General Notes PresSTORE Backup, Backup2Go, Archive and Synchronize are single products, at least one of which is the primary, initially purchased license, to which any further licenses are added. (1) Standard Warranty Each purchased license includes the minimal legal warranty period, which begins with the date of activation of this particular license. An upgrade or expansion license purchased at a later date does not extend the warranty period of any previously purchased licenses. The licensee is entitled to bug fixes in form of minor updates (but not upgrades) for the length of the warranty period. (2) Update Service; Renewal and Termination The Software Update Agreement (SUA) is an agreement between the customer and ARCHIWARE as the supplier. The SUA gives automatic and unlimited access to major and minor updates, upgrades and patches of the ARCHIWARE products purchased, and are subject to the agreement. The term of the SUA starts with the activation of the software. The first year of SUA is free of charge. Additionally purchased licenses will not extend this time period. The Software Update Agreement (SUA) is available in two different versions: with a variable or a fixed term of contract. Variable term of contract: For a variable term of contract, the SUA agreement has to be signed and returned to Archiware within the first 12 months after the software is registered. Any additional licenses purchased within an existing SUA’s term will automatically be subject to this SUA. The term of contract is 12 months and is automatically renewed until it is canceled by one of the contracting partners. The contract must be cancelled at latest six weeks prior to its yearly renewal. Fixed term of contract: A fixed term of contract is signed for a period of two or three years (including the first year which is free of charge) together with the purchase of the primary license. The entire SUA fees are due immediately. Any additionally purchased licenses are subject to the same term of contract as the primary licenses. If no SUA is ordered with an expansion license, the SUA fees for the additional license will be charged upon registration of the license. The term of contract for the existing licenses is not influenced by the expansion licenses. An additional period of one or two years of SUA can be purchased at the end of the term of contract. Note: The standard warranty granted in §1 will neither expand nor limit the term of the Software Update Agreement. (3) The fee for a one-­‐time update/upgrade from an older version, when no Software Update Agreement exists: The update is considered to be a primary license (initial purchase) for which paragraphs 1-­‐2 apply. A SUA can be signed afterwards. (4) Upgrade from one PresSTORE single product or bundle to another PresSTORE bundle A customer with SUA can upgrade from one PresSTORE single product or one smaller bundle to a (larger) bundle (e.g. Professional bundle). The customer will be granted 75% of the purchase price of his original product towards the purchase of the (larger) bundle, provided his current license carries the latest version. Products from one platform cannot be upgraded to another. The serial number of the single product will become the serial number of his bundle. The Software Update Agreement (SUA) will automatically be transferred to the bundle for the rest of the current SUA period. A customer without SUA can only make use of the discount within the first year after purchase. Should the customer be employing an older version of a single product, he has to upgrade prior to making the transfer. Following the upgrade, the rules given above apply. (5) Trade-­‐in promotion When trading in a product of comparable functionality ARCHIWARE offers up to 30% discount. The maximum of 30% of the price of the PresSTORE license will be granted, but not exceeding the price of the old product. This does not include update and maintenance costs. To claim the discount, a copy of the previous product’s invoice must be immediately submitted. (6) Upgrade from PresSTORE (V1/V2/V3) to PresSTORE 4.x Version upgrades do not modify the existing scope of the license(s). Glossary and FAQs (1) What is a PresSTORE Media Management and Storage License? A PresSTORE Media Management and Storage License (MMSL) can be employed twofold: a. It can be assigned to a slot of a physical changer device. b. It can be used to store up to 1000GB of data in a PresSTORE volume in the file system on disk. c. Consequently, when multiple MMSLs are available, these can be assigned to any number of changers or used in any combination of assignment to slots and to volumes on disk. E.g., a Workgroup license comes with 24 units of MMSL. 16 units can be assigned to a tape library and 8 units can be used to store up to 8TB of data in PresSTORE volumes in the file system on any number of disks. (2) What is a PresSTORE Media Drive? A PresSTORE Media Drive is a tape drive. (3) What is the difference between a: a. Server Agent b. Virtual Server Agent c. Workstation Agent PresSTORE definition of a server operating system: Mac OS X Server, Windows Server 2003, Windows Server 2008, Linux or Solaris PresSTORE definition of a workstation operating system: Mac OS X, Windows XP, Windows Vista and Windows 7 A server operating system can run either on a physical computer or within a virtual machine. Server Agent License: This license type is required for a server operating system running on a physical computer. Virtual Server Agent License: This license type is required for a server operating system running within a virtual machine. Workstation Agent: This license type is required for a workstation operating system. It can EITHER be assigned for use by PresSTORE Backup2Go OR by the other PresSTORE products (Backup, Archive and Synchronize), but not by both.
