RECOMMENDATION: Adopt the resolution.
FUNDING: No financial impact.
BACKGROUND:
California Elections Code Section 10515 provides that when the number of candidates
for office for a special district board of directors does not exceed the positions to be
filled, the Board of Supervisors shall make appointments in lieu of an election. Officers
so appointed serve exactly as if elected at a general district election for office. See the
attached resolution for a list of appointments and Certificate of Facts that includes a list
of vacancies for special district offices where there were insufficient candidates. The
Board of Supervisors may appoint any person who is'~qualified on the date when the
election would have been held" to such vacancies.

OF THE BOARD OF SUPERVISORS OF THE COUNTY OF NEVADA
RESOLUTION MAKING APPOINTMENTS IN LIEU OF GENERAL
ELECTION HELD ON NOVEMBER 6, 2012 GENERAL ELECTION
WHEREAS,Elections Code Section 10515 provides that if, by 5:00 p.m. on the 83rd day
prior to the day fixed for the general district election: only one person has filed a declaration of
candidacy for any elective office to be filled at that election; or no one has filed a declaration of
candidacy for such an office; or in the case of directors to be elected from the district at large, the
number of persons who have filed a declaration of candidacy for director at large does not exceed
the number of offices of director at large to be filled at that election, and if a petition requesting
that the general election be held has not been presented to the officer conducting the election, the
county clerk shall submit a certificate of these facts to the Board of Supervisors and request that
it, at a regular or special meeting held prior to the Monday before the first Friday in December,
appoint to such office or offices the person or persons, if any, who have filed declarations of
candidacy. The Board of Supervisors shall make such appointment; and
WHEREAS,a certificate ofthe above facts has been submitted by the County ClerkRecorder/Registrar of Voters to the Board of Supervisors; and
WHEREAS,the following persons are nominees for director either at large or by division
in the special districts listed for the November 6, 2012 general district election, but the number of
nominees for director at large does not exceed the number of offices to be filled:
NOW,THEREFORE,BE IT RESOLVED BY the Board of Supervisors, of the County of
Nevada, State of California, that pursuant to Election Code Section 10515 the proposed nominees
set-forth in E~ibit A are deemed qualified to fill the number of vacancies within the special
districts' board of directors, and hereby appoints the nominees to the board of directors of their
respective districts.
