Vote For Promoters of The Year
It’s been a busy couple of
months with Workshops prep and
the trip to Reno, so we have some
catching up to do. Most
important, just after RPM went to
press in Late October, Specialty
Tires of America, and its
subsidiary Race Tires America,
elected not to appeal to the U.S.
Supreme Court, the decision of the
Court of Appeals for Third Circuit
of Western Pennsylvania, thus,
ending the firms’ litigation against
Hoosier Racing Tire and World
Racing Group. Readers will recall
as reported in these pages that in
2009, Federal Judge Terrence
McVeery dismissed on summary
judgement the suit brought in
2007 by Race Tires America
against Hoosier Racing Tire and
the World Racing Group of
Charlotte, NC aka DIRTcar Racing
that contended that Hoosier’s
contracts with tracks and
sanctioning groups violated U.S.
Antitrust laws. Specialty Tire
appealed McVeery’s 2009 decision
last summer, but the appeals court
affirmed McVeery’s dismissal
August 18, 2010. The Third
Circuit’s decision underscores the
right of promoters and
sanctioning groups to enter
exclusive contracts. The court
wrote in its July 2010 opinion that,
“The Sherman Act does not forbid
sanctioning bodies and other
sports-related organizations from
freely (i.e., without any coercion
or improper interference)
adopting exclusive equipment
requirements, so long as such
organizations otherwise possess,
in good faith, sufficient procompetitive or business
justifications for their actions.”
The conclusion of the
litigation with a positive result is a
clear victory for promoters,
sanctioning organizations, and
short track racing overall as well
as other sports. As we reported in

circumstances. Among them is the public
face of the Nuckles family, our current
Promoters of the Year. The family, for more
than 62 years operators of the NASCARsanctioned Columbus Motor Speedway,
waited through eight regional nominations
before becoming the 34th Auto Racing
Promoters of the Year. It was an emotional
moment when JEFFREY NUCKLES motored
his power chair to our stage in Hilton
Daytona Beach last February. For those not
familiar with Jeffrey, he is a quadriplegic
since a 1984 summer night at Eldora
Speedway when he wrecked a midget. In
the 26 years since, Jeffrey, has overcome
more challenges than we can imagine,
raising his family, and playing a key role in
the success of the paved 3/8-mile oval.
Mindful of his reliance on others,he credits
his brothers, his late mother, father, and
extended family, for the track’s success,
saying he is but a member of the team. He
also notes his appreciation of his bride
Cindy, who through fortunate happenstance
is a nurse by training, as well as wife and
mother of their children.
We occasionally lose track of how
much the Auto Racing Promoter of the Year
award means to recipients, until reminded
onstage. We’ve seen huge egos humbled,
loquacious promoters speechless and battlehardened men mist up as they receive the
award. When his family’s time came last
February, Jeffrey carried the moment with
humility, class, and barely perceptible

established a “bright line,” a ruling intended
to protect promoters, sanctioning groups,
and other sports governing bodies from
unnecessary lawsuits. The Court's ruling
says that sanctioning bodies can legally
enter exclusive contracts where they have in
good faith “freely adopted their own
equipment rules and then freely entered
into exclusive contracts with the respective
suppliers.” It also noted that the evidence
supported the sanctioning bodies’ good
faith belief that single-tire rules benefit
racers and motorsports generally, including
by promoting parity among racers,
increasing safety, and controlling overall
costs.
The court’s ruling was intended to
make possible predictable and consistent
legal results, reducing the burden on courts
to hear cases and to minimize the risk to
businesses and individuals from suits. The
widely encompassing ruling will help the
governing bodies of sports of all types, not
just racing.

We knew this series would be different.
Jeffrey would not be with us in Reno, the
logistics of travel just prohibitive. We looked
toward Speedweek with great anticipation,
only to learn early last August he was
experiencing medical problems with a
stubborn pressure sore. His struggle with the
nemesis of any paralyzed person continues
as this is written with skin grafts recently to
heal his sore. He is optimistic he will attend
Speedweek events. He is uncomfortable
because he could not come to Reno, worried
it makes his family appear unappreciative of
the honor bestowed on them. But, we
assured him of the industry’s admiration for
him and for his family’s accomplishments,
and most important that everyone
appreciates the fact that such a condition as
his cannot be trifled with.
Occasioned by this month’s ballot, we
share this story and invite readers to send
him get well messages. He’s determined to
be with us in Daytona, it will be a great day
indeed. We look forward to welcoming him
back to the Hilton and the 38th Workshops

The nominees, top vote getters from among over 100
different short tracks in 41 states, are a who’s who of
next-gen promotional talent. We look forward to
introducing three to the national stage for the first
time in Daytona Beach, and to welcoming two others
who have a decade under their belts off the national
radar.
New York Southern Tier track operator. Harpell’s 60year-old dirt track near Binghampton, NY, has been in
continuous family operation since its construction in
1950, with Harpell in charge since 2003. Harpell is
admired not only for his New York Southern Tier
weekly racing but also his two touring series: the
eleven race Race Of Champions Asphalt Modified Tour

The nominees’ experience ranges from six years
to over 51 years. One is affiliated with NASCAR for
weekly racing, one with ASA, one co-sanctions with
WISSOTA/USRA, and three operate independently. The
length of the nominees’ track’s: three are 3/8-mile
ovals, two are 1/4-mile ovals, and one is a 1/2-mile
oval. Three are paved; three are dirt. The six Regional
Promoters of the Year and nominees for Thirty-Fifth
Auto Racing Promoter of the Year are:
