During the past two months we have been
n e g o t i a t i n g for a new contract with the J . p. Manning
Company of Boston.
During a l l of the conferences
that we have had, the Company refuses to give us an
increase.
We have been before the State Board of
Conciliation and Arbitration and have agreed to arbitrate
the question in d i s p u t e , andthe Company has refused.
Last year when we organized these men, we had a strike
that lasted twelve weeks, and we do not want to go through
it again.

Local 646 haa paid
a p p l i c a t i o n for 95 men employed by the Boston Fruit Terminal.
The Company has a signed contract -.1th the nallv.ay Clerks
w ich can be terminated by either side on thirty day3 written
notice.
These 95 men do not desire to i,tay as members of the
ailwa^ clerks ^rothHrhnnj and have sent their resignations
to the ^ailEoy Clerk3 Brotherhood's headquarters in Cincinnati
stating that they have resigned fron membership in the clerks
organization.
Local 646 tried to get some results from the
Company having 95 nen and the Clerks only 5 men.

Enclosed please find letter in answer
to your letter of September 9th pertaining to the complaint
of the Butcher Workmen t i a t the Teamster's Union has members
working in the New England Rendering Co. taat belong to the
Butchers or the Amalgamated Workers received by your o f f i c e
from Mr. Gorman, Secretary-Treasurer of the Amalgamated
Workers.
The enclosed letter explains just what
has been done. Local 646 organized these men and never had
any complaint u n t i l now. Local 646 informs me that the men
in question do loading and trucking around the pldht and
belong to the Teamsters Union.

For your information, we were contacted recently by an
o r g a n i z a t i o n , New England Rendering Company, a subsidiary of Swift
& Company, in regards to organizing the men in this p l a n t .
A meeting
was called f o r the purpose of o r g a n i z i n g .
At the time of this meeting,
there were representatives of the Machinists U n i o n , Amalgamated Meat
Cutters, Teamsters' Local #25 and Teamsters' Local # 6 ^ 6 .
At the time
of this meeting, Teamsters' Local #25 said that the truck drivers cam?
under their j u r i s d i c t i o n and should po into their o r g a n i z a t i o n .
We
contended that the men should be with u s , and this was settled between
representatives of both teamsters' u n i o n s .
We then contended that the
inside employees who do warehouse and laboring work belong to our organi z a t i o n , excluding from this group machinists and maintenance men which
the M a c h i n i s t s ' Union claims and which there is no dispute on our p a r t .
A dispute then arose between our organization and the meat
cutters in regards to the inside employees.
We told the Meat C u t t e r s '
Organization that we did not want any meat cutters or any men engaged in
slaughtering work and were only interested in warehouse men and men doing
laboring worlt. At this meeting, there was present four business agents
from a local of the Meat Cutters and also an International Representative.
A f t e r talking the matter over in the hall amongst c u r a t i v e s , the Representatives of the Meat Cutters agreed that a l l these men would go into our
organization with the exception of the meat o^tters and that we would not
hear from the Meat Cutters Organization again in regards to this matter.

For the past two years, we have under contract two Large
companies in the Boston area doing this t y e of work.
At the time
of the organization of these men, we called in a representatives of
the Meat Cutters to take these men, and the men refused to join
the Meat Cutters' Organization t e l l i n g us at that time that they
would prefer to j o i n the C. I . 0 . rather than j o i n the Meat Cutters'
Organization.
At the time of the organization of both of these
plants, which we now have under contract, there was a strike which
lasted three weeks.
The C. I . 0 . tried to organize these companies,
but we succeeded in getting the men into
our organization.
We f e e l where we have this type of work organized that the
men belong to the j u r i s d i c t i o n of the Teamsters' and not the Amalgamated
Meat C u t t e r s .

In the event that no modification is made by this Board of its

Labor Board for processing in the usual course.
In the event that modification of the Order is made the within rules with respect to modified
Directive Orders will govern.

Petitions for Review of Rulings or Directive Orders Modified Upon
Reconsideration
If the ruling or directive order issued by an agent of the Board
is modified by such agent in response to a petition for reconsideration
or upon its own motion, tho agent shall issue to the parties cuch ruling
or order, as modified, in tho same manner and with the same effect as is
provided in Section 002.37 above,

be subject to review in accordance with tho provisions of Sections 902.38
and 3 0 2 . 3 9 above except that tho period prescribed therein for f i l i n g a

The National
ar Labor Board desires to call to the attention of companies and unions the d e s i r a b i l i t y of refraining from
f i l i n g appeals to th National Board unless they are thoroughly
convinced that the order of the Regional Board or commission is
defective under the p o l i c i e s laid down by the National Beard.
The appeals procedure unanimously adopted by the national Board
orovides that appeals w i l l only be considered on a clear showing
that:
1 . The order exceeds the Board's j u r i s d i c t i o n , or
- 2*. The order contravenes the eeta li^hed p o l i c i e s
of the Board, or
3 . A novel question i s ^nvolvjd of cuch importance
as to ---arrant national action, or
4 . The procedure r o s u l t i r j in the T d ; r wes unfair
to the p e t i t i o n j r , and has caused substantial
hardship.
The statistics on th^ disposition of aopeals in recent
months by the National Board demonstrates rather conclusively
that a very lar ,e number of appeals hav^ been f i l e d needlessly
by both com^ani^s and unions.

Joint Council No. 10 & r e q u e s t for e n d o r s e m e n t of strike
sanction in the m a t t e r o f A r m o u r , Clinton-Hollis and t h e
^tropolitan Supply Company, involving approximately 122 men.
The required committee xas appointed and after they had
completed their investigation they submitted their report
to the Council at its meeting of :..arch 12, 1947.
The committee in its report recommended that the endorsement of the strike sanction sought, be approved.
The report of the committer was accepted and its t-ecommendation
adopted.

Dear Sir and Brother:
I am asking for a Strike Sanction which
involves about 120 people with the companies listed
below:
Armour and Company of Boston, Massachusetts
Swift and Company, Clinton H o l l i s Market of Boston,
Metropolitan Hotel Supply Company of Boston, Mass.
Mass.
I have been negotiating with these companies
for some time and have failed to come to an agreement.
On Wednesday, Maroh 1 2 , 1 9 4 7 , our Local Union received
the approval of Joint Council No. 10 for a strike
sanction.
In compliance with the Smith-Connally Act,
I have n o t i f i e d Secretary of Labor, Mr. Lewis Schwellenbach
and the cases of these three companies have been recorded
in Washington.
The 50-dsv waiting period was up Maroh 1 2 ,
1947.
Hoping the International will grant me this
sanction, although I w i l l do my best to settle these cases
peacefully without having to resort to a stoppage of work.

be prmnt+d. They also indicated that Local 64 ef ^revidence,

I n c . negotiations and recommended an endorsement of the
request of that Local Lnlen although i t is not a f f i l i a t e d

I am asking for a Strike Sanction which involves
about 13 people, who are employee at the Schuler Foods,
Incorporated of Cambridge and Avon, Massachusetts.
I have been negotiating with this company for
some time and have f a i l e d to come to an agreement.
On September 8 , 1 9 4 8 , our Local Union received the
approval of Joint Council Ko. 10 for a strike
sanction.
Our Local Un!on has also complied with a l l
Federal and State Laws, as well as a l l contract and
constitutional provisions.
Hoping the International w i l l rrant me this
Sanction, although I w i l l do my best to settle this
case peacefully, without having to resort to a
s t o p p a e of work.

terminated March 4 , 1 9 5 0 .
