3. The Trail of Tom Robinson--Rhetorical Devices, CDWs, and Appeals--12/15/2014--The trial of Tom
Robinson is a travesty of justice. Respond to the following activities by typing your responses in word
processor, and then upload your responses to the appropriate location on Socrative:
a. Analyze the testimony given at Tom Robinson’s trial. For each witness (Heck Tate, Bob Ewell,
Mayella Ewell, Tom Robinson), discuss the following elements: Pathos, Logos, Ethos.
b. Develop a Claim, Data, Warrant for one of the 4 witnesses.
c. Analyze the testimony of Bob Ewell, Mayella Ewell, and Tom Robinson. Develop a SPES in which
you identify the grounds Atticus will have for appealing the jury’s verdict. Find at least two pieces of
evidence from the text to support your claim. Explain why that evidence justifies an appeal. Finally,
synthesize your position with fresh new insights or perspectives.

PART A:
Heck Tatea) Pathos: “She was pretty beat up” page 223, “Asked her if he
took advantage of her and she said yes..” he uses strong words
to describe the injuries.
b) Logos: “Her right eye, I said..” page 225
c) Ethos: He is a police officer, and a witness
Bob Ewella)
Pathos: “Well, Mayella was raisin’ this holy racket so I dropped
m’load and run as fast as I could…” Page 231

Logos: “What time was it Mr. Ewell?” “Just “fore sundown.”

Ethos: He is the father of Mayella, and saw part of the crime
occur.
Mayella Ewella)
Pathos: “-he chunked me on the floor an’ choked me’n took
advantage of me.” Page 241

Logos: “Was this the first time you asked him to come inside
the fence?” “Yes it was”
c)
Ethos: She was the victim of the crime.
Tom Robinsona)
Pathos: He tells everything without hesitation, and very
passionately. He even starts to cry.
b)
Logos: “that was the only thing, only furniture, ‘sturbed in that
room, Mr. Finch, when I left it. I swear ‘fore God.” Page 259
c)
Ethos: He was the “culprit”
PART B:
Tom Robinson
Claim: I am innocent.
Data: “she’d grabbed me round th’ legs,” “an’ she sorta jumped on
me.” Page 259. His left hand is also disabled.
Warrant: If Tom Robinson is disabled in his left hand, and Mayella
got hit on the right eye, and Bob Ewell is left handed, you normally
don’t punch across, you punch straight ahead. Therefore Tom
Robinson is not responsible for beating Mayella, because he cannot
punch straight ahead if he is disabled on that arm. Also, what Tom
said happened makes more sense, and couldn’t just be a story he
made up on the spot. Also, Bob and Mayella’s testimonies
contradict.
PART C:
STATEMENT: Atticus has many reasons to make an appeal. Many
of the testimonies are unreliable and contradict.
PROOF: When Mayella goes to testify, she says “He’s does tollable,
‘cept when-” (page 245) and when Mayella changes her mind about
how many times she let him inside the fence.
EXPLAIN: Mayella basically flatly says that her father abuses her
when he gets drunk, which explains the injuries of Mayella. Also
when she decides about how many times she let him inside the
fence, it is obvious that she is trying to figure out which would
make a better story, and benefit her the most.
SYTHESIZE: Therefore, Atticus has many reasons to take this case
to a higher court. There are many flaws and inconsistencies in the
testimonies of Bob and Mayella Ewell, and basically everyone knows
Tom is innocent, it is just a matter of his skin color. Since society is
so biased because of race, the court is too, which majorly effects the
case and determines who is innocent.
