NCJUA/NCIUA PRODUCER CERTIFICATION NCJUA AND NCIUA OVERVIEW • • • • • Created by the NC General Assembly in 1969 to provide an adequate markets for basic property insurance. Not an agency of the NC state government Policymaking body is a 14-member Board of Directors Supported by all insurers “member companies” who are authorized and engage in writing property insurance in NC. Website: www.ncjua-nciua.org NC Joint Underwriting Association (FAIR Plan) Adequate market for basic residential and commercial property insurance FAIR = Fair Access to Insurance Requirements Encourages improvement of property Equitable distribution among property insurers “Market of last resort” Dwelling Fire and Commercial Fire coverage available in all areas of the state except the barrier islands No contractual relationship between producers and the Association—Producers have NO binding authority. NC Insurance Underwriting Association (Beach Plan) Adequate market for basic property insurance in the Beach Area. – Beach Area = Barrier islands – Coastal Area = 18 counties that form the eastern border of NC from the Virginia state line to the South Carolina state line Insurance necessary for financing property in support of economic development the Beach/Coastal Areas Equitable distribution among property insurers Adequate market for Wind and Hail policies in the Beach and Coastal Areas Adequate market for primary Homeowner policies in the Beach and Coastal Areas “Market of last resort” Producers have binding authority. FAIR Plan/Beach Plan Variances NCJUA’s coverage areas consists of the entire state except for the barrier inlands NCIUA’s coverage area has two distinct areas— – Beach Area which is the barrier islands – Coastal Area which is the eighteen coastal counties NCJUA/NCIUA Departments Underwriting – – – – – – – Reviews new and continuation applications for Dwelling, Commercial, Crime, Farm, Windstorm and Hail and Homeowners Sets terms and conditions of policy—Coverage limits, deductibles, surcharges, exclusions, etc Utilizes Marshall & Swift /Boeckh cost estimator for risk valuation. Statues require that risk not be over–insured or under-insured Performs ongoing loss reviews and reunderwriting Order and review property inspection reports as needed. Processes policy endorsements Provides customer service for producers, insureds, mortgagees, etc. NCJUA/NCIUA Departments Continued Claims – – Personnel consist of one Claims Manager, six to eight In-office adjusters and one clerical staff member. Claims staff oversees independent claims adjusters – Claims Handling – experienced in handling hurricane and tropical storms claims very knowledgeable of Member companies and independent adjusting procedures has an additional 20 Association staff members pre-trained to assist the Claims Department in the event of a catastrophe Independent field adjusters are used to adjust NCJUA claims and “All Peril” NCIUA policies Member companies claims departments handle the adjustment of Wind/Hail policies Single Adjustor Program During catastrophes, adjustment of losses is handled through a single adjuster in full cooperation with FEMA. The FEMA staff are housed in Association facilities following a catastrophe. Intended to reduce potential conflicts when handling wind and/or flood losses. Available functions include: Annual premium rating (no prorating) Submission of endorsements and cancellation requests Producers can do policy inquiries On-line access to policy declarations Loss notices can be submitted Dynamic Web operation time is normally 7:00 am – 8:30 pm System problems should be reported to the Association’s automation department immediately upon notice. Producer Download Systems supported: AMS, Applied, Doris, Instar and Jenesis NCJUA/NCIUA Departments Continued Mail and Supply – – Incoming correspondence –received, sorted and distributed to various departments Outgoing correspondence – Newly issued policies Policy endorsements Certified Mailings Maintains supply stock for large printing needs and normal office needs Accounting – – – – – – Processes all premium payments/refunds and credit card transactions Processes all claims checks Handles all routine accounting needs associated with business operation Calculates producer commissions for tax reporting Monitors member company participation Prepares financial statements Underwriting Standards Physical Condition and Occupancy of Property Building and utilities must be maintained for active occupancy and so as to prevent general deterioration No unrepaired damages Good housekeeping and proper storage of flammable materials Should not be over-crowded Use of property should not be in violation of law or public policy Underwriting Standards Continued Vacant, Unoccupied or Under Renovations Properties vacant or unoccupied beyond 60 days are not generally eligible for coverage through the NCJUA Exceptions for possible considerations: 1) 2) 3) 4) 5) Estates Property Closings Rehabilitation or renovation normally allows up to 6 Months for completion & occupancy Temporary vacancy or unoccupancy (under contract for rental or sale) Historical properties Underwriting requirements for qualifying exceptions 1) Full details on application and expected occupancy date 2) Secured against unauthorized access 3) Historical properties requires historical preservation information Photos are required, especially of any existing deterioration or conditions Property cannot be open to trespass Must be in a progressive state of repair or renovation 1) With the exception of closings a 20 day waiting period applies to all vacant or unoccupied properties 2) Other than Historical properties unusual for Plan to continue beyond 1 year policy term Underwriting Standards Continued Ineligible Fire losses Two or more fires, each amounting to at least $500 or 1% of the insurance in force, whichever is greater, in a 12 month period or Three or more fires in a 24 month period provided the causes were within the owners’ control Other ineligible standards approved by Commissioner of Insurance Two or more of the following conditions: Delinquent real estate taxes – 1 year or more No heat or electricity beyond 30 days – within the control of insured Failure to correct conditions dangerous to life, health or safety within a reasonable time Or any of the following conditions: Outstanding order to vacate the premises due to physical condition of the building Ordered demolition Property declared unsafe Owner or occupant convicted or under indictment for incendiarism. 65% or more rental units unoccupied Unrepaired fire damage after reasonable repair period Indication of intent to abandon property Unexplained removal of salvageable materials Reliable information that building will be intentionally burned. Indictment or conviction of insurance fraud Underwriting Standards Continued Amount of Insurance Policy loss settlement provisions must be considered when evaluating the coverage limit. Replacement cost coverage requires coverage limits in line with the estimated cost to replace. Likewise, an Actual Cash Value policy should be written at an ACV limit. Broad Evidence Rule is used to determine the cash value to be paid out to the insured in the event of a claim. As opposed to using the traditional cash value (replacement cost minus depreciation), this rule can take into account such factors as the age of the property, its tax value and any possible profits the item may have accrued. Underwriting Standards Continued Amount of Insurance Continued Appeals Process – – Any applicant for insurance and any person insured under the Plan of Operation or any affected insurer may appeal in writing to the Board of Directors within fifteen (15) days after any final ruling, action or decision of the Association (other than a ruling, action or decision relating to the cause or amount of a claimed loss). – Any decision of the Board may be further appealed to the Commissioner within thirty (30) days. – Orders of the Commissioner shall be subject to judicial review. – We do recommend that before an appeal to the Board of Directors that you verify all available information has been forwarded to Underwriting. We rely on the servicing producer to help us fully assess the risk. Wind/Hail Only Coverage is underwritten by the essential carrier. Wind/Hail policies should be as concurrent as possible with the essential carrier. This includes policy period, coverage limits, deductibles, endorsements, etc. Hurricane Restrictions No new or increased coverage shall be bound or application for new or increased coverage accepted after 12:01A.M. the following day when the center of a designated named storm is located within Longitudes 65º West and 85º West, and Latitudes 20º North and 37º North. The term “designated named storm ” is a windstorm designated as a hurricane or tropical storm by the National Weather Service. House Bill 1305-Beach Plan Changes 1. Purpose was to stabilize Beach Plan growth which had increased exponentially due to rate inadequacy. 2. Name Changed to Coastal Property Insurance Pool 3. Established building maximumsa. Residential- $750,000 maximum and contents maximum of 40% of coverage A. b. Commercial maximum of $3,000,000 per location, subject to a $6,000,000 aggregate on multi-fire division buildings. c. Excess coverage required for the value property exceeding these maximums. 4. Rate Deviations---Established that NCIUA will surcharge the applicable NC Rate Bureau rates for Windstorm and Hail by 5% and Homeowners by 15%. 5. 1% Named Storm Deductibles required for Named Storm Wind and Hail losses 6. Mitigation Credits implemented (May 2011)---adopted three credits developed by the NC Rate Bureau a. Hip Roof b. Opening Protection Features c. IBHS Hurricane Fortified for Safer Living and IBHS Hurricane Fortified for Existing Homes House Bill 1305-Beach Plan Changes Continued 7. Installment Plan implemented (January 2011)--- offers two-payment and four-payment options 8. Retained Earnings--accumulated surplus will no longer be distributed to member companies a. Used to pay losses b. Reinsurance Cost c. Repaying debt d. Other expenses as necessary 9. Deficit Event a. Member assessment will be limited to $1billion per calendar year in the event that all available resources are usurped. b. NCIUA will notify the Commissioner of Insurance when all losses and expenses will exceed all resources (retained earnings, interest income from retained earnings, member assessments reinsurance, etc) c. NCJUA/NCIUA has a reinsurance plan in place. Extensive actuarial models are considered in determining reinsurance needs. NCJUA/NCIUA DYNAMIC WEB Requirements of the Dynamic Web Producers must be NCJUA/NCIUA certified for web use: 1) completing this course and providing Completion Certificate. 2) authorizing the Associations to draft “Accepted” policy premiums from their checking account by an Automated Clearing House (ACH). 3) New producers must submit a W9 tax form. Producers must review the Dynamic Web Instruction Manual. Dynamic Web User Agreement must be executed. Producers must agree to maintain a printed, signed application on file. Recertification is required on a rolling three-year basis. NCJUA/NCIUA DYNAMIC WEB Advantages of the Dynamic Web Use Producers will have access to the Associations’ rating system New business applications are entered in a Producer’s office and electronically submitted to the Association Change and cancellation requests submitted over the Dynamic Web Policy Inquiry for payment and claim status is available Claim Loss Notices submitted via the Dynamic Web Daily summary of ACH transfer is sent via email to Producer Access to on-line policy declarations Receive a higher commission than non-certified producers Insurance Products Offered NCJUA-FAIR Plan Dwelling Property 1) Basic – DP1, This is an Actual Cash Value (ACV) loss settlement contract. 2) Broad w/ ACV endorsement-DP2 with DP0476 (Photos required) 3) Broad – DP2, Provides Replacement Cost on building coverage. (Photos required) (a) Must be constructed within the past 20 years OR (b) Must have all building systems (roof, electrical, plumbing, heating ) updated within last 20 years. Commercial Property 1) Standard Property Policy CP 00 99 2) PF 1002 Optional Perils for Broad Form Coverage (same requirements as 3)(a)or (b) above) Crime Coverage—Residential or Commercial Farm Coverage NO LIABILITY is provided on any FAIR Plan policy NCIUA-Beach Plan (photos required) Dwelling Property, Commercial Property, Crime Coverage—same as FAIR Plan but limited to property in “Beach area” Barrier Islands. Enter your Producer and Authorization Codes. Authorization Codes are activated by the Associations after the usage agreement has been executed. NCJUA/NCIUA DYNAMIC WEB The Main Menu directs you to several options. NCJUA/NCIUA DYNAMIC WEB All applications are available to submit except Specific Rated Commercial, Commercial Crime, Farm Coverage and Primary Excess coverage. NCJUA/NCIUA DYNAMIC WEB Consider your risk and choose the appropriate application /Plan Dwelling---Fair or Beach? Google maps help as some areas can be both FAIR and Beach risks. (Holden Beach, Ocean Isle Beach, Surf City and Sunset Beach) Wind/Hail---Is essential a Dwelling, Homeowners or Commercial Form? W/H form MUST match the essential form. Homeowner---Do you need full peril or wind only? Is risk a primary residence? Consider your Dwelling risk and choose the appropriate form and perils Most dwellings are written as DP1- Fire, EC and VMM—ACV coverage and limits Vacant properties are written as DP1-Fire and EC, no VMM—also, $1000 deductible. A surcharge will be added by the underwriter which is not rated by the web and a 20-day wait is required. DP2-RC require homes be 20 years or newer, or have had verifiable updates to heating, electrical, plumbing, and roof. Photos are required. DP2-ACV provides Board perils coverage at ACV loss settlement. Premium is based on the Replacement Cost of risk. Photos are required. NCJUA/NCIUA DYNAMIC WEB Entering a New FAIR Plan Application Fields are 30 characters in length. Do not use punctuation. If a business name, use the last name for entry. Make appropriate selection from Applicant is drop down menu. Depending on your selection for Applicant is, your coverage selection screen, which is shown later, will have different data box views. It will not allow entry at any other time. Always use navigation buttons at the bottom of the screen, and not the Back and Forward arrows on browser. NCJUA/NCIUA DYNAMIC WEB Always abbreviate street names (i.e. Street=St, Place=Pl, Avenue=Ave, etc.). CONFIRM YOU HAVE THE CORRECT LOCATION! This screen refreshes several times as you load County and make your Fire District selections. The Territory and Protection Class are calculated automatically by your selections and you cannot over-ride. NCJUA/NCIUA DYNAMIC WEB Make Occupancy selection. Enter year built YYYY. Enter square footage. If vacant or 50% or less occupied, a Vacancy Questionnaire will appear. NCJUA/NCIUA DYNAMIC WEB If Mortgagee name does not run onto second line, do not start address until the third line. All name and address fields are 30 characters in length. Do not use Punctuation. This screen changes based on type of policy previously selected under “Applicant is”: Owner Occupant/Nonoccupant – Renter – Personal Property Limit only. Condo Owner Occupant/Non-occupant – – Building Limit and Personal Property Limit. Condo Unit Owners Limit. Personal Property Limit. Tenant Occupied will require Monthly Rental Income, and this box will appear. NCJUA/NCIUA DYNAMIC WEB If an Optional Endorsement(s) is desired, make selections on this screen. You may scroll through screen if None. NCJUA/NCIUA DYNAMIC WEB Underwriting Questions are all defaulted, and you need to make the appropriate selections. If you change an answer, the section will highlight and you will need to enter additional data. Mortgagee Question will not let you enter data unless there is a mortgagee on the application. Review all questions with the applicant in this section. Both applicant and producer must sign acknowledging the accuracy of the application. NCJUA/NCIUA DYNAMIC WEB Attach photos in this section. You may also attach a scanned file in this section such as an appraisal or cost estimator. Enter any comments that should be taken into consideration when reviewing the application. NCJUA/NCIUA DYNAMIC WEB The applicant must review and agree to the Applicant Authorization. The producer must review and agree to the Producer Authorization. The Authorization Code must be entered again as validation. You may now: – – – – – Submit the Application for premium quote. Go to Previous screen. Print Application. Save and Return to Main Menu. Cancel and Return to Main Menu. NCJUA/NCIUA DYNAMIC WEB “Submit” will provide a premium estimate/quote. If Accept is selected at this point, ACH occurs and policy is transmitted. Do not select Accept unless you have the funds. If you would like to now Save, click Previous. You can Print Application, which will now include the quote. You can Save and Return to Main Menu or any of the other selections. FAIR Plan deducts Net Premium and Beach Plan deducts Gross Premium. NCJUA/NCIUA DYNAMIC WEB Switching to Beach Plan briefly to illustrate the payment options screen. Beach Plan drafts gross premium. 2-payments or 4-payments are available ONLY in the Beach Plan (subject to eligibility rules) NCJUA/NCIUA DYNAMIC WEB “Accept” will transmit the application to the Associations. A policy number is provided. Print Application will now include the premium and the policy number. Signed application is to be retained in the Producer’s Office. There are minor differences between all of the applications, but they all work in the same manner. NCJUA/NCIUA DYNAMIC WEB Commercial Differences Effective Date for FAIR Plan has the 20 day wait and cannot be overridden. You make your coverage selections. The screen changes based on the type of Occupancy, and you may or may not see all selections. NCJUA/NCIUA DYNAMIC WEB Commercial Classification is made for the drop down menu. We only support Class rating at this time on the web. Specific rating must be submitted via paper application. If you have a Miscellaneous Structure, you may select this button and you will get selections and data boxes to complete. Application follows pretty much the same other than this difference. NCJUA/NCIUA DYNAMIC WEB Retrieving a Saved Application Applications can be saved for up to 30 days and retrieved to edit or submit for final consumer acceptance. The 30 days begins from the last time a file was edited. - Break Please return in 10 minutes NCJUA/NCIUA DYNAMIC WEB NCJUA/NCIUA DYNAMIC WEB Policy Inquiry is available from the Main Menu Enter the last six or eight digits of the policy number. For example DW1123123 is 123123 or HW452344400 is 52344400. Location Information is provided. Policy Premium and Status are provided. Payment Information also is shown. Links to view Claim Information and on-line policy declarations and forms are available. Note: Policy number sequence uses two letters (policy type) and a digit (first number) for internal use. NCJUA/NCIUA DYNAMIC WEB Policy Inquiry also includes a claim summary for policyholder. Select the Claim from the drop down selection and the information will appear. If you have another policy to review, you can use the Back button on your browser to go back and reenter a new policy number. This is one of the only places where this is possible. NCJUA/NCIUA DYNAMIC WEB Policy Loss Notice Again, enter either the last six digits or eight digits, dropping the first three characters. Select Go. Insured information returns for your confirmation. Complete required fields and transmit loss notice to Associations. Contact Information is only required if contact other than policyholder is selected. NCJUA/NCIUA DYNAMIC WEB Select the Location to enter the loss and click on Enter Losses. Select the Building from the location. Select the type of Loss from menu. NCJUA/NCIUA DYNAMIC WEB Complete the rest of the form. You may print with the Print button that is now on screen. Complete and Submit. You can check on Inquiry the next day to see assignment. NCJUA/NCIUA DYNAMIC WEB Application for Policy Change Enter the last six or eight digits of the policy number (dropping the first three characters) and select go. Policy confirmation is returned. Select Location to Change. Select Building to Change. Indicate the Change either in boxes provided or comments. NCJUA/NCIUA DYNAMIC WEB You may also amend the Mortgagee Information. This feature is not interactive and will not provide a quote. This feature eliminates mailing time to the Associations as well as postage. Supporting photos and documents can be attached. Producers are encouraged to make use of this feature whenever possible for any endorsement. You may print the information prior to submitting. Enter your Authorization code to validate. You will receive immediate confirmation of receipt. NCJUA/NCIUA DYNAMIC WEB Adding a location to an existing policy **Requires submission of new application with photographs** Web Options The web can be used to generate the new application. (Be sure not to hit “Accept”!) The application can be printed, scanned and attached as a document under the existing policy. Be sure to submit a change requesting the location be added and photos. Manual Options The web can be used to generate the new application. (Be sure not to hit “Accept”!) The application can be printed and mailed to the Association along with photos. Write “Endorsement” in the top margin and provide the existing policy number. NCJUA/NCIUA DYNAMIC WEB Application for Cancellation Enter the last six or eight digits of the policy number (dropping the first three characters) and select go. Policy confirmation is returned. Complete the appropriate date, reason, and remarks. Any cancellation dates request over 30 days prior to the submission date will require supporting documentation. Example, if the property was sold, a copy of the settlement papers should be attached via the web. NCJUA/NCIUA DYNAMIC WEB A Print button has been added to this page, and you may print the information prior to submitting. Enter your Authorization code to validate. You will receive immediate confirmation of receipt. Signed cancellation should be retained on file in the producer’s office. NCJUA/NCIUA DYNAMIC WEB ITEMS TO REMEMBER The Web is available from 7 am to 8:30 pm Monday – Friday including Holidays unless posted. A fifteen minute idle will log you off system, so make sure you save your data. Always abbreviate Street, Circle, Place, Avenue, etc to St, Pl, and Ave Do not use punctuation in Data or Limits in any place during the application process. This includes: !, @, #, $, %, *, , . / ‘ “ ; : If you chose to enter these characters, you will have data problems. The only exception is “&” which does work in the Mortgagee Section. Data fields for all names and addresses are 30 characters in length. Do not use the Back and Forward buttons on your browser; utilize the Previous and Next navigation buttons on the screen. Choosing “Submit” provides a quote only and does not upload the application. Choosing “Accept” will upload the application and start the draft process. If you Accept in error, contact us immediately. NCJUA/NCIUA DYNAMIC WEB ITEMS TO REMEMBER-Continued Premiums are estimates, not binding quotations. FAIR Plan, Crime, and All Commercial draft net premium as they are “Producer Billed”. Beach Plan Dwelling, Homeowner, and Wind draft gross premium as they are “Direct Billed”. All questionnaires will appear if required based on your selections.
