Rattray's on MalaMala offers a glimpse of an era long past, when distant travellers to Africa married the magic
of the wild with elegance and refinement. Rattray’s on MalaMala is a culmination of over 50 years of experience

Each suite or khaya (the Zulu for "home") functions as an inclusive home, resplendent with hand-selected

MALAMALA CAMP
Every aspect of the MalaMala Camp is designed to appreciate and enjoy the view of the surrounding wilds.
Pathways wind their way along the perimeter of the camp to reveal individual ochre colored units tucked into the
greenery which flanks the Sand River. Massive trees and rolling green lawns are filled with birdsong, with the
occasional antelope or elephant which seeks the succulence of greenery.
The camp is unfenced - an oasis in the middle of the bushveld.

companionship - safari style

DISABLED ACCOMMODATION : MalaMala prides itself on being one of the few safari destinations which is
able to offer a fully equipped disabled suite - designed in accordance with the Disabled People’s Information
Service of South Africa, it is in line with international standards.

Master bedroom with two en-suite bathrooms and an additional disabled bathroom which is able to
comfortably accommodate a guest who is wheelchair bound. This includes a wheel-in shower with all
the necessary fittings.
Desk/table surfaces specifically adjusted to the correct level at which a wheelchair is positioned.
A separate lounge area which may be converted to a bedroom should a disabled guest require
assistance from an accompanying nurse/aid.
Game drives are conducted safely in a suitably equipped landrover with a wheelchair ramp.
AGE RESTRICTION : Children of all ages accepted. Children of 4 years and younger are not permitted in
the boma for dinner, or on game drives (unless parent's have booked sole use of a vehicle). A babysitting facility
is available at a nominal fee

SABLE CAMP
Imbued with the spirit of MalaMala, the Sable Camp is a more intimate version of the Main Camp and the choice
for those seeking a more private and intimate safari. Situated at the southern end of the MalaMala Camp in a
prime elevated position overlooking the Sand River and surrounding bushveld, Sable Camp accommodates a
maximum of 14 guests. It may also be reserved exclusively for between 10 & 18 guests

JUNIOR RANGER PROGRAMME
Children’s Policy and Rates - Age restrictions do exist and are applied in the interests of personal safety as
well as the comfort of other guests.
MalaMala Main Camp welcomes children of all ages. Children under 12 years, sharing accommodation with full
paying adults, pay the quoted child tariff. Children aged four and under are not permitted to dine in the boma in
the evenings. Special dining arrangements can be made and baby-seating services are provided on request, at
a nominal charge. Children aged four and under are unable to join the game drives, unless their parents / party
have reserved sole-use of the game drive vehicle at the additional cost.
Family rooms may be used as a triple or a quad room to accommodate children – the separate lounge is
converted to a bedroom utilising single beds. Every room at MalaMala Main Camp includes two bathrooms
On arrival, the ranger looking after the family will assess the age, enthusiasm and independence of the children
and in collaboration with the parents and guardians, various activities will be offered.
A MalaMala backpack including an interactive check-list, bird and mammal colouring books, compass &
thermometer, lip-ice and water are given to each child between the ages of 4 and 12.
The ranger allocated to the family will, throughout their stay, offer some of the following activities:1. The tracking of various animals from their spoor markings.
2. Teach basic survival skills (where to find water, what plants are good to eat, medicinal uses of plants,
the toothbrush and toilet paper trees).
3. Warning signs of dangerous animals and first aid for emergency situations in the bush.
4. A bush breakfast enables children to learn how to make fire and to participate in the meal preparation.
5. Children are able to communicate on the radio (out of game drive times)
6. Special meals and “ration packs” are prepared for children.
7. Babysitters are available in the evenings if required.
8. In camp there are children’s movies, wildlife movies (filmed on MalaMala) and board games.
The Sable Camp does not accommodate children under the age of 12, unless the entire camp is reserved
exclusively.
Rattray’s on MalaMala does not accommodate children under the age of 16.
Mount Anderson Ranch welcomes children aged 8 and above. Children under 12 years, sharing
accommodation with full paying adults, pay the quoted child tariff.

TERMS AND CONDITIONS
The charter flight is conducted in a Cessna Grand Caravan – a single engine, unpressurised turboprop aircraft.
Minimum 2 guests / maximum 9 guests. Please contact us for a separate quotation for groups of more than 9.
Luggage allowance: strictly 20 kg’s per person.
Accommodation must be confirmed for a minimum of 2 nights each at MalaMala Game Reserve & Mashatu Game Reserve in
order to utilise these flights.
Bookings must be confirmed 1 month prior to departure to guarantee availability.
Guests must have the relevant visas and travel documentation for South Africa and Botswana.
Airlink offers daily connecting flights between Skukuza Airport and Cape Town International Airport, Skukuza Airport and O R
Tambo International Airport (Johannesburg) and Kruger Mpumalanga International Airport – KMIA (MQP) and Livingstone on
Monday, Tuesday, Wednesday, Friday and Saturday.
Airlink offers daily flights between Johannesburg and Polokwane. A connecting road transfer between Polokwane and Mashatu is
available through our central reservations office.

THE AFRICAN DEFINITIVE EXPERIENCE:Combine MalaMala and Mashatu Game Reserves in an exciting 6 night package which includes the Malatu
Express charter flight (per seat basis, minimum 2 guests / maximum 9 guests) between the two reserves. This
package combines easily with Cape Town, Livingstone and Johannesburg using connecting flights on Airlink
from Skukuza Airport or Kruger Mpumalanga International Airport (KMIA).
Itineraries include 3 nights at Mashatu Game Reserve & 3 nights at MalaMala Game Reserve. The order of the
itinerary is flexible as the charter flight operates in both directions.

The best route to travel within the reserve may change depending on weather conditions. It is essential that
you speak with the camp reception prior to entering the reserve to receive their advice. For your safety and
comfort please ensure that you have entered the Sabi Sand Wildtuin before 16h00.
The MalaMala Game Reserve is a 6 hour drive from Johannesburg.
From Hazyview to MalaMala
Travel to Hazyview in the Mpumalanga
Province and turn east at the SPAR Centre
onto the R536 - towards the Paul Kruger Gate.
After 37,5 km's you will see a brown road sign
indicating ‘MalaMala’ to the left. Turn left onto
the dirt road – beware the tight hairpin bend.
Follow this road for 3km's. At the T-junction
turn right and continue for another 4,2 km's to
Shaw's Gate, the entrance to the Sabi Sand
Wildtuin.
Here you will be required to pay the ZAR
190.00 entrance fee per vehicle plus ZAR
50.00 per person in cash – these rates are
valid until 31/12/15.
From 01 Jan 16 it’ll increase to ZAR 250.00
entrance fee per vehicle plus ZAR 110.00 per
person in cash.
Continue straight following the signs to

come to a crossroad. Turn left at the cross

Rattray’s on MalaMala is approximately 11 km
from this point.

just before the Rattray’s turnoff.
You will arrive at the MalaMala entry gate where you will be asked to sign the register. The guard will advise
reception of your arrival.

Federal Air - Directly into MalaMala Game Reserve
Federal Air run a twice daily shuttle service between OR Tambo International Airport (JNB) and MalaMala
Game Reserve, utilizing twin-engined, pressurized turbo-prop aircraft.
Check-in for Federal Air flights is at the Federal Air kiosk, located in the multi story parkade adjacent to the car
rental companies – a map of O R Tambo International Airport is available on our website.
Daily, O R Tambo (JNB) to MalaMala:
Departure between 10:30 and 11:30 with estimated arrival at MalaMala between 11:30 and 13:00
Check in for this flight will be open from 07:00. Passengers must be checked in at the Federal Air kiosk by 09:45 latest to connect onto
this flight. Passengers must be checked in at the Federal Air departure lounge by 10:00 latest to connect onto this flight.
Departure between 12:30 and 13:30 with estimated arrival at MalaMala between 14:30 and 15:30
Check in for this flight will be open from 07:00. Passengers must be checked in at the Federal Air kiosk by 11:45 latest to connect onto this

Cancellation fees:

30 – 15 days: 15% cancellation fees apply to all reservations cancelled between 30 and 15 days prior to travel.

14 days – day of travel: 100% cancellation fees apply to all reservations cancelled within 14 days prior to travel.

All shuttle departure times are a guide only and are subject to change;

Federal Air offers a shuttle service and NOT a scheduled service , therefore times and routes may vary from day to day
depending on actual bookings;

Federal Air reserves the right to include technical stops en-route due to operating conditions at the time, which is in the interest of
safety and at the sole discretion of the Captain;
•
Federal Air cannot be held responsible or liable should incoming flights be delayed resulting in passengers missing their shuttle
connection to MalaMala. Federal Air will endeavour to assist them on a later departure subject to seat and flight availability;
•
Federal Air cannot be held liable or responsible for any delays due to weather, ATC or technical delays, and will rectify the
situation to the best of their ability;
•
In the event of bad weather (low cloud or water logged runways) Federal Air reserves the right to drop off clients “at the nearest
suitable and serviceable airstrip”. This might mean a road transfer for guests to get to their final destination. This road transfer will
not be for Federal Air’s account, but will be for the guests’ account. This diversion will only be done in the interest of safety and
when weather and / or runway conditions are not suitable to land at your original destination.

Federal Air cannot be held liable or responsible for any delays due to weather, resulting in missed connections when returning
from MalaMala.
•
Federal Air offers a complimentary meet & greet facility off any Federal Air connecting flight into O R Tambo International Airport.
Please provide us with your connecting flight details should you require this service.

MalaMala operates on a 12h00 midday check-in and an 11h00 check-out. Guests booked on the late departure flight out of
MalaMala who require lunch on their day of departure will be charged for the extra lunch – payable with their extra’s on check-out.
•
Guests not able to connect with their Federal Air flight from O R Tambo International Airport for whatever reason will be booked
on the next available flight (possibly the following day). Cancellation fees may apply. Travel insurance is advisable.
•
Luggage allowance is restricted to 20kg’s per person with a maximum size of 25 cm x 30 cm x 62 cm. A complimentary luggage
storage facility is available with Federal Air for excess luggage.

Reservations on Airlink flights to and from Johannesburg / Skukuza Airport and Cape Town / Skukuza
Airport should be made via your travel agent or directly with Airlink (www.flysaa.com).
Check-in for Airlink flights is at the Airlink check-in desks in the domestic departures terminals at OR
Tambo International Airport and Cape Town International Airport.
Reservations for road transfers to and from Skukuza Airport and MalaMala Game Reserve must be
made through the MalaMala central reservations office and will be invoiced with the reserved
accommodation.
Reservations for Federal Air charter flights to and from Skukuza Airport and MalaMala Game Reserve
can be made directly with Federal Air or with MalaMala Game Reserve.
A one hour road transfer is available between Skukuza Airport and MalaMala Game Reserve and can be
reserved through through MalaMala Game Reserve, at a cost of R 400.00 per person one way.
• The arrival time at Rattray’s on MalaMala will be approximately 80 mins after the aircraft arrival at
Skukuza Airport. .
• The arrival time at MalaMala Main Camp and Sable Camp will be approximately 90 mins after the
aircraft arrival at Skukuza Airport.
• The departure time from Rattray’s on MalaMala will be 80 mins prior to the scheduled aircraft
departure from Skukuza Airport.
• The departure time from MalaMala Main Camp and Sable Camp will be 90 mins prior to the
scheduled aircraft departure from Skukuza Airport
Airlink - via Kruger Mpumalanga Int’l Airport (MQP):
Airlink operates daily scheduled flights from Johannesburg and Cape Town into Kruger Mpumalanga Airport
(MQP).
Airlink operates flights to and from Livingstone Airport, Zambia on Mondays, Tuesdays, Wednesday, Fridays &
Saturdays.
Kruger Mpumalanga Airport is situated close to the town of Nelspruit and transfers to MalaMala can be provided
by either a small light aircraft (30 minute air transfer) or a road transfer (2 hour transfer).

MOUNT ANDERSON RESERVE, Mpumalanga
Mount Anderson Reserve is a unique and exclusive mountain retreat set on 7300ha (20 000 acres) of dramatic
landscape in the Mpumalanga escarpment, west of the Kruger National Park. It is an idyllic getaway for those
seeking refuge from the rigors of everyday city life and offers the perfect opportunity to relax and unwind in one
of South Africa’s most exquisite and private nature reserves. The property is blessed with spectacular scenery
and mesmerizing views while still offering access to rare and endangered wildlife and some of the most unique
vegetation in the country. Mount Anderson is steeped in history and is the site of the largest gold nugget ever
found in South Africa.
Proclaimed in 1990 as South Africa’s first ever private water catchment reserve, Mount Anderson Reserve is
also a classic conservation success story. Once overgrazed cattle and sheep country, it has been fully restored
to its original ecological splendour. Today it protects not only the major river catchments that are the lifeblood of
the Kruger National Park but also conserves unusual antelope such as eland and black wildebeest and
charismatic predators like leopard, brown hyena and aardwolf. It is also an important sanctuary for threatened
mammals like the oribi and critically endangered species like the tiny, rough-haired golden mole. Recently, a
new species of the Callilepus flower was discovered 100 metres from Golden Cottage. This is the only known
flower of its type in the world!
Golden Cottage, the reserve’s luxury lodge, was painstakingly crafted from hand-hewn rose shale and features
graceful rooms with tall ceilings and airy windows. Situated in a secluded valley, it overlooks crystalline trout
ponds and while you might occasionally hear the bark of baboons from the cliff tops, the only disturbance to
one's solitude is the sound of Africa's game approaching the streams to drink.
Activities
Mount Anderson Reserve is an idyllic family retreat with a wide range of outdoor activities available in the
company of a qualified guide and host. As a constructive consequence of protecting the water catchments,
there is outstanding fishing available on the property. The 24 weirs, two large lakes and long river catchments
provide opportunities for the strong fighting wild trout. The quality and diversity of fishing ensures that all levels
of fishermen – from beginner to the more experienced – are accommodated. Fly-fishing rods and reels are
available at Mount Anderson.
Wildlife safaris on foot or in a 4-wheel drive vehicle are undertaken in the mountains surrounding the
homestead. Herds of Africa's less famous antelope including eland, black wildebeest, blesbuck, mountain
reedbuck and the much endangered oribi are likely to be seen. Brief glimpses of predators such as the elusive
leopard, jackal or caracal are always possible. Indigenous birdlife includes the brilliant malachite sunbird, the
Cape vulture, the fish eagle and numerous species of spurfowl. Mount Anderson Reserve is a botanists dream
and a variety of indigenous flowers grow wild throughout the property.
A camera trap reveals the nocturnal activities of the predators on the reserve and images of leopard and brown
hyena are an addictive addition to breakfast conversation.
Hiking trails are plentiful in the mountains which comprise the Mount Anderson Reserve and range from gentle
river-side ambles to a challenging hike and climb. Walk to beautiful waterfalls and enjoy a refreshing swim in the
pristine mountain streams. Find the San rock art paintings in the valleys and explore the ruins of the ancient
Pedi tribes – officially documented sights with Stone Age artefacts. The geology of Mount Anderson is an ideal
classroom in which to learn the differences between sedimentary, metamorphic and igneous rock whilst your
guide will help you identify spoor of the different species that make up the flora of this unique destination.
Mount Anderson Reserve offers some of the most exhilarating and technically challenging mountain bike
riding in South Africa. Spectacular vistas and thrilling single track cycling paths, guided by a professional
cycling guide make this a must for anyone who enjoys the excitement of mountain biking. Mountain biking
beginners and children are also included with a specially built mountain bike track for younger children. Support
vehicles and staff are on hand for those unwilling to tackle the more challenging terrain.
Horse riding on well schooled “boer perd” ponies is available for intermediate and experienced riders whilst
children and beginners can experience the thrill of this pastime in the safety of the paddocks. Compulsory
protective riding hats are available for guests use. Trail saddles are used. Please note horse riding is only
available for guests under 100kg.
The relics of the gold mining era of the 1920's and 1930's are visible on the property. Old miners' houses, a
mining press and deep level shafts bear witness to the harshness of the conditions in which the pioneers
worked. Guests may explore these old gold mine workings and shafts and may even try their hand at panning
for gold. This is a great activity for children but please don’t take any gold or rocks home with you!
Clay pigeon shooting and air rifle shooting adds a competitive element to the holiday with an assortment of
fun targets. Safety eye protection is available and the activity is conducted in the presence of an experienced
guide who will provide strict safety instructions.
Treasure Hunts may form part of a hiking or cycling activity using planned GPS routes to designated areas.
Children learn orientation with directional cards and a GPS device directing them to “treasure areas” which may
include panning for gold, digging for artifacts or using a metal detector to find the quarry.
Picnic at the Spekboom Dam (Lake), where activities includes a zipline, fishing from a rowing boat and
swimming. A homemade pizza oven will bring out the creative chef in everyone while plaster moulds of animal
spoor and river ecology trips keep the youngsters occupied whilst Mum and Dad catch up on the stresses of the
year.

Travelling to Mount Anderson Reserve
• Airlink offers daily flights from Johannesburg and Cape Town into Kruger Mpumalanga International
Airport (MQP). A 90 minute road transfer to Mount Anderson Reserve is available at an additional
charge.
• Private charter flights into Lydenburg Airfield (1 hour flight from Johannesburg). Lydenburg Airfield is a
40 minute drive from Mount Anderson Reserve.
• A 4 hour self drive or road transfer from Johannesburg on tarred main roads
• A 3 hour self drive or road transfer from MalaMala Game Reserve
• Via helicopter from Kruger Mpumalanga International Airport or MalaMala Game Reserve. This scenic
transfer can include a picnic lunch in the mountains overlooking the Blyde River Canyon. There is a
helipad at the Golden Cottage.
• The above transfer rates are available on request and dependent on the number of guests travelling in
the party.
MALAMALA RANCH (PTY) LTD - STANDARD TERMS AND CONDITIONS
1.
PARTIES
This document (“Standard Terms”) sets out the terms and conditions of contract that apply between MalaMala Ranch (Pty) Ltd ("MalaMala"), of the one
part, and the person who visits MalaMala Game Reserve and/or Mount Anderson Reserve (both referred to as “the Reserve”), and the entity which makes a
booking on behalf of the person who visits the Reserve, if any, of the other part (both the individual and the entity, if any, referred to as “the Guest”). The
Standard Terms shall supersede and take precedence over any contrary term contended for by the Guest unless such contrary term is recorded in writing
and signed by a director of MalaMala.
2.
RESERVATIONS
2.1
Any enquiries for reservations shall be treated as provisional reservations from the time that MalaMala delivers correspondence to the Guest notifying
the Guest that a provisional reservation has been made (“the Provisional Reservation”).
2.2
The Provisional Reservation shall state, amongst other things, the dates of the reservation, the cost of the reservation and the time period within which
the deposit and balance must be paid to MalaMala.
2.3
The reservation shall not be secure until such time as the deposit is paid, and such payment has been brought to the attention of MalaMala in
accordance with 4.6, regardless of whether the time period for payment stipulated in the Provisional Reservation has lapsed or not.
2.4
If the deposit is paid within the time period stated in the Provisional Reservation, then MalaMala shall send confirmation in writing to the Guest (“the
Confirmed Reservation”).
3.
RATES
3.1
MalaMala publishes rates from time to time and reserves the right to amend the published rates without notice. The rates quoted by MalaMala include
game drives and meals over a 24 hour period – both of which form an indivisible portion of the rates quoted. Rates apply to both group and individual
reservations and are quoted on a per person per night basis and are inclusive of VAT.
3.2
The rates are quoted in United States Dollars (“USD”) and payment is accepted in that currency but arrangements can be made to convert the USD
rate to South African Rand (“ZAR”) using the conversion rate supplied to MalaMala by Nedbank Ltd within a 6 (six) month period of the Guest’s arrival
at the Reserve. Rates converted to ZAR are only valid if the amounts due are paid by due date and if the Guest fails to make payment by due date the
USD rate shall apply or at MalaMala’s discretion a new conversion rate supplied by Nedbank Ltd shall be used.
3.3
MalaMala shall not be liable for any rate fluctuations of third party suppliers whose services MalaMala books on behalf of the Guest.
4.
PAYMENT
4.1
All reservations will be on a pre-payment basis. Payment must be made in accordance with the directions in that regard detailed in the Provisional
Reservation.
4.2
In the event that payment is not made in accordance with the directions in that regard detailed in the Provisional Reservation then MalaMala reserves
the right to treat the reservation as cancelled.
4.3
All payments are to be made in monetary currency, without demand and free of exchange, deduction or set-off.

4.6
A copy of the bank transfer notification, together with the Provisional Reservation date and number, must be faxed or emailed to the central sales and
reservations office.
4.7
Any bank charges resulting from the payment by the Guest shall be for the Guest’s account.
4.8
Payment in foreign currency may be made by means of Master Card, Visa or American Express credit cards, and payment in ZAR may be made by
Master Card, Visa or Diners Club credit cards. A letter of authorisation with the cardholder’s signature must be provided in order for MalaMala to debit
the credit card. Credit cards submitted to central sales and reservations office for payments must be presented at the relevant camp on check in for
verification purposes.
4.9
In the event that the Guest fails to make payment in accordance with the directions detailed in the Provisional Reservation, and MalaMala does not
treat the reservation as having lapsed then payment shall be made when demanded by MalaMala, and in any event by no later than on arrival at the
relevant camp.
4.10
Guests shall settle their extras accounts in full prior to departure from camps, with payment to be made in cash or by means of credit card.
4.11
Should the Guest default in making any payment on its due date, MalaMala shall have the right forthwith to cancel the reservation, always subject to
MalaMala's rights to damages, and MalaMala shall have the right to retain all moneys paid by the Guest pending the determination of such damages
and thereafter to set off the amount so retained against the amount owing.
5.
TRANSFERS AND CHECK-IN/CHECK-OUT
5.1
Transfers to and from camps, the airport/airstrips and entrance gates are by road. Transfer times are dictated by passenger numbers and their flight
variations. Charges are not levied for the transfer to/from MalaMala airfield. Other transfers are charged at a nominal rate per person. MalaMala is
unable to conduct transfers from Kruger Mpumalanga International Airport but MalaMala is able, on prior request, to make transfer arrangements on
behalf of Guests who have a Confirmed Reservation, at an additional cost.
5.2
Check-in time is 12 noon and check-out is 11h00 South African Standard Time. Should a Guest require an earlier check-in or later check-out time then
the Guest must request same from management and it shall be in management’s discretion to allow a variation. Arrivals after 20h00 South African
Standard Time are not permitted at any camp.

POLICIES
Children :
MalaMala Main Camp : Children under 12 years, sharing accommodation with full paying adults, pay the quoted child rate.
Sable Camp : Children under 12 years are not permitted unless exclusive use of the camp is reserved.
Rattray’s on MalaMala : Children under 16 years are not permitted.
Mount Anderson Reserve : Children under 8 years are not permitted.
Tour leader/pilot/driver/guide:
Subject to availability, B grade accommodation may be reserved for bona fide tour leaders, pilots, drivers and guides. B grade accommodation
rate shall apply, and is for accommodation and meals and does not include game drives and other activities.
CANCELLATIONS
No reservation is secure until the deposit detailed in the Provisional Reservation is paid and the Confirmed Reservation is delivered by
MalaMala to the Guest.
MalaMala is entitled to cancel a Confirmed Reservation in the event that the balance of the amount due in terms of the Provisional
Reservation is not paid by the due date or dates for payment.
MalaMala shall be entitled to charge the following cancellation fees should a Confirmed Reservation for any period outside high season be
cancelled by either MalaMala in terms of 7.2 or by the Guest:
o
5% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled more than 60 days prior to
scheduled arrival;
o
25% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled 60 days or less and 30 days or
more prior to scheduled arrival;
o
50% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled 30 days or less and 14 days or
more prior to scheduled arrival;
o
90% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled 14 days or less prior to
scheduled arrival.
For purposes of the Standard Terms high season is from 20 December in one year to 10 January in the following year. MalaMala shall be
entitled to charge the following cancellation fees should a Confirmed Reservation for a period in high season be cancelled by either
MalaMala in terms of 7.2 or by the Guest:
o
5% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled more than 90 days prior to
scheduled arrival;
o
25% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled 90 days or less and 60 days or
more prior to scheduled arrival;
90% of the quoted total reservation charge detailed in the Provisional Reservation if cancelled 60 days or less prior to
scheduled arrival.
7.5
Any cancellation fee shall be subject to the relevant provisions of the Consumer Protection Act such that if the Consumer Protection Act
allows only a smaller cancellation fee, then such smaller fee shall apply.
8.
GENERAL TERMS
8.1
Whilst at the Reserve the Guest shall comply with any reasonable instruction given to the Guest by an employee or representative of MalaMala.
MalaMala shall have the right to eject a Guest from the Reserve who fails to comply with any such reasonable instruction.
8.2
MalaMala shall have the right to eject a Guest from the Reserve who in the reasonable opinion of the management of MalaMala cause a nuisance
which interferes with the tranquility of the natural surroundings, which interferes with the reasonable enjoyment of the Reserve by other guests or which
could result in harm to the Guest or other guests.
8.3
The Guest shall be responsible for taking out comprehensive travel insurance covering them for personal effects, personal accident, medical and
emergency travel expenses and cancellation.
8.4
The Guest shall seek medical advice regarding prophylaxis and vaccination requirements.
8.5
MalaMala shall be entitled to change accommodation, game drive schedules and schedules for other activities which are absolutely necessary due to
unforeseen circumstances.
8.6
MalaMala shall not be responsible for any services which are provide by third parties.
9.
WAIVER AND INDEMNITY
9.1
Safekeeping of baggage and personal effects shall at all times remain the Guests responsibility. MalaMala will assume no liability for lost,
stolen or damaged personal effects or baggage.
9.2
Whilst MalaMala undertake to make all reasonable endeavours to ensure the Guest’s, the Guest’s family and dependents, and the Guest’s
invitee’s safety, it is an express condition of the Guest’s visit to the Reserve that MalaMala, its employees or agents, are not responsible for
loss of or damage to the property of the Guest, the Guest’s family and dependents or the Guest’s invitee’s property, brought onto the
Reserve, whether arising from fire, theft or otherwise, by whomsoever caused, or arising from negligence or wrongful act of any person,
whether or not in the employ of MalaMala.
9.3
The Guest, by making the reservation and entering onto the Reserve, irrevocably waives and abandons all and any claims of whatsoever
nature and howsoever arising which the Guest may have against MalaMala, its employees or agents, in connection with the facilities,
services, advice and activities made available to the Guest or used by the Guest in any way, and the Guest indemnifies MalaMala, its
employees and/or agents against any claims which may be made by any person arising out of or in connection with my waiver.
10.
LIMITATION OF LIABILITY
Notwithstanding anything to the contrary, and in any event MalaMala, its employees or agents shall not be liable to the Guest for any indirect,
consequential, incidental or contingent loss or damages of any nature arising out of a breach of contract, delict or any cause whatsoever.
11.
FORCE MAJEURE
If MalaMala is prevented or restricted directly or indirectly from carrying out all or any of its obligations due to any cause beyond the reasonable control of
MalaMala (including without limitation, war, civil commotion, riot, insurrection, strikes, fire, explosion, floods and acts of God), MalaMala shall be relieved of
its obligations during the period of the event and shall not be liable for any delay or failure in the performance of its obligations or for any loss or damages
which the Guest may suffer due to or resulting from such delay or failure, provided that written notice of the inability to perform shall be given by MalaMala
to the Guest within 72 (seventy two) hours of the occurrence constituting force majeure. If MalaMala invokes force majeure it shall use its best endeavours
to terminate the circumstances giving rise to the force majeure.
12.
BREACH
Should the Guest default in making any payment by due date for payment then, in addition and not substitution for what is set out elsewhere in these Standard
Terms, MalaMala shall have the right to cancel all contracts with the Guest subject always to MalaMala’s right to hold the Guest liable for damages. MalaMala
shall have the right to retain all money paid by the Guest pending determination of such damages and thereafter to set-off the amount so retained against the
amount owing.
13.
DELIVERY OF DOCUMENTS
13.1
For the purposes of delivery of legal documents, including legal process, and contractual and statutory notices, the Guest chooses delivery by hand, by
post, by fax or by email, and chooses the addresses including email addresses, and fax numbers, that the Guest:
13.1.1
inserts in any enquiry for a reservation;
13.1.2
records on its letterhead and/or other correspondence;
13.1.3
uses as its principal place of business;
13.1.4
records as its registered address;
13.1.5
uses to send communications to MalaMala.
13.2
Any notice delivered in terms of these Standard Terms, if delivered by hand, be deemed to have been duly delivered on the date of delivery and, if sent
by post, be deemed to have been delivered seven (7) days after posting and if sent by fax or email, be deemed to have been delivered on the day that
the fax or email is sent. A written notice of communication which has been actually received by the Guest will be regarded as delivered despite the fact
that it was not dispatched to a chosen address.
13.
COSTS
The Guest shall pay any costs incurred by MalaMala as a result of any breach by the Guest of these Standard Terms or any failure by it to pay an amount
on due date, on the scale as between attorney and own client. Such costs shall include any collection commission which MalaMala is required to pay to its
attorneys as a result of any action taken by them.
14.
NON-VARIATION
14.1
No person other than a director of MalaMala has any authority to contract on MalaMala's behalf on terms or conditions other than those contained
herein.
14.2
No variation of these Standard Terms shall be binding upon MalaMala unless reduced to writing and signed by a director of MalaMala.
15.
GENERAL
15.1
No relaxation or indulgence which MalaMala may grant to the Guest shall constitute a waiver of its right to enforce strict compliance with these
Standard Terms.
15.2
Advice, recommendations or opinions by representatives of MalaMala are given and expressed in good faith and shall not constitute representations of
any description, and shall not give rise to any claim against MalaMala.
15.3
The Standard Terms shall be governed by, and construed in accordance with, the laws of the Republic of South Africa.
