The co-operation of the public is sought to
establish the identity of the person or persons
responsible for the death of Richard Mladenich
at St Kilda on 16 May 2000.
A reward of up to one million dollars
($1,000,000) will be paid at the discretion of the
Chief Commissioner of Police for information
leading to the apprehension and subsequent
conviction of the person or persons responsible
for the murder of Richard Mladenich.
In appropriate cases, the Director of
Public Prosecutions may consider, according
to established guidelines, the granting of
indemnification from prosecution to any person
who provides information as to the identity of
the principal offender or offenders in this matter.
Any information given will be treated as
confidential and may be given at any time to
Crime Stoppers on 1800 333 000.
Any payment will be subject to the applicant
signing a deed of confidentiality prior to

Under section 206, Schedule 10, Clause 2 of the Local Government Act 1989, the Southern
Grampians Shire Council, at its Ordinary Meeting held on Wednesday 14 October 2015, having
complied with section 223 of the Act and having determined the road shown hatched on the plan
below was closed in 1959 due to safety issues and the road cross-hatched on the map below was
substituted as the deviated road to be transferred to Crown land, hereby gives notice of its intention

Under section 206 and Schedule 10, Clause 3 of the Local Government Act 1989, Moira Shire
Council has resolved that Hamilton Lane, Cobram, as shown hatched, cross-hatched and marked
‘A’, ‘B’, ‘C’ and ‘D’ on the plan, is not reasonably required as a road for public use and resolved to
discontinue the road and transfer the land to the Crown.

OPERATION AND MAINTENANCE OF
ONSITE WASTEWATER TREATMENT
SYSTEMS
Pursuant to section 119 of the Local
Government Act 1989, notice is hereby given
that the Hepburn Shire Council has adopted
Local Law No. 3 – Operation and Maintenance
of Onsite Wastewater Treatment Systems.
The title of the Local Law is Local Law
No. 3 – Operation and Maintenance of Onsite
Wastewater Treatment Systems.
The purpose and general purport of the
Local Law is to:
a) provide a mechanism for Council to ensure
the ongoing operation and maintenance of
onsite wastewater treatment systems so that
they do not:
(1)cause a nuisance to others because of
odour;
(2)cause a nuisance to others because of
discharge;
(3)cause or could cause a risk to public
health; and
(4)
cause
or
potentially
cause
environmental or property damage.
b) provide a mechanism for Council to require
the owner or occupier of the land on which
an onsite wastewater treatment system is
installed to:
i.make the onsite wastewater treatment
system available for inspection by an
authorised officer when requested to do
so;
ii.
ensure that the owners or occupiers
of high-risk properties as identified in
the Domestic Wastewater Management
Plan must provide a status report by
a suitably qualified professional or
servicing agent. The owner/occupier
of the land must submit the report to
Council within 90 days of the issue
date of the initial request by Council;
and
iii.
have the septic tank inspected by
a suitably qualified professional or
servicing agent including submission of
a regular maintenance report as required
by EPA Certificates of Approval or as
Victoria Government Gazette
required by any conditions contained
on any approved Onsite Wastewater
Treatment System (Septic Tank)
permit issued by Council. The owner/
occupier of the land must submit the
report to Council within 30 days of the
maintenance inspection.
Note: This requirement cannot be
retrospectively applied to any system that
has been lawfully installed and is operating
where the system is not causing a public
health nuisance, or where no permit
conditions were required when the Onsite
Wastewater Treatment System permit was
granted.
c) provide a mechanism for Council should an
authorised officer determine that an onsite
wastewater treatment system is operating
or maintained contrary to subclause (2.1).
The owner or occupier of the land on which
the septic system is located may be required
to modify the system to the standards
prescribed in the EPA Code of Practice for
Onsite Wastewater Management and the
Australian Standard AS/NZA 1547.

held on 27 January 2016, it resolved to make
Administrative Procedures (Use of Common
Seal) Local Law No. 2.
The purpose of this Local Law is to regulate
and control the use of the Council’s Common
Seal and to revoke the existing Local Law of
the same name.

When the Common Seal may be used
The Common Seal may be used only on the
authority of Council and in accordance with this
Local Law.
Provides who may authorise the use of the
Common Seal
Where Council authorises the use of the
Common Seal, the affixing of the Common Seal
to any document must be witnessed by not less
than 2 people comprised of:
1. Councillors; or
2. The Chief Executive Officer;
3. A senior officer occupying the position of
Chief Financial Officer, Director Corporate
Services or Executive Manager Corporate
Administration and Customer Service;
4. Or any combination of persons referred to in
Clauses 1, 2, or 3 except that not more than
1 of the persons described in Clause 3 may
witness the affixing of the Common Seal to
a document.
Delegation to the Chief Executive Officer
Delegates the power to the Chief Executive
Officer to authorise the use of the Common Seal
in certain circumstances.
Offences
Provides for the establishment of offences
against the Local Law and the application of
penalties.
Repeal and Revocation of existing Local Law
Provides for the repeal and revocation of the
existing Local Law of the same name, adopted
in 2006.

whole of the municipal district of the Council.

Classic waterskiing event are prohibited from
entering and remaining in the waters of the Lake
Moodemere south of the 5 knot signs 180 metres

ORDER PROHIBITING OR RESTRICTING THE ENTRY OR IMPORTATION OF
EUROPEAN HOUSE BORER HOST MATERIAL INTO VICTORIA
I, Gabrielle Vivian-Smith, as delegate of the Minister for Agriculture, make the following Order:
1Objective
The objective of this Order is to prevent the entry or importation of the exotic pest, European
house borer, into Victoria.
2
Authorising Provision
This Order is made under section 36 of the Plant Biosecurity Act 2010 (‘the Act’).
3Commencement
This Order comes into operation on the date of making.
4
Definitions
In this Order –
‘European house borer’ means the exotic pest Hylotrupes bajulus (Linnaeus);
‘European house borer host material’ means any timber of pinewood, including seasoned
pinewood, or any item made from timber of pinewood, including pallets, packing materials
and structural pinewood, but excluding household furniture, and items made from processed
pine;
‘pinewood’ means any wood from trees of the genera Abies Mill, Picea A. Dietr, Pinus L. or
Pseudotsuga Carriere;
‘seasoned pinewood’ means pinewood that has a moisture content of 20% or less
when tested in accordance with Australian Standard AS1080.1 – 1997 ‘Timber: methods of
test – moisture content’;
‘structural pinewood’ means any pinewood which is part of an existing building or is to be
used in the construction of a building.

Prohibitions, restrictions and conditions
(1) The entry or importation into Victoria of any European house borer host material is
prohibited.
(2) Sub-clause (1) does not apply if the European house borer host material:
(a) was grown or packed on a property located in a State or Territory, or part of a
State or Territory, for which an area freedom certificate, issued by an officer
responsible for agriculture for the State or Territory where the host material
was grown or sourced, is currently in force certifying that the State or Territory,
or part of the State or Territory, is known to be free from European house borer;
or
(b) is accompanied by a plant health certificate, assurance certificate or plant health
declaration, certifying or declaring that the host material has been treated in a
manner described in the Schedule.

Verification
Where requested by an authorised inspector, European house borer host material imported into
Victoria, which is required by clause 5(2) to be accompanied by a certificate or declaration,
must be presented to an authorised inspector for inspection.

as being suitable for the purpose of excluding European house borer; or
(b) by fully wrapping in plastic film which is not ripped, torn or otherwise damaged; or
have one dimension less than 4 mm thick; or
in the case of pallets be sourced from a supplier approved under a scheme administered by
Quarantine WA.
Notes:
1.
Section 38(1) of the Act provides that a person is guilty of an offence and liable for a penalty not exceeding
60 penalty units in the case of a natural person, and 300 penalty units in the case of a body corporate, for knowingly
causing, permitting or assisting any host material to enter or be imported into Victoria in contravention of an
importation order.
2.
Section 38(2) of the Act provides that a person is guilty of an offence and liable for a penalty not exceeding
10 penalty units in the case of a natural person, and 60 penalty units in the case of a body corporate, for causing,
permitting or assisting any host material to enter or be imported into Victoria in contravention of an importation
order.
3.
Terms used in this Order that are defined in the Act have that meaning.

submissions were received and have been considered in accordance with section 11 of that Act.

Amendment C170
The Minister for Planning has approved Amendment C170 to the Wyndham Planning Scheme.
The Amendment comes into operation on the date this notice is published in the Government
Gazette.
The Amendment:
Facilitates the Black Forest Road North Precinct Structure Plan by rezoning land to Urban Growth
Zone – Schedule 7 (UGZ7); applies the Land Subject to Inundation Overlay (LSIO) to part of the
land; amends the Schedule to Clause 52.01 to require a 3% public open space contribution for land
zoned UGZ7; amends the Schedule to Clause 52.17 to remove the need for a planning permit for
native vegetation removed in accordance with Commonwealth environmental approvals; amends
the Schedule to Clause 61.03 to reflect mapping changes; amends the Schedule to Clause 66.06
to specify the Licensee of the Brooklyn to Lara Transmission Gas Pipeline as the body to which
notice is given in accordance with Schedule 7 to the Urban Growth Zone; and incorporates the PSP
by inserting a new entry ‘Black Forest Road North Precinct Structure Plan, December 2015’ in the
Schedule to Clause 81.01.
