HOLIDAY TOY DRIVE
The Elmwood Business Association is sponsoring our annual
Toy Drive for Angels’ Place and we’d like your help!
Angels’ Place, INC. is a non-profit organization which provides
a loving and caring environment for children diagnosed with lifethreatening illness. The respite/hospice atmosphere provided
by Angels’ Place is dedicated to the ease and comfort of the
whole family and helping preserve the family unit.
For the past few years, the toy drive has been an incredible success. We have touched the lives of many who are less
fortunate and we have been able to brighten their holidays.
Please help us continue doing so by making a contribution this year. Keep in mind we need
items for girls and boys of all ages.

TAX HIGHLIGHTS

YEAR END TAX PLANNING
As the holidays are fast approaching, all of our
thoughts at this time of the year should be geared
toward tax planning. Now is the time to evaluate
your tax situation and make some key decisions that
will determine your tax liability in April 2010. After
December 31, many tax planning opportunities are
eliminated.
BUYING A NEW VEHICLE
As part of the American Recovery and Reinvestment
Act of 2009, you may be able to deduct any sales
taxes paid in 2009 on a new vehicle. This deduction
applies to most vehicles weighing under 8,500
pounds. The deduction can either be claimed as an
itemized deduction for those taxpayers who itemize,
or can be added to the standard deduction for those
who do not itemize. The deduction is phased out for
higher income levels.
CAPITAL LOSSES
Remember that it may be time to sell capital assets,
such as stocks. Capital losses can offset capital gains
and also can be used to reduce other income by
$3,000.
CAPITAL GAINS TAX RATES
This may be the last year for reduced capital gains tax
rates. Currently, there is a 0% tax on capital gains if

you are in the 10% or 15% tax bracket. Once you
enter the 25% tax bracket, $33,950 of taxable income
for single filers and $67,900 for married filing jointly,
the long term gain tax rate is 15%. There is a good
chance that Congress will increase these rates in the
future.
RETIREMENT ACCOUNT DISTRIBUTIONS
There is no required year end distribution from IRA’s
or other retirement accounts this year for taxpayers
over 70 1/2 years old.
PROPERTY TAXES
Once again this year remember to include your
property taxes paid on the itemized deduction
schedule. If you do not itemize, you can still add up
to $500 for single filers and $1,000 for married filing
jointly as an addition to the standard deduction.
STATE INCOME TAX DEDUCTION FOR
EDUCATION EXPENSES
New for 2009, the State is allowing an income tax
deduction for tuition and fees for a dependent’s
enrollment in a nonpublic elementary or secondary
school. The deduction is limited to 50% of the
expenses paid per dependent and up to $5,000.
Qualifying expenses include: tuition, school
uniforms, textbooks, and school supplies required by
schools.

ARE YOU READY FOR H1N1 FLU AT WORK?
Disability Issues and Leave Policies

The Americans with Disabilities Act (ADA) prohibits discriminating against employees because
of a “disability”. A disability typically has a significant impact on a person’s life and involves a
condition that is permanent. The ADA also regulates questioning an employee about a disability
and employer-sponsored medical examinations and tests. The ADA is enforced by the EEOC, a
federal agency. The ADA may affect how an employer with 15 or more employees deals with employees during flu
season.
H1N1 or swine flu is a strain of flu which is said to be worse than “seasonal” flu. The EEOC takes the position that
seasonal flu is not a disability and therefore not subject to the anti-discrimination provisions of the ADA but that H1N1
flu is a disability. The restrictions on medical tests applies in all situations, not just those concerning a disability.
According to the EEOC, an employer dealing with swine flu at work may take certain steps to protect the
workplace. A company may send home an employee who displays flu-like symptoms. The ADA permits an employer
to require employees to follow infection control measures such as frequent hand washing and coughing and sneezing
into an elbow. And the EEOC says an employer may ask an employee about the nature of her symptoms—
but an employer may not ask if an employee
has an underlying condition (like diabetes)
that might make him more susceptible to the
flu or a secondary infection (such as
pneumonia) from H1N1 flu. An employer
may use tele-work” as a measure to
reduce opportunities for infection.

The EEOC urges all employers to obtain
information from the CDC (www.cdc.gov).
H1N1 flu promises to challenge a
company’s leave practices, especially paid
sick leave. A company may want to consider
changing its sick leave practices to address
H1N1 such as adding more paid days (do
you really want Bob back at work coughing
on everyone and getting co-workers sick?),
accelerating the accrual of paid days for new
hires or extending the number of unpaid days
so sick employees feel some measure of job
security and less pressure to return until they
are well.
Leave policies may also be affected
where your employee is well but has a
dependent with flu to take care of such as a
child. Again the same issues surface: the
use of paid leave, the extension of unpaid
leave, allowing new employees to use leave.
Leave policies often do not address dependent care so that may be a topic to consider
now.
If an employer is covered by the Family
and Medical Leave Act (FMLA), many of
the considerations concerning leave practices
will transform from optional to mandatory.
But FMLA is a topic for another day.

also assists Harahan Elementary School as part of our
Adopt-a-School program as well as collecting
donations of toys and food annually for Angel’s Place
and Second Harvest Food Bank respectively.
