PRESIDENT’S LETTER
As I set down to write this letter I realize the holiday
season is almost upon us. It is funny how the year seems
to just fly by. As I get older they seem to fly by faster. As
the New Year begins we will all set goals for our lives and
businesses. Seems like our business need to constantly
increase in order to maintain what we did in previous years.
My focus on business continues to increase because of our
forever-changing industry.
Coming up in March will be our 25th NDABA convention.
The convention will be held at the Seven Seas Hotel and
Convention Center in Mandan, March 3rd and 4th, 2011.
I hope everyone will make the time to attend to talk about
the future and reminisce about the past. If any of you have
pictures of previous conventions, let me know as we are
trying to put together a slide show of the past 25 conventions.
We are also looking for ideas and input on ways to celebrate
our 25th. Please contact any board member or the convention
chairman, Miles Doll, with your ideas to commemorate this
special occasion.

It looks like we may have an individual to maintain our
website for the long haul. His only stipulation was that he
would like someone within the association to field the content.
On such a short notice, we couldn’t saddle anyone else with
that job, so I consented to do it until we could find someone
within the association to do it. It seems I’ve done this before,
I’m a hard learner.

Nobody died and made me king, we just need someone
to take care of this NOW. YOU could be King though, just
volunteer for the job, it’s a start.

members of the Association.

the automotive service industry.

Dakota Auto Body Association.
I would like to conclude with
another issue our association is having.
We need to have more diversification
on our board. We need the small
and the large shops to be a part of
our association in order to survive.
Right now it is hard to make decisions because we have
such a small representation of the North Dakota auto body
industry. Please help us as we go into the New Year by filling
an open position on our board. Not a lot of time needs to
be committed in order to be on the board and attend the
meetings – just a willingness to participate and give ideas on
keeping the North Dakota Auto Body Association alive…. or
we may not be around for the next 25. We all need to work
together as a team effort in order to move forward.
May each and every one of you have a very Merry
Christmas and prosperous New Year.

2011 NDABA 25th ANNUAL CONVENTION
March 3 & 4, 2011 at Seven Seas, Mandan, ND

As many of you know, the convention we are going to have is the NDABA’s 25th convention
and we are looking for some ideas on how we should promote this. If anyone has any ideas, please
contact me or Miles Doll.
We are also in need of pictures from previous conventions so we can put a slide show together, so
if anyone has some old pictures, please contact me.
It looks like we may need a meeting before next scheduled meeting to work out some convention
details. I will let you know if we need to do that.

Meeting Minutes
October 3, 2010 – Chieftan, Carrington
The board of the NDABA met
October 3, 2010 at the the Chieftan
in Carrington. Members present were
Ed Barnhardt, Tom and Lana Ose,
Clarence Meidinger, Kent Meidinger,
Chuck German, Miles Doll. Larry
Teters was also present.
The secretaries report was read.
Miles Doll made a motion to approve
the minutes, second by Tom Ose.
The treasures report was presented.
Tom Ose made the motion to approve
the report, second by Kent Meidinger.
The CD comes due on October 5,
2010. Discussion was held on what
to do with it. Miles Doll made the
motion to move it to Minot, put it
in a 6 month CD and discuss further
options at convention. It was seconded
by Chuck German.
Work around the state has been
varied but most there reported steady
work during the summer.
The NDABA magazine NEEDS
your articles. Body Shop Business
articles are easy to get reprinted.

for your magazine!
The 2011 convention will be held
March 3 and 4 at the Seven Seas in

of Brad Zander are organizing the
convention. The main speaker will
be from 3M and will be speaking on
Profitability. If anyone has any ideas
for other speakers, please contact

someone to do the job, pay them and
get it updated. Seconded by Clarence

Discussion was held on having a
membership drive. Ed Barnhardt is
going to start working on this project.
The next meeting will be held
February 5, 2011 at the Chieftan in
Carrington.

Ammo to Fight Steering

I don’t know if you noticed (and
I hope you did because that would
mean you’re an avid reader of our
weekly e-newsletter, BodyShop News,
which is e-mailed to over 24,000
shop owners and managers every

spotlight in the August 26 edition.
The lead story concerned a new antisteering law that passed in New York
that prohibits insurance companies
from requiring that consumers use
specific rental car companies. The
second story was about a TV station
in Maine that profiled a consumer who
was “bullied” into taking her vehicle
to a shop in the insurer’s network.
The third story noted that the Texas
Department of Insurance recently
issued a bulletin to insurers reminding
them of the state’s anti-steering law.
What does this all add up to? What
we already know: that steering is one
of the biggest challenges facing body
shop owners.
I wanted to address one person’s
comment online that sounded as if she
was accepting steering as a fact of life
and throwing up her hands, saying,
“What can you do?” Actually, there are
some things that shops can do.

much energy to combatting steering
as they are to anything else they’re
doing: training, advertising, fixing

vehicles, etc. They need to declare
war on illegal steering by coming up
with a comprehensive action plan that
will minimize the damage it causes to
their businesses.
First, let’s address legislation.
Realize that most anti-steering
legislation has so far been worthless.
Because it’s often unenforced and
carries no significant fines (and what
is a significant fine to a multi-billion
dollar insurance company?), insurers
ignore it and blatantly violate it or
cleverly work around it. With that
said, I think it’s still worth pursuing
in conjunction with your local state
association because even if getting
an anti-steering law passed only
amounts to a “warm fuzzy” in your
belly, you’ve at least educated local
lawmakers on what steering is and
why it destroys the free market.
Short-term, you need to educate
the heck out of your customers. Why
not devote your monthly customer
newsletters (you do have these, right?)
entirely to conveying the message that
they have the right to choose the shop
of their choice? Why not provide them
with a word track of their own they
can use when they file a claim and
the insurer tries to steer them? Here’s
an example:
INSURER: If you take your vehicle
to ABC Body Shop, the work won’t
be guaranteed.
CUSTOMER: Actually, ABC
guarantees all their work.
INSURER: You may also have
out-of-pocket expenses if you take it
to ABC.
CUSTOMER: I don’t anticipate
that. After all, you as my insurer are
obliged to pay the reasonable costs
of repair.
INSURER: We may not be able to
get an appraiser out there for another
week.
CUSTOMER: If you value my
business, you’ll get an appraiser
out there ASAP, otherwise I may go
insurance shopping.
It’s your job to educate your
customers. No one else is going to
do it for you. They need to have
their hands held and be told exactly
what to say – and they need to be
communicated with constantly. Why
not send a monthly text message to all
of them restating their right to choose
the shop of their choice?
You also need to give your customers
reasons to come back to your shop. If
insurers are telling them why they
should go to a shop on their preferred
lists, you need to tell them why they
need to come to you. One shop I know
offers rewards points that customers
can redeem on their next visit. Another
promotes a free detail. You don’t
necessarily have to offer freebies, but
you get the picture.
The key here is that you really have
to roll up your sleeves and constantly
work at the customer education
process. Insurers are not going to stop
steering anytime soon, so you need
to meet with your team pronto if you
haven’t already and discuss a strategy
to combat it. It’s just as important as
doing a quality repair. After all, if
steering gets the best of you, you won’t
have any repairs to do.
The key here is that you really have to roll
up your sleeves and constantly work at the
customer education process.

In Memory of Lynn C. Cermak

Lynn Cermak of the Midwest
Auto Dealers Parts Association
passed away on September 7,
2010. Lynn’s death was a shock
to everyone and was the result of
complications after a fall. He was
62 years old.
Lynn Courtney Cermak was
born in Roseville, MN on November 15, 1947. After graduation from Roosevelt High
School he was drafted into the US Army
where he served in Vietnam on Medivac helicopters.
Lynn became a fixture in the automotive
industry, working in the field for most of his
life. He was the sales representative for the
St. Paul-Mpls Wholesale Parts Dealers for a
few years and the director for the Minnesota
branch of ASA for a time. At the time of his death,
he was the sales representative for the Midwest Auto
Dealers Parts Association.
Lynn loved people and telling stories. It didn’t matter if his stories were about business, his boys, or his
hobbies, many of them would begin with “Let me tell
you...” Besides a love for fast cars, Lynn’s passions were
hunting and fishing at his northern Minnesota get-away.
He is survived by his two sons Jesse and Justin.
A service was held for Lynn on September 11,
2010 and interment was at Fort
Snelling National Cemetery on
September 13, 2010.
Lynn will be missed by all
that knew him.
