 Arrowhead Rental Agency Addendum One ***READ THIS DOCUMENT CLOSELY, IT IS LEGALLY BINDING*** This is an Addendum to Lease Listing Agreement dated ____________________ between Arrowhead Rental Agency herein called “Broker,” I/We, _____________________________________________________, (Owners of subject property) herein referred to as Owner. All terms of this agreement supersede the Lease Listing Agreement. EXCEPTIONS: If property is sold or transferred by law, the obligation to honor existing rental contract passes to the successors in title. Owners warrant they will make successors aware of this requirement, in written form, prior to title change. In the event that either party wishes to cancel this agreement at the end of a lease or month to month contract, provided the existing tenant does not continue to rent the home, a 60 days written notice by certified or registered or email is required. Owner agrees to pay Broker’s commission on all rental amounts generated by Broker or through Broker’s efforts. Owner further agrees, that if any tenant procured by Broker shall by coincidence or purpose contact the Owner (or vice‐versa) for a future rental or purchase instead of Broker, then any tenant so procured in the renting of the herein described property is and shall remain the valid customer of Broker for a period of 365 days following the expiration of this contract or any extensions thereof. Should Owner rent to any such customer, Broker shall be entitled to a full commission just as though the customer had contacted Broker and the subject property was subsequently rented as a result of that contact. The property is to remain off the market during the tenants lease. If the tenant buys the property anytime during their occupancy or within one (1) year of vacating the property, Broker is entitled to a 6% commission of the agreed upon selling price, if property is sold under circumstances described above. Owner hereby agrees security deposits are adequate and authorizes Broker to determine at end of tenancy the amount of cleaning and/or damage, if any, to be charged against and deducted from deposit. It is specifically agreed that Broker is in no way or manner liable to Owner for utility charges generated by tenants, nor for any cleaning, theft, or damage costs that may be or is determined to be in excess of the deposit. Owner warrants that they will maintain at least one properly mounted but unlocked, currently charged, suitable fire extinguisher in a conspicuous location in the home. Owner warrants Owner will be specifically and exclusively responsible for maintaining sufficient properly operating smoke detectors to meet all present and future applicable ordinances for tenant safety. Smoke detectors, which “chirp” or do not sound when the button is pressed need new batteries or need to be replaced. Owner must, by law, have a deadbolt on all exterior hinged doors. (909) 337­7368 / Fax (909) 337­6036 Arrowhead Rental Agency Owner further warrants that he/she will consistently maintain any furniture, appliances, stairs and utility systems in a safe and suitable manner. Owner agrees to maintain sufficient commercial insurance to cover the premises, dock if any, and walkways if applicable for loss due to fire, natural disaster, vandalism and malicious mischief, and to cover claims for injuries to persons and property upon the premises, and in such commercial insurance policy to name Broker additionally insured as “Property Management Company”. Owner accepts the liability for obtaining appropriate insurance. Owner will promptly furnish Broker with specific evidence of Broker insurance coverage. Further, Owner hereby agrees to indemnify Broker, his agents and employees, and agrees to hold them harmless from any claim for any claim for injuries to persons and/or damages to property occurring upon or in connection with the premises and this agreement. This provision covers repair, service and cleaning persons, tenants, and their guests, if any. In case of emergency, and after reasonable attempts to contact Owner Broker will act on Owner's behalf to correct a safety hazard, condition potentially damaging to the property, or dangerous to Tenants, and Owner accepts complete financial and legal liability for related repairs up to $500.00 each. Owner will be responsible for workmen’s compensation if needed. In non‐emergency situations, Broker will attempt to contact Owner, though not guaranteed, and Broker is not obligated to act or authorize repairs, etc. In all but emergency situations, Broker will have Owner authorize repairs or other work, so the cost and scope will be clear. Nothing herein shall render Broker liable for any losses to Owner, including, but not limited to, any loss arising out of any unpaid check issued to Broker by tenant. Only cashier’s checks or money orders shall suffice for pre‐move‐in payments. Owner is aware that Broker will accept personal checks for on‐going rental payments, but Owner understands that in case of a non‐sufficient funds check, Owner will refund all money to Broker which was sent to Owner. To minimize “bad” checks, rental contracts may specify “cashier’s check, money order or cash”, but Owner instructs Broker to accept personal checks in lieu of loss of rental. Tenant pays for his/her own credit check. Except for emergencies, by California state law, tenants may require 24 hours’ notice before Owners, Owner’s agents; inspectors or work people can enter the property.
