INTRODUCTION & POPULATION PROJECTION
The Village of Menomonee Falls is a growing community in northeastern Waukesha County. The Village is the fourth largest community in Waukesha County with a 2000 census population of 32,647 and is expected to experience a steady level of growth in the future as well. The Wisconsin Department of Administration projects a growth of over 20% or about 6,600 new residents by 2030, bringing the Village population near 40,000 people. This is the second greatest numerical population growth projected in Waukesha County during this time period. 2000

HOUSING STARTS SUMMARY
The Building Department issues all the permits for commercial, institutional, industrial, and residential projects. Since 2005, only three Waukesha County communities have had more housing starts than Menomonee Falls and in 2009 the Village ranked fifth in new home construction with 24. When compared to these five communities, the 2009 average home value in the Village was second to the Town of Pewaukee. The average home value and the consistent volume of new home construction reiterates the high quality of life and demand for property in the Village. Municipality

COMMERCIAL ACTIVITY
Commercial activity continued to maintain its growth in the Village during 2009 with several large projects. The Village reviews all proposals of this nature and guides them through the approval process. Some of the new construction and commercial expansion projects are highlighted below. ƒ Woodman’s Food Market obtained a conditional use permit to construct an approximately 240,000 square foot super market at the northwest corner of Leon Road and N. 124th Street in Tax Incremental District No. 5. The Woodman’s site will also feature a gas station and cash wash. South of the Woodman’s parking lot approximately 7.5 acres of undeveloped land remain for future commercial uses. ƒ
Roundy’s Supermarkets, Inc. obtained a conditional use permit to redevelop the Sears Grand site adjacent to the North Pointe shopping centre along Appleton Avenue. The proposal is for a new 103,228 square foot super market. This will be the first new construction Super Pick N Save store. The site is approximately 11.3 acres and will feature pedestrian walkway connections to the single and multi‐family neighborhoods adjacent to the property. 2009 Development Report 7
ƒ
Su Casa Mexican Grill & Sports Bar obtained a conditional use permit to redevelop and locate at the former Ponderosa Steakhouse site along Appleton Avenue. Su Casa is planning extensive interior and exterior renovations including the addition a new 132 person outdoor seating area facing Appleton Avenue. ƒ
Falls BP Gas Station on Appleton Avenue received PID Planned Infill development approval for a 1,170 square foot addition to the existing gas station/convenience store. The addition will allow for expanded cooler, new cashier area, and more storage space. The red box below highlights the approved addition. 2009 Development Report 8
INDUSTRIAL ACTIVITY
According to the 2009 Statement of Equalized Value, produced by the Wisconsin Department of Revenue, the Village of Menomonee Falls has the third highest equalized value for manufacturing real estate in Wisconsin. In 2009, the Village had over $316 million in manufacturing real estate equalized value, placing us behind only Milwaukee and Green Bay. Consistent with past years, the industrial areas of the Village created several projects in 2009. Much of the industrial activity added new jobs and other projects improved the aesthetic appeal of older buildings. A few of the approved industrial projects are described below. ƒ Actuant obtained approval for a 132,290 square foot warehouse expansion to an existing office/ warehouse facility (former Kelch Corp.) in the Westbrook Corporate Park. This expansion will feature nine additional loading docks and is accompanied by an expanded parking lot and extensive landscaping. This is the first phase of a larger project as Actuant plans to consolidate their operations in Menomonee Falls.
ƒ
Storage Battery Systems, Inc. is located in the Silver Spring Corporate Park. In 2009, they received approval for a 28,275 square foot warehouse addition and a 2,240 square foot office addition to their existing facility. The red outlined boxes in the image below highlight the areas of the addition. 2009 Development Report 9
ƒ
American Landscape obtained conditional use approval to construct an approximately 13,000 square foot building along the south side of Kohler Lane, a few parcels to west of their existing operations. The new building will feature large overhead doors and an area for salt and landscape material storage and the loading of salt trucks. ƒ
Wisconsin Shower Door is located along Leon Road and they recently completed their approved 12,000 square foot addition to expand their operations. This expansion features a 2.5 ton crane that straddles the inside of the ceiling. 2009 Development Report 10
ƒ
Traditional Concrete is located along Fountain Boulevard in the northeastern area of the Village. They recently obtained approval to construct a 7,000 square foot addition that will feature a suspended crane. This addition will allow for increased space for the indoor production of their products. The red boxes highlight the addition locations. 2009 Development Report 11
INSTITUTIONAL & PUBLIC ACTIVITY
The Village also reviews all applications for development in the P‐2 Institutional and P‐1 Park and Open Space districts. In 2009, project approved in these districts included the revamping of the Trenary Field concession stand and bleachers, two sanitary sewer pump houses along Menomonee Avenue, and a dormitory for the Falls Baptist College of Ministry. ƒ Falls Baptist College of Ministry received a conditional use permit to construct a 48 bed dormitory and classroom facility in the North Hill neighborhood. The proposal also includes an elevated pier that would cross the wetlands and connect to the existing Falls Baptist church site to the north. ƒ
The Village of Menomonee Falls received approval from the Architectural Control Board to revamp of the existing bleacher and concession stand system at Trenary Field in Riverside Park. The reconstruction included converting the space below the bleachers into concession/ storage space and refinishing the exterior with stone veneer. 2009 Development Report 12
ƒ
Waukesha County obtained conditional use approval to construct a new 3,466 square foot maintenance/ storage building in Menomonee Park. The new structure will replace the outdated facilities in the park. The County also proposed areas of prairie grass and rain gardens to handle stormwater runoff events. 2009 Development Report 13
RESIDENTIAL ACTIVITY
The Village reviews all subdivision plats, certified survey maps, and multi‐family development proposals. Although the housing market continued on its slow down, the Village worked with a few developers during 2009 on residential projects. A description of the 2009 ongoing residential projects is below. On another note, even though the number of new homes is down from past years, the Village issued 24 permits for new single family homes in 2009 with an estimated building cost of nearly $7.2 million. ƒ Horizon Development Group received PID Planned Infill Development approval for a 57 unit senior residential project to be known as Alta Mira II in the North Hills Neighborhood. This project is directly south of the first Alta Mira project and shares its access to Northfield Drive with the 20 unit Buena Vista condominium development. The project will also feature underground parking. 2009 Development Report 14
ƒ
The Quail Haven subdivision is the most recent preliminary plat that was approved in the Village. The applicant began the project in 2008 and continued the PRD Planned Residential Development approval process in 2009. The proposal allow s lots that range from 16,038 to 40,014 square feet in size that would be situated east of Marcy Road and to the south of Creekwood Highland Addition No.4. ƒ
Fiduciary Real Estate Development, Inc received PRD Planned Residential Development approval for a 76 condominium units project at the northwest corner of One Mile and Lisbon Roads. The plans are for ranch style buildings with 18 of them containing four dwelling units and two of them as duplexes. 2009 Development Report 15
2009 CONDITIONAL USE PERMIT SUMMARY
Some of the projects in the Village are subject to the conditional use permit process designed to lessen adverse impacts. This process consists of appearances before the Plan Commission, Architectural Control Board, and the Village Board of Trustees and creates an avenue for a public hearing. In 2009, the Village approved eight new conditional use permits and amended six others. Following is brief description of each of these conditional use permits: ƒ American Landscape obtained conditional use approval allowing them to operate a landscaping and snow removal business from their four parcels located along the south side of Kolher Lane. ƒ American Landscape obtained a second conditional use approval allowing the construction of a new salt storage building and the operation of a landscaping and snow removal business on a parcel (identified as MNFV0108992001) located four properties to the west of their existing facility. ƒ Joseph and Angela Eberhardy obtained conditional use approval for an in‐ground pool to be located in the floodplain on their property at W142 N6126 Mill Ridge Drive. ƒ Falls Baptist College of Ministry Dormitory obtained conditional approval allowing a 18,730 square foot dormitory building to be constructed in the P‐2 Institutional district. ƒ Waukesha County amended its conditional use permit to allow for a new maintenance building in Menomonee Park located at W220 N7884 Townline Road. ƒ Absolute Necessity in North Pointe Plaza amended its conditional use permit to correct a title issue. ƒ Northwestern Extract Co. amended a conditional use permit allowing a new industrial use within 300 feet of STH 41/ 45 at N84 W13660 Leon Road. ƒ Continental 202 Fund LLC received conditional use approval allowing the construction of a new super market store at the former Sears Grand site located at N77 W14435 Appleton Avenue. ƒ Curative Care Network, Inc. amended their conditional use permit allowing the conversion of a miniature golf clubhouse to an adult family home on property located north of Menomonee Avenue and west of Maple Road. ƒ Su Casa Mexican Grill & Sports Bar obtained conditional use approval allowing a restaurant and sports bar with outdoor seating at the former Ponderosa restaurant site located at N84 W15842 Appleton Avenue. ƒ T‐Mobile Central LLC obtained conditional use approval to place wireless communication facilities on property owned by Claude Grieger at N50 W13941 Overview Drive. ƒ The Village of Menomonee Falls amended a conditional use permit allowing T‐Mobile Centrall LLC to place wireless communication facilities on the water tower located at N60 W16765 Kolher Lane. ƒ Wisconsin Shower Door amended their conditional use permit to allow the business to construct an addition on a facility located with 300 feet of STH 41/ 45. ƒ Woodman’s Food Market obtained conditional use approval to construct a super market and a gas station with a car wash on the property located at the northwest corner of Leon Road and N 124th Street. 2009 Development Report 16
2009 REZONING SUMMARY
The Village reviews all applications to amend the zoning map. These rezoning applications include a Plan Commission appearance and recommendation, public hearing, and a final approval from the Village Board of Trustees. In 2009, the Village reviewed and processed nine rezoning applications (all of which were approved). Following is a brief description of the 2009 rezoning applications: ƒ Andy Khullar rezoned the property located at N85 W16198 Appleton Avenue from the C‐1 Neighborhood Business District to the C‐1 Neighborhood Business District with the OC‐5 Commercial Service Overlay District. ƒ Helen M. Best Trust rezoned property located at W220 N8124 Town Line Road from the A‐1 Agricultural District, CW‐1 Conservancy‐Wetlands District, and Shoreland Wetland District to the A‐2 Agricultural/Urban Fringe District, P‐1 Park and Open Space District, CW‐1 Conservancy‐Wetlands District and Shoreland Wetland District. ƒ The Village of Menomonee Falls initiated a rezoning of property located at N82 W12476 Hwy 145 from the RM‐2 Multi‐Family Residential District to the PRD Planned Residential District. ƒ Creekwood Commercial investments LLC rezoned a portion of the property located at the southeast corner of Silver Spring Drive and Marcy Road from the C‐1 Neighborhood Commercial District to the C‐4 Suburban Commercial District. ƒ The Curative Care Network rezoned a portion of the property located north of Menomonee Avenue and west of Maple Road from the P‐1 Park and Open Space to the P‐2 Institutional District. ƒ Fiduciary Real Estate Development Inc. rezoned property located on the northwest corner of Lisbon and One Mile Road from the A‐1 Agriculture to the PRD Planned Residential District. ƒ The Elenora J. Brehmer Revocable Living Trust rezoned property located east of Marcy Road and south of Creekwood Crossing Addition No. 4 from the A‐1 Agricultural District to the PRD Planned Residential Development District for the Quail Haven subdivision. ƒ The Village of Menomonee Falls initiated a rezoning of Village property located at N82 W12476 Hwy 145 from the R‐3 Single‐Family Residential District to the I‐1 Light Industrial District. ƒ Woodman’s Food Market rezoned the property on the northwest corner of Leon Road and N. 124th Street to the I‐1 Light Industrial District with the OC‐5 Commercial Services Overlay District. 2009 Development Report 17
2009 ARCHITECTURAL CONTROL BOARD (ACB) APPROVALS
The Architectural Control Board review and approves all industrial, commercial and multi‐family residential buildings. Their focus is on the types and colors of exterior materials and other site aesthetics such as landscaping, lighting, signage, and dumpster enclosures. 2009 ZONING BOARD OF APPEALS (ZBA) APPROVALS
The Zoning Board of Appeals hears requests for variances from the Municipal Zoning Code. In 200, the following variances were granted: ƒ Biesik Falls Properties LLC was granted a variance allowing a parking lot addition closer to the property line than allowed by the zoning ordinance and a narrower landscape buffer than required by the zoning ordinance. ƒ The home located at N90 W17124 Highland Court was granted a variance to allow an addition to the principle structure that would encroach into the rear yard setback more than is allowed by the zoning ordinance. ƒ The home located at N63 W14930 Pocahontas Drive was granted a variance to allow an addition to the principle structure that would encroach into the side yard setback more than is allowed by the zoning ordinance. ƒ Traditional Concrete located at W142 N9110 Fountain Boulevard was granted a variance to allow the addition to the industrial building that would encroach into the front yard setback more than is allowed by the zoning ordinance. ƒ Woodman’s Food Market located on the property to the northwest of the intersection of Leon Road and N 124th Street was granted a variance to provide less at‐grade landscaping coverage than required by the zoning ordinance. ƒ The home located at W172 N7388 Shady Lane was granted a variance to allow a deck addition to the non‐conforming principle structure that would encroach into the setbacks more than allowed by the zoning ordinance. ƒ The home located at N53 W14106 Invery Drive was granted a variance to allow an addition to the principle structure that would encroach into the rear yard setback more than allowed by the zoning ordinance. ƒ The Lutheran Church of the Prince of Peace located at W156 N7149 Pilgrim Road was granted a variance to allow a 16 foot tall accessory structure in the front yard rather than a maximum of a 15 foot tall accessory structure in the rear yard as required in the zoning ordinance. ƒ The property located at N72 W17791 Good Hope Road was granted a variance from the side and rear setback requirements of the zoning ordinance for accessory structures in the A‐1 Agriculture district. ƒ The property located at W204 N5823 Lannon Road was granted a variance from the side setback requirements of the zoning ordinance for accessory structures in the A‐1 Agriculture district. ƒ The home located at W159 N7453 Pinewood Circle was granted a variance to allow an addition to the non‐conforming principle structure that would encroach into the setbacks more than allowed by the zoning ordinance. ƒ Continental 202 Fund LLC was granted variances from the zoning ordinance for parking lot setbacks, a reduced landscaping screen depth, reduced greenspace, and reduced at – grade coverage for N77 W14435 Appleton Avenue. ƒ The property located at N58 W18075 Birch Lane was grant a variance to allow an accessory structure to encroach in the side yard setback more than allowed by the zoning ordinance. 2009 Development Report 20
MUNICIPAL CODE TEXT AMENDMENTS & ORDINANCE CREATION
The Village approved nine ordnances amending the Municipal Code in 2009. The Village also started progress on a Wind Energy System ordinance, but postponed adoption until after new State legislation is finalized to ensure local and state regulations coordinate. The approved ordinance amendments are briefly that the outlined below. ƒ Section 94‐47(g) was amended eliminating a number of the unnecessary and/ or redundant requirements on subdivision plats and certified survey maps. ƒ Section 122‐328 was amended making single family houses and accessory estate buildings principle uses in the A‐2 Agriculture/ Urban Fringe district rather than conditional uses. ƒ Section 78‐11(b) was amended to correct statements regarding the process to appeal a signage decision by the Architectural Control Board. ƒ Section 122‐2 was amended to create language that increased the number of amusement devices from six to eleven to constitute an arcade. ƒ Section 78‐6(3)(b)(2)(ii) was amended removing a limit on the number of colors allowed to be used within an electronic message board. ƒ Chapter 38 of the Municipal Code was amended to update the post‐construction storm water management and construction site erosion control regulations ƒ Sections 122‐58, 122‐70, and 42‐122(p) were amended regarding the fee reference to amend zoning boundaries and regulations, as well as the process and fee to amend the village comprehensive plan. ƒ Sections 122‐62, 122‐191, 122‐192, 122‐561, 122‐566, and 122‐567 were amended to correct references to the floodland zoning districts. ƒ Section 18‐99 was amended to regulate foundation repairs and damp proofing. 2009 Development Report 21
