TO WHOM IT MAY CONCERN: This is to certify that the undersigned surveyor at the
request of xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx, attended the
sailboat in and out of the water on the 13th day of May in the year 2016, at Bohemia Bay Yacht
Harbour, 1026 Town Point Road, Chesapeake City, Maryland, and did survey said vessel for Mr.
xxxxxxxxx, while representing his interest as a prospective buyer.
The vessel is a custom built 44 cutter, built by David Laux, located at 18043 Asketum Branch
Road, Georgetown, Delaware, (phone number 302-875-2917), in the year xxxx. The vessel was
designed by current owner, Rapp Crook. The vessel does not have a hull identification number.
The vessel’s approximate measurements are: LOA 44’0”, LOD 40’0”, LWL 39’4”, BEAM 11’3”,
DRAFT MINIMUM 3’9”, DRAFT MAXIMUM 6’0”, and DISPLACEMENT 14,000 lbs. The
vessel’s documentation number is xxxxxx, which will expire January 31, 2017.
ALL MAJOR HULL MEMBERS, wherever accessible, together with all surfaces, joints,
bonds, fillets, webs, bulkheads, and hard curve areas were carefully inspected with particular care
being devoted to areas of normal stress concentrations and possible bulkheads or other hard spots.
Field methods of sounding and visual sighting were used.
HULL CONSTRUCTION: the vessel has aluminum hull, decks, and cabin top. The cockpit is
finished with Burmese teak. The hull has hard chine. The vessel has a full keel with centerboard.
The interior was lined with spray foam. I have noted the following:
a) The foredeck is solid and in good, structural condition.
b) The bow sprit is in good, structural condition.

c) Both the starboard side and port side catwalks are solid and in good, structural condition.
d) The cockpit appears to be solid and in good, structural condition
e) The cabin top appears to be solid and in good, structural condition. The mast step appears to be
in good order with no deflection to the cabin top.
f) The hull runs fair and in good condition. There is no oil canning of the hull. The paint is
peeling.
g) The transom appears to be solid and in good condition.
h) There are paint blisters on the bottom of the hull. No signs of major repairs, damage, or hard
grounding. Random ultrasound readings were taken of the bottom, and the readings averaged

.250. No bad readings were found. The bottom does have a barrier coat, which has failed. I
noted blisters and water behind the coating.

i) The keel appears to be in good condition.
j) The centerboard housing is well secured with no defects noted at time of my inspection.
The centerboard is fiberglass and appears to be in good condition. The stainless steel pennant
has meat hooks.
k) Where accessible for inspection, the hull to deck seam appears to be in good condition with no
signs of separation.
l) The bulkheads appear to be in good condition.
m) The compression post is in good condition.

n) The engine bed is in good condition with no signs of separation or structural fatigue.
o) The deck supports accessible for inspection appear to be in good condition.
p) The hull stringers accessible for inspection appear to be in good condition with no signs of
defects or structural failure. Note, the interior stringers and ribs are totally covered with foam,
except for the stringers in the aft section. The foam is spray foam, and I do not have a rating
for this foam.
q) The interior shows well. The interior is clean and well kept.

MACHINERY: said vessel’s auxiliary power is a 30 horsepower Vetus, model M4.14, fresh
water cooled, diesel engine. The engine’s serial number is not available. The engine was new in
1990. I have noted the following:
a) The water intake hose is in good condition. The hose is double hose clamped.
b) The exhaust hoses are in fair condition. The exhaust system is double hose clamped as per
ABYC standard P-1.7.10 sections 1, 2, and 3.
c) The water circulation hoses are in good condition.
d) The riser is in good condition. The water jacket is in good condition. Note, this was only an
external inspection.
e) A boot is not installed to cover the starter cable terminal end as per ABYC standard E-11.5.2.8.
f) The linkage appears to be in good order.
g) The custom made rubber muffler appears to be well secured and in good condition. Refer to
the sea trial for leaks and additional comments.
h) The motor mounts are in fair condition. The aft mount on the starboard side is rusted, and I
could not move the nut. The aft mounts appear to have nuts that backed off.
i) The engine belt is in fair condition.
j) No oil analysis of the engine oil was requested.

STEERING SYSTEM: pedestal wheel steering system. The pins, cable, quadrant gear arm, and
other mechanical fittings accessible for inspection are in good condition. Refer to the sea trial for
additional comments.
ELECTRONICS: the electronics appear to have been properly installed. The vessel is
equipped with the following:
a) The Icom M502 VHF came on, but the radio check was incomplete.
b) The Humminbird depth finder worked.
c) The homemade autopilot with Raymarine controls worked.
d) The Magellan 315 handheld GPS gave the test reading 39.25.23 / 075.53.78.
e) The pedestal mounted Danforth compass is in good condition.
RUDDER: keel attached aluminum rudder. The rudder is solid and in good condition. There
was a little play in the lower bearing.
PROP: 16 x 13 right hand, three-blade bronze prop, which is in good condition. When tested,
the blades ran out true.
SHAFT: 1.250” stainless steel shaft, which appears to be in good condition. The shaft appears to
be straight with no signs of pitting.

CUTLASS BEARING: in good condition.
SHAFT PACKING GLAND: conventional type packing gland, which did not leak at time of
the sea trial.
GALVANIC PROTECTION: the vessel is equipped with sacrificial anode protection. The zinc
plate has stray current damage.
RIGGING:
HARDWARE - the two Barient two-speed primary winches are well secured to the coamings, in
fair condition, and did work. The two Barbarossa winches are well secured and did work.

RIGGING (cont.)
The three Barbarossa winches on the mast do have a little play, as well as the drums are worn
smooth. As part of routine maintenance, the winches should be greased.
The sheaves and blocks are weathered and chalky.
STANDING RIGGING
a) The aluminum deck step mast mounted on a tabernacle with boom and wood spreaders. The
mast appears to be straight and in good condition. The boom appears to be straight, and the
gooseneck is in good condition. All stainless steel hardware accessible for inspection appear
to be in good condition. The mast was not unstepped for inspection. The mast is missing the
bolts to lock down the tabernacle. The two mast cleats’ bases are cracked.
b) The open style turnbuckles appear to be in satisfactory condition. The turnbuckles have ample
adjustment remaining. I did not detect any damaged threads.
c) The crimped fittings appear to be in good condition.
d) The stays and shrouds appear to be in good order.
e) The chain plates appear to be well secured with no signs of distortion to the hull.
RUNNING RIGGING: in satisfactory condition.

SAILS: I have noted the following:
a) The mainsail is in good condition. However, the sail is stained.
b) The jib is in fair condition.
VENTILATION: does meet all requirements as per U.S.C.G. regulation 183.620 and ABYC
standard H-32. The ventilation system is natural air.
FUEL SYSTEM: the vessel is equipped with one aluminum fuel tank, which is integrated as
part of the keel. I have noted the following:
a) The deck fill port is not properly marked “DIESEL” as per ABYC standard H-33.12.3.
b) The fuel fill is PVC cap with type A-2 hose. The hose is dry rotted. The hose is double hose
clamped at both ends.
c) The feed and return hoses could not be determined to be type A-1 hose. The hoses are slid
over copper tubing.
d) The fuel tank is vented. The vent line is PVC and hose.
e) The inline plastic device for fuel vent does not have an UL rating for marine use.
f) The system is equipped with a Racor filter with priming pump.

ELECTRICAL:
12 VOLT SYSTEM - negative ground system with a fuse panel and Cole Hersee battery switch. I
have noted the following:
a) The vessel is equipped with two Series 31 acid plate batteries.
b) The batteries are secured to the hull as per ABYC standard E-10.7.4. The positive terminal
ends are covered as required by ABYC standard E-11.5.2.8.
c) I did not detect any wiring violations and/or safety hazards with the 12 volt system.
d) The cabin lights worked at time of my inspection.
120 VOLT SYSTEM – the vessel does not have 120 volt system.
BILGE: some water and oil film in bilge at time of my inspection.
BILGE PUMP: the bilge is equipped with a manual Guzzler pump. The pump is secured. The
pump did not work. The discharge hose is in fair condition.
FIRE PROTECTION: ABYC standard A-4 Table II states that a vessel 40’ in length is required
to be equipped with three B-1 type, U.S.C.G. approved fire extinguishers or ABC dry chemical
fire extinguishers, mounted in the following locations: outside engine compartment, steering
position and galley, if equipped with a stove, or passenger cockpit.
The vessel is equipped with a 1996 5 lb. ABC dry chemical fire extinguisher mounted by the
companionway steps. A Halon 1211 is mounted in the main cabin, but does not have a current
inspection. The vessel is not equipped with carbon monoxide detectors or smoke detectors.
SEACOCKS, STRAINER, AND THRU-HULL FITTINGS: the seacocks are reasonably
accessible as installed and oriented that their handles are easy to operate as per ABYC standard
H-27.6.3. All seacocks that were installed are PVC, which does not comply to ABYC standards
for below water line use. The Vetus plastic strainer is in satisfactory condition.

SEACOCKS, STRAINER, AND THRU-HULL FITTINGS (cont.)
PLUMBING: the hoses and lines have been properly ran throughout the vessel. The hoses
below the waterline are double hose clamped. The drains, faucets, and fixtures are in good
good condition. The vessel is equipped with one aluminum fresh water tank.
The Shur Flo fresh water pressure pump appears to have been properly installed and did work.
The vessel is equipped with a Paloma propane on demand hot water heater. They state that their
hot water heaters are for residential or commercial. I would also state that there is no Charley
Noble for venting overboard, thus carbon monoxide could make this a deadly shower

GALLEY: the appliances appear to have been properly installed. The galley is equipped with
the following:
a) Double stainless steel sinks with a faucet for pressure hot and cold water. The drain hose is in
fair condition.
b) Ship Mate propane three-burner stove with an oven. The unit appears to be in good
condition. The stove has a manual shut off. No thermal coupler is installed. No pressure gauge
on the propane tank. The stove does gimbal. However, there was no propane to check
operation.
The flex line is slid over copper tubing. With this set up, a hose barb is required. Also, the line
is T’d off in the cabin. ABYC standard A-1.9.5.6 Fuel supply lines shall be continuous lengths
of tubing, piping, or hose from the regulating device, solenoid valve, or leak detector to the
appliance, or to the flexible section at the appliance.
c) The ice box with a refrigeration system which did not work

HEAD: the vessel is equipped with a manual marine toilet with an aluminum holding tank and
set up with a transfer pump. The head intake hoses and discharge hoses are in fair condition. The
discharge line is hose with PVC pipe.
DECK HARDWARE: the deck hardware, such as cleats, chocks, and railing, are well to the
deck. The lifeline plastic coating is peeling off.
NAVIGATION LIGHTS: the red and green bow light, stern light, and steaming light worked at
time of the survey. Strobe light worked.
PORTS AND HATCHES: I have noted the following:
a) The forward hatch is well secured to the deck and in good condition.
b) The bronze ports are in good condition. The two aft ports in the main cabin are leaking.
c) The sliding hatch and drop boards for the companionway are in satisfactory condition.
d) The deck hatches are in satisfactory condition.
GROUND TACKLE: two Danforth anchors with 5/16” chain and yacht braid. The ground
tackle is properly sized for said vessel.

CANVAS: the sail cover and wheel cover are in fair condition, but in need of some minor repair.
MISCELLANEOUS
a) Two nuts are missing off of the two bolts located in the aft section of the vessel on the port
side located aft of the access panel. I could not determine the bolts’ function.

SEA TRIAL REPORT
On May 13, 2016, I attended the sea trial that was performed on xxxxxxx, while representing the
interest of Mr. xxxxxxxxx. I have noted the following:
ENGINE
The engine reached a maximum of 2,800 rpms. There was no shaft vibration. There were no
visual signs of exhaust leaks, water leaks, or oil leaks. The engine reach a temperature of 163.7°.
The alternator charged at 14.01 volts. The oil pressure gauge read 60.
The transmission shifted well, and I did not have any problems finding neutral, forward, or
reverse. However, it did make noise going into gear.

RECOMMENDATIONS
STRUCTURAL ITEMS AND SAFETY IT
a) Install new fire extinguishers in the above given locations. Extinguishers mounted in lockers
or cabinets need ISO labels.
b) Install new carbon monoxide detectors.
c) Install new smoke detectors.
d) Install a cable boot over the battery cable end on the engine’s starter.
e) Replace all the PVC fittings/seacocks below the water line with Marelon seacocks and thru
hull fittings.
f) Install a marine grade fuel fill port with the labeled of “DIESEL” on the flange.
g) Install A-2 hose and double hose clamp each end.
h) Install a vent pipe designs for boat which would have a screen to keep insects out of the vent
line.
i) Fuel feed and return lines need to be A-1 hose and all fuel connection from copper tubing need
to be made with a hose barb and properly clamped.
j) Repair manual bilge pump
k) REMOVE THE PROPANE HOT WATR HEATER FROM THE BOAT.
l) Install a pressure gauge for the propane tank.
m) Install a hose barb for the propane feed line to the stove and properly clamp.

GENERAL REPAIR AND REPACEMENT ITEMS
a) Replace the pennant for the center board.
b) Replace the motor mounts.
c) Install a Vetus plastic muffler and a Vetus goose at the exhaust port.
d) Replace cracked mast cleats.
e) Replace the winches on the mast, if so desired.
f) Further evaluation should be giving to the transmission.
g) Install lock down nuts on the tabernacle.
h) Replace the life lines.
i) Paint the hull and decks.

PREVENTIVE MAINTENANCE
a) Bottom sample the fuel tank before using the boat.
b) Align engine with shaft.
c) Grease winches.
d) Install new zinc plates.
SURVEYOR'S SUGGESTIONS
(as per conversation at survey and not part of this report)
1) Install a wind generator and solar panel.
2) Provide a 30’ 5/16” trip line with a fishing float for the anchor.
3) Install a conventional dripless packing gland.
4) Replace the prop with a Max three blade prop.
5) Replace plastic sea strainers with Groco sea strainers
6) Supply a 45 lb CQR anchor.
7) Install 12 volt refrigerator system.
8) Install two 4-D AGM batteries for a battery bank.
9) Replace the standing rigging before any blue water cruising.

COMMENTS
This vessel is very unique and has many clever components. However, there are ABYC standards
in which they did not apply. The overall structural integrity of the vessel is very good. The interior
systems need to be brought up to standards, such as the seacocks, fuel, etc.
CONCLUSION
Said vessel is suitable builder’s intended purpose.
With consideration given to the condition of the vessel, optional equipment, market condition,
and the use similar boats, it is hereby my professional opinion that an insured value for said
vessel can be placed at $xxxxxxxxx. A replacement value can be set around $xxxxxxxxxx.
I would advise to request for a full disclosure from the current owner and obtaining an estimate of
all repairs before settlement.
