Joint Endeavour of NCPCR & JSCPCR Venue: Auditorium, Rajendra Institute of Medical Sciences, Bariatu, Ranchi Date: 11 th – 12th November 2013 State Level Public Hearing Report – Jharkhand 2013 Background Jharkhand is a state in eastern India. “Jhar” meaning the land of forests is the 28th state of Indian
union carved out of the southern part of Bihar on 15th November 2000 and specially a tribal
dominated state. It is rich with vast biodiversity and beautiful landscapes. It has a diverse ethnical,
cultural, linguistic heritage with largely agriculture and forest based livelihoods. Jharkhand has 24
districts, 260 blocks and 32,620 villages. The industrial city, Ranchi is its capital. Sophisticated steel
and power plants also flourish here.
About three quarters of the state’s 32.9 million people live in rural areas, many in traditional tribal
groups. Lying beneath the forests of one of the poorest states in India, with high child under
nutrition and anaemia among women, is one of the greatest mineral wealth in the country. Onethird of Jharkhand’s children do not have full immunization against childhood diseases. The state’s
literacy rate is 66%. Dropout rate among poor, female and tribal children at the elementary
education level is high. Child marriage is still prevalent in tribal communities. A large number of
households in rural Jharkhand don’t use toilets. There is a growing incident of child abuse and
trafficking of minors, especially girls, to other metropolitan cities including Delhi, as domestic help.

State Level Public Hearing Report – Jharkhand 2013 Rationale Child protection is the foundation of all child rights and therefore child rights cannot be achieved
without ensuring protective environment for children in the State. As Jharkhand is facing lot of
child issues there is a need to ensure that children living under the difficult circumstances are given
required help. There is an urgent need to ensure that children of the State are protected under the
laws made for them.
In the recent years Integrated Child Protection Scheme (ICPS) envisages ensuring protective
environment for children living under difficult circumstances. There is needed to make innovation
in the ICPS programme to meet local needs and to converge with various departments to achieve
the goals.
It is evident that Children in difficult situation should be identified at the local level and should be
provided necessary facilities in their surrounding environment.The Public hearing attempts to
provide safe and secure environment for overall development of the children in need of care and
protection and children in conflict with law; improving well-being of children in difficult
circumstances and reducing vulnerabilities. In this respect a series of Public hearing is being
conducted in Jharkhand on different issues for the protection of child rights issues.

State Level Public Hearing Report – Jharkhand 2013 Day – I, 11th Nov’13 Registration of Child Cases Before Public hearing cases were registered from all over Jharkhand with focus on RTE, child
labour, sexual harassment of child, missing child, and cases on trafficking. The cases were brought
from department and also through different network partners. In total 99 cases were registered.

Inaugural Session: The workshop started with RTE Anthem and presenting the bouquet to all members of NCPCR and
Jury members by the children who came from different districts of Jharkhand.
Welcome address by Smt. Rooplaxmi Munda, Chairperson JSCPCR Smt. Munda welcome with ‘Johar’ to all delegates and
other
participants. She conveyed the objective of
today’s public hearing in which an
attempt will be made to sort-out the
issues related to RTE, child rights and
trafficking. She also mentioned that
this is first time when public hearing
is being organised in Ranchi at State
level. She also reiterated that
organizing such a public hearing is a
good sign for the benefit of the children.
She brought the attention of the rights of
children, that are already been depriving in the context of
Jharkhand.
After the welcome address the workshop
started with lighting of lamp by all
members of hearing bench.

State Level Public Hearing Report – Jharkhand 2013 Key note address: Mr. Vinod Kumar Tikku, Member, NCPCR First of all he welcomes and thanks to all delegates and participants from NCPCR. He thanked the
whole team for such a huge effort. In his notes he told that commission was established in 2007 at
national and state level and it is the
highest constitutional body which is
committed for the child rights. He told
that the objective of commission is
centred on monitoring of children
rights. Those cases which do not have
attention at national level will be solved
here, commission has made numerous
efforts
in
the
field
of
children’s
development in the country specifically
for those who work in the railway
signals, got trafficked, and deprived
from their rights. He made stress that
there’s needed to make efforts by whole society
including govt. officials, NGOs, social institutions, experts etc. towards development as well as
protection of children. With concluding of his speech he said problems of the children will be
solved within a timeline.
Opening Remark: Smt. Kushal Singh, Chairperson, NCPCR The context was further elaborated by Smt. Kushal Singh. She started with the basic idea behind
organising of such type of public hearing by commissions to address the common issues of child
rights. She emphasized that children are not the future citizen but they are the citizen of today’s
phenomena so they should also enjoy all those rights which has already been given to other
citizens. She further elaborated the different conventions of UN on protection of child rights. She
told that children should have the basic rights of proper nutrition, birth certificate registration,
rights to survival, right to development which includes physical and mental growth, right to
recognition etc. Commission took lots of intiatives in ensuring all these which includes protection
also.
She told that a number of laws were enacted for protection of child rights - The Child Labour
(Prohibition and regulation) Act, The Juvenile Justice Act, Right to Education Act and CPCR Act.
Research and survey is required which will help to design robust policy for the protection of child
rights.This is a constructive forum which provides the common platform for interaction with local

requested to start the process of public hearing.
Hearing of Child Cases After the inaugural session the process of public hearing started in which, RTE cases were taken up.
A total of 18 registered cases were
taken along with some fresh complain.
The cases were mainly related with
school infrastrurcture, lack of school
teachers, and irregularity of MDM.
Members of commission raise the
concern of condition of MDM in
some districts of Jharkhand where its
proper implementation is lacking,
where children are deprived of MDM
services. The bench recommended
develop the monitoring mechanism
for teachers who are irregular or not
doing well in their job. They also
mentioned that if in any area, anganwadi center is far from children’s home than mini anganwadi
should be established.
The bench also said that, the State Authorities are themselves responsible for irregularities in RTE
issue as mechanism seems to be failed in State.

The Commission took suo-moto
cognizance of the news item titled
“Surplus food grain, but no mid-day
meal for kids”, published in The Hindu (
24th Aug, 2013) regarding
discontinuation of mid-day meal in at

In the first day of public hearing only the cases taken which have been registered under RTE Act,
has been summarised by Smt. Kushal Singh, Chairperson NCPCR. She concludes the Session by
following major drawbacks of Jharkhand State:

The student and teacher ratio in schools is not appropriate.
•
Lack of infrastructure in schools such as drinking water, toilets, boundary wall, class rooms
etc.
•
No steps have been taken towards corporal punishments neither released any guidelines for
the same and it is still practiced here.
•
The children, who categorised under EWS criteria, are not getting benefits of the RTE Act.
•
MDM implementation is still a challenge.
•
Children with disability, not getting benefit due to lack of attention in inclusive education.
Meeting with Principal Secretary After the hearing of cases RTE, NCPCR and JSCPCR members had a meeting with K. Vidyasagar,
IAS, Principal Secretary, HRD, GOJ and Ms. Mamata, Education Department, GOJ. To start with
commission members raised the
concern of attendance of teachers.
Ms Mamata told that daily
attendance of 100 teachers are
monitored randomly at district and
block level. Draft is ready for
grievance redressal mechanism.
Regarding strengthening of SMC it
was said that, there is an issue of
quality training of SMC so effort is to
have interesting and localized
module for the development of SDP.
VEC still continues because advance
settlement is still due with most of
the VEC, ensured that in coming six
months settlement will be done.
Ms. Kaushal Singh emphasized to have a state advisory committee under Chief Minister in which
State commission also need to be included. Commission also adviced to have teachers for special
need children. Ms. Mamata told that we have made resource pool and mapping of out of special
need children would be done.
National commission told that state commission are not recognized and requested to appoint a
nodal person from the department.
Ms. Kaushal Singh also advised to conduct a social audit atleast in five districts and send NCPCR
the report for which NGOs can be identified. NCPCR has prepared kit for Social audit which will be
send to the education department.

will be finally linked to Adhar no.
Day II, 12th November’13 Hearing of Child Cases The second day of public hearing was conducted for cases related to violation of juvenile justice,
child trafficking and missing cases. In total 27 cases were registered for second day hearing. It was
found that all the trafficking cases was of girls. Board members mentioned that mostly trafficked
girls, who were rescued from other states, belong to Jharkhand State.The members suggested that
the missing cases should be registered and immediately action should be initiated. Mrs. Kushal
Singh discussed about the special provisions under POCSO Act. There are special provisions of
guidelines for treating victim under any offense in POCSO Act. The training shall be given to
officers for this because it is a new act and generally officers are not aware with the provisions of
this act. She also said that NCPCR officers will join the training of police under POCSO Act.

Further the school issues a letter to his parents submitting the grounds for his suspension. The letter issued by the school state “Your ward Master Abhay Prakash of 1 c is hereby suspended till further order for creating problems in the classroom, school premises and in the school bus.” The School asked the parent to keep the child at his residence or admit him to another school. According the news report, this is the second time in the past year that schools in Khunti district have discontinued MDM. It is also reported that since the past two financial years, receipts and utilization certificate were not submitted by the Education Department on time and over Rs. 50 lakh in funds lapsed.
