objective of the program is to reach out
to young people and teach them to give
more value to music and help them
discover their musical side. The latest

KickassTorrents under the domain
name KAT.PH is the second most
popular torrent download site in the
world next to Pirate Bay. The site
provides torrent files and links to
facilitate illegal peer-to-peer file
sharing of copyrighted works. In
June 14, 2013, the domain name
kat.ph was taken down by the local
domain name service provider

26th Awit Awards
The Awit Awards Committee is already finished with the screening
and final judging for the 26th Awit Awards. Results are already with
the auditors and we are finalizing the plans for the awards night.
The 26th Awit Awards screening was handled by the Philippine
Association of the Record Industry, Inc. (PARI, Inc) with the help of
our sponsors, STI College (for computers and programming) and
PriceWaterhouseCoopers (for the auditing and results). AC

OMB – Chinese General Hospital
Memorandum of Agreement (MOA)

In the agreement, Chinese General
Hospital (CGH) shall provide preliminary medical aid
and treatment at the Chinese General Hospital and
Medical Center to all OMB Personnel assigned in Metro
Manila who sustained injuries or wounds during the
actual performance of their “official duties”.
Chinese General Hospital (CGH) shall provide
diagnosis, treatment, surgeries and major operations as
well as use of its medical equipment and facilities from
admission to release for FREE.
The Optical Media Board extends their appreciation to
Ambassador James Dy, Mr. Ramon Chuaying, and the
Chinese General Hospital for making the agreement
possible. They will now have renewed confidence in
dealing with optical media piracy. AC

The Kat.PH case started from the complaints of the local record labels under
PARI membership. The torrent download site kat.PH was doing “irreparable damage” to the
music industry by providing illegal download links to copyrighted works owned by the local
record labels.
After gathering strong evidences against the site, PARI, given the authority by the record
labels, filed a case against kat.PH before the Bureau of Legal Affairs (BLA) of the Intellectual
Property Office of the Philippines (IPOPH). Reyes-Fajardo Law Office is handling the case
headed by Atty. Ivy Reyes-Fajardo. On June 14, 2013, the IPO issued a Temporary
Restraining Order (TRO) ordering the domain name service provider, dotPH, to take down the
domain name of kat.PH.
The take down order created a worldwide buzz and crippled the illegal site
for some time. It forced kickasstorrents to abandon the kat.ph domain
name and transferred to another domain name service provider outside
the Philippines. Although they are now operating again under a different
domain name, this move by PARI and the reaction of the Philippine
Government through the IPO clearly showed the world that the Philippines
is really serious in dealing with online piracy. PARI is still pursuing the
case against KickassTorrents and we are now working together with
dotPH to further protect copyrighted works online. AC
The IP Code (Republic Act. No. 8293) has been
amended last February 28, 2013. Among the other
amendments like Establishment of a Copyright
Bureau, Accreditation of Collective Management Organizations (CMOs), Fair use for
the blind, Formulation of IP policies; the most important amendment would be the
granting of enforcement powers to the IPO. This would give the IPO more teeth in
protecting copyright owners from infringement although there is still no clear provision
in the IP code that is dedicated to addressing internet or online piracy. This prompted
the PARI board to plan and lobby for a law in congress to address the problem. AC

Nationwide Sticker Campaign
The OMB/PARI/AVIDPhil nationwide
sticker campaign is a partnership
project between the Optical Media
Board, PARI, Assoc. of Video
Distributors of the Philippines
(AVIDPhil), and legitimate film and
music outlets, Astrovision, Odyssey
and Viva Video. The objective of this
project is to create anti-piracy
awareness, spread the “Bawal
Kumopya” anti-piracy battle cry, and
create a feedback system where
people could report any form of Movie
and Music Piracy. The partnership
with the legitimate outlets will ensure
that the nationwide distribution of the
stickers will reach the different parts of
the Philippines. Aside from this, the
sticker will also be a stand-alone antipiracy campaign tool for OMB, PARI,
and AVIDPhil. Finalization of the
project will soon be realized and the
distribution and launch of the project
will follow. AC

Piracy-Free Bazaars / Tiangges
The following accomplishments prompted the International Intellectual
Property Alliance (IIPA) to recommend the removal of the Philippines
from the Piracy Watchlist of the US Trade Representative (USTR)
Special 301 Report:
• In the past two years, the removal of piracy from Quiapo
and) and Makati Cinema Square (Makati);
• the passage of the anti-camcording law;
• the issuance of Supreme Court Rules of Procedure for
Intellectual Property Cases;
• the establishment of administrative enforcement functions of
the IP Office (and the availability of injunctive relief);
• and, an MOU between Philippine National Police (PNP) and
OMB to remove red tape.

Unfortunately, USTR has retained the Philippines in the Watchlist
even after the positive recommendation of IIPA. We have to address
the following according to USTR: Internet piracy / Some issues in the
patent law / Poor protection of undisclosed confidential information
and strengthening enforcement (such as criminal enforcement and
predictability for search and seizure orders). AC
We are on our 3rd year with this partnership with
the Optical Media Board. The project is about
making sure that the bazaars and tiangges this
holiday shopping season are free from Optical
Media Pirated products such as movie and music
DVDs and CDs. We are happy that the
Bazaar/Tiangges organizers are imposing strict
rules against selling pirated products but some
tenants are still violating their agreement with the
organizers. The OMB closed down one stall in one
bazaar at the Fort due to selling pirated DVDs and
CDs. AC

OMB Nationwide campaign
The Optical Media Board has been very effective with
their city operations in Metro Manila for the past couple
of years. Piracy is gradually being shifted to the
underground market. Most of the vendors are now on
foot trying to evade authorities. They usually operate at
night to avoid raids. The Optical Media Board is now
shifting its focus into a more broader nationwide scope.
Due to financial constraints and logistical problems,
operating nationwide is a big burden for the agency.
But giving their limited budget and personnel, the
agency has been able to conduct operations outside
Metro Manila effectively. Among other provinces and
cities, the OMB has operated in Cavite, Pampanga,
Nueva Ecija, Benguet, Tarlac, Laguna, Batangas,
Cebu, Cagayan, Bacolod, Iloilo, Baguio, Tagaytay,
Rizal, etc. AC
“OPERATE & EDUCATE” This is what the Optical Media
board believes in. Operations and raids alone could not solve the
piracy problem in the country. We have to educate people of the
negative effects of piracy and from there they will start to
understand our cause. We need to start educating the students as
they are the next
generation leaders of
this nation. We need
to educate the vendors
as well as they need to
shift to legitimate
businesses rather than
selling pirated goods.

The Optical Media Board with the help of the Crime
Investigation and Detection Group (CIDG) has
seized a total of 60 boxes of Pirated DVDs and CDs
found inside a parked truck in Palanca Street,
Quiapo last May 2013. The pirated goods
amounted to approximately P6,000,000. The
goods are about to be delivered to satellite pirated
stalls within Metro Manila. The DVDs and CDs
were seized and the truck was impounded at the

List of PARI Gold, Platinum, & Diamond Awards
The list of PARI Gold, Platinum, & Diamond awardees is now accessible via
PARI’s website. The awards were given starting from the year 1990. The
awards are listed per year in chronological order. The awards were certified
and authenticated by the Philippine Association of the Record Industry, Inc.
(PARI, Inc.) based on the total units sold.
The standard awards given by PARI are Gold, Platinum, and Diamond. In
some cases, a multi-platinum award is given if multiples of the platinum
requirement is achieved. As of 2013, we are using the following standards:
Gold Record Award for 7,500 units sold, Platinum Record Award for 15,000
units sold, and Diamond Record Award for 150,000 units sold.
