COMUNICACIÓN DE LA REPÚBLICA ESLOVACA
Oferta condicional de la República Eslovaca en materia de
compromisos iniciales en las negociaciones de la
Ronda Uruguay sobre el comercio de servicios
La comunicación siguiente se distribuye a los miembros del Grupo de
Negociaciones sobre Servicios a petición de la República Eslovaca.
La República Eslovaca tiene el honor de presentar con la presente
comunicación su oferta condicional en materia de compromisos iniciales para
las negociaciones emprendidas en el marco del futuro Acuerdo General sobre
el Comercio de Servicios (GATS).
La presente oferta está supeditada a una conclusión satisfactoria de
las negociaciones de la Ronda Uruguay sobre los compromisos iniciales en el
sector de los servicios. Por consiguiente, la República Eslovaca se
reserva el derecho a modificar, complementa', reducir o retirar la presente
oferta si no se alcanzan resultados satisf.. torios a este respecto. Puesto
que la República Eslovaca es una parte contratante en proceso de transición
a una economía de mercado, se reserva además el derecho a mantener -por
razones vinculadas con su situación concreta- un nivel de liberalización
del comercio de servicios acorde con las necesidades de su proceso de
transición económica. La República Eslovaca también se reserva el derecho
a introducir modificaciones técnicas en su oferta y a corregir omisiones e
inexactitudes.
La disposición de Eslovaquia a mantener la presente oferta dependerá
de la voluntad de sus interlocutores en las negociaciones de asumir, habida
cuenta de sus niveles de desarrollo, compromisos comparables a los asumidos
por la República Eslovaca. La República Eslovaca tomará particularmente en
cuenta los compromisos asumidos por los interlocutores comerciales más
importantes con objeto de determinar la eventual necesidad de reproducir,
ampliar o retirar su oferta.

La oferta se ha establecido sobre la base del proyecto de Acuerdo
General sobre el Comercio de Servicios (GATS) y la nota de la Secretaría
sobre Consignación en listas de los compromisos iniciales en la esfera del
comercio de servicios, de julio de 1993, así como de los resultados de las
consultas informales celebradas posteriormente en el marco del GNS. La
República Eslovaca se reserva el derecho a corregir la oferta sobre la base
de cualquier aclaración que pudiera efectuarse en futuras conversaciones.
La oferta de la República Eslovaca en materia de compromisos iniciales
sobre el comercio de servicios comprende dos partes: en la primera se
indican los compromisos horizontales correspondientes a todos los sectores
y modos de prestación, cuando proceda, y en la segunda los compromisos
específicos por sectores o subsectores.
La República Eslovaca está dispuesta a proporcionar las aclaraciones
que se soliciten así como a participar en las reuniones de negociación
sobre compromisos iniciales.

Commitments
a) essential sénior executives transferred to the Slovak Republic
within a specific business or company who primarily direct the
management of the organization or one of its departments and
who receive only general supervisión or direction principaily
from the board of directors or stockholders. Executives would
not directly perform tasks related to the actual provisions of the
services of the organization.
b) specialists possessing high or uncommon qualifications and knowledge indispensable for a provisión of a specific service and
essential to the organization's service, research, equipment,
techniques or management.
c) persons employed or mandated by an organization and who enter
temporarily in the Slovak Republic in order to conclude the
sale of a service on behalf of the organization which employs them
or has mandated them. Services sellers may not sell services
directly to the general public.
d) persons meeting criteria under a) who are responsible for
setting up in the Slovak Republic of commercial presence of
the service provider when they are not engaged in making
direct sales or supplying services and when the service
provider has no representative branch or subsidiary in the
Slovak Republic.
All other requirements of the Slovak Republic's laws and regulations regarding entry, stay and work shall continué to apply.
Temporary entry and stay does not imply a right to permanent
residence ñor does it count as residence period for the permanent
residential status and citizenship.
