access to information about your graded work in your classes; please contact Ms.
Catherine Lemelin in the Front Office for information about accessing this useful
tool. E-mail is often an effective way to contact a specific staff person; staff e-mail
addresses are available by selecting the Staff List on the school website,

an Anonymous Bullying Incident Report form available at the district website, or use

voicemail system so that messages can be left at a specific extension for individual
staff. NOTE: When necessary, parents may contact the school with messages to be relayed
to students but we ask that this be done sparingly. Please be aware that students are
not called from classes to receive phone calls or messages and we can not guarantee

school staff directly when they have questions or concerns, either by email or
telephone. Parents/guardians can best reach teachers directly by telephoning the

block 2 class. The middle school schedule runs on its own distinct class schedule with Related
Arts periods 6 and 7 at the end of the day on Monday, Tuesday, and Friday, and at
the beginning of the day on Wednesday and Thursday. The bell schedule can be
accessed from the school website. 5 This year most Wednesdays will be Professional Learning Days, with students
released at 12:50. Please refer to the school calendar, available for download from
the school website, for an overview of these dates. SCHOOL CLOSINGS In the event of school closing due to unsafe weather conditions, school
announcements will be broadcast, starting at 5:30 a.m. on WHAI, WHMP, WRSI,
WHYN, WTTC, WAQY radio stations. School cancellations are also broadcast on
TV40, TV3, and TV22, posted at http://mohawkschools.org/, and are announced via
the district’s automated phone system, School Reach. Two-hour delays or early dismissals are possible in inclement weather; access the
stations above for current information. When there is a two-hour delay the school
day is scheduled to start at 9:44. II – ACADEMICS ACADEMIC INTEGRITY Reflecting our school values of “be responsible” and “be accountable”, students are
expected to take responsibility for their learning and submit their own work. We
take cheating and plagiarism seriously and they are violations of our code of student
conduct. Cheating refers to unauthorized help with an assignment, which may
include giving and/or receiving information from other students, notes, books, and
other sources not permitted by the teacher. Teachers giving “open book” type
assignments will describe the types of materials that are allowed. Plagiarism is
defined as the submission of another’s work or ideas as one’s own. This includes
direct copying from another source as well as paraphrasing material without proper
citation. Mohawk’s Guide to Citing Sources is available in the Resource Center and
online at the school webpage to provide students with guidance about proper
citation practice. Any student who violates our expectations of academic integrity will first meet with
the teacher to discuss the incident. The student will not receive credit for the
assignment in question and may be subject to other consequences, including: a
meeting with parents, guidance counselor and school administration; a requirement
to fulfill the assignment again; and/or other disciplinary action. ACADEMIC PROBATION Academic Probation is notice that academic achievement is below promotion or
graduation standards. A student is placed in Academic Probation status when he or
she earns an F in any marking period. During this period of Academic Probation, the
student’s participation in school-based extracurricular activities is restricted so that
the student can focus on fulfilling academic requirements. 6 Academic Probation begins when grades are issued at the end of a marking period.
Academic Probation status persists through the quarter until the end of the next
marking period; when grades are next issued and the student has earned all passing
grades the Academic Probation status is lifted. Students with Academic Probation status are not eligible to participate in
extracurricular activities, including sports. Students have to be academically eligible
to try-out for teams that hold try-out sessions. Students who become eligible during
a sport season are not allowed to join a team if that team held try-outs at the
beginning of the season. During Academic Probation, students may attend field trips
related to academic coursework but they may not participate in social activities that
would require them to miss academic classes. Students lose senior privileges and
cannot hold school-wide or class office positions during Academic Probation. If a student has failed a required course, he or she may: ● Add the needed course to the next semester’s schedule, in addition to the
credits required for that year. ● Make up the credits by passing an approved summer school course at a local
high school or college or through a correspondence program. This
coursework must be approved by the Principal. Only two courses per

60- 63- 67- 70- 73- 77- 80- 83- 87- 90- 93- 9760 62 66 69 72 76 79 82 86 89 92 96 100 ADMINISTRATIVE WITHDRAWAL Mohawk Trail Regional High School attendance policy requires that students be in
attendance for 90% of scheduled classes in order to receive academic credit. (See
the Attendance Policy section of this handbook for additional information, including
information about the waiver process for students with extenuating circumstances.)
The school’s policy authorizes the Principal to administratively withdraw students
who have exceeded the threshold of absences, are over 16 years of age, do not have
an IEP (Individualized Education Plan), and who have not provided acceptable
documentation of absences for consideration by the waiver committee. Students
may re-register for courses the following semester. FIELD TRIPS Field trips provide students with learning opportunities that cannot be duplicated in
the classroom setting. Students must have parental/guardian permission to
participate in a field trip; consent slips will be sent home to be signed before each
trip. If students are traveling with another student as a driver, they need a letter of
permission stating that understanding from the parent or guardian. Students who
might otherwise be unable to participate in a field trip due to financial difficulties
7 should consult with their teacher or the Principal or Assistant Principal so that
arrangements can be made to assure their participation. Students are required to
complete all class work missed while on a field trip. Participation in field trips is
optional and no student will be penalized academically or in any other way for
deciding not to accompany a class or group on a particular field trip. The school
reserves the right to require an adult chaperone for or exclude any student whose
behavior has resulted in safety concerns on previous trips or who has not met the
academic criteria for a field trip. It is understood that this student handbook is to
guide behaviors on all school trips and in extracurricular activities. GRADUATION CEREMONY PARTICIPATION In order to participate in the graduation ceremony, seniors must have met all local
graduation requirements, be in good behavioral standing, and must have met all
class obligations. If a student has not met the graduation requirements but is within
12 credits of fulfilling those requirements and has developed a plan of completion
with a timeline for finishing those credits before the start of the next school year, he
or she may petition to the Principal for permission to participate in graduation. HONOR ROLL CRITERIA Students are recognized for achieving High Honors when they earn all A’s in
academic courses (English, Social Studies, Math, Science, and World Language) and a
C or above in other courses. Students are recognized for achieving the Honor Roll
when they have no grade lower than a B in an academic course (English, Social
Studies, Math, Science, and World Language) and a grade of C or better in all other
courses. SENIOR PRIVILEGES – FOR EMPLOYMENT AND/ OR OFF CAMPUS STUDIES Qualified seniors may request permission from the administration to access senior
privileges. Seniors may request permission by completing a signed application for
senior privileges, found in the Front Office. Seniors who earn their privileges will be
allowed to leave campus early or come to school late as long as they uphold their
school-based responsibilities. Examples of such responsibilities are: school and class
attendance, having no outstanding school dues, not being on academic probation,
and behavior that meets the Mohawk expectations of being Respectful, Responsible,
A Role Model, Engaged, and Accountable. All students are expected to remain on
campus for the duration of the school day without special permission or privileges,
including seniors, and are not allowed to leave campus and return during the school
day unless authorized by the Front Office. Though student’s code of conduct outside
of school is not the responsibility of the school, senior privileges may be revoked for
conduct during the school day hours that does not meet the Mohawk expectations of
being Respectful, Responsible, A Role Model, Engaged, and Accountable.
Student-athletes must meet the attendance requirements as specified by MIAA rules
and regulations. Senior Privileges are: 8 1. Leave campus early/ arrive late, schedule permitting, for an approved
activity
2. No hall passes required.
How do I access them? 1. Completed and approved application.
2. In good academic and social standing. No grades less than C-, no discipline
issues.
3. Confirmed participation in at least two class activities (for example: worked
on Booster Day float or wall, chaired a fund-raising committee, etc.)
4. Class dues paid in full. (Alternative arrangements may be worked out with
class advisors and administration.)
5. No outstanding bills with Resource Center, materials, gym locks, books, etc.
6. Parental Consent
Seniors must maintain passing grades and remain in good academic and behavioral
standing to enjoy privileges. When a senior enters Academic Probation he or she
loses these privileges immediately and must reapply for reinstatement. Students
with senior privileges must sign in and sign out in the Front Office and are
responsible for their own transportation. Students with privileges who transport
from school any student who is not authorized to leave school will be subject to
disciplinary action, including the loss of privileges. NATIONAL HONOR SOCIETY Selection for membership in the National Honor Society is based upon outstanding
accomplishment in four areas: scholarship, service, leadership and character.
Students in the sophomore, junior and senior class who have maintained a grade
point average of 3.50 (based upon a minimum of two core academic classes per
semester) are eligible for consideration for membership. There are many ways for
students to exemplify and demonstrate the qualities of leadership, service and
character. We encourage interested students to seek information and opportunities
to demonstrate leadership in theses areas. At the beginning of the spring semester students in the 10th and 11th grade who are
academically eligible will be notified and invited to submit Student Activity
Information Sheets; eligible seniors will be invited to submit information after the
first quarter of the fall semester. Faculty members are asked to assess the students
on the basis of their service, leadership and character. The Faculty Honor Council,
appointed by the principal, meets to evaluate the information provided by eligible
students and the input from the faculty. Candidates receiving a majority vote of the
Faculty Honor Council are selected for induction into the National Honor Society.
The induction ceremony for students selected at any time during the school year is
held in the spring. Membership in the National Honor Society is both an honor and responsibility.
9 National Honor Society members are expected to continue to demonstrate the high
standards of leadership, scholarship, service and character which were recognized
when they were selected for membership. Students who do not maintain these
standards will be informed of the nature of the concern and given a time period for
improvement. If the student does not demonstrate improvement in the specified
time, he or she is liable for whatever disciplinary measures are considered
appropriate by the Faculty Honor Council, which may include dismissal from
membership. Students who are dismissed or resign from membership are never
again eligible for membership in the National Honor Society. The National Honor
Society (NHS) meets regularly. Notices of NHS activities are posted on the bulletin
board outside of the Front Office, NHS Web Page at mohawkschools.org website,
and on the NHS Facebook page. SCHEDULE CHANGES Every effort is made to honor course requests that reflect individual interests,
graduation requirements, and the recommendations of teachers. The master
schedule is built based upon student registration requests but there are limits to
what can be effectively scheduled. Student schedules are mailed home during the
summer so that students and families can examine them carefully. If a student
wishes to request a schedule change, please contact Student Services to schedule an
appointment with a guidance counselor during the week before school opens. All
schedule changes must be completed in the first five days of semester. III - ATTENDANCE POLICY & PROCEDURE Mohawk Trail Regional School is committed to ensuring the success of all students.
The school’s policies and procedures are designed to facilitate this success. The
most basic of these concerns is attendance. Success more readily comes to students
who are in class, on time, every day. Both Massachusetts General Law [Chapter 76: Section 1] and our school district’s
policies require daily attendance of all students. We strongly believe that what occurs in class is central to student learning. On-line
courses and independent study have their place. But, ultimately, the classroom is the
centerpiece of the academic experience. The richness of the classroom environment
- the exchange of ideas with peers and teachers, the opportunity to explain, defend
and receive feedback on one’s thinking, learning to work collaboratively with one’s
peers - these are all experiences that are irretrievably lost when a student is not
present in class. Some academic experiences can be made up; these cannot. The purpose of this section, then, is to provide students and families with all the
information about the Mohawk attendance policy necessary for them to make sound
decisions. The most basic piece of information is this: unless they have a valid
reason, students are required to attend each of their scheduled classes. As well, they
are required to be on time for each class.
10 THE ROLE OF PARENTS AND GUARDIANS Massachusetts General Law [Chapter 76: Section 2] directly addresses the
responsibility of parents and guardians to ensure their children’s consistent
attendance. As it is consistent with Massachusetts General Law, we hope and expect
that parents and guardians support the Mohawk attendance policy and encourage
their children’s daily attendance. An important way parents and guardians can support Mohawk’s attendance policy
is to inform the school about reasons for absences and tardies. Instructions about
how to provide this information to the school is described in the EXCUSED ABSENCE
section found below. At times, the school and parents and guardians will disagree about what constitutes
a legitimate excuse. The school will work to be fair and reasonable in its judgments,
but, ultimately, retains the right to make these determinations. ATTENDANCE POLICY Consistent school attendance is important. Excessive absences, tardiness, and
leaving school before scheduled dismissal times have a negative effect on student
performance. Absences exceeding 10% of class time will result in a loss of credit. Any
student who misses ten (10) classes in any semester course (either a course
that meets daily for one semester or meets every other day for a full year) will
not receive credit for that course. The course must be retaken for credit. For a
course that meets on alternating days for a semester, any student who misses five
(5) classes will not receive credit for that course; missing 19 classes for a yearlong
course (one that meets every day for the full year) will also result in loss of credit.
There is an appeals process through which a student may request a waiver under
extenuating circumstances. The WAIVER PROCESS is outlined below. Information about student attendance is reported on progress reports and report
cards; letters are sent home informing families of excessive absences. A student who is absent from a class may not participate in extracurricular
activities, such as athletics, on the day of the absence, unless participation is
approved in advance by the principal. A student will not be able to participate in an
athletic or other school activity on Saturday if the student is absent Friday, without
approval by the administration. School-sanctioned field trips, assemblies, college visits with school permission,
athletic competitions and other school-sanctioned activities will not be considered
an absence. 11 ABSENCES General absences from school for common illness and other minor reasons are
considered unexcused. UNEXCUSED Absences from school include: ● Missing school for common illness ● Truancy, cutting class/school ● Missing more than one half (1/2) of the class period or fifteen minutes
due to truancy, or cutting class. ● Vacations taken while school is in session ● Driver’s license exams EXCUSED absences from school include: ● Religious observance ● Illness; serious, long-term with a doctor’s note ● Death of a family member ● Medical appointment with doctor – physician’s note ● Court appointment Please note that the school may ask for documentation for any excused absences. WAIVER PROCESS Students who wish to appeal the loss of credit may submit a waiver request to the
administration as soon as the threshold for loss of credit has been reached. A
waiver committee composed of student support personnel including guidance
counselors, the school nurse, and the administration meets to review waiver
applications. Students should not wait until the end of the semester to submit
waiver requests. Waiver forms are available in the Front Office and must be
submitted with documentation attached. The waiver committee reviews the
application and the Principal may approve a waiver request contingent upon the
student fulfilling obligations such as making up time with the school. Appeals
relative to the enforcement of this policy must be made in writing to the
Superintendent of Schools within two (2) weeks of the parents’ receipt of the letter
indicating the loss of credit. PROCEDURE FOR REPORTING ABSENCES 1. On the day of absence, the student's parent/guardian must call the school at
625-9811 extension 3 to inform the school that the student will be out. If the
attendance officer does not receive a call from a parent/guardian on the day
of the absence, phone calls may be made to the home and/or
parent/guardian’s place of work.
2. Upon his or her return to school, the student must bring a note from his/her
parent/guardian to the front office. The note, signed by the parent or
guardian, must state the student's name, indicate the dates of absence from
school, and give the reason for absence. The school requires the student to
12 bring a note for each absence. The administration, after investigating, will
determine whether the absence was excused or unexcused.
TRUANCY Students who are absent from school without parent/guardian contact or note, or
who leave school grounds without prior consent, will be considered truant and are
subject to school discipline and/or state truancy laws. EARLY DISMISSAL A student who is to be dismissed must report to the Front Office before school to
receive an early dismissal slip. All dismissal requests must come in written form
from parents. Every effort should be made to arrange doctor, dentist and other
appointments after school hours. Parental dismissals that will be considered
unexcused for attendance reasons include leaving early for a vacation, hair
appointments, etc. The same policies regarding excused and unexcused absences
apply to reasons for dismissal. Unexcused dismissals, like tardies, also count toward
the attendance record. Dismissals made by the nurse for health reasons are
considered excused absences. Dismissed students are required to show their
dismissal pass to the classroom teacher at the time of the dismissal before signing
out in the front office and leaving through the front doors. When returning to school
following a legitimate appointment, a professional note is required (doctor, dentist,
court, etc.). Note that if a student misses half of the class period due to a dismissal
or late arrival, this is considered an absence from class. PLANNED ABSENCES By June the School Committee establishes a calendar for the coming academic year.
This is posted on the district website. This should allow families adequate time to
schedule trips and vacations to coincide with periods when school is not in session.
Family vacations are not considered excused absences for the purposes of
attendance appeals. (See Attendance Policy.) However, if a student will be away
from school for an extended period of time, he or she should complete a Planned
Absence Form one week prior to the date of absence. Please note that completing
the Planned Absence Form does not have any impact on whether an absence is
considered excused or unexcused; the purpose of the form is to inform teachers of
the anticipated absence. These forms are available in the Front Office and must be
signed by all of the student’s teachers. It is the responsibility of the student to meet
with teachers and obtain work that will be missed in advance of the absence, and it
is the student’s responsibility to make up any work and assessments missed during
the absence. TARDIES All students are to report to the office to sign in and receive a tardy slip if they arrive
after the 7:44 bell. Students who arrive to classes after the bell are considered tardy
for class. All tardies are unexcused unless they qualify as an absence for which an
excuse will be approved (see details in the Absence Policy). Typical unexcused
13 tardies include sleeping late, missing ride or bus, etc. Bad weather will occasionally
be an acceptable excuse for tardies at the administration’s discretion. Three
unexcused tardies will result in a detention. IV – BEHAVIORAL AND SOCIAL EXPECTATIONS / CODE OF CONDUCT CODE OF CONDUCT The code of conduct explains the social expectations, rules, and consequences for all
students in the Mohawk community; these expectations are shared for staff as well.
Our core values are guidelines for everyone to use in their daily interactions at
school and beyond. The values are summarized in these statements of expectations: As members of the Mohawk community, we are all expected to: Be respectful, Be responsible, Be a role model, Be engaged, and Be accountable. Be respectful. - Students and staff are expected to be respectful toward each other.
We should share mutual respect and courtesy; and to resolve conflicts in a civil
manner. Be responsible. - Students and staff are expected to take responsibility for their
classes, be prepared to work, and be prepared with assignments and materials as
necessary. Be a role model. - Students and staff are expected to act with integrity, taking pride
in their work and their role in the learning community. Be engaged. - Students and staff are expected to work diligently, cooperatively and
effectively in all aspects of school, on a variety of tasks, appreciating the

the classroom for any behaviors that disrupt teaching and learning, at the staff’s
discretion. The following behaviors will result in the removal of a student from class. Students
will be asked to leave class and are expected to report to the Front Office. 1. Physically aggressive, threatening behavior. 2. Any form of behavior that threatens the safety of the student or anyone else in
the classroom. 3. Strong and stubborn insubordination, repeated and firm refusal to follow
teacher’s directions. 4. Strong emotional outbursts, emotional imbalance and volatility. 5. Extreme verbal attacks/outbursts directed at staff or students. 6. Repeated refusal to participate in class. 7. Blatant, continuing interference in the learning process (either the teacher’s or
student’s learning.) BULLYING PREVENTION AT MOHAWK – THE OLWEUS PROGRAM The Olweus Bullying Prevention Program (OBPP) is a research-based program
backed by more than thirty-five years of research and implementation and is a
whole-school program that has been proven to prevent or reduce bullying
throughout a school. Mohawk has adopted the Olweus Bullying Prevention
approach. What is bullying? Bullying is when someone repeatedly and on purpose says or does mean or hurtful
things to another person who has a hard time defending himself or herself. OUR SCHOOL RULES AND EXPECTATIONS: 1. We will not bully others.
2. We will try to help students who are bullied.
3. We will try to include students who are left out.
4. If we know someone is being bullied, we will tell an adult at school
and/or home.
DISCIPLINARY INTERVENTION In order to support and improve student academic and social success, we
implement behavioral interventions that address misconduct that may occur. The
goals of intervention are to address the problem behavior, maintain safety and
16 productivity, improve supports for students who require assistance, and maximize
academic and social achievement for all students. At the discretion of staff and/ or administration, students may be assigned specific
consequences or combinations for violations of the Code of Conduct. The range of consequences that may be assigned is as follows: Reprimand: Student will be issued a warning of unacceptable behavior and
redirected to the appropriate behavior. Hall Pass Restriction: Pass privileges are revoked for improper use or tardiness.
Loss of this privilege requires that students remain in class for the duration of the
class or classes. Emergency needs will be assessed and mitigated by staff and/or
administration. Lunch Detentions: Students are expected to remain in the front office or
designated area for the duration of the lunch period. Students will eat lunch silently
and complete class assignments. Failure to attend an assigned lunch detention will
result in referral to the administration for further consequences. Teacher Assigned Detentions: Staying with a teacher after school, generally for
one hour. Notice must be given to the student and family. Failure to attend a teacher
assigned detention will result in referral to the administration for further
consequences. Front Office Detentions: 2:30pm – 4:30pm after school in a designated area.
Students are expected to do class work or remain silent in detention. NOTE: Any form of detentions may be assigned on the same day of the discipline
referral. Restorative Justice Classroom (RJC): The RJC is a quiet, structured and
supervised classroom used to support students and staff when a student’s behavior
does not meet Mohawk’s Code of Conduct. Teachers, paraprofessionals,
administration and counselors periodically meet with students to support their
academics and plan to restore the relationships that have been harmed as a result of
their behavior. Students will reflect upon their behavior and commit to restorative
justice practices. These practices will often result in a written plan to change and
prevent the harmful behavior with the individuals involved in the incident. In the Restorative Justice Classroom – ­ Students must engage in the processes of Restorative Justice ­ Students must work on class assignments when applicable 17 ­

Students must commit to a plan to restore the relationships that they
have harmed No electronics, no sleeping, no heads down. Students may need to do “morning check in” /”afternoon check out” with
guidance if the time in RJC goes beyond the initial day. Students who are unable to meet expectations will have their time in RJC extended
at the discretion of staff and/ or administration. School/ Community Service: At the discretion of the administration and with the
agreement from parents and students, voluntary school (community) service may
be used in lieu of detention(s) and/or school suspension. Students may be assigned
to the custodial, office and/or cafeteria staff or, upon approval from the
administration, seek service opportunities elsewhere. Loss of Transportation: Transportation privileges to and from school provided by
the district may be restricted and/or terminated for behavioral infractions at the
discretion of administration. Internal Suspension: Held for up to an entire school day or multiple days. Students
are expected to complete class assignments and sit silently in the Restorative Justice
Classroom or other designated area. External Suspension: Suspensions can be for several school days. The length of the
suspension is at the discretion of the administration. Suspended students may not
be at school or attend any school-related functions such as sporting events, concerts
etc. during the period of suspension. NOTE: In accordance with MGL Ch. 76, S. 21, students who are suspended from
school for 10 or more consecutive days, whether in or out of school, shall have an
opportunity to make academic progress during the period of suspension, to make up
assignments and earn credits missed including, but not limited to, homework,
quizzes, exams, papers and projects missed. Re-Entry Meetings: Students who have been suspended for more than two days
are required to participate in a Re-entry meeting with the school administration,
guidance counselor, teacher/s, and the students’ family. The purpose of the re-entry
meeting is to re-establish expectations, address the behavior, and support the
student in meeting their academic requirements. CATEGORIES OF DISCIPLINARY INFRACTIONS - This list is not meant to be all
inclusive, but should give guidance to understanding the general assignment of

teachers will be considered harassment and/or assault) ● Fighting. Mohawk Trail Regional High School subscribes to a “no fault
policy.” Any students involved in a fight will be suspended. Loss of control
and intent to injure are more important considerations than fault. Mediation
may be recommended. ● Hazing or harassment. ● Behavior that is materially disruptive to the educational process; 19 ● Disruption of a school assembly ● Possession/use of dangerous substances, such as, but not limited to
fireworks, "stink bombs," or incendiary devices. CATEGORY IV: AT LEAST TEN DAYS OF SUSPENSION AND STUDENT IS SUBJECT
TO EXPULSION AND ATHLETIC RESTRICTION (AT THE DISCRETION OF THE
PRINCIPAL) ● Possession, use, distribution of drugs or drug paraphernalia on school
grounds (see Drug policy for definitions) ● Possession, use, distribution of alcohol on school grounds ● Intent to use or receive drugs or alcohol on school grounds CATEGORY V: IMMEDIATE SUSPENSION AND STUDENT IS SUBJECT TO EXPULSION
AND ATHLETIC RESTRICTION (AT THE DISCRETION OF THE PRINCIPAL.) 1. Any student who is found on school premises or at school-sponsored or
school-related events, including athletic games, in possession of a dangerous
weapon, including, but not limited to a gun or knife.
2. Any student who is found on school premises or at school-sponsored or
school-related events, including athletic games, in possession of, or under the
influence of a controlled substance as defined in Chapter 94C, including,
but not limited to, marijuana, cocaine, and heroin.
3. Any student who assaults any school employee on school premises or at
school-sponsored or school-related events, including athletic games.
4. Any student charged with, or found guilty of, a felony charge either
initiated for in-school or out-of-school behavior may be subject to an
expulsion under MGL ch. 71 sec. 37H ½..
*Any student who is found to have violated Category IV or V shall be notified in
writing of the opportunity for a hearing; the student may have representation, along
with the opportunity to present evidence and witnesses at a hearing before the
Principal. After the hearing, the Principal may decide to suspend or expel the
student from school. NOTE: 1. Parents/guardians should be aware that serious violations of the Code of Conduct
could mean that law enforcement authorities will be involved and the
administration reserves the right to extend the period of suspensions or to suspend
out-of-school. 2. Multiple discipline infractions will result in progressive discipline at the
discretion of the school administration. In determining the severity of a penalty, the
administration will consider all relevant factors including, but not limited to: - Student’s previous discipline record - Severity of disruption to the educational process - Degree of danger to self, others and the school in general 20 - Degree to which the student is willing to change inappropriate behavior Appeal of Expulsion Any student who has been expelled from a school district pursuant to these
provisions shall have the right to appeal to the superintendent. The expelled student
shall have ten days from the date of the expulsion in which to notify the
superintendent of his appeal. The student has the right to counsel at a hearing
before the superintendent. The subject matter of the appeal shall not be limited
solely to a factual determination of whether the student has violated any provisions
of this section. (MGL. Ch. 71, S. 37h) When a student is expelled under the provisions of this section, no school or school
district within the commonwealth shall be required to admit such student or to
provide educational services to said student. If said student does apply for
admission to another school or school district, the superintendent of the school
district to which the application is made may request and shall receive from the
superintendent of the school expelling said student a written statement of the
reasons for said expulsion. AFTER SCHOOL PRESENCE ON CAMPUS Students are not allowed to remain on campus after school hours unless in an
approved, organized activity, under supervision of staff. The Library/Resource
Center is typically open for student use for one hour after school. Students awaiting
transportation should wait in the front of the school or in the front foyer. Repeated
violations of this expectation will result in the loss of after-school privileges and
programming. Athletes are expected to remain with their coaches until they are
picked up. AGE OF MAJORITY When a student reaches the age of majority (18), he/she is afforded all the rights
and privileges of adulthood. It is imperative that the student who reaches this status
recognizes that schools have been given the right to establish reasonable rules
regarding their operation. A student attending school, regardless of age, is covered
by school committee policies. An 18-year old is still responsible for their student
obligations which do not change upon reaching the age of majority. CELL PHONE USE POLICY The use of cell phones for high school students is allowed as described below: 1. between arrival to school and the start of classes at 7:44am,
2. in the Cafeteria during your scheduled lunch block,
3. in class as directed by staff - solely for educational purposes.
Texts and calls to and from home can be considered violations of the school policy
when they occur during class. Any device which serves more than one function,
including texting capacity, is subject to this policy. 21 Upon request and at the discretion of staff, students may use a school phone or cell
phone with their school counselor or in the front office. In this case, the students
will be responsible for appropriate cell phone use and etiquette. Cell phone use is prohibited for Middle School students. USE OF ELECTRONIC DEVICES, INCLUDING CELL PHONE High School: The use of electronic devices so that students may listen to music
between classes is allowed in the high school building with restrictions in the
classrooms. Staff may allow or prohibit the use of electronic devices in class. Use in
classrooms is solely for educational purposes and shall be at the discretion of
staff. High school students may use their cell phones and electronic devices before
school begins at 7:44 and after the 2:15 end-of-day bell, and during lunch in the
cafeteria. Middle School: Use of electronic devices, including cell phones, in the Middle school
is prohibited except at the discretion of staff for educational purposes. In the case of Cell Phone or Electronic Device Policy violation: At the determination of staff, inappropriate use of a cell phone or electronic device
is cause for confiscation of the device. In this case, the device will be turned off,
given to staff, and delivered to administration. Cell phones must be relinquished in
their complete form, including SIM cards and battery. Failure to meet the
expectation could result in disciplinary action. If the student is able to meet this
expectation the following restrictions will be initiated: 1st offence: Device confiscated and returned at the end of the school day. 2nd offence: Device confiscated and returned at the end of the day, call to parents
made. 3rd offence: Device confiscated and returned only to parents at their discretion, cell
phone privileges revoked for an agreed upon time, typically two weeks. Repeated offences could result in extended or permanent loss of cell phone
privileges for the remainder of the school year. DRESS CODE/ APPROPRIATE SCHOOL ATTIRE
Staff and students have a right and responsibility to monitor their dress attire. We
recognize that dress and attire are forms of personal expression that bring a rich
and creative component to our school culture. However, we expect that staff and
student dress will reflect the seriousness to which we and our entire school
community takes education. We ask that students and staff think about the context
of school when choosing what to wear and strive for their dress to bring a positive
impact on student learning, student behavior, and the overall educational
environment. We recognize that there are no “rules” that provide clear guidelines
22 for dress that work for everyone in all seasons and within the context of school.
Using a guideline like “business casual” may be useful.
In addition, clothing, hats or jewelry advertising or promoting tobacco, alcohol, or
controlled substances are prohibited. Clothing with messages demeaning to or
oppressive toward groups or individuals is not allowed. In the event that students
fail to comply with these expectations, they will be asked to change attire.
Parents/guardians may be contacted and asked to provide acceptable clothing to
the school. In the event that a student refuses to comply with the request of staff or
administration, their parents/guardians will be contacted and the student may face
disciplinary action.
GUEST PARTICIPATION AT SCHOOL SPONSORED EVENTS A student requesting to bring a guest to a school-sponsored event, such as a school
dance or prom, who is not a Mohawk Trail Regional School student must complete a
Guest Permission Form and have it approved before the guest may attend the event.
Guests must not be over the age of 20. A photocopy of the guest’s high school I.D. or
state driver’s license/state I.D. card must be attached to the completed form. The
Guest Permission Form is available in the Front Office. HALL PASSES/LUNCH PASSES Students may go from one area to another during class time or lunch with the
permission of staff and with a hall pass, unless pass privileges are revoked for
improper use. During lunch, students are expected to remain in the cafeteria unless
other obligations have been scheduled in advance and hall passes provided by the
receiving staff. RECORDING DEVICES Recording devices (both audio and video) are not permitted in classrooms without
prior consent of the teacher and the administration. Unauthorized use of digital
images, both still and video, will be considered a violation of the code of conduct. SALE OF GOODS IN SCHOOL Students are not permitted to purchase or sell items from other students in school,
including, but not limited to, electronic items, food or drink. SEARCH AND SEIZURE Under the doctrine of reasonable cause, as enunciated by the U.S. Supreme Court
(New Jersey vs. T.L.O., 1985, student search and seizure), Mohawk Trail Regional
School policy allows for any administrator with reasonable suspicion and with a
witness, to search a student, his or her belongings, and any school locker assigned or
used by the student in question. Such a search can be conducted for items in
violation of school policy that are not necessarily illegal. In the most general sense,
any student discovered or reported in a location and at a time, either or both which
are unauthorized has presented the school administrators with reasonable cause to
23 conduct a search. Examples for “reasonable suspicion” include, but are not limited
to, the following: ● Smell of marijuana or other substances ● Quick or suspicious movements, such as quickly putting something into a
pocket ● Large number of dollar bills ● Tip(s) from a student, staff member, parent, or other witness ● Leaving school grounds and returning, once having arrived for the school day ● Physical symptoms consistent with drug or alcohol use, as determined by
administration, with consultation from the school nurse ● General, chronic unruly and disorderly behavior Note: For students on school property or a school sanctioned/sponsored event or
activity, possession means on one’s person, in one’s personal belongings, or in any
school locker assigned to or used by the student. SEARCH PROTOCOL: 1. The student will be informed of the reason for the search and their due
process rights.
2. An additional staff witness will be present for the duration of the search.
3. Any item/s confiscated during the search will be catalogued and stored in the
school safe.
4. Parents/guardians will be informed of the search and results.
5. Local authorities may be informed as necessary.
Students who refuse a search may be suspended, in or out of school, until the
administration can resolve the initiating suspicion that caused the search. SKATEBOARDING, ETC. Skateboarding, roller-blading (unless in PE), and heelys type shoes are not allowed
at Mohawk Trail Regional Middle and High School. USE AND CARE OF SCHOOL PROPERTY All students are expected to care for and use school property as it was intended to
be used. Any student who causes damage to school property (or buses) will be
expected to pay for damages and face disciplinary action. Textbooks 1. Textbooks are school property provided by the taxpayers for your use and
you are responsible for those books issued to you.
2. If property is lost, damaged, excessively soiled or worn beyond normal use,
you must pay for damage. If you lose a book, notify your teacher. Check lost
and found. If the book is not found, you will be charged for it before being
issued a replacement.
3. If you find your original book, return one of the books to your teacher.
Payment for lost books is not refundable once a replacement has been
24 purchased.
4. Books must be returned at the end of the year, at which time they will be
examined for damage.
5. If you received a book that is marked or soiled, call it to the attention of your
teacher at the beginning of the year so that you will not be held responsible
for it later.
6. All textbooks issued to you must be kept covered at all times to prevent
excessive wear and soiling.
USE OF STUDENT IMAGES Mohawk reserves the right to use student images in still, video, and digital form for
school publications and productions. Parents may opt out of this by submitting a
request in writing to the principal. VEHICLES ON SCHOOL PROPERTY Students must register their vehicles in the main office in order to obtain a parking
permit. Student vehicles on school property without a permit will be removed at the
expense of the student/family. Students must observe basic rules of driving safety
while on school grounds. A strict speed limit of 10 MPH is in effect on school
property at all times. ● Students are not allowed to leave school grounds in their vehicles without
permission from the administration. ● School buses have the right of way at all times; all vehicles must come to a
complete stop when buses are flashing red lights. ● No student is allowed in the parking lot or cars during school hours without
permission from the administration. ● Students must park in the designated parking area only. ● Students who are consistently late to school may have their driving
privileges revoked. Failure to observe expectations for safety driving while on school grounds or failure
to remain in good behavioral standing may result in driving privileges being
revoked at the discretion of administration. The school administration may file a
criminal complaint with the local police and/or Massachusetts Registry of Motor
Vehicles, and reserves the right to tow any vehicle in violation of the above rules. V - STUDENT SERVICES/ GUIDANCE ADMISSION REQUIREMENTS New students who wish to enroll at Mohawk must submit required records before
enrollment can be approved and the student can begin attending classes. Contact
Mrs. Karen Strong, School Registrar/Student Services Secretary for details. The
enrollment process involves submitting required documentation that includes, but
is not limited to: academic transcripts, disciplinary records, attendance records,
school registration forms, any required parent custody agreements, Individualized
Education Plans (IEPs), psychological and academic assessments, all health records,
25 and any other records deemed necessary by school officials to properly place a
student in programs and courses. The Principal will work with service providers to
expedite students who are covered by the provisions of the McKinley-Vento
Homeless Act. APPLICATIONS AND TRANSFERS All applications and transfers to public vocational-technical schools are processed
through the student services department. In order to provide the towns that belong
to the Mohawk Trail Regional School District appropriate and timely information,
the following procedure and timelines are strictly adhered to. Absolutely no
vocational school applications will be processed by Student Services after April 1st,
or March 15th in the case of Ashfield, Charlemont, Hawley, Plainfield, and Rowe
residents. COLLEGE VISITS Students are strongly encouraged to seek out information regarding post-secondary
education. Visiting college campuses is an integral part of that process. Families are
strongly encouraged to use the February and April vacation weeks of junior year
and summer vacation to accomplish that goal. Juniors will be allowed two days to
visit colleges during their spring semester and seniors will be allowed three days,
for a total of five overall. For these visits, a parent or guardian must accompany
students. Additionally, a College Visitation Form, available in Student Services, must
be completed. EARLY ENTRANCE TO COLLEGE/DUAL ENROLLMENT Seniors and second semester juniors who are currently enrolled at Mohawk and
meet academic eligibility requirements may be considered for early entrance into
one of the local colleges, such as Greenfield Community College. Students
participating in this arrangement can earn credits that meet both high school
graduation and higher education matriculation requirements. Student eligibility:
Students must be in their senior year or the second semester of their junior year and
have attained a 3.0 grade point average, or better, and/or be recommended to take
college-level course work by the Principal, Guidance Counselors, or teachers. In
addition to the qualifying academic standing and/or appropriate school personnel
recommendations, students must meet pertinent higher education admission
requirements and individual course requirements at the respective post-secondary
institution. A student must have written approval from parent or guardian to be

6-7 courses A total of 162 credits in core academic courses and electives combined is required
for graduation. Core academic requirements are met when students pass the
minimum number of required courses. Students accumulate elective credit for any
courses taken beyond core academic requirements. Beginning in the 2014-2015 school year, a minimum of 40 credits must be earned
to be a 10th grader. A minimum of 80 credits must be earned to be a 11th grader. A
minimum of 120 credits must be earned to be a 12th grader. Credits are assigned as follows:
three (3) credits for a course that meets every other
day for a semester.
Six (6) credits for a course that meets daily for a semester.
Twelve (12) credits for a course that meets daily all year (for two semesters). PHYSICAL EDUCATION: All students are required to take health and physical
education. Due to the participatory nature of physical education, presence and
participation in class are critical. All absences have an impact on a student’s grade;
therefore all excused absences can be and should be made-up. Any student who
cannot participate in the regular physical education classes due to medical reasons
must still be assigned to class. During their P.E. period class they will, in cooperation
with the teacher, participate in an alternative program. Any medical excuses must
be on file in the Health Services Office and updated yearly. Students with a medical
excuse must check in with the P.E. teacher before each scheduled class, unless other
arrangements are made with the teacher. Exercising clothing is required for
participation in class. This may consist of loose-fitting shorts with an elasticized
waistband, a t-shirt, socks and sneakers. Jewelry, earrings, or any other body rings
are not allowed during P.E. classes. Padlocks will be issued for gym lockers, and must be returned at the end of the
school year. Report lost padlocks to the instructor immediately. Keep lockers locked
at all times. Do not give combinations out to anyone. The school is not responsible
for your personal property. Valuables and items which do not fit into the locker
should be given to the coach or P.E. teacher for safekeeping. Students will be
charged a $5 fee for lost padlocks. STUDENT SERVICES CENTER The Student Services Center is available to students, parents, and other school
personnel who have educational, vocational and social issues to discuss. Please use
these services. Student work permits are issued through this office. Make
appointments with counselors. The Student Services secretary will give students a
pass. There is one guidance counselor assigned to the Middle School and one
assigned to the High School. 27 STUDENT VISITORS Students may have a guest in school if the visitor is shadowing a current student for
the purposes of possibly attending Mohawk. That potential student shall have their
parents/guardians contact the school to make arrangements through Student
Services. This must happen at least 48 hours prior to the visit and the guest must
sign in at the office and get a visitor's pass. Students who are currently enrolled in
another school must have permission from their principal. Mohawk students who wish to invite a student from another school to a school
event such as a dance or prom must complete a request form that is available in the
front office and receive permission from the administration prior to the event. The
form requires that the guest student’s principal approve his/her participation in the
Mohawk event. HEALTH SERVICES The Health Office is staffed daily by a Registered Nurse from 7:30 AM-2:30 PM. The school nurse is available to do the following: ● Provide first aid and illness assessment. ● Provide initial emergency care. ● Administer medications. ● Perform treatments and procedures. ● Perform mandated screenings. ● Provide immunizations. ● Act as a health resource for students, parents, and staff. ● Maintain the health records, which include at a minimum medical history,
immunizations, physical examinations, screening results, and emergency
information. The school nurse also helps to identify health care and social needs, makes
appropriate referrals, attends IEP and 504 meetings if a health issue is involved, and
serves on committees. HEALTH OFFICE PROCEDURES ● Students must obtain a pass from their teacher or adult supervisor before
going to the Health Office. This requirement would be waived in case of an
emergency. ● Students are seen on a “first come, first served basis” usually. Students
presenting with an emergency situation are seen immediately. ● Students are expected to wait quietly and act appropriately while waiting to
be seen by the nurse. ● Students are required to sign the log upon arrival. ● If the nurse determines that a student needs to be dismissed, the nurse will
call the parent/guardian or emergency contact to notify them and to arrange
transportation home. The nurse will issue a Dismissal Slip for Medical
28 Reason to the student that needs to be brought to the front office before
leaving. CONDOM AVAILABILITY The school believes that abstinence is of paramount importance as teens begin to
develop more intimate relationships and encourages abstinence as the most
effective response to an increasing incidence of sexually transmitted diseases,
including HIV/AIDS. For young people who make the decision to become sexually
active, the school promotes responsible behavior that increases the likelihood of
personal safety. Condoms are an effective barrier to the spread of HIV/AIDS when
used properly but are not a complete guarantee of protection. The school nurse will
offer counseling in this area.
The Mohawk Trail Regional School District makes condoms available to sexually
active students in grades 9-12 with appropriate counseling through the Health
Office. The school district provides parents the right and opportunity to opt
students out of this program. If parents or guardians do not want students to have
access to condoms through this program, they must indicate so on the form
provided. VI - SCHOOL RESOURCES ATHLETICS: PARTICIPATION AND ELIGIBILITY Mohawk offers a variety of team sports in middle school, varsity and junior varsity
interscholastic athletics. To be eligible to participate in sports, students must
complete an annual physical, be in good academic standing, pay user fees, and sign
an athletic contract. Fall sports include cross-country, field hockey, and football,
girls’ volleyball, and soccer, golf. Winter sports include alpine (downhill) skiing,
basketball, cross-country (Nordic) skiing, winter track, and wrestling. Spring sports
include baseball, tennis, softball, and track and field. Students interested in
participating in athletics, please contact Fred Redeker, Athletic Director at ext. 1310. Note: Students with disabilities are provided additional protections under the law
and may need special consideration when applying the school rules for participation
in athletics and student activities. The Director of Pupil Personnel Services will
collaborate with the Building Principal and Athletic Director, as needed, when a
disabled student’s eligibility is in question. ACTIVITIES There are many ways to be engaged in the Mohawk community. In addition to
athletics there are a number of clubs and extra-curricular opportunities. These
include: As Schools Match Wits: Each year a team from Mohawk competes in this regional
competition. See Mr. Galvagni, advisor, for more details. 29 Booster Week: Mohawk’s Homecoming Week features a pep rally, parade with
floats, and big games. Dances: Classes or other groups seeking to hold a dance at Mohawk must comply
with the administrative regulations for dances. Contact the Front Office for this
information. Key Club: See the bulletin board outside of the Front Office for more information
about this service organization. National Honor Society: Please refer to the separate section in this handbook that
outlines the selection process. Student Council: Mohawk’s Student Council organizes a number of events and
provides a forum for student leadership and initiative. Each class is represented by
elected student representatives and class officers. Contact Ms. Rubinaccio or Mr.
Mastorakis, the co-advisors, or your class representatives. SGA: Sexuality and Gender Alliance: Please contact Mr. Grail or Ms.
Skutnik-Sheffield for further information about this group. Yearbook: Students in Mr. Otten’s Yearbook course produce the yearbook. Contact
Mr. Otten for more information. Additional information is available in the Front Office and will be posted throughout
the school year. These and many other groups meet during the ELO (Expanded
Learning Opportunities) period in the high school schedule. CAFETERIA - BREAKFAST AND LUNCH Breakfast is served 7:15-7:44. Each student schedule includes a 25-minute lunch
period. Use of the cafeteria during breakfast and lunch is a privilege which depends
upon proper behavior. Students with outstanding bills may be restricted to a
limited, but healthy food offering, separate from the menu of the day. Applications
for nontransferable free or reduced lunches are available in the front office. Open
food containers are not to be removed from the cafeteria. EMERGENCY PROCEDURES Fire drills are held several times during the year, signaled by a fire alarm. Students
are expected to be thoroughly familiar with evacuation procedures that are posted
in all rooms. Students are to proceed in an orderly manner to a designated area
where attendance will be taken by the homeroom or ELO Home Group teacher. All
students must leave the building during a drill. Any student who endangers safety
may be disciplined. The school also may initiate a “lockdown” protocol which will be
practiced during the year. When staff indicates that the school is in lockdown
status, students are to remain in the classroom until instructed to do otherwise. LOCKERS Each middle school student is issued a locker with a private combination lock at the
opening of school. Lockers are for the use of the student but are the property of the
school district. No padlocks may be attached to hall lockers. In the middle school,
backpacks, book bags, athletic bags, etc. are not allowed in classrooms. Passing
30 times between periods permit students to get materials needed for their next class.
High school students may request a locker. RESOURCE CENTER The Resource Center houses the school’s collection of print and non-print material
and equipment. The school-based television studio operated by Falls Cable Corp. is
also located in the Resource Center. Students, staff, and community members are
invited to access the Resource Center’s extensive collection of materials. No fines
are charged for overdue material, but patrons are expected to return borrowed
items within the three-week loan period. There is a charge for lost material and
students may lose borrowing privileges for noncompliance. Reference material does
not circulate. Limited photocopying of non-circulating material and computer
printouts of Internet resources may be made in the Resource Center at no charge. Students may use the Resource Center during their free time or as part of a class
visit with a teacher. Students who do not arrive as part of a class must present a
pass when entering the Resource Center and sign in at the circulation desk. If a
student wishes to leave prior to the end of the block, he or she must ask permission
from library staff and sign out at the circulation desk. The restrooms beside the
cafeteria are designated for use by Resource Center patrons. Due to limited seating
capacity, priority will be given to scheduled class visits and individual students who
are engaged in research. The Resource Center is open most afternoons for one hour
after school. While in the Resource Center, patrons are expected to work quietly and respect the
rights of others. Consequences for inappropriate behavior include a warning, a
request to leave the library, and possible loss of library privileges. Food and drink
should not be brought into the Resource Center. Students in the Resource Center at
2 p.m. are asked to remain until the dismissal bell rings at 2:15 p.m. Only one
student per study booth and up to four students may be seated at a table. Please do
not rearrange the furniture. Students may use the computers in the Resource Room according to the terms of the
school’s Internet policy and by following the procedures outlined by library staff.

I. SAFE SCHOOL POLICY
32 A. Statement Of Purpose and Compliance
1. The Mohawk Trail Regional School District and the Hawlemont Regional
School District are committed to assuring a safe school environment for all
Students, Parents, Staff and community members. The Mohawk Trail
Regional School District and the Hawlemont Regional School District have
safety standards and procedures that conform with the standards of
classroom safety adopted by the Massachusetts Board of Education pursuant
to the M.G.L. c. 69, 1B and meet the requirements set forth by M.G.L. c. 71,
37H. These standards and procedures address such events as building
emergencies, intruders, bomb threats and natural disasters.
B. Standard Of Safety
1. The School Committees, Administration and Staff of the Mohawk Trail
Regional School District and the Hawlemont Regional School District shall
encourage the creation of and maintenance of a safe, secure learning
environment in every school building and at school sponsored events. The
creation of a safe learning environment will be enhanced by the provision of
sufficient resources, expert consultation, adequate staff training, established
policies and procedures, and ongoing support for the procurement and
maintenance of appropriate safety devices.
2. Administration, Staff and Students in each building shall strive to create an
educational environment that is safe and secure in order to facilitate learning
and teaching. The school plan will include strategies for the prevention of
injuries and violence.
C. Procedures To Meet Standards
1. Administrative Action
a. The Superintendent will assess current safety standards and procedures
not less than once every three years.
b. The assessment of current standards and procedures will be
accomplished by the Superintendent, building Principals and other
District personnel who shall review and update current practices with
representatives of the police and fire departments in each town, the
Districts’ insurance carrier, and the Districts’ counsel, in addition to other
parties whom the Superintendent and Principals determine to be critical
to the process.
33 c. The Superintendent or his/her designee shall collect, review and
disseminate the assessment report to the District Safety Committee,
building-based safety committees and the School Committee.
d. Those groups and individuals receiving the assessment report will
promptly review it.
The District Safety Committee and each
building-based safety committee will subsequently meet and make
recommendations to the Superintendent and the School Committees for
the purpose of making the necessary improvements to the existing safety
and security practices.
e. The Superintendent and each building Principal shall annually, as part of
the budget process, identify safety and security needs and request
appropriations for security personnel, devices, equipment and updated
training for all Staff.
f. Building Principals in consultation with the Superintendent will provide
pertinent safety information to Parents based upon a careful review of
each circumstance.
2. School Committee’s Action
a. The School Committees shall review the Superintendent’s final report and
discuss its contents with the Superintendent and other district
Administration prior to making any changes to existing policies or
procedures.
b. Prior to adopting recommendations for changes to the existing policies,
the Committees shall receive from the Superintendent estimated costs
associated with the implementation of any recommendations.
c. Upon adoption of amended or new safety policies, the School Committees
shall forward a copy of the policies and standards to the Massachusetts
Board of Education and local law enforcement and safety officials.
II. STUDENT RIGHTS AND RESPONSIBILITIES/DUE PROCESS
A. How are Students protected from discrimination?
1. State law guarantees that no Student may be excluded from or discriminated
against in any school program because of their race, gender, color, sex,
religion, national origin, gender identity, or sexual orientation.
B. What means are available to Students for expressing their opinion?
34 1. There are several ways in which Students may express their opinions. They
may express their views through speech and symbols (arm bands, buttons,
etc.) as long as such expression does not cause disruption in the school and
there is no clear and present danger to the well being of Students and Staff.
Students may petition the Administration at any time. Students may
assemble peaceably on school property in order to express their views,
although the Administration may restrict the time and place of assemblies
and the distribution of written opinions during regularly scheduled school
hours.
C. What are a Student’s rights in suspension or expulsion?
1. Suspension is a temporary exclusion from the classroom (for 10 consecutive
days or less), and is enforced by the Administration in accordance with the
provisions of the suspension system. Expulsion is administered directly by
the Superintendent or Principal and may be for a period of time longer than
10 days. Any Student being suspended or expelled is entitled to:
a. Be told of the charges and evidence against him /her.
b. In the case of suspension of 10 days or less, be allowed to tell his/her side
of the story, at least informally, in a conference with impartial decision
makers (the Administration).
c. In the case of expulsion longer than 10 days, in addition to (b) above, also
be allowed a formal hearing and shall have the right to counsel.
D. What are the Students’ rights regarding the privacy and security of student
records?
1. Definitions:
a. Transcript. The transcript shall contain administrative records that
constitute the minimum data necessary to reflect the Student’s
educational progress and to operate the educational system.
b. Temporary record. The temporary record shall consist of all the
information in the student record which is not contained in the transcript.
This information clearly shall be of importance to the educational
process.
c. Student record. The student record shall consist of the transcript, the
temporary record, and any other material concerning a Student that is
organized on the basis of the Student’s name or in a way that such
Student may be individually identified.
35 2. The school Principal or his/her designee shall be responsible for the privacy
and security of all student records maintained in the school. The eligible
Student and his/her Parents or Guardians shall have access to the student
record. In no event, shall such access be delayed more than two consecutive
school days after the request for a review has been made, unless the
requesting party consents to a delay.
3. Students 18 years of age or over may limit the right of access of their Parents
or Guardians by making such request in writing to the school Principal, who
shall honor such request and retain a copy of it in the student record.
4. The student transcript will be kept for 60 years following the Student’s
graduation, transfer or withdrawal from the school system. The temporary
record will be kept no more than five years after the Student transfers,
graduates or withdraws from the school system.
5. A copy of the Student Records Regulation is on file in the Principal’s office
and is accessible to any Student, Parent, or Guardian upon request.
6. Except for the Student, Parent and/or Guardian as specified above,
authorized school personnel, and certain exceptions detailed in the
governing state regulation, no third party shall have access to information in
or from the student record without the specific, informed written consent of
the eligible Student or Parent or Guardian. When granting consent, the
eligible Student or Parent or Guardian shall have the right to designate which
parts of the student record shall be released to a third party.
E. What should a Student do if he or she feels rights are being denied?
1. First, the Student should try to talk the problem out with the individual
teacher, coach or club advisor. If the problem cannot be solved in this way,
the Student’s parents or Guardian should set up a conference with the
individual staff member. If the Student and his/her Parents or Guardian are
still not satisfied, they should set up a second conference with the individual
teacher and his or her coordinator (or, in the case of a club advisor, with an
administrator). This process of conferences should be continued through the
Administration to the Superintendent and School Committee, with legal
action being used as a last resort, if the Student is not satisfied with the
results.
2. There are many avenues to express student opinion and many individuals or
groups within the school to help a Student resolve problems; the basic
student right is to a good education. All of our efforts are directed toward
that goal. Students who sit down in good faith and work towards
36 harmonious solutions to problems will find the entire Staff willing and ready
to work with them to reach those solutions.
III.
STUDENT ATTENDANCE, ABSENCES, TARDINESS AND EARLY
DISMISSAL
1. The Mohawk Trail Regional School District and Hawlemont Regional School
District Committees believe strongly in the importance of regular attendance
by all students. Excessive absences, whether excused or unexcused;
tardiness; and leaving school before scheduled dismissal times have a
negative effect on student performance.
2. The Committees adhere to, and is in full compliance with Chapter 76 of the
Laws of the Commonwealth of Massachusetts which defines school
attendance regulations. Parents/Guardians have legal responsibility to
ensure that their children attend school during the school year.
3. Students are scheduled to attend school 180 days with vacations built into
the school calendar. Unless an absence is deemed to be excused by the
District, students are expected to be present when school is in session.
Parents are strongly urged not to schedule family vacation during school
days and not to extend the scheduled vacation periods.
4. The Districts shall develop guidelines, policies and procedures for managing
attendance in accordance with this policy which shall be published in the
student handbook.
Administration shall, from time to time, have
conversations with the Policy Subcommittee regarding the development of
policies, procedures, and guidelines.
5. Attendance Policy
Parents/guardians must notify the school whenever a student is absent. An
absence is considered to be excused if the absence is due to a legitimate need
to be excused from school, which includes, but is not limited, to one of the
following: 1) Illness, 2) Hospitalization, 3) Death of a family member, 4)
Observance of religious holidays, 5) Crisis situations, 6) physical or mental
conditions which render attendance inexpedient or impractical. A telephone call from the parent/guardian to the school is acceptable to
document the absence if made by 9:00 AM the day(s) of the absence.
Whether excused or unexcused, a note from the parent/guardian must
accompany the student on their return to school. After three consecutive days of absence, school personnel will contact the
family to determine the student’s status. Students who have been out for
37 three or more consecutive days may be required to provide the school with a
doctor’s note at the school’s discretion. The School Districts have established the following procedures and
guidelines for excessive student absences: ● After seven absences, excused and/or unexcused, a letter of
notification will be sent home to the parents/guardians. ● After ten absences, excused and/or unexcused, a 2nd letter will be sent
requiring the parents to meet with the Principal, with a copy of the
letter sent to the office of the Superintendent. Another copy of the
letter may be sent to the designated School Truant Officer. ● After fifteen absences, a 3rd letter will be sent home and a referral of
the situation may be sent to the designated School Truant Officer and
copy to the office of the Superintendent. ● After twenty absences, a 4th letter will be sent home and a referral
may be sent to the Massachusetts Department of Children and
Families for investigation, with a copy sent to the office of the
Superintendent. If a student at the middle/high school is absent for more than 9 class
meetings for a full semester course (5 for a course that meets on alternating
days) or 18 class meetings for a full year course, the student may be issued a
final non-passing grade for that course. In the event that a non-passing grade
is to be issued for excessive absences, the parents and student will be
notified and will be given an application for appeal and additional
information as to how they can appeal the decision. An appeal may be made
to a Committee consisting of an administrator, counselors, and a teacher. The
parents and/or student should fill out an application for an appeal at least a
week before the last day of the semester, or within ten (10) days of receiving
notification, which ever date is later (unless extenuating circumstances
prevent timely submission of the application).
The Committee has full
discretion to determine if the non-passing grade is appropriate or should be
waived, or to fashion alternative conditions which a student must fulfill in
order to receive a passing grade. All documentation from the case, including
information concerning serious or chronic illness documented by a
physician's note, will be taken into consideration. A student who is absent from a class may not participate in extracurricular
activities, such as athletics, on the day of the absence, unless participation is
approved in advance by the principal. School-sanctioned field trips,
assemblies, college visits with school permission, athletic competitions and
other school-sanctioned activities will not be considered an absence. TARDINESS: 38 Tardiness is defined as arriving and/or entering the school building after the school

the school office. Middle and high school students must be in their first class of the
day at 7:44 a.m.; those who arrive late must sign in at the front office and are
considered tardy. Elementary school students who arrive at school after the
mid-point of the school day (11:45 AM) will be marked absent for the day. High
school and middle school students who miss more than 30 minutes of regular length
(typically 76 minutes) class period (15 minutes of a 45-minute period) will be
considered absent from that class. This is due to the requirements of the time on
learning standards set by the Commonwealth of Massachusetts as managed by our
student attendance system. EARLY RELEASE FROM SCHOOL: The School Districts recognize there are occasions and legitimate reasons for
parents/guardians to request early dismissal from school. The School Districts
strongly encourage parents/guardians to have their children complete the school
day. Parents/guardians should make every effort to schedule appointments after
school hours when possible. Elementary school students dismissed before the
mid-point of the school day (11:45 AM) will be counted as absent for the day. High
school and middle school students who miss more than 30 minutes of a regular
length (typically 76 minutes) class period (15 minutes of a 45-minute period) will
be considered absent from that class. This is due to the requirements of the time on
learning standards set by the Commonwealth of Massachusetts as managed by our
student attendance system. CONSEQUENCES FOR EXCESSIVE TARDINESS TO SCHOOL: 39 The School Districts have established the following guidelines for elementary school
students who have excessive tardies: ● After seven tardies, a letter of notification will be sent home to the
parents/guardians. ● After ten tardies, a 2nd letter will be sent requiring the parents to meet
with the Principal, with a copy of the letter sent to the office of the
Superintendent. Another copy of the letter may be sent to the
designated School Truant Officer. ● After fifteen tardies, a 3rd letter will be sent home and a referral of the
situation may be sent to the designated School Truant Officer and
copy to the office of the Superintendent. ● After twenty tardies, a 4th letter will be sent home. A referral to the
Massachusetts Department of Children and Families for investigation
may occur at this point, with notification of the referral sent to the
office of the Superintendent. At the middle and high school, students who are tardy to 3 times to school or any
class in a semester may be assigned a detenetion for the 3rd tardy and for every
subsequent one until the end of the semester. Students who are frequently tardy to
school may, if they drive themselves, have their driving privileges suspended or
revoked. IV. STUDENT CONDUCT
A. Good citizenship is based on respect and consideration for the rights of others.
Students will be expected to conduct themselves in a way that the rights and
privileges of others are not violated. They will be required to respect constituted
authority, to conform to school rules and to those provisions of the law that
apply to their conduct.
B. A Student may be expelled under M.G.L. 71:37H for the following actions:
1. Assaulting a Principal, Assistant Principal, teacher, paraprofessional, coach or
other volunteer, visitor or staff member or student on school premises or at
school-sponsored or school-related events including athletic games.
Being found on school premises or at school-sponsored or school-related
events, including athletic games, in possession of a dangerous weapon or a
controlled substance. C. A Student may also be expelled for the following, non-exclusive, reasons:
1. Intentionally causing or attempting to cause damage to private property,
stealing or attempting to steal school property.
40 2. Intentionally causing or attempting to cause damage to private property,
stealing, or attempting to steal private property.
3. Intentionally causing, or attempting to cause physical or emotional injury
including bullying in all its forms to another person.
4. Repeatedly and intentionally defying the valid authority of supervisors,
teachers or administrators.
6. Assaulting another student on school property including school buses or at
school-sponsored or school-related events, including athletic games at any
time. The above prohibited actions will be printed in a handbook or publication and made
available to Students and Parents. School building administrators may suspend a Student, or recommend a Student for
suspension or expulsion, if the Student has engaged in one of the prohibited actions
mentioned above while on school property or taking part in a school activity off
school grounds. These disciplinary actions are informed by MGL, chapter 222. Any school building administrator intending to suspend a Student for 10 or more
days or to expel a Student may do so after informing the Superintendent of his/her
intentions of doing so. D. LEGAL REF: MGL, CHAPTER 71, SECTION 37H1/2
1. Upon the issuance of a criminal complaint charging a Student with a felony or
upon the issuance of a felony delinquency complaint against a Student, the
Principal or headmaster of a school in which the Student is enrolled may
suspend such Student for a period of time determined appropriate by said
Principal or headmaster if said Principal or headmaster determines that the
Student’s continued presence in school would have a substantial detrimental
effect on the general welfare of the school. The Student shall receive written
notification of the charges and the reasons for such suspension prior to such
suspension taking effect. The Student shall also receive written notification
of his/her right to appeal and the process for appealing such suspension;
provided, however, that such suspension shall remain in effect prior to any
appeal hearing conducted by the Superintendent.
The Student shall have the right to appeal the suspension to the
Superintendent. The Student shall notify the Superintendent in writing of
his/her request for an appeal no later than five calendar days following the
effective date of the suspension. The Superintendent shall hold a hearing
41 with the Student and the Student’s parent or guardian within three calendar
days of the Student’s request for an appeal. At the hearing, the Student shall
have the right to present oral and written testimony on his/her behalf, and
shall have the right to counsel. The Superintendent shall have the authority
to overturn or alter the decision of the Principal or headmaster, including
recommending an alternate educational program for the Student. The
Superintendent shall render a decision on the appeal within five calendar
days of the hearing. Such decision shall be the final decision of the regional
school district with regard to the suspension. 2. Upon a Student being convicted of a felony or upon an adjudication or
admission in court of guilt with respect to such a felony or felony
delinquency, the Principal or headmaster of a school in which the Student is
enrolled may expel said Student if such Principal or headmaster determines
that the Student’s continued presence in school would have a substantial
detrimental effect on the general welfare of the school. The Student shall
receive written notification of the charges and reasons for such expulsion
prior to such expulsion taking effect. The Student shall also receive written

required to provide educational services to the Student. V. APPEAL OF SUSPENSION A. Any Student who has been expelled from a school district pursuant to Section IV
above, shall have the right of appeal to the Superintendent . The expelled
Student shall have ten days from the date of expulsion in which to notify the
Superintendent of his appeal. The Student (if age 18), Parent or Guardian has
42 the right to request a special education evaluation. The Student has the right to
counsel at a hearing before the Superintendent . The subject matter of the
appeal shall not be limited solely to a factual determination of whether the
Student has violated any provision of the above.
MGL c. 71, s. 37H Approved by School Committee: 4/27/95 VI. BULLYING PREVENTION PROCEDURE
Bullying, Cyberbullying, and Retaliation Policy B. Bullying, cyberbullying, and retaliation are prohibited. The Department of
Elementary and Secondary Education, in accordance with M.G.L. c. 71, § 37O and
Chapter 92 of the Acts of 2010, defines these terms as:
1. Definitions:
a. Bullying is the repeated use by one or more Students of a written, verbal
or electronic expression or a physical act or gesture or any combination
thereof, directed at a victim that: (i) causes physical or emotional harm to
the victim or damage to the victim’s property; (ii) places the victim in
reasonable fear of harm to her/himself or of damage to her/his property;
(iii) creates a hostile environment at school for the victim; (iv) infringes
on the rights of the victim at school; or (v) materially and substantially
disrupts the education process or the orderly operation of a school. For
the purposes of this section, bullying shall include cyber-bullying.
b. Cyber-bullying is bullying through the use of technology or any
electronic communication, which shall include, but shall not be limited to,
any transfer of signs, signals, writing, images, sounds, data or intelligence
of any nature transmitted in whole or in part by a wire, radio,
electromagnetic, photo electronic or photo optical system, including, but
not limited to, electronic mail, internet communications, instant messages
or facsimile communications. Cyber-bullying shall also include (i) the
creation of a web page or blog in which the creator assumes the identity
of another person or (ii) the knowing impersonation of another person as
the author of posted content or messages, if the creation or
impersonation creates any of the conditions enumerated in clauses (i) to
(v), inclusive, of the definition of bullying. Cyber-bullying shall also
include the distribution by electronic means of a communication to more
than one person or the posting of material on an electronic medium that
may be accessed by one or more persons, if the distribution or posting
creates any of the conditions enumerated in clauses (i) to (v), inclusive, of
the definition of bullying.
43 c. Retaliation is any action taken against a person who reports bullying,
provides information during an investigation of bullying, or witnesses or
has reliable information about bullying.
B. INCIDENT REPORTING
1. Students are expected to report all incidents or suspicions of bullying,
cyberbullying or retaliation to the Principal/ Assistant Principal in a timely
manner. Verbal reports will need to be documented on the form contained
within the student handbook, which will also be available on the District
website and front offices of each school.

C. ADMINISTRATIVE RESPONSE
1. Principal/Assistant Principal interviews alleged victim and completes
Bullying Incident Report, which opens an investigation.
2. Principal/Assistant Principal interviews the alleged perpetrator and any
witnesses.
3. Principal/Assistant Principal creates preliminary Student Safety Plans for the
alleged victim and the alleged perpetrator and informs the Students’ families.
4. Principal/Assistant Principal completes the investigation and makes a
determination.
5. If a determination is made that bullying has occurred, the Principal/
Assistant Principal shall take appropriate disciplinary action with the
Student, inform the involved families, and, as appropriate, notify the local law
enforcement agency if criminal charges may be pursued against the
perpetrator.
6. If the Principal/Assistant Principal determines that a Student has knowingly
made a false bullying accusation, appropriate disciplinary action may be
initiated.
7. Principal/Assistant Principal, in consultation with the school Guidance
Counselor and/or Psychologist, creates a more permanent Student Safety
Plan subject to review and revision as needed.
44 D. RANGE OF DISCIPLINE
1. Based on the particular circumstances of the bullying determination, the
Principal/Assistant Principal shall impose reasonable, respectful and realistic
consequences up to and including expulsion.
E. LEGAL REF: MGL, CHAPTER 269: SECTION 19
1. Each institution of secondary education and each public and private
institution of post-secondary education shall issue to every student group,
student team or student organization which is part of such institution or is
recognized by the institution or permitted by the institution to use its name
or facilities or is known by the institution to exist as an unaffiliated student
group, student team or student organization, a copy of this section and
sections seventeen and eighteen; provided, however, that an institution’s
compliance with this section’s requirements that an institution issue copies
of this section and sections seventeen and eighteen to unaffiliated student
groups, teams or organizations shall not constitute evidence of the
institution’s recognition or endorsement of said unaffiliated student groups,
teams or organizations.
2. Each such group, team or organization shall distribute a copy of this section
and sections seventeen and eighteen to each of its members, plebes, pledges
or applicants for membership. It shall be the duty of each such group, team or
organization, acting through its designated officer, to deliver annually, to the
institution an attested acknowledgement stating that such group, team or
organization has received a copy of this section and said sections seventeen
and eighteen, that each of its members, plebes, pledges, or applicants has
received a copy of sections seventeen and eighteen, and that such group,
team or organization understands and agrees to comply with the provisions
of this section and sections seventeen and eighteen.
3. Each institution of secondary education and each public or private institution
of post-secondary education shall, at least annually, before or at the start of
enrollment, deliver to each person who enrolls as a full time student in such
institution a copy of this section and sections seventeen and eighteen.
4. Each institution of secondary education and each public or private institution
of post-secondary education shall file, at least annually, a report with the
board of higher education and in the case of secondary institutions, the board
of education, certifying that such institution has complied with its
responsibility to inform student groups, teams or organizations and to notify
each full time student enrolled by it of the provisions of this section and
sections seventeen and eighteen and also certifying that said institution has
45 adopted a disciplinary policy with regard to the organizers and participants
of hazing, and that such policy has been set forth with appropriate emphasis
in the student handbook or similar means of communicating the institution’s
policies to its Students. The board of higher education and, in the case of
secondary institutions, the board of education shall promulgate regulations
governing the content and frequency of such reports, and shall forthwith
report to the attorney general any such institution which fails to make such
report.

[email protected] VII. HEALTH SERVICES 46 A. The Health Office is staffed daily by a Registered Nurse. The school nurse is
available to do the following: 1. Provide first aid and illness assessment. 2. Provide initial emergency care. 3. Administer medications. 4. Perform treatments and procedures. 5. Administer the fluoride mouth-rinse program. 6. Perform mandated screenings. 7. Provide immunizations. 8. Act as a health resource for Students, Parents, and Staff. 9. Maintain the health records, which include at a minimum medical history,
immunizations, physical examinations, screening results, and emergency
information. B. The school nurse also helps to identify health care and social needs,
makes appropriate referrals, attends IEP and 504 meetings if a health issue
is involved, and serves on committees. C. When Should Your Child Stay Home From School? 1. If your child has a fever of 100 degrees or higher, please keep your
child home for 24 hours after the fever is down. 2. If your child is experiencing vomiting and/or diarrhea he/she should
be kept at home until symptoms have resolved for at least 12 hours and
he/she is able to keep down food and liquid. 3. If the white part of your child’s eye appears red and you notice a green
or yellow discharge from the eye, call your health care provider. Your child may
have conjunctivitis (“pink eye”), a common but contagious eye infection. Your child
may need antibiotic eye ointment which will need to be used for 24 hours before
he/she can return to school. 47 4. If your child has an unusual rash or a rash associated with a fever, have
your child evaluated by your health care provider. A rash may be a sign of a bacterial
or viral illness, an allergic reaction to a medication, food, or something in the
environment (plants, chemicals, detergents). 5. If your child has a contagious illness such as strep throat, flu, or
chicken pox. 6. If your child has head lice or nits. In this case the child needs to be
treated at home and seen by the school nurse before returning to class. 7. If your child has a persistent cough, which is not improving, we

that states that immunizations conflict with religious beliefs or that there
is a medical contraindication. The school nurse can provide you with the
appropriate forms to complete. F. Parent/Guardian Responsibilities: 1. If your child is sick or has an accident of sufficient seriousness to
warrant it, the school will get in touch with the Parent/Guardian to take
the child home and arrange for needed medical attention. 2. If your child will be absent, it is required by law that you call the school. 3. Please notify the school nurse if there are any changes in your child’s
health, if your child will be out of school for an extended period of time, or if your
child has a contagious disease (we may need to take precautions to protect the
health of others). 4. Please complete and return the Annual Medical Update/Emergency form
that is sent home at the beginning of each school year. It is extremely important that
this form be completed fully and returned to the school nurse. This information is
essential to the nurse so that she has an accurate and current picture of your child’s
health status and so that she can also contact you or your designee in the event that
your child is ill or injured. 49 G. Medication Policy 1. Prescription medications can be given during school hours if the
school nurse has a health care provider’s order and a signed parental
permission form. Please ask the school nurse for the appropriate forms. 2. Medication must be delivered to the school in a pharmacy- or
manufacturer- labeled container by a Parent, Guardian, or a responsible adult.
Students are not allowed to bring medication to school. 3. All medications are to be kept in the nurse’s office unless a Student is
authorized to “self-administer” and carry medication on his person. 4. In order for a Student to “self-administer” medication at school the
following conditions must be met: a. The health care provider provides written permission. b. The Parent/Guardian signs a consent form. c. The nurse agrees that it is safe for the Student to self-administer. The final
decision rests with the nurse. Student Health Exams In accordance with M.G.L. c.71, s. 57 and regulations thereunder, every student in
the Mohawk Trail Regional School District (MTRSD) will be screened to identify
potential health concerns, as below. Evidence or certifications required under these
provisions shall be provided by parents or guardians to the child’s school Principal
or the Principal’s designee. Physical Examinations The parent or guardian of each child enrolled in the District shall present
certification that the child has passed a physical examination performed by a
licensed physician or primary care provider. Such examinations must be performed
not more than 12 months prior to the child’s entrance into the following grades: • Pre-school (annually) 50 • Kindergarten • Grade 4 • Grade 7 • Grade 10 In addition, physical examinations are required: • For athletes in grades 7-12, annually before participating in competitive sports
(including practice). • For transfer students who do not have an adequate medical transcript from their
previous school. • For children referred to the School Nurse because of frequent absences because of
unexplained illnesses. • For children referred to the School Nurse because of known physical conditions
that require repeated appraisal. • For children referred to the School Nurse as a result of a teacher/nurse conference
because the child is not making expected progress in school or because of signs of
illness noted by the teacher or nurse. • For children under 16 and over 14 years of age requesting employment
certificates. The School Committee encourages parents/guardians to have the required physical
exams performed by the child’s primary care provider. For students who do not
have access to a private primary care provider, examinations may be made by the
school physician who is appointed on an annual basis by the School Committee. Vision and Hearing Screenings Within MTRSD, the vision of each student shall be tested by the appropriate District
School Nurse using the Massachusetts Vision Test or other comparable method
approved by the Massachusetts Department of Public Health. Such screenings shall
occur: • In the year of preschool entry; • Annually in grades K – 7; • Grade 10. In addition, a stereopsis screening will be conducted annually for students in Grades
PK-3, if not completed by the student’s primary care physician. Within MTRSD, the hearing of each student shall be tested by the appropriate
District School Nurse using some form of discrete frequency hearing test, such as the
Massachusetts Hearing Test or comparable method approved by the Massachusetts
Department of Public Health. Such screenings shall occur: • In the year of school entry, including preschool and kindergarten; • Annually through grade 7; 51 • Grade 10. With respect to any student who does not pass a vision or hearing screening, a
referral letter will be sent to that student’s parent or guardian for appropriate
follow-up. With consent of the parent or legal guardian, the student’s primary care
physician may be furnished with a copy of the record of screening tests performed
in the school. It is the responsibility of the District School Nurse to obtain the
referral information from the student’s parents. Growth and Development Screenings Within MTRSD, the height and weight of each student will be ascertained by the
appropriate District School Nurse in accordance with guidelines of the
Massachusetts Department of Public Health: • In the year of school entry, including preschool and kindergarten; • Annually through grade 7; • Grade 10. Every reasonable effort will be made to provide prior notice of the screening and
information regarding the benefits of such screening to each child’s parent or legal
guardian. Within MTRSD, the appropriate District School Nurse will calculate each student’s
BMI (Body Mass Index) in the following grades: • Grade 1 • Grade 4 • Grade 7 • Grade 10 Every reasonable effort will be made to provide prior notice of the screening to each
child’s parent or legal guardian, who may request, in writing, that their child not
participate in this screening. The BMI and comparison percentile will be reported directly and confidentially to
each student’s parent or legal guardian, along with informational and explanatory
materials provided or approved by the Massachusetts Department of Public Health
on BMI and the importance of healthy eating and adequate physical activity. A copy
of the student’s BMI score shall be maintained in the student’s school health record.
With the consent of the parent or legal guardian, a copy shall be provided to the
student’s primary care provider. It is the responsibility of the District School Nurse
to obtain the referral information from the student’s parents. The Massachusetts
Department of Public Health shall be provided annually with student BMI by the
District Nurse Leader as specified in guidelines of the Department. 52 LEGAL REF: M.G.L. c. 71, s. 57 1. Physical exam forms are available from the school nurse. 2. Students without complete documentation of the required immunizations
and physical exam will be excluded from school. H. School Health Insurance 1. Lefebvere Insurance, Inc. provides school insurance. Information is sent
home at the beginning of the school year. VIII.
SAFE STUDENT TRANSPORTATION POLICY AND PROCEDURES
A. The School Committees of these two districts will send
representatives to a Joint Transportation Committee, which will be
responsible for contracting for transportation services, and examining and
making recommendations relative to transportation. Management of
transportation services will be handled through the office of the
Superintendent by the Director of Transportation. The above listed school
districts have the responsibility to provide eligible K-12 Students with safe
and efficient transportation. Parents have the responsibility to help Students
get to bus stops.
B. Routing and Location of Bus Stops
1. Bus routes will be established with consideration given
to the concentration of Students, the road conditions, location of
schools, safety and economy of operation, and so that Students are
transported in the most efficient manner. Elementary Students will
ride the bus no longer than one hour. High School Students will ride
no longer than 1-¼ hours. Within these parameters, each district has
the right to establish “not to exceed” time on bus as long as any
changes do not adversely impact the other two districts without
approval from the affected districts(s). All bus routes will follow
public roads.
2. The Districts will comply with all applicable state laws
for minimal standards of service. Students living more than one and
one-half miles from a schoolhouse, as measured by commonly
traveled roads, will be provided service. The Districts have the right
to establish bus stops up to 1 mile from a Student’s residence.
53 3. In some cases, Parents may be contracted with to
provide transportation.
4. Students will ride their assigned bus unless they
provide parental/guardian permission slips to the school office to ride
a different bus. They may only ride another bus when seats are
available. Students may not stand on the bus.
C. Due Process
1. Parents/Guardians/Students
dissatisfied
with
transportation service may appeal to the Director of Transportation.
If still dissatisfied, Parents/Guardians/Students may appeal to the
Superintendent of Schools. Finally, if the concern stems from school
district policy, further appeal may be made to the appropriate school
district Transportation Subcommittee. Or, if the concern stems from
the three-district policy, further appeal may be made to the
Three-District Transportation Subcommittee.
D. Student Conduct
1. Parents and Students will sign an annual agreement
regarding rules for bus riding, which will be kept on file in the schools.
The text of this agreement also will be provided in the student
handbook.
E. Special Needs Transportation
1. Children with special needs will be transported on
separate vehicles in accordance with their Individualized Education
Plan when special transportation requirements are specified in the
IEP.
F. Service on Major Highways
1. When embarking or disembarking from a bus on a state
highway or other heavily traveled road, elementary Students will be
not required to cross the road.
G. Time of Arrival
1. Bus transportation will be arranged so that Students
arrive in time for school. Each district has the right to establish time
of arrivals and/or start times of school as long as any changes do not
54 adversely impact the other two districts without prior approval from
the affected district(s). However, supervision is not provided for
Students until fifteen minutes before the start of school. Elementary
Students should not arrive earlier than fifteen minutes before the
start of school unless enrolled in a before school program.
H. Transportation of Students Off-Campus
1. Students participating in off campus curricular and
extracurricular activities under the direction and supervision of
school personnel shall be transported to and from such activities by
vehicles operating under contract with School Committees or by
volunteers.
I. Transportation of Choice Students
1. Each School Committee will be responsible for
formulating and administering its policy regarding access of
transportation to choice Students. Consideration will be given with
the following provisions:
a. there must be sufficient room
b. it will not cause a bus to deviate from its existing route
c. it does not result in additional cost to the District.

1. Bus operators are in charge of the bus and the
passengers. They are responsible for the safety of the pupils and for
their conduct on the bus. Riding the bus is a privilege that can be
denied temporarily or permanently, if a pupil’s behavior warrants it.
55 The operator reports to the bus company all violations of rules, and a
pupil may become ineligible for transportation if his/her behavior
creates a problem on the school bus. It is necessary for Students to
observe the following rules:
a. Be at the stopping places on time and ready to get into the bus with the
least possible delay, in order to keep the bus on schedule.
b. Do not stand or play in the roadway while waiting for the bus.
c. Remain at least five feet from the bus when it stops to pick up, and move
toward the bus only when the door opens.
d. Students having to cross the road when boarding or leaving are to cross
in front of the bus, NOT IN THE REAR, upon the driver’s signal. All
Students are to use extreme caution by looking at traffic both ways before
crossing the road.
e. After boarding the bus, take a seat as quickly as possible. The driver may
assign you a specific seat.
f. No students will be allowed to board or leave the bus at any other place
other than their regular stop without written consent from their
Parent(s). Students 18 years of age or older may write their own note,
but need all notes signed by authorized school staff.
g. All Elementary school Students must provide the driver with written
authorization in order to ride any bus other than that to which regularly
assigned. Students 18 years of age or older may write their own note, but
need all notes signed by authorized school staff.
h. Obey the bus driver at all times while under his/her supervision.
i. Do not bring animals, firearms, explosives or any dangerous objects on
the bus.
j. Maintain an acceptable manner of conduct at all times. Smoking,
vulgarity, and loud, boisterous or other improper conduct will not be
permitted.
k. Remain seated while the bus is in motion.
l. Do not extend arms or head out of the bus windows at any time.
m. Keep aisles clear of lunch boxes, musical instruments, books, etc.
56 n. Assist the bus driver in keeping the bus clean by not eating or drinking
while on the bus.
o. Remain absolutely quiet when approaching a railroad crossing.
p. Do not play any electronic devices without headphones while on the bus.
q. Do not tamper with operating mechanisms on the emergency door.
r. Do not operate the service (front) door; this is the responsibility of the
driver.
s. Do not damage or deface any part of the bus. Parents can be held
responsible for the cost of the repairs.
K. School Bus Safety Rules and Procedures
1. Use crosswalks if they are available.
2. When walking on the road, walk on the left side of the
road (so that you will face the oncoming traffic).
3. Remain seated if the bus is delayed on the road.
4. Use emergency door only if there is an emergency.
5. Be helpful and of assistance to children who are smaller
than you.
6. When you leave the bus, do not stop in the roadway,
and NEVER try to pick up anything that is under the bus.
7. Go home promptly after you leave the bus.
L. Warning Ticket System (Note: This system is in addition to any other
disciplinary consequences contained in the student handbook.)
1. 1st Ticket – Warning.
2. 2nd Ticket – Riding privilege suspended for three
school days.
3. 3rd Ticket – Riding privilege suspended for five school
days.
57 4. 4th Ticket – Riding privilege suspended indefinitely.
5. If it is deemed necessary by the Superintendent of
Schools, riding privileges may be suspended without using the above
system.
6. If a ticket is issued, the Student must do the following in
order to ride on the bus:
a. Have the ticket signed by the Parent(s)
b. Give the signed ticket to the bus driver.
1) If a warning, the next morning
2) If a suspension, on the morning riding privileges are reinstated (note
date on the ticket)
c. If the ticket has not been signed, the Student’s first attempt to ride the bus
will be allowed, however, the Student will be brought to the Principal’s
office for Parent notification. If the Student does not return the signed
ticked the following school day, the Student will not be allowed to ride
the bus.
d. If a Student refuses a ticket(s) she/he must report to the Principal or the
bus company for a new one before she/he will be allowed to ride the bus
again.
e. If a Student rips up, loses, or in any way destroys a ticket issued to
him/her, she/he must report to the Principal or the bus company for a
new one before she/he will be allowed to ride the bus again.
f. A Parent or Student may appeal to the school Administration for a
hearing if they have any questions.
IX.
SPECIAL EDUCATION: IDEA
A. The Individuals with Disabilities Education Act (IDEA). The
Individuals with Disabilities Education Act (IDEA) is a federal law ensuring
services to children with disabilities throughout the nation. IDEA governs
how states and public agencies provide early intervention, special education
and related services to eligible infants, toddlers, children and youth with
disabilities. Infants and toddlers with disabilities (birth-2) and their families
receive early intervention services under IDEA Part C. Children and youth
58 (ages 3-21) receive special education and related services under IDEA Part B.
The school(s) in the Districts have programs for children ranging from those
who need a minimum of support services to those who require the full-time
service of a special needs teacher. For further information, please contact the
school Principal or the school system’s Director of Pupil Services at
625-0192.
B. Discipline for Students with an Individual Education Plan (IEP)
1. The Individual Education Plan (IEP) for every Student
with special needs will indicate whether the Student can be expected
to meet the regular discipline code or if a modification is required. If a
modified discipline code is required, it will be written into the IEP.
C. Suspension of Special Education Students
1.
Students are expected to meet the requirements for behavior as set forth
in this handbook. Chapter 71B of the Massachusetts General Laws requires that
additional provisions be made for Students who have been found by an
evaluation team to have special needs and those whose program described in an
Individual Education Plan (IEP).
2.
The following additional requirements apply to the discipline of special
needs Students:
a. The IEP for every special needs Student will indicate whether the Student
can be expected to meet the regular discipline code or if the Student’s
handicapping condition requires modification. Any modification will be
described in the IEP.
b. The Principal (or designee) will notify the Special Education Office of the
suspendable offense of a special needs Student and a record will be kept
of such notices.
c. When it is known that the suspension(s) of a special needs Student will
accumulate to ten days in a school year, a review of the IEP will be held to
determine the appropriateness of the Student’s placement or program.
The team will make a finding, Manifestation Determination, as to the
relationship between the Student’s misconduct and his/her handicapping
condition and either:
1) Design a modified program for the Student, or;
59 2) Write an amendment to provide for the delivery of special education
services during the suspension and any needed modification of the
IEP, relative to discipline code expectations.
X.
NON-DISCRIMINATION POLICY
A. Public schools have the responsibility to overcome, insofar as
possible, any barriers that prevent children from achieving their potential.
The public school system will do its part. The School Committee is
committed to the following:
1.
Promoting the rights and responsibilities of all individuals as set forth in
the State and Federal Constitutions, pertinent legislation and applicable judicial
interpretations.
2.
Encouraging positive experiences in human values for children, youth
and adults, all of whom have differing personal and family characteristics and
who come from various socioeconomic, racial and ethnic groups.
3.
Working towards a more integrated society, and to enlist the support of
individuals as well as groups and agencies, both private and governmental, in
such an effort.
4.
Using all appropriate communication and action techniques to air and
reduce the grievances of individuals and groups.
5.
Carefully consideration, in all the decisions made within the school
system, the potential benefits or adverse consequences that those decisions
might have on the human relations aspect of all segments of society.
6.
Initiating a process of reviewing policies and practices of the school
system in order to achieve to the greatest extent possible the objectives of this
statement.
B. The School Committee’s policy of non-discrimination will extend to
Students, Staff, the general public and individuals with whom it does
business; No person shall be excluded from or discriminated against in
admission to a public school of any town or in obtaining the advantages,
privileges and courses of study of such public school on account of race,
color, sex, gender identity, religion, national origin, sexual orientation or
disability. If someone has a complaint or feels that they have been
discriminated against because of their race, color, sex, gender identity,
religion, national origin, sexual orientation or disability, their complaint
should be registered (using the attached form) with the Title IX compliance
officer in the office of the Director of Pupil Personnel Services.

NONDISCRIMINATION ON THE BASIS OF SEX
The School Committee, in accordance with Title IX of the Education Amendments of
1972, is committed to safeguarding the right of all persons associated with the
District, including students, employees, School Committee members and volunteers
to work in an educational environment that is free from all forms of sex
discrimination. The School District does not and will not discriminate on the basis
of sex and condemns and prohibits all forms of sex discrimination on its premises,
or in connection with any educational programs wherever they may occur. The School Committee will continue to ensure fair and equitable educational and
employment opportunities, without regard to sex, to all of its students and
employees. The Committee shall designate an individual to act as the school system's Title IX
compliance officer. All students and employees will be notified of the name and
office address and telephone number of the compliance officer. XII.
POLICY ON SEXUAL HARASSMENT FOR STUDENTS
A. PURPOSE
To create for all Students of the Mohawk Trail Regional District and Hawlemont
Regional District a study environment free of sexual harassment. The Mohawk Trail Regional District and Hawlemont Regional District are committed
to safeguarding the right of all persons associated with the Districts’ schools,
including Students, employees, School Committee members and volunteers to a
work and educational environment that is free from all forms of sexual harassment.
Therefore, the Mohawk Trail Regional District and Hawlemont Regional District
condemn and prohibit all sexual harassment on its premises. 62 All individuals associated with the Districts, but not necessarily limited to the School
Committees, the Administration, the Staff, Students and members of the public while
on campus, are expected to conduct themselves at all times so as to provide an
atmosphere free from sexual harassment. Any person who engages in sexual
harassment while acting as a member of the school community or while on school
property will be in violation of this policy. Appropriate disciplinary action, up to and including dismissal, will be taken in any
instance where an employee violates this policy. Sexual harassment by a Student
will result in disciplinary action up to and including expulsion. Sexual harassment
by others will result in their being excluded from School premises or if it is required
that they enter the premises, they will be accompanied by a School District
representative at all times. If the sexual harassment is criminal in nature, the offense shall be reported to the
police department as well as the Title IX Coordinator. If the sexual harassment
requires the intervention of State social service or protective agencies, the proper
authorities will be contacted. In these circumstances, the School’s attorney will be
immediately contacted to give advice and guidance on how to process these actions
with the appropriate authorities. Any Student who believes that he or she has been subjected to sexual harassment
should make a complaint to any administrator, the Title IX Coordinator, or directly
to the Superintendent, so that appropriate action may be taken at once. Management representatives are charged with the responsibility of discouraging
any sexually harassing behaviors within or outside of their areas of supervision.
This includes directly confronting the harasser when a management representative
observes harassing behavior, and immediately reporting the activity to the Title IX
Coordinator. The Title IX Coordinator will investigate complaints promptly, and corrective action
will be taken where appropriate. No person will suffer retaliation or intimidation as
a result of using the internal complaint procedure. A copy of this policy and its accompanying regulations are posted in appropriate

Title IX of 1972 Education Amendments B. SEXUAL HARASSMENT DEFINITION
Sexual harassment consists of unwelcome sexual advances, requests for sexual
favors and other verbal or physical conduct of a sexual nature where: 1. Submission to such conduct is either explicitly or implicitly made a term or
condition of a Student’s education; or
2. Submission to or rejection of such conduct is used as a basis for education
decisions affecting such Student; or
3. Such conduct has the purpose or effect of substantially interfering with a
Student’s educational performance, or creating an intimidating, hostile or
offensive educational environment.
Sexual harassment may include, but is not limited to: 1. Assault, inappropriate touching, intentionally impeding movement,
comments, gestures, or written communications of a suggestive or
derogatory nature.
2. Continuing to express sexual interest after being informed that the interest is
unwelcome. (Reciprocal attraction between peers is not considered sexual
harassment.)
3. Implying or actually withholding grades earned or deserved, suggesting that
a poor performance evaluation will be prepared, or suggesting that a
scholarship recommendation or college application will be denied.
4. Coercive sexual behavior used to control, influence or affect the educational
opportunities, grades and/or the learning environment of a Student.
5. Offering or granting favors or educational benefits, such as grades or
recommendations, in exchange for sexual favors.
Other sexual harassing behavior directed towards Students, whether committed by
management, Staff, or Students, is also prohibited. Such conduct includes but is not
limited to: 64 1. Unwelcome sexual flirtations, advances or propositions;
2. Sexually explicit language or gestures;
3. Touching that an individual interprets as sexual in nature;
4. Any unwelcome physical contact;
5. The presence of sexually provocative photographs, pictures or other
material, and the telling of sexual stories or jokes;
6. Verbal or non-verbal behavior about an individual’s body that is interpreted
as sexual in nature.
C. COMPLAINT PROCEDURE
1. INFORMAL PROCESS FOR STUDENTS
In determining whether an alleged incident constitutes sexual harassment, the Title
IX Coordinator will be vested with the authority and responsibility of processing all
sexual harassment complaints in accordance with the procedure outlined below,
unless the Title IX Coordinator is the subject of the complaint. a. Any Student of the District who believes that he/she has been subjected
to sexual harassment is to report the incident(s) to any administrator,
Title IX Coordinator, or directly to the Superintendent. The administrator
and/or Superintendent are to immediately contact the Title IX
Coordinator. A written record of the complaint will be made by the party
receiving the complaint. A separate file system will be maintained, apart
from the Student’s personal record, regarding these complaints and as to
all matters relating to the complaints.
b. If the alleged harassment involves the Title IX Coordinator, the
Superintendent of Schools will act as the Title IX Coordinator.
c. If the alleged harassment involves the Superintendent of Schools, the
Secretary of the School Committee will act as the Title IX Coordinator.
d. The Superintendent and the Title IX Coordinator will look at the totality
of the circumstances and the context in which the alleged incidents
occurred. They will attempt to resolve the problem by conferring with
both parties in order to obtain a clear understanding of the facts. All
matters involving sexual harassment complaints will remain confidential
to the extent possible.
65 e. Students may be accompanied, at any phase of this process or subsequent
hearing before the Committee, by a Parent, Guardian or representative of
their choosing. Parents will be immediately notified by the Title IX
Coordinator of the existence of a Student’s report of sexual harassment.
f. The Title IX Coordinator will explain each phase of the Informal and
Formal Complaint Process to a Student who wishes to file a complaint
and will assist the Student in the processing of the complaint. In addition,
the Title IX Coordinator will inform the Student of additional forums for
resolution of the complaint such as the Office of Civil Rights (O.C.R.) and
the Massachusetts Commission Against Discrimination (M.C.A.D.).
g. Under normal circumstances, the Title IX Coordinator’s investigation will
be completed within five working days of the initial complaint. Upon
completion of the investigation, the Title IX Coordinator shall issue
his/her findings in writing to the Student and the alleged harasser.
D. COMPLAINT PROCEDURE
1. FORMAL PROCESS FOR STUDENTS
a. A complainant may file a formal complaint immediately or may do so
after the Superintendent’s and the Title IX Coordinator’s efforts to reach a
settlement under the informal process have proven unsuccessful.
b. The complaint will state clearly and concisely the complainant’s
description of the incident and it will also indicate any remedy sought.
The complaint must be signed by the complainant. The Superintendent’s
office will send the respondent a copy of the complaint within five
working days after it is received. A separate file system shall be
maintained as to all matters relating to the complaint. Confidentiality
shall be maintained to the extent possible.
c. The respondent will have ten working days to respond in writing. This
statement will contain full and specific references to each claim in the
complaint, admitting, denying or explaining the complainant’s allegations.
The respondent must sign his or her statement which will then be
appended to the original complaint. Within three working days, the
Superintendent’s office will forward both statements to the complainant
and the respondent.
d. There will be two modes of resolution for formal complaints. A complaint
may be settled through mediation or through a hearing. If the
complainant and respondent agree to pursue mediation, a date mutually
acceptable to both parties will be set within ten working days. If the
66 mediation results in a mutually acceptable agreement, copies of the
agreement will be forwarded to both parties. If the mediation does not
result in an agreement, the case will be forwarded to the Superintendent
for a hearing unless the Superintendent is the alleged harasser in which
case the hearing will be before the Pittsfield School Committee.
e. When a hearing is requested, the Title IX Coordinator will inform the
Superintendent or the School Committee, as the case may be, and the case
will be heard at the next regularly scheduled meeting of the School
Committee pursuant to the provisions of the Commonwealth’s Open
Meeting Law and/or before the Superintendent pursuant to M.G.L., c. 71,
§ 42.
E. FORMAL HEARING
1. The purpose of the Superintendent or School Committee Hearing is to
determine whether the school system’s policy on sexual harassment has
been violated, and, if so, to determine the appropriate consequences for the
violation.
2. Both parties will be given a full and fair hearing. The proceeding, although
formal, is not a court proceeding and the Superintendent or School
Committee is not bound by the procedures and rules of evidence of a court of
law. In most instances, complainants and respondents will be expected to
speak for themselves, although, if desired, each party may be accompanied by
counsel or an advocate.
3. The presiding officer of the hearing may have counsel present for purposes of
assisting in the orderly conduct of the hearing and the questioning of
witnesses. The complainant and the respondent will be asked to clarify the
issues and to define the areas of disagreement. To encourage a fair and
focused hearing, at the start of the proceedings the points of agreement and
disagreement will be reviewed. The Superintendent or the Committee, as the
case may be, will hear testimony and consider whether the School Committee
Policy on Sexual Harassment has been violated, and, if so, will recommend
appropriate consequences.
4. The presiding officer will:
a. ensure an orderly presentation of all evidence;
b. ensure that the proceedings are accurately recorded by means of a
tape or stenographic recording; and
67 c. see that a decision is issued no later than ten working days after the
conclusion of the hearing or, when written arguments are submitted,
ten working days after their submission.
5. The Superintendent or the Committee, as the case may be, will:
a. conduct a fair and impartial hearing which ensures the rights of all
parties involved;
b. define issues of contention;
c. receive and consider all relevant evidence which reasonable people
customarily rely upon in the conduct of serious business;
d. ask relevant questions of the complainant, respondent, and any
witnesses if needed to elicit information which may be of assistance in
making a decision; and
e. ensure that the complainant and respondent have full opportunity to
present their claims orally or in writing, and to present witnesses and
evidence which may establish their claims.
F. DECISION OF THE SUPERINTENDENT OR THE COMMITTEE
1. After all the evidence, testimony, and written arguments have been
presented, the committee will convene for deliberations to determine
whether the school system’s policy on sexual harassment has been violated.
If the Committee finds after a roll call vote that the policy has not been
violated, that fact will be registered in the records of the hearing, and the
written decision will be forwarded to the complainant and the respondent no
later than fifteen working days after completion of the hearing.
In hearings before the Superintendent, if the Superintendent finds that the
policy has not been violated, the Superintendent will issue a written decision
to the complainant and the respondent no later than fifteen working days
after the completion of the hearing. 2. If the Committee finds after a roll call vote that the charge of violating the
school system’s policy on sexual harassment has been substantiated, the
hearing Committee will prepare findings and will determine a penalty for the
respondent and relief for the complainant. The Committee will issue such
decision to the complainant and the respondent no later than fifteen working
days after the completion of the hearing.
68 In hearings before the Superintendent, if the Superintendent finds that the
charge of violating the school system’s policy on sexual harassment has been
substantiated, the Superintendent will prepare findings and will determine a
penalty for the respondent and relief for the complainant.
The
Superintendent will issue such decision to the complainant and the
respondent no later than fifteen working days after the completion of the
hearing. The findings of fact as well as the penalty and relief will be based solely on
the testimony and evidence presented at the hearing. 3. The penalty should reflect the severity of the harassment. The penalties may
include, but will not be limited to, any one or combination of the following:
verbal admonition, written warning placed in the respondent’s personnel file
or student record, probation, suspension without pay, dismissal, demotion,
or removal from administrative duties within a department; Students may be
subject to suspension or expulsion proceedings following a finding that the
policy has been violated. The Committee or Superintendent may also make
appropriate recommendations, such as professional counseling, and may
recommend relief for the complainant which reinstates and restores, as
much as possible, the aggrieved party.
XIII.
PROHIBITION OF TOBACCO ON SCHOOL PROPERTY
A.
Smoking and the use of tobacco products by Students, Staff,
volunteers and visitors are prohibited on all school property at all times in
accordance with Massachusetts General Laws Chapter 71, section 37H, effective
June 4, 1993. District policy prohibits Student possession of tobacco products or
paraphernalia on school property and at school sponsored trips or events.
School property includes school buildings, school facilities, school grounds,
school parking lots and school buses, any property controlled by the School
Committees.
XIV.
DANGEROUS WEAPONS ON SCHOOL PROPERTY
1. In accordance with M.G.L. Chapter 71, Section 37H of the Education Reform
Act of 1993, it is the policy of the Mohawk Trail Regional School District and
the Hawlemont Regional School District to prohibit the possession of or use
of firearms on school property including school buses or at school sponsored
or school related events, including athletic games, at any time.
2. Any Student who is determined to have brought a firearm to school will
automatically be expelled for a minimum of one year subject to modification
by the Superintendent on a case-by-case basis. The Student will also be
referred to the Police Department for further action.
69 3. Other dangerous weapons such as knives or other objects that can be
construed as a weapon are not permitted. Any dangerous weapon found in
the possession of a Student will be confiscated.
4. Any Student who in the judgment of the Principal, as verified by due process,
is determined to be in violation of this policy shall be suspended from
attendance (out of school) and in the discretion of the Principal, may be
referred for an expulsion hearing according to M.G.L. Chapter 71, Section
37H.
XV.
NON-CUSTODIAL PARENT POLICY
A. A non-custodial Parent who wishes to receive information concerning
his/her child, including but not limited to progress reports, the results of
testing, notification of a referral for a special needs assessment, notification
of enrollment in a transitional bilingual program, absences, illnesses,
detentions, suspensions, expulsions, withdrawal from school, must submit a
written request to the school Principal.
Upon receipt of the above, the school shall immediately notify the custodial Parent
of the request by registered and first class mail. The notice shall inform the
custodial Parent that the information requested shall be provided to the
non-custodial Parent after 21 days unless the school receives evidence thatthe
parent has been denied legal custody or has been ordered to supervised visitation,
based on a threat to the safety of the student and the threat is specifically noted in
the order pertaining to custody or supervised visitation, or the parent has been
denied visitation, or the parent's access to the student has been restricted by a
temporary or permanent protective order, unless the protective order (or any
subsequent order modifying the protective order) specifically allows access to the
information contained in the student record, or there is an order of a probate and
family court judge which prohibits the distribution of student records to the parent. B. At any time the school is presented with a court order which prohibits
the distribution of information to the non-custodial Parent, the school shall
notify the non-custodial Parent that provisions of the information shall cease.
C. The information provided to the non-custodial Parent shall be marked
to indicate that it may not be used to support admission of the child to
another school.
D. The above information shall be provided in a timely and appropriate
manner to all Parents of children enrolled in school.
M.G.L. c. 71, Sec. 34H 70 XVI.
POLICY ON PUBLIC COMPLAINTS
A. Although no member of the community will be denied the right to
bring complaints to the School Committee, they will be referred through the
proper administrative channels for solution before investigation or action by
the committee. Exceptions will be made when the complaints concern School
Committee actions or School Committee operations only. The School
Committee believes that the complaints are best handled and resolved as
close to their origin as possible, and that the professional Staff should be
given every opportunity to consider the issues and attempt to resolve the
problem prior to involvement by the committee. Therefore, the proper
channeling of complaints involving instruction, discipline or learning
materials will be as follows:
1. Teacher
2. School building administrator
3. Superintendent
4. School Committee
B. Any complaint having to do with the condition of the school facilities
will be first presented to the Principal.
C. If a complaint, which was presented to the School Committee and
referred back through the proper channels, is resolved, a report of the
disposition of the matter will be made to the School Committee and then
placed in the official files.
D. Matters referred to the Superintendent and/or School Committees
must be in writing and should be specific in terms of action desired.
E. The School Committees expects the professional Staff to receive
complaints courteously and to make a proper reply to the complainant. No
employee of the School Committee shall take any retaliatory action or allow
any such action to be taken in response to complaints or concerns raised by
parents.
XVII.
PUBLIC COMPLAINTS ABOUT SCHOOL PERSONNEL
A. Complaints about school personnel will be investigated fully and
fairly. However, before any such complaint is investigated, the complainant
should submit his/her complaint in writing.
71 B. Whenever a complaint is made directly to the School Committee as a
whole or to a committee member as an individual, it will be referred to the
school Administration for review and possible resolution.
C. The Superintendent will develop procedures that assure prompt and
fair attention to complaints against school personnel. The procedures will
require that an employee who is the object of a complaint be informed within
a reasonable time period and be afforded the opportunity to present the facts
as (s)he sees them.
D. If it appears necessary, the Administration, the person who made the
complaint, or the employee involved may request an executive session of the
School Committee for a formal hearing. Statutory restrictions on executive
session will be observed.
E. The School Committee may hear the complaint, however, under the
Education Reform Act of 1993, personnel actions may only be taken by
school administration unless the position is directly hired by the School
Committee.

COMMUNITY USE OF SCHOOL FACILITIES
A. The policy of the Mohawk Trail Regional School District and the
Hawlemont Regional School District is to make its facilities and resources
available to the community. Community groups will make application for use
of facilities to the School Principal. The BUILDING RENTAL
APPLICATION/CONTRACT FOR SCHOOL FACILITIES form is available in the
school office. In scheduling use of facilities, school-sponsored activities have
priority over non-school-sponsored functions.
B. Groups using school facilities must comply with the use regulations
(KF-R) and pay any applicable rental fees. Groups wishing to use school
facilities on a regular and sustained basis may negotiate a separate
agreement with the Superintendent.
XIX. STUDENT RECORDS A. Parents and Students are guaranteed the right to inspect, as well as,
seek addition to or deletion from all records, which are kept or requested to
be kept by the School Department, concerning individual Students. The
records include the Student’s transcript and any other recorded information,
72 which is identified by the Student’s name. A signed log is kept in each
cumulative record for all Students.
B. Pursuant to M.G.L. c.71, §§ 34D & 34F, and the regulations
promulgated there under, no third party, other than authorized school or
Department of Elementary and Secondary Education personnel, shall have
access to information in or from a Student record without the specific
informed written consent of the eligible Student or the Parent.
C. Upon receipt of a court order or lawfully issued subpoena, or upon
receipt of a request from a Court or the Department of Youth Services for
information regarding a Student, the school, prior to compliance, shall notify
the eligible Student or Parent of the order, subpoena or request in such
reasonable time that he/she may seek to have the process quashed.
D. Except for certain limited and specifically defined individuals, i.e.,
certain court officers, health officials and authorized school personnel, no
individual or agency may have access to school records of the Student(s)
without “the specific informed written consent” of the Student or his/her
Parent. This means that if a Parent or Student wishes transcripts or records
forwarded to school, colleges, or prospective employers, a written release
must be delivered to the Principal of the school or appropriate custodian of
the Student’s school records.
E. In case of a Student 14 through 17 years of age, or of one who has
entered the ninth grade, both the Student and his/her Parents, or either one
acting separately, shall exercise these rights. Any Student 18 years of age or
older may exercise these right alone.
F. Schools may release for publication a Student’s name, class,
information about participation in officially recognized activities and sports,
honors, awards, and post-high school plans.
G. Complete copies of the state regulations concerning Parents’ and
Students’ rights to records may be obtained in the building Principal’s office.
XX. EMERGENCY CLOSINGS
A. The Superintendent or his designee may close the schools or dismiss
them early in the event of hazardous weather or other emergencies that
threaten the health or safety of Students and personnel. It may be prudent,
under certain circumstances, to excuse all Students from attending school, to
delay the opening hour or to dismiss Students early. The Superintendent has
the responsibility to see that as much administrative, supervisory and
73 operational activity is continued as may be possible. Therefore, if conditions
affect only a single school, only that school will be closed.
B. In making the decision to close schools, the Superintendent will
consider many factors, including the following principal ones relating to the
fundamental concern for the safety and health of the children:
1. Weather conditions, both existing and predicted
2. Driving, traffic and parking conditions affecting public and private
transportation facilities
3. Actual occurrence or imminent possibility of any emergency condition that
would make the operation of schools difficult or dangerous
4. Inability of teaching personnel to report for duty, which might result in
inadequate supervision of Students
C. The Superintendent or his designee will weigh these factors and take
action to close schools only after consultation with public works and public
safety authorities and with school officials from neighboring towns.
Students, Parents and Staff will be informed early in each school year of the
procedures that will be used to notify them in case of emergency closings.
When schools are closed for emergency reasons, Staff members will comply
with School Committee policy in reporting to work.
XXI.
NO IDLING POLICY
(MOTOR VEHICLE IDLING ON SCHOOL GROUNDS) A. No motor vehicle operator shall cause or allow any motor vehicle
operated by him or her on school grounds to idle unnecessarily, except for
any of the following reasons:
1. traffic conditions
2. queuing at a school for the purpose of picking up or discharging Students
3. turbo-charged diesel engine cool down or warm up
4. maintenance of appropriate temperature for school buses when
accepting or discharging passengers not to exceed three minutes in any
fifteen minute period or one minute in any fifteen minute period for other
motor vehicles
74 5. for circumstances involving safety or emergencies and for servicing or
repairing motor vehicles
6. and as these exceptions are more completely described in the below
referenced regulations.
B. The term “school grounds” shall mean in, on or within 100 feet of the
real property of the school whether or not it is in session, and shall include
any athletic field or facility and any playground used for school purposes or
functions which is owned by the municipality or school district, regardless of
proximity to a school building, as well as any parking lot appurtenant to such
school athletic field, facility or playground.
C. Reasonable efforts shall be made by the Districts to identify by
signage all known and actual air intake systems, which may be within 100
feet of an idling motor vehicle.
D. A motor vehicle operator shall not idle a motor within 100 feet of such
air intake system, unless the Mohawk Trail Regional School District and the
Hawlemont Regional School District have determined that alternative
locations block traffic, impair Student safety or are not cost effective.
LEGAL REF: M.G.L. 41:35 XXII. DRUG AND ALCOHOL POLICY
A. The Mohawk Trail Regional School District is committed to providing safe and
healthy school environments in which our students can learn. The use of drugs
and alcohol can negatively impact a student physically, emotionally, socially,
academically, and legally. Scientific studies have shown that drugs and alcohol
have particularly harmful effects on developing adolescent brains. Therefore, the
district provides drug and alcohol education as part of their comprehensive
health curriculum and has created this policy to define the district's position on
drugs and alcohol use on school grounds and at school-sponsored activities. The
regulations of the drug and alcohol policy provide written guidelines for
handling incidents of consumption, possession, and/or distribution of alcohol
and drugs.
B.
In accordance with M.G.L. c.71, Section 37H and c. 272, Section 40A, drug and
alcohol use
by students, staff and visitors is prohibited on all school properties at all times.
District policy prohibits any person from ingesting, possessing, being under the
influence of or distributing drugs and alcohol on school grounds or at school
sponsored functions at any time. Possession or distribution of drug
paraphernalia is also prohibited. School property includes school buildings,
75 school facilities, school grounds, school parking lots and school buses and any
property controlled by the school committee. C.
Definitions:
1. Ingestion - Ingestion is the eating, drinking, inhaling or absorbing of drugs or
alcohol into the body. Ingestion may or may not have occurred on school
property or at a school sponsored function.
2.
Possession - Possession is the unlawful custody of alcohol or a
controlled substance.
3. Distribution - Distribution is the unlawful transfer of alcohol or a controlled
substance from one person to another. The transfer does not require the
knowledge of the receiver nor does it require a transaction by sale.
4. Drugs - The term "drug(s)" as used in this policy includes any narcotic
substance, hallucinogenic substance, any substance taken for the purpose of
"getting high" or becoming intoxicated, and all chemical and controlled
substances as defined by state or Federal law, including, but not limited to
substances commonly known as marijuana, LSD, cocaine, crack, heroin,
amphetamine and methamphetamine, and barbiturates. The term "drug(s)"
also includes all prescription medicines, except when used or possessed in
accordance with the school medication administration policy.
XXIII. FAMILY EDUCATIONAL RIGHTS and PRIVACY ACT (FERPA) A. The Family Educational Rights and Privacy Act (FERPA), a Federal Law, requires
that Mohawk Trail Regional School, with certain exceptions, obtain your written
consent prior to the disclosure of personal identifiable information from your
child’s education records. However, Mohawk Trail Regional School may disclose
appropriately designated “directory information” without written consent,
unless you have advised the District to the contrary in accordance with District
procedures. The primary purpose of this directory information is to allow the
Mohawk District to include this type of information from your child’s education
records in certain publications. Examples include:
1.
A playbill, showing your student’s role in a drama production;
2.
The annual yearbook;
3.
Honor roll or other recognition lists;
4.
Graduation programs; and
5.
Sports activity sheets, such as wrestling, showing weight and height of
team members
B. Directory information, which is information that is generally not considered
harmful or an invasion of privacy if released, can also be disclosed to outside
76 organizations without a parent’s prior consent. Outside organizations include,
but are not limited to, companies that manufacture class rings or publish
yearbooks. In addition, two federal laws require local educational agencies
(LEAs) receiving assistance under the Elementary and Secondary Education Act
of 1965(ESEA) to provide military recruiters, upon request, with three
information categories-names, addresses and telephone listings-unless parents
have advised the LEA that they do not want their student’s information disclosed
without prior written consent.
XXIV. PREGNANT STUDENTS POLICY A. School-aged mothers, unless they receive adequate assistance, might drop out of
school without acquiring the necessary education or without marketable skills.
B. Pregnant students will be permitted to remain in regular classes and participate
in extracurricular activities with non-pregnant students throughout their
pregnancy, and after giving birth are permitted to return to the same academic
and extra-curricular activities as before the leave.
C. The District does not require a pregnant student to obtain a certification of a
physician that the student is physically and emotionally able to continue in
school unless it requires such certification for all students for other physical or
emotional conditions requiring the attention of a physician.
XXV. ANTI-HAZING POLICY A. Hazing in strictly prohibited in the Mohawk Trail Regional School System,
compliant with MGL 269, Sec. 17-19. Hazing is defined as and shall mean any
conduct or method of initiation into any student organization, whether on public
or private property, which willfully or recklessly endangers the physical or
mental health of any student or other person. Such conduct shall include
whipping, beating, branding, forced calisthenics, exposure to the weather, forced
consumption of any food, liquor, beverage, drug or other substance, or any other
brutal treatment or forced physical activity which is likely to adversely affect the
physical health or safety of any such student or other person, or which subjects
such student or other person to extreme mental stress, including extended
deprivation of sleep or rest or extended isolation.
XXVI. ACCEPTABLE USE POLICY Our staff and students use technology to learn. Technology is essential to facilitate
the creative problem-solving, electronic technology fluency, and collaboration that
we see in today’s global economy. While we want our students to be active
contributors in our connected world, we also want them to be safe, legal, and
77 responsible. This Acceptable Use Policy supports our vision of technology use and
upholds in our users a strong sense of electronic technology citizenship. While it is our intent to make technology resources available to further educational
goals and objectives, students and staff may find ways to access unacceptable
materials. Filtering software and firewalls are in use at all of our schools. No
filtering system, however, is capable of blocking 100% of the inappropriate material
available. We believe that the advantages afforded students from access to
information and communication technologies and the opportunities for
collaboration exceed any disadvantages. Please carefully read this complete document, review its contents and sign the
Student User Agreement and Parent/Guardian Permission section at the end
of this document. This signed agreement is kept on file. In order to rescind the
agreement, the student’s parent or guardian or the student who is at least 18 years
old must provide the Front Office with a written request. Any questions or concerns
about this user agreement should be referred to the school’s principal. A copy of this
document can be found on the MTRSD web site. Internet Safety and Security The safety of our students is of utmost importance. Educating students and
shareholders about the proper and safe use of the Internet is a priority. Users are
expected to take reasonable safeguards against the transmission of security threats
over the school networks. This includes, but is not limited to, opening or distributing
infected files or programs and not opening files or programs of unknown or
untrusted origin. Usage Guidelines Students and staff use the district’s information and communication technologies to
support classroom activities, educational research or enrichment activities to
further the educational mission, goals and strategic direction of the MTRS. Access is
a privilege, not a right. As such, general school rules for behavior apply, and users
must honor the agreement they have signed on the Student User Agreement section
of this document. Any violations of the Acceptable Use policy may result in a loss of access as well as
other possible disciplinary and/or legal actions. Based on the guidelines stated in
78 this document, the Instructional Technology (IT) Department will deem what is
inappropriate and their decision is final. ● All use of information and communication technologies during school or
school-sponsored events must be consistent with the following guidelines. ● Use of information and communication technologies is for educational
purposes only and must be under the direct supervision of the teacher. ● Be polite. Use appropriate, non-abrasive language. Refrain from making
defamatory remarks, sexual or racial slurs and from using obscene or
profane language. ● Be considerate. Do not bully, harass or insult others. ● Protect personal information that could identify you, other students, and/or
staff. ● Each student is responsible for all activity under her/his school-provided
accounts. It is imperative that all users keep their passwords secret so that
no one else can use their accounts. ● Do not send, display or access obscene, pornographic or sexually explicit
material, any material advocating illegal acts, or material that discriminates
on the basis of gender, national origin, sexual orientation, gender identity,
race, color, ancestry, religion, handicap, or age. ● Hardware and software shall not be destroyed, modified or added without
permission from the IT Department. ● Transmitting material in violation of any state or federal law could result in
legal action. ● It is forbidden to attempt to access unauthorized areas on the district’s
network. ● Respect digital ownership by not moving, deleting or altering any
applications or files that belong to the system, district or other users. 79 ● Using the network for commercial purposes, financial gain, fraud, or political
lobbying is not allowed. ● Using any means designed to bypass school blocking filters will result in
immediate disciplinary action. ● All copyright laws must be followed. ● Misusing resources such as storage space and printers is prohibited. ● Downloading and/or streaming non-educational or entertainment files
without permission is not acceptable. ● Students are not permitted to use any electronic device to record audio or
video or take pictures of any student or staff member without their
permission. The distribution of any unauthorized media may result in
disciplinary action including, but not limited to, suspension, criminal charges,
and/or expulsion. Privacy Users should have no expectation of personal privacy in any matters stored in,
created, received, or sent through electronic technologies provided by the MTRSD.
These matters are subject to review by the MTRSD at any time, with or without
notice, with or without cause and without the permission of any student or
parent/guardian. Administrators and/or staff may review files, content, and
communications to maintain system integrity and ensure that users are using the
system responsibly. Cell Phones and Personally-Owned Information and Communication Devices ● When permitted by a teacher, students are allowed to use cell phones and
other personally-owned devices in the classroom for educational purposes
only and must be under the direct approval of their teacher. ● Cell phones and other personally-owned devices are to be in the “off” or
“quiet” mode at the beginning of each class period. 80 ● The taking of photos or recording of videos, whether by cell phone or any
other device, in places where privacy is a reasonable expectation is strictly
prohibited ● Using cell phone cameras or any other video recording devices to record
altercations on school grounds or at school events is prohibited. In such
cases, the device may be confiscated as evidence. User Agreement and Parent Permission Form for Network, Internet, Cell
Phone, and Personal Electronic Devices The Acceptable Use Policy for the MTRSD and records of violations are reviewed by
technology staff and administrators annually. The MTRSD makes no warranties of any kind, neither expressed nor implied, for the
Internet access it is providing. The district will not be responsible for ● Loss of data resulting from delays or interruptions in service ● The accuracy, nature, or quality of information gathered and/or stored
through technologies provided by the MTRSD ● Unauthorized financial obligations resulting from access through
district-provided technologies. This policy does not attempt to articulate all required or proscribed behaviors. All
provisions of this Acceptable Use Policy are subordinate to local, state, and federal
laws. Each student user must have this form signed and on file before accessing or
using any information and communication technologies at MTRSD schools. Section I: Student User Agreement As a user of the MTRSD’s computer network and Internet connectivity, I hereby
