CALL TO ORDER
The Meeting of the Board of County Commissioners on Tuesday, July 24, 2012, was called to
order by Chair, Dan Gibbs, at 1:34 p.m. in the County Commissioners’ Meeting Room; Summit
County Courthouse, 208 East Lincoln Avenue, Breckenridge, Colorado.

MOTION: A motion was made by Commissioner Davidson and seconded by
Commissioner Stiegelmeier, to approve the Consent Agenda A-G, as presented,
including Resolution 2012-47, approving renewal of ambulance license and ambulance
vehicle permits for the Summit County Ambulance service.

PUBLIC HEARING
A.
Petition for Abatement or Refund of Taxes; Schedule No. 6512116; Lot 2A, Osprey
Reserve Subdivision First Amendment; Mills H. Ford with Ford & Company; agent for
owners Benjamin and Beth Roland Coopersmith (Assessor)
Michael Peterson, Appraiser, reviewed the appraisal report and noted the Assessor’s original
assigned value for 2009 and 2010 was $720,594. After further review, the Assessor’s Office
found the subject property was undervalued and recommends denial of the petition of
abatement or refund of taxes for 2009 and 2010. He noted the discrepancy between the
Petitioner’s value of $605,000 and Assessor’s is due to the different sales comparables used as
well as a negative time adjustment of -0.63% which is in direct conflict with the positive time
adjustment of 0.85% that the Assessor’s Office employed.
Mills Ford, Agent for the Petitioner and Certified General Appraiser, relied primarily on sales of
five comparable properties. He believed comp 1 was the most analogous and focused his
comparison on it, noting that it is adjacent to the subject property and was assessed in 2009 at
$611,650. He utilized a negative time adjustment based on analysis of overall sales data in
Silverthorne which revealed a fairly precipitous drop in the number of sales during the statutory
time period of January 1, 2007 to June 30, 2008.
Mr. Peterson rebutted Mr. Ford’s allegations, stating that property sales in Summit County were
not affected until after the third quarter of 2008. He requested time to provide further information
regarding the assessed value of comp 1.
PH-A was tabled and continued after PH-B.
Mr. Peterson dispersed the property detail report for comp 1 and explained the valuation of
$611,650 was for the structure only, which must be added into the assessed value of the land,
$108,353.

Mr. Ford maintained his position by stating that time adjustments and statistical analysis can be
skewed. He suggested discarding the use of time adjustments and recommended a new
assessed value of $665,000.
Commissioner Gibbs opened and closed the hearing with no public comment.
MOTION: A motion was made by Commissioner Davidson and seconded by
Commissioner Stiegelmeier, to deny the Petition for Abatement or Refund of Taxes for
Schedule No. 6512116 for tax years 2009 and 2010.

B.
Petition for Abatement or Refund of Taxes; Schedule No. 6512710; Lot 2, Silverthorne
Automotive Subdivision; Todd Stevens, Stevens & Associates; agent for owner Spraddle
Creek Automotive Real Estate LLC (Assessor)
Amie Davis, Appraiser, reviewed the Appraisal Report for tax years 2009 and 2010. She
explained that in 2009 the subject property was undergoing improvements and only eighty
percent (80%) complete. Therefore, she recommended partial approval of the 2009 petition for
abatement, which amounts to a reduction in value from $4,701,680 to $4,268,872.
Improvements to the subject property were fully completed in 2010 and Ms. Davis
recommended the valuation of $4,701,680 be upheld. She relied most on the cost approach and
factored in adjustments for time and market conditions. She stated the analysis indicates the
property should be valued at $128.38 per square foot or $5,092,771. However, she made a ten
percent (10%) deduction for external obsolescence based on national and statewide figures
which indicate a slow economy for car dealerships as of June 30, 2008.
Jeff Huntley, County Attorney, pointed out that while the national and statewide data indicates a
decrease, the actual sales from the Department of Revenue for Summit County and
Silverthorne increased by 11% to 18% from 2006 to 2008. He questioned how Ms. Davis was
able to reconcile the local data by deducting 10% for external obsolescence.
Ms. Davis responded that she conducted a personal site visit in which she found a portion of the
property was not being utilized to its fullest potential. In addition, she relied on the dealership
outlook throughout the whole state of Colorado.
Commissioner Gibbs opened and closed the hearing with no public comment.
Commissioner Davidson commented that Mr. Huntley made a good point and remanded the
petition for further consideration.
MOTION: A motion was made by Commissioner Gibbs and seconded by Commissioner
to continue the public hearing for the Petition for Abatement or Refund of Taxes for
Schedule No. 6512116 for tax years 2009 and 2010 at the next BOCC regular meeting on
August 14, 2012.

Proposed Amendments to multiple chapters of the Summit County Land Use and
Development Code (“Code”), including but not limited to amendments to: 1) the
Transfer of Development Rights provisions and maps set forth in Section 3506 and
removal of Figure 3-9; 2) the Local Resident Housing regulations as provided for in
Section 3809 et seq. including, but not limited to affordable workforce housing; 3) the
County Road & Bridge Standards related to parking on County roads as set forth in
Section 5508.01; 4) the applicability of General Grading Permits as set forth in Section
6301.02; 5) Sections 7105.01 and 7105.03 to clarify the applicability of the County
Wetland Regulations; 6) the regulations on Community Appearance, Maintenance and
Safety related to noxious weeds set forth in Chapter 11; 7) the Authority to Initiate a
Development Review Application as provided for in Section 12000.02; 8) the Fee
Schedule set forth in Section 12005 and the cost for special studies set forth in Section
12006; 9) the provisions on Nonconforming Uses set forth in Section 14102 and removal
of Figure 14-1; 10) related Definitions provided in Chapter 15; and 11) other
miscellaneous modifications to accomplish the foregoing. (PLN10-143a/Summit County

Kate Berg, Senior Planner, stated this is the first round of proposed Land Use and Development
Code (Code) amendments in which changes are being proposed to the County’s transferable
development rights regulations, local resident housing regulations, County road and bridge
standards for parking on County roads, grading and excavation regulations, wetlands
regulations, noxious weeds regulations, procedural regulations for development review
applications, and regulations governing nonconforming uses.
Mrs. Berg summarized the necessity of a few of the proposed Code amendments. Based on
research from other communities throughout Colorado and the advice of a Workforce Housing
Work Group, Staff proposes the Master Deed Restriction Guidelines be removed from the
Development Code and a separate reference document titled “Summit County Affordable
Workforce Housing Deed Restriction Guidelines” be created and kept on file in the Planning
Department. Moving the guidelines to a separate reference document will result in documented
guidelines that are still enforceable by the County, and that also allow appropriate flexibility and
the ability to modify the guidelines as needed without necessitating future amendments to the
County’s Development Code.
The Countywide Planning Commission (“CWPC”) recommended approval of the proposed Code
amendments with a few suggested revisions, such as (a) language to more clearly note that the
methodology used to determine annual TDR value is adopted by the BOCC and all
amendments thereto must be approved; (b) addition of more definitive language to explain the
design elements that characterize a duplex vs. a single-family home; and (c) other minor
wording changes and correction of typographical errors. Another suggestion from the CWPC, in
relation to parking on County roads, was to perform trials in both urban, residential areas as well
as rural areas.
Commissioner Davidson asked if the trial process for parking on County roads would be
specified in the Code. He also inquired how Staff would handle previous caretaker unit and
accessory apartment recorded covenants that contained the old language.
Jim Curnutte, Community Development Director, stated the trial process for parking on County
roads is not detailed in the proposed Code amendments and would not be a formal process.

Staff would initiate the trial in an area deemed appropriate; however a citizen could also request
a trial of their neighborhood.
Regarding previously recorded covenants, Mrs. Berg explained that when additional uses are
requested the process to obtain a new covenant for those uses will be implemented. The new
covenant with additional use language will replace the old covenant. Only those covenants with
additional uses requested will be updated.
Commissioner Stiegelmeier asked to learn more about the Workforce Housing Work Group.
Jennifer Kermode, Summit Combined Housing Authority Director, stated the work group is a
collaborative effort from jurisdictions throughout Colorado. The main purpose is to offer options
for varying circumstances. Therefore, a reference manual was created detailing all elements
that could go into a deed restriction and other factors to consider.
Commissioner Gibbs opened and closed the hearing with no public comment.
The Commissioners commented that they had discussed the proposed Code amendments at
length during the June 12th and June 19th work sessions. Commissioner Davidson asked that
Robert Jacobs have criteria available for parking on County roads.
MOTION: A motion was made by Commissioner Stiegelmeier and seconded by
Commissioner Davidson to adopt Resolution 2012-48, approving Planning Case #10143a, amending multiple chapters of the Summit County Land Use and Development
Code (“Code”), including but not limited to amendments to: 1) the Transfer of
Development Rights provisions and maps set forth in Section 3506 and removal of Figure
3-9; 2) the Local Resident Housing regulations as provided for in Section 3809 et seq.

Approval to exercise option agreement to acquire the West Side Claim
The OSAC made a unanimous recommendation at their June 6, 2012 meeting that the County acquire the
4.31 acre West Side mining claim in the Ten Mile Basin.
The West Side Claim MS#2758, Owner: US Bank, Trustee, Schedule No. 3009141, 4.306 acres (see map)
OPEN SPACE VALUES: On the slopes of Wheeler Mountain facing Clinton Reservoir, this highly
scenic property close to the Lake County line protects view corridors and unique lands.
ƒ Extensions of protected lands: The property is adjacent to National Forest lands, and would be
highly eligible for a USFS trade.
ƒ View Corridors: The property is on the ridgeline of the Clinton Amphitheater, and is visible to
recreationists in this very scenic area.
ƒ Unique Lands: The property is in an area of very high biodiversity significance, as rated by the
Colorado Natural Heritage Program. It may contain subalpine riparian willow carr habitat and rare
plant species, and provide lynx habitat.
BACKGROUND: An employee from the real estate division of US Bank contacted open space staff to
gauge their interest in purchasing the claim. OSAC discussed the backcountry, scenic character of this
area of the County, and unanimously recommended the County offer approximately $1,000 an acre, or
$4,030. US Bank has accepted the offer and a closing date of September 14, 2012.
STAFF RECOMMENDATION AND REQUEST: Staff requests BOCC approval to exercise the
option agreement and purchase the West Side Claim.
