A motion was made by Chair Donadio, seconded by Commissioner Gunderson to annrove the
minutes of the May 6, 2014 Planning Commission Meeting as presented Vote: 5 Ayes, 0 Nays.
Motion Carried.
A. Review of an Amendment to a Conditional Use Permit as requested by Mount
Olivet Lutheran Church —West Campus to Allow for Expansion of an Existing
Building Located at 7200 Rolling Acres Road,Victoria,Minnesota 55386

Chair Donadio requested that Ms. Kreft give an overview and take questions regarding the
amendment to the Conditional Use Permit requested by Mount Olivet Lutheran Church.
Ms. Kreft stated that the applicant is requesting an amendment to a Conditional Use Permit for
expansion of the existing church due to the height of the structure, which is the reason that a
conditional use permit needed to be granted in April of 2004 for the original structure. This lot is

zoned MR-Multiple Residential, which has a maximum building height of 35 feet. The church
building is approximately 79 feet from lowest grade to peak. The expansion will be a maximum
height of 55 feet from grade.
The church is requesting permission for a 29,000 -square foot
addition for administrative offices and
classrooms, and the existing administrative building on the northeast area of the site will be
removed as part of this plan. The driveway and drop off
- area for the church will also be removed
and reconfigured. A retaining wall will be constructed on two sides of the parking area. They are
proposing a four foot,
black -vinyl, chainlink
fence atop the retaining wall. The architecture will be
similar in nature to the existing structure with a mixture of stone, lap siding, and metal panels.
The existing parking area provides for 159 parking stalls, whereas the new parking will allow for
200 parking stalls, which will be required due to the addition. No changes are proposed to the
egressingress,
/
and access will remain the same on Rolling Acres Road. These plans were sent to
the Carver County Traffic Engineer for comments. The Engineer has stated that turn lanes would
not be required. Storm water
management will need to be upgraded, and a permit from the MCWD
will be required. The church is proposing the construction of two infiltration basins.
Ms.Kreft stated that there has been input from the City Engineer, with those comments attached for
the Commission members, especially regarding utilities. The only concernscomplaints

that have
been received from neighboring residents of the church have been regarding speeding and traffic on
Rolling Acres Road. Ms. Kreft stated that there will be a neighborhood meeting held so that
residents can voice any concerns they might have. The City is working with Carver County on
traffic issues on that road.
Ms.Kreft stated that staff recommends approval of Resolution 14 09
- with the following conditions:
a building permit shall be obtained prior to construction, any permits required from outside
agencies shall be filed with the City, and incorporation of Engineer's Comments dated May 14,
2014. Ms. Kreft asked if there were questions.
Commissioner Goulart inquired about screening of the parking area at the church, and Ms. Kreft
stated there had been no concerns voiced by neighbors to the City in that regard.
Commissioner Loeschen inquired whether some sort of traffic control, be it traffic cones or
something else, would be required during church events. Ms. Kreft stated that it was not required
by the City,but the church had volunteered to do this. Commissioner Loeschen stated that has been
helpful.
Commissioner Loeschen also asked if there would be a sight line review at this time. Ms. Kreft
stated that there had been no discussion in that regard. There had been no concerns or complaints.
Chair Donadio stated that the three homes east of the church have very large trees on their lots at
this time which
provide excellent screening between their lots and the church.

Commissioner Goulart inquired about impervious surface with the addition. Ms. Kreft stated that
the addition will add 8%
to the present impervious surface.
Commissioner Loeschen asked to clarify the parking, which will be 200 parking spaces, 41
additional than prior to the addition being built.

Chair Donadio questioned the four foot,
black -vinyl, chain link
fence and was wondering if there
might be anything else they might consider. Steven Miller, the architect on this project, responded
to this question. The church has made the decision to change from black -metal, chain link
- fencing
to black -metal, picket style
fencing,probably using aluminum. That seemed more agreeable to the
Commission members.
Chair Donadio mentioned the traffic concerns on Rolling Acres Road, as he lives nearby. He said
that landscaping should be taken into consideration near the entrance to the church, since cars
coming out of the church are nearly hit by cars on that road at times due to poor sight lines.
Civil Engineer David Rey stated that there are two trees that can be removed from that entrance,
which would make for a better sight line for traffic in and out of the parking lot. Chair Donadio
stated that he wasn't requesting tree removal, but just wanted to state that there is already a traffic
issue on that road and more so when church events are going on. Steven Miller stated that the
number of Sunday School students will not be increasing, that the congregation is growing, but no
more Sunday School classes are planned. Chair Donadio requested a meeting regarding traffic on
Rolling Meadows Road at some point.
Chair Donadio thanked everyone for their contributions and for attending the meeting tonight.
A motion was made by Chair Donadio, seconded by Loeschen to approve the request for
Resolution No. 14 09:

COUNCIL MEETING UPDATES:
Ms. Kreft stated that the City Council meeting next week will be held on Tuesday night due to
the upcoming holiday on Monday. She then gave the Commission a City Council update. She
stated that the following items were discussed: the relocation of the Public Works Building,
which was approved by the Council, Vacation of Easement for Lake Wassermann Woods, which
was also approved by the Council, the final Plat for Lake Wasserman Woods for a 65 L
- ot,
Single -Family Development by Golden Valley Land Co. at 5980 Marsh Lake Road, which was
also approved by the Council, and a review of Harvest Glen Sketch Plat submitted by K.
Hovnanian Homes for a 77 l-ot, Single -Family Development located north of 78 Street and
south of Highway 5 and west of Madelyn Creek.
Regarding the latter issue with K.Hovnanian Builders, there was significant discussion regarding
the density issue and the fact that this site plan would not conform to the 2030 Plan for the City.
Ms. Kreft stated that the City Council urged K.Hovnanian to look at the options once again and
attempt to conform with the 2030 plan of the City. She stated that she met with the City
Engineer, K. Hovnanian on May 19 to discuss these issues and they talked about a revised
concept plan.
Chair Donadio stated that the Council had, basically, the same concerns as the Commission.

MISCELLANEOUS:
Ms. Kreft reminded the Commission about the groundbreaking ceremonies scheduled for June 2,
2014. The groundbreaking for Public Works will be at 6:00 p.m. and the groundbreaking for City
Hall will be at 7:00 p.m.

BACKGROUND INFORMATION
Lennar has requested review of a final plat for property located north of Rhapsody to be known as
Rhapsody North 2'Addition. Below is the aerial photo of the site:

Zoning F3isto The parcel was annexed in 2005 with the RhapsodyKreyLakes
/
annexation. The
sketch plat was reviewed in June of this year. The preliminary plat,CUP for PUD, rezoning and
easement vacation were approved in September of 2013. The final plat for the first addition was
approved in November of 2013.
Comprehensive Plan Guided as Low Density Residential (15
. - 4.9 units acre).
/
The proposed
density is 1.21 units per gross acre and 2.1 units per net acre for the overall plat.
Roads The development will be served by an extension to Northwest Boulevard. Northwest
Boulevard was constructed as a collector street in the Rhapsody neighborhood with increased right ofway
- and no driveway accesses allowed Ambergate Drive will be connect via the Ambergate
development and provide access to County Road 43.
Schools This development is located within the Eastern Carver County School District. Open
enrollment to Victoria Elementary and Chanhassen High School will close in 2014. Students that
live within the District will still attend those schools.
Sewage Disposal Systems: This area would connect to the existing sewer in the Rhapsody
neighborhood
Water Supply System: The water system will also be an extension of the existing water main in
Rhapsody and will provide a portion of the required water main loop that will connect the systems
in Krey Lakes and Rhapsody.
Fire Protection: The water extended from the existing system would provide adequate fire protection.
Weather Waming: This area is serviced by outdoor warning sirens in the Rhapsody neighborhood
DETAILS OF REQUEST
The applicant is requesting review of a final plat consisting of 33 single family lots. The preliminary
plat included 49 single family lots to be developed in two phases.
Natural Resource Protection
This site has numerous wetlands and ravines. Wetland delineations have been reviewed and
approved byMmehaha Creek Watershed District. The wetland delineation determined the
classification of the wetland and its associated required buffer.
The final plat includes a wetland and buffer that will be deeded to the City as O utlot A This
includes the fringe wetland around Carl Krey Lake. There will not be anyprivate access to the lake.
O utlot C will continue to be owned by Lennar Corporation to allow for future development once
access to this property is available.
Landscaoirte
A landscaping plan was submitted with the preliminary plat. The majority of the plantings for this
phase will be done in the wetland buffer and open space area, and street trees.
Parks and Trails
The development would be served by the existing park located in the Rhapsody neighborhood, so
park dedication will be in the form of cash. The park dedication is based on 11%
of the buildable
area, which excludes wetlands and steep slopes. The buildable area is 33 acres. The current market
value of the parcel is $479,400,so the cash dedication would be $42,94726. Park dedication was
paid at the time of the fast phase and satisfied the requirements for this phase.

Lot Sizes Setbacks

The applicant is proposing single family home lots with typical lot sizes of 70' wide lots by 140'
deep. The proposed setbacks are consistent with the Rhapsody neighborhood - 30 foot front yard,
10 foot side yard and 30 foot rear yard. The minimum impervious surface coverage will be 35 %,
which is also consistent with the Rhapsody and Ambergate neighborhoods.
Uiities
Attached is the comment letter from the City Engineer. The utilities will be extended from the
existing stubs in Rhapsody.
Streets Access
/
The proposed access is from an extension of Northwest Boulevard. Northwest Boulevard will
continue to the west,but have a cul de sac at this time. Krey Lake Court will cul de sac. Ambergate
Drive will extend to the east and provide access to County Road 43.
Stormwater Management
The applicant has shown the proposed pond location. Stormwater management will need to be
approved by the Minnehaha Creek Watershed District. Outlot B will be deeded to the City as a
stormwater pond.

orderly, economic, and safe development of land within the City,

6. The homeowners association, and/or the residents of the subdivision or adjacent outlots are

I have completed my review of the Rhapsody North, 2nd Addition Final Plat submittal dated May 20,
2014, prepared by Sathre -Bergquist for Lennar Corporation submitted on May 22, 2014.
Approval of the final plat is hereby recommended, however, the following comments shall be
addressed prior to final execution of a Development Agreement and scheduling a preconstruction
meeting.
Comments: It is recommended that the Developer's Engineer provide an item by item response to each
of the comments listed below as part of the final plat process to expedite future review of revised
submittal materials.
1. Per City of Victoria standards, the minimum diameter of the cul de
- sac
- shall be 90'. Many of the
plan sheets still call the radius out at 44 feet,

2. A pressure reduction valve must be placed on the watermain along Ambergate Drive just north of
Northwest Boulevard. City will provide a detail for incorporation into final plans.
3. Gate valves shall be reviewed to ensure that valves will not be located in gutter of curb.
4. Inlet capacity for the 10 year
storm event shall be reviewed. Additional inlets may be needed. The
maximum run of street drainage to each catch basin shall be 350 feet.

5. Walls on private property must meet building permit requirements where applicable. As required by
City ordinance, retaining walls exceeding four (4)feet in height, including stage walls which
cumulatively exceed four (4)feet in height, must be constructed in accordance with plans prepared
by a Registered Engineer in the State of Minnesota. Plans must be submitted to City for review prior
to construction of the wall.
