum of three and one-­‐half (3 ½) hours per day in a position sustained on a year-­‐to-­‐year basis shall receive 13 days Annual Leave. Leave shall be pro-­‐rated for any employee with a work agreement that is less than full time or who begins employment after the beginning of the normal school year or ends employment prior to the end of the school year. All Annual Leave and Unused Accumulated Leave shall be canceled when an employee leaves the employment of the district. Resigning full-­‐time employees with a 15 year vesture will be given a benefit of $25 per day for any unused Leave. This benefit is not allowed for terminations. Employees will have the option of receiving this payment in cash or having it deposited into a Post Funding Retirement Plan with Security Benefit, or the District approved company. Annual Leave and Unused Accumulated Leave balances will be reflected each month on the employee’s pay stub. Employees shall notify their principal or immediate supervisor as soon as prudently possible when Annual Leave or Unused Accumulated Leave is to be taken. The daily hours granted for Annual or Unused Accumulated Leave will be based on the number of hours the employee works during a normal day. Classified Support Personnel must attach a Use of Leave form to their timesheet when requesting use of leave (see Use of Leave Form, p. 47. Appendix C). Additional copies may be obtained from building secretaries. Use of Annual Leave Annual Leave may be used on scheduled work days for the following reasons: Sick, Personal, Bereavement, or Snow Days. Unused Annual Leave Any Annual Leave unused at the end of the fiscal year (June 30) will be transferred into the employee’s Unused Accumulated Leave account which shall accrue to a maximum of 80 days. Classified employees who have reached their maximum of 80 days and have unused Annual Leave at the end of the school year shall be compensated for their unused Annual Leave at a rate of $50 per day which will be pro-­‐rated based on their scheduled work hours per day. This compensation shall be included in their paycheck at the end of the fiscal year. 13
Use of Unused Accumulated Leave After all Annual Leave days are used for the year, only Sick and Bereavement leave will be granted based on the balance of days available in the employee’s Unused Accumulated Leave account. All requests for use of Unused Accumulated Leave must be approved by the employee’s supervisor. Unpaid Leave Classified employees will use available leave when absent from work. Once all Annual Leave and Unused Accumulated Leave is exhausted, the following policies go into effect: • Requests for Sick/Bereavement Leave – Employees eligible to use the Sick Leave Bank may apply according to the Sick Leave Bank Policy for Classified Support Personnel. • Requests for Personal/Business Leave – Once all leave balances reach zero, classified staff requesting a day off for Personal or Business reasons will incur a day without pay. Unpaid days must be approved by the employee’s supervisor. Requests for exceptions to the leave policy should be directed to the Superintendent. Sick Leave Bank A Sick Leave Bank for the Classified Support Personnel of USD 313 is to be used when personal or family illnesses result in the employee’s Annual Leave and Unused Accumulated Leave to be exhausted. The Sick Leave Bank (SLB) is administered by District Office Administrative Personnel. The procedures of the Sick Leave Bank shall be as follows: 1. The maximum number of days in the SLB shall be equal to the total FTE for Classified Support Personnel in the district. Days contributed to the sick leave bank become a permanent part of the district’s Classified Support Personnel Sick Leave Bank. The remaining days in the SLB at the end of each fiscal year will carry over to the next year. If the SLB runs out of days, District Office Administrative Personnel will request an additional day from each of the participating classified support personnel in the district. Classified employees will not be required nor expected to comply with this request. Administrative Personnel will notify the payroll clerk at the BAC with a list of classified employees who want to contribute an additional day to the SLB. 2. Beginning with contract year 2014-­‐2015, each returning classified employee who chooses to participate in the SLB will contribute either .5 or 1 day to be determined by District Office Administrative Personnel. This determination will be based on the balance of days remaining in the SLB each year. Any classified employee who does not want to contribute to the SLB must notify the payroll clerk at the BAC in writing prior to September 15 for any given year. 14
3. Classified support personnel who are new to the district each fiscal year who choose to participate in the SLB will donate one day to the SLB or notify the payroll clerk at the District Office in writing prior to September 15 of non-­‐participation. 4. Only classified support personnel who contribute to the SLB may use the bank. 5. Days drawn from the bank may be used for personal prolonged illness of the employee, prolonged illness of a member of the employee’s immediate family, or bereavement at the loss of a relative or close friend. 6. Classified employees may request days from the SLB in writing to the District Office Administrative Personnel (see Sick Leave Bank Application, p. 48. Appendix D). a. Classified staff members may request days from the SLB only after exhausting all other leave. To request a SLB day, the Sick Leave Bank Request Application form should be completed and given to the Administrative office on a monthly basis. b. The maximum number of days that a classified employee may withdraw from the bank will be 20 days. c. Applications will be acted upon as received and classified staff members will be notified. d. Denial of the application for days from the SLB may be appealed to an appeal committee. The appeal committee shall consist of the Superintendent, a Board Member, and the Director of the employee’s department. The decision of the appeal committee will be final. 7. The Business Manager shall receive a sick leave bank report from the Payroll Department at the end of each quarter. Requests for exceptions to the Sick Leave Bank policy should be directed to the Superintendent. Maternity/Adoption Leave Each employee may be granted up to 12 weeks of leave for child birth/bonding. Maternity leave begins on the date the child is born and concludes when the employee returns to work. Adoption leave may begin up to one (1) week prior to obtaining custody of the child and will conclude when the employee returns to work. The employee may request to use Annual Leave followed by Unused Accumulated Leave during maternity or adoption leave. The remainder of the leave will be unpaid. If an employee takes more than 6 weeks maternity leave and has elected to have a short-­‐term disability plan, they are eligible to use short-­‐term disability before using Annual Leave. Family/Medical Leave Family and medical leave shall be granted for a period of not more than 12 weeks during a 12-­‐
month period. For purposes of this policy, a 12-­‐month period shall be defined as a fiscal year 15
beginning July 1 and ending the following June 30. Spouses employed by the district may only take an aggregate of 12 weeks of leave for a birth of placement for adoption of a child, foster care or to care for a child with a serious health condition. Leave is available because of: 1. the birth of a son or daughter of the employee and to care for the son or daughter; 2. the placement of a son or daughter with the employee for adoption or foster care 3. the need to care for a spouse, son, daughter or parent of the employee because of a serious health condition; or 4. a serious health condition of the employee that prevents the employee from performing the job functions (Leave for reason 1 or 2 must be taken within 12 months of birth or placement.) The leave shall normally be unpaid leave. However, if the employee has any paid leave or vacation that is available for use because of the reason for the leave, the paid leave shall be used first and counted toward the annual family and medical leave. The superintendent will notify the employee prior to or during the leave period that the leave has been designated as paid family and medical leave. The employee is eligible for family and medical leave upon completion of 12 months of service in the district and employed at least 1,250 hours during the preceding year. During the period of any unpaid family and medical leave, the Board shall continue to pay the employer’s share of the cost of group health benefits in the same manner as paid immediately prior to leave. The employee shall pay any employee portion of the cost to the clerk of the board on or before the payroll date or at another time as the employee and superintendent may agree. The Board may terminate group health coverage if the employee payment is not received within 30 days of the due date. When leave is foreseeable, the employee shall give written notice 30 days in advance. If leave is not foreseeable, notice will be give as soon as practicable. Upon the employee providing notice of need for leave, the employer will notify the employee of: 1. the reasons that leave will count as family and medical leave; 2. any requirements for medical certification; 3. employer requirement of substituting paid leave; 4. requirements for premium payments for health benefits and employee responsibility for repayment if employer pays employee share; 5. right to be restored to same or equivalent job; and 6. any employer required fitness-­‐for-­‐duty certification 16
Family leave (reasons 1 or 2) may not be used intermittently or on a part-­‐time basis without the prior approval of the superintendent. The superintendent may require an instructional employee to continue leave until the end of the semester if the leave begins more than five (5) weeks before the end of a semester, lasts more than three (3) weeks and the return would occur during the last three (3) weeks of the semester. If the leave is for a reason other than the employee’s serious health conditions, the superintendent may require and instructional employee to continue leave until the end of a semester, if; 1. the leave begins in the last five (5) weeks of a semester, will last more than two (2) weeks and the return to work would occur in the last two (2) weeks of a semester; or; 2. the leave begins in the last three (3) weeks of a semester, and lasts more than five (5) days. Staff Development/Professional Leave All full-­‐time and part-­‐time classified employees whose employment arises from a position sustained on a year-­‐to-­‐year basis may qualify for staff development / professional leave. If an employee requests and is approved or is requested to attend a professional meeting, leave from the job will be with pay. Paid professional leave is limited to the actual amount of time an employee is absent from the scheduled work day(s). Judicial Leave An employee shall be granted leave for jury duty or to appear in a court of law as a subpoenaed witness. The employee will be paid his/her salary for a normal working day provided that the employee endorses over to the school district his/her witness or juror’s compensation not including travel or subsistence reimbursements. Military Leave All full-­‐time and part-­‐time classified employees whose employment arises from a position sustained on a year-­‐to-­‐year basis, upon written request to the superintendent, shall be granted leave to cover the length of required service with the armed forces of the United States as provided in policy GARID. Vacation Leave Employees with a 12-­‐month agreement are granted paid vacation according to the following provisions: 5 days after the 1st and 2nd year of employment, 10 days after the 3rd, 4th, 5th, 6th, 7th, 8th, and 9th year of employment, 15 days after the 10th year of employment and thereafter. Vacation needs to be scheduled through the supervisor at his/her discretion. Vacation schedules begin on July 1 of each year and must be used within 18 months. A Use of Leave form must be submitted with the employee’s timesheet when requesting vacation leave. 17
Paid Holidays The following paid holidays are offered to Classified Staff who are consistently scheduled a minimum of 3 ½ hours per day: July 4 (1 day), Labor Day (1 day), Thanksgiving (2 days), Christmas (2 days), December 31 (1 day) New Year’s Day (1 day), Good Friday (1 day), Memorial Day (1 day). Classified personnel are entitled to the paid holidays which fall during the employees assigned work schedule. OTHER BENEFITS Health Insurance The district provides a fixed health insurance benefit that is determined each year. The benefit is available only for payment of the health insurance premium. There is no cash, or other option for this benefit. Any remaining premiums due will be paid through salary reduction. Employees who work less than full-­‐time but at least 17.5 hours per week will receive a prorated amount of the benefit. Section 125 Cafeteria Plan USD 313 has established a flexible fringe benefit plan to make a wide range of benefits available to staff. This program has been established in conformity with Section 125 of the Internal Revenue Code of 1986, as amended, and in compliance with the applicable rules and regulations issued by the Internal Revenue Service. All employees meet with a third party administrator during the months of August or September to complete this process. Purchase of benefits by way of salary reduction or salary deduction must be from approved companies. A list is available from the district office. Enrollment periods are during the months of August and September and take effect October 1. All requests to purchase, modify or discontinue benefits by salary reductions and/or deduction must be submitted on the proper form with our 3rd party administrator. Exceptions arising from some change in family circumstances may be considered. In order for the annuity contract or health insurance to remain in force there must not be a lapse in payment. Payment for all salary reductions will be divided equally between the employee’s pay periods. Classified Staff members may purchase the following tax exempt benefits by way of salary reduction: 1. Health Insurance 2. Life Insurance 3. Cancer Insurance 4. Flexible Medical Spending Account Prepaid Child/Dependent Care 18
5. Dental Insurance 6. Vision Insurance Employees may purchase the following taxable benefits by way of salary reduction: 1. Tax Sheltered Annuity (Exempt from Federal and State withholding, subject to KPERS and Social Security Tax. 2. Additional deductions include scholarship funds administered by the Buhler USD 313 Education Foundation, United Way, pre-­‐paid legal services and others as defined by the employer. Salary Protection The district provides paid salary protection insurance coverage for all classified employees in covered positions. Security Benefit Life Insurance Company underwrites the insurance. The specified coverage is approximately 66% of average wage for all classified employees in covered positions. This coverage does not begin until Annual Leave and Unused Accumulated Leave is exhausted. The employee must initiate all claims. Additional information is available from the Benefits Clerk. Liability Insurance The Board shall provide liability insurance coverage for all employees while acting within the scope of their duties. Tax Sheltered Annuity A non-­‐transferable, tax-­‐sheltered annuity program is available to all employees who qualify. Employees wishing to participate shall complete all necessary forms with the annuity company to implement the contribution or deduction. The district will not deduct salary for payment of an annuity until a signed contract has been received in the Business Office. Kansas Public Employees Retirement System (KPERS) Eligible employees receive Basic Life and Disability Insurance at no cost to them. Basic Life insurance provides an insured death benefit which is currently 150% of the member’s annual rate of compensation. Disability income benefits provide a monthly benefit based on 60 percent of your annual salary. To qualify you must be disabled for 180 days and no longer receive employer compensation. You must apply for Social Security benefits and complete any appeal process. Retirement Plans: Personnel employed by Buhler Schools who have established eligibility, are required by law to participate in the Kansas Public Employees Retirement System, beginning with the employee’s first day of employment. 19
Vesting Employees must be a member of KPERS for 5 years before becoming vested. If you leave covered employment before completing 5 years of service you may apply for a refund of your contributions plus interest. If you are vested with five or more years of service you are guaranteed a monthly retirement benefit even if you leave covered employment as long as you keep your contributions in your account. Tier 1 Members: Employees hired prior to July 1, 2009 Prior to January 1, 2014 members contributed 4% with a benefit multiplier of 1.75%. Service earned before January 2014 will stay at the 1.75% multiplier. Beginning January 1, 2014 members contribute 5% with a benefit multiplier of 1.85%. Beginning January 1, 2015 and after members contribute 6% with a benefit multiplier of 1.85%. Full benefits for retirement from KPERS will be paid: At age 65 with one year of service credit At age 62 with ten years of service credit When your age and years of service credit added together equal 85 Retiring Early An employee may retire with reduced benefits as early as age 55 with 10 years of credited service. Tier 2 Members: Employees hired after July 1, 2009 Beginning January 1, 2014 Tier 2 members’ 6% contribution rate remains the same but their multiplier increases to 1.85% for all of their service, not just future service. Full benefits for retirement from KPERS will be paid: At age 65 with five years of service credit At age 60 with 30 years of service credit Additional information can be obtained from the District Business Office or by calling KPERS at 1-­‐888-­‐275-­‐5737. District Retirement Benefits Employees are placed in Groups based on KPERS eligibility and hire dates. A classified employee must satisfy all of the following requirements to be eligible for the district retirement plan: 1. The employee must currently be a regular employee with an agreement to work a minimum of 17.5 hours per week. 2. The employee must have an employment history of at least 10 consecutive years with an agreement of 17.5 hours per week with a term of no less than nine months. 20
3. The employee must have filed an application and be eligible for retirement benefits from the Kansas Public Employees Retirement System. Eligibility, as specified herein, shall be determined by district administration following receipt of written notification of retirement. Upon final approval by the Board of Education, district administration shall notify the applicant of final disposition, the date and amount of retirement benefits to be paid. Classified employees meeting the criteria set forth in this section shall be eligible for the retirement benefits as specified below. Cash benefits, including payment for Unused Accumulated Leave, shall be subject to the appropriate withholdings. Group 1 includes all current employees retiring between and including the 2014-­‐2015 and 2018-­‐2019 school years. They can choose from Option 1 or 2 as follows: Option 1 • 9% of their final salary for a total of 3 years or age 65, whichever is shorter. This benefit is deposited in one annual payment (in July) to a Post Funding Retirement Plan with Security Benefit, or the district approved company. • Full Health Insurance Benefit for 5 years or age 65, whichever is shorter. To receive this benefit the employee must have been enrolled in the district sponsored health insurance plan within the last year of their employment. They will receive a defined benefit equal to the amount given to current employees toward single or family insurance coverage in the district approved health insurance plan until they are Medicare eligible or for a term not to exceed 5 consecutive years. The 5-­‐year term shall commence with the first month the employee is deleted from the USD 313 payroll for the purpose of approved retirement. In all instances, the paid benefit shall terminate on the last day of the last month before the employee’s age eligibility for Medicare benefits. In the event of the retired employee’s death, the retired employee’s spouse may continue to purchase a single or family district health insurance until said spouse reaches Medicare eligibility. Option 2 • 9% of their final salary for a total of 5 years or age 65, whichever is shorter. This benefit is deposited in one annual payment (in July) to a Post Funding Retirement Plan with Security Benefit, or the district approved company. Employees in Group 1 will declare each August during open enrollment whether they wish to remain in Group 1 or move to Group 2. 21
Group 2 includes all current employees that are eligible to retire between and including the 2019-­‐2020 and 2023-­‐2024 school years. They can choose from Option 1 or 2 as follows: Option 1 • 4% of their final salary for a total of 3 years or age 65, whichever is shorter. This benefit is deposited in one annual payment (in July) to a Post Funding Retirement Plan with Security Benefit, or the district approved company. Option 2 • Full Health Insurance Benefit for 3 years or age 65, whichever is shorter. To receive this benefit the employee must have been enrolled in the district sponsored health insurance plan within the last year of their employment. They will receive a defined benefit equal to the amount given to current employees toward single or family insurance coverage in the district approved health insurance plan until they are Medicare eligible or for a term not to exceed 3 consecutive years. The 3-­‐year term shall commence with the first month the employee is deleted from the USD 313 payroll for the purpose of approved retirement. In all instances, the paid benefit shall terminate on the last day of the last month before the employee’s age eligibility for Medicare benefits. In the event of the retired employee’s death, the retired employee’s spouse may continue to purchase a single or family district health insurance until said spouse reaches Medicare eligibility. No matter which above option is chosen, they would also receive the following: • A $100.00 match plan invested in a 403(b) for as long as employed. The match plan will begin October 1, 2015. Group 3 are all current employees that are eligible to retire in and after the 2024-­‐2025 school Year AND were hired in or before the 2007-­‐2008 school year. They will receive the following: • 50% of Full Health Insurance Benefit for 3 years or age 65, whichever is shorter. To receive this benefit the employee must have been enrolled in the district sponsored health insurance plan within the last year of their employment. They will receive a defined benefit equal to 50% of the amount given to current employees toward single or family insurance coverage in the district approved health insurance plan until they are Medicare eligible or for a term not to exceed 3 consecutive years. The 3-­‐year term shall commence with the first month the employee is deleted from the USD 313 payroll for the purpose of approved retirement. In all instances, the paid benefit shall terminate on the last day of the last month before the employee’s age eligibility for Medicare benefits. 22
In the event of the retired employee’s death, the retired employee’s spouse may continue to purchase a single or family district health insurance until said spouse reaches Medicare eligibility. •
A $75.00 match plan invested in a 403(b) for as long as employed. The match plan will begin October 1, 2015. Group 4 are all current employees hired during or after the 2008-­‐2009 school year. They will receive the following: • A $50.00 match plan invested in a 403(b) for as long as employed. The match plan will begin October 1, 2015. Retirees will receive a benefit for unused Leave at the rate of $25 per day, which will be deposited to a Post Funding Retirement Plan with Security Benefit, or the district approved company. (In the event of the employee’s death, payment for any unused Leave shall be made to the designated beneficiary of the KPERS term life insurance. In the event that there is no designated beneficiary, payment shall be made to the residual estate of the employee.) Continuation of Group Health Coverage COBRA (Consolidated Omnibus Budget Reconciliation Act PL-­‐99-­‐272). An employee or their qualified beneficiary who would otherwise lose coverage under the district’s group health insurance plan as a result of a qualifying event (voluntary or involuntary job loss, reduction in the hours worked, transition between jobs, death, divorce, or other life events) has the right to elect continuing coverage. This continuation coverage is in accordance with the requirements of Federal Law, and is commonly referred to a COBRA. Details pertaining to continuing coverage of your health plan and your obligations are available from the Business Office. Unemployment Compensation For answers to questions regarding unemployment insurance policies, benefits and claims, contact the District Business Office. Workers Compensation USD 313 is subject to the Kansas Workers Compensation Law which provides compensation for job-­‐related injuries. All employees of USD 313 are covered by the district’s workers compensation insurance. Benefits are payable under this insurance if an employee suffers bodily injury resulting from an accident, bodily injury resulting from a disease or bodily injury resulting in death. Such disease, injury or death must have occurred as a result of the employee performing his assigned duties. 23
In the event of a job-­‐related injury, the employee must file a workers compensation claim. The necessary forms may be obtained at the Burkholder Administrative Center. Notice of Accidents Employees must notify the employer within 10 days of an accident or injury. Failure to do so may result in the claim being barred. Additional information about your rights and responsibilities under workers compensations may be obtained from your supervisor or the district office. Coverage Benefits are for personal injury from accident or occupational disease arising in the course of employment with the district. Injuries which occur during recreational or social events under circumstances where the employee is under no duty to attend, and where the injury did not result from the performance of tasks related to normal job duties are not covered under workers compensation. Any employee who is off work and drawing workers compensation shall be required to provide the Business Office with a written doctor’s release before the employee is allowed to return to work. In addition, should the employee be released to return to work by a doctor and fail to do so, all benefits under sick leave shall be ended and those benefits under workers compensation shall be restricted as provided by current statute. Coordination With Leave Benefits The workers compensation plan will provide coverage for medical expenses and wages to the extent required by statute to those employees who qualify. Whenever an employee is absent from work and is receiving workers compensation benefits due to a work-­‐related injury or is receiving district paid disability insurance, the employee may use available paid leave to supplement the workers compensation or district paid disability insurance payments. Workers compensation benefits and FMLA benefits provided in a board approved plan shall run concurrently if both are applicable. In no event shall the employee be entitled to a combination of workers compensation benefits and salary in excess of his/her full salary. Available paid leave may be used for this purpose until 1) available paid leave benefits are exhausted; 2) the employee returns to work; or 3) employment is terminated. Leave shall be deducted on a prorata amount equal to the percentage of salary paid by the district. The board shall have the right to choose a designated health care provider to provide medical assistance to any employee who suffers an injury while performing their job. Attendance Incentive Any hourly wage classified employee who has a 100% work attendance (no absences) for the contract year is eligible for a one-­‐time attendance incentive payment at the end of the year. 24
Reimbursement/Travel Expenses School vehicles are available upon request and availability. All staff is encouraged to use school vehicles. Staff members using their own private vehicles will be authorized for travel for school related business. The rate of reimbursement will be set by the Board of Education. Staff members must fill out the required forms and attach receipts in order to collect any compensation. Reimbursements for mileage and other expenses, such as meals, hotel, registration, etc., will be reimbursed. Activity Passes The Board provides each employee with a pass to district-­‐sponsored activities with the exception of specified athletic tournaments and KSHSAA events. The pass will be valid for the employee, spouse, and children through 12th grade to attend all home activities. CONDUCT Employee Dress Codes Appropriate dress is required for all employees. Requirements will vary based on job responsibilities. Generally, jeans are not considered appropriate dress unless designated by the employee’s supervisor. Drug Free Schools and Communities Act/Drug Free Workplace The unlawful possession, use, sale or distribution of illicit drugs and alcohol by school employees on school premises or as a part of any school activity is prohibited. As a condition of employment in the district, employees shall abide by the terms of the Board policy on drug free school/workplace. Employees shall not unlawfully manufacture, distribute, dispense, possess or use illicit drugs, controlled substances, or alcoholic beverages on district property or at any school activity. Compliance with the terms of this policy is mandatory. Employees who are found violating the terms of this policy will be reported to the appropriate law enforcement officers and the district Discipline Policy (p. 11) will be followed. Additionally, an employee who violates the terms of this policy may be subject to any or all of the following sanctions: • Short term suspension with pay • Long term suspension without pay • Required participation in a drug and alcohol education, treatment, counseling, or rehabilitation program (the cost of which will be borne by the employee) • Termination or dismissal from employment 25
Prior to applying sanctions under this policy, employees will be afforded due process rights to which they are entitled under the provisions of Kansas law. Tobacco Use The use of tobacco products by any person, in any form, is prohibited in any school building, owned, leased or rented by the district that is used for pupil attendance purposes, or in any school vehicle. Sexual Harassment Sexual harassment is unlawful discrimination on the basis of sex under Title IX of the Education Amendments of 1972, Title VII of the Civil Rights Act of 1964, and the Kansas Act Against Discrimination. All forms of sexual harassment are prohibited at school, on school property, and at all school-­‐sponsored activities, programs or events. Sexual harassment against employees or students of the district by board members, administrators, certified and classified personnel, students, vendors, and any others having business or other contact with the school district is strictly prohibited, whether or not the harassment occurs on school grounds. Sexual harassment shall include, but not be limited to, unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when: • submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment; • submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual; or • such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile or offensive working environment. No district employee shall sexually harass, be sexually harassed, or fail to investigate or refer a complaint or sexual harassment for investigation. Complaints of sexual harassment by employees will be promptly investigated and resolved. Initiation of a complaint of sexual harassment will not adversely affect the job security or status of an employee, nor will it affect his or her compensation or work assignment. Violation of district policy shall result in disciplinary action, up to and including termination. Any employee who witnesses an act of sexual harassment or receives a complaint of harassment from another employee or a student shall report the incident to the building principal or administrator. Employees who fail to report complaints or incidents of sexual harassment to appropriate school officials may face disciplinary action. Employees who believe they have been subjected to sexual harassment should discuss the problem with their immediate supervisor. If an employee’s immediate supervisor is the alleged harasser, or if the employee is uncomfortable discussing the issue with his/her supervisor, the employee should discuss the problem with the coordinator of federal compliance, the principal or the superintendent. 26
Employees who do not believe the matter is appropriately resolved may file a written complaint under the district’s discrimination complaint procedure. Confidentiality shall be maintained throughout the complaint procedure. Initiation of a complaint of sexual harassment in good faith will not adversely affect the job security or status of an employee, nor will it affect his or her compensation. Racial Harassment Racial harassment is unlawful discrimination on the basis of race, color or national origin under Title VI and VII Civil Rights Act of 1964, and the Kansas Act Against Discrimination. All forms of racial harassment are prohibited at school, on school property, and at all school-­‐sponsored activities, programs or events. Racial harassment against individuals associated with the school is prohibited, whether or not the harassment occurs on school grounds. Racial Harassment is racially motivated conduct which: • Affords an employee different treatment, solely on the basis of race, color or national origin, in a manner which interferes with or limits the ability of the employee to participate in or benefit from the services, activities or programs of the school • Is sufficiently severe, pervasive or persistent so as to have the purpose or effect of creating a hostile working environment • Is sufficiently severe, pervasive or persistent so as to have the purpose or effect of interfering with an individual’s work performance or employment opportunities Racial harassment may result from verbal or physical conduct or written graphic material. An employee who witnesses an act of racial harassment or receives a complaint of harassment from another employee or a student shall report the incident to the building principal or administrator. Employees who fail to report complaints or incidents of racial harassment to appropriate school officials may face disciplinary action. Employees who believe they have been subjected to racial harassment should discuss the problem with their immediate supervisor. If an employee’s immediate supervisor is the alleged harasser, or if the employee is uncomfortable discussing the issue with his/her supervisor, the employee should discuss the problem with the coordinator of federal compliance, the principal or the superintendent. Employees who do not believe the matter is appropriately resolved may file a written complaint under the district’s discrimination complaint procedure. Confidentiality shall be maintained throughout the complaint procedure. Initiation of a complaint of racial harassment in good faith will not adversely affect the job security or status of an employee, nor will it affect his or her compensation. 27
Gifts Patrons and students should not be encouraged to give personal gifts to school personnel. If gifts are offered, school personnel should minimize such acts and not give publicity or public recognition for such gifts to praise the donor. No employee may accept any commission, gift or gratuity for personal gain from any source whatsoever that is offered by virtue of his or her employment with the school district or that has any relationship to any school activity or program. Acceptance of such commission, gift or gratuity for personal gain by any employee will be sufficient reason for immediate termination of employment with the school district. Any individual bequest to the district will be considered on an individual basis by the Buhler USD 313 Board of Education. Conflict of Interest District employees are prohibited from engaging in any activity that may be defined as a conflict of interest and detract from the effective performance of their duties. During the school day or on school property, no employee will attempt to sell or influence any student to buy any product or service which would directly or indirectly benefit the employee. No school employee will enter into a contract with the district other than for employment unless the contract is awarded on the basis of competitive bidding. Personal Business/Solicitation Unless permission is granted by the appropriate supervisor, solicitation of employees by any vendor, student, other school district employee or patron during normal duty hours is prohibited. No employee will attempt, during the school day or on school property, to sell or endeavor to influence any student or school employee to buy any product, article, instrument, service or other items which may directly or indirectly benefit the school employee. No employee will engage in sales or solicitation on behalf of the school or use the school name without the prior approval of the principal. Any agent or business representative calling on school personnel about school matters, such as textbooks, publications of the school, class insignia, athletic equipment, music instruments, school equipment, school supplies, building and custodial supplies, etc., will first obtain permission from the superintendent or principal. It is the duty of the school employee to ascertain if the representative has such permission. In general, a teacher will not interrupt class work to purchase anything for the school without expressed authorization from the superintendent or principal and shall be personally liable for payment of the bill and material so ordered if prior approval has not been made. 28
Distribution of Information Materials from sources outside of the district may not be distributed on school grounds without prior permission from the principal. Examples of outside materials include, but are not limited to, political materials, special interest materials and advertisements. The principal shall determine the time, place, and manner for materials distribution. Visitors Adult guests from other districts are welcome to our schools as well as patrons from our district. All visitors to any building are required to check in at the office. Children or relatives from other districts are discouraged from visiting the schools unless special permission is received from the administration. Confidentiality Confidential student information, whether written or oral, shall be handled in a confidential manner and be discussed only with the parents/guardians of the particular student and the appropriate school personnel. Violations of this rule which violate the privacy rights of students could result in disciplinary actions being taken against the employee, including termination. Confidential personnel information, whether written or oral, shall be handled in a confidential manner and be discussed only with the appropriate school personnel. Violations of this rule which violate the privacy rights of personnel could result in disciplinary actions being taken against the employee, including termination. Political Office Employees who intend to become candidates for political office should notify the superintendent within five days of the date on which the declaration of candidacy is filed. Employees who are elected or appointed to a political office which the board, in its discretion, deems to be a full-­‐time office may be required to terminate their employment with the district. An employee who must be absent from work to carry out the duties of a political office must take a leave of absence without pay for the duration of the political duties. Employees are not eligible to serve on the Board of Education in the district they are employed by. Employees may not use school time or school property for the purpose of furthering the interest of any political party, the campaign of any political candidate or advocacy of any political issue. Participation in Activities Employees are encouraged to participate in community activities and organizations, insofar as those activities do not infringe upon time on the job. Prior permission must be obtained from 29
the superintendent for participation in any community activity that takes place during the workday. Outside Employment School employees may not accept employment or carry on business or activity for profit that interferes with the complete discharge of responsibilities to the school district. Provided there is no interference with school duties, school employees may engage in occasional business transactions for profit outside of school hours or on holidays. Criminal Convictions Any employee convicted of a felony or driving under the influence, or who enters a plea of guilty or diversion agreement, must notify the superintendent within five (5) days after the conviction or diversion agreement. Staff and Student Relations All employees are expected to maintain relationships with members of the student body which are conducive to an effective, professional education environment. Social fraternization between employees and students is generally prohibited. All employees share the responsibility for the regulation of student conduct at school and at school-­‐sponsored events not on school property. Interrogation/Investigation of Students No one may interrogate or investigate a student on school grounds without the permission of the principal. Searches of Students and Property If a staff member believes there is a need to search a student or property, he/she shall contact the principal. Searches of students or property shall be conducted in accordance with the rules approved by the Board. Staff shall not search students or property. No law enforcement officer shall search students or property without a search warrant. Building principals are authorized to search students or property if there is reasonable suspicion that district policies, rules or directives are being violated. All searches by the principal shall be carried out in the presence of another adult witness. Administration of Medicine The supervision of any medications shall be in strict compliance with the rules and regulations of the Board. District employees may not dispense or administer any medications, including prescription and non-­‐prescription drugs, to students except as outlined in Board policy JGFGB. 30
Bullying The board of education prohibits bullying in any form either by any student, staff member, or parent towards a student or by a student, staff member, or parent towards a staff member on or while using school property, in a school vehicle or at a school-­‐sponsored activity or event. The term “bullying” shall have the meaning ascribed to it in Kansas law. Staff members who bully others in violation of this policy may be subject to disciplinary action, up to and including suspension and/or termination. If appropriate, staff members who violate the bullying prohibition shall be reported to local law enforcement. OTHER Church Night Wednesday night is set aside as church night in Buhler USD 313. The local school will schedule no school activities of any kind after 6 p.m. The only exceptions that are made to this policy will be activities over which the school has no control. Any deviations must receive specific approval from the building principal and the superintendent or the Board of Education. Memorials Buhler USD 313 has an established Educational Foundation. One purpose of the Foundation is for receiving and administering monetary memorials given in memory of an alumnus, student or staff member. While the Buhler USD 313 Board of Education is sensitive to the sentiment prompting memorials other than monetary, it is our school district’s belief that accepting, displaying and printing such memorials is not in the best interest of all students. Plaques, pictures and other memorabilia may not be placed in any attendance center or on any attendance center grounds in memory of the deceased. Memorial pages dedicated to the deceased will not be printed in student yearbooks, the student newspaper or other student publications. Personal Property The district is not responsible for employees’ personal property and does not provide insurance on employees’ personal property. If an employee’s personal property is broken, damaged or stolen while the employee is on the job, repair or replacement is the employee’s responsibility. Staff Development Buhler USD 313 is a charter member of Educational Services and Staff Development Association of Central Kansas (ESSDACK) and member of Smokey Hill Education Service Center. Through these service centers, staff development and continuing education opportunities are offered to staff members. Additional staff development activities are planned through the District Learning Team and Classified Committee. 31
Classified Committee The Classified Employee Communications Committee is established to provide two-­‐way communication between classified employees and the Board and administration. The committee serves in an advisory capacity to the administration on matters of classified employee concerns. The committee makes recommendations to the Leadership Cadre, which in turn is charged with making recommendations to the Board of Education. Each building’s classified staff selects a representative to the committee. Permanent members are the Public Information Officer, Director of Buildings and Grounds, Food Service Director and Transportation Director. The Business Manager and Superintendent attend meetings as ex-­‐officio members. Regular quarterly meetings are held during the regular school year. Special meetings may be set and sub-­‐committees formed as needs arise. The minutes of each meeting will be posted on the district web site. Leadership Cadre The Leadership Cadre of Buhler USD 313 is composed of the following: • The Superintendent • The Business Manger • Building Principals • Assistant Principals • Director of Learning and Instruction • Public Information Officer • Technology Director • Transportation Director • Food Service Director • Director of Buildings and Grounds • Technology Integration Specialist • Human Resources Clerk • Clerk of the Board The Cadre is set up to provide involvement and assistance to the superintendent of schools and the Board of Education for the purpose of establishing policy, procedures and future plans. Board of Education The Buhler USD 313 Board of Education is comprised of seven members who meet once a month at the Burkholder Administrative Center, 406 West 7th, in Buhler. These meetings are held on the 2nd Monday of each month so that business of the district may be legally transacted. Visitors are welcome to all regular meetings. Detailed information concerning the Board of Education’s functions and operations may be found in Section B of the Board of Education Policy manual. 32
HEALTH Asbestos Federal and state regulations require annual notification to the public that friable asbestos has been detected in Buhler USD 313 buildings. An operations and management plan was developed in compliance with federal and state regulations regarding friable asbestos and is on file at the Burkholder Administrative Center. A copy of the plan is available in each school building. The three-­‐year inspection, required by federal and state laws, has been completed by Reliable Environmental Agency. No significant changes were found. Any questions may be addressed to the USD 313 Director of Buildings and Grounds. Hazardous Waste When hazardous waste material is located in the district, its disposal shall be in accordance with state and federal laws, rules and regulations. No employee shall bring hazardous material to school without prior approval of the supervisor. Such material shall be in an appropriate container and properly labeled. If an employee discovers waste material that is, or may be hazardous, he/she should notify his/her supervisor immediately. Hazardous wastes include, but are not limited to, wastes that are flammable, corrosive, infectious, highly reactive or toxic. Hazardous waste must be placed in an appropriate container affixed with a hazardous waste label that lists the specific contents. Unlabeled containers containing undetermined contents which may contain hazardous substances shall not be put in trash containers. All hazardous wastes must be properly labeled and stored appropriately until they can be disposed of properly. Placing them in trash containers or the sewer system is not an acceptable disposal method. Bloodborne Pathogens The exposure control plan for bloodborne pathogens is available for review from school nurses. All staff shall receive the training and equipment necessary to implement the plan. All staff receive Bloodborne Pathogen training materials and sign the necessary documentation annually. 33
Communicable Diseases Whenever an employee has been diagnosed by a physician as having a communicable disease, the employee shall report the diagnosis and nature of the disease to the superintendent so a proper report may be made as required by statute. An employee afflicted with a communicable disease dangerous to the public health shall be required to withdraw from active employment for the duration of the illness in order to give maximum health protection to other district employees and to students. The employee shall be allowed to return to duty upon termination of the illness, when authorized in writing by a physician. The Board reserves the right to require a written statement from the employee’s physician indicating the employee is free from all communicable disease symptoms. SAFETY Inclement Weather In case of power failure, snowstorms or any other emergency resulting in a condition that would endanger the health of students, school shall be dismissed and students delivered to their respective homes as soon as possible, provided the emergency cannot be corrected that day. Parents should instruct the student and the office of any special circumstances resulting from early dismissal. Buhler USD 313 will attempt to accommodate all the situations regarding the student’s best interests. If in the judgment of school officials it seems wise not to have school because of storm conditions or other circumstances, Buhler USD 313 will notify parents, students, and employees using SchoolReach, our district's automated notification system. In addition, the district will also notify local newspaper, radio and television stations with any cancellations or emergency announcements. Important information about receiving calls sent through SchoolReach: • Caller ID will display the school’s main number when a general announcement is delivered. • Caller ID will display 411 if the message is a dire emergency. • SchoolReach will leave a message on any answering machine or voice mail. • If the SchoolReach message stops playing, press the number 1 key and the message will replay from the beginning. A decision to cancel school will be made prior to 7:00 a.m. so that the appropriate announcements can be made. If the announcement is not made by 7:00 a.m., it may be assumed that school will be in session and buses will run. 34
Fire Drills Fire drills are held in each school once each month for the protection of students and staff. Procedures are posted in each room and are discussed with students before a drill. During the drill, students will walk a safe distance from the building. Tornado Drills Procedures for tornado precautions are posted in all rooms and are discussed with students. At least three tornado drills will be held during each school year. Accidents Any school employee who discovers an accident on school property shall report the accident to the building principal or designated representative. If the person requires medical treatment, the employee shall: • Send for medical help; • Make the individual as comfortable as possible while waiting for competent medical assistance to arrive; and • Notify the principal or designated representative Any If an employee is qualified to administer first aid, that aid may be given. Qualified employees include the school nurse and those employees who have successfully completed an approved Red Cross first aid program. If an employee is injured on the job, the supervisor should be contacted immediately and a report shall be made within 10 days. The supervisor will then be responsible for contacting the district central office, who will in turn supply the injured employee with the appropriate forms to complete. The employee must keep copies of all doctor’s orders and provide a file copy to the district central office. The employee must inform the doctor or hospital that he/she is covered by the district workers compensation plan. See “Workers Compensation,” section in this handbook. Security Any district employee who believes any of the following has occurred at school, on school property or at a school-­‐sponsored activity shall immediately report this information to local law enforcement: • An act which constitutes the commission of a felony or a misdemeanor; or • An act which involves the possession, use or disposal of explosives, firearms or other weapons as defined in current law Firearms on District Property Unless otherwise required by law or authorized by board policy, no person other than a law enforcement officer shall possess a firearm on any district owned or operated property, within any district owned or operated building or facility; in a school vehicle or an employee’s personal 35
vehicle being used to transport students, or at any school sponsored activity, program, or event. This prohibition includes possession of concealed weapons even if the person has a valid concealed carry license in this state; however such prohibition shall not apply to the secured storage of a handgun in a district employee’s own locked vehicle on school property so long as such employee holds a valid Kansas concealed carry license and such weapon is maintained out of plain sight. Appropriate signs shall be conspicuously posted as directed by the board and required by law. Anyone in violation of this policy shall be directed to leave the premises immediately and not return without prior approval from the building administrator or superintendent. Failure to comply with such order will result in a report to law enforcement. Child Abuse Any district employee who has reason to know or suspect that a child has been injured as a result of physical, mental or emotional abuse or neglect or sexual abuse, shall promptly report the matter to the local Social Rehabilitation Services (SRS) office or to the local law enforcement agency if the SRS office is not open. It is recommended the building administrator also be notified after the report is made. District employees shall not contact the child’s family or any other persons to determine the cause of the suspected abuse or neglect. It is not the responsibility of school employees to prove the child has been abused or neglected. Crisis Management Plans/Building Safety Plans Building Safety Plans outline responses to various incidents that might threaten student/staff safety and well-­‐being. The district’s Crisis Management Plan supports each building’s safety plans by providing detailed information on how to respond and who will be responsible in crisis situations. Outlined in the plan are guidelines and procedures to accomplish the following: 1. Immediately allow staff to take control of any crisis situation 2. Prevent additional injuries or tragedies to students and staff 3. Alleviate unnecessary confusion and turmoil among students, staff and the community 4. Reduce disruption of school 5. Return to normal school routine as quickly as possible Building Safety Teams have been designated for each attendance center. The building principal in each attendance center is charged with the responsibility of the team. A District Crisis Intervention Team has been designated, and the superintendent of schools is responsible for this team. Buhler USD 313 also participates in and supports the Crisis Intervention Team training sponsored by ESSDACK (Educational Services and Staff Development Association of Central Kansas). Staff have received extensive training and are authorized to assist other school districts 36
if called upon to provide counseling and other crisis intervention support. Buhler USD 313 schools also have access to additional expertise and support through this program. Threats of Violence Policy and Procedures To provide a safe and respectful environment for all students and staff, Buhler USD 313 will take steps to deter incidents of violence or threats of violence in our schools. Therefore, students and parents must be aware that all threats (verbal, written, implied or physical) will be taken seriously by school personnel and each and every threat will carry a consequence. We request parent and community support in this effort to let our students know that no threat is “just joking,” and no threat will be ignored. We must work together to teach our youth better ways to deal with conflict and frustration. We must also establish the understanding that our community is united in the belief that violence or threats of violence in our schools is intolerable. Procedures to Respond to Threats of Violence: 1. All threats will be reported to school staff immediately by anyone who sees or hears it without regard for interpretation. If it is a threat, report it. 2. Administration and staff will investigate to determine the seriousness and circumstances surrounding the threat. 3. Any necessary disciplinary action will follow current Board of Education policy, including notification of parents/guardians and law enforcement officials. FACILITIES/SUPPLIES/EQUIPMENT Purchasing/Requisitions The procedure for purchasing is as follows: 1. Submit a complete electronic requisition (e-­‐req) to the building treasurer (secretary) which is coded and sent on to the building principal for consideration and approval. User identifications and passwords will be issued by the Accounts Payable Clerk through the building secretary. 2. If approved by the building principal, the e-­‐req will be forwarded to the business manager with the appropriate account number to which the purchase is to be charged. 3. If the funds are available in the designated account, the business manager will instruct the accounts payable clerk to issue an approved purchase order. At this time, and not before, a purchase may be made. 4. Supplies and materials will be purchased in a manner which is economical, efficient and which takes into consideration the goals and objectives of the educational process. Care of Facilities and Equipment All personnel have the authority and responsibility to help take care of the grounds and buildings and their contents. Damage and/or accelerated wear and tear to school property due to abuse, neglect or other misuse may be cause for disciplinary action. 37
When leaving a building at night, all doors and windows should be closed and locked. All lights and other equipment should be turned off as appropriate. Energy Management Conservation Policy The following is the Buhler USD 313 Energy Management Conservation Policy, as adopted on March 22, 2004: As the School Board of the Buhler USD 313, we believe it to be our responsibility to ensure that every effort is made to conserve energy and natural resources while exercising sound financial management. The implementation of this policy is the joint responsibility of the Board members, administrators, teachers, students and support personnel and its success is based on cooperation at all levels. The Buhler USD 313 will maintain accurate records of energy consumption and cost of energy and will provide information to the local media on the goals and progress of the energy conservation program. The principal will be accountable for energy management on his/her campus with energy audits being conducted and conservation program outlines being updated. Judicious use of the various energy systems of each campus will be the joint responsibility of the principal and head custodian to ensure that an efficient energy posture is maintained on a daily basis. To ensure the overall success of the energy management program, the following specific areas of emphasis will be adopted: 1.
Every student and employee will be expected to contribute to energy efficiency in our Buhler. Every person will be expected to be an “energy saver” as well as an “energy consumer.” 2.
Effective immediately, all unnecessary lighting in unoccupied areas will be turned off. All lights will be turned off when students and teachers leave school. Custodians will turn on lights only in the areas in which they are working. 3.
Energy management on his/her campus will be made a part of the principal’s annual evaluation. 4.
The head custodian at each school will be responsible for a complete and total shutdown of the facility when closed each evening. 5.
Within sixty (60) days, administrative guidelines will be adopted that will be the “rules of the game” in implementing our energy program. 6.
Meet published standards in ASHRAE 62, Ventilation for Acceptable Indoor Air Quality, and keeping current on the standard. 7.
Ensure proper preventative maintenance of HVAC units. 8.
Prevent and respond to water intrusions within Buhler USD 313 buildings. 38

Maintain proper drainage around buildings. Monitor and maintain appropriate relative humidity levels. Whereas the School Board bears responsibility for the best use of tax dollars, and Whereas public education can provide leadership in developing a realistic energy ethic and awareness if energy needs and costs, Therefore, the School Board of Buhler USD 313 directs the superintendent and/or his/her agents to develop short and long range strategies in the areas of facilities management and curriculum development dealing with energy awareness and conservation. (For more detailed guidelines contact the Burkholder Administrative Center. Use of Facilities Requests for use of school buildings should be directed to the building principal when school is in session and to the business manager at other times. If the school is sponsoring a social function, the school must provide custodial service. Request for custodial service at these functions should be submitted in writing to the business manager for approval. Specific procedures and fees are described in the Board policy manual. Requests must be made in writing and must be approved by the building principal. However, requests to use the school equipment and furniture are discouraged. Please refer to the Board of Education Policy Manual, Section KGB, for further details. Request for use of school grounds should be directed to the building principal when school is in session and to the business manager at other times. The operation of mini-­‐bikes, motorcycles, motorized vehicles or horses are prohibited on the school grounds with the following exceptions: • use of driveways to enter or leave parking areas; • use of parking areas while attending school or attending school events. Use of School Facilities/Grounds for Memorial Services/Funerals The primary purpose of school facilities and grounds is to support the educational and extra-­‐
curricular endeavors of all students. It is the intent of the Buhler USD 313 Board of Education to maintain all facilities and grounds for this purpose and to give first priority to these endeavors. Furthermore, the Board of Education believes learning best takes place in an environment protected from undue emotional stress. It is the belief of the school district that using school grounds or facilities for memorial and/or funeral services is not in the best interest of all students. Therefore, the granting of such requests during school time is prohibited. 39
Requests for use of school grounds or facilities for such purposes after school and on weekends are discouraged. Equipment Use Use of equipment and supplies is for the performance of official and approved assignments only. Use of district equipment or supplies for personal projects is prohibited without prior permission of the employee’s supervisor. Use of Telephone No staff member or student will be called from their duties/class unless it is an emergency. A message slip will be made of incoming calls and the message will be delivered when it is possible to deliver. If the message cannot be taken, the number of the party calling will be relayed so that the staff member/student may call back at the earliest convenient time. In case of emergency, the teacher or student will be called to the phone immediately. Staff members wishing to make long distance calls on school business only should contact their building principal. Long distance personal calls are discouraged. Copying and Duplicating The copyright laws of the United States make it illegal for anyone to duplicate copyrighted materials without permission. Severe penalties are provided for unauthorized copying of all materials covered by the act unless the copying falls within the bounds of the “fair use” doctrine. Any duplication of copyrighted materials by district employees must be done with permission of the copyright holder or within the bounds of “fair use,” as set forth in Board policy. Technology Policy Technology is any form of electronic equipment or media designed to support the productivity of the students, staff and patrons of Buhler USD 313 and enhance the learning process. This equipment includes, but is not limited to, desktop computers, laptops, printers, networking equipment, the Internet, e-­‐mail, other forms of telecommunications, telephones, all forms of software and other peripherals. Use of our access to district technology is for approved educational and professional use only. Employees are expected to comply with the policy as a condition of employment. The district retains the right to discipline any employee, up to and including termination, for violations of this policy. Ownership of Employee/Student-­‐Produced Computer Materials All information created by employees shall be considered district property and shall be subject to unannounced monitoring by district administrators. Computer materials or devices created 40
as part of any assigned district responsibility or classroom activity undertaken on school time shall be the property of the Board. Copyright Software and other materials acquired by staff using either district or personal funds, and installed on district technology, must comply with copyright laws. Proof of purchase (copy or original) must be filed in the district office. Installation Only software purchased by the district may be loaded onto district computers. Software licensed to the district shall not be used on computers not owned by the district without prior approval. District software shall not be copies for personal use without prior approval. No software, including freeware or shareware, may be installed on any district computer until cleared by the system administrator. Program files must have the approval of the administrator to be installed on any district server or computers. Students shall not install software on district computers or computer systems. Employees shall only use passwords or other encoding or security mechanisms as assigned by system administrator. The use of a password does not affect the employer’s right to monitor. All forms of electronic communications are subject to monitoring by the employer to ensure the systems are only being used for official purposes. Hardware Staff shall not install unapproved hardware on district computers or make changes to software setting that support district hardware. Computer Materials The administration may conduct periodic audits of software installed on district equipment to verify legitimate use. Privacy Rights Employees shall have no expectation of privacy or restricted access to any information generated during the course of their official duties or entered in any district computers or other forms of technology. Any email or computer application or information in district computers or computer systems is subject to monitoring by the administration. E-­‐mail Buhler USD 313 e-­‐mail accounts are first and foremost for education/business-­‐related activities. Access is a privilege, and with it comes an expectation of responsible use. Employees should use this technology to support their work and accomplish the educational mission of our school district. Employees waive any right to privacy in e-­‐mail messages and consent to the access and disclosure of e-­‐mail messages by authorized employees. 41
Messages/information sent using the all@... Address must have building administration approval, must be business/education related and must pertain to the majority of our employees. Internet The Internet is an electronic communications network that provides vast, diverse and unique resources. Our goal in providing this service is to promote educational excellence by facilitating resource sharing, innovation and communication. Inappropriate use and/or transmission of any material in violation of any United State or state regulation, is prohibited. This includes, but is not limited to copyrighted material, threatening or obscene material, or material protected by a trade secret. District Web Presence Our schools’ web presence represents the school to a potentially greater audience than any other medium. The collection of electronic documents can be an excellent way to provide unique information about the schools. In addition, the World Wide Web is an excellent teacher and learning tool. Buhler USD 313 web pages will be used for the following purposes: • Share Information • Share Resources • Provide authentic classroom and audience experiences for students • Bring real-­‐world relevance to curriculum and expands the classroom beyond the traditional “four walls” Please note: Some of the information included in the following policy is repeated from the Board of Education Technology Policy printed above. This Acceptable Use Policy is reprinted here for your information. Every student and parent/guardian must sign the agreement before access to technology is granted. These agreements are kept on file. Policies and Guidelines related to the use of District Technology “Acceptable Technology Use Policy” Approved by the Board of Education January, 1998 Overview and Purpose All of the guidelines and procedures outlined in this document pertaining to the acceptable use of technology are intended to make that technology more useful to students, staff and patrons of Buhler USD 313. These guidelines are also intended to maximize the learning environment and process. Access to these technologies is a privilege that comes with responsibility. Buhler USD 313 views information gathered from various technological resources, including the Internet, in the same manner as reference materials identified by the schools. Specifically, the district supports resources that will enhance the learning environment with directed guidelines and supervision from the faculty and staff. Exploration and manipulation of resources is 42
encouraged. However, it is impossible to control all materials on a global network and an industrious user may discover inappropriate information that is not consistent with the educational mission, goals and policies of the school district. Guidelines for Acceptable Use Acceptable Use Policy – Rules of Behavior: Informal rules of behavior have evolved for the use of technology and communication on the Internet and other online services. All users of Buhler USD 313 computers and networks are expected to abide by the generally accepted rules of technology usage and etiquette. Collectively, they help to identify a level of acceptable use of the technology in Buhler USD 313. These rules of behavior include, but are not limited to, the following: Technology Usage Guidelines: • Treat the technology like you’d treat your own – with respect. • Always ask permission before using a computer or other form of technology. • Use the technology only for school-­‐related activities: homework, research, etc. • Respect other people’s files on the computer, network, etc. Do not change, copy, delete, read, or otherwise attempt to access files that are not yours. • Do not install or remove any software on a computer. • Remember that others need to use the computers and technology, too. Don’t monopolize it. • All software installed on the computers is copyrighted. Do not copy, distribute, or alter it in any way. • Classroom and district rules and policies toward plagiarism are expanded to include technology-­‐based research methods. ‘Netiquette’: Rules of the Online World • Never give our personal information anywhere on the Internet. • Be concerned about getting personal e-­‐mail messages from anyone online asking you for personal information, attempting to arrange private meetings, etc. • Do not bypass any security measures installed on the computers and network. • Never use the Internet to harm other people in any way. • Always ask for permission to use pictures or text from someone’s Web site in your work. • Treat other online users as you would like to be treated – with respect. • Protect your password(s). • “Lurk” before you leap; read what others have written before you post your comments. • While at school, use the Internet only for school-­‐related activities, homework, research, etc. • Note that electronic mail (e-­‐mail) is not guaranteed to be private. People who operate the system do have access to mail. 43
Acceptable Use Policy – State and Local Policies: Use of district technology (as defined above) is a privilege that comes with responsibility. Violations of the policies and procedures of Buhler USD 313 and/or Kansas Law concerning the use of technology will result in disciplinary action. State and local policies concerning these issues are outlined below. USD 313 Board Policy: Computer Materials (IIBG) • Ownership of Employee/Student-­‐Produced Computer Materials: Computer materials or devices created as part of any assigned district responsibility or classroom activity undertaken on school time shall be the property of the Board. The Board’s rules governing ownership of employee or student-­‐produced computer materials are on file with the clerk and are available upon request. • Computer Use: Use of district computers or software is for performance of official and approved assignments only. Use of district computer equipment or software for personal projects is prohibited without prior permission of the administration. • Administrative Access to Computerized Information: All computer-­‐
generated information produced by students and employees are subject to administration or Board review. Kansas Law K.S.A. 21-­‐3755 Computer crime; criminal computer access. As used in this section, the following words and phrases shall have the meaning respectively ascribed thereto: • “Access” means to approach, instruct, communicate with, store data in, retrieve data from, or otherwise make use of any resources of a computer, computer system or computer network. • “Computer” means an electronic device which performs work using programmed instruction and which has one or more of the capabilities of storage, logic, arithmetic or communication and includes all input, output, processing, storage, software or communication facilities which are connected or related to such a device in a system or network. • “Computer network” means the interconnection of communication lines, including microwave or other means of electronic communication, with a computer through remote terminals, or a complex consisting or two or more interconnected computers. • “Computer program” means a series of instructions or statements in a form acceptable to a computer which permits the functioning of a computer system in a manner designed to provide appropriate products from such computer system. 44
“Computer software: means computer programs, procedures and associated documentation concerned with the operation of a computer system. • “Computer system” means a set of related computer equipment or devices and computer software which may be connected and unconnected. • “Financial instrument” means any check, draft, money order, certificate of deposit, letter of credit, bill of exchange, credit card, debit card or marketable security. • “Property” includes, but is not limited to, financial instruments, information, electronically produced or stored data, supporting documentation and computer software in either machine or human readable form. • “Services” includes, but are not limited to, computer time, data processing and store functions and other uses of a computer, computer system or computer network to perform useful work. • “Supporting documentation” includes, but is not limited to, all documentation used in the construction, classification, implementation, use or modification of computer software, computer programs or data. Computer crime is: • Intentionally and without authorization gaining or attempting to gain access to and damaging, modifying, altering, destroying, copying, disclosing or taking possession of a computer, computer system, computer network or any other property; • Using a computer, computer system, computer network or any other property for the purpose of devising or executing a scheme or artifice with the intent to defraud or for the purpose of obtaining money, property, services or any other thing of value by means of false or fraudulent pretense or representation, or; • Intentionally exceeding the limits of authorization and damaging, modifying, altering, destroying, copying, disclosing or taking possession of a computer, computer system, computer network or any other property. • Computer crime which causes a loss of the value of at least $500 is a Class A nonperson misdemeanor. • Computer crime which causes a loss of the value of at least $500 but less than $25,000 is a severity level 9, nonperson felony. • Computer crime which causes a loss of the value of $25,000 or more is a severity level 7, nonperson felony. In any prosecution for computer crime, it is a defense that the property or services were appropriated only and avowedly under a claim of title made in good faith. •

Criminal computer access in intentionally, fraudulently and without authorization gaining or attempting to gain access to any computer, computer system, computer network or to any computer software, program, documentation, data or property contained in any computer, computer system or computer network. Criminal computer access is a Class A nonperson misdemeanor. This section shall be part of and supplemental to the Kansas criminal code. Acceptable Use Policy – Security: If you identify a security problem, notify a faculty member immediately. • Do not show or identify security problems to others. • Do not reveal your password(s) to another person for use. • Attempts to log in as another use may result in cancellation of privileges. • Any user identified as a security risk or having a history of problems with other computer systems may be denied access. Users may occasionally be required to update/change password information in order to continue access. Acceptable Use Policy – Privileges: Access to all forms of technology is a privilege. Unacceptable usage may result in revoked privileges and/or district disciplinary actions. Acceptable Use Policy – Vandalism/Harassment: Vandalism and/or harassment will result in the cancellation of the offending user’s account. • Vandalism is defined as any malicious attempt to harm or destroy data of another user, the Internet or other networks. This includes, but is not limited to, creating and/or uploading computer viruses. • Harassment is defined as the persistent annoyance of another user or the interference in another user’s work. This includes, but is not limited to, the sending of unwanted e-­‐mail. 46
