MINUTES OF THE 2 nd MEETING (2014 SERIES) OF BOARD OF APPROVAL FOR
EOU SCHEME HELD UNDER THE CHAIRMANSHIP OF COMMERCE SECRETARY
ON 24.07.2014 AT 02:15 P.M. IN ROOM NO. 47, UDYOG BHAWAN, NEW DELHI
The 2nd meeting (2014) Series of the Board of Approval for EOU was held on
24.07.2014 under the Chairmanship of Shri Rajeev Kher, Commerce Secretary in
Room NoA7, Udyog Bhawan, New Delhi. At the outset, the Chairman welcomed all the
members of the BOA.
2.1 (14)
Confirmation of Minutes of the 1st BOA (2014 Series) meeting held
on 03.04.2014.
The BOA ratified the minutes of its is' meeting held on 03.04.2014.

The Board noted the contention of CBEC that since Cutting Machine with Double
Blade Cutter does not find mention in Annexure-V to the Notification No. 52/2003­
Cus dated 31.03.2003 and that Customs Wing of the CBEC is examining this matter.
The Board, therefore, decided to defer the request

Mis Navin Fluorine International Ltd. - Application for conversion
of existing DTA unit to EOU under the jurisdiction of ISEZ.
The Board approved the proposal of MIs Navin Fluorine International Ltd. for
conversion of existing DTA unit to EOU. The Board further deliberated that since the
investment in plant and machinery of the said unit as well as its export during the last 3
years has been less than Rs. 50 Cr., the proposal could have been approved by UAC
under chairmanship of the Development Commissioner.

MIs Synergies Castings Ltd. an EOU under VSEZ- Request for
extension of the validity of Letter of Permission for a period of 5 years w.eJ.
17.04.2013.
The Board considered the proposal for extension of validity of LOP beyond 16.4.2014 in
respect of MIs Synergies Castings Ltd., an EOU under VSEZ and after deliberations
decided to extend the validity of LoP for a period of one year at a time for four times
upon payment of duties in accordance with Notification No. 5212003-Cus dated
31.03.2003. The extension of LoP shall not have an adverse bearing on the
adjudication proceedings initiated by C.E Authorities. The Board also agreed with
the recommendation of DC, VSEZ to extend the lease agreement between Mis
Synergies Dooray Automotive Ltd, and MIs Synergies Castings Ltd. The power to
extend the LoP annually for a period of four years was also delegated by the BoA to

DC, VSEZ subject 10 submission of its decision for perusal and ratification by BoA
on achievement of the following milestones:

The unit will buy land for their operation in DTA within 1 year from the date of
issuance of current extension of validity of LoP and submit land documents to
VSEZ by July, 2015.
Create civil structures within the 2 years from the date of current extension of
LoP i.e by July, 2016.
Start commencement of production in 4 years from the date of current extension
of LoP i.e by July 2018.
The above time lines for shifting the EOU from SEZ land will be reviewed by DC
before granting annual extension, and if the prescribed time lines are not met by
the unit, the case will be placed before BoA for reviewing the status of the LoP.

Mis Bio Plus life Sciences Pvt. Ltd., an EOU under CSEZPermission for procurement /import of data loggers as per provision of FTP.
After deliberations, the Board approved the proposal of Mi s Bio Plus Life Sciences Pvt.
Ltd., an EOU under CSEZ to allow the unit to procurelimport data loggers duty free
subject to provisions contained in FTP and instructions issued from Government of
India from time to time.
Mis Hothur Traders, an EOU under CSEZ- Extension of loP (which

lapsed on 24.01.2013) beyond 5 years for continuation under 100% EOU
scheme.
After deliberations, the Board approved the proposal of Mis. Hothur Traders, an EOU
under CSEZ for extension of validity of its Letter of Permission beyond 5 years for
continuation under 100% EOU scheme subject to the outcome of Hon'ble Supreme
Court's order in SLP No. 7366 and 7367 and conditions specified in FTP, HBP and
instructions issued from Government of India from time to time.

Mis TES Electronic Solutions (India) Private limited, an EOU
under CSEZ- Permission for inclusion of PCB designing (Software) and
Embedded Software Applications.
After deliberations, the Board approved the proposal of Mis TES Electronic Solutions
(India) Private Limited, an EOU under CSEZ for inclusion of PCB Designing
(Software) and Embedded Software Applications subject to condition that NFE
calculations should be done separately for services and manufacturing components
as per applicable rules.

Mis Strides Acrolab Ltd., Bangalore, an EOU under CSEZ­
Permission for destruction of imported raw material, packing material and
finished products as per provisions of FTP.

The representative of DoR stated that as per para 1(3)(d)(i)(ii) of notification 52/2003­
cus dated 31.3.2003, duty can be demanded if goods , other than capital goods are
neither used for manufacture of export goods nor cleared for home consumption within
3 years of their import. The Board observed that para 6.15(b) of FTP provides no duty
shall be payable for destruction of imported raw materials and finished products within
the EOU after intimation to customs. Further DoR reported that the Customs
notification shall be aligned with the provisions of FTP. Therefore, the Board decided to
defer the proposal.

Mis Indosolar Ltd., an EOU under NSEl - Renewal of LoP.
The issue was discussed in detail and the BoA noted that the unit is negative NFE. After
deliberations, the Board decided to approve the proposal of extension of LoP for a
period of five years in respect of Mis Indosolar Ltd. , an EOU under NSEZ subject to the
payment of duties and penalties in accordance with Notification No. 52/2 003-Cus
dated 31.03.2003, and that the extension of LoP shall not have an adverse bearing
on the recovery proceedings to be initiated by C.E Authorities .

Mis Combitic Global Caplet Pvt. Ltd., an EOU under NSEl­
Permission for consolidation of goods (imported/locally procured) related to
manufactured articles and export thereof.
After deliberations, the Board decided to approve the proposal of the unit to procure
from DTA or by import some PP medicines and organic chemicals for exportation of
same without payment of duty, to the extent of 5% FOB value of such manufactured
articles exported by the unit in the preceding financial year along with the goods
manufactured by them subject to provisions contained in FTP and instructions
issued from Government of India from time to time.

MIs Prime Exporters, an EOU under KASEl- LoP extension by 5 years.
After deliberations, the Board decided to approve the proposal for extension of LoP of
MIs Prime Exporters under EOU scheme operating in KASEZ for a further period of 3
months from the date of expiry of LoP i.e upto 30.09.2014. The Board also directed DC,
KASEZ to report on the compliance of the conditions imposed upon the unit while
granting the LoP and its subsequent renewals from time to time and the earlier
directions of the BoA in its meeting held on 03.04.14, with his clear recommendations
within 2 weeks.
2.12 (14) MIs San Polyplast Exim Pvt. Ltd., an EOU under KASEl LoP extension
by 5 years.
After deliberations, the Board decided to approve the proposal for extension of LoP of
MIs San Polyplast Exim Pvt. Ltd. under EOU scheme operating in KASEZ for a further
period of 3 months from the date of expiry of LoP i.e upto 30.09.2014. The Board also

directed DC, KASEZ to report on the compliance of the conditions imposed upon the
unit while granting the LoP and its subsequent renewals from time to time and the

extension by 5 years.
After deliberations, the Board decided to approve the proposal for extension of LoP of
Mis Aishwarya Plast Exports Pvt. Ltd. under EOU scheme operating in KASEl for a
further period of 3 months from the date of expiry of LoP i.e upto 30.09 .2014. The Board
also directed DC, KASEl to report on the compliance of the conditions imposed upon
the unit while granting the LoP and its subsequent renewals from time to time and the
earlier directions of the BoA in its meeting held on 03.04.14, with his clear
recommendations within 2 weeks.
