NEWSLETTER DESIGN/PRODUCTION: MARCI ROSENBLUM @ RWD GROUP (845) 364-0222 [email protected] President MANNION On September 17, 2007, I along with Frank, Joe, Glenn, Artie, our attorney Mark Soroka and consultant Allen Brawer, negotiated a tentative agreement with the City. This last negotiation session was concluded after almost 12 hours of bargaining. I called a meeting with the Negotiating Committee/Executive Board for September 19, at the Union Hall. The package was presented to them in full detail and they approved this agreement unanimously. We as a Union were on the way of making SOA history by having the ability to vote and except a contract before our current contract expires. If accepted, this will be a FIRST in the known history of this great Union. This is something we can all be proud of. As of this writing, the ballots are in the mail and you will have accepted or rejected our tentative contract with the City of New York. Results will be posted on our website and in our next issue of “In Unity”. I held a Contract Meeting for all of our Active members at the Ronald F. DiCarlo Training Facility”in Floyd Bennett Field on September 26. Close to 100 members came to listen and ask questions. In all, it was a very productive meeting with little opposition. There seems to be a very small minority that unfortunately do not know — or better yet do not care — about the history of our negotiated contracts and the impact, good or bad, that it had on them or others. This is a sad frame of mind to be in. If it was up to some, they wouldn’t care about the Retirees or the new Brothers and Sisters that this contract was able to help. I thank God that they are at very best, a small minority in numbers. They are what I would classify as the “Me, Myself and I” people. Their only care is what’s in it for “Me, Myself & I”, no one else. We had an opportunity in this double round to extend out our contract dates to generate monies to be used to benefit all our members, present, past and future. By delaying certain raises, we received value to do this. We did not have to do any “Give Backs” in these rounds, and received excellent value for these extensions. With the exception of the PBA, all Uniformed Unions have done the same and are in agreement of the value factor. I have been approached by President Thomas Nazzaro of the NYCDS Retirees Association based in Staten Island to speak at one of his upcoming membership meetings. Once I can work out my schedule with him as well as other Retiree Groups, I would be happy to speak to all of our Retired members about this and other issues of their concern. I’m happy to see a new Retiree Group starting in the Poconos and surrounding area. Good luck to Steven Schmalzried with his new endeavor. In closing, I would like to thank all those that attended this year’s Annual Shop Steward Convention held in Princeton, NJ at the Chauncey Convention Center. We all had a great time of comaraderie and learning. The sessions were filled with information that should be brought back to their locations and shared with their fellow Officers. Tools were learned to help them protect the Officers they represent. The time we shared at our meals and down time is what good memories are made of. I look forward to next year’s Convention and I’m hoping that more of our Shop Stewards attend our Union Meetings to qualify for these very informational and team building experiences. Message From Secretary-Treasurer FERBER Active & Retired Members Get New Benefit that Could Help Save a Life President Joe Mannion and the Board of Trustees announced a new benefit at the October 11, 2007 union meeting. Members, both active and retired, are now eligible for advanced screening tests through Inner Imaging. This will help with the early detection of coronary diseases. Inner Imaging and the Continuum Heart Institute at Beth Israel Medical Center have collaborated to open the first Risk Assessment and Preventive Cardiology facility in metropolitan New York. Inner Imaging offers advanced cardiac imaging called Electron Beam Tomography (EBT). Recognized as the Gold Standard in Heart Scanning, EBT is clinically proven to detect coronary artery disease (plaque) when it is preventable long before symptoms occur. Their advanced screening test includes Heart Scan, Lung Scan, Full Body Scan, Virtual Colonography and Non-invasive EB Angiography. Testing is generally not recommended for those under 35 years of age. President Joe Mannion said the Convention is one of the best opportunities for the Shop Stewards to gather together and hear about problems, issues and solutions from other Shop Stewards throughout the Union. Union’s Historic Contract Approved by 85% SOA members voted overwhelmingly in approval of the new historic contract recently finalized by the Union. President Joe Mannion said that 719 members returned their ballots with 612 accepting the terms and 90 rejecting. There were 17 ballots deemed invalid for one reason or another. “This is a historic contract for our union and one that we should all be proud of,” Mannion said. “I think the overwhelming result of 85 percent approval shows that members were more than satisfied with the terms. A special thanks to all those who took the time to vote and for showing your support and confidence in us as we worked on your behalf to make it this far.” “We’re all very happy and pleased that this phase is behind us,” he said. “Now we’ll be working quickly to get everything into place as soon as possible so our members can be paid quickly and on time.” Union Meeting Location? The 6th floor classroom at the Central Repair Shop (CRS) is no longer available to us because of major ongoing renovations. As Active members already know, our Sept 26, Contract Meeting was held at the Floyd Bennett Field Training Center. On Oct. 11, we held the General Union Meeting at Queens East 7a. The upcoming November 1 General Union Meeting will be held back at the Floyd Bennett Field Training Center Location since it had more room to accommodate us. While neither of these locations are as centrally located as we would like, when choosing between the two locations, Floyd Bennett wins. Don’t forget the Veteran’s Day Parade on November 11, on Fifth Avenue in Manhattan. 7 A Members “Sanitation Heart Bill” Experience Dear Joe, I thought it best I sit down and describe to you my recent experience, successfully applying for ¾ Disability under the Sanitation Heart Bill. Both to inform the membership what they are expected to provide, and should consider if they have Cardiac issues and feel they are eligible. First and really foremost is the thought to think carefully before retaining an attorney to help through the application process. Besides the application itself (an easy to fill out form) it was left to me to gather up all of the supporting medical records for NYCERS. Procedures, test results, hospital stays, doctors notes (which I was told by my attorney that it would be better collected by me, if he did it, they would charge him per page and he would simply pass that charge to me). Getting the documents was pretty straight forth. I made copies and hand delivered everything to NYCERS myself. It happened that I was missing some notes they needed. They called me a few weeks later directing me to submit them. I should mention that NYCERS overall was very helpful. While it required visits to Jay Street, the couple of times I went there for guidance they were very patient and answered all of my questions completely. The Medical Board exam itself was conducted at Jay Street. NYCERS sent a notice prior to my exam, Warning that anyone accompanying me would have no input or able to speak, and that if anyone other than I voiced an opinion or interfered, the exam would be terminated. There was no point in having my attorney present so he didn’t attend. A couple of days after the exam I was able to call NYCERS direct to find out their decision. I can’t speak for anyone’s experience but mine, and I wouldn’t say to definitely go it alone, but in my case I can tell you that my attorney had an advisory function only. The decision by NYCERS is of course strictly based upon one’s medical situation and that said, attorneys have a minimal involvement. Knowing what I do know, I would have done it by myself. I went into it with my eyes open. Being apprehensive I thought best to have a lawyer. But, the word should go out that legal assistance is not mandatory to apply. I’ve recently heard from another member that was looking into applying. He found an attorney that is offering his services for the same amount I paid, $10,000, but had to pay $3,500 up front, non-refundable regardless of the outcome. The other $6,500 must be paid if approved. In my case it was strictly based upon a favorable ruling. The only charge was an up front $200 administration fee if I was denied. In either case, that’s quite a number for what in my case amounted to several phone calls. Joe, if anyone would like to speak to me further about this I’d be happy to. When faced with the need to retire under the Heart Bill there are obviously other more pressing things going on and shouldn’t have to stress out over the process itself. As I retire, I should say I am grateful for everything over the years, both you and the guys in the Hall. My COB is in a couple of days, 10/1, and it’s really nice to hear this week that you have another good contract for the Active members in the works. For that, and for the many times I was on the job to witness 444 represents us through sometimes (and all to often) contentious negotiations, over issues large and small, my sincere thanks. I’m sure it will be very helpful to our brothers & sisters if they need to go this route. If anyone needs your assistance, we will contact you first and give you their contact information. It was told to me by some attorney’s that this Heart Bill was not for the Supervisory ranks, I’m proud that you proved them wrong and I knew you would. This Heart Bill is for all Uniformed Sanitation and was fought hard by this Union to get in the memories of Supv Wright, Supv Sanchez, Supv McMillan, Supv Mitchell and Supv Thomas who all died from heart attacks without the Heart Bill. They should always be remembered for what they helped us accomplish in protecting the future Heart Bill recipients. My husband Louis was a Foreman in Staten Island #3, Section 32 and he retired in November 1987. A lady from my church gave me a copy that she sent to the Board of Education in Florida. She couldn’t describe my dear husband any better. I’ve included a picture of our 55th Anniversary. We also gave four boys to the Marine Corp., the oldest one died in Vietnam. Glad to write this letter. Julie Boria Wife of Retired Supv. Louis Boria (I would like to thank you for letting us share your pride for Louis. His accomplishments and service to this Country are truly the definition of a Hero. God Bless the Boria Family and your sacrifices, God Bless our Military and most of all God Bless America! — JM) May 13, 2001 Dear Mr. Hagerty, I want to thank you for this opportunity to tell you about a friend of mine, Louie Boria. I met Louie and his wife Julie a few years ago at our church, Northside Baptist Church in Apopka. As a teacher, I look for local individuals, heroes if you will, that I can hold up to my students as an example of what America really stands for. Louie is one that I had the opportunity to not only interview, but to also know on a day to day basis. I would like to tell you about Mr. Boria and suggest that you recognize him in your school’s Memorial Day program. I would also recommend him to talk to students in your American History classes. He can make the history period between WWII and Vietnam come alive for them, they will really see the sacrifices and dedication Americans once had. Perhaps through his influence, we can help teenagers see what history and being an American is all about. Louie Boria was 16 years old in 1943. World War II was cranking up and America needed men and women to support the war effort in both Japan and Germany. Louie, like a lot of American boys during that era, joined the Marines after telling them he was really 18. Louie joined to see action and action he really saw! He was promptly trained and shipped out to the Philippines. He landed with the 5th Amphibian Force at Leyte, Philippines in the Pacific Campaign. He was there for the liberation of the Philippines from Japan. He was also wounded there and received the first of many commendations. After WWII, Mr. Boria stayed in the Marines and was again sent into action in Korea. He landed at Inckon, Korea on September 16, 1950. He was the Sergeant of an infantry platoon during this conflict. He was again wounded and received his second Purple Heart. This second wound later caused him to have hearing loss, and he now wears hearing aids. Among Louie’s other commendations for wartime duty are: 2 Purple Hearts, 2 Presidential Unit Citations, the Korean Presidential Citation, and the Navy Unit Citation. He has numerous medals and ribbons he had earned for marksmanship, valor and service to his country. In 1953, Louie and Julie were married and will soon celebrate their 50th wedding anniversary. The Borias had eight children, four daughters and four sons. Louie and his wife Julie’s dedication to their country did not end when Louie took a medical discharge for his war injuries after 17 years as a Marine. He set an example for his own children. As a matter of fact, all four of his sons grew up to become Marines! Julie and Louie gave the greatest sacrifice when their oldest son Louis III died in action of wounds received at Quan Tri Vietnam. Every year, the Boria’s invite their neighbors and friends to a Memorial Day Service at their house. They have erected an American flag and monument to their son’s honor, and to all those who have served America. Louie dons his uniform and he and Julie lead in a short prayer and pledge. Usually, someone gives a brief message about Memorial Day and the sacrifices made by the American families throughout the years. If you ever want to attend a moving service for one of our own, you should attend this one. When I asked Louie why he became a Marine and gave 17 years of his life, he said, “I love the Marine Corps. It was my life. I am proud of my four sons for being Marines, too. The Marines changed my life. It motivated me to do things I never thought I could do.” I asked Louie whey the Marines? He gave a simple answer. “If I had to go to combat, I would want to go with the Marines. Sempre Fi, always faithful.” When I look at today’s teenagers, so many of them seem lost and like they are wandering around without purpose. People like the Borias and their sons can give them direction. His advice would be serve God, family and your country. Join the Marines of one of the other Armed Force to find a place in your future and America’s. The Borias exemplify the best in America and we need to honor them this Memorial Day. Joe Accardo, is the proud winner of “Miss Teen Dance Arts Plus” Title, a National Dance Competition held in Lancaster, PA, July 18-20, 2007. Stephanie competed against other dancers from across the country in her age group, and performed a solo in the Jazz category for which she received “Highest Overall Score 15-16 Year Old Level 2”. She received a 294.6 out of a possible 300. Stephanie is also a member of the National Honor Roll Society and Captain of the St. John Villa Academy High School Varsity Soccer Team.
